This essay argues that important critical and political perspective can be gained on Deleuze's famous essay, ‘Bartleby; or, The Formula’ by viewing it as an attempt to move beyond the Sartrean framework of ‘bad faith’. The argument comprises four sections. In section one, I contextualise Deleuze's essay in terms of contrasting readings of Bartleby, from a prior account by Georges Perec, to contemporary accounts indebted to Deleuze, from Hardt and Negri's Empire to Gisèle Berkman's recent L'Effet Bartleby. The (...) argument of this section is that a problematically reductive image of Bartleby has emerged in the wake of Deleuze's essay, but that this can be challenged in favour of a more nuanced and politically significant reading by contextualising the essay as an attempt to overcome bad faith. In section two, I develop this by drawing out the nature and relevance of the threat posed by bad faith through a focus on Sartrean, Deleuzian and Badioucan critiques of Bartleby, before arguing, in section three, that attention to the concept of a ‘logic of presuppositions’ developed in Deleuze's essay shows how bad faith can be overcome. These sections all build towards the fourth and longest section, which draws out the wider political significance of what it means to overcome bad faith. To do so, I pay attention to how logics of presupposition function in Bartleby's story, and consider Deleuze's essay in relation to his work on ‘control societies’ and ‘collective assemblages of enunciation’. The recent Common Rule revision process took almost a decade and the resulting changes are fairly modest, particularly when compared to the ambitious ideas proposed in the advance notice of proposed rulemaking and notice of proposed rulemaking. Furthermore, the revision process did not even attempt to tackle any of the Common Rule subparts pertaining to vulnerable populations where commentators think the rules unduly restrict important research. We believe that this was a missed opportunity to make desirable changes, and that given (...) the usual process the next opportunity to revisit the Common Rule is unacceptably remote. In this article, we argue that the Common Rule should be regularly reassessed, with a mechanism for making substantive changes. Drawing on lessons learned from the recent revision process, we make recommendations about ways to structure future attempts to maximize the ability to make timely and necessary changes. (shrink)

Background: Patients today interact with physicians, physician groups, and health plans, each of which may follow distinct ethical guidelines.Method: We systematically compared physician codes of ethics with ethics policies at physician group practices and health plans, using the 1998–99 policies of 38 organisations—18 medical associations , nine physician group practices , and 12 health plans —selected using random and stratified purposive sampling. A clinician and a social scientist independently abstracted each document, using a 397-item health care ethics taxonomy; a reconciled (...) abstraction form was used for analysis. This study focuses on ethics policies regarding professional obligation towards patients, resource allocation, and care for the vulnerable in society.Results: A majority in all three groups mention “fiduciary obligations” of one sort or another, but associations generally address physician/patient relations but not health plan obligations, while plans rarely endorse physicians’ obligations of advocacy, beneficence, and non-maleficence. Except for occasional mentions of cost effectiveness or efficiency, ethical considerations in resource allocation rarely arise in the ethics policies of all three organisational types. Very few associations, groups, or plans specifically endorse obligations to vulnerable populations.Conclusions: With some important exceptions, we found that the ethics policies of associations, groups, and plans are narrowly focused and often ignore important ethical concerns for society, such as resource allocation and care for vulnerable populations. More collaborative work is needed to build integrated sets of ethical standards that address the aims and responsibilities of the major stakeholders in health care delivery. (shrink)

