Recording of neural activity during grasping actions in macaques showed that grasp-related sensorimotor transformations are accomplished in a circuit constituted by the anterior part of the intraparietal sulcus (AIP), the ventral (F5) and the dorsal (F2) region of the premotor area. In humans, neuroimaging studies have revealed the existence of a similar circuit, involving the putative homolog of macaque areas AIP, F5, and F2. These studies have mainly considered grasping movements performed with the right dominant hand and only a few (...) studies have measured brain activity associated with a movement performed with the left non-dominant hand. As a consequence of this gap, how the brain controls for grasping movement performed with the dominant and the non-dominant hand still represents an open question. A functional magnetic resonance imaging (fMRI) experiment has been conducted, and effective connectivity (dynamic causal modeling, DCM) was used to assess how connectivity among grasping-related areas is modulated by hand (i.e., left and right) during the execution of grasping movements toward a small object requiring precision grasping. Results underlined boosted inter-hemispheric couplings between dorsal premotor cortices during the execution of movements performed with the left rather than the right dominant hand. More specifically, they suggest that the dorsal premotor cortices may play a fundamental role in monitoring the configuration of fingers when grasping movements are performed by either the right and the left hand. This role becomes particularly evident when the hand less-skilled (i.e., the left hand) to perform such action is utilized. The results are discussed in light of recent theories put forward to explain how parieto-frontal connectivity is modulated by the execution of prehensile movements. (shrink)

The reach-to-grasp movement is ordinarily performed in everyday living activities and it represents a key behavior that allows humans to interact with their environment. Remarkably, it serves as an experimental test case for probing the multisensory architecture of goal-oriented actions. This review focuses on experimental evidence that enhances or modifies how we might conceptualize the “multisensory” substrates of prehension. We will review evidence suggesting that how reach-to-grasp movements are planned and executed is influenced by information coming from different sensory modalities (...) such as vision, proprioception, audition, taste, and olfaction. The review closes with some considerations about the predominant role of the multisensory constituents in shaping prehensile behavior and how this might be important for future research developments, especially in the rehabilitative domain. Drawing on philosophy, law and political science, and on a wealth of practical experience delivering emergency medical services in conflict-ridden settings, Lepora and Goodin untangle the complexities surrounding compromise and complicity.

Torture is unethical and usually counterproductive. It is prohibited by international and national laws. Yet it persists: according to Amnesty International, torture is widespread in more than a third of countries. Physicians and other medical professionals are frequently asked to assist with torture. -/- Medical complicity in torture, like other forms of involvement, is prohibited both by international law and by codes of professional ethics. However, when the victims of torture are also patients in need of treatment, doctors can find (...) themselves torn. To accede to the requests of the torturers may entail assisting or condoning terrible acts. But to refuse care to someone in medical need may seem like abandoning a patient and thereby fail to exhibit the beneficence expected of physicians. -/- In this paper, we argue that this dilemma is real and that sometimes the right thing for a doctor to do, overall, is to be complicit in torture. Though complicity in a wrongful act is itself prima facie wrongful, this judgment may be outweighed by other factors. We propose three criteria for analyzing how those factors apply to particular cases of medical complicity in torture. (shrink)

Here I present the first version of the transcription of the Commentarius in Metaphysicam by Konrad Graf from Cod. Pp 183 4°, Teil 2, Zentral- und Hochschulbibliothek Luzern [ZHB], Sondersammlung (ff. 1r-56v), which collects Graf's lectures in metaphysics, held at the Lucerne Gymnasium in 1635-36. The transcription of the text was carried out at the Lucerne Faculty of Theology within the SNSF project "Zwischen monastischer und reformierter Metaphysik. Die schweizerische 'Wiege' der Ontologie im Zeitalter der Reformation" (SNSF project 100012_192559 - (...) applicant: Prof. Dr. Giovanni Ventimiglia (TF- University of Lucerne), Employees: Marco Lamanna, Chiara Paladini. The project aimed to redefine the "cartography" of the Reformation in Switzerland on the traces of metaphysics teaching (Reportationes) in Swiss educational institutions and monastic poles, and thereby to gain a precise place for Swiss studies in the panorama of research on metaphysics and ontology in the early modern period. The project was based on a preliminary investigation that made it possible to recover new texts transmitting lessons on metaphysics held in Lucerne and Engelberg. The method was 1. to produce a systematic and comprehensive documentation based on an index of manuscripts and printed texts, most of them already identified, which testify to the existence of a cultural flourishing in Switzerland that has so far remained unexplored. 