Brain death has been accepted worldwide medically and legally as the biological state of death of the organism. Nevertheless, the literature has described persistent problems with this acceptance ever since brain death was described. Many of these problems are not widely known or properly understood by much of the medical community. Here we aim to clarify these issues, based on the two intractable problems in the brain death debates. First, the metaphysical problem: there is no reason that withstands critical scrutiny (...) to believe that BD is the state of biological death of the human organism. Second, the epistemic problem: there is no way currently to diagnose the state of BD, the irreversible loss of all brain functions, using clinical tests and ancillary tests, given potential confounders to testing. We discuss these problems and their main objections and conclude that these problems are intractable in that there has been no acceptable solution offered other than bare assertions of an ‘operational definition’ of death. We present possible ways to move forward that accept both the metaphysical problem - that BD is not biological death of the human organism - and the epistemic problem - that as currently diagnosed, BD is a devastating neurological state where recovery of sentience is very unlikely, but not a confirmed state of irreversible loss of all [critical] brain functions. We argue that the best solution is to abandon the dead donor rule, thus allowing vital organ donation from patients currently diagnosed as BD, assuming appropriate changes are made to the consent process and to laws about killing. What role do nurses play in euthanasia? How do they experience this role and what should be their ideal role? These are the questions of a study undertaken to gain insight into the role of nurses in euthanasia. Answers to these questions were derived from 20 semistructured in-depth interviews with nurses employed in a Dutch hospital. To make clear the role of nurses in euthanasia, the issue was split up into four phases: observation of a request for euthanasia; decision making; (...) carrying out of the request; and after-care. This article is a brief report on the most important results regarding these four phases. Special attention will be paid to nurses who have conscientious objections. To evaluate the study results, an unambiguous interpretation of the concept of ‘euthanasia’ is of most importance. For that reason, Dutch laws and other regulations concerning euthanasia will be explained. (shrink)

