The process of territorial planning is complicated, because there are different and even opposite interest of persons related with particular territory. Administrative legal regulation of territorial planning in Lithuania underlies emergence of a legal conflict, namely the administrative litigation. Investigation of the administrative dispute applying the pre-litigation procedure allows the parties thereof to save both money and time. This article presents the problematic aspects of the pre-trial investigation of the administrative disputes arising in the area of (...) territorial planning. The article is composed of an introduction, three parts and conclusions. In the first part the characteristics of the disputes arising in the area of territorial planning, the preconditions of origin, and the demand for the pre-trial investigation thereof are analyzed. Legal regulation of pre-trial investigation out-of-court of the disputes arising in the area of territorial planning is revealed in the second part. In the third part key provisions of the reform of the pre-trial investigation out-of-court of the disputes arising in the area of territorial planning are discussed. (shrink)

Prevention and social planning are two terms that bind to the sense of community and identity of a territory, at a time of socio-economic regeneration of the territory itself and resilience to the crises imposed by globalization. The local community is at the center of the processes of renaissance, or at least this is what all decision-makers declare in their planning. In reality, programming needs to confront the demands, values, resources and power of change that belong to the (...) local community, as an expression of relationships and power. The relationship between external/internal agents of change is not only limited to policy makers and stakeholders, but also to the view that they have of the dichotomies such as: health/health, well-being/disease, development/protection, investment/cost, participation/delegation. What limits ought there be on a state’s ability to create a homogeneous society, to increase or perpetuate non-diversity, or to create hierarchies within existing diversity? This article examines those questions with reference to the Lieberman Plan—which proposes to transfer populated territories from Israel to the Palestine in exchange for Jewish settlements on the West Bank— as an abstract exercise in demographic transformation by the state. First the article considers if the Lieberman plan would “work”: Would it create the alterations (...) it proposes, and would those changes achieve a stable, peaceful, perhaps even just settlement? It finds that though there is debate about the range of effect, there is little doubt that transfer would alter the state’s demography. It then turns to the international standards that might govern the transfer of territory and the denaturalization of citizens, to see how they would characterize such a plan. It finds that comparisons to ethnic cleansing are inapposite, and that norms protecting citizenship are considerably more complex than they first appear—even allowing ethnically targeted denaturalization in some cases. The article then analyzes the loyalty provisions of the Lieberman Plan, and notes that, contrary to the usual normative assumption that citizenship is tied to the state, the foundations of citizenship are actually a habitual or formative link to a given territory, which in turn creates a right to citizenship not in any particular state, but in the one that incidentally is sovereign over that territory. This interaction of citizenship and territory, when considered together with norms requiring equal protection for all citizens, suggests that the polity has an interest in defining its own territorial scope, and thereby its membership. The legal regime is ambiguous, and therefore deliberations about this question are in the realm of politics. The article demonstrates how transfer’s assimilation to existing norms suggests a novel interpretation of selfdetermination with far-reaching consequences for both sides of the conflict. Finally, the article notes that international law, though it polices excesses, is largely silent on the principal determinant of demography: the fact of state control over territory. (shrink)

Taking advantage of economic opportunities has led to numerous conflicts between society and business in various geographies of the world. Companies have developed social responsibility programs to prevent and manage these types of problems. However, some authors comment that these programs lack a strategic vision. Starting with the Working with People model, created for the field of rural development planning, this paper proposes a methodology to prevent the generation of social conflicts from business strategy: the territorial dimension. Finally, an experience in Peru, a country that has been characterized in recent years by high economic growth and also by the presence of social conflicts that have stopped entrepreneurship is analyzed. Management of the renewable natural resources in Madagascar is gradually being transferred to the local communities, particularly that of forest resources. However, these local communities are struggling to assess the consequences of management plans that they themselves must develop and implement on ecologically, economically and socially sustainable grounds. In order to highlight key aspects of different management options beforehand, we have developed MIRANA, a computer model to simulate various scenarios of management plan implementation. MIRANA differs from other simulation models by (...) not only taking into account individual practices and economic exchanges, but also by accounting for the applicable regulations. These regulations are taken into consideration by means of a multiplicity of normative structures within a spatial context. The objective of this paper is to describe the representations of institutions, norms and territories proposed by MIRANA and to discuss these representations in relation to the state of the art in the field of normative multi-agent systems. The Covid-19 pandemic has been analysed and discussed from many disciplinary perspectives. An