What is the proper punishment from the perspective of the libertarian philosophy? More specifically, in what way, if at all, may a thief benefit from his robbery? The present essay attempts to wrestle with these challenging questions.

Catholics and libertarians make strange bedfellows. They sharply disagree on many issues. However, when it comes to intellectual property rights, they are surprisingly congruent, albeit for different reasons. The present paper traces out the agreement on patents between these two very different philosophies.

Freedom to smoke is part and parcel of overall freedom. The former cannot be abrogated without violating the latter. The present paper applies this insight to the regulations placed on the tobacco industry and smoking in general. We find that government interventions into people’s lives regarding smoking are highly incompatible with libertarian principles. We examine many regulations such as prohibiting youths from smoking, preventing second hand smoke, restrictions on advertising, taxing the industry, and liability issues.

Meaningful relationships are centrally important for human functioning. It remains unclear, however, which aspects of meaningful relationships impact wellbeing the most and whether these differ between psychiatric patients and members of the community. Information about relationship attributes and functions were collected in community members and psychiatric patients. Relationship attributes and functions were examined for differences between groups, their impact on wellbeing and symptoms, and the size of network. Community members reported fewer relationships, higher frequency of contact and less desire for (...) change when compared to the psychiatric patients. Nevertheless, both groups reported relatively high levels of fulfilled functions. Quality of the relationship and investment into the relationship was associated with both wellbeing and symptoms for both the community and the patient group. Almost all functions were associated with wellbeing and symptoms for the community group. However, for the patient group, only few functions were associated with wellbeing and no functions were associated with symptoms. Contrary to our hypotheses, the results show that psychiatric patients do not have a deficit in fulfilling relationships. Most people report a well-functioning network of meaningful, high-quality relationships. Patients benefit from meaningful, function-fulfilling relationships just as much as community members. Results are discussed with respect to how targeting relationships can be used clinically. (shrink)

This study furthers scholarship on the religion-entrepreneurship link by proposing that aspects of a country’s religious profile impact individual entrepreneurial activity differently and that a country’s level of investments in knowledge serves as a contingency factor in this milieu. Our cross-level analyses of data from 9,266 individuals and 27 predominantly Christian countries support the second, but not the first suggestion. The study contributes to a more nuanced understanding of religion’s role for entrepreneurship and bridges the literatures on religion and knowledge-based (...) entrepreneurship. Furthermore, the study provides evidence of the effects of religion above and beyond the effects of national culture. (shrink)

The conception of a ‘law of nature’ is a human product. It was created to play a role in natural philosophy, in the Cartesian tradition. In light of this, philosophers and scientists must sort out what they mean by a law of nature before evaluating rival theories and approaches. If one’s conception of the laws of nature is yoked to metaphysical notions of truth and explanation, that connection must be made explicit and defended. If, on the other hand, one’s aim (...) is to disentangle laws from truth or from explanation, that must be stated and defended as well. If philosophers do not make such assumptions, intuitions, and methodological commitments clear, then it will be impossible to identify the source of disagreement in debates about the laws of nature. Are the conflicts rooted in disagreement about the conclusions reached, or do the background commitments of the combatants block any resolution to the dispute in principle or in practice? (shrink)

