Title VII of the 1964 Civil Rights Act forbids discrimination in employment on the basis of race, color, religion, national origin — and sex. Although the sex provision was treated as a joke at the time (and was originally introduced by a Southern Congressman in an attempt to defeat the bill), the Equal Employment Opportunities Commission (EEOC) — charged with enforcing the Act — discovered in its first year of operation that 40% or more of the complaints warranting investigation charged (...) discrimination on the basis of sex. According to a report by the EEOC, nearly 6,000 charges of sex discrimination were filed with that agency in 1971 alone, a 62% increase over the previous year. Title VII extends as well to practices which aid and abet discrimination. For example, the Act forbids job advertisements from indicating a preference for one sex or the other unless sex is a bona fide occupational qualification for employment. In interpreting this provision, the EEOC has ruled that even the practice of labeling help-wanted columns as "Male" or "Female" should be considered a violation of the law. (shrink)

A proposta que se insere neste artigo é a de ampliar a discussão sobre a presença da Filosofia na Educação Básica, a partir das formulações propostas pela Base Nacional Comum Curricular, instituídas a partir do Parecer CNE n. 15/2017 e da Resolução CNE n. 2/2017 e suas relações com o Exame Nacional do Ensino Médio, realizado, anualmente, pelo Instituto Nacional de Estudos e Pesquisas Educacionais Anísio Teixeira, órgão vinculado ao Ministério da Educação e aplicado a estudantes e egressos do sistema (...) educacional brasileiro, ou seja, o exame é de adesão voluntária e se propõe a avaliar os conhecimentos que os inscritos indicam saber sobre os conteúdos apreendidos durante os anos finais de formação na Educação Básica. O estudo utiliza a investigação exploratória e tem como objetivo estudar os resultados do Enem entre os anos 2013 e 2018, seu histórico, suas dinâmicas e propor uma análise sobre a avaliação do desempenho escolar por meio de habilidades e competências. Busca-se, também, compreender as avaliações externas, seus aspectos históricos e sua evolução com base em autores como Borges e Rothen, Ferreira, Minhoto, Oliveira, Soares, Vieira, entre outros, além das normativas legais que impactam e regulam as ações do microespaço da sala de aula. As análises indicam que a disciplina de Filosofia, possivelmente, desaparecerá do currículo escolar, uma vez que seus conteúdos se encontram diluídos nos chamados itinerários formativos dentro das disciplinas de Ensino Religioso e de História, reforçando a afirmação de Soares de que as “demandas socialmente úteis ao sistema capitalista tendem a fortalecer ideias perigosas, como a possível extinção dos cursos de Ciências Humanas dos currículos, bem como afasta a educação de sua prerrogativa fundamental, que é educar para a emancipação”. : Throughout its history, pragmatism has served as the bearer of an unsystematic welter of philosophic insights from which varying movements or individuals could abstract bits and pieces as these were seen to serve the cause of their respective, often conflicting, philosophic claims. One common result to be found in these conflicting uses of pragmatic doctrines is a loss of the distinctively pragmatic philosophic vision which defies assimilation and which dissolves in the dismembering of its parts. What such endeavors further (...) have in common is a failure to adequately recognize the nature of the scientific method to which pragmatic thought is linked and which provides the key to the unity of its systematic vision. It is this key which the present paper proposes to use to explore, in broad outlines, the depth and breadth of the pragmatic vision as offering a unique well structured and systematic conceptual paradigm.Key-words: pragmatism, philosophy, scientific method, system, paradigm.Resumo: Por toda a sua história, o pragmatismo serviu como o suporte de um turbilhão assistemático de insights filosóficos, do qual movimentos ou indivíduos variados poderiam abstrair pedaços ou partes quando se considerava que eles serviam à causa de seus respectivos, em geral conflitantes, argumentos filosóficos. Um resultado comum encontrado nesses usos conflitantes das doutrinas pragmáticas é uma perda da visão filosófica distintivamente pragmática que desafia a assimilação e que se dissolve no desmembramento de suas partes. O que tais esforços possuem ainda em comum é um fracasso para reconhecer adequadamente a natureza do método científico ao qual o pensamento pragmático está ligado e que fornece a chave para a unidade de sua visão sistemática. Este artigo analisa a trajetória do Jardim da Infância da Escola Normal de São Paulo idealizada por republicanos paulistas que tinha como projeto a organização e modernização da instrução pública do estado em fins do século XIX. Mesmo fazendo parte do complexo construído para atender a educação do povo, o prédio idealizado para o Jardim da Infância não resistiu às pressões políticas e econômicas, e foi demolido em 1939. As razões da demolição deste prédio que pôs por terra a estrutura (...) física e administrativa da instituição, que teria perdido relevância na história de sua constituição serão apontadas bem como os valores defendidos e praticados que indicavam a suntuosa arquitetura pensada para esta instituição. Razões que levaram ao desmonte dessa escola na década de 1930, com as possíveis consonâncias e dissonâncias entre as autoridades políticas estão indicadas e analisadas. As transformações urbanas e sociais a partir da Proclamação da República aceleraram o crescimento econômico o qual se traduziu em mais capacidade de investimento para a cidade e ajudou a consolidar o desejo da nova elite de produzir um novo espaço urbano para viver. A modernização da cidade acompanhou essa visão. O palco da nova vida devia ser moderno, confortável e bonito. Seduzido