aspect that still needs critical exploration is the role—that is, the modes and forms—of regulatory interventions during the pan- demic. It is interesting to note in this regard that, in many studies, regulatory measures are labelled “non-pharma- ceutical interventions”, as if they do not have any specificity on their own and only represent a theoretically residual category. The main aim of this article is instead to focus on (...) the distinctive features of normative measures as such. As regards the article’s focus, it centres on the normative interventions in the first period of the pandemic—that is, 2020—with particular reference to Italy. We have chosen to focus on this period because the most extensive and severe restrictions introduced to combat Covid-19 were established at that time. And we have chosen to con- sider Italy because it was the first country, after China, to be hard hit by the virus and to react in a draconian manner. As regards the methodology, the article is based, in general and primarily, on an extensive interdisciplinary literature review. With reference to the Italian case, the study is additionally based on: first-hand data collection and analysis (especially concerning Italian normative measures mainly issued at the national level: their type, frequency, target, hierarchical relationships); second-hand data and analysis (for instance as regards the effectiveness of Italy’s and other countries’ regulatory measures). In discussing the Italian response to the Covid-19 pandemic, certain weaknesses have been identified; and possible lessons have been highlighted, in terms of both “planning” (i.e. the necessity to better pre-define concrete and circumscribed sets of actions) and of “meta-planning” (i.e. the necessity of better planning the way in which public authorities could and should plan and act). Although this article is mainly based on the Italian situation, what we can learn from this case is largely generalizable. (shrink)

The first signs of historical settlements in Tirana date back to the year 1614. These settlements and their road system belongs to the Ottoman city structure. Nowadays this historic northeast area of Tirana consists of a conglomeration of buildings that date back to different historical periods. A good part of these dwellings are informal ones, which damage the morphology of the area. This paper is considering a genuine historical basis to create an intervention model in this specific area of Tirana. (...) The total surface of the area which is rigorously analyzed is 2.08 ha. Regulatory plans that will be considered for this analysis are the regulatory plans of 1917, 1921, 1937, 1953, 1980, up to today (the existing situation of the city of Tirana). The whole area will be analyzed including the typical road system; the typical structure of the dwellings, and the typical morphology of the area. All dwellings will be filed, according to historical dating situation and the existing situation. The current local general (PPV) plan provides a radical intervention in this area which seriously damages the historical heritage of the city of Tirana. This article aims and focuses on a territorial development model recovering it and not damaging it, (in contradiction with the current regulatory plan). The new model will be clearly detailed (up-to-level plans). The city of Tirana needs historical heritage and historical identity. How can one damage such treasure which the time took care so much to create and preserve? Such allusions are to be spoken out loudly! (shrink)

As a theoretical extension of other previous studies, this work represents an improvement of the notions about the relationship between adolescence and Mafia. The research has been aiming at exploring teenagers’ universe within specific social contexts where the presence of criminal organizations is significant, focusing the attention on the modalities through which evolutionary tasks are coped with in contexts with high Mafia density and often characterized by a perception of social space that makes personal, financial, and political development problematic. The (...) research has involved 93 teenagers who live in southern regions where the presence of Mafia organizations is significant. Six focus groups have been carried out, recorded, and transcribed. In “The Blessing of Departure—Exchange of Populated Territories The Lieberman Plan as anExercise in Demographic Transformation,” Prof. Timothy Waters offers a strong endorsement of the right of ethnic majorities within a state to redefine their state's boundaries in ways consistent with the majority's right to self-determination and to opt out of a political union with minority groups, regardless of the latter's' political preferences. Applied to the Israeli context, Waters concludes that parts of the Lieberman Plan—a plan advocating the redrawing of (...) Israel borders, inter alia, in ways which exclude some areas populated by Israeli citizens belonging to the Arab-Palestinian minority —does not run afoul of international law . This short response challenges two points that are central to Waters’s analysis. First, that the right to self-determination of peoples—in particular, the right to external self-determination —is subject to temporal or contextual limitations. The right is fully applicable only in exceptional and formative moments in the life of a nation—e.g., during the formation of a new polity or the collapse of an existing political arrangement , and when states systematically fail to respect the basic interest of some of the groups that comprise its populace—i.e., in response to extraordinary situations of groups exclusion or oppression. Second, even if Waters is correct and an ongoing right to self-determination—including, a right to secede from existing states—is available to ethnic groups comprising diverse national societies, the invocation of such a right must necessarily be limited by other positive rules of international law designed to protect group and individual interests. Specifically, Waters’s concept of self-determination as a right of a preliminary nature, that overrides other human rights , is debatable. (shrink)