2. this documentation should be placed on a solid textual basis by transcribing and eventually critically editing those texts judged to be of interest in terms of their content and influence, in order to make them accessible to the scholarly community and to readers. 3. finally, we will examine the specific aspects of the teachings transmitted in these manuscripts. Citation metrics are statistical measures of scientific output that draw on citation indexes. They purport to capture the impact of scientific articles and the journals in which they appear. As evaluative tools they are mostly used in the natural sciences, but they are also acquiring an important role in the humanities. While the strengths and weaknesses of citation metrics are extensively debated in a variety of fields, they have only recently started attracting attention in the philosophy of science. This paper (...) takes a further step in this direction and presents an analysis of citation metrics from the perspective of a Kuhnian model for the development of science. To do so, it assesses the argument made against the use of citation metrics for scientific research by Gillies (2008). According to Gillies, citations metrics tend to over-protect normal science at the expenses of revolutionary science–in other words, reinforce the status quo rather than supporting innovations and breakthroughs. Unlike Gillies, this paper focuses on the context of normal science and shows that citation metrics can in fact arbitrarily hinder its development when they do not take field-specific differences into account. In light of this, the paper cautions against their use for evaluative purposes. To argue for this conclusion, the paper shows that citation metrics fail to “carve science at its joints” and thus cannot be relied upon as indicators of scientific quality that can support the development of normal science. Compromise arises in contexts where irreconcilable claims must nonetheless somehow be resolved. Ordinary people in everyday life, politicians and artists, doctors engaging in research, humanitarian workers providing aid in the midst of war – all of them will have faced situations where compromise appeared to be the only reasonable option, and yet will have felt that there was nevertheless something deeply wrong with it. The aim of this paper is to help make sense of that sentiment. The focus of this (...) paper will be on some aspects of the morality of compromise. Its lynchpin will be to construe compromise as a joint action, in particular, a joint wrongdoing – taking part in, and sharing responsibility for, the doing of things that are wrong from the point of view of those who are the parties to the compromise. The question of ‘what is wrong with compromise?’ is thus recast as a question of ‘what is my part in the wrongs being done as part of the compromise?’ It is tempting to suppose that a compromise serves to dilute personal responsibility, parsing it out among parties to the compromise. Viewing a compromise as a joint action, in contrast, will help us to see how a compromise actually increases responsibility among parties to it. They are now jointly collaborating in some action that each of them sees as wrong, at least in part (albeit in differing parts). Discussions of compromise traditionally prioritize the inter-personal aspect – compromise, in the transitive form of ‘compromising with’ someone. But I argue that the intransitive form – ‘compromise of’ – deserves pride of place. The reason for prioritizing the intransitive ‘compromise of’ is simple: that is what is involved in the intra-personal calculation that must, of necessity, go on inside one's own head in the process of deciding whether or not to agree to a 'compromise with' someone else. In this paper I shall concentrate specifically on compromises of principles, or (more precisely) on ‘matters of principled concern to the compromising parties’. Not only is that the most troubling and morally problematic sort of compromise, it is also logically the most central case. I demonstrate that that is so by shifting the focus from inter-personal compromise to the more fundamental intra-personal process underlying it – the compromise we are involved in when adjudicating among our own conflicting values, to decide whether or not to agree to a compromise of the inter-personal sort. This is the subject of the first section of the paper below. Compromise involves resolving conflicts of principles through mutual concessions that are accepted and undertaken by all parties. Doing so may be on-balance desirable, not only from some larger perspective (of social peace, or whatever) but also from each party's own perspective. Nevertheless, from each party's perspective, compromise necessarily involves interacting with, and sometimes contributing to, wrongdoing. Morally, something is lost, even if more is gained on balance. (shrink)

