Are words like ‘woman’ or ‘man’ sex terms that we use to talk about biological features of individuals? Are they gender terms that we use to talk about non-biological features e.g. social roles? Contextualists answer both questions affirmatively, arguing that these terms concern biological or non-biological features depending on context. I argue that a recent version of contextualism from Jennifer Saul that Esa Diaz-Leon develops doesn't exhibit the right kind of flexibility to capture our theoretical intuitions or moral and political (...) practices concerning our uses of these words. I then float the view that terms like 'woman' or 'man' are polysemous, arguing that it makes better sense of the significance of some forms of criticisms of mainstream gender ideology. (shrink)

Upon doing something generous for someone with whom you are close, some kind of reciprocity may be appropriate. But it often seems wrong to actually request reciprocity. This chapter explores the wrongness in making these requests, and why they can nevertheless appear appropriate. After considering several explanations for the wrongness at issue (involving, e.g. distinguishing oughts from obligation, the suberogatory, imperfect duties, and gift-giving norms), a novel proposal is advanced. The requests are disrespectful; they express that their agent insufficiently trusts (...) the hearer to recognize their own reasons to reciprocate, and the close relationship between them morally requires this kind of trust. This proposal is articulated and situated in the recent discussion of the normativity of requests. The chapter concludes by explaining how these requests may appear appropriate. Agents in these relationships often have standing to make requests, though the standing is lacking in these particular cases. (shrink)

A critical survey of various positions on the nature, use, possession, and analysis of normative concepts. We frame our treatment around G.E. Moore’s Open Question Argument, and the ways metaethicists have responded by departing from a Classical Theory of concepts. In addition to the Classical Theory, we discuss synthetic naturalism, noncognitivism (expressivist and inferentialist), prototype theory, network theory, and empirical linguistic approaches. Graeme Laurie stepped down from the Chair in Medical Jurisprudence at the University of Edinburgh in 2019. This edited collection pays tribute to his extraordinary contributions to the field. Graeme has often spoken about the importance of 'legacy' in academic work and has forged a remarkable intellectual legacy of his own, notably through his work on genetic privacy, human tissue and information governance, and on the regulatory salience of the concept of liminality. The essays in this volume animate the concept (...) of legacy as lens of analysis for the study and practice of medical jurisprudence. In this light, legacy reveals characteristics of both benefit and burden, as both an encumbrance to and facilitator of the development of law, policy and regulation. Overall, the contributions reconcile the ideas of legacy and responsiveness and show that both dimensions are critical to achieve and sustain the health of medical jurisprudence itself as a dynamic, interdisciplinary and policy-engaged field of thinking. ABSTRACT:Neuroethics, the study of the cognitive and neural mechanisms underlying ethical decision-making, is a growing field of study. In this review, we identify and discuss four themes emerging from neuroethics research. First, ethical decision-making appears to be distinct from other types of decision-making processes. Second, ethical decision-making entails more than just conscious reasoning. Third, emotion plays a critical role in ethical decision-making, at least under certain circumstances. Lastly, normative approaches to morality have distinct, underlying neural mechanisms. Our ultimate purpose is to give an axiomatic treatment of recursion theory sufficient to develop the priority method. The direct or abstract approach is to keep in mind as clearly as possible the methods actually used in recursion theory, and then to formulate them explicitly. The indirect or experimental approach is to look first for other mathematical theories which seem similar to recursion theory, to formulate the analogies precisely, and then to search for an axiomatic treatment which covers not only (...) recursion theory but also the analogous theories as particular cases.The first approach is more general because it does not depend on the existence of analogues. A concrete mathematical theory, it seems, need have no such analogues and still be important, as e.g. classical number theory. In such a case, an axiomatic treatment may still be useful for exhibiting the mathematical structure of the theory considered and the assumptions on which it rests. However, it will lack one of the most heavily advertised advantages of the axiomatic method, namely, the “economy of thought” which results from an uniform theory for several different and interesting cases: we cannot hope for this if, by hypothesis, we know of only one particular case. In contrast, the second approach, if successful at all, is bound to achieve such “economy” because we start out with several interesting particular cases. Another possible virtue of the second approach is that of field work over insight: the abstract pattern that we are looking for and hoping to formalize in axioms, may not be evident in any one mathematical theory, but may spring to the eye if one happens to look simultaneously at several theories which happen to realize the pattern. Ethicists struggle to take reductive views seriously. They also have trouble conceiving of some supervenience failures. Understanding why provides further evidence for a kind of hybrid view of normative concept use.