Ce deuxième tome des Hommes de la fraternité s'achève avec le règne de Constantin et le concile de Nicée (325). Les quelques deux cent cinquante évêques qui participent à ce concile dit " œcuménique " représentent bien mal, par leur provenance, ce qu'on appelait alors l'oïkouméné (l'ensemble des terres habitées). Mais le concile est présidé par l'empereur, et une ère nouvelle commence pour les chrétiens au sein de l'Empire. Ils sont si bien traités par le prince, ces évêques conciliaires, qu'ils (...) " se demandent s'ils ne sont pas déjà dans le Royaume de Dieu ". Il semble loin le temps de l'épître à Diognète (vers 195) qui parlait des chrétiens en ces termes : " toute terre étrangère leur est une patrie, toute patrie une terre étrangère. " avec Constantin s'inaugure ce qu'on appellera plus tard l'alliance du trône et de l'autel. Ce deuxième tome est celui d'un tournant décisif pour la suite de l'histoire. Mais l'historien qu'est Michel Clévenot se garde bien d'illustrer une thèse, fût-elle éclairante. Il donne au contraire à voir et à entendre la diversité des situations aux quatre coins de l'Empire et au sein des classes sociales si peu homogènes : le lecteur fait connaissance avec le " directeur de conscience " de la bourgeoisie d'Alexandrie, mais il visite aussi les petits agriculteurs d'Italie, d'Afrique du Nord ou des bords du Nil. Les querelles commerciales, les tensions économiques, les controverses théologiques, les affrontements politiques et guerriers, rien de tout cela n'est négligeable pour celui qui entend " l'appel de Jésus à ne pas déserter l'Histoire ". This article reports the findings of a study into the role of Dutch nurses in the alleviation of pain and symptoms with a life-shortening intention, conducted as part of a study into the role of nurses in medical end-of-life decisions. A questionnaire survey was carried out using a population of 1509 nurses who were employed in hospitals, home care organizations and nursing homes. The response rate was 82.0%; 78.1% were suitable for analysis. The results show that in about half of (...) the cases nurses were involved in the decision making by the physician and that nurses were frequently involved in administering the medication. The authors' conclusion is that alleviation of pain and symptoms with a life-shortening intention represents a `grey' area, in which physicians and nurses act on the basis of personal ethical norms rather than legal rules, professional guidelines or shared moral values. What, if anything remains of religion after the demise of traditional theism and the theologies based upon it? What are the consequences of so-called Post-theism for the modern scholarly study of religion (in Religionswissenschaft and philosophical theology or church dogmatics, in the philosophy of religion as well as in the more recent phenomenon of comparitive religious studies)? This volume collects some thirty articles written in honor of Professor Hendrik Johan Adriaanse whose intellectual trajectory, recounted here in extensive personal reflections, has (...) lead to an incisive inquiry into the possibilities of thinking and experiencing "After Theism" (the title of a fundamental article reprinted here). Post-theism : Refraiming the Judeo-Christian Tradition raises this question from three different perspectives : first, by spelling out the historical and intellectual backgrounds that have led to the supposed end of theism as it had been known through the ages; secondly, by discussing the systematic relationship between the disciplines of theology and competing concepts of rationality; and, thirdly, by sketching out the contours of a philosophical thought that ventures beyond the most tenacious classical and modern presuppositions of theism. Along the way, the contributors explore a variety of ways in which the concepts and arguments, imagery and rhetoric of the Judeo-Christian traditions are in need and in the process of being constantly displaced. Molendijk and Hent de Vries teach Philosophy, the history of Christianity, and Metaphysics, respectively, at the Erasmus University, The University of Groningen, and the University of Amsterdam. Benedito Nunes, aclamado filósofo e crítico literário, guarda em sua biografia um período de formação jurídica na Faculdade de Direito do Pará, entre os anos de 1948 e 1952. Este é um dado que normalmente fica isolado na observação de sua trajetória, sobretudo em relação aos aspectos intelectuais da formação jurídica, fator que pode permitir uma maior compreensão sobre a construção do pensamento do filósofo. Diante dessa percepção, o presente trabalho tem como objetivo analisar a formação jurídico-filosófica propiciada pela Faculdade (...) de Direito do Pará ao estudante Benedito Nunes, dando ênfase aos estudos realizados em “Introdução à Ciência do Direito”, disciplina ministrada pelo professor Daniel Coelho de Souza. Para tanto, utiliza-se como base os dossiês acadêmicos albergados pelo Arquivo da atual Faculdade de Direito da Universidade Federal do Pará (UFPA) e demais fontes que auxiliam o trabalho a partir da perspectiva da História Intelectual. Em conclusão, nota-se que a Faculdadem de Direito do Pará foi um ambiente que contribuiu para a formação da visão de mundo de seus bacharéis, em especial de Benedito Nunes, por meio da formação filosófica rica em temas de Teoria do Conhecimento, abrindo possibilidades para um pensamento universal. Este artigo faz parte de uma investigação em andamento, na qual exploramos a leitura de arendtiana do Agostinho de Hipona, partindo da obra inicial, El concepto de amor en San Agustín (2001). Consideramos que a investigação da dissertação doutoral, obra tão pouco explorada pelos seus mais relevantes interpretes, pode brindarmos novas chaves de leitura da teoria política de Hannah Arendt, tornando mais complexo nossa abordagem na sua leitura heterodoxa da tradição do pensamento (...) filosófico. Segundo nossa hipótese é a tese doutoral de 1929, onde a dimensão política do problema num sentido amplo começa a emergir, a partir da questão do que é especificamente humano, sempre sujeito à constante tensão entre um “não mais” e um “ainda não” (Arendt, 2001: 311; Agustín, 2005: XI, 21,27). Somente em posteriores trabalhos a leitura da fonte agostiniana –focada cada vez mais nas Confesiones (2005) y na Ciudad de Dios (1958) fica articulada explicitamente com a elaboração da trama mais conhecida da fenomenologia da ação política; na qual numerosos e importantes interpretes tenham situado o giro embora da política da aluna do Heidegger e Jaspers (Young Bruehl, 2006; Canovan, 2002; Benhabib, 2000; Forti, 2001). Embora essas autoras reconheçam a formação inicial e sua influencia sobre a filósofa Arendt, em geral, todas elas acentuam a ruptura com todo o seu escopo de formação universitária em filosofia e teologia. The phenomenological method he defended is basically a hermeneutical approach in which an observer relates personally and even existentially to the “phenomena” (s)he studies in order to determine their essence (Wesensschau). In his anthropology (that reflects on the basic structure of human beings) a similar way of relating to the world is discussed: the “primitive mentality” that is characterized by the “need to participate” (besoin de participation). Both phenomenology (...) and mentalité primitive imply a critique of modern scholarship. This fundamental criticism of the prevailing (historical) approach in the humanities including religious studies explains the growing distance between van der Leeuw and the majority of scholars of religion in the decades after his death in 1950. Trabajando sobre el género de ¿Historias de los Profetas¿ (Qis.as. al-Anbiya-¿) en el proceso de elaboración de mi tesis sobre Abraham en la literatura islámica, el profesor J. Sadan me envió un manuscrito que había localizado en la British Library relacionado con este género. Posteriormente encontré versiones similares de la misma composición, lo que me animó a profundizar mi investigación sobre sus orígenes. La obra está próxima a la literatura de predicación (wa¿z.), que se ocupa principalmente de la educación moral, (...) pero también incluye historias. Me planteé la posibilidad de que éste formarse un género que hubiera surgido como una ayuda, un material auxiliar concebido para entender la tradición oral y los estudios religiosos para, posteriormente, convertirse en un género independiente, más cercano a la Parénesis o al Specula Regis (Espejos de príncipes). Describiré el manuscrito para intentar alcanzar una conclusión sobre ciertas cuestiones: ¿es éste un género literario diferente?, ¿se trata de un género educativo o solamente es una versión simplificada de historias para ilustrar a niños o principiantes de la lengua árabe?, ¿buscaría el autor un nombre original para su compilación, haciendo referencia al reducido tamaño de la colección y descartando el de Qis.as. al-Anbiya-¿ por ser conocido? It is shown that the coherence of de re belief ascriptions is doubtful in view of certain plausible principles. Subsequently, it is argued, the standard argument against substitutivity in de dicto ascriptions loses some of its power. Also, some possible reactions to these results are considered.