This study offers a new interpretation of the poem of the founder of Western philosophy: Parmenides. It shows that there is more in his poem than the description of Being by means of negative adjectives such as ingenerated and immobile. His words ask his audience to question their habits, to modify their goals, to engage in new enterprises and to look with a critical eye at their previous attempts to get knowledge. It operates as a travel guide that leads the (...) audience on a journey that will educate them and help them to gradually become philosophically mature, to become true themselves, which can also be described as the encouragement to become Being. We believe that intellectual humility is an essential intellectual virtue for university students to foster. It enables them to excel as students of philosophy and other disciplines, to navigate the fast-changing world inside and outside academia, and to flourish in interaction with others. In this paper, we analyze this virtue by singling out two distinct but related aspects: the openness-aspect and the care-aspect. The former makes one value a dialogue with those who have different views from one’s own. The latter (...) aspect involves searching for implicit assumptions one brings to encounters with one’s object of inquiry and trying to study this object as unique and irreducible. We discuss four learning activities we developed for the philosophy bachelor course “Who are we? Philosophical views on humans and the gods” at University College Utrecht (the Netherlands). Throughout this paper, we show extracts from the students’ assignments, reflections, and evaluations. These extracts indicate that students developed both aspects of intellectual humility —openness to different views and care for the uniqueness of each object of inquiry— and acknowledged their importance. Medical complicity in torture is prohibited by international law and codes of professional ethics. But in the many countries in which torture is common, doctors frequently are expected to assist unethical acts that they are unable to prevent. Sometimes these doctors face a dilemma: they are asked to provide diagnoses or treatments that respond to genuine health needs but that also make further torture more likely or more effective. The duty to avoid complicity in torture then comes into conflict with (...) the doctor’s duty to care for patients. Sometimes the right thing for a doctor to do requires complicity in torture. Whether this is the case depends on: the expected consequences of the doctor’s actions; the wishes of the patient; and the extent of the doctor’s complicity with wrongdoing. Medical associations can support physicians who face this dilemma while maintaining a commitment to clear principles denouncing torture. (shrink)

Throughout the present paper, I propose an analysis of René Magritte’s artwork Les mots et les images (La Révolution surréaliste, 1929) in connection with a reflection on the associated theories he formulated in the handout for his London lecture (1937). Read in reference to selected writings (and in erratic observation with other artworks of his oeuvre), the eighteen propositions of Les mots et les images, along with their development in the 1937 document, might help at investigating the aesthetic principles that (...) guide and characterise Magritte’s reflection around language. In this same regard, in the last part of my article I will focus on Michel Foucault’s Ceci n’est pas une pipe (1973) and, particularly, on the distinction between resemblance (ressemblance) and similitude (similitude). These last remarks, I argue, offer the opportunity not only to think about the way in which images and words are related to each other in Magritte’s works, but also to inves- tigate the vital issue of language, which has occupied a crucial place within French thought. The current situation around COVID-19 portrays a threat to us in several ways: It imposes uncertainty, a lack of control and reminds us of our own mortality. People around the world have reacted to these threats in seemingly unrelated ways: From stockpiling yeast and toilet paper to favoring nationalist ideas or endorsing conspiratorial beliefs. According to the General Process Model of Threat and Defense the confrontation with a threat - a discrepant experience - makes humans react with both