The article analyses, in a comparative perspective, the phenomenon of the evolution of the protection of surviving spouse’s inheritance rights in France and Lithuania, the two legal systems historically having some points of interaction. The protection of the surviving spouse is one of the major preoccupations of married couples of today, the couple occupying a central role within the contemporary family. Comparative analysis reveals certain points of convergence between these two legal systems inasmuch the surviving spouse is considered by both (...) legislations as an heir ab intestat and whose protection over the years has been considerably strengthened. The surviving spouse is called to inherit alongside with the heirs of the first or second order and is entitled to the proportions in assets that have not ceased to increase. Lithuanian law seems to have been innovative at an earlier stage than French law, as it is only in the beginning of the 21st century that significant reforms were carried out in this area of law in France. Analysis has also revealed apparent differences in the scope of protection of the surviving spouse, both in regards to the protection provided by law (statutory protection), as well as protection organised by the will of the spouses (voluntary protection). In some respects the statutory protection is more extensive in France (for example, complementary statutory rights of the spouse in regards to the dwelling place or the quality of héritier réservataire) and the instruments of this protection seem to be more varied (for example, the possibility for the spouses to organise their matrimonial regime by inserting specific clauses into the nuptial contract, mechanisms outside the nuptial contracts, such as donations, wills or life insurance contracts). However, this protection might appear to be more extensive under Lithuanian law as far as the voluntary protection is concerned taking into account the introduction, by the new Lithuanian Civil Code of 2000, of the joint will of spouses under which the whole property of the deceased spouse shall be inherited by the surviving spouse (except the mandatory share of succession). The article raises some doubts as to the desirability or even feasibility of aligning the two models of protection given the fact that each of the two countries has its own history and traditions. Nevertheless, a proposition resurges from the analysis in regard to the possible improvement of the protection of the rights to the dwelling place of the surviving spouse under Lithuanian law. Some elements from the existing French model could be transposed given that the dwelling place is an essential family element providing some stability for the surviving spouse. (shrink)

We defend Joseph Melia's thesis that the role of mathematics in scientific theory is to ‘index’ quantities, and that even if mathematics is indispensable to scientific explanations of concrete phenomena, it does not explain any of those phenomena. This thesis is defended against objections by Mark Colyvan and Alan Baker.

This book draws on Merleau-Ponty’s phenomenology, psychology, neuroscience and Buddhist philosophy to explicate Merleau-Ponty’s unwritten ethics. Daly contends that though Merleau-Ponty never developed an ethics per se, there is significant textual evidence that clearly indicates he had the intention to do so. This book highlights the explicit references to ethics that he offers and proposes that these, allied to his ontological commitments, provide the basis for the development of an ethics. In this work Daly shows how Merleau-Ponty’s relational ontology, in (...) which the interdependence of self, other and world is affirmed, offers an entirely new approach to ethics. In contrast to the ‘top-down’ ethics of norms, obligations and prescriptions, Daly maintains that Merleau-Ponty’s ethics is a ‘bottom-up’ ethics which depends on direct insight into our own intersubjective natures, the ‘I’ within the ‘we’ and the ‘we’ within the ‘I’; insight into the real nature of our relation to others and the particularities of the given situation. Merleau-Ponty and the Ethics of Intersubjectivity is an important contribution to the scholarship on the later Merleau-Ponty which will be of interest to graduate students and scholars. Daly offers informed readings of Merleau-Ponty’s texts and the overall approach is both scholarly and innovative. (shrink)

Many contemporary philosophers rate error theories poorly. We identify the arguments these philosophers invoke, and expose their deficiencies. We thereby show that the prospects for error theory have been systematically underestimated. By undermining general arguments against all error theories, we leave it open whether any more particular arguments against particular error theories are more successful. The merits of error theories need to be settled on a case-by-case basis: there is no good general argument against error theories.

