Cet article vise à élucider la place décisive qu’occupe Franz Kafka au sein de la phénoménologie de Michel Henry. Si cette place est désormais largement reconnue par l’ensemble de la littérature critique, elle n’en demeure pas moins énigmatique. C’est pourquoi une analyse de fond semble requise afin d’en saisir l’impact réel sur une phénoménologie ayant pour but de penser la vie en tant que Soi invisible et pathétique. En effet, l’introduction de Kafka dans le discours henryen, hormis son intérêt historique, (...) relève de la plus haute importance, au sens où elle permet de réfléchir les conditions d’un discours propre à une « pensée de la vie ». Le but de cet article consiste donc à démontrer l’originalité philosophique spécifique de Michel Henry lorsque celui-ci décide, très consciemment et avec audace, d’insérer Kafka à l’intérieur de son argumentation, en assumant par ce fait le statut paradoxal d’une « contre-philosophie ». Outre l’hypothèse d’un dispositif de « paroles de la vie » traversant le discours de Michel Henry, l’article propose, entre autres, de réfléchir les thématiques de la lecture et de l’écriture du point de vue d’une phénoménologie de la vie. We'd like to begin with the thought experiment of imagining The Merchant of Venice as a genealogy of morality and imagining Shylock as Nietzsche. What is The Merchant of Venice about? What is (...) at stake in this oddly inside-out drama, where a piece of good old Elizabethan comic Jew-baiting rotates 180 degrees into a devastating study of Christian anti-Semitism only to flip back into what it seemed to deny? Our initial hypothesis is that it is nothing less than an inquiry into the origin of our moral concepts of justice, good and bad, and more particularly guilt, law, mercy, and love. It is here that a link with Nietzsche suggests itself, particularly with the Second Essay of On the Genealogy of Morals.* * *How do we breed an animal with the right to make promises? For Nietzsche, the human being is an originally forgetful creature, like a young child. To make this originally forgetful creature remember requires physical discipline; it behooves punishment. The teaching of morality is never gentle; it never droppeth from heaven like gentle rain. On the contrary, if something is to be retained in memory, it must be burned in. The origin of memory lies in pain and cruelty: "Man could never do without blood, torture and sacrifices when he felt the need to create a memory for himself" [GM 61]. Nietzsche's first, astonishing hypothesis in the Second Essay is that the origin of concepts like responsibility and conscience lies in cruelty—cruelty administered and maintained through a corporal and corporeal regime. Further, as religions are systems of cruelty, all forms of asceticism originate in the same painful place. "Consider the German punishments," Nietzsche proposes—and we all know that there's nothing quite like the German punishments: stoning, breaking on the wheel, piercing with stakes, tearing apart or trampling with horses, boiling in oil, flaying alive, cutting straps from the flesh, smearing the wrongdoer with honey and leaving him to the flies in the blazing sun. As Nietzsche quips, with magnificent understatement, "With the aid of such images and procedures one finally remembers five or six 'I will not's'" [GM 62]. IntroductionThe questions this article addresses are as follows: do non-Western societies have a qualitatively better, more balanced relationship with nature than modern Western societies? Can the difference between the two be described in terms of an opposition between a reciprocal and an exploitative relationship? What difference does the Judeo-Christian tradition make in (...) shaping the modern relationship with nature?To answer these questions I will give brief descriptions of the way in which three cultural traditions have structured the relationship between man and nature: societies that are ruled by sacred kings, societies where power over nature is attributed to divinities, and the Old Testament tradition. As cases of sacred kinship, I present ethnographic material taken from my anthropological fieldwork among the Lulubo, Lokoya, and Lotuho peoples from the East Bank of the Nile in Southern Sudan. I will use the term "Eastern Nilotic" as shorthand for this complex of peoples. For the societies where divinities play the central role, I take the Western Nilotic Dinka, Nuer, and Atuot living in the flood plains of the Nile north of the kingship societies.In comparing these three traditions my point of departure is René Girard's analysis of culture as a mechanism to resolve conflict by directing the aggression of the members of society onto a victim and so achieving a new consensus. We shall see that in the kingship societies what we call natural phenomena play an integral part in culturally staging the scapegoat mechanism. They are the stage of human rivalries and their resolution. Among the polytheistic Western Nilotes they are the instrument through which the gods make their power felt and demand attention from humans. Kings as Ecological AgentsThe survival of the communities of the Lokoya and Lulubo on the East Bank of the Nile who traditionally live in well-fortified village-polities, counting in the precolonial period between 1500 and 2500 inhabitants, is dependent on forces that are unpredictable (Simonse 