The work highlights the problems of economic risk management in a territorial context. The purpose of the study is to substantiate the strategic management of economic risks in a territorial context, based on the development of a mechanism of criteria that can give a generalized assessment of the results of risk situations, based on consideration of the variability of the development of the territorial economy. When assessing risks, special attention is paid to the economic results of the (...) consequences of their occurrence for the objectivity of strategic planning. The materials studied on various approaches to risk assessment show the economic category, while there is a functional connection between social and economic processes. The calculation technology itself requires improvement, which consists in creating a mechanism for generalizing indicators, concentrating them in a territorial context. Most likely, when developing a strategy for the development of the economy of a territory, it will be necessary to consider the variability of events that involve the occurrence of risks, providing an objective assessment of risks when making management decisions. The scientific novelty of the study is to justify the development of a mechanism for assessing the risks of the territorial economy, based on the relationship between the consolidation of risk analysis indicators and the effectiveness of the development of socio-economic processes, while comparing various options for the forecast effect. As a result of the study, the problems of assessing the strategic management of economic risks in the territorial context made it possible to develop generalized indicators characterizing risk events. Anyone reading Yuval Shany’s response to my article, “The Blessing of Departure—Exchange of Populated Territories The Lieberman Plan as anExercise in Demographic Transformation,” would hardly characterize it as “agreement.” In part this is because Shany builds his case by assuming I am saying something about self-determination that misses—at least misplaces—my real point. This is unfortunate, both as it masks the fact that Shany and I actually agree transfers can be legal, and it distracts attention from the points of real, substantive (...) disagreement. The misreading is not an accident, rather the product of a patterned view. The points of disagreement, center on: whether transfer is a harm per se; whether the presence of a minority affects the state’s power to transfer; whether there is a positive right not to be denationalized; and whether there is a hierarchy of rights. Se analiza el debate actual sobre el concepto de Escuela de Salamanca. Se muestran las nuevas propuestas de los estudiosos: su carácter global (no solo Salamanca); su alcance interdisciplinar (no solo teológico, también jurídico, económico, sociopolítico, etc); la cuestión de los miembros también experimenta una ampliación, aunque siempre se señala un cierto cordón umbilical con los Maestros salmantinos; todo ello dentro de un marco temporal que se extiende durante el siglo XVI y primera mitad del XVII. Estas nuevas perspectivas no (...) excluyen los elementos tradicionales, sino que amplían y desarrollan el concepto primitivo, pero con carácter inclusivo. Por último, se aborda el tema de las condiciones de posibilidad de la Escuela, que se contextualiza en un ámbito histórico que la hace posible. La psiquiatría nace con el siglo XIX, la fenomenología con el XX. Desde el advenimiento de la segunda ha querido la primera ver en ella una vía para la superación del positivismo que la atenazaba desde su mismo origen. Uno de sus intentos más logrados fue el del psiquiatra Ludwig Binswanger a lo largo de los años veinte del pasado siglo. Recorrió en ese tiempo las Investigaciones lógicas de Husserl y ensayó su acercamiento a la psicología estructural. Proponemos que una (...) deficiente lectura de las posibilidades de la fenomenología ―comprensible en su prematuridad, desgraciada en su ímpetu anti-(neo)kantiano― impidió que reconociera su horizonte trascendental y así pudiera entrever caminos de acceso al mundo, a la persona y a su concreto sufrimiento. Para concluir presentamos el intento que supone el proyecto La mirada filosófica como mirada médica por recuperar aquella problematicidad y ahondar en una aproximación respetuosa al padecer, tal como aparece, sin violentarlo por el concepto. One of the main purposes of Terwagne's law is to associate the regions to the economic planning. Three regions : Flanders, Wallonia and Brabant are instituted and endowed with organs, the SDR and the CBR.The CERB took part to the regionalisation of the Plans. But various factors made this regionalisation insufficient.The CERB still expressed views on the used water purification, transport infrastructure, territory planning and institutional matters. Moreover, the ERB greatly developed its research mission rather than claiming activity. (...) Meanwhile, the subsequent development of the ideas about regionalisation led to a delimitation of a central region not the same as that instituted by the economic decentralisation : the Brussels region restricted to nineteen communes.The activity of CERB makes it primarily a consultative organ of the future regional institutions. But as a preliminary, the geographical competence of the CERB and its composition must be modificated.To organize a real regionalisation, it is necessary to suppress technical impediments and it is also necessary that the consultation should be complete and real. Interim measures are procedural means that allow persons or States to have their rights preserved when a case is pending. Application of these measures especially in environmental cases is very important. In many of these cases (e.g. cases dealing with territorial planning, IPPC permits, environmental impact assessment, etc.) the claims deal with the protection of environment or its components (water, air, soil, etc.) as well as with the protection of public interest. Legal regulation of application of interim measures (...) provided by Lithuanian Law on Administrative Proceedings is not optimal. That is why the first part of the article is dedicated to the analysis of the possibilities and problems of application of interim measures in the administrative