This paper explores the issue whether feminism needs a metaphysical grounding, and if so, what form that might take to effectively take account of and support the socio-political demands of feminism; addressing these demands I further propose will also contribute to the resolution of other social concerns. Social constructionism is regularly invoked by feminists and other political activists who argue that social injustices are justified and sustained through hidden structures which oppress some while privileging others. Some feminists (Haslanger and Sveinsdóttir, (...) Feminist metaphysics. In E. N. Zalta (Ed.), Stanford encyclopedia of philosophy. Stanford: Stanford University, 2011) argue that the constructs appealed to in social constructivism are real but not metaphysically fundamental because they are contingent. And this is exactly the crux of the problem—is it possible to sustain an engaged feminist socio-political critique for which contingency is central (i.e., that things could be otherwise) and at the same time retain some kind of metaphysical grounding. Without metaphysical grounding it has been argued, the feminist project may be rendered nonsubstantive (Sider, Substantivity in feminist metaphysics. Philosophical Studies, 174(2017), 2467–2478, 2017). There has been much debate around this issue and Sider (as an exemplar of the points under contention) nuances the claims expressed in his earlier writings (Sider, Writing the book of the world. Oxford: Clarendon Press, 2011) and later presents a more qualified account (Sider, Substantivity in feminist metaphysics. Philosophical Studies, 174(2017), 2467–2478, 2017). Nonetheless, I propose the critiques and defences offered by the various parties continue to depend on certain erroneous assumptions and frameworks that are challengeable. I argue that fundamentality as presented in many of these current accounts, which are underpinned by the explicit or implicit ontologies of monism and dualism and argued for in purely rationalist terms which conceive of subjects as primarily reason-responding agents, reveal basic irresolvable problems. I propose that addressing these concerns will be possible through an enactivist account which, following phenomenology, advances an ontology of interdependence and reconceives the subject as first and foremost an organism immersed in a meaningful world as opposed to a primarily reason-responding agent. Enactivism is thus, I will argue, able to legitimize feminist socio-political critiques by offering a non-reductive grounding in which not only are contingency and fundamentality reconciled, but in which fundamentality is in fact defined by radical contingency. My paper proceeds in dialogue with feminists generally addressing this ‘metaphysical turn’ in feminism and specifically with Sally Haslanger and Mari Mikkola. (shrink)

This paper explores the ontological bases for ethical behaviour between human animals and non-human animals drawing on phenomenology and Buddhist philosophy. Alongside Singer and utilitarianism, I argue that ethical behaviour regarding animals is most effectively justified and motivated by considerations of sentience. Nonetheless, utilitarianism misses crucial aspects of sentience. Buddhist ethics is from the beginning focused on all sentient beings, not solely humans. This inclusivity, and refined interrogations of suffering, means it can furnish more nuanced understandings of sentience. For phenomenology, (...) sentience includes the capacities for self-awareness and, I will argue, a plural self-awareness; the ‘I’ belongs to a ‘we’, and the ‘we’ is constitutive of the ‘I’. This ‘primordial we’ provides the basis for rethinking the moral relations between human animals and non-human animals. I contend finally we thus have an ontological basis in ‘interanimality’ to explain why we most often do and should care about all sentient beings. (shrink)

There is a recent and growing trend in philosophy that involves deferring to the claims of certain disciplines outside of philosophy, such as mathematics, the natural sciences, and linguistics. According to this trend— deferentialism , as we will call it—certain disciplines outside of philosophy make claims that have a decisive bearing on philosophical disputes, where those claims are more epistemically justified than any philosophical considerations just because those claims are made by those disciplines. Deferentialists believe that certain longstanding philosophical problems (...) can be swiftly and decisively dispatched by appeal to disciplines other than philosophy. In this paper we will argue that such an attitude of uncritical deference to any non-philosophical discipline is badly misguided. With reference to the work of John Burgess and David Lewis, we consider deference to mathematics. We show that deference to mathematics is implausible and that main arguments for it fail. With reference to the work of Michael Blome-Tillmann, we consider deference to linguistics. We show that his arguments appealing to deference to linguistics are unsuccessful. We then show that naturalism does not entail deferentialism and that naturalistic considerations even motivate some anti-deferentialist views. Finally, we set out deferentialism’s failings and present our own anti-deferentialist approach to philosophical inquiry. (shrink)

