While justifications are used frequently by young children in their everyday interactions, their use has not been examined to any great extent. This article examines the interactional phenomenon of justification used by young children as they manage social organization of their peer group in an early childhood classroom. The methodological approaches of conversation analysis and membership categorization analysis were used to analyse video-recorded and transcribed interactions of young children in a preparatory classroom in a primary school in Australia. The focus (...) is an episode that occurred within the play area of the classroom and involved a dispute of ownership relating to a small, wooden plank. Justifications were frequent occurrences as the young participants drew upon justificatory devices to support their stances. The justifications related to the concepts of ownership and were used by those engaged in the particular dispute to support their positions and provide reasons for their actions. Four types of justificatory responses using child-constructed rules are highlighted. They are: justification based on the rule of transferred ownership; the rule of first possession; rules associated with custodianship; and the rule of third-party verification. The justifications are practices that work to build and reinforce individual children's status within the group, which in turn contributes to the social order of the classroom. (shrink)

Spontaneous play, important for forming the basis of friendships and peer relations, is a complex activity involving the management and production of talk-in-interaction. This article focuses on the intricacies of social interaction, emphasizing the link between alignment and affiliation, and the range and importance of verbal and nonverbal interactive devices available to children. Analysis of the way in which two girls, one of whom has been diagnosed with Asperger’s Syndrome, engage in spontaneous activities demonstrates the potential for interactional difficulty due (...) to the unscripted nature of the interaction. The article argues for further research into how improvised, unscripted interactions are initiated within moment-by-moment talk, how they unfold, and how they are brought to a close in everyday contexts in order to understand how children create their social worlds. The number of people diagnosed with autism has risen exponentially in recent years. Are the diagnostic labels currently in use adequate to describe such a vast range of symptoms? Should we reconsider the appropriateness of the language we use to discuss autism? A mother of two autistic sons describes what the autism label has meant for her and her family.

G. E. Moore opined that the paradox of analysis might be avoided if it could be shown that sentences expressing conceptual analyses convey information not only about concepts, but also about the expressions they use. If so, “to be a brother is to be a male sibling” and “to be a brother is to be a brother” might express the same proposition, and yet not be identical in information value as the paradox suggests. How sentences might do this, (...) class='Hi'>Moore could not see. Many philosophers have pointed out an obvious way in which sentences might be said to convey information about the expressions they use. Some have suggested this information might be used to develop Moore's intuition and resolve the paradox of analysis. I argue that this approach fails. I present a version of the paradox of analysis that resists this sort of solution. (shrink)

