En terminant, je tisse des liens avec la philosophie de Jean Hampton, afin de stimuler la discussion autour des travaux inédits de Bhandary, qui élargissent l'influence de la théorisation libérale féministe contemporaine. This contribution discusses Asha Bhandary’s book Freedom to Care: Liberalism, Dependency Care and Justice and engages with some key concepts used by three commentators Daniel Engster, Kelly Gawel, and Andrea Westlund in this book symposium. The symposium makes it clear that care can be a central notion not only in the ethics of care, but also in debates about liberalism, justice and autonomy.

In this paper I examine and elaborate on Asha Bhandary’s conception of autonomy, and take up the question of what education for autonomy, thus understood, might require. I argue that educating for autonomy requires educators to impart, to students, an interlocking set of dialogical or relational skills that center responsiveness to the perspectives of others, and that these skills significantly overlap with the skills required for basic education in care.

This article claims that Asha Bhandary’s theory of justice in Freedom to Care: Liberalism, Dependency Care, and Culture is right to stress the interdependency of justice and care in addressing structural oppressions, but wrong in upholding liberalism’s capacity for doing so. Against her procedural mechanism of education for caregiving skills in particular, I point to the critical and generative methods of social reproduction feminism and Transformative Justice as models of radical praxis in the collective work of politically centering and (...) radically transforming cultures of care. The novelty is to claim that such care is among the Rawlsian circumstances of justice. I argue that liberalism does not support this extremely strong claim. Dependency care is indeed among the goods generated by social cooperation, broadly speaking—but so are virtually all goods, such as pizza provision, scarcely any of which are (...) among the circumstances of justice. Most of us have ample inclination toward caring for dependents—but neither is this extended to everyone else’s dependents, nor is it mostly a legal duty, as indeed having children at all is not. Nor should it be on liberal principles. Neither of the two Rawlsian Principles support general dependency care. And, Bhandary’s “strong proceduralism,” calling for the training of all persons in care-giving skills, would edge up toward totalitarianism—hardly a welcome outcome of liberalism. (shrink)

RésuméJohn Rawls et Asha Bhandary utilisent les conditions de justice définies par David Hume pour encadrer le choix de la position originale à partir de laquelle les principes de justice sont sélectionnés. Utiliser les conditions de Hume de cette manière exclut de la représentation ceux qui ne sont pas des coopérateurs à part entière, y compris les personnes qui ont besoin de soins de dépendance pendant toute la vie. Cela implique que la demande de soins de ces personnes n'est (...) pas une revendication fondamentale de justice, mais qu'elle doit avoir une priorité nettement inférieure. Cet article soutient qu'une théorie libérale appropriée de la prise en charge de la dépendance abandonnera ce cadrage humien et traitera la demande de prise en charge de la dépendance comme une exigence fondamentale de justice. Asha Bhandary’s Freedom to Care represents an important challenge to the idea that care ethics and liberalism necessarily stand in tension, arguing instead that most of the commitments of care ethics can be integrated within a recognizably mainstream liberal contract theory. Although I am sympathetic to Bhandary’s project, I identify three ways in which it falls short: Bhandary’s thin moral premises fail to support decent care for all; her survival baseline principle of care does not support some important forms (...) of care; and her proceduralist approach offers little alternative other than coercion for assuring sufficient care for all. I argue a thicker set of moral assumptions based on the importance of decent care for all are necessary for reconciling liberalism and care ethics on more equal terms. (shrink)