proceedings in Lithuania, paying special attention to environmental cases. The second part of the article reflects the findings of a workshop of the Association of European Administrative Judges on „Interim relief in environmental matters” held in Vilnius on 22 September 2011. It briefly describes various national rules on interim relief procedures, especially in the German and the French legislation, with an assessment from the German point of view. This part of the article focuses on provisional legal protection where a permit is challenged by a third party whose rights are allegedly afflicted. In such a constellation the rights of the plaintiff compete with the rights of the operator. The article concludes that, when deciding on the necessity of interim measures, it is vital to ensure the balance of interests: both by ensuring effective access to justice and by protecting the respondent and the third party (in environmental cases - usually the operator) from the violation of their rights and the damage caused by the abuse of the right to request interim measures. In such cases short time limits for procedural steps both of the parties and the court are not advisable and a prima facie prognosis on the outcome in the main proceedings meets the interests of the parties. The Resolution of the Seimas of the Republic of Lithuania on the Approval of the State Sports Development Strategy for 2011-2020 states that it is important to create and develop a horizontal structure of public administration of sport, which includes many state administration areas and municipal institutions, which would allow to develop cooperation with non-governmental sports organizations and private sector of sports activities. To create legal and economic conditions for the fast development of active and healthy lifestyle and universal sports (...) clubs as primary subjects of the national sport system; to promote their contribution to non-formal sports education and employment of children and young people, development of various sports, interaction between amateur and professional sports. In this respect, the tasks have been set to create a multi-tier system of strategic cooperation with non-governmental sport organizations with public administration structures, to expand cooperation between municipal institutions in the field of sport, authorized by the Government of the Republic of Lithuania so that these resolutions include the National Sport for All Development Program implementation, enhancing the vitality of communities through sport, ensuring healthy lifestyle conditions and developing sports infrastructure through territorial planning documents and investment programs; to create and develop a system of partnerships in the field of sport between public and private sectors; to develop cooperation between institutions of all fields of management by developing and implementing physical activity, healthy lifestyles and work ability, social cohesion through sport, leisure employment and social prevention and other interinstitutional programs, accordingly reorganizing and expanding functions of the institution authorized by the Government, strengthening its administrative capacity. The implementation of the strategy is particularly relevant, as is the case at the level of municipal administrations and councils, to which functions are delegated to implement the priority functions of sport policy. Problems in the implementation of sport policy are analyzed by scientists as well as representatives of sports policy legislators. The aim of the research is to analyze how the sports policy of the Republic of Lithuania is formulated and implemented in the activities of municipal administrations and councils. Research methods -analysis of scientific literature, analysis of laws, analysis of sports management system. Research results and conclusions. The real role of municipalities and the priority to develop community sport, to promote the vitality of communities has not been realized yet. The role of private business for private investment in sports infrastructure for the development of sports movement and cooperation with socially responsible business representatives, the independent role of clubs and non-governmental organizations as a priority have also not been understood and finally not implemented. In the functional division of activities in the sport policy process, all chains of interaction between organizations, acting within the competence, must strive to implement laws and strategic goals of sports policy. In order to achieve these objectives, the activities of the institutions depend on the political decisions adopted jointly by the central government, public programs and projects. It is important that the executive structures are delegated the same kind of functions, so that the implementation of the policy is carried out consistently in all areas of the republic.Improvement of the process of implementing sports policy and the search for the improvement, trying to achieve the efficiency of activities of municipal administrations and councils must be the main goal of all institutions involved in it. The whole system of institutions involved in the development and implementation of sport policy is too centralized. Institutional differences in the management of interdependence and in the resolution of structural problems between national organizations and municipal organizations are very pronounced. This has a negative impact on the status of municipal territorial sports divisions, when grants are distributed from the state budget, selecting sportsmen, performing medical technological examination of promising sportsmen, setting up sports bases, and so on. Anna Stilz’s Territorial Sovereignty (2019) aims to be a revisionist account of territorial rights that puts the value of individual autonomy first, without giving up the value of collective self-determination. In what follows I examine Stilz’s definition of occupancy rights and her emphasis on the moral relevance of what she calls ‘located’ life plans. I suggest that, if it aims at being truly revisionist, her theory should work with a broader definition of occupancy. So long as it doesn’t, (...) these rights will be mainly