In this paper, I consider what it might mean to approach boredom as a problem of post-history, rather than of modernity as such. Post-history, or ‘end of history’, in this sense, is linked with the impossibility or unlikelihood of political-systemic change, and thus with the disappearance of the contingency or temporal flux that had been understood as the context or prerequisite of political action and political freedom. I will, argue, firstly, that both Rousseau and Fukuyama depict societies that are ‘post-historical’, (...) in this sense, and which are marked by ‘boredom’ of this specifically post-historical kind. Secondly, I will argue that both thinkers link post-historical boredom with the disappearance or diminution of the ‘drive for recognition’ that both understood as both an agent and effect of ‘history’. Thirdly, I will argue that while Fukuyama understands post-historical boredom as an ‘irritant’ that threatens to restart history without quite succeeding in doing so, Rousseau understands it as an essentially stabilising (and happy) condition that maintains post-historical man in an equilibrium modelled on the order of nature itself. And fourthly, I consider certain ways in which this ‘post-historical’ boredom might coexist and overlap with the ‘promise of intensity’ experienced in post-Fordist neoliberal society. (shrink)

Categorization-based diagnosis, which endeavors to be consistent with the third-person, objective measures of science, is not always adequate with respect to problems concerning diagnostic accuracy, demarcation problems when there are comorbidities, well-documented problems of symptom amplification, and complications of stigmatization and looping effects. While psychiatric categories have proved useful and convenient for clinicians in identifying a recognizable constellation of symptoms typical for a particular disorder for the purposes of communication and eligibility for treatment regimes, the reification of these categories has (...) without doubt had negative consequences for the patient and also for the general understanding of psychiatric disorders. We argue that a complementary, integrated framework that focuses on descriptive symptom-based classifications (drawing on phenomenological interview methods and narrative) combined with a more comprehensive conception of the human subject (found in the pattern theory of self), can not only offer a solution to some of the vexed issues of psychiatric diagnosis but also support more efficacious therapeutic interventions. The key idea behind reduction is a simple and familiar one: it’s that there’s more to things than meets the eye. Surprisingly, this simple idea provides the resources to block a number of notable anti-reductionist arguments: Mackie’s argument from queerness against objective moral values, Kripke’s Humphrey objection and its recent variants, and Jubien’s objection from irrelevance against Lewisian modal realism. What is wrong with each of these arguments is that they suppose that what is to be reduced must not be (...) dissimilar to what it is to be reduced to. This supposition is shown to be misguided and that the success or otherwise of a reduction turns on quite different considerations. (shrink)

