O presente artigo científico é parte de pesquisa destinada a investigar as implicações e interpretações advindas da transformação do posicionamento do princípio de universalização (U) operada na teoria do discurso do filósofo alemão Jürgen Habermas, sobretudo a partir de algumas de suas obras das décadas de 80 e 90. A pretensão cognitivista da ética do discurso fundamenta a moral diante da possibilidade de reconstrução racional discursiva das justificativas das normas. O teste de universalização faz parte da fundamentação, mas em que (...) sentido? A fim de afastar o ceticismo quanto a pretensão de justificação prática, Habermas repensa a relação kantiana entre moral e direito. Mais precisamente, diante de sociedades complexas marcadas pelo Estado Democrático de Direito e pelo uso de discursos práticos diversos da moral para a justificação das práticas sociais, a legitimidade das normas passa por explicitar a relação discursiva entre direito, moral e política. É no âmbito deste desafio que o filósofo alemão vem modificando a formulação e o posicionamento de seu princípio de universalização (U) ao longo do tempo, bem como sua relação com o princípio do discurso (D) e, posteriormente, com o princípio da democracia (De). Após percorrermos este caminho, lançamos a hipótese, segundo a qual, a ênfase que Habermas confere ao direito em Facticidade e Validade junto do reposicionamento do ponto de vista moral, permite pensar de maneira dialógica a interação social como práxis comunicativa sem sujeitos. Cet article possède un caractère programmatique et anticipe en partie un travail plus substantiel dont le but sera de contribuer tant aux études portant sur l’histoire du scepticisme moderne qu’à celles touchant à la pensée des Lumières en général, et à celle de Voltaire en particulier. Dans le cadre d’analyse qui est ici le nôtre, il s’agit avant tout d’analyser brièvement certains points de rapprochement et de divergence entre Voltaire et la pensée sceptique. Nous nous contenterons ici de pointer du (...) doigt quatre thèmes qui permettent d’interroger l’utilisation faite par Voltaire du scepticisme sans prétendre proposer d’étude exhaustive de la question : 1) la question de la diaphonie ; 2) le problème de l’existence du monde extérieur ; 3) les rapports entre la foi et la raison ; et 4) les rapports entre l’épochè sceptique et la raison libre des Lumières.The present article has a programmatic perspective. It is the structuring of a longer work which aims to be a contribution both to the studies of skepticism in modern thought and to the studies of Voltaire’s thought. The objective is to consider the proximities and distances of Voltaire and skepticism. In order to do that, I shall organize the analysis of that relation after four aspects which constitute the possible directions for more detailed considerations : the question of diaphony in Voltaire’s texts, the problem of the existence of the exterior world, the relations between faith and reason and the relation between the skeptical epokhe and the raison libre. In most western countries, there is a 'human organ shortage' with waiting lists for the performance of transplantation. In a recent report of the UNOS Ethics Committee it is stated that there are approximately 31,000 potential recipients on waiting lists, but only one fourth of potential donors give their specific consent. Xenotransplantation--defined as the transplantation of animal cells, tissues or organs into human beings--is associated with particular ethical dilemmas, namely the problems of efficiency and safety of this medical procedure. Also, xenotransplantation will be evaluated as far as the legal regulation of transplantation is concerned. This chapter explores the debate between contemporary projectivists or expressivists, and the advocates of sensibility theory. Both positions are best viewed as forms of sentimentalism — the theory that evaluative concepts must be explicated by appeal to the sentiments. It argues that the sophisticated interpretation of such notions as “true” and “objective” that are offered by defenders of these competing views ultimately undermines the significance of their meta-ethical disputes over “cognitivism” and “realism” about value. A presente pesquisa tem como escopo analisar como as denominadas “razões de segurança” enquanto justificadoras de medidas excepcionais e a existência de uma peste são visualizadas por Giorgio Agamben enquanto paradigmas de governo. O objetivo é demonstrar como esses dois fatores, com a pandemia do coronavírus, se uniram e se transformaram no que o filósofo italiano denomina biossegurança. Para tanto, tratando-se de pesquisa essencialmente bibliográfica, de abordagem qualitativa, serão exploradas obras de Agamben sobre seu método, textos anteriores ao COVID-19 e (...) seus alertas acerca dos dispositivos de controle adotados no combate ao vírus. Este artigo buscou problematizar dados de uma pesquisa de viés socioantropológico, realizada em uma comunidade indígena Pataxó localizada na cidade de Itapecerica- MG, acerca da educação intercultural. Trata-se de uma pesquisa qualitativa, que utilizou a revisão de literatura, entrevistas narrativas, bem como análise documental como método de pesquisa. Apoiando em estudos sobre interculturalidade, e em uma coletânea das histórias indígenas contadas na comunidade em questão, foi possível entrecruzar as vozes da comunidade indígena, constatando que a educação intercultural é uma maneira (...) de legitimar direitos às minorias indígenas e um modo de fortalecer suas tradições culturais. Através das histórias indígenas e de outras ferramentas educativas utilizadas na escola da aldeia Muã Mimatxi, a comunidade indígena se mostra como agente ciente da própria educação, em diálogo constante com outros conhecimentos e tradições, a fim de construir seus projetos de futuro. Allocation of healthcare resources is clearly associated with the concept of distributive justice and to the existence of a right to healthcare. Nevertheless, there is still the question of whether this right should include all types of healthcare services or if it should be limited to selected types. It follows that choices must be made, priorities must be set and that efficiency of healthcare services should be maximum.

