Abstract:The Paris Agreement requires that States take action to avoid dangerous climate change. It is informed by the Intergovernmental Panel on Climate Change that summarizes hundreds of scientific articles, yet the language of the treaty does not mirror the scientific literature. Instead, the Agreement encourages States to join in a collective effort without assigning responsibility for past emissions. The Agreement tells a story that does not track the truth. One justification is to see it as a "noble (...) lie," and that, like in the Republic, it could be the story that States need to hear to do what must be done. (shrink)

Проаналізовано основні маршрути біженців. У зв'язку з цим визначено основні країни - експортери та імпортери біженців. Проаналізовано основні заходи, що має намір ужити Єврокомісія для регулювання міграційної кризи, яка склалась у світі.

This article provides an overview of some of the key changes brought about by the groundbreaking Framework Agreement (known as the Ohrid Agreement) in Macedonia since its signing in 2001. A power-sharing arrangement, it saved Macedonia from the brink of civil war. This article describes how the Ohrid Agreement restored peace by addressing the constitutional status of minorities, their equitable representation in the public sector and issues connected with higher education in the 2002–2006 period. It further assesses (...) the merits of decentralization as a remedy for safeguarding a unitary state in a multi-ethnic environment. It consequently argues that the Ohrid Agreement and the ensuing reforms have been important steps in the right direction revitalizing Macedonia by empowering not only the sizeable Albanian population but other less numerous communities as well. However, daunting challenges remain ahead. The perception and language gap between the two main ethnic communities hinder efforts for a truly functioning multi-ethnic state. Moreover, the new government formed after the July 2006 general elections has stirred controversy and caused tensions affecting its Euro-Atlantic perspective. To what extent this will affect Macedonia’s multi-ethnic democracy remains to be seen. (shrink)

The Nile, one of the longest rivers in the world, has not been subjected to a uniform legal regime yet, despite the pressing needs. The hitherto proposals presented by the riparian states of the lower and upper reaches have not been unanimously accepted. Egypt and Sudan face particular difficult situation since the Nile river is their main source of water supply. It is argued that the lack of necessary coordination among all the States in the basin may in the future (...) lead to significant damage and consequences both in terms of access to water and its quality. This new edition of Darwin’s work is due, says the introduction, to the interest felt in the new science of kinesics, viz., the non-verbal aspects of human communication. Darwin felt that the genetic approach to the problem should throw light on the emotional expressions to be observed in animals, children, the insane and normal adults and he crystallized his findings in a number of definite laws. More recent attention to these problems however shows the danger of dogmatism in this department. (...) For scientific knowledge concerning emotion is neither comprehensive nor overly exact; the nature of emotions, their meaning, their physiological aspects and external manifestations are still obscure. When knowledge of the situation to which the emotion is a response is withheld, there is little agreement among observers as to what specific emotion is being depicted, e.g., in a photograph. When that knowledge is supplied the agreement grows; it further helps the observer to be acquainted with the person depicting the emotion for it appears that the individual has only two or three expressions which appear in the great majority of his responses to widely different situations. And many of these responses are acquired rather than innate, social rather than emotional in character, as can be seen in the manner in which they vary from one people to another. (shrink)