1992). As agriculturists they are dependent on regular rains. However, the rains in their area are erratic and localized. As a result there is always a risk that the harvest may fail. The soil is of varying quality, giving varying yields in different places. The birth rate is another major concern. It determines the security of the community in its relationship to neighboring, frequently hostile, communities. There is the concern for epidemics, crop-eating insects and birds, and root-eating worms. Violent winds may destroy the crop, and lions and leopards may kill humans and cattle. A concern of a different order is the extent of the effectiveness of weapons, spears, and bows and arrows, in assuring security.When adversity affects the community, the first question asked by those affected is that regarding its cause. Frequently the cause is a breach of the social rules: an act of violence and a failure to perform or properly perform a ritual of purification necessitated by the violence. It may also be unconscious resentment on the part of a person or group that feels excluded from benefits enjoyed by others. It may be the cry of a neglected relative. It may be incest. It may be an attack by outsiders.Among the Lulubo and Lokoya, responsibility for the various aspects of the natural environment that can be critical for community survival is allocated to the different clans. In poem 40, through a series of rhetorical questions, Catullus confronts Ravidus about what made him commit such a foolish action as to fall in love with Catullus’ own lover. The poem ends with the lines: eris, quandoquidem meos amores | cum longa uoluisti amare poena, ‘You will be, since you have chosen to love my lover at the risk of receiving a long punishment’. There is a long-standing tradition of scholarship which testifies to the frequency with which Catullus incorporates (...) wordplay in his poems, including bilingual puns. The reasons for this are explored, using academic studies, survey reports as well as insights gained from the Institute of Business Ethics' work with large corporations. These indicate that there is a gap between the existence of explicit ethical values and principles, often expressed in the form of a code, and the attitudes and behaviour (...) of the organisation. The paper suggests that two basic reasons appear to be at the heart of the problem: ineffective ethics programmes and deficiencies in corporate culture. The paper concludes that successfully embedded corporate ethical values requires well‐designed ethics policies, sustained ethical leadership and incorporation of ethics in organisational processes and strategy as part of an ethical culture at all levels of the organisation. The article proposes a novel approach to the much discussed question of which symmetries have ‘direct empirical significance’ and which do not. The approach is based on a development of a recently proposed framework by Hilary Greaves and David Wallace, who claim that, contrary to the standard folklore among philosophers of physics, ‘local’ symmetries may have direct empirical significance no less than ‘global’ ones. Partly vindicating the standard folklore, a result is derived here from a number of plausible assumptions, that (...) states that local symmetries can indeed have no direct empirical significance. ArgumentEarly modern Europeans routinely compared nature to a theater or spectacle, so it makes sense to examine the practices of observing real spectacles and performances in order to better comprehend acts of witnessing nature. Using examples from the history of fireworks, this essay explores acts of observing natural and artificial spectacles between the sixteenth and late eighteenth centuries and suggests these acts of observation were mutually constitutive and entailed ongoing and diverse exchanges. The essay follows the changing ways in which (...) audiences were imagined or expected to react to fireworks and shows how these also shaped experiences of natural phenomena. Both natural and artificial spectacles were intended to teach morals about the state and nature, yet audiences rarely seemed to take away what they were expected to learn. The essay examines how performers thus sought to discipline audience observation, before exploring, in conclusion, how spectacle provided a vocabulary for discerning and articulating new natural phenomena, and sites for the pursuit of novel experiments. Scholars are divided over whether a victim's rights persist when an agent permissibly responds to an emergency. According to the prevailing view the moral force of rights is not extinguished by moral permissibility and the agent, therefore, has a duty to compensate the victim. According to another influential view permissibility does erase the moral force of rights and the agent, therefore, can only have a duty to compensate for reasons other than the fact that they committed a rights transgression. I (...) argue that liability does not follow even if we grant that the victim's rights persevere. A non-pecuniary remedy such as a formal apology provides an adequate way of vindicating the victim's rights and of recognizing the agent's causal role. Thus, the answer to the question of what remedy the permissible transgressor owes the victim does not provide us with an answer to the question of who should bear the burden. (shrink)