Argentina fue el primer país del mundo en establecer que los organismos que resulten de nuevas técnicas de edición genética (GE, en sus siglas en inglés) no estarán alcanzados por la normativa para Organismos Genéticamente Modificados (OGM), siempre y cuando una primera evaluación concluya que no incluye ADN de otra especie. Esto es relevante porque las evaluaciones para comercializar un OGM son tan extensas y costosas que solo son accesibles para unas pocas empresas multinacionales, que monopolizan la innovación fundamental, las (...) licencias y los productos derivados. Esta simplificación regulatoria coincide con el descubrimiento de técnicas como CRISPR-Cas9, mucho más baratas y simples que las previas, y con potencial para desarrollarse con reducidos presupuestos de investigación. Este trabajo indaga cómo el Estado argentino utiliza la legislación sobre biotecnología para fomentar la investigación, el desarrollo y la innovación (I+D+i), indagando en los límites y posibilidades de esta estrategia. Para ello se basa en la legislación y las políticas públicas competentes; observaciones en reuniones y conferencias biotecnológicas; y en entrevistas semi-estructuradas realizadas durante 2019 a científicos y empresarios que trabajaban con CRISPR. Así, encuentra que la legislación opera como fomento para los desarrollos locales, pero las ventajas que ofrecen las nuevas técnicas de edición genética dependen de una serie de acciones y estrategias geopolíticas. Entendiendo por regulación al conjunto de acciones y omisiones de los actores interesados, a escala mundial y con intereses contrapuestos, la investigación concluye que es esta regulación geopolítica la que condiciona la innovación biotecnológica en Argentina. Así, la posibilidad de aprovechar esa “ventana de oportunidad” que habilitan las nuevas técnicas descansa en una serie de variables que configuran nuevas relaciones de interdependencia global. L’article part du contemporain et de ce qui en affecte le religieux, un effondrement des médiations sociales et la montée de religiosités privées vivant d’un rapport direct à la vérité. Il reprend ensuite certains des motifs en cause, décalant les oppositions reçues. Ainsi sur les médiations, à repenser en lien à ce que sont tant le religieux que le social, sur l’extériorité, à repenser en lien à ce qu’est le sujet, sur ce qu’est une tradition, à repenser comme cristallisation culturelle (...) et institutionnelle d’une voie d’accomplissement de l’humain, à investir et valider comme telle, hors système auto-référencié. L’article fait enfin retour sur ce qu’il en est du christianisme, dans sa consistance propre, en principe faite d’une suite d’acculturations au creux des sociétés et des cultures, et vivant d’instances diverses et irréductibles. Miguel de Cervantes, no último capítulo de sua obra O engenhoso fidalgo Dom Quixote de La Mancha, retrata o falecimento de seu protagonista, decorrente de uma profunda tristeza. O cavaleiro, depois de vencido, sente-se obrigado a retornar ao seu povoado e a renunciar à cavalaria andante, o que lhe causa a transformação de sua realidade e de seu estado mental - da loucura à cordura -, além do seu direcionamento à morte. Assim como faz Cervantes no início do século XVII, (...) Espinosa, ao final do mesmo século, também parece estabelecer analogias entre as ideias de transformação e morte, ao apontar, em sua Ética, a relação entre a natureza do ser e sua proporção de movimento e repouso, responsável pelas inconstâncias humanas. A partir de tais considerações, este trabalho pretende aproximar o último capítulo da obra Dom Quixote à proposição 39 da Quarta Parte da Ética espinosana, de forma a ressaltar as devidas semelhanças entre o conceito de morte como transformação, retratado tanto pelo escritor espanhol quanto pelo filósofo holandês, uma vez que a morte, para ambos, demonstra estar vinculada à mesma ideia. Different types of consent are used to obtain human biospecimens for future research. This variation has resulted in confusion regarding what research is permitted, inadvertent constraints on future research, and research proceeding without consent. The National Institutes of Health Clinical Center's Department of Bioethics held a workshop to consider the ethical acceptability of addressing these concerns by using broad consent for future research on stored biospecimens. Multiple bioethics scholars, who have written on these issues, discussed the reasons for consent, the (...) range of consent strategies, and gaps in our understanding, and concluded with a proposal for broad initial consent coupled with oversight and, when feasible, ongoing provision of information to donors. This article describes areas of agreement and areas that need more research and dialogue. The aim of this paper is to investigate the role of water stress on plants production. We propose a mathematical model for the dynamics growth of plants that takes into account the concentration of available water in the soil, water stress, plant production and plants compensation. Sensitivity analysis of the model has been performed in order to