pela propaganda oficial estadonovista e fascinado pelas mensagens de progresso, o povo – sem perceber – aplaudiu a agonia da República e saiu às ruas para venerar Getúlio, pai dos pobres. As constantes reformulações do ensino, as transformações urbanísticas e verticalização da cidade possibilitaram a Prestes Maia dar prosseguimento ao seu Plano de Avenidas e ruir com o prédio original e monumental dessa instituição escolar pública de atendimento a primeira infância. O trânsito religioso é indicador de que os “modelos oficiais e religião” têm sido substituídos, ou coexistem com oferenciais religiosos cambiantes, respondendo à demanda dos sujeitos de fé. Os anseios de significação imediata dos sujeitos de fé encontram na “vagabundagem religiosa” sua atitude mais coerente. A vagabundagem semântica dos crentes infiéis é o elemento dinamizador do campo religioso moderno. No presente texto nos propomos a discutir o trânsito religioso de mulheres, suas motivações e as implicações dessa “andança religiosa” para a (...) concepção que estas têm a respeito do sagrado. Para tanto nos utilizamos e dados de nossa pesquisa de campo realizada para a Universidade Católica de Goiás no ano 2000 em Alto Paraíso – GO, bem como de dados obtidos em pesquisa que realizamos para a Universidade Metodista de São Paulo na cidade de São Bernardo do Campo – SP em 2003, como parte do projeto intitulado: “Religiosidade caleidoscópica – nomadismo espiritual: implicações de gênero”. Os resultados da pesquisa indicaram um trânsito maior das mulheres por força das representações de gênero. Palavras-chave: Trânsito religioso; Secularização; Gênero. ABSTRACT Religious transit indicates that ‘official models of religion’ have been replaced, or coexist with mutable religious references, answering the believers’ demand. Their desire for immediate signification finds their most coherent attitude in ‘religious nomadism’. Unfaithful believers’ semantic nomadism is the dynamic element of modern religion. This text discusses women’s religious transit, their motivations and the implications of that ‘religious walk’ to their conception of the sacred. The date used are from a field research for the Universidade Católica de Goiás, developed in Alto Paraíso - State of Goiás, in 2000, and from a research for the Universidade Metodista de São Paulo, carried out in São Bernardo do Campo – State of São Paulo, in 2003, as part of a research project entitled: “Kaleidoscopic religiosity – spiritual nomadism: gender implications”. Este artigo discute, de forma interdisciplinar, como é possível, em um Estado Democrático de Direito, existir formas de vida expostas às mais diversas possibilidades de violações de direitos e garantias fundamentais, como as das pessoas em situação de rua no Brasil. O objetivo deste artigo é mostrar como se deu o início do problema das pessoas em situação de rua no país e como o Estado brasileiro enxerga a questão, e a partir disso refletir como o acesso a direitos impede (...) que estes indivíduos detenham participação na sociedade. Assim, se tratará a hipótese de que as pessoas em situação de rua, do ponto de vista do Estado, por não habitarem o contexto político, econômico e social de forma efetiva não são tratados como seres sujeitos de direitos na ordem pública, o que legitima tomada de decisões que são, em parte, danosas a esta classe e cobertas por um véu falacioso de cuidado com este contingente populacional. Para sustentar e desenvolver este artigo foi utilizada uma metodologia de pesquisa que analisa como se deu a formação da questão no contexto sócio político brasileiro, bem como uma abordagem crítica das bases normativas instituídas em torno da problemática. Ainda, se utilizou das contribuições bibliográficas de autores que escrevem sobre: politização da vida, poder estatal e relações sociais, tais como Michel Foucault, Giorgio Agamben e Achille Mbembe. Biological knowledge does not fit the image of science that philosophers have developed. Many argue that biology has no laws. Here I criticize standard normative accounts of law and defend an alternative, pragmatic approach. I argue that a multidimensional conceptual framework should replace the standard dichotomous law/ accident distinction in order to display important differences in the kinds of causal structure found in nature and the corresponding scientific representations of those structures. To this end I explore the dimensions of stability, (...) strength, and degree of abstraction that characterize the variety of scientific knowledge claims found in biology and other sciences. What is the fruit of a searching dialogue between faith and reason? This book collects theological and philosophical perspectives on the richness of the faith-reason dialogue, including examples from literature, continental and analytic philosophy, worship and liturgy, and radical approaches to issues of racism and prejudice. The authors strongly resist the temptations to either disregard the faith-reason dialogue or take it for granted. The controversy regarding the unit of selection is fundamentally a dispute about what is the correct causal structure of the process of evolution by natural selection and its ontological commitments. By characterizing the process as consisting of two essential steps--interaction and transmission--a singular answer to the unit question becomes ambiguous. With such an account on hand, two recent defenses of competing units of selection are considered. Richard Dawkins maintains that the gene is the appropriate unit of selection and Robert Brandon, (...) in response, argues that the individual organism is better suited to the role. This paper argues that by making explicit the underlying questions that each of these views addresses, the apparent conflict can be resolved. Furthermore, such a resolution allows for a more complete and realistic understanding of the process of evolution by natural selection. (shrink)