ABSTRACTThe central hypothesis of this paper is that the phenomenology of Merleau-Ponty offers significant philosophical groundwork for an ethics that honours key feminist commitments – embodiment, situatedness, diversity and the intrinsic sociality of subjectivity. Part I evaluates feminist criticisms of Merleau-Ponty. Part II defends the claim that Merleau-Ponty’s non-dualist ontology underwrites leading approaches in feminist ethics, notably Care Ethics and the Ethics of Vulnerability. Part III examines Merleau-Ponty’s analyses of embodied percipience, arguing that these offer a powerful critique of the (...) view from nowhere, a totalizing God’s-eye-view with pretensions to objectivity. By revealing the normative structure of perceptual gestalts in the intersubjective domain, he establishes the view from everywhere. Normativity is no longer deferred to higher authorities such as duty, utility or the valorized virtue, but through the perceptual gestalt it is returned to the perceiving embodied subject. This... BackgroundWe review original papers on ovarian-hormone status in two areas of emotional processing: facial emotion recognition and emotional memory. Ovarian-hormone status is operationalized by the levels of the steroid sex hormones 17β-estradiol and progesterone, fluctuating over the natural menstrual cycle and suppressed under oral contraceptive use. We extend previous reviews addressing single areas of emotional processing. Moreover, we systematically examine the role of stimulus features such as emotion type or stimulus valence and aim at elucidating factors that reconcile the inconsistent (...) results.MethodsWe followed the Preferred Reporting Items for Systematic Reviews and Meta-Analyses guidelines and included papers published until September 2020 indexed in PubMed and Web of Science databases. Search terms were MeSH terms AND AND with representing our separately searched areas, resulting in, and. To be included, articles had to be written and published in English, examine healthy, non-pregnant adult women in their reproductive age, and measure or at least estimate levels of E2 and P4. In PubMed, the search was limited to humans and to the search term present in the title or abstract.ResultsFeatures of the provided stimulus material constitute a relevant influence that interacts with E2- and P4-related ovarian-hormone status. For instance, recognition of basic emotions appears to be more related to P4- than E2-levels. Quite consistent, OC intake was accompanied by impaired recognition accuracy of basic and also complex emotions, although not in a recent large-sample study assessing complex emotions. Memory recall of negative content was mainly enhanced by P4, especially after having been stressed.Discussion and ConclusionWe document the methodological diversity in the field, presumably contributing to the heterogeneity of results. More studies explicitly contrasting the early follicular phase, mid-cycle phase, mid-luteal, and OC intake while standardizing tasks are needed. Research would take advantage of using within-subject designs and accounting for the recognition of complex emotions. (shrink)

Animalism is the theory that we are animals: in other words, that each of us is numerically identical to an animal. An alternative theory maintains that we are not animals but that each of us is constituted by an animal. Call this alternative theory neo-Lockean constitutionalism or Lockeanism for short. Stephan Blatti (2012) offers to advance the debate between animalism and Lockeanism by providing a new argument for animalism. In this note, we present our own objection to Blatti's argument, and (...) argue that Carl Gillett's earlier reply misses the fundamental problem. Medical professionals often deny patients who inject opioids a second or third heart valve replacement, even if such a surgery is medically indicated. However, such a position is not well defended. As this paper demonstrates, the ethical literature on the topic too often fails to develop and apply an ethical lens to analyse the issue of multiple valve replacements. This paper addresses this lacuna by analysing the case of Mr Walsh, a composite case which protects the identity of any one (...) patient, through the principlist approach of Beauchamp and Childress. It argues that the hospital should offer Mr Walsh, a second valve replacement because the procedure is: medically indicated, autonomously requested, non-maleficent, beneficent and does not violate a formal account of justice. The paper concludes with clinical ethical guidelines for valve surgery for patients with opioid use disorder. (shrink)

Sex determines much about one's life, but what determines one's sex? The answer is complicated and incomplete: on close examination, ordinary notions of female and male are vague. In 2012, the International Olympic Committee further specified what they mean by woman in response to questions about who, exactly, is eligible to compete in women's Olympic events. I argue, first, that their stipulation is evidence that the use of vague terms is better described by semantic approaches to vagueness than by epistemic (...) approaches. In addition, the IOC's 2012 stipulation was made with sensitivity to its practical consequences. Linguistic actions often have morally relevant consequences, and I contend that, other things equal, we should adopt theories about language that acknowledge the responsibility we bear for what we say. Taking vagueness to be an epistemic phenomenon precludes the sense of agency needed for moral responsibility; taking it to be semantic does not. Thus I advance two arguments for semantic approaches to vagueness, as against epistemic approaches: one descriptive and one normative. (shrink)