proximal and (...) distal threat responses. While the proximal response manifests in behavioral inhibition that leads to heightened anxious arousal and vigilance, distal responses seek to lower behavioral inhibition and the associated state of anxiety and vigilance through engaging in distal defenses. In the present research, we propose that the reactions to COVID-19 may represent distal defense strategies to the pandemic (in the form of environmental or group related worldview defenses) and therefore can be explained and forecasted by the model. Thus we hypothesized increased perceived COVID-19 threat perception to lead to a proximal threat response in the form of heightened behavioral inhibition. This, in return, should enhance the use of distal defenses (i.e.: several ingroup biases, system justification and conspiratorial beliefs) overlapping with the reactions observed as a response to COVID-19. This hypothesized mediated effect of increased perceived COVID-19 threat on distal defenses was tested in two pre-registered studies: In Study 1 (N = 358) results showed perceived COVID-19 threat to be related to behavioral inhibition and in turn to be associated with increased distal defenses (i.e., higher entitativity, control restoration motivation, passive party support). In Study 2 (N = 348) we manipulated COVID-19 threat salience and found results suggesting the distal defenses of system justification and conspiratorial beliefs to be mediated by the proximal threat response. The results of the present research hint towards a common mechanism through which the seemingly unrelated reactions to COVID-19 can be explained. The results might help to predict future behavior during the COVID-19 pandemic and design measures to counteract detrimental effects of the pandemic. (shrink)

How does other people’s opinion affect judgments of norm transgressions? In our study, we used a modification of the famous Asch paradigm to examine conformity in the moral domain. The question we addressed was how peer group opinion alters normative judgments of scenarios involving violations of moral, social, and decency norms. The results indicate that even moral norms are subject to conformity, especially in situations with a high degree of social presence. After initially emerging in China, the coronavirus outbreak has advanced rapidly. The World Health Organization has recently declared it a pandemic, with Europe becoming its new epicentre. Italy has so far been the most severely hit European country and demand for critical care in the northern region currently exceeds its supply. This raises significant ethical concerns, among which is the allocation of scarce resources. Professionals are considering the prioritisation of patients most likely to survive over those with remote chances, and (...) this news has triggered an intense debate about the right of every individual to access healthcare. The proposed analysis suggests that the national emergency framework in which prioritisation criteria are currently enforced should not lead us to perceive scarce resources allocation as something new. From an ethical perspective, the novelty of the current emergency is not grounded in the devastating effects of scarce resources allocation, which is rife in recent and present clinical practice. Rather, it has to do with the extraordinarily high number of people who find themselves personally affected by the implications of scarce resources allocation and who suddenly realise that the principle of ‘equals should be treated equally’ may no longer be applicable. Along with the need to allocate appropriate additional financial resources to support the healthcare system, and thus to mitigate the scarcity of resources, the analysis insists on the relevance of a medical ethics perspective that does not place the burden of care and choice solely on physicians. Gesundheit and colleagues offer dramatic examples of the medical treatment of terrorists but then pose the suggestion that those who engage in terrorism forfeit their right to medical care, and, consequently, that physicians have no obligation to treat them. Their argument presupposes that a physician’s obligation to provide medical care depends on the patients’ right to health care. Therefore, someone who commits heinous and abhorrent acts thereby waives the right to health care and the physicians’ duty to provide health care (...) might consequently be absolved. This view may appeal to physicians who have experienced the complexity and discomfort of treating someone whose morality or even humanity they question, such as a rapist, a serial killer, or a perpetrator of genocide. However we have grounds to believe that the duty of physicians to treat is not based on the moral worth of patients, but rather on the duties that physicians have, and this notion renders any concern about the unacceptability of any person’s behavior irrelevant in determining whether to provide treatment. We