What is the nature of consciousness? How is consciousness related to brain processes? This volume collects thirteen new papers on these topics: twelve by leading and respected philosophers and one by a leading color-vision scientist. All focus on consciousness in the "phenomenal" sense: on what it's like to have an experience. Consciousness has long been regarded as the biggest stumbling block for physicalism, the view that the mind is physical. The controversy has gained focus over the last few decades, and (...) phenomenal knowledge and phenomenal concepts--knowledge of consciousness and the associated concepts--have come to play increasingly prominent roles in this debate. Consider Frank Jackson's famous case of Mary, the super-scientist who learns all the physical information while confined in a black-and-white room. According to Jackson, if physicalism is true, then Mary's physical knowledge should allow her to deduce what it's like to see in color. Yet it seems intuitively clear that she learns something when she leaves the room. But then how can consciousness be physical? Arguably, whether this sort of reasoning is sound depends on how phenomenal concepts and phenomenal knowledge are construed. For example, some argue that the Mary case reveals something about phenomenal concepts but has no implications for the nature of consciousness itself. Are responses along these lines adequate? Or does the problem arise again at the level of phenomenal concepts? The papers in this volume engage with the latest developments in this debate. The authors' perspectives range widely. For example, Daniel Dennett argues that anti-physicalist arguments such as the knowledge argument are simply confused; David Papineau grants that such arguments at least reveal important features of phenomenal concepts; and David Chalmers defends the anti-physicalist arguments, arguing that the "phenomenal concept strategy" cannot succeed. “Decortication” does not distinguish between removing all cerebral cortex, including three-layered allocortex or just six-layered neocortex. Functional decortication, by spreading depression, reversibly suppresses only neocortex, leaving minimal intentionality. Removal of all forebrain structures except a hypothalamic “island” blocks all intentional behaviors, leaving only tropisms. To what extent do Merker's examples retain allocortex, and how might such residues affect his interpretations? (Published Online May 1 2007).

This article introduces the three-valuedweakly-intuitionistic logicI 1 as a counterpart of theparaconsistent calculusP 1 studied in [11].I 1 is shown to be complete with respect to certainthree-valued matrices. We also show that in the sense that any proper extension ofI 1 collapses to classical logic.The second part shows thatI 1 is algebraizable in the sense of Block and Pigozzi (cf. [2]) in a way very similar to the algebraization ofP 1 given in [8].

The present paper focuses on the heuristic selection process preceding the actual transitive reasoning process. A part of the difficulty of transitive reasoning lies in the selection of the relevant problem aspects. Two experiments are presented using the paradigm introduced by Markovits, Dumas, and Malfait (1995), in which children were asked to make “higher than” inferences about arrays of coloured blocks. In order to discriminate between genuine transitive inference and a simple strategy of relative position, Markovits et al. interspersed white (...) blocks with the coloured blocks, such that the relative position strategy leads to erroneous responses. However, we argue that the white blocks cause confusion due to their ambiguity, which interferes with the heuristic selection process. Two methodological adaptations were introduced, which are hypothesised to facilitate the selection process and improve transitive reasoning: (1) the white blocks were replaced by coloured blocks, and (2) a less abstract context was added to the experimental design. The colour manipulation leads to a clear increase in the use of a transitive strategy by 9-year-old children; 8-year-old children mainly used the relative position strategy. When adding a context story, 9-year-old children used the transitive strategy regardless of the colour of the interspersed blocks. The overall performance of 8-year-olds improved slightly. These results are interpreted as support for a dual-process model of transitive reasoning. (shrink)

In his book, Defending the Undefendable, Walter Block makes the case that an individual counterfeiter of fiat notes does not commit a natural law crime, because money issued by the government is itself counterfeit. Several authors, including Murphy, Machaj, and Davidson, have taken issue with Block’s argument. In Davidson, I maintain that while the issuance and use of fiat currency by the state violates the natural law, fiat notes are not counterfeit, and their use by ordinary people is legitimate. (...) The private counterfeiter is a thief when he exchanges his notes with these innocents, because they are rightful owners of both the fiat currency and the goods for which it is exchanged. Block, in a rejoinder, disputes this on both ethical and utilitarian grounds. The present paper is a response to Block, and an elaboration of my original article. From a natural law perspective, I explore the ethical violations surrounding counterfeiting, and the legitimacy of producing and using fiat money by both the state and the individual. (shrink)

I address Walter Block’s recent criticisms of my book, Dialogues on Ethical Vegetarianism. Methodologically, Block relies too much on appeals to contentious and extreme assumptions. Substantively, most of his objections are irrelevant to the central issue of the book. Those that are relevant turn on false assumptions or lead to absurd consequences. In the end, Block’s claim to oppose suffering cannot be reconciled with his indifference to a practice that probably causes, every few years, more suffering than all the (...) suffering in human history. A standard argument for ethical vegetarianism contends that factory farming – the source of nearly all animal products – is morally wrong due to its extreme cruelty, and that it is wrong to buy products produced in an extremely immoral manner. This article defends this argument against objections based on appeal to libertarian political philosophy, the supposed benefit to animals of being raised for food, and nonhuman animals’ supposed lack of rights.

