This book presents a collection of contemporary discourses that reconsider the relationship of democracy as a political ideology and American ideal and education as the foundation of preparing democratic citizens in America.

Privilege brings obligations – noblesse oblige. Boyle came from a deeply privileged background. If we are to locate him through twentieth-century eyes in order to rediscover his psychic space, then this background needs to be borne in mind. It was a constant shaping force for him. Twentieth-century eyes mean a new perspective. As Eliot wrote of Pascal, Boyle's contemporary, ‘every generation sees preceding ones differently. Pascal is one of those writers who will be, and who must be, studied afresh by (...) men in every generation. It is not he who changes, but we who change. It is not our knowledge of him that increases, but our world that alters and our attitudes towards it’ – and so it is with Boyle.Boyle's childhood was beset by tragedy. From a psychological point of view, there can be fewer worse tragedies than the premature loss of a mother. His mother died of consumption when he was three. She was forty-two and he was her fourteenth and penultimate child. It seems clear that this early loss haunted him for the rest of his life, its unconscious effect always there. At some level he may have felt partly responsible for her death – that his birth had helped to wear her out, to finish her off, to consume her. It would seem that he missed out on mourning in the conventional sense, or rather in the sense that Freud emphasized as being all-important in his paper ‘Mourning and Melancholia’. Boyle did use, in his autobiographical writing as ‘Philaretus’, the word ‘disaster’ to describe this early tragedy, and it is a powerful enough word in the context. But what happened to his grief ? Was it worked through? Was it lived with? Or was it just sublimated into his work, his wide range of preoccupations? Was it something that remained as a constant, underlying refrain in his life, that he needed to defend himself against? (shrink)

Some philosophers think that two distinct things can occupy exactly the same region of space, as with a statue and a piece of clay. Others think that the statue and the piece of clay are identical, but not necessarily so. I argue that Alan Gibbard’s well-known story of Goliath and Lumpl does not support either of these claims. Not the first, as there is independent reason to think that it cannot be true. A widely held view has it that sometimes there is more than one thing in exactly the same place, as is the case, allegedly, with a clay statue. There is the statue, but there also is a piece of clay—both obviously in the same place yet distinct in virtue of their differing properties, if only modal ones. Those holding this view—pluralists—often describe the relation between such objects as one of constitution, with the piece of clay being said (...) to constitute the statue. In the first part of this paper I consider ways in which the supposed relation of constitution may be understood. I conclude that the only coherent interpretation of ‘x constitutes y’ is one on which it is presupposed that x and y are identical. While this does not, by itself, show that pluralism is false, it is something that should make us suspicious of it. In the second part of the paper I propose a simple way with the temporal and modal facts the pluralist appeals to, showing that they do not force us into accepting his puzzling doctrine. (shrink)

Pluralists believe that there are cases of distinct but spatio-temporally coinciding things. The statue goes, the piece of clay remains: differing persistence conditions, different things. Yet while both are with us, they are obviously in the same place. The argument rests on two assumptions: that statues have their shape essentially and that pieces of clay do not. Only if we make both does the conclusion follow. Here I suggest that while both assumptions are plausible on their face, each (...) may be questioned. In this article, I offer a background to digital theology and its methodology, exploring especially aspects of transhumanism and metaphysical enquiry. The article moves on to engage with several articles given at the Science and Religion Forum at Birmingham in 2022, especially the Gowland Lecture given by Professor Niels Gregersen and the Peacocke Lecture by Andrew Jackson. Both offer a metaphysical approach to information linked closely to the concept of Logos drawn from the Prologue of John—Jackson focusing on Maximus (...) the Confessor's exploration of phylogenetic logoi; Gregersen on a further development of “Deep Incarnation” through the title “God with Clay” drawn from Bonaventure. The article extends this engagement with John by querying the model of incarnation in “deep incarnation” but building on the Logos/logoi to set out some initial building blocks for an alternative metaphysics of information. Monists and pluralists disagree concerning how many