They explore the relationship of this framework to other contemporary business ethics perspectives, as well as its implications for moral leadership in business and business education.

Este artigo tem como objetivo geral comentar o estatuto do conhecimento da coisa em si na metafísica de Schopenhauer. De modo mais específico, visa analisar como se inserem neste debate, tradicionalmente enfrentado por estudiosos da filosofia schopenhaueriana como Julian Young, Paul Lauxtermann e David Cartwright, duas correntes interpretativas bastante discutidas neste ciclo, principalmente na última década; ambas lidam com o problema da coisa em si a partir de uma interpretação da transição analógica que Schopenhauer empreende do mundo da representação para (...) o da Vontade. Ao disputarem que tipo de conhecimento, metafórico ou metonímico, esse autor pode almejar da coisa em si, é possível apontar como De Cian e Marco Segala, bem como Jorge Prado, por um lado, e Sandra Shapshay, de outro, se distanciam da tradição exegética que lhes antecede; e, mais ainda, em que medida eles são precursores no esforço de apontar uma espécie de “método” específico, alternativo ao método transcendental kantiano, a partir do qual Schopenhauer realizaria sua empreitada metafísica. A fim de situar nossa própria interpretação entre a desses comentadores, focaremos na análise de passagens de O mundo como vontade e como representação e da Crítica da filosofia kantiana, em que Schopenhauer especifica com mais ênfase como deve ser entendida sua abordagem metafísica. A distinctive form of anticolonial analysis has been emerging from Latin America in recent decades. This decolonial theory argues that important new insights about modernity, its politics, and epistemology become visible if one starts off thinking about them from the experiences of those colonized by the Spanish and Portuguese in the Americas. For the decolonial theorists, European colonialism in the Americas, on the one hand, and modernity and capitalism in Europe, on the other hand, coproduced and coconstituted each other. The (...) effects of that history persist today. Starting thought from these LA histories and current realities enables envisioning new resources for social transformations. These decolonial insights seem to receive only a passing recognition in the Latin American social studies of science and technology projects that have begun cosponsoring events and publications with northern equivalents. My focus will be primarily on the decolonial theory and on just two of its themes. One is the critical resources it offers for creating more accurate and progressive northern philosophies and histories of science as well as social studies of science. The second is insights from Latin American feminists that carry different impacts in the context of the decolonial accounts. (shrink)

Unites George Herbert Mead and Maurice Merleau-Ponty in a shared rejection of substance philosophy as well as spectator theory of knowledge, in favor of a focus on the ultimacy of temporal process and the constitutive function of social praxis.