Where there is controversy, the book presents the case for each side, but highlights where the key difficulties with them lie. While eminently student-friendly, the book makes an important contribution to the debate regarding the acceptability of the various philosophical methods, and (...) so it will also be of interest to more experienced philosophers. The recognition of the similarities between Roman epic poetry and historiography have led to valuable studies such as Joseph’s analysis of the relationship between Lucan’s Bellum Civile and Tacitus’ Histories. Traces of Lucan’s Bellum Civile can also be observed in Tacitus’ Annals 1 and 2, causing the beginning of Tiberius’ reign to look like a civil war in the making. The charismatic Germanicus sits with a supportive army on the northern frontier, much like Caesar, causing fear for Tiberius at Rome. (...) Germanicus denies his chance to become the next Caesar and march on the city, but he exhibits other similarities with Lucan’s Caesar, including an association with Alexander the Great. Although at some points Germanicus seems to be repeating the past and reliving episodes experienced by Caesar in Bellum Civile, he prevents himself from fully realizing a Caesarian fate and becoming Lucan’s bad tyrant. The similar images, events, and themes presented by both authors create messages that reflect experiences from the authors’ own lives during dangerous times. (shrink)

Medical practice is ideally based on robust, relevant research. However, the lack of disease-modifying treatments for Alzheimer’s disease has motivated “innovative practice” to improve patients’ well-being despite insufficient evidence for the regular use of such interventions in health systems treating millions of patients. Innovative or new non-validated practice poses at least three distinct ethical questions: first, about the responsible application of new non-validated practice to individual patients ; second, about the way in which data from new non-validated practice are communicated (...) via the scientific and lay press ; and third, about the prospect of making new non-validated interventions widely available before more definitive testing. We argue that the authors of metabolic enhancement protocols for Alzheimer’s disease have overstated the evidence in favor of these interventions within the scientific and lay press, failing to communicate weaknesses in their data and uncertainty about their conclusions. Such unmeasured language may create false hope, cause financial harm, undermine informed consent, and frustrate the production of generalizable knowledge necessary to face the societal problems posed by this devastating disease. We therefore offer more stringent guidelines for responsible innovation in the treatment of Alzheimer’s disease. (shrink)

Abstract:Christian Bendayán (Iquitos, Peru 1973 -) is one of a cadre of visual artists from Iquitos, Peru that has cultivated an Amazonian pop aesthetic over the last decade. Bendayán creates an alternative, counter-dominant viewpoint to seemingly intractable archival versions of the Amazon and its peoples. The place, its habitants, and its flora and fauna have been documented in published texts and drawings by sixteenth-century missionaries, eighteenth-century botanists, nineteenth-century rubber barons, and countless adventurers. I argue that Bendayán queers some of these (...) archival documents through his incorporation of gender non-conforming and homoerotic figures into his depiction of Iquitos. Additionally, he reconfigures images and texts from previous eras via his transformation of historical facts into open-ended narratives that reflect a queer temporality that toggles back and forth between the past, the present and the future. Through his transformation of archival materials, and his incorporation of local myths and pop culture, he presents physical desire not as a means to procreation, but as an end in and of itself. In sum, through his paintings, Bendayán perceives from and with Iquitos. He turns his city into a distinct viewpoint instead of a fantastical destination for the projections of outsiders. (shrink)