the preserve of groups of settlers and peoples with predictable patterns of movement. Moreover, insofar as occupancy rights ground collective rights to self-determination, they actually have the potential to trump individual rights to what I call ‘dynamic’ or non-located occupancy. This is worrying, I claim, for at least two reasons. First, rights to dynamic occupancy are arguably as central for respecting individual autonomy as rights to located occupancy. And second, rights to dynamic ocupancy should be seen as key in helping to form the kind of political allegiances required to overcome the most pressing collective action problems that humanity faces. We interviewed Galileo Morandi, a young Italian architect working in a research project on architecture and new technologies and author of several publications about the relation between city, territory and project. The discussion starts and finishes in a place where Morandi studied and worked, Dubai – example of a city in rapid growth and in its way iconic representation of the new globalized cities – passing through Milan and Los Angeles, the new Chinese town and a village in the mountains. Starting with the hypothesis that during this first decade of the 21st century a certain territorial culture has spread that implies greater awareness of landscape on the part of the authorities, the economic and social agents who exercise a degree of leadership in territorial matters and the general public, this article sets out to analyse the possibility that a new ethics of landscape is beginning to take shape. The notion of landscape as proposed by the European Convention in (...) Florence in 2000 looks at the idea of the social construction of landscape. In this new paradigm, landscape is conceived as a social product, the cultural projection of a society in a given space from a material, spiritual and symbolic standpoint. Landscape is understood to be inherently dynamic and changing. When the elements that give a particular landscape its historical and cultural continuity are suddenly removed and its sense of place is lost, we are seeing not evolution in the landscape but its destruction. And the very idea of intervention in these landscapes gives rise to the need for principles and moral values that will provide guidelines that allow landscapes, whether unique or commonplace, to evolve without being destroyed. As I see it, therefore, there is an obvious need for an ethics applicable to regional and landscape planning and management. The new ethics of landscape must be based on the ethics of responsibility, taking into account the dignity of nature, the rights of future generations to enjoy quality landscapes and the rights and duties of today's citizens whose interventions transform landscapes and with them their collective identity, their quality of life, their physical and social welfare and, in short, their happiness. The article gives grounds for a new paradigm of development - branding of the territory. The problem of region brand formation is actualized. The point of view of the author on the territorial branding as a technology of providing the balanced and stable socio-economic territory development in current conditions deserves particular attention. The analysis of territorial branding formation as independent marketing trend is given. The scientific interpretations of the category "territorial branding" are given. The proposition that branding (...) is an effective instrument of attracting attention to the territory is stressed. In conditions of informational and creative economy the existence of the city brand and its development strategies become the necessary factor of the effective realization of territorial potential. The conceptual framework of territorial branding and main characteristics of the utility of the territory are considered. The results of scientific research develop scientific knowledge in the field of branding territory theory, promote the development and use of intellectual and institutional resources of the territory for the growth of its marketing potential. This indicates, that the basic principles of territorial development, starting from the main concept to the specific project documents need updating, which is connected with the economic processes and also democratization and globalization processes. The cultural-economical planning gets priority, the foundation of it is the use of human and cultural capital of the city. The novelty is that material assets, traditionally considered being the basis of territorial economy development, lose their significance comparing to intangible assets, which are of various character: creative and cultural potential of the inhabitants, management professionalism, information environment saturation, the possibility to create the atmosphere of tranquility and comfort on the territory. Not the territory size and its economic base become the main success factors, but new unconventional management decisions, an energetic wish of the territory to formulate clearly its strategical interests in the country, in the region and in the world. This is the aim of the territorial branding. Currently the changing of territory development paradigm takes place. It becomes the subject of socio-economic relations, goods, intangible assets concentration. The emphasis of the development shifts towards culture, entertainment, impressions. (shrink)

In these circumstances, the state authorities of the Russian Federation, while maintaining global leadership in the energy sector, define as long-term development goals of (...) the country, the creation of a competitive economy based on knowledge and high technologies. Following this doctrine in the Russian regions in the period from 2012 to 2014 cluster policy is implemented on the basis of Federal and regional innovation strategies. An important role in this process belongs to the activities of leading higher educational institutions - national research universities, which contribute to stimulate an active scientific activity of students and the introduction of scientific achievements into production. One of the pilot cluster projects, funded by the Federal budget became the territorial cluster ‘ Pharmaceutics, medical technology and information technology ‘ formed in the Tomsk region with a unique starting opportunities for the development of sustainable regional innovation system is a developed scientific and educational complex, small and medium-sized innovative enterprises with the latest technological developments in pharmaceuticals and medical technology. In two years, the activity cluster, implemented with the financial support of public authorities, has been successful. In the future, there are plans to expand the range of pharmaceutical products and the collaboration with other clusters Tomsk. Cluster policy contributes to the emergence of stakeholders and large economic enterprises, thus providing a close relationship between science, business and regional authorities. (shrink)