As a natural result of globalization and migration from village to city, peace, ease, and happiness of people who have to coexist in cities are extremely important. Beliefs, systems, ideologies, and institutions aim to achieve this. This situation forces individuals and groups who live together, whether they want to or not, to get to know and communicate with each other within a trust environment. The most important factor that makes recognizing segments of society with different characteristics and communicate with them (...) in a healthy way is to develop a culture of coexistence among the community members. Coexistence means that people with different identities and affiliations are united around the citizenship denominator and contributing to the continuation of social life in unity and solidarity. This understanding must be transformed into a cultural consciousness in the community members. Because, polarization, marginalization, discrimination, and violence become common among individuals who live in societies where the culture of living together and the awareness of citizenship are not developed. It is not possible to ensure coexistence only by law. In societies where a culture of cohabitation develops, differences are not seen as a cause of separation, but as a richness that diversifies society and gives dynamism to social life. In societies dealing with political, social, economic, and moral problems, religion, language, race, ethnic identity, and regional sense of belonging might be more likely used as terrorization tools. The self-confidence that accurrate religious knowledge gives to individuals might weaken such a possibility. Islam anticipates a social system that facilitates a pecaful and easeful life for the people. Giving importance to principles such as love, respect, tolerance, justice, consultation, assistance, and solidarity in the Qur'an is an indication of the need for this system. The Prophet Mohammad had the opportunity to apply an example of this system in Madinah anticipatedin the Qur'an in Madinah. After the migration, some principles related to the basic rules of coexistence were included in the Madinah agreement, which the Prophet signed with representatives of different segments living in Madinah. It is very important that these principles are able to shed light on the issues happenin in the recent world. The experience of living together in the time of the Prophet Muhammad (pbuh) should be introduced to the next generations with correct information. Because, The Medina Agreement, which has an important place in the history of Muslims, is an important example of the ability to live together in peace and ease by maintaining differences in society. The Medina Agreement is the first written document that allows different groups of people residing in Medina to live together. The main purpose of this agreement, which the Prophet made with the Jewish, Christian, and polytheistic tribes in Medina after the migration, is to protect the fundamental rights stemming from the citizenship of people who live in the same city by having different faiths and cultural values. If so, the Madinah Agreement might be an example for many societies that recently experience discord and unrest due to their characteristics such as religion, language, race, political thought, and etc. In this regard, this article focuses on the importance of the culture of coexistence in the context of the Madinah Agreement and the process of formation of this culture and offers some suggestionsthat will facilitate peace and ease for different groups living in the same society. Some of these suggestions are as follows: Differences such as language, religion, race, culture, and political thought among the realities of social life should not be seen as an element of discrimination, everyone should contribute to the peace and well-being of society by combining in the common denominator of citizenship. In educational institutions, it should be taken into account values such as human love, respect for the other, tolerance, freedom of thought, empathy, and peace. In addition to educational institutions, all segments operating in the field of law, politics, economics, religion, and media should unite, and thus, should develop a consciousness of citizenship in society, where differences in race, religion, language, culture and political views are seen as richness. This essay examines the controversy over the attempt to establish rules governing global capital flows in the Multilateral Agreement on Investment (MAI), which became a target of “antiglobalization” activism. Making sense of the activists' concerns about the MAI requires understanding how the emergence of transnational standards in contemporary globalization constitutes an exercise in power. I develop the concept of “network power” to explain the way in which the rise of a single coordinating standard for global activity can be experienced (...) as coercive, as it eclipses alternative standards and abrogates the genuinely free choice among different conventions. Using a network‐power analysis, I reinterpret the controversy over the MAI as a concern about the processes by which neoliberal globalization is being brought about. (shrink)

How should we deal with noncompliance in the context of the Paris Agreement? After having delimited the scope of noncompliance as a motivational issue, I will argue that two kinds of reasons can motivate agents to comply, moral and prudential reasons. Then, I will show that moral and prudential reasons can motivate compliance, although in different ways, as moral reasons require the institutions, whereas prudential reasons are thought to be self-sufficing. Prudential reasons come with the assumption that they have (...) ample motivational force to elicit compliance. I will contend that, for what concerns climate treaties, this assumption does not hold. To do so, I will argue that, from an interest-based perspective, reasons for agreeing on a treaty rarely conflate with the reasons that motivate agents to complying with it, so, if we want to ensure compliance, the international climate regime should establish institutions to oversee compliance when prudential reasons fails to motivate. Inter-ethnic relations between Albanians and Macedonians in Macedonia have been rather problematic since the times of former Yugoslavia. After independence, the new constitution of the Republic of Macedonia instead of improving it has further downgraded the position of Albanians and other minorities living in the country. The non-fulfilment of Albanians’ core demands led to an armed conflict in 2001. The Ohrid Agreement has in addition to ending the armed conflict, also provided for a range of legislative and policy measures (...) to improve the position of the Albanians by ensuring equality and minority protection. However, 16 years after the Ohrid Agreement, inter-ethnic relations in Macedonia still remain burdened by prejudice and stereotypes, rather than cooperation and mutual prosperity. The main aim of the paper is to analyse the state of inter-ethnic relations in Macedonia, with special focus on relations between ethnic Macedonians and ethnic Albanians. The paper also offers an analysis of main factors that contribute to inter-ethnic tensions in the country and explores possible scenarios in the future. The most relevant part of the paper analyses the causality between inter-ethnic and interstate relations. The paper claims that similarly to most of the countries in the Western Balkans, inter-ethnic and interstate relations are basically the components of the same equation. The paper concludes that in Macedonia, Kosovo rather than Albania is much more relevant for the causality between inter-ethnic and interstate relations in Macedonia, and it also offers several reasons to support such thesis. Accordingly, the overall inter-ethnic relations between Macedonians and Albanians in Macedonia heavily depend on inter-state relations between Macedonia and Kosovo and vice versa. (shrink)

From 8 February until at least 19 April 1686, the Dublin Philosophical Society was occupied with a prodigiously talented young girl whose name was never recorded. She was less than eleven years of age, but still much older than the society itself, which had begun meeting less than three years previously. Although one of many wonders engaging the curiosity of the nascent society, this girl served a surprising range of purposes, so that accompanying her anonymity was a curious malleability. (...) Pressed into several different roles and identities, her exploitation affords a glimpse into the various qualities that could make a spectacle useful in a philosophical climate that was unique among the British Isles. The use of this girl therefore not only sheds light on the needs of a less familiar learned society, but also shows how these could differ from those of its better-understood counterparts. For a period of time, it was the versatility not of the gentlemen in Dublin, but of the prodigy they used, that best served this group on the periphery. (shrink)

