We discuss the role of prior authorization (PA) in supporting patient-centered care (PCC) by directing health system resources and thus the ability to better meet the needs of individual patients. We begin with an account of PCC as a standard that should be aimed for in patient care. In order to achieve widespread PCC, appropriate resource management is essential in a healthcare system. This brings us to PA, and we present an idealized view of PA in order to (...) argue how at its best, it can contribute to the provision of PCC. PA is a means of cost saving and as such it has mixed success. The example of the US demonstrates how implementation of PA has increased health inequalities whereas best practice has the potential to reduce them. In contrast, systems of universal coverage, like those in Europe, may use the cost savings of PA to better address individuals' care and PCC. The conclusion we offer therefore is an optimistic one, pointing towards areas of supportive overlap between PCC and PA where usually the incongruities are most evident. (shrink)

On 9 August 1994 the German legislature revised the German Drug Law (AMG). Included in the revision is a passage requiring, for the first time, that the sponsors and investigators of clinical studies involving human subjects first obtain the approval of an ethics committee before carrying out such studies. According to the legislation, which takes effect on 17 August 1995, approval is to come from 'an independent ethics committee, set up and administered according to state law [emphasis added]' (1). Although (...) it is clear according to the text that the 16 federal states have been empowered to establish ethics committees within their jurisdictions, this does not mean that the state governments are free to transfer exclusive authority in the matter to their respective medical associations, a step that would effectively abolish Germany's private ethics committees. First, the legislation does not rule out the authorization of private ethics committees. Second, as legal scholars attest, the exclusive control of ethics committees by the medical associations would constitute an illegal monopoly. Third, it is arguable that medical-association ethics committees fail to meet the one prior federal requirement, that of independence. There is a great deal of confusion in Germany today about which kinds of ethics committees (public and/or private) the states will sanction before 17 August 1995. In an attempt to sort things out we present a brief explanation of how ther came to be two kinds of ethics committees in Germany, review the legal battle between the two over the issue of authorization, point out how the German legislature, in passing the recent bill, has missed an opportunity to clarify the issue and, finally suggest why the administration of ethics committees by the medical associations may be incompatible with the requirement that ethics committees be independent. In a pair of very important papers, namely “Space, Time and Individuals” in the Journal of Philosophy for October 1955 and “The Indestructibility and Immutability of Substances” in Philosophical Studies for April 1956, Professor N. L. Wilson began something which badly needed beginning, namely the construction of a logically rigorous “substance-language” in which we talk about enduring and changing individuals as we do in common speech, as opposed to the “space-time” language favoured by very many mathematical logicians, perhaps most notably (...) by Quine. This enterprise of Wilson's is one with which I could hardly sympathize more heartily than I do; and one wishes for this logically rigorous “substance-language” not only when one is reading Quine but also when one is reading many other people. How fantastic it is, for instance, that Kotarbinski1 should call his metaphysics “Reism” when the very last kind of entity it has room for is things —instead of them it just has the world-lines or life-histories of things; “fourdimensional worms”, as Wilson says. Wilson, moreover, has at least one point of superiority to another rebel against space-time talk, P. F. Strawson; namely he does seriously attempt to meet formalism with formalism—to show that logical rigour is not a monopoly of the other side. At another point, however, Strawson seems to me to see further than Wilson; he is aware that substance-talk cannot be carried on without tenses, whereas Wilson tries to do without them. Wilson, in short, has indeed brought us out of Egypt; but as yet has us still wandering about the Sinai Peninsula; the Promised Land is a little further on than he has taken us. (shrink)

One way of answering this question is to translate ‘God is omniscient’ into some slightly more formalised language than colloquial English, e.g. one with variables of a number of different types, including variables replaceable by statements, and quantifiers binding thes.

Divided into two parts, the first concentrates on the logical properties of propositions, their relation to facts and sentences, and the parallel objects of commands and questions. The second part examines theories of intentionality and discusses the relationship between different theories of naming and different accounts of belief.

It is frequently said that words like ‘now’, ‘then’, ‘ago’, ‘present’, ‘past’, ‘future’ and the various indications of tense, are ‘egocentric’ or ‘token-reflexive’ in character. I want to suggest, on the contrary, that the apparent egocentricity or token-reflexiveness of this class of expression is deceptive. It is perhaps not easy to see how on a point of this sort deception is possible, but a parallel case may make the position clearer.

This book was designed primarily as a textbook; though the author hopes that it will prove to be of interests to others beside logic students. Part I of this book covers the fundamentals of the subject the propositional calculus and the theory of quantification. Part II deals with the traditional formal logic and with the developments which have taken that as their starting-point. Part III deals with modal, three-valued, and extensional systems.