ordinary objects there are in a single situation. For instance, pluralists argue that a statue and the clay it is made of have different properties, and thereby are different. The standard monist’s response is to hold that there is just a single object, and that, under the description “being a statue”, this object is, e.g., aesthetically valuable, and that, under the description “being a piece of clay”, it is not aesthetically valuable. (...) However, Fine provided an ontological reading of the expression “an object under a description”: the theory of rigid embodiments. The debate between monists and pluralists reduplicates in the domain of ordinary occurrences, like walks and conferences. Specifically, they disagree whether an occurrence in progress (also called “process”) like John’s walk that is happening at tn is identical to some completed occurrence (also called “event”) like John’s walk that happened between, e.g., t1 and tn. Under the adoption of the pluralist’s position, the article aims to provide a novel theory of ordinary occurrences that develops the ontological reading of “under a description” to account for occurrences in progress and completed occurrences. As a first result, we formulate a theory according to which both occurrences in progress and completed occurrences are rigid embodiments. As a second result, we argue that the suggested theory is explanatorily powerful to the extent it solves two puzzles that we call “the Puzzle from the Completion of a Process” and “the Metaphysical-cum-Semantical Puzzle”. John R. Schneider explores the problem that animal suffering, caused by the inherent nature of Darwinian evolution, poses to belief in theism. Examining the aesthetic aspects of this moral problem, Schneider focuses on the three prevailing approaches to it: that the Fall caused animal suffering in nature (Lapsarian Theodicy), that Darwinian evolution was the only way for God to create an acceptably good and valuable world (Only-Way Theodicy), and that evolution is the source of major, God-justifying beauty (Aesthetic Theodicy). He also uses canonical texts and doctrines from Judaism and Christianity - notably the book of Job, and the doctrines of the incarnation, atonement, and resurrection - to build on insights taken from the non-lapsarian alternative approaches. Schneider thus constructs an original, God-justifying account of God and the evolutionary suffering of animals. His book enables readers to see that the Darwinian configuration of animal suffering unveiled by scientists is not as implausible on Christian theism as commonly supposed. (shrink)

Systemic financial risk is one of the most significant collective action problems facing societies. The Great Recession brought attention to a tragedy of the commons in capital markets, in which market participants, from the first-time homebuyer to Wall Street financiers, acted in ways beneficial to themselves individually, but which together caused substantial collective harm. Two kinds of risk are at play in complex chains of transactions in financial markets: ordinary market risk and systemic risk. Two moral questions are relevant in (...) such cases. First, from the standpoint of interactional morality, does a person have a moral duty to avoid risk of harm to others if their financial transactions contribute in some way, however small, to the loss or harm? This article identifies the conditions in which persons are morally responsible in such cases. Second, from the standpoint of institutional morality, how should society distribute the risk of harm associated with massively complex financial markets? This question is considered in the context of the home mortgage credit market. Luck egalitarianism, in particular a Dworkinian insurance scheme to allocate risks and resources relating to mortgage credit and private home ownership, offers substantial promise. (shrink)

Studies in Empirical Philosophy was published in 1962 shortly after Anderson's death and had been prepared by him to include most of his published articles from the Australasian Journal of Philosophy and Psychology. It also includes a couple of articles written especially for the book. It remains the main published source of material on Anderson's systematic philosophy. John Passmore has kindly granted permission for his introduction to be included in this new release. John Anderson (1893-1962) was Challis Professor (...) of Philosophy at the University of Sydney from 1927 until 1958. He is generally regarded as the most important philosopher to have worked in Australia. His students included not only academic philosophers but also important figures in politics, law and journalism. His impact upon Sydney's social and cultural life was enormous. (shrink)