Halk arasında yarıcılık olarak bilinen bu ortaklıkların temeli, fıkıhtaki müzâraa ve müsâkāt ortaklıklarına dayanmaktadır. Agricultural production has an important role in the Turkish economy as in many countries. However, the hazelnuts, tea and fresh fruits have been produced through inefficient methods for a long time. With the development of technology and new techniques, farmers have started to produce more efficient agricultural production with low costs. The basis of these partnerships, known as sharecroppers among the farmers, is based on muzara’ah and musaqat partnerships in Islamic Law. However, today it is not known whether these partnerships are made in accordance with the conditions of muzara’ah and musaqat agreements. In this study, we investigate how musaqat partnerships are made over hazelnut production, and we also try to detect problems that appear during the partnership. In addition, we offer suggestions to eliminate the detected problems. When the literature on musaqat is examined, it is seen that this partnership agreement is not the subject of research separately, and that the issue is generally discussed in some fiqh issues that concern partnership agreements. During the literature review, it was seen that today there are no studies on how the partnership contract is fulfilled and what problems emerge in terms of Islamic law. The fact that this study directly focuses on the current practices of musaqat partnership and identifies the emerging fiqh problems will fill a gap in the literature. (shrink)

Written from the point of view of a campaigner against economic globalisation, this paper looks at the recent Multilateral Agreement on Investment (MAI) and the campaign against it which eventually led to its demise. It looks at the nature of the diverse coalition of interests opposed to the MAI, and in particular their use of e‐mail and the Internet, and argues that the success of this campaign has lessons beyond the immediate victory over the forces promoting the MAI. It (...) is argued that the emergence of anti‐globalisation action also contains the seeds of new grassroots forms of ethical social organisation, based in specific but interconnected localities, a cosmopolitan interlocalism, and that this in itself remains a key feature in the short‐ and long‐term success of such action. The most popular argument against moral realism is the argument from disagreement: if there are mind‐independent moral facts, then we would not expect to find as much moral disagreement as we in fact do; therefore, moral realism is false. In this paper, I develop the flipside of this argument. According to this argument from agreement, we would expect to find lots of moral disagreement if there were mind‐independent moral facts. But we do not, in fact, find much moral disagreement; (...) therefore, moral realism is false. I defend the argument, explain the empirical evidence that supports it, and show what makes this challenge novel and powerful. (shrink)

Stanley Cavell’s account of aesthetic judgment has two components. The first is a feeling: the judge has to see, hear, ‘dig’ something in the object being judged, there has to be an ‘emotion’ that the judge feels and expresses. The second is the ‘discipline of accounting for [the judgment]’, a readiness to argue for one’s aesthetic judgment in the face of disagreement. The discipline of accounting for one’s aesthetic judgments involves what Nick Riggle has called a norm of convergence: the (...) judge aims to get one’s audience to taste see or hear what the judge tastes or sees or hears in the object being judged. Because of the unmistakable difficulty in reaching agreement in aesthetic judgment, Riggle has denied that aesthetic judgment requires a convergence norm and has proposed instead that it requires ‘a kind of harmony of individuality’ (which Riggle calls ‘vibing’). We argue that Cavell offers a version of the convergence norm that is distinct from those that Riggle criticizes, namely Kant’s demand for agreement and Andy Egan’s presupposition of similarity in dispositions in ‘non-defective’ aesthetic conversations. Cavell’s version of the convergence norm is ‘the hope of agreement’. One can hope that one’s audience will agree with one’s aesthetic judgments even when one isn’t in a position to demand agreement or to presuppose similarity in the dispositions that would make agreement more likely. Cavell’s distinct convergence norm avoids Riggle’s criticisms and contributes to a richer account of what’s going on when we disagree about aesthetic matters. (shrink)