This paper examines how Charlotte Brontë's belief in phrenology influences the narration of her novel Jane Eyre. Phrenology was a nineteenth-century belief that the shape of the skull could give information about a person's temperament. Phrenologists speculated that the brain was split into separate parts, or faculties, that defined the individual's ability to feel a particular emotion. A bump on the skull implied that the faculty underneath that part of the skull was bigger, so the individual was more inclined (...) to feel that emotion. By placing Jane Eyre within the historical context of the rise of phrenology, I explore the ways in which Brontë's phrenological representation of Jane's mind informs and parallels the autodiegetic narration of Jane Eyre. My analysis focuses on moments when Jane draws attention to the fact that she is a first-person narrator telling the story of her own past experiences. I argue that these moments are comparable to those when Jane’s experiencing-self is fractured into phrenological faculties. Concomitantly, I seek to trace how Jane's narration changes as she moves between the locations of Thornfield, the Moor House, and Ferndean. I suggest that the shifts in narration draw attention to these locations as metaphors for varying degrees of restriction on Jane's faculties. Through an application of nineteenth-century psychological studies, I conclude that Brontë uses her narration style to criticize phrenologists who promote an unnaturally restrictive control of the faculties. It may seem odd to review a New York social club's yearbook, with its list of members’ addresses and series of committee reports. But such books sometimes contain material of more general interest. The latest one from the Century Association, for example, devotes 250 of its 685 pages to “Century Memorials”—that is, biographical sketches of recently deceased members, written by other members. Among the well-known figures taken up in these eighty-three sketches are the artists Richard Anuszkiewicz and Robert Motherwell; the (...) architects Henry N. Cobb and Charles A. Platt; the newspaper editors Harold Evans and Whitelaw Reid; the historians Henry F. Graff and William McFeely; the translator and literary scholar Donald Keene; the collector of literary and musical manuscripts Frederick Koch; the popular writer on Russian history Robert K. Massie; the clergyman James Parks Morton; the financier Felix G. Rohatyn; the lawyers Whitney North Seymour Jr. and Isaac N. Phelps Stokes; the literary editor Elisabeth Sifton; the university president Michael Sovern; the museum director Evan H. Turner; and the broadcast journalist Sander Vanocur. The sketches are generally well written and often richly evocative: the writers include Louis Begley, Kenneth T. Jackson, D. T. Max, and Honor Moore.The long shelf of Century volumes like this one clearly constitutes a valuable contribution to prosopographical literature. And the Century is not the only institution with such a tradition (other examples are the British Academy and the American Philosophical Society); but their publications are a frequently overlooked source, one not always available in research libraries. Unfortunately, it is also a source that seems to be diminishing: the American Antiquarian Society and the John Simon Guggenheim Memorial Foundation are examples of organizations, each with a history of providing biographical information, that are no longer doing so. Of course, the great previous runs of the former's Proceedings and the latter's Reports remain (one hopes) on the shelves for those who know to look for them. A step in the opposite direction has recently been taken by the Grolier Club, which has not had such a tradition (except for two biographical volumes in 1959 and 2000): its Gazette now includes a section of memorials in each issue. This is a welcome move, but one has to regret that so little scholarly use is made of this whole body of biographical detail and reminiscence. (shrink)

In this paper the author attempts to reconcile two claims recently defended by Mitchell Green. The first is that illocutionary force is part of speaker meaning. The second is that illocutionary force is a product of cultural evolution. Consistent with the second claim, the author argues that some utterances – particularly those produced by infants and great apes – are produced with communicative intent, but without illocutionary force. These utterances lack the normative properties constitutive of force because their utterers have (...) no grasp of the norms that operate on developed speech. If there can be utterances produced with communicative intent that lack force, we must consider how exactly force is a part of speaker meaning. In response the author argues that force is an inessential and acquired part of speaker meaning. As a result we need a conception of communicative intent more basic than illocutionary intent. He spells this out in terms of a ‘perlocutionary’ intention. (shrink)

In this paper the problematic nature of the morality of management, in particular related to business organisations operating under Anglo-American capitalism, is explored. MacIntyre’s critique of managers in After Virtue serves as the starting point but this critique is itself subjected to analysis leading to a more balanced and contemporary view of the morality of management than MacIntyre provides. Paradoxically perhaps, MacIntyre’s own virtues-goods-practice-institution schema is shown to provide a way of re-imagining business organisations and management and thereby holds out (...) the possibility of resolving the issue of the morality of management within such organisations. In print for the first time in over ten years, Act and Crime provides a unified account of the theory of action presupposed by both Anglo-American criminal law and the morality that underlies it. The book defends the view that human actions are always volitionally caused bodily movements and nothing else. The theory is used to illuminate three major problems in the drafting and the interpretation of criminal codes: 1) what the voluntary act requirement both does and should require; 2) (...) what complex descriptions of actions prohibited by criminal codes both do and should require ; and 3) when two actions are 'the same' for purposes of assessing whether multiple prosecutions and multiple punishments are warranted. The book both contributes to the development of a coherent theory of action in philosophy, and it provides both legislators and judges a grounding in three of the most basic elements of criminal liability. Bodily privacy, understood as a right to control access to one’s body, capacities, and powers, is one of our most cherished rights − a right enshrined in law and notions of common morality. Informational privacy, on the other hand, has yet to attain such a loftily status. As rational project pursuers, who operate and flourish in a world of material objects it is our ability control patterns of association and disassociation with our fellows that afford each of us the room (...) to become distinct individuals. Privacy, whether physical or informational, is valuable for beings like us. Establishing the truth this claim will be the primary focus of this article. Providing reasons, evidence, and support for this claim will take us into the historical and cultural dimensions of privacy. (shrink)