The author of the article studies the activities of the Executive Committee of the Leningrad City Council on the development of the city and its infrastructure in the first half of the 50s of the 20th century. Particular attention is paid to prevention of attempts made by various departments to violate the existing layout of the city and cause damage to monuments of historical and cultural heritage. By the beginning of the 1950s, the tasks of restoring the municipal economy in (...) Leningrad and liquidating the damage caused by the war and the enemy blockade of the city were basically solved. In these years, the most acute task for Leningrad was to ensure a steady increase in the volume of housing construction and to reconstruct ‘under-repaired‘ residential buildings. In addition, it was necessary to build and start up the first stage of the subway, i.e. to fulfill the task set in the Fourth Five-Year Plan. To ensure the solution of these problems, the General Plan for the Development of Leningrad in 1951-1960 was developed. The most important part of the plan was the implementation of new housing construction along with the restoration and renovation of existing houses and buildings. Particular attention was paid to the development of social infrastructure. The plan provided for the construction of schools, hospitals, and other public facilities. The Executive Committee of the Leningrad City Council constantly kept under control the problems that arose with land allocation for organizations and enterprises located in the city. Sometimes the solution of these issues acquired the all-Union character, and the city’s leadership protected the interests of the residents and preserved the architectural and historical integrity of the city territories. Thanks to the principled and uncompromising position of the Leningrad City Council, it was possible to save many monuments of culture and architecture of the city, to ensure its development in strict accordance with the General Plan. Palestinians would be effectively cut off from Jerusalem, the centre of Palestinian life. Similar arrangements are likely in Gaza, with Israel keeping the southern coastal region and a small settlement at Netzarim, which is hardly more than an excuse for a large military presence and roads splitting the Strip below Gaza City. Drawing on Security, Territory, Population and The Birth of Biopolitics, this article aims, firstly, to consolidate our understanding of Foucault’s engagement with law by fleshing out his approach to law and by clarifying that he distinguishes between different kinds of law on the basis of the objectives that law serves and the regime of truth that it embodies. Secondly, using this understanding, the article proceeds to illustrate how the objectives and the regime of truth of the EU internal market law (...) have been displaced in the last few decades. It is argued that this body of law has increasingly come to perform the tasks of law in neoliberal government as pointed out by Foucault in these lectures, namely of expanding the domain of market values and mechanisms, and of restricting the exercise of legitimate government by opposing the rule of law to planning. In this regard, particular attention is paid to the way in which justiciable rights function as a technology of neoliberal rule within the internal market. (shrink)

Au-delà de son acception triviale - se loger, résider à telle adresse ou dans tel quartier -, le terme "habiter" renvoie au rapport que l'homme entretient avec les lieux de son existence, mais aussi à la relation, sans cesse renouvelée, qu'il établit avec l'écoumène, cette demeure terrestre de l'être. "Habiter" entremêle le temps et l'espace, et l'explorer revient à questionner l'histoire et la géographie d'une manière anthropologique en sachant que l'humain est un être parlant et fabriquant. Les auteurs de cet (...) ouvrage confrontent ainsi les apports de différentes disciplines à la compréhension de "habiter" et de l'"habiter". Ils témoignent de la très riche polysémie de ce verbe, source de débats contradictoires aux implications tant théoriques que pratiques. En effet, si "habiter" est le propre de l'homme, alors pourquoi accepte-t-il trop souvent l'inhabitable? Que signifie l'habitabilité de la Terre? En quoi l'architecture et l'urbanisme contribuent-ils, ou non, à la rendre habitable? Comment la qualité d'un lieu conforte-t-elle la beauté de l'existence? Répondre à ces questions revient à analyser les tensions qui se manifestent entre l'homme, la technique et la nature et aussi les représentations qui en découlent. À l'heure de l'urbanisation planétaire, de la généralisation des réseaux techniques de communication et d'une certaine homogénéisation des rapports homme/nature, il est essentiel de penser ce qu'"habiter" veut dire. City Living is about urban spaces, urban dwellers, and how these spaces and people make, shape, and change one another. More people live in cities than ever before: more than 50% of the earth's people are urban dwellers. As downtown cores gentrify and globalize, they are becoming more diverse than ever, along lines of race, ethnicity, socioeconomic class, sexuality, and age. Meanwhile, we are in the early stages of what seems sure to be a period of intense civil unrest. During (...) such periods, cities generally become the primary sites where tensions and resistance are concentrated, negotiated, and performed. For all of these