Aristotle argued that you need some wealth to live well. The Stoics argued that you could live well with or without wealth. But the Cynics argued that wealth is a hinderance. For the Cynics, a good life consists in self-sufficiency, or being able to rule and help yourself. You accomplish this by living simply and naturally, and by subjecting yourself to rigorous philosophical exercises. Cynics confronted people to get them to abandon extraneous possessions and positions of power to live better. (...) And while the Cynics were experts in living in this way, their ascetic lifestyles made their message curious to some audiences. Leibniz presents not only his reflections on predestination and election but also a more detailed account of the problem of evil than is found in any of his other works apart from the _Theodicy_. Surprisingly, his _Dissertation on Predestination and Grace_ has never before been published in any form. Michael J. Murray's project of translating, editing, and providing commentary for the volume will therefore attract great interest among scholars and students of Leibniz's philosophy and theology. (...) Philosophers and logicians have long debated how best to understand conditional or hypothetical sentences. William G. Lycan has a distinctive approach to this debate, attending not just to the semantics of such sentences, but equally to their syntax. He shows how insights from linguistic theory help to illuminate problems about the meaning and function of conditionals. For instance, philosophers and logicians have had problems analysing the locutions 'only if', 'unless', and 'even if'. In a cross-cultural study that ranges from ancient to modern times, he asks how far we are bound by the conceptual systems to which we belong, and explores topics such as ontology, morality, philosophy of language, and communication.

G. E. Moore 's 1912 work Ethics has tended to be overshadowed by his famous earlier work Principia Ethica. However, its detailed discussions of utilitarianism, free will, and the objectivity of moral judgements find no real counterpart in Principia, while its account of right and wrong and of the nature of intrinsic value deepen our understanding of Moore 's moral philosophy. Moore himself regarded the book highly, writing late in his career, "I myself like [it] better than Principia Ethica, because (...) it seems to me to be much clearer and far less full of confusions and invalid arguments." Short but philosophically rich, and written with impressive precision and intellectual candor, Ethics is a minor classic which repays careful study. The foregoing considerations support the conjecture that prototypes are semi-compositional in the sense that there exist unboundedly many combinations of nouns with non-exceptional adjectives, which satisfy the rule default-to-prototype and hence are compositional. Presumably there also exist unboundedly many combinations of nouns with exceptional adjectives, which violate DP and hence are non-compositional. An analysis of the connection between productivity and compositionality has been suggested by Robbins. He argues that, for the explanation of productivity, one need not assume that conceptual meanings (...) always compose—it is enough that they compose in infinitely many cases. Since semi-compositionality entails the existence of unboundedly many non-compositional cases, non-compositionality cannot be dealt away with a finite list of idiomatic exceptions, but is a genuine feature of prototype semantics in natural language. An alleged moral right to informational privacy assumes that we should have control over information about ourselves. What is the philosophical justification for this control? I think that one prevalent answer to this question—an answer that has to do with the justification of negative rights generally—will not do.

The practice of paternalism has changed along with developments in medicine, philosophy, law, sociology and psychology. Physicians have learned that a patient's values are a factor in determining what is best for that patient. Modern paternalism continues to be guided by the principle that the physician decides what is best for the patient and pursues that course of action, taking into account the values and interests of the patient. In the autonomy model of the doctor-patient relationship, patient values are decisive. (...) In the paternalistic model, they are but one among several factors the physician must consider in making a medical decision. Although difficult to practise because of limitations in empathising with another person, modern paternalism remains a way to achieve maximum patient benefit. (shrink)

On one way of talking about a traditional metaethical topic, realists accept that some items appear on the list of what exists in the moral or more broadly normative domain of inquiry. They then divide over whether those items are like what science and experience suggest that all other items on the list of what exists across all domains are like – naturalistic and secular. Reductive naturalists answer this further question affirmatively. Why don’t nonnaturalists? I explore the answer that it’s (...) because normative entities are “just too different” in the sense that they are countably different things. However, I argue that this answer rests on the subtle presupposition that the normative domain doesn’t also contain uncountable entities of the sort that analytic metaphysicians call “stuff”. Taking intuitions of difference seriously points the way to a novel form of metaethical reductive naturalism. The key is to identify the stuff that matters. (shrink)