William Molyneux's friendship with John Locke helped make Locke's ideas well known in early eighteenth-century Dublin. TheEssay Concerning Human Understandingwas placed on the curriculum of Trinity College in 1692, soon after its publication. Yet there has been very little discussion of whether Irish women from this period read or knew Locke's work, or engaged more generally in contemporary philosophical debate. This essay focuses on the work of Laetitia Pilkington (1709–1750) and Mary Barber (1685–1755), two of the Dublin women (...) writers of the so-called ‘Triumfeminate’, a literary and intellectual circle connected to Jonathan Swift which met and discussed ideas at the home of Patrick Delaney. Pilkington and Barber were particularly influenced by Locke's ideas on obstetrics and childhood in hisSome Thoughts Concerning Educationand especially by his discussion of memory in theEssay Concerning Human Understanding. Both authors engage playfully and imaginatively with Locke's theories, especially in a domestic context. Not all philosophical debates took place in the public male spaces of school, coffee house and university. This essay attempts to recreate the contexts in which intellectually curious women of the ‘middling sort’ encountered and engaged with philosophical ideas, especially those of Locke, and how these shaped their writing. This paper establishes the generalisation that whenever agreement with the finite verb is controlled by a constituent that is not in a Spec–Head relation with the inflectional head of the clause, this agreement cannot affect person. A syntactic representation for person inside the noun phrase and on the clausal spine is proposed which, in conjunction with the workings of agreement and concord, accommodates this empirical generalisation and derives Baker’s Structural Condition on Person Agreement (SCOPA). The proposal (...) also provides an explanation for the φ-feature agreement facts of specificational copular sentences. We investigate the possibility of arguing for or against the philosophical position that mathematics is an _epistemic exception_ on the basis of agreement data from the mathematical peer review process and argue that Cohen’s \(\kappa \), the standard agreement measure used for inter-rater agreement, is unable to detect epistemic exceptionality from peer review data.

Public deliberation has been defended as a rational and noncoercive way to overcome paradoxical results from democratic voting, by promoting consensus on the available alternatives on the political agenda. Some critics have argued that full consensus is too demanding and inimical to pluralism and have pointed out that single-peakedness, a much less stringent condition, is sufficient to overcome voting paradoxes. According to these accounts, deliberation can induce single-peakedness through the creation of a ‘meta-agreement’, that is, agreement on the (...) dimension according to which the issues at stake are ‘conceptualized’. We argue here that once all the conditions needed for deliberation to bring about single-peakedness through meta-agreement are unpacked and made explicit, meta-agreement turns out to be a highly demanding condition, and one that is very inhospitable to pluralism. The 1992 Convention on Biological Diversity (CBD) and its 2010 Nagoya Protocol brought about a breakthrough in global policy making. They combined a concern for the environment with a commitment to resolving longstanding human injustices regarding access to, and use of biological resources. In particular, the traditional knowledge of indigenous communities was no longer going to be exploited without fair benefit sharing. Yet, for 25 years after the adoption of the CBD, there were no major benefit sharing agreements that led (...) to significant funding streams for indigenous communities. This changed with the signing of the Rooibos Benefit Sharing Agreement in South Africa, described in this paper. As the authors report, the Rooibos Agreement is a superlative in two respects. It is the biggest benefit sharing agreement between industry and indigenous peoples to date. It is also the first industry-wide agreement to be formed in accordance with biodiversity legislation. This article is a co-production between traditional knowledge holders, the lawyer who represented their interests, the Co-Chair of the Nagoya Protocol negotiations, and an ethicist who analyzed the major challenges of this historic agreement. With no precedent in the benefit sharing world, the agreement stands as a concrete example of the ‘art of the possible.’ Although the rooibos case is unique in a number of aspects, the experience offers many transferable insights, including: patience; incrementalism; honesty; trust; genuine dialogue; strong legal support; a shared recognition that a fair, win-win deal is possible; government leadership; and unity amongst indigenous peoples. Such ingredients of success can apply well beyond southern Africa. (shrink)

In this paper, we provide an overview of how the outcomes of the Uruguay Round affected the application of pharmaceutical intellectual property rights globally. Second, we explain how specific pharmaceutical policy tools can help developing states mitigate the worst effects of the TRIPS Agreement. Third, we put forward solutions that could be implemented by the World Bank to help overcome the divide between creating private incentives for research and development of innovative medicines and ensuring access of the poor to (...) medicine. Fourth, we evaluate these solutions on the basis of utilitarian considerations and urge that equitable pricing is morally preferable to the other solutions. (shrink)

We examine the short-term and long-term impact of bilateral agreements on migrant workers’ vulnerability during their employment in Israel. To do so, we developed the Vulnerability Index of Migrant Workers based on five dimensions: poor working conditions, poor living conditions, poor safety conditions, low wages, and dependence on migration costs. We focus on migrant workers arriving in Israel from two different countries, employed in two different sectors of the economy. Data was gathered through a survey conducted among workers arriving from (...) both countries before and after the implementation of the bilateral agreements. The study revealed that after the implementation of bilateral agreements, the working, living and safety conditions of migrant workers remained poor or even worsened. For Thai workers, there was a slight improvement in the working and living conditions in the short term after the bilateral agreement, but they worsened in the long run. The total Index of Vulnerability of both groups showed improvement due to the dramatic decrease in dependence on migration costs, despite the deterioration in some working and living conditions and the reduction in migrant workers’ relative wages.