determine the impact of related parameters on the dynamics growth of plants. We present the theoretical analysis of the model with and without water (...) stress. More precisely, we show that the full model is well-posedness. For each model, we compute the trivial equilibria and derive two thresholds parameters that determine the outcome of water stress within a plantation. Further, we perform numerical simulation on the case of banana-plantain simulations to support the theory. We found that the Hopf bifurcation occurs for a specific value of the water absorption rate of unstressed plants. The impact of the water stress on the banana-plantain production is also numerically investigated. After, the role of the water stress on the plant production is numerically investigated. We found that the water stress can cause about 68.16% of loss of banana-plantain production within a plantation with 1600 rejets initially planted. This suggests that climate change plays a detrimental role on banana-plantains production. (shrink)

The idea of a right not to know emerged in the late 20th century, largely in response to the early incorporation of genetic testing into clinical care. While a few commentators took a more absolute view about the strength of the RNTK, most of the scholarship was openly sceptical of the concept, or at least was willing to acknowledge that the RNTK was defeasible.1 After two decades of relative quiet, it was surprising, then, that the RNTK reappeared with a seemingly (...) widespread consensus that it deserved to be treated as an absolute right. In response to the American College of Medical Genetics and Genomics recommendation2 to actively search for a limited set of high-value medical variants as a default many bioethics commentators came forward to endorse a strong RNTK.3 While ‘deliberate ignorance’ is a complicated moral and psychological concept,4 I was and remain sceptical of a strong RNTK in all cases, and largely support the novel arguments put forth by Ben Davies. But he makes two moves that deserve additional discussion and analysis. This introduction specifies the context in which the texts that make up the dossier were written, presents them and outlines their respective main axes. In a second, more distant phase, it opens up three critical questions, linked to what Joas proposes and aiming to continue the discussion on what is at stake at the social, political and religious levels. It welcomes the aim of a 'self-reflection of social and cultural sciences on their biological bases and normative contents' in relation to (...) historically determined social and political problems. It underlines the anthropological substratum explored by the Joassian approach, which aims to highlight what is at stake between the individual and social bodies, the singular creativities of human action, and the social structures and dynamics. It is under this horizon that the three questions that mark a gap with Joas' work emerge. The first one focuses on the games between body and overcoming, and what is mobilised there, where collective organisation that is not reducible to politics alone and to what would be proper to it, takes shape. The second returns to the question of rite, to evoke its importance at the heart of our worldly activities, in a secular and non-religious mode. The third part takes up the strictly religious question, questioning how Joas deals with the modern differentiation of social spheres, as well as the absence, in his work, of a critical analysis of religions in their traditions, with all the pathologies that may run through them. Comprendemos que estas prácticas tienen como trasfondo el encuentro entre compatriotas y apelan a la creatividad y espontaneidad en el contexto de integración a la sociedad de destino, contribuyendo a formar redes y lazos sociales quizás antes no existentes. Estas actividades creativas y re-creativas contribuyen a la (...) configuración de la identidad nacional en un contexto migratorio, a la vez que tienen en común surgir de manera espontánea, sin planificación previa, e ir configurando una red de relaciones que consolidan tanto la “identidad argentina” como la “identidad senegalesa” en el contexto migratorio de recepción. En littérature, elle est l’œuvre des deux grands courants romanesques de la première moitié du xix e siècle, le romantisme et le (...) réalisme. Este ensaio debate os conceitos de afeto e vontade no trabalho docente e seus vínculos com o “voluntarismo pedagógico” presente em diversas concepções e políticas sobre a educação de crianças. Utiliza-se da doutrina espinosana dos afetos e também da noção de trabalho estranhado nos Manuscritos