The association of poetry and femininity … excluded women poets. For the female figures onto whom the men projected their artistic selves—Tennyson’s Mariana and Lady of Shalott, Browning’s Pippa and Balaustion, Arnold’s Iseult of Brittany—represent an intensification of only a part of the poet, not his full consciousness: a part, furthermore, which is defined as separate from and ignorant of the public world and the great range of human experience in society. Such figures could not write their own poems; the (...) male poet, who stands outside the private world of art, has to do that for them. The Lady of Shalott could not imagine someone complex and experienced enough to imagine the world beyond range of her windows, or to imagine her. A woman poet who identified herself with such a stock figure of intense and isolated art would hardly be able to write at all. Or, like the Lady of Shalott preparing her death-ship, she could write only her own name, only herself. For a man, writing poetry meant an apparent withdrawal from the public sphere , but for a woman it meant just the opposite: a move toward public engagement and self-assertion in the masculine world. She could not just reverse the roles in her poetry and create a comparable male self-projection, since the male in this set of opposites is defined as experienced, complexly self-conscious, and part of the public world and therefore could not serve as a figure for the poet. We can formulate the problem like this: a man’s poem which contains a female self-projection shows to distinctly different figures, poet and projection; in a woman’s poem on the same model, the two would blur into one.Furthermore, it’s not really poets that are women, for the Victorians: poems are women. The cliché that style is the man arises more readily and with much greater literalness and force when the stylist is a woman, and it is often charged with erotic intensity. The young lovers in Gilbert and Sullivan’s Iolanthe describe their perfect love by singing that he is the sculptor and she the clay, he the singer and she the song. Ladislaw in Middlemarch tells Dorothea that she needn’t write poems because she is a poem. Edgar Allan Poe remarks in a review of Barrett Browning’s works that “a woman and her book are identical.” In her love letters Barrett Browning herself worried about the problem of her identity—was she her poems, were they she, which was Browning in love with? “I love your verses with all my heart, dear Miss Barrett,” he had written disconcertingly in his first letter, “… and I love you too.” […] As we can see in Tennyson’s The Princess, the lyric in particular seemed female to Victorians—private, nonlogical, purely emotional—and it is surely no accident that large numbers of English and American women began to publish poetry in the nineteenth century, when the lyric established its dominance. Victorian poems like Victorian women were expected to be morally and spiritually uplifting, to stay mostly in the private sphere, and to provide emotional stimulus and release for overtasked men of affairs.9 All this may have encouraged women to write poetry, but at the same time it made writing peculiarly difficult because it reinforced the aspects of conventional Victorian femininity—narcissism, passivity, submission, silence—most inimical to creative activity. Novak himself. The topics themselves concern whether Jews and Christians worship the same God, suicide, natural law, Pope Pius IX, justice, the sanctity of human life, and supersessionism. Its contributors include senior scholars as well as those at the beginning of their careers. Each essay, arising from some aspect of Novak's vast corpus, is replied to by Novak himself. These replies are instructive, for they show a great teacher at work, responding with nuance and charity to criticisms and always moving the conversation forward in illuminative ways.Levering opens the volume with a contribution about Novak as a master of Jewish–Christian dialogue, indeed, "the greatest master of Jewish–Christian dialogue who has ever lived" (1). Levering highlights the intellectual pedigree of Novak, whose teachers included Abraham Joshua Heschel, Leo Strauss, Yves Simon, Louis Dupré, and Germain Grisez. The ancient lawgiver Solon of Athens left norms of proper conduct that carry important ethical implications for all manner of human affairs, including commercial activities and the pursuit of wealth. In his extant poetry, he emphasizes the strong connections between individual virtue and its consequences in the social and political sphere. In considering the proper means of obtaining material wealth, he describes multiple ways to earn a living and connects them to proper intellectual and ethical dispositions through a concept of (...) justice. This focus on virtue establishes a long-range ethics that is based on a principle of justice, demands rational intellectual activity, and carries implications for everyone’s self-interest. Solon’s concern for matters of virtue, the proper means of attaining wealth, and the need for long-range awareness of consequences offers a valuable point of historical focus for our own examinations of business ethics today. This chapter talks about Ayn Rand's