A espiritualidade não está presente apenas no indivíduo adulto. As crianças possuem experiências espontâneas e genuínas com o sagrado. Essa pesquisa teve como objetivo conduzir uma revisão sistemática da literatura para acessar estudos sobre Espiritualidade Infantil. Para tanto, foi realizado um levantamento nas bases de dados: CAPES, SCIELO e ERIC no período de 2010 a 2020. Foram incluídos estudos que avaliaram alguma faceta da espiritualidade em crianças e adolescentes, publicados em inglês, português ou espanhol, no período entre 2010 e 2020. (...) Dos 380 artigos identificados, após exclusões iniciais, 80 foram classificados para leitura completa e 15 para análise qualitativa. Visualizou-se que ainda há poucos estudos sobre espiritualidade infantil, principalmente no Brasil, e a maioria dos estudos utilizou entrevistas para coleta de dados. (shrink)

Aurélio Agostinho, when he was consecrated bishop in Hippo, had contact with a community in a situation of extreme social inequality, and adding to his understanding of bidirectional love (to God and neighbor), translated into nonconformity with the suffering of others, in the function as a bishop he had the opportunity to fight with the weapons at his disposal for a less undignified life for the poorest. Therefore, the concept of poverty that appears between the lines of his texts and (...) sermons is translated as a lack of material resources that makes it impossible for people to get the basics for survival. Among the weapons used by the philosopher bishop is the exhortation in his sermons, which in addition to denouncing the intense inequality of society, pondered on ways to resolve this huge gap between rich and poor. Thus, in this article we will analyze Augustine's lucubrations in sermons: 345, 355, 60, 61, 161, 14, which critically reflect poverty and wealth. The aforementioned sermons stand out on the subject for their critical reflections, because, although they treat the rich and their accumulation of wealth very harshly, showing solidarity with the less favored, and at different times they also have a critical look at the poor they idealized as a dream., desire or life goal to possess riches. The increasing costs of healthcare delivery led to different political and administrative approaches trying to preserve the core values of the welfare state. This approach has well documented weaknesses namely with regard to healthcare rationing. The objective of this paper is to evaluate if independent healthcare regulation is an important tool with regard to the construction of fair processes for setting limits to healthcare. Methodologically the authors depart from Norman Daniels’ and James Sabin’s theory of accountability for reasonableness and try (...) to determine if new regulatory models—namely independent agencies—perform better with regard to the public disclosure of the reasons and rationales of healthcare rationing. In publicly financed healthcare systems independent regulation is an important tool to assure fair and reasonable procedures of prioritising services. In accordance with the principle of public accountability, independent regulatory agencies are particularly well suited to assure publicity of the decision-making processes, relevance of the rationale involved and particularly mechanisms for challenge and dispute resolution regarding limit setting decisions. It follows that independent healthcare regulation could be regarded not only as an instrument for performance improvement but also as a tool of social justice. The authors conclude by stating that accountability for reasonableness should be regarded as a landmark of any healthcare reform. And therefore regulators have the social task of assuring that the rationales for limit-setting decisions are clearly accessible to the public. (shrink)