Econômico-Filosóficos de Marx para uma meditação sobre o perfil sociológico dos professores da educação básica brasileira. Suas considerações finais ressaltam a importância de Espinosa na crítica do “domínio absoluto dos afetos” e análise das atuais condições (...) nas quais se realiza o trabalho docente, apresentando pontos de convergência – e uma possível divergência – com relação a ideias de Mészáros na busca de uma educação “para além do capital”. Departing from and closing with reflections on issues regarding teaching practices of philosophy of mathematics, I propose a comparison between the main features of the Leibnizian notion of symbolic knowledge and some passages from the Tractatus on arithmetic. I argue that this reading allows (i) to shed a new light on the specificities of the Tractarian definition of number, compared to those of Frege and Russell; (ii) to highlight the understanding of the nature of mathematical knowledge as symbolic or formal (...) knowledge that Wittgenstein mobilizes in his book; (iii) to offer reasons for the claim that Wittgenstein can be considered the philosopher of mathematical practice avant la lettre. The paper ends with an overview, a return to the initial reflection on the connections between research and teaching, and a defense of the reading key used here in terms of its potential for the research in philosophy of mathematics. We offer a reading of some passages from Wittgenstein’s Tractatus Logico-Philosophicus in which, dealing with the symbolic constructions of arithmetic, Wittgenstein puts in motion the most outstanding features of Leibniz’s concept of Symbolic Knowledge: the computational and the “ecthetic” functions of the notion of Symbolic Blind Though. We begin with a brief presentation of some conceptual distinctions proposed by Oscar Miguel Esquisabel in his investigation about the Leibnizian origin of the tradition of Symbolic Knowledge. We then contrast these topics with (...) the way Pasquale Frascolla interprets those same Tractarian passages, emphasizing the way in which he suspends any relevant sense in which we could speak about formal knowledge in Wittgenstein’s opera. To make our criticism better suited, our projection of Leibnizian lights into the Tractatus and into Frascolla’s interpretation of it is assisted with a concise exposition of one historical development in the Leibnizian tradition. Grounded in a study in which Javier Legris retraces the features of Symbolic Blind Though in Frege’s works, we then conclude proposing the advantages of our approach. (shrink)

Qui précise au final en quoi la théologie, ainsi repensée, peut être riche d’enseignements pour les sciences (...) des des religions, et en quoi les sciences des religions sont pleines de richesses humaines instructives pour le travail et la réflexion théologiques, tout en étant en même temps un lieu de défis et une occasion de déplacements qui ne peuvent qu’en relancer la réflexion. This paper explores political engagement by Guatemalans who seasonally migrate to Canada as contracted agricultural workers. Since 2003, an ever-increasing number of Guatemalans have pursued economic opportunities in Canadian fields and greenhouses as participants in a labour migration scheme brokered by the International Organization for Migration called the Temporary Agricultural Workers to Canada Project. While some describe this labour migration as a win-win situation for employers and migrant workers, for too many of these migrants, work in Canada has demanded sacrifices (...) and losses, not the least of which of their human rights and dignity at the hands of employers and administrators of the TAWC Project. While there is a great deal at stake for these migrants should they denounce mistreatment, given the climate of fear created by the employer-driven nature of the TAWC project, a growing number of them have been pushed to do so. With the support of allies that encourage political empowerment of migrant workers, black-listed Guatemalans have formed a political advocacy group - Asociación de Guatemaltecos Unidos por Nuestros Derechos - aimed at fighting for the realization of their rights and redressing cases of wrongdoing. Based on workers’ testimonies and other institutional interviews, this paper outlines the difficulties workers have experienced as labour migrants to Canada, the context of vulnerability that largely impedes them from denouncing mistreatment, and the development and activities of AGUND. Informed by literature on political organizing, it also identifies the factors that have both impeded and encouraged political activity on the part of these disenfranchised yet determined Guatemalan workers.