David Friedman posed a number of libertarian philosophical problems (Friedman 1989). This essay criticizes Walter Block’s Rothbardian responses (Block 2011) and compares them with J C Lester’s critical-rationalist, libertarian-theory responses (Lester [2000] 2012). The main issues are as follows. 1. Critical rationalism and how it applies to libertarianism. 2.1. How libertarianism is not inherently about law and is inherently about morals. 2.2. In his paper, “Is There an ‘Anomalous’ Section of the Laffer Curve?”, Walter Block describes some situations in which it appears that a libertarian should violate the non-aggression principle. To rectify this, Block proposes a different perspective on libertarianism which he calls punishment theory. This paper argues that no new theory is needed, as the non-aggression principle can be used to resolve the apparent conundrums.

The present paper is an attempt to show that Walter Block’s defense of the ostensibly libertarian character of evictionism against my original criticisms is unsuccessful, thought certainly informative and thought-provoking. In my exploration of Block’s counter-criticisms, I focus in particular on the role played in his account by the principle of proportionality, as well as on the putative disanalogy between cases of abortion and child abandonment on the one hand and my airplane thought experiment on the other hand.

This special issue aims to explore and investigate a new subfield, namely experimental philosophy of medicine. Whereas experimental philosophy is relatively new on the philosophical block, some of its takes and findings have already shaped central debates in ethics, philosophy of action, philosophy of language, and epistemology. Interestingly, the approach of this program was for a long time almost wholly ignored within bioethics and philosophy of medicine—although this seems to have changed somewhat recently. “Paris, Capital of the Nineteenth Century” juxtaposes elliptical descriptions that reveal the interiorization of commodities in the economy of high capitalism. “Allegory in the nineteenth century vacated the outer world, to colonize the inner world.”32 Each of the exposé’s six sections consists of two parts: “Fourier, or the Arcades,” “Daguerre, or the Panoramas,” “Grandville, or the World Exhibitions,” “Louis-Philippe, or the Interior,” “Baudelaire, or the Streets of Paris,” “Haussmann, or the Baricades.”33The commercial arcade and not the factory is the logical (...) starting point for Benjamin. Paris, like London, the other capital of nineteenth-century capitalism, is an administrative and financial but not an industrial center. Paris is the locus classicus of bourgeois culture, which finds its most conspicuous expression in the arcade. The arcade cuts through and commercializes the residential block. It harnesses the technology of cast-iron “Pompeian” pillars, to offer in its enticing bay windows the latest, most sophisticated form of bourgeois merchandising. Fourier houses his “land of Cockaigne” in a “reactionary modification” of the arcade.34Parallel to the technical innovation of the arcades is that of the lifelike painted panoramas, which serve Jacques-Louis David’s pupils when they “draw from nature.” Politically superior, the city still dreams of the country. “The panoramas, which declare a revolution in the relation of art to technology, are at the same time an expression of a new feeling about life.”35 They drive a wedge between “plastic foreground” and “informational base.” The worker in the literary panorama is “a trimming for an idyll.” Technical innovations in photography reduce the representational significance of painting. Now photography “is given the task of making discoveries”: it explores the sewers and catacombs. It markets events. In a recent paper, Walter Gilbert's group has estimated the number of original exons from which all extant proteins might have been constructed. The approach used is subjected to a critical analysis here. It is shown that there are flawed assumptions about both the mechanism and generality of exon‐shuffling and in the sequence comparison procedures employed, the latter failing to distinguish chance similarity from similarity due to common ancestry. These methodological errors lead to the omission of many known cases (...) of exonshuffling and the inclusion of others which may not be genuine. In consequence, the analysis from the Gilbert group cannot give a reliable estimate of those modules that actually participated in exon‐shuffling and provides no information on the number of protein archetypes that did not participate in these processes. In Time Deposits, Dimension, and Fraud (2009), William Barnett and Walter Block argue that by borrowing short and lending long there is an over issuance of property rights. Their article, however, does not fully extend the consequences of their contribution. Once this is done, it becomes clearer that their argument suits a great impediment to banking, becoming a possible reason to support rather than to oppose fractional reserve banking. Bagus and Howden (J Bus Ethics 90(3):399–406, 2009) comment on Barnett (...) and Block (J Bus Ethics 88(4):711–716, 2009), the authors claim that while maintaining the illegitimacy of fractional reserve deposits, borrowing short and lending long it is actually not illegitimate. An extension on Bagus and Howden (2009) will show that their line of argumentation can be applied as a defense of fractional reserve banking as well. (shrink)