I show how a de se belief ascription such as "Privatus believes that he himself is rich" may be dealt with by means of a scope distinction over and above that one separating de dicto and de re ascriptions. The idea is, roughly, that 'Privatus...himself' forms in this statement a unity, a single "spread" sign that is at the same time in a de re and de dicto position. If so, H-N. Castañeda's contention that the "quasi-indicator" 'he himself' ('she herself', (...) 'it itself') belongs to a "unique, irreducible logical category" of singular terms is, at best, misleading. Further, my account is superior to the well-known theories of R. Chisholm and D. Le rapport de Hegel au judaïsme a tant varié selon les périodes et les textes que Karl Rosenkranz, le premier biographe du philosophe, a pu qualifier ce rapport de « sombre énigme ». Si, assurément, l’énigme s’éclaircit par la mise en relief du basculement des points de vue (rationaliste du XVIII? siècle, romantique, dialectique) à partir desquels s’ouvrent les interprétations hégéliennes, reste une tension, peut-être non entièrement réductible, entre un discours souvent anti-judaïque d’un côté et une position philosophicopolitique très nettement (...) anti-antisémite de l’autre. The purpose of this article is to show how Spinoza’s conception of history could lead to a new formulation of the theory of democracy, in the context of Spinoza’s political philosophy. In this perspective, the analysis deals with the relations between historicity, on the one hand, and the notions of multitude and democracy, on the other, in the topic of Spinoza’s political thought. Into the horizon of historicity, the multitude’s (or the masses’) political activity could lead to the realisation of (...) a sustainable democratic regime. (shrink)

The question of whether relics which were part of the historical body of Jesus could exist, arose in the first decades of the 12th century, as the monks of St. Medard des Soissons claimed to have a tooth of Jesus. Based on historical and theological reasoning it seemed to Guibert of Nogent impossible that this kind of relic could exist or that they could mediate the redemption which Christ attained on the Cross. According to him, the prize of salvation could (...) only be mediated through the eucharist. Guibert perceived a twofold mediality of the eucharist which at the same time reprents the holy body of Christ and mediates salvation. This medial dimension of the eucharist is denoted with the term figura. Since the Second Eucharist Debate and as a result of the criticism of Berengar of Tours the term figura became precarious. The discussion between Berengar and his opponents such as Durandus of Troarn, Guitmund of Adversa, Alger of Liège about the term figura can be viewed as a debate concerning mediality. (shrink)

Even the critics of Dutch Reformed theologian, politician, and publicist Abraham Kuyper acknowledge his great power of oratory. This essay examines the nature of Kuyper's rhetoric in a mythopoetic perspective that sees its inspiration in a romantic understanding of artistic inspiration and vivid representations of reality. Long-term editor of De Standaard, Kuyper's stalwart defence of Calvinism against Modernism drew from the struggles of Dutch history and from his personal history to espouse strong views that are couched in military as well (...) as organic metaphors. His mastery of the psychology of mass communication enabled Kuyper to accomplish many, though not all, of his political goals. (shrink)

Zusammenfassung Das Thema dieses Aufsatzes ist die Art und Weise, in der Religion auf der Weltausstellung 1883 in Amsterdam repräsentiert wurde. Zuerst wird die facettenreiche Komplexität der Weltausstellungen umrissen, um dann den Aufbau der Amsterdamer Kolonial- und Exportausstellung zu beschreiben. Solche Ausstellungen waren heterogene Mischungen aus Erbauung und Unterhaltung, aus nationalem Stolz und internationaler Verbundenheit, aus Bewunderung für die Handarbeit der kolonialen Bevölkerung und westlichem Superioritätsbewußtsein. Die religiöse Dimension der Amsterdamer Ausstellung wird dann besonders anhand der Auseinandersetzungen über den – (...) arabischislamischen – Stil des niederländischen Kolonialgebäudes und an der Art und Weise, in der hier religiöse Objekte der Kolonialvölker zur Schau gestellt wurden, gezeigt. Besondere Aufmerksamkeit gilt weiter der ethnographischen Sektion und den begleitenden wissenschaftlichen Konferenzen. Zum Beispiel begrüßte die Tagung der Orientalisten ohne zu zögern die Eroberung der Kolonien ‘au profit de la science’. Zum Schluß wird – in Anlehnung an das von Michel Foucault geprägte Konzept des Heterotopia – die komplexe Beziehung zwischen Repräsentation und ‘abgebildeter’ Wirklichkeit erkundet. Religion ist nicht an einem bestimmten Ort lokalisiert, sondern “durchdringt” sozusagen das diffuse Ganze der Weltausstellung als solcher. (shrink)