will first argue that not all duties are directly derived from rights, and then illustrate how deontological views, along with common views on the role morality of physicians, provide a basis for offering indiscriminate medical care. Second, we will discuss the physician’s role in the context of war, and offer one compelling moral reason on the basis of which warfare norms do indeed obligate physicians to extend their duty to care toward enemies, terrorists included, independently of whatever right they maintain. The Sārasaṅgaha is a Pāli text of XIIth–XIIIth century by the Sinhalese monk Siddhattha Thera. Its themes include the aspiration to become a Buddha, shrines, meditation, theories on rain, wind, gender and more. The main body consists of citations from the Nikāyas, the Jātakas, the Visuddhimagga and above all, from commentarial literature. By analysing the way the Sārasaṅgaha refers to and establishes a dialogue with the quoted works, this paper promotes a new assessment of the cultural and textual tendencies that (...) influenced the development of Buddhist literature especially in the Middle Ages. In particular, the analysis of this text and the quotations of which it is composed reveals the importance of commentarial literature, a literary genre that only recently has attracted the attention of Pāli scholars. In the philosophy of science and epistemology literature, robustness analysis has become an umbrella term that refers to a variety of strategies. One of the main purposes of this paper is to argue that different strategies rely on different criteria for justifications. More specifically, I will claim that: i) robustness analysis differs from de-idealization even though the two concepts have often been conflated in the literature; ii) the comparison of different model frameworks requires different justifications than the comparison of models (...) that differ only for the assumption under test; iii) the replacement of specific assumptions with different ones can encounter specific difficulties in scientific practice. These claims will be supported by a case study in population ecology and a case study in geographical economics. (shrink)

Elaborating on the notions that humans possess different modalities of decision-making and that these are often influenced by moral considerations, we conducted an experimental investigation of the Trolley Problem. We presented the participants with two standard scenarios (‹lever’ and ‹stranger’) either in the usual or in reversed order. We observe that responses to the lever scenario, which result from (moral) reasoning, are affected by our manipulation; whereas responses to the stranger scenario, triggered by moral emotions, are unaffected. Furthermore, when asked (...) to express general moral opinions on the themes of the Trolley Problem, about half of the participants reveal some inconsistency with the responses they had previously given. This paper investigates Philomela's metamorphosis into a swallow as inferred from Sophocles’ fragmentary Tereus. The first part focusses on the association between the swallow and barbaric language, casting new light on Philomela's characterization in the play. The second investigates the shuttle, the weaving tool which prompts the recognition of Philomela, arguing that the mention of its ‘voice’ in fr. 595 Radt refers not only to the tapestry which it created, but also to the actual sound of the shuttle, which ancient (...) Greeks associated with the swallow, and thus anticipates Philomela's metamorphosis. The representation of Philomela as a speech-impeded and yet vocal character supports the Dionysiac background of the act of vengeance which she and her sister commit. (shrink)

There is a vast class of things that science has so far almost entirely neglected. They are central to the understanding of physical reality both at an everyday level and at the level of the most fundamental phenomena in physics, yet have traditionally been assumed to be impossible to incorporate into fundamental scientific explanations. They are facts not about what is--the actual--but about what could be: counterfactuals. According to physicist Chiara Marletto, laws about things being possible or impossible may (...) generate an alternative way of providing explanations. This fascinating, far-reaching approach holds promise for revolutionizing the way fundamental physics is formulated, but also for providing essential tools to face existing technological challenges, from delivering the next generation of information-processing devices, beyond the universal quantum computer, to designing AIs. Each chapter in the book delineates how an existing vexed open problem in science can be solved by this radically different approach; and it is augmented by short fictional stories that explicate the main point of the chapter. As Marletto demonstrates, contemplating what is possible can give us a more complete and hopeful picture of the physical world. (shrink)