According to the socio-cognitive revolution hypothesis, humans but not other great apes acquire language because only we possess the socio-cognitive abilities required for Gricean communication, which is a pre-requisite of language development. On this view, language emerged only following a socio-cognitive revolution in the hominin lineage that took place after the split of the Pan-Homo clade. In this paper, I argue that the SCR hypothesis is wrong. The driving forces in language evolution were not sweeping biologically driven changes to hominin (...) social cognition. Our LCA with non-human great apes was likely already a Gricean communicator, and what came with evolution was not a raft of new socio-cognitive abilities, but subtle tweaks to existing ones. It was these tweaks, operating in conjunction with more dramatic ecological changes and a significant increase in general processing power, that set our ancestors on the road to language. (shrink)

A prevailing view is that while human communication has an ‘ostensive-inferential’ or ‘Gricean’ intentional structure, animal communication does not. This would make the psychological states that support human and animal forms of communication fundamentally different. Against this view, I argue that there are grounds to expect ostensive communication in non-human clades. This is because it is sufficient for ostensive communication that one intentionally address one’s utterance to one’s intended interlocutor – something that is both a functional pre-requisite of successful communication (...) and cognitively undemanding. Furthermore, while ostension is an important feature of intentional communication, the inferences required in Gricean communication may be minimal: ostension and inference may come apart. The grounds for holding that animal communication could not be Gricean are therefore weak. I finish by defending the idea that a ‘minimally Gricean’ model of communication is a valuable tool for characterising the communicative interactions of many animal species. (shrink)

A gas prepared in a non-equilibrium state will approach equilibrium and stay there. An influential contemporary approach to Statistical Mechanics explains this behaviour in terms of typicality. However, this explanation has been criticised as mysterious as long as no connection with the dynamics of the system is established. We take this criticism as our point of departure. Our central claim is that Hamiltonians of gases which are epsilon-ergodic are typical with respect to the Whitney topology. This collection of fourteen original essays addresses the seminal contribution of Franz Brentano and his heirs, to philosophy of language. Despite the great interest provoked by the Brentanian tradition and its multiple connections with early analytic philosophy, precious little is known about the Brentanian contribution to philosophy of language. The aim of this new collection is to fill this gap by providing the reader with a more thorough understanding of the legacy of Brentano and his school, in their pursuit of (...) a unique research programme according to which the analysis of meaning is inseparable from philosophical inquiries into what goes on in the mind and what there is in the world. In three parts, the volume first reconstructs Brentano’s pathbreaking thoughts on meaning and grammatical illusions, exploring their strong connections with the Austro-German tradition and analytic philosophy. It then addresses the multifaceted debates on the objectivity of meaning in the Brentano School and its aftermath. Finally, part three explores Brentano’s wider legacy, namely: Husserl’s theory of modification and typicality, Bühler’s theory of linguistic and non-linguistic expressions, and Wittgenstein’s thoughts on guidance and rule-following. The result is a unique collection of essays which shows the significance, originality and timely character of the Brentanian philosophy of language. (shrink)