La théorie d'Asha Bhandary sur la prise en charge libérale de la dépendance cherche autant à rectifier l'invisibilité des soins qu’à défendre les principes de justice concernant les modalités de soins en revendiquant plusieurs modifications importantes à la théorie de la justice de John Rawls. Dans cet article, j'analyse les modifications de Bhandary à la théorie de Rawls pour examiner (...) comment la prise en charge libérale de la dépendance s'intègre dans un cadre politique libéral plus large, tout en protégeant contre l'oppression. With the advent of social media and increase in networked publics, context collapse has emerged as a critical topic in the discussion of imagined audiences and blurring of the private and the public. The meshing of social contexts portends problematic issues as messages inadvertently reach unimagined audiences causing shame and leading to loss of ‘face’. In this article, we specifically study the impact of context collapse on some celebrities ‘who had it all’ yet, lost ‘it some’ to the world of (...) networked public. The article examines celebrities sharing identity information across multiple contexts and explores situations of lost fame when ‘face’ is threatened, usage falters and breaks some of the well-established norms of interactivity. It concludes that lack of prudence in separating social contexts, loss of ‘face’ and social approval can dampen online celebrity presence. It proposes the use of ‘polysemy’ to simultaneously appeal to audiences from different contexts. (shrink)

Invested with the capacity to reinstate physiological order, medicines are at the centre of contemporary health care. Their purpose and efficacy are generally seen as predictable and concrete: disease = therapy = outcome. These culturally specific understandings shape the practices and meanings of taking medicines. This article, however, queries what actually takes place when human bodies and medical drugs converge. Is it a solely therapeutic affair, a restoration of bodily normality, or one of multiple transformations? The ambivalent meaning of the (...) original Greek word for drug, pharmakon, intimates the potential of medicines to act as ‘remedy’ as well as ‘poison’. Using pharmakon as a conceptual tool, the article explores the complex, and often paradoxical corporeal effects of HIV combination therapy, with particular focus on lipodystrophy, a peculiar change in people‘s body shape. This unintended and frequently distressing iatro-genic phenomenon challenges common notions of therapeutic efficacy and causality and foregrounds the productive dimension of medical drugs - their capacity to reconfigure bodies, diseases and identities in multiple, unpredictable ways. Once we shift the intension of the concept of wage-labour from juridical attributes of negative ownership and contractual freedom to the actual performance of capital-positing labour, the extension of the concept – the cases that fall under it – changes as well. Once the concept of wage-labour is intensively re-defined as capital-positing labour, it becomes evident that the history and the geographical scope of wage-labour have not been well understood. A person’s financial well-being is the complete contentment gained from one’s present financial condition. This has a powerful impact on the entire achievement of an employee’s “well-being.” Researchers, financial analysts, financial planners, educationists, and economists have explored the “enablers” to improve employees’ living standards by investigating the possible “FWB” resources for decades. There is no literature available to show the connection between social capital theory, social exchange theory, social cognitive theory, financial literacy and FWB, and employees’ financial knowledge sharing a (...) moderator to expand the complete FWB. As a legal aid union president in New Haven, laboring within shouting distance of a different large research university, I recall how our membership rolled our eyes when Professors Greiner, Pattanayak, and Hennesy of Harvard published their study providing evidence, through a randomized control trial, that law clinic housing work made no difference for clients.1 Representing, as I was, “lawyers, secretaries, and paralegals who have dedicated their careers to serving poor clients in crisis,”2 the authors’ conclusion generated first shock, then (...) denial, and then an anxious realization that somebody’s job was to research and disseminate such conclusions. In a 2013 United States where there was one legal aid lawyer for every 8,893 people who qualified,3 where federal Legal Services Corporation funding had dropped 40% over ten years in real dollars,4 and in an America that spends as much on Halloween costumes for its pets as it does legal aid for the poor,5 the inquiry felt like a pile-on. It made no more sense to us than asking if a teacher is “good for students,” a nurse “good for the sick,” or a chef “good for the hungry.”6. (shrink)

The shift to companionate marriage in South Asia and elsewhere is widely read as a move from ‘tradition’ to ‘modernity’ resulting in an expansion of individual agency, especially for women. This paper critically examines the narratives of urban middle-class women in Sri Lanka spanning three generations to illustrate that rather than indicating a radical shift in the way they negotiated between individual desires and social norms, the emphasis on ‘choice’ signals a shift in the narrative devices used in the presentation (...) of the ‘self’. The paper illustrates how young women's narratives about marriage appear to suggest ‘modernity’ as inevitable—that its processes are reconstituting the person who, less constrained by ‘tradition’ and collective expectations, is now experiencing greater freedom in the domain of marriage. However, it also shows how urban middle-class families in Sri Lanka have collectively invested in the narrative of choice through which ‘a choosing person’ is consciously created as a mark of the family's modernity and progress. Rather than signalling freedom, these narratives about choice reveal how women are often burdened with the risks and responsibility of agency. The paper illustrates that the ‘choosing person’ is produced through narratives that emphasise agency as a responsibility that must be exercised with caution because women are expected by and obligated to their families to make the ‘right’ choices. Hence, a closer look at the individualised ‘choosing person’ reveals a less unitary, relational self with permeable boundaries embedded within and accountable to family and kinship. (shrink)