Friedrich Albert Lange was a neo-Kantian and a socialist. Scholars have questioned whether there is a connection between these two aspects of Lange’s work. The paper argues that such a connection is apparent once Lange’s philosophy is understood in light of Schiller’s Kantianism. According to Lange, Schiller’s aesthetic redemption consists of two tasks: to create the beautiful image of an ideal reality; and to realize this ideal model in the actual world. Accordingly, I show that Lange’s political analysis points to (...) three different types of social evolution: 1) one corresponding to the natural state of humanity, based on Darwin’s and Malthus’s concept of the struggle for survival; 2) one corresponding to ideal evolution, in which all human beings achieve full development of their talents (first task of the esthetic redemption); 3) one corresponding to the actual realization of this ideal, in which human beings advance step by step thanks to social experimentation and the resulting progress in knowledge (second task of esthetic redemption). In this book, originally published in 2007, Chiara Bottici argues for a philosophical understanding of political myth. Bottici demonstrates that myth is a process, one of continuous work on a basic narrative pattern that responds to a need for significance. Human beings need meaning in order to master the world they live in, but they also need significance in order to live in a world that is less indifferent to them. This is particularly true in the realm of politics. (...) Political myths are narratives through which we orient ourselves, and act and feel about our political world. Bottici shows that in order to come to terms with contemporary phenomena, such as the clash between civilizations, we need a Copernican revolution in political philosophy. Complicity with wrongdoing comes in many forms and many degrees. We distinguish subcategories cooperation, collaboration and collusion from connivance and condoning, identifying their defining features and assessing their characteristic moral valences. We illustrate the use of these distinctions by reference to events in refugee camps in and around Rwanda after the 1994 genocide, and the extent to which international organizations and nongovernment organizations were wrongfully complicit with the misuse of refugees as human shields by the perpetrators of the genocide who (...) were allowed to run those camps. This essay argues that diversity needs to be practised. Drawing insights from two thinkers who saw themselves as educators, Dōgen and bell hooks, I single out three steps towards practising diversity in a learning community. I make two concrete recommendations for each step. Step One involves trying to understand the other in their own terms, by becoming informed about the frameworks that play a role in their experience. Step Two guides us to listen to every unique other and receive their (...) story, in such a way as to put them, instead of ourselves, in the centre of our attention. In Step Three, we engage in dialogues that do not consist in a series of monologues but of calls and responses, in which we practise to respond to each other in an attuned way, and to take responsibility for co-transforming each other and our shared world. Zusammenfassung Der Aufsatz untersucht die Theorie der exemplarischen Kausalität von Petrus Aureoli (1280–1322). Mindestens bis zur zweiten Hälfte des 13. Jahrhunderts behaupteten mittelalterliche Autoren, dass die Welt geordnet und intelligibel war, weil Gott sie nach aus der Ewigkeit in seinem Intellekt existierenden Modellen (d.h. göttlichen Ideen) geschaffen hatte. Aureoli focht diese traditionelle Ansicht an. In Aureolis Theorie ist die göttliche Essenz das einzige Urbild für die Erschaffung. Um zu erklären, wie ein einziges Objekt allein als Urbilder für die Erschaffung mehrerer (...) verschiedener Kreaturen fungieren kann, muss er den Begriff der Nachahmbarkeit neu überdenken und ein neues Modell der exemplarischen Kausalität entwickeln. Das traditionelle Modell war das der Analogie: Eine Ursache erzeugt einen Effekt, der zum Teil ähnlich wie sie und zum Teil anders als sie ist. Aureoli greift auf den Be-griff von Äquivokation zurück. Er argumentiert, dass keine direkte Ähnlichkeit zwischen Ursache und Effekt notwendig ist. Im Gegenteil: Damit ein Objekt das Urbild für mehrere verschiedene Dinge sein kann, ist es notwendig, dass es für keinen von ihnen repräsentativ ist. Der Begriff der Äquivokation erlaubt es Aureoli, das traditionelle Modell der Erschaffung abzulehnen. Aequivocatio sieht keine Ähnlichkeit zwischen Idee und Ideatum vor. Es be-steht also kein Widerspruch darin, wenn man sagt, dass ein einziges Objekt (göttliche Essenz) aequivoce die exemplarische Ursache für mehrere verschiedene Objekte ist. (shrink)

This article probes the visual spatial représentations underlying the creative conceptual design of complex objects.