I develop a challenge for a widely suggested knowledge-first account of belief that turns, primarily, on unknowable propositions. I consider and reject several responses to my challenge and sketch a new knowledge-first account of belief that avoids it.

This article investigates the prospects of deliberative democracy through the analysis of small-scale deliberative events, or mini-publics, using empirical methods to understand the process of preference transformation. Evidence from two case studies suggests that deliberation corrects preexisting distortions of public will caused by either active manipulation or passive overemphasis on symbolically potent issues. Deliberation corrected these distortions by reconnecting participants’ expressed preferences to their underlying “will” as well as shaping a shared understanding of the issue.The article concludes by using these (...) insights to suggest ways that mini-public deliberation might be articulated to the broader public sphere so that the benefits might be scaled up. That mini-public deliberation does not so much change individual subjectivity as reconnect it to the expression of will suggests that scaling up the transformative effects should be possible so long as this involves communicating in the form of reasons rather than preferred outcome alone. What is the relation between what we ought to do, on the one hand, and our epistemic access to the ought-giving facts, on the other? In assessing this,it is common to distinguish ‘objective’ from ‘subjective’ oughts. Very roughly, on the objectivist conception what an agent ought to do is determined by ought-giving facts in such a way that does not depend on the agent’s beliefs about, or epistemic access to, those facts; whereas on the subjectivist conception, what an agent ought (...) to do depends on his beliefs. This paper defends the need for, and explicates, a third category of ‘ought’: ‘warranted oughts’. Section 1 introduces the distinction between objective and subjective ‘oughts’. Sections 2–3 draw attention to some serious problems with each. Section 4 examines, though rejects, a recent attempt to replace subjective ‘oughts’ with objective ‘wide-scope oughts’ operating on belief-action combinations. Section 5 explicates the notion of a warranted ‘ought’ and defends the account against some possible objections. The resulting a picture is one in which an adequate analysis of practical normativity requires both objective and warranted ‘oughts’. In this paper I problematize the use of appeals to the common intuitions people have about the morality of our society’s current treatment of animals in order to defend that treatment. I do so by looking at recent findings in the field of cognitive science. First I will examine the role that appeals to common intuition play in philosophical arguments about the moral worth of animals, focusing on the work of Carl Cohen and Richard Posner. After describing the theory of (...) Moral Disengagement—which has been used to explain how people live with themselves when they commit acts that they themselves believe are wrong—I will review the recent empirical research that details the nature of the moral disengagement that accompanies animal treatment. This includes studies that reveal that those who eat animals engage in the following behaviors: They minimize the nature of the harm of killing animals by casting the practice in a positive light; They obscure personal responsibility by blaming others for harms; They minimize the effect of the conduct on the animals by avoiding reference to the animal origins of meat; They derogate vegetarians as a way of avoiding feelings of guilt for their own practices. Perhaps most importantly, a number of empirical studies have shown that people’s intuitions about the moral worth of animals are shaped by their practice of eating animals—and not the other way around. In addition to the studies on moral disengagement, there is another body of research that has attempted to discover what accounts for the individual differences in attitudes people have toward the moral worth of animals. These studies have linked masculinity and traits like Authoritarianism, Social Dominance Orientation and Right Wing Authoritarianism to the tendency to disregard the moral worth of animals. I will briefly summarize this body of research and will then conclude by arguing that this data should cause us to be highly skeptical of the value that the common intuition that people who eat animals have about the moral status of animals may have in helping us understand the actual moral worth of animals. On a widely suggested knowledge-first account of belief, to believe p is to phi as if one knew p. I challenge this view by arguing against various regimentations of it. I conclude by generalizing my argument to alternative knowledge-first views suggested by Williamson and Wimmer.

In his works on argumentation, Aristotle develops three main forms: apodeictical, dialectical, and rhetorical argumentation; dialectic is subdivided into several subspecies. The purpose of this paper is to discuss all of the forms described by Aristotle, to examine their differences and to point out their interrelations. This leads to an examination of the differentiating criteria and their applicability in the case of each argumentation form—and in particular to the question regarding the number of criteria that are necessary to describe each (...) form clearly and unambiguously. It is argued that Aristotle’s works on argumentation contain an implicit system of argumentation forms that is based on no more than three criteria. (shrink)