Although environmental philosophy and the human exploration of space share common beginnings, scholars from either field have not given adequate attention to the possible connections between them. In this essay, we seek to spur the rapprochement and cross-fertilization of philosophy and space policy by highlighting the philosophic dimensions of space exploration, pulling together issues and authors that have had insufficient contact with one another. We do so by offering an account of three topics: planetary exploration, planetary protection and the search (...) for extraterrestrial life, and terraforming. The resulting synthesis seeks to change our thinking about earthbound environmental ethics as it considers the philosophical dimensions of space exploration, and introduces the possible benefits of a humanities-oriented approach to space policy. In the Québécois political vision of the twentieth century, sovereignty became synonymous with mastery. French Canadians sometimes claimed solidarity with racialized and Indigenous peoples, yet they saw their liberation as a matter of taking their rightful place in the seat of the oppressors. The idea of mastery has prevented the Québécois from seeing that their liberation is bound up with that of other groups oppressed by colonial powers. The Eye of the Master confronts the missed opportunities for a decolonial version (...) of indépendance in Quebec by examining the quest for mastery that has been at the root of every version of independence offered to the people of Quebec since the mid-twentieth century. Exploring political discourse, popular culture, and the family photo album, Dalie Giroux revisits the mythology of being “masters in our own house” and identifies the obstacles blocking a more comprehensive version of liberation based on solidarity. Drawing from the living forces of Indigenous thought and anti-racist, ecological, and feminist movements, Giroux envisions life without conquest, domination, exploitation, and surveillance. Making the case for a different future, beginning in the here and now, The Eye of the Master offers a major new intervention in contemporary political thought to Canadian readers and all those who imagine a different North America. After a review of terminology, I identify—in addition to Margaret Battin’s list of five primary arguments for and against aid-in-dying—the argument from functional equivalence as another primary argument. I introduce a novel way to approach this argument based on Bernard Lonergan’s generalized empirical method. Then I proceed on the basis of GEM to distinguish palliative sedation, palliative sedation to unconsciousness when prognosis is less than two weeks, and foregoing life-sustaining treatment from aid-in-dying. I conclude that aid-in-dying must be justified on (...) its own merits and not on the basis of these well-established palliative care practices; and that societies must decide, in weighing the merits of aid-in-dying, whether or not to make the judgment that no life is better than life-like-this part of their operative value structure. The brain requires sustained interaction with a rich physical and social environment to stay healthy. Individuals without access to such enabling environments and who instead live and grow in disabling environments tend to have greater risk of developing dementia. But research and policymaking as regards dementia risk reduction have so far focused almost exclusively on the role of how individuals’ health behaviors change their risk profile. This exclusive focus on “lifestyle” is both ethically problematic and therapeutically inadequate. I highlight a (...) growing literature on three different kinds of deprivation, an independent and overlooked risk factor for dementia that invites upstream action against inequalities. Future prevention guidelines should include explicit mention of deprivation as a risk factor and be developed around the need to make society fairer. Meanwhile, interventions and discourse based on lifestyle modification should respect the principle of “no ought without support.”. (shrink)

What is at stake in the reversibility thesis is whether it overcomes skeptical objections in both assuring real communication and avoiding solipsism in assuring real difference; the Other must be a genuine, irreducible Other. It is objected that across the domains of reversibility, symmetry and reciprocity are not guaranteed. I argue that this is a non-problem; rather the potentialities for asymmetry and non (...) reciprocity in fact guarantee the irreducibility of the Other; reversibility needs to be appreciated as dialectical or aesthetic, not as a literal or ‘mechanistic’ reversal. A further criticism targets the viability of ontology itself, whether alterity is ever compatible with ontology. This paper considers these objections from two of Merleau-Ponty's contemporaries—Claude Lefort and Emmanuel Levinas. Levinas developed a philosophy which while intersecting with Merleau-Ponty's at important junctures, nonetheless arrived at an entirely different destination. I argue alongside Martin Dillon against the objections of Lefort, and alongside Dan Zahavi against the objections of Levinas. Both of these interpreters, I propose remain faithful to the core directions and spirit of Merleau-Ponty's endeavours without becoming diverted by the less significant inconsistencies. (shrink)

In the ‘ordinary business of life’, everyone makes claims about what there is. For instance, we say things like: ‘There are some beautiful chairs in my favourite furniture shop’. Within the context of philosophical debate, some philosophers also make claims about what there is. For instance, some ontologists claim that there are chairs; other ontologists claim that there are no chairs. What is the relation between ontologists’ philosophical claims about what there is and ordinary claims about what there is? According (...) to Cian Dorr, ontologists’ claims and denials of existence belong to ‘a sort of professional jargon’. Dorr claims, for example, that ‘There are prime numbers between 20 and 30’ can be used superficially or used fundamentally. Ordinary uses of are superficial: we use the sentence to assert a boring, well-known truth. But in the ontology room, is used fundamentally, to assert that numbers are ‘part of the ultimate furniture of reality’: and this is a substantial metaphysical doctrine, not a boring truth. In this paper, we will show that none of Dorr’s arguments for these claims succeeds. (shrink)