The first book of the De anima contains Aristotle’s psychological doxography. It is usually divided into two sections: the mere listing of the previous theories on the soul (I.2) and their critical examination (I.3–5). Despite such apparent neatness, various discrepancies emerge and the structure of the doxography remains obscure. To account for such problems and for the general agenda of the psychological doxography, I shall propose a tripartite model, arguing that Aristotle’s grouping of his predecessors’ theories is based on three (...) criteria (motion, cognition and incorporeality), all of which are to be referred back to one overarching criterion (primacy). After collecting some textual evidence in favour of this interpretation, I shall deal with an apparent difficulty faced by the suggested model, namely chapter 4. Based on the results thus reached, I conclude that the doxography of De anima i significantly contributes to the development of Aristotle’s own psychological theory and to defining its role within his wider philosophical project. This article is about the terms used in the works traditionally ascribed to Alexander of Aphrodisias to mean the process of abstraction through which intellect separates form and matter. The passages are studied in order to identify what nouns and verbs are used. Since in two works of dubious authorship aphaireô and aphairesis are found, the usage of these terms in the works that can be ascribed with certainty to Alexander is studied. Although the term “pre-predicative” (vorprädikativ) is used only two times in Being and Time, it qualifies in an essential way the hermeneutical process in which the existentials of understanding, interpretation and discourse cooperate to structure the phenomenal field into a meaningful horizon. This hermeneutical function represents for Heidegger the precondition for every theoretical-predicative behaviour of Dasein towards being. By means of a conceptual-historical analysis throughout the Twenties, it is possible to point out that Heidegger considers the domain of the pre-predicative (...) identical to the hermeneutical process. Nevertheless, on the basis of some indications that are to be found in Heidegger’s writings, we can trace the contours of a different history of the concept of “pre-predicative”, in which the latter hints at a deeper dimension of the human being – a dimension that can be designated as “pathic” or “prehermeneutical”. To this purpose, it is essential to investigate the concept of “pre-worldly” (vorweltlich), introduced by Heidegger in his first lecture course, his analysis of anxiety in 1929 and, finally, the image of the “great silence” (große Stille) in the later Contributions to Philosophy. In this paper I will present the idea of a phenomenology of the “pathic” by interpreting some passages of Heidegger’s lecture course of 1919, Being and Time and What is Metaphysics? The first part provides a critical discussion of the perspective of AldoMasullo, who denies not only that Heidegger really succeeded in fathoming the pathic sphere, but also that a phenomenology of the pathic in general is possible. In contrast, my purpose is to outline a phenomenology of the pathic in (...) two possible directions of investigation, both inspired by Heidegger. On the one hand, the phenomenology of the “pathic” intends to define the distinctive features of what Heidegger calls experience of the “preworld” (Vorwelt) and to specifically argue for its premeaningful character. On the other hand, this phenomenological approach aims at identifying the transcendental conditions of possibility for experiencing the “prewordly something”: in such a factical experience the hermeneutic capacities of the subject are temporarily suspended, so that the sole Befindlichkeit, understood as the primordial way of access to the phenomenal horizon, is still at work. § 219a of the German Penal Code (StGB) – the so-called ban on advertising abortions – has been subject of an increasing legal-political controversy since 2017 and was dropped by legislation in July 2022. This paper examines and reconstructs the extent to which the aforementioned ‘ban on advertising’ was (in–)‌compatible with recognized standards of medical ethics. For this purpose, arguments put forward in public discourse on both sides of the conflict, insofar as they go beyond basic attitudes toward abortion, will (...) be subjected to a plausibility test from the perspective of medical ethics. This will show that (I.) according to the standard understanding of autonomy in medical ethics by Beauchamp and Childress, the provision of information about abortions is not an undue influence, but a necessary precondition for autonomous decisions by pregnant women; that (II.) the feared undesirable social developments after the abolition of § 219a StGB are empirically unfounded and largely implausible; but that on the other hand (iii) a multi-perspective communication landscape with accessible expert information promises to effectively counteract the self- and external stigmatization of unintentionally pregnant women. As a result, this analysis provides two things: a coherent medico-ethical justification for the annulment of § 219a StGB and an argumentative basis for the defense against future efforts to support biopolitical positions by censoring available information.