reasons, understanding cities and contemporary city living is pressing and exciting from almost any disciplinary and political perspective. Quill R Kukla offers the first systematic philosophical investigation of the nature of city life and city dwellers. The book draws on empirical and ethnographic work in geography, anthropology, urban planning, and several other disciplines in order to explore the impact that cities have on their dwellers and that dwellers have on their cities. It begins with a philosophical exploration of spatially embodied agency and of the specific forms of agency and spatiality that are distinctive of urban life. It explores how gentrification is enacted and experienced at the level of embodied agency, arguing that gentrifying spaces are contested territories that shape and are shaped by their dwellers. The book then moves to an exploration of repurposed cities, which are cities materially designed to support one sociopolitical order, but in which that order collapsed, leaving new dwellers to use the space in new ways. Through detailed original ethnography of the repurposed cities of Berlin and Johannesburg, Kukla makes the case that in repurposed cities, we can see vividly how material spaces shape and constrain the agency and experience of dwellers, while dwellers creatively shape the spaces they inhabit in accordance with their needs. This paper on the phenomenology of joint agency proposes a foray into a little explored territory at the intersection of two very active domains of research: joint action and sense of agency. I explore two ways in which our experience of joint agency may differ from our experience of individual agency. First, the mechanisms of action specification and control involved in joint action are typically more complex than those present in individual actions, since it is crucial for joint action that (...) people coordinate their plans and actions. I discuss the implications that these coordination requirements might have for the strength of the sense of agency an agent may experience for a joint action. Second, engagement in joint action may involve a transformation of agentive identity and a partial or complete shift from a sense of self-agency to a sense of we-agency. The digital is deeply transforming reality. Through discussion of concepts such as identity, location, presence, law and territoriality, this article explores why and how these transformations are occurring, and highlights the importance of having a design and a plan for our new digital world.

Since the 1860s, petroleum companies, through their influence on local governments, port authorities, international actors and the general public gradually became more dominant in shaping the urban form of ports and cities. Under their development and pressure, the relationships between industrial and urban areas in port cities hosting oil facilities evolved in time. The borders limiting industrial and housing territories have continuously changed with industrial places moving progressively away from urban areas. Such a changing dynamic influenced the permeability of these (...) borders. Port cities are nodes and logistic points where various flows of commodities, wealth, and knowledge gathered before further re‐distribution. These flows affected port cities by changing their spatial organization and the availabiity of space between borders. The main question here is: How did industrial and urban borders evolve through time in port cities? Through a historical analysis, the article explores the settlements of oil facilities and the influence of oil companies over local, regional, and national governments in creating borders and how it influenced the porosity of port cities. This article, through the petroleum narrative, illustrates the impacts of past borders on the contemporary urban form through the evolution of the French port city of Dunkirk, in the North of France. As a historical study, the article analyzes the changing relationships between petroleum industrial sites and housing areas in the city of Dunkirk, using aerial pictures, archival sources, and regulations of different periods. The importance of this analysis lies in knowing that former oil sites previously located on the periphery of Dunkirk, that were forgotten by the authorities are now located within the current urban tissue. This process demonstrates the importance of historical developments to understand current challenges in the urban planning of industrial port cities. (shrink)

What, if anything, is problematic about gentrification? This article addresses this question from the perspective of normative political theory. We argue that gentrification is problematic insofar as it involves a violation of city-dwellers’ occupancy rights. We distinguish these rights from other forms of territorial rights and discuss the different implications of the argument for urban governance. If we agree on the ultimate importance of being able to pursue one’s located life plans, the argument goes, we must also agree on (...) limiting the impact of gentrification on peoples’ lives. Limiting gentrification’s impact, however, does not entail halting processes of gentrification once and for all. (shrink)

Spain is one of the most advanced European countries in terms of the legislative and administrative development of ADs. Article 11 of Law 41/2002, concerning Patient Autonomy, regulates ‘advance directives’ and has prompted various Autonomous Regions to develop legislation in this area. Nevertheless, whilst the variety of legislations in different territories presents advantages, the disparity of criteria also presents problems.Despite significant legislative development, only 23,000 Spanish citizens have filled in an AD. Clearly, AD use is confined to a minority. Several (...) surveys, however, show that the Spanish population views these documents in a positive light. Thus, we must analyse this discrepancy between attitude and practice. A similar situation exists amongst health professionals. Whilst they generally feel that the use of ADs is positive and necessary, they are frequently unwilling to employ them.Bioethical literature and research on ADs has significantly increased in Spain over the last six years. It is likely that this trend will continue in the foreseeable future; but more resources and effort are required if ADs are to become consolidated. (shrink)