distinctive view of the philosophical roots and meaning of the events of her time ‐ especially the events of the 1960s and 1970s when she was most active as a commentator on current events. It begins with a section on Rand's political writings and activism in the 1930s and (especially) 1940s, which is followed by Rand's essays that provide a broad philosophical and historical context for the issues facing the world. While the third section (...) deals with antitrust and censorship which according to Rand were as the most pressing issues, the fourth discusses the Kennedy administration. The fifth section analyzes the brokering deals between pressure groups by the Johnson and Nixon administrations. Then, Rand's writings focus on the unprincipled nature of American foreign policy, especially during the “Cold War”. To think of commercial law as only the law of states is to have an inadequate understanding of the norms governing commercial transactions. Some have argued for a transnational conception of commercial law, but their grounds of justification have been unpersuasive, often grounded on claims about the common content among national legal systems. Legal positivism is a rich literature on the concept of a legal system and the validity (...) conditions for rules in legal systems, but it has not been used to understand legal order outside or beyond the state. This article aims to use legal positivism to conceptualize a transnational commercial law order. Prevailing positivist accounts at least implicitly condition legal order on state sovereignty. The article offers a cosmopolitan conception of legal positivism, in which the state is no longer an enabling condition for law. The cosmopolitan conception provides the means by which to adequately describe a transnational commercial law order. There are limits to the conceptual analysis this article provides, one of which is that it does not purport to evaluate the justice or morality of transnational legal order. But the cosmopolitan conception of legal positivism elucidated in this article stands on its own as a way of understanding a number of transnational legal orders other than commercial law. The attractiveness of the account is that it describes law as a human social practice even when it is not solely the product of the state, so that we do not have to rely on natural law theories to understand legal rules that states do not maintain. From unemployment to Brexit to climate change, capitalism is in trouble and ill-prepared to cope with the challenges of the coming decades. How did we get here? While contemporary economists and policymakers tend to ignore the political and social dimensions of capitalism, some of the great economists of the past - Adam Smith, Friedrich List, John Maynard Keynes, Joseph Schumpeter, Karl Polanyi and Albert Hirschman - did not make the same mistake. Leveraging their insights, sociologists John L. Campbell (...) and John A. Hall trace the historical development of capitalism as a social, political, and economic system throughout the twentieth and early twenty-first centuries. They draw comparisons across eras and around the globe to show that there is no inevitable logic of capitalism. Rather, capitalism's performance depends on the strength of nation-states, the social cohesion of capitalist societies, and the stability of the international system - three things that are in short supply today. This article offers a critique of Ronald Dworkin’s article “A New Philosophy for International Law”, (Philos Public Aff 41: 1–30, 2013). It begins by showing that Dworkin’s moralised theory of law is built on two highly questionable background assumptions. On the one hand, a descriptively implausible characterisation of a positivist-voluntarist view of international law as the reigning “orthodoxy”. On the other hand, the methodologically questionable assumption that a theory of international law must discharge the dual function of explaining the validity (...) of international law in a manner that underwrites its presumptive legitimacy. In its core part, the article then offers a sustained criticism of Dworkin’s moralised account of the validity and legitimacy of international law. Various problems are identified with the “principle of salience” that Dworkin offers in place of consent as a ground for international law. A key concern is the difficulties that stem from Dworkin’s willingness to proceed on the “fantasy” assumption that his theory needs to get off the ground, i.e. that there is an international court with compulsory jurisdiction and reliable mechanisms for enforcing its judgements. Finally, the article concludes with some thoughts on how Dworkin’s “fantasy-based” approach led him to over-estimate the degree to which international law can be a vehicle for the global spread of liberal democratic values. More minimalist ambitions for international legal order, along the lines suggested by John Rawls inThe Law of Peoples, seem more realistic. (shrink)