The Architectonics of Meaning is a lucid demonstration of the purposes, methods, and implications of philosophical semantics that both supports and builds on Richard McKeon's and other noted pluralists' convictions that multiple philosophical approaches are viable. Watson ingeniously explores ways to systematize these approaches, and the result is a well-structured instrument for understanding texts. This book exemplifies both general and particular aspects of systematic pluralism, reorienting our understanding of the realms of knowing, doing, and making.

Are demands for equality motivated by envy? Nietzsche, Freud, Hayek, and Nozick all thought so. Call this the Envy Objection. For egalitarians, the Envy Objection is meant to sting. Many egalitarians have tried to evade the Envy Objection.. But should egalitarians be worried about envy? In this paper, I argue that egalitarians should stop worrying and learn to love envy. I argue that the persistent unwillingness to embrace the Envy Objection is rooted in a common misunderstanding of the nature of (...) the charge, what it reveals, and what can be said in response to it. I develop what Bernard Williams might call a vindicatory genealogy of envy, thereby allowing us to see that envy, rather than undermining egalitarian intuitions, can in fact play a distinct justificatory role (when it is fitting), which undermines the Envy Objection. Dorothy Edgington’s work has been at the centre of a range of ongoing debates in philosophical logic, philosophy of mind and language, metaphysics, and epistemology. This work has focused, although by no means exclusively, on the overlapping areas of conditionals, probability, and paradox. In what follows, I briefly sketch some themes from these three areas relevant to Dorothy’s work, highlighting how some of Dorothy’s work and some of the contributions of this volume fit in to these debates.

The explanatory gap . Consciousness is a mystery. No one has ever given an account, even a highly speculative, hypothetical, and incomplete account of how a physical thing could have phenomenal states. Suppose that consciousness is identical to a property of the brain, say activity in the pyramidal cells of layer 5 of the cortex involving reverberatory circuits from cortical layer 6 to the thalamus and back to layers 4 and 6,as Crick and Koch have suggested for visual consciousness. .) (...) Still, that identity itself calls out for explanation! Proponents of an explanatory gap disagree about whether the gap is permanent. Some say that we are like the scientifically naive person who is told that matter = energy, but does not have the concepts required to make sense of the idea. If we can acquire these concepts, the gap is closable. Others say the gap is uncloseable because of our cognitive limitations. Still others say that the gap is a consequence of the fundamental nature of consciousness. (shrink)

Based on a comparison of various sources, such as different editions, correspondence, reviews, and lecture transcripts, it is shown that Ludwig Heinrich Jakob’s Outline of the General Logic and Critical Elements of Metaphysics in General uses one or more transcripts of Kant’s Logic Lectures as a source. In addition to the thus far known texts by Kiesewetter and Hippel, Jakob’s textbook should therefore also be added to the list of secondary transmissions of Kant’s Logic Lectures.