The main concern in this paper is to explore the relationship between Jaina ethics and meditation techniques proposed in the Jaina scriptures and its foundations. Meditative practices have been practiced in Jaina tradition for centuries. We also find a difference between the interpretation of scriptures regarding meditation, and it also sometimes gets translated into the practice of meditation. In the case of Jaina tradition, it is challenging to separate ethics from the spiritual path of liberation and meditation as a practice. (...) In this paper, based on Tattvartha Sutra, Uttaradhyayana, and Acaranga Sutra, I have tried to show that ethics in its restricted sense can be seen as only one aspect of meditation, but in its broader sense, the whole spiritual path suggested in the Jaina scriptures can be seen as meditation. The fourteen stages suggested in the Jaina scriptures can be considered the stages of ethical path or meditation. We can see preksha dhyana - a recent form of meditation that translates these stages into more acceptable to the laymen - a popular and simple form of the spiritual path in modern times. Nevertheless, in the end, the ultimate aim remains the same - self-purification through the Karmic cycle. (shrink)

The COVID-19 pandemic laid bare systemic inequities shaped by social determinants of health (SDoH). Public health agencies, legislators, health systems, and community organizations took notice, and there is currently unprecedented interest in identifying and implementing programs to address SDoH. This special issue focuses on the role of medical-legal partnerships (MLPs) in addressing SDoH and racial and social inequities, as well as the need to support these efforts with evidence-based research, data, and meaningful partnerships and funding.

This article assesses which policies for addressing antibiotic resistance as part of a multi-pronged approach would benefit from legalization through an international legal agreement. Ten candidate policies were identified based on a review of existing literature, especially The Lancet Series on Antimicrobial Resistance, The Lancet Infectious Diseases Commission on AMR, and the World Health Organization Global Action Plan for AMR. These policies were then grouped under the headings of access, conservation, and innovation.Each of the ten policies were assessed using four (...) criteria developed by Hoffman, Røttingen, and Frenk to help consider why their legalization may be helpful, necessary and/or justified. These criteria are: the problem has a significant transnational dimension; the goal justifies the coercive nature of law; the outcome is likely to be beneficial; and legalization represents the best commitment mechanism among competing alternatives. Plagiarism is increasingly evident in business and academia. Though links between demographic, personality, and situational factors have been found, previous research has not used actual plagiarism behavior as a criterion variable. Previous research on academic dishonesty has consistently used self-report measures to establish prevalence of dishonest behavior. In this study we use actual plagiarism behavior to establish its prevalence, as well as relationships between integrity-related personal selection and workplace deviance measures. This research covers new ground in two respects: (a) That (...) the academic dishonesty literature is subject to revision using criterion variables to avoid self bias and social desirability issues and (b) we establish the relationship between actual academic dishonesty and potential workplace deviance/white-collar crime. In the world today, human beings are confronted with a number of problems due ultimately to the apparent conflicts among the different religions (religious faiths). Religious attitudes, ideas, and practices differ and even seem to be incompatible with one another. I argue, however, that these faiths do not contradict. To see this, we need to engage in the comparative study of religion. This will show that the ultimate aim of all the world's religions is to establish unity among people, and (...) will thereby provide a basis for tolerance and understanding on the part of the followers of every religion towards other religions. Tax law changes at a startling rate - not only does societal change bring with it demands for change in the tax system, but changes in the political climate will force change, as will many other competing pressures. With this pace of change, it is easy to focus on the practical and forget the core underpinnings of the tax system and their philosophical justifications. Taking a pause to remind ourselves of those principles and how they can operate in the modern (...) tax system is crucial to ensuring that the tax system does not diverge too far from what it should be or could be. It is essential to understand the answers to some of the seemingly basic questions that surround tax before we can even begin to think about what a tax system should look like. This collection brings together major themes and difficult questions in the philosophical foundations of tax law. The chapters consider practical issues such as justification, enforcement, design, and mechanics, and provide a full and coherent analysis of the basis for tax law. Philosophical Foundations of Tax Law allows the reader to consider how tax systems should move forward in the modern world, with a sound philosophical basis, to provide the practical tax system that the state requires and citizens deserve. The prime concern of education is to evolve the good, the true and the divine in man so as to establish a moral life in the world. It should essentially make a man pious, perfect and truthful. The welfare of humanity lies neither in scientific or technological advancements nor in acquisition of material comforts. The main function of education is to enrich the character. What we need today more than anything else is moral leadership founded on courage, intellectual integrity and (...) a sense of values. Since education is a powerful instrument of social change and human progress, it is also a powerful tool to cultivate values in an individual. Therefore all the educational institutes have greater responsibility to impart learning and cultivation of values through education. For inculcating values many educationists have suggested different ideas such as : provision of value based curriculum, designing special orientation program for teachers, value based foundation courses, publication of literature based on values, necessity to develop code of conduct for teachers and students, inculcation of philosophical viewtowards life among teachers and students. Further to cultivate values among the new generations we are to design a curriculum from out of our accumulated cultural heritage. (shrink)