Drawing on her pioneering work in feminist standpoint theory, Harding articulates and defends the “strong objectivity” program, which she subsequently tests against recent discussions of objectivity and against postcolonialist science and technology studies. Strong objectivity starts with an examination of the experiences of individuals, such as women and minorities, who have traditionally been excluded from knowledge production in order to criticize prevailing standards of objectivity - especially the “weak objectivity” of allegedly value-neutral science - and to articulate stronger standards of (...) objectivity. This stance assumes that by adopting a standpoint outside of a discipline, one can achieve the distance required to critically assess the values, interests, and assumptions of that discipline. As Harding makes clear, this program is not merely interested in criticizing dominant research practices to improve the reliability and validity of science, but it is an inherently social and political project aimed at articulating standards that can produce science for social justice movements. After identifying various ways in which the strong objectivity program is consonant with major themes in recent science and technology studies research (e.g., historical work on the concept of objectivity, the dynamic co-evolution of science and society, theoretical pluralism), Harding responds to some potential objections to strong objectivity, e.g., accusations of relativism. By way of conclusion, Harding outlines her vision of a “new unification of multiple sciences” as a possible fruit of the strong objectivity program, wherein the global sciences are unified and harmonized by common goals of obtaining knowledge and developing more socially responsible societies. The frequency of the use of deception in American psychological research was studied by reviewing articles from journals in personality and social psychology from 1921 to 1994. Deception was used rarely during the developmental years of social psychology into the 1930s, then grew gradually and irregularly until the 1950s. Between the 1950s and 1970s the use of deception increased significantly. This increase is attributed to changes in experimental methods, the popularity of realistic impact experiments, and the influence of cognitive dissonance (...) theory. Since 1980 there appears to have been a decrease in the use of deception as compared to previous decades which is related to changes in theory, methods, ethical standards, and federal regulation of research. Abstract:Latin American modernity/coloniality studies emerged in the early 1990s from a network of scholars focused on charting the nature and consequences of causal connections between the first appearances of modernity in Europe and Spanish and Portuguese colonialism in the Americas beginning in 1492. In this article, I address primarily epistemological and ontological issues raised by this literature for issues pertaining to the history and philosophy of science. The first section briefly summarizes the sixteenth century differences that were the starting point (...) of the modernity/coloniality analyses and points to just a few of the still-emerging feminist issues about this early era. The second section focuses on the distinctive epistemic and political stances that Latin American decolonial theorists use today to frame such analyses: they intend to do theory “otherwise.” This Latin American project has been conceptualized through Gloria Anzaldúa's influential “borderlands” thinking and aligns with the feminist standpoint methodology and other knowledge-from-below projects that have appeared in all of the social justice movements. Burnout is a phenomenon characterized by fatigue and frustration, usually related to work stress and dedication to a cause, a way of life that does not match the person’s expectations. Although it seems to be associated with risk factors stemming from a professional environment, this problem may affect any person. Palliative care is provided in a challenging environment, where professionals often have to make demanding ethical decisions and deal with death and dying. This article reports on the findings of a (...) systematic review aimed at identifying described burnout levels in palliative care nurses and physicians, and the related risks and protective factors. The main findings indicate that burnout levels in palliative care, or in health care settings related to this field, do not seem to be higher than in other contexts. (shrink)

However, the language in which it is usually expressed tends too often to conflate its epistemic and ontological dimensions, thereby hiding from view its full systematic significance. The following discussion will focus on the emergence of such meanings as epistemic relational structures which embody the characteristics of the dynamics of organism-environment interaction in their very internal structure and which lead outward toward the universe, providing (...) an experienced content which is at once epistemic and ontological. This essay follows the assumption that the first principle of classical metaphysics has its counterpart in political sovereignty as suprema potestas. Therefore, both can be equally described as arché. Their epitome is the God of so-called ontotheology, who thus proves to be what I call the Ur-Arché. In contrast to current post-metaphysical approaches, however, I suggest overcoming ontotheology through a different metaphysics, which emphasizes the self-transcending surplus character of being. I regard early Christian martyrdom as an eminent way in which (...) the surplus of being is manifested. This has two interwoven aspects, one ontological and one political, both arising from the excessive idea of the Christ event, or the notion that there is life beyond life unto death. I will analyse the mechanism allowing early Christian martyrs to counteract Roman imperial sovereignty. Finally, I will relate this to contemporary life systems in which sovereignty has become anonymous biopower. (shrink)

This collection provides a thorough grounding in the philosophy of American pragmatism by examining the views of four principal thinkers - Charles S. Peirce, William James, John Dewey, and George Herbert Mead - on issues of central and enduring importance to life in human society. The ease with which genotyping technologies generate tremendous amounts of data on research participants has been well chronicled, a feat that continues to become both faster and cheaper to perform. In parallel to these advances come additional ethical considerations and debates, one of which centers on providing individual research results and incidental findings back to research participants taking part in genetic research efforts. In 2006 the Industry Pharmacogenomics Working Group offered some ‘Points-to-Consider’ on this topic within the context of the (...) drug development process from those who are affiliated to pharmaceutical companies. Today many of these points remain applicable to the discussion but will be expanded upon in this updated viewpoint from the I-PWG. The exploratory nature of pharmacogenomic work in the pharmaceutical industry is discussed to provide context for why these results typically are not best suited for return. Operational challenges unique to this industry which cause barriers to returning this information are also explained. (shrink)

Les récits de vie constituent un corpus apprécié tant par la sociologie que par la sociolinguistique. Cet article vise à distinguer les présupposés épistémologiques de ces deux approches disciplinaires des récits de vie, et à dégager la spécificité de ce type de corpus. A une approche sociologique qui utilise les entretiens biographiques pour en extraire des données factuelles, s’oppose une interprétation des récits à partir de leur matérialité discursive. Partant du présupposé que les récits sont une re-construction linguistique du monde, (...) il s’agit suivant l’approche sociolinguistique d’opérer une analyse à la fois discursive et interactionnelle des récits de vie, en prenant en compte le contexte interactionnel dont ils sont issus.