This paper looks at the current wave of protests and demonstrations and asks whether what we are witnessing is the emergence of a new movement against austerity and in favour of democracy, as many suggest. The wider context is the crisis of representative politics, which is in turn transforming the nature of mobilisation, contestation and politics more generally. In place of traditional organisational structures, we are seeing the emergence of cloud, swarm and connective initiatives with characteristics that challenge and supplant (...) traditional organisational politics. We are seeing the emergence of a politics that is resistant to ‘politicians’ of whatever ideology, seeking to recuperate power and agency from representatives. This creates an interesting tension at the heart of democracy: whether and to what extent democracy needs to ‘reboot’ or whether new political parties and movements can ally the connective to representational styles of politics to provide a way in which democracy can evolve.Este artículo examina la ola de protestas y manifestaciones, preguntándonos si, como muchos sugieren, lo que estamos presenciando es el surgimiento de un nuevo movimiento contra la austeridad y a favor de la democracia. El contexto político está marcado por una generalizada crisis de la política representativa, hecho que a su vez marca la transformación de la naturaleza de la movilización, de la contestación y de la política en general. Estamos presenciando el surgimiento de iniciativas con características cloud, swarm y conectivas que desafían y suplantan a las estructuras organizativas tradicionales. En la actualidad está emergiendo una forma de política que es resistente a los “políticos” de cualquier tipo de ideología y que trata de recuperar el poder de los representantes. This paper examines a particularly egregious example of a NIMBY claim and considers three proposals for explaining what about that claim might be ethically problematic: The NIMBY claimant is being selfish or self-serving; The NIMBY claim cannot be morally justified, because respecting everyone's NIMBY claims leaves communities worse off; and if policymakers were to defer to people's NIMBY claims, they would end up perpetuating environmental injustices. We argue that these proposals fail to explain why there is anything wrong with the (...) NIMBY claim per se. (shrink)

The Moral Conscience principle claims that a conflict between the demands of a law and the demands of an individual’s sincere moral conscience provides her with a defeasible moral entitlement to an exemption. This chapter argues that this principle is vulnerable to an unfairness objection. There is nothing special about moral conscience that would justify granting an exemption, it claims, that is not shared by a variety of non-moral projects. Thus, there is no principled moral reason for a defeasible entitlement (...) to moral conscience-based exemptions that is not an equally good reason for a defeasible entitlement to non-moral project-based exemptions. Since the chapter assumes that people are not defeasibly entitled to such project-based exemptions, it advocates scepticism about the Moral Conscience principle. (shrink)

The main purpose of this article is to demonstrate the enduring relevance of the concept of ideology to contemporary sociological analysis. To this end, the article draws upon central arguments put forward by Pierre Bourdieu and Luc Boltanski in ‘La production de l’idéologie dominante’ [‘The Production of the Dominant Ideology’]. Yet, the important theoretical contributions made in this enquiry have been largely ignored by contemporary sociologists, even by those who specialize in the critical study of ideology. This article intends to (...) fill this gap in the literature by illustrating that useful lessons can be learned from Bourdieu and Boltanski’s critical investigation, as it provides crucial insights into the principal characteristics and functions of ideologies, including the ways in which they develop and operate in advanced capitalist societies. The article is divided into two main parts: the first part examines various universal features of ideology; the second part aims to shed light on several particular features of dominant ideology. The paper concludes by arguing that the ‘end of ideology’ thesis, despite the fact that it raises valuable sociological questions, is ultimately untenable. (shrink)

We situate the well-trodden debate about defining health and disease within the project of a metaphysics of science and its aim to work with and contribute to science. We make use of Guay and Pradeu’s ‘metaphysical box’ to reframe this debate, showing what is at stake in recent attempts to move beyond it, revealing unforeseen points of agreement and disagreement among new and old positions, and producing new questions that may lead to progress. This article explores the way in which the practice of neuroscience, in the form of contemporary brain-imaging, has to actively define and isolate aspects of mindfulness as solely contained within the individual. Although hidden from final scientific accounts, at the centre of this process is the need for the researchers to forge brief but intimate and personal relationships with the volunteers in their studies. With their increasing interest in studying more and more complex mental processes, and in particular as researchers (...) focus on what they term `the social brain', a potential paradox arises from the commitment to the straightforward location of brain function and recognition of the more distributed and intersubjective nature of the objects of their study. Consequently, in order to elicit specific mental activities, such as empathy, the scientists inevitably employ a range of socially based resources, which includes establishing a personal relationship with the volunteers. The scientists themselves see this as ensuring that they can trust that the volunteers will participate in the ways intended. But in contrast, the article argues that the central feature is actually the creation of a sense of intimacy, which serves to align the expectations and experiences of volunteer and researcher. Yet, while this relationship is necessary in order to ensure the required mental state is generated, during the experiment itself a great deal of work is then done to ensure it can be excluded from the final conceptualization of mental activity.