This paper explores a variety of perfect being theism that combines Yujin Nagasawa’s maximal God thesis with the view that God is not atemporal. We argue that the original maximal God thesis still implicitly relies on a “static” view of divine perfections. Instead, following the recent re-evaluation of divine immutability by analytic philosophers, we propose that thinking of divine great-making properties as fluctuating but nevertheless remaining maximal either for every time t or across all times strengthens the original maximal God (...) thesis. Furthermore, we show that “temporalising” Nagasawa’s maximal God and adopting what we call the fluctuating maximal God thesis provides more effective ways of responding to objections to perfect being theism, in particular, the argument from evil and some conceptual problems pertaining to the Incarnation. Finally, we demonstrate that our proposal is compatible with Christian Scriptures and coheres with numerous biblical passages better than Nagasawa’s original proposal does. (shrink)

Although the mathematics of interest is very precise, the practice of charging computing and disclosing interest or cost of credit is full of variations and therefore often questionable on ethical grounds. The purpose of this paper is to examine some of the prevalent practices which are incorrect, illogical, unfair or deceptive. Both utilitarian and formalist schools of ethical theory would find these practices to be inappropriate. The paper will specifically look at unfair practices in the areas of estimation of intrayear (...) rates, use of 360 days in a year, the "rule of 78th", interest rate ('APR') advertising, and computation of unpaid balance by credit card issuers to figure interest costs.The current practices are not in the best interest of the average consumer. There is, therefore, an urgent need for new legislation, change in regulatory code and disclosure requirement for eliminating these unethical practices. The author recommends that the Truth in Lending Code of the Federal Reserve should require the disclosure of the effective APR if the periodic rate is determined by dividing the 'APR' by the number of payment period in a year; the use of 360 days in a year methods and the "Rule of 78ths" should be immediately discontinued; Deceptive advertising, which tend to understate the true cost of credit or hides hidden costs and fees should be outlawed; interest should be payable with the same frequency as the frequency of compounding and credit card holders should be provided with a comparative example of various methods of balance computation. The Evil‐god challenge attempts to undermine classical monotheism by arguing that because the existence of an evil god is similar in reasonableness to the existence of a good god, the onus is on the theist to justify their belief in the latter over the former. In the Part I paper, I defined the Evil‐god challenge, distinguished between several types of Evil‐god challenge, and presented its history and recent developments. In this paper, I describe the merits of the challenge, outline and (...) address the main objections that have been posed to it, and discuss some of the implications for classical monotheism if the Evil‐god challenge remains untarnished by objections.