The relevance of the study has two sides — individual and general. In its essential aspect, it is the development of achievements of predecessors by consistently taking into account the latest data on trends and changes in the interconnected spheres of education, economics and culture. In the individual aspect, it is about improving the professional means of improving the efficiency of teaching foreign languages in order to form students with a high level of linguistic-professional competence. Public relevance is the goal (...) of educating young people in a new patriotic direction, because today, due to various global influences, the classical principles of life in the agrarian system, created in recent centuries, or in the industrial society, are devalued due to various global influences. The purpose of the study in a broad sense was to highlight the causes and consequences of the European religious Reformation as the main factor in accelerating the movement of the whole of Western Europe to the position of the world leader that previously belonged to China. We see precis e tasks in the integrated analysis on the basis of the latest discoveries of many humanities and exact sciences in the educational, economic and cultural systems of Germany and other successful European states. On this basis, we hope to fulfill the public task which is to make significant proposals in the plans and practice of higher education reform in Ukraine. The methodology of the study relies on the best classical means, on the principle of historicism and the continuity of the connection between the material and the ideal, a modern multidisciplinary approach. For the highest effectiveness of the research, we will use the latest scientific data and recommendations of the innovators who collect and use these data. The results of the study mostly follow from the mentioned new discoveries. They testify that in ancientt history, in the role of locomotives of civilizational progress in the western part of Eurasia, direct descendants of the inventors of agriculture acted, among which the especially great contribution belongs to the ancestors of Ukrainians from the territories of Trypillya and the Great Trypillya. It is indicated that during the existence of the Great Trypillya, future German farmers acquainted themselves with the technologies of the Great Trypillya, so the German language, through borrowed words, became part of the Indo-European family. It is noted that after the collapse of the Great Trypillya, the Germans and Slavs became neighbors along the meridian Elbe. In the age of steppe invasions, future Ukrainians and Germanic tribes did not get in contact, and the influence of the Roman Empire was mostly experienced by western lands. Emphasis was placed on the evolution of ideological, religious and other paradigms in the territory of Germany after the collapse of the Holy Roman Empire, which determined the development of the nation for the next hundreds of years. The religious and philosophical paradigmatic origins of those unique features of culture and education that during the nineteenth century were emphasized. brought Germany to the position of the scientific and technological leader of the world. The high role of German neo-humanism and the Berlin Research University were noted. In the final section, special attention is paid to religious issues and to the destructive impact on social and other processes in the German immigration flows of Islamists. The conclusions focus on the competition of several important paradigms in the education of modern Germany and the proposals made to incorporate German experience in legislation and the use of the Bologna process. An important caution is made regarding the choice of Germany's strategy for the development of the scientific and educational complex 'within the framework of the Lisbon project. This country has become a world leader not only in alternative energy, but also in the implementation of the fourth industrial revolution. We consider an example of this leadership like the regular world conferences in Davos, which involve the majority of influential politicians and economists. (shrink)

In the article, the recent social-philosophical discussions on authenticity and autonomy have been reviewed through the optics of power. The latter is understood as the regulation of the actors’ state of being marked or unmarked in the social-cultural space. Another dimension of the optics is the adjustment of the access to power and representation of the groups in media-related and legal discourses. The visibility asymmetry has been considered through the social representation of the groups, with attention paid to the concepts (...) of recognition, exoticization and adaptation, power, and powerlessness. The immediate and terminated effect of visibility on social cohesion and integration processes in communities has been reviewed in this context. The distortions of visibility, such as invisibility and super-visibility, require estimation of the unmarked normalcy threshold for the communities; therefore, the Ukrainian perspective on the issue involved the analysis of the conflict-related massive protracted inner displacement in the country. Based on the situation descriptions and action plans suggested in the project on the Strategy of Integration of Internally Displaced Persons and Implementation of Long-Term Solutions to Internal Displacement until 2023, the distortions of visibility in the Ukrainian communities have been assessed. One of the suggested perspectives implies the possible impact evaluation of media-type visibility of the internally displaced persons and residents of the non-government-controlled areas in Ukraine on the scenarios of reintegration of the territories temporarily occupied by the Russian Federation and Russia-backed forces. The theoretical adjustment lies in finding the visibility theory gap and formulation of the further research question on the correlation between the group visibility and reconciliation being facilitated by the actors.