Aristotle uses philosophia (and philosophos, philosophein, philosophôs, sumphilosophein, philosophêteon) in at least ten senses across his oeuvre, as this first study of every instance in his writings reveals. Irrespective of the specific approaches of its practitioners, philosophia may be, for example, an exercise of cleverness; or leisurely study; or the desire to know; or the pursuit of fundamental explanation; or a historically extended discipline. This variety allows us to go some way in reconstructing the complex attitude Aristotle had toward a (...) culturally specific practice in which he located himself and soon helped develop into a specialized discipline. Another benefit is that it allows us to clarify the argumentative method in his Protrepticus, which depends on several senses of philosophia. It also puts up obstacles to determining whether, for example, Aristotle believes philosophia is an epistêmê. (shrink)

Dialectical materialism was born in 1857, when Marx returned to studying Hegel. In opposition to Hegel, Marx adopted a realist epistemology. Abandoning the pragmatist ambiguities of his Economic?Philosophical Manuscripts, he became a materialist in the traditional sense of that word. Influenced by Hegel, Marx simultaneously attempted a dialectical proof for the labor theory of value. Abandoning his positivist critique in The Holy Family, he started using dialectic to discover beneath appearances an otherwise inaccessible reality. But his dialectic was incompatible with (...) his materialism. The identification of reality with Praxis, rejected at the level of philosophical statement, was retained at the level of economic argument. Turning Hegel upside down proved harder than Marx thought. In this paper, we consider three arguments for the irrelevance of the doctrine of double effect in end-of-life decision making. The third argument is our own and, to that extent, we seek to defend it. The first argument is that end-of-life decisions do not in fact shorten lives and that therefore there is no need for the doctrine in justification of these decisions. We reject this argument; some end-of-life decisions clearly shorten lives. The second is that the doctrine of double (...) effect is not recognized in UK law ; therefore, clinicians cannot use it as the basis for justification of their decisions. Against this we suggest that while the doctrine might have dubious legal grounds, it could be of relevance in some ways, e.g. in marking the boundary between acceptable and unacceptable practice in relation to the clinician's duty to relieve pain and suffering. The third is that the doctrine is irrelevant because it requires there to be a bad effect that needs justification. This is not the case in end-of-life care for patients diagnosed as dying. Here, bringing about a satisfactory dying process for a patient is a good effect, not a bad one. What matters is that patients die without pain and suffering. This marks a crucial departure from the double-effect doctrine; if the patient's death is not a bad effect then the doctrine is clearly irrelevant. A diagnosis of dying allows clinicians to focus on good dying and not to worry about whether their intervention affects the time of death. For a patient diagnosed as dying, time of death is rarely important. In our conclusion we suggest that acceptance of our argument might be problematic for opponents of physician-assisted death. We suggest one way in which these opponents might argue for a distinction between such practice and palliative care; this relies on the double-effect doctrine's distinction between foresight and intention. Most scholars agree that Socrates’ arguments in the course of his refutation of Thrasymachus in Plato’s Republic are at best weak and at worse fallacious. Some interpreters have used this logical inadequacy to argue that Socrates’ aim is psychotherapeutic rather than cognitive, but this does not address why Thrasymachus feels shamed. I argue in this article that Thrasymachus blushes not simply because his explicit propositions are contradictory but because two principles of his sophistic ēthos—that his skill requires knowledge and that (...) his skill achieves victory in logoi—are fundamentally at odds. My claim that Socrates’ elenchus of Thrasymachus appeals to a principle of ethical consistency has the specific advantage of reconciling the otherwise opposed views of Socratic elenchus as exclusively ‘logical’ or ‘psychotherapeutic’. Bei Patienten, die frühe Traumata erlebt haben, die nicht erzählbar sind, weil sie vor der Zeit liegen, in der das autobiographische Gedächtnis etabliert ist, spielt die Angstregulierung eine fundamentale Rolle. Hochfrequenz kann bei diesen Patienten Ängste auslösen, die als nicht steuerbar erlebt oder befürchtet werden. Ein niederfrequentes Setting ist hier oft – vor allem (...) am Beginn der Behandlung – das, worauf Analytiker und Patient sich verständigen können.