O presente artigo apresenta uma série de considerações sobre o tema do racismo no pensamento Iluminista com a intenção tanto de contribuir para a análise dos fundamentos do racismo moderno quanto para apresentar uma defesa da história da filosofia como disciplina capaz de auxiliar a tarefa de crítica filosófica de nosso presente. Em primeiro lugar, sugere uma série de reflexões gerais sobre maneiras de abordar e aprofundar a reflexão sobre o racismo no pensamento moderno, sobretudo no século XVIII. Em segundo (...) lugar, reflete sobre a categoria Iluminismo considerando seus aspectos históricos e filosóficos e a variedades de posições filosóficas que a noção abriga. Por fim, considera as manifestações racistas dentro da obra de Voltaire, levando em conta os comentários anteriores e a ambivalência das posições do autor para mostrar que seu racismo não se funda em uma filosofia da história como defesa da civilização europeia, mas em suas posições poligenistas gestadas em seu embate contra a ortodoxia cristã e sua explicação da origem dos seres humanos. Resumo Plotino é um pensador estranho para o filósofo contemporâneo: nas suas Enéadas, ele discute experiência mística e prática filosófica como se fosse uma mesma coisa. De fato, no pensamento plotiniano, o ápice da vida filosófica é a contemplação mística: não pensamento irracional, mas uma forma supra-racional de consciência que é alcançada pela prática ascética e pelo procedimento dialético. Este artigo tenta entender o que é a experiência mística em Plotino. Na verdade, uma leitura atenta dos textos das Enéadas que (...) tratam do assunto mostram que não existe apenas um, mas dois tipos de contemplação mística supra-racional: a experiência da alma humana unida ao Intelecto divino e a experiência da alma humana unida ao Um, o princípio supremo da realidade de acordo com a filosofia plotiniana. Ambos são tipos de intuição intelectual interior, mas, se a experiência mística do Intelecto é a contemplação da totalidade do mundo inteligível, a contemplação do Um é a intuição da identidade pura, além de toda a diferença. Palavras-chave: Plotino; Neoplatonismo; Mística.Plotinus is a strange scholar to the contemporary philosopher: in his Enneads, he discusses mystical experience and philosophical practice as if they were the same thing. Indeed, according to his thoughts, the summit of philosophical life is mystical contemplation: not irrational thinking, but a supra-rational form of consciousness achieved through ascetic practice and dialectical procedure. This paper attempts to understand the mystical experience in Plotinus. In fact, a close reading of the texts of the Enneads on the subject demonstrates that there are not only one, but two kinds of supra-rational mystical contemplation: the experience of the human soul united to the divine Intellect and the experience of the human soul united to the One, the supreme principle of reality according to Plotinus's philosophy. Both are kinds of interior intellectual intuition, but if the mystical experience of the Intellect is the contemplation of the whole of the intelligible world, the contemplation of the One is the intuition of pure identity, beyond all difference. O objetivo do artigo é indicar que na crítica a Fichte em Fé e saber, referida à noção de crença de Jacobi, já se pode vislumbrar dentro de certos limites e desvios a posição de Hegel nas Lições sobre a história da filosofia sobre o vínculo entre Schelling e Jacobi no que diz respeito às noções de intuição intelectual e saber imediato.