Arthur Prior (1914-69) is regarded as New Zealand's greatest 20th-century philosopher. Until World War II, Prior seriously considered a career as a religious journalist, especially when traveling and living on the Continent and in England with his first wife. During these years, Prior wrote widely on theology and contemporary Christianity. In his correspondence with Ursula Bethell and Hugh Teague, Prior discusses in detail his religious and theological thoughts, including his shift from formal theological study into a (...) world of journalism and philosophy. These previously unknown letters, which cover the years from 1936 to 1941, chronicle a substantial part of a fascinating period in Prior's development, both theologically and philosophically, and have been transcribed and annotated for this volume. The thesis of this paper is that certain nonhuman animals could be conceived of as capable of moral motivation and subsequent moral behavior, with the appropriate behavioral, psychological and cognitive evidence. I argue that a certain notion of morality—morality as the process of conscious, reasoned deliberation over explicit moral concepts—is excessively exclusionary, and that such a notion describes one mode of moral cognition, but not, as others have argued, morality's essence. Instead, morality and moral behaviors could be viewed as natural (...) phenomena that arose as a means by which social species could better cohere and survive, and one that consists of a spectrum of behaviors. Ultimately, I argue that the aforementioned notion of moral cognition has unfairly worked to exclude (certain) nonhuman animals from the sphere of morality as beings capable of moral behavior, and that instead we should be looking at moral behavior as a function of what I call ‘moral responsiveness.'. Should animal advocates be allowed to publicly display graphic footage of how animals live (and die) in industrial animal use facilities? Cube of truth (‘cube’) demonstrations are a form of animal advocacy aimed at informing the public about the realities of animals’ experiences in places such as slaughterhouses, feedlots, and research facilities, by showing footage of mostly lawful practices within these workplaces. Activists engaging in cube-style protests have recently been targeted by law enforcement agencies in two Australian states on the (...) basis that the footage on display was too offensive to be shown in public. In this paper, I argue that these justifications do not stand up to scrutiny. Using an original politics of sight analysis, this paper demonstrates how the democratic costs associated with targeting cube protests outweigh the costs to the public. Cube activists are engaging in public dialogue by drawing attention to sites of potential injustice, and are playing an important role in highlighting the agency of the animals involved in exploitative industries. I further make the case that, where such demonstrations fall foul of the law, they should be regarded as legitimate acts of civil disobedience. (shrink)

Before taking this book with the seriousness which at least parts of it deserve, it is necessary to dispose of a criticism which is basically frivolous but has already been made too often to be ignored. “Contemporary British Philosophy”—the title conjures up the names that everyone is currently bandying about ; and then you find with a jolt that you are being served with fare by such cooks as Ewing, Findlay, Kneale, Mabbott, Price, and—of all people—Paton. People, clearly, who for (...) the most part wouldn’t even pretend to be “contemporary” in the ordinary use of this word, and who indeed in these very papers subject the real “contemporary” philosophers to endless sniping and sharp-shooting. Almost the only contributor one can imagine wishing to be thought “contemporary” is Ryle; and even he—well, did Freud really think of himself as a Freudian? Ayer might be put up as another exception, but that would be shallow— there's no one so completely and hopelessly out of date as the conductor of the bandwagon that's just gone past. Even from the point of view of crass physical age, the baby of this bunch , works out at about 43. (shrink)

Particular attention has been paid in the present century to the question as to whether a man's duty is to do what is actually right, i.e. what his situation actually demands of him, or what he thinks is right. Mr. Carritt has pointed out that the former possibility bifurcates—a man's duty may be to do what is actually demanded by his actual situation, or what is actually demanded by what he believes to be his situation. I do not propose in (...) the present paper to carry this discussion any further, but rather to consider how it has been carried on in the past, as there seems to be a little confusion on this point. This book discusses and aims to clarify the issue of describing conduct and character as ‘good’ or ‘bad’, or as ‘right’ or ‘wrong’. The book states that one of the main factors that have made this issue obscure is the illusion of some anti-naturalists that purely logical considerations can settle it. It clearly defines the limitations of the discussions: it is not concerned with the ‘other things’ people use to define conduct and character. The book attempts to consider the issue (...) from the purely logician point of view and suggests to the naturalists and anti-naturalists how their positions may be freed from logical faults. The book also introduces the ‘logic of ethics’, which is not a special kind or branch of logic, but rather an application of it. (shrink)