The article presupposes that the term “spirituality”, originally proper to the theological literature, no longer belongs only to this field, and is now widely used in different areas of knowledge. The essay also says that, even within the theological and religious studies, there has never been clarity as to the meaning of “spirituality”, which eventually became a vague and imprecise term, invoked in different situations and in need of a deeper theoretical reflection able to point its history, its development and (...) multiple applications. The vagueness around this concept is increased when “spirituality” is used along with the expression “non-religious”, causing more difficulties of understanding even in the field of religious studies. After delving into these conceptual challenges, the article points to the need for a comprehensive review of the literature in order to identify similarities with other areas of knowledge in recent decades that have progressively absorbed this concept, particularly the fields of arts, psychology, business administration, organizational studies, neuroscience and health sciences. At the end, the article offers challenges and suggestions for the development of the studies around this theme among researches of Religious Sciences in Brazil that privilege interdisciplinary approaches in their research. In all countries where health care access is considered a social right, regulation is both a tool of performance improvement as well as an instrument of social justice. Both social (equity in access) and economical (promoting competition) regulation are at stake due to the nature of the good itself. Different modalities of regulation do exist and usually new regulatory cycles include the creation of stronger regulatory agencies. Indeed, health care regulation is rising steadily in most developed countries as a consequence (...) of the introduction of the New Public Management perspective to provide essential public goods.Health care is delivered by different organisations with very different cultural backgrounds—public and private (profit and non-profit)—that should be accountable for their decisions. Control by regulatory agencies is instrumental to accomplish this goal. However, there is some dispute with regards the degree of regulatory autonomy. The objective of this paper is to determine if independent regulatory agencies (IRAs) are effective in carrying out health care regulation. The authors apply Walshe’s analytical framework to the Regulatory Authority of Health (Portugal) to answer the question if independent regulation works.In conclusion, the two year experience of the Regulatory Authority of Health is important not only because the primary goals of independent regulation were achieved but also because this authority is now a full partner in the health care sector. However, independent agencies need to develop strong mechanisms of accountability because good regulatory governance is the paradigm of this institutional innovation. (shrink)

We perceive smells as perduring complex entities within a distal array that might be conceived of as smellscapes. However, the philosophical orthodoxy of Odor Theories has been to deny that smells are perceived as having a distal location. Recent challenges have been mounted to Odor Theories’ veracity in handling the timescale of olfactory perception, how it individuates odors as a distal entities, and their claim that olfactory perception is not spatial. The paper does not aim to dispute these criticisms. Rather, (...) what will be shown is that Molecular Structure Theory, a refinement of Odor Theory, can be further developed to handle these challenges. The theory is further refined by focusing on distal perception that requires considering the perceptual object as mereologically complex persisting odor against a background scene conceived of as a smellscape. What will be offered is an expansion of Molecular Structure Theory to account for distal smell perception within natural environments. (shrink)

Sua profunda introspecção, suas experiências supra-racionais e seu gênio filosófico tornaram-no capaz de desenvolver uma noção nova do eu, desconhecida pelos pensadores gregos anteriores, que está intimamente relacionada com as noções de parakoloúthesis, sunaísthesis e súnesis. Alguns estudiosos pensam esse eu plotiniano como uma espécie de eu móvel, mas, pelo contrário, passagens importantes das Enéadas afirmam que o eu é a alma. Tendo essas passagens em mente, nesse artigo, tento pensar o eu (...) plotiniano não como um eu móvel, mas como uma alma que possui diferentes níveis de eu e de consciência. (shrink)

The lack of economic sustainability of most healthcare systems and a higher demand for quality and safety has contributed to the development of regulation as a decisive factor for modernisation, innovation and competitiveness in the health sector. The aim of this paper is to determine the importance of the principle of public accountability in healthcare regulation, stressing the fact that sunshine regulation—as a direct and transparent control over health activities—is vital for an effective regulatory activity, for an appropriate supervision of (...) the different agents, to avoid quality shading problems and for healthy competition in this sector. Methodologically, the authors depart from Kieran Walshe’s regulatory theory that foresees healthcare regulation as an instrument of performance improvement and they articulate this theory with the different regulatory strategies. The authors conclude that sunshine regulation takes on a special relevance as, by promoting publicity of the performance indicators, it contributes directly and indirectly to an overall improvement of the healthcare services, namely in countries were citizens are more critical with regard to the overall performance of the system. Indeed, sunshine regulation contributes to the achievement of high levels of transparency, which are fundamental to overcoming some of the market failures that are inevitable in the transformation of a vertical and integrated public system into a decentralised network where entrepreneurialism appears to be the predominant culture.
