Migration und Armut sind eng miteinander verbunden. Für die meisten Migrant*innen ist Armut der Grund, ihre Heimat zu verlassen, um anderswo ein günstigeres wirtschaftliches Umfeld zu finden. Der Internationalen Organisation für Migration zufolge lag die Zahl der sogenannten Arbeitsmigrant*innen im Jahr 2015 weltweit bei 150,3 Millionen, bei einer Gesamtzahl von 247,6 Millionen Migrant* innen. Diese Zahlen erfassen Migrant* innen mit offizieller Arbeitserlaubnis und es ist anzunehmen, dass die Zahl von Arbeitsmigrant*innen ohne legale Dokumente deutlich höher ist.

L'auteur retrace l'histoire récente du droit des étrangers à partir de la distinction entre ordres publics de direction et de protection. Il montre que d'une base de « haute police » sont nées plusieurs branches distinctes : sécuritaire, dissuasive et économique. Il s'interroge sur le débordement de ce modèle par la crise migratoire et propose une conception renouvelée, en partie extra-territoriale, de l'ordre public migratoire européen.

Social scientific evidence suggests that labor migration can increase resilience to climate change. For that reason, some have recently advocated using labor migration policy as a tool for climate adaptation. This paper engages with the normative question of whether, and under what conditions, states may permissibly use labor migration policy as a tool for climate adaptation. I argue that states may use labor migration policy as a tool for climate adaptation and may even have a duty to do so, subject (...) to two moral constraints. First, states must also provide acceptable alternative options for adaptation so that the vulnerable are not forced to sacrifice their morally important interests in being able to remain where they are. Second, states may not impose restrictive terms on labor migrants to make accepting greater numbers less costly for themselves because doing so unfairly shifts the costs of adaptation onto the most vulnerable. Many philosophers argue that the right of self-determination confers to states a right to exclude would-be migrants. Drawing on the case of anti-colonial struggles of the 20th century, I argue that self-determination should be thought of as fundamentally a claim against intergroup hierarchy. This means that self-determination only grants a right to exclude in cases where immigration poses a genuine oppressive threat. Cases involving immigration into wealthy and powerful states rarely meet this criterion, and so talk of self-determination as grounding (...) a right to exclude in such cases is misguided. (shrink)

L’Europe se prétend terre d’asile et d’accueil, mais elle reste de marbre devant les milliers de noyés en Méditerranée. La gauche européenne pense qu’il vaut mieux minimiser la question, pas de vagues. Pourtant, l’appel à la main d’œuvre immigrée devient à nouveau stratégique avec le développement de la « silver economy » (économie des têtes argentées, autrement dit, du soin), le « réarmement industriel, technologique et scientifique », le besoin de travailleurs agricoles saisonniers. Le pacte européen sur la migration et (...) l’asile va à rebours : il s’agit d’empêcher les étrangers de fouler le sol des États membres par une « procédure à la frontière ». Les demandes d’asile seront désormais filtrées et examinées en amont des frontières européennes. En attendant, les migrants seront détenus dans un sas. Ce qui cimente les pays de l’Union, c’est le partage « équitable » du fardeau de la gestion de ces migrants, en passant des accords avec des pays prêts à gagner de l’argent pour ce gardiennage. This study investigates whether and how the corporate social responsibility (CSR) profile of a company transfers to another company when an executive leaves a firm. We integrate upper echelon and institutional theories, and develop a novel measure of CSR profiles to explore this issue with a longitudinal data set of executive migrations over a 14-year period. We find that migrated executives assimilate elements of their old firms’ CSR profiles into their new firms (i.e., narrowing the distance between the two (...) firms’ CSR profiles), and this is true for both CSR and corporate social irresponsibility (CSiR). This relationship is stronger when the migrating executive comes from a bigger firm with better social and financial performance than that of the new firm. We also find that the potential for improvement in CSR profiles in migration holds true for CSiR, but not CSR. Our findings have import for upper echelon theory and the managerial discretion afforded to executives regarding CSR decisions. (shrink)

Nursing migration: global treasure hunt or disaster‐in‐the‐making?International nurse migration — moving from one country to another in the search of employment — is the focus of this article. The majority of member states of the World Health Organization report a shortage, maldistribution and misutilisation of nurses. International recruitment has been seen as a solution. The negative effects of international migration on the ‘supplier’ countries may be recognised today but are not effectively addressed.Nurse migration is motivated by the search for professional (...) development, better quality of life and personal safety. Pay and learning opportunities continue to be the most frequently reported incentives for nurse migration, especially by nurses from less‐developed countries. Career opportunities were considered key incentives for nurses emigrating from high‐income countries. Language was reported to be a significant barrier. The positive global economic/social/professional development resulting from international migration needs to be weighed against a substantial ‘brain and skills drain’ experienced by supplier countries. The vulnerable status of migrant nurses is also of concern in certain cases. The focus on short‐term solutions as opposed to resolving the problem of a worldwide shortage of nurses causes great concern. Recent initiatives attempt to curb or channel international recruitment. The delicate balance between recognising the right of individual nurses to migrate and a collective concern for the health of a nation’s population must be achieved. (shrink)

It is often argued that development aid can and should compensate the restrictions on migration. Such compensation, Shachar has recently argued, should be levied as a tax on citizenship to further the global equality of opportunity. Since citizenship is essentially a ‘birthright lottery’, that is, a way of legalizing privileges obtained by birth, it would be fair to compensate the resulting gap in opportunities available to children born in rich versus poor countries by a ‘birthright privilege levy’. This article sets (...) out a defence of three theses. The first states that equality of opportunity is incompatible with, and cannot be achieved in, segregated territories. The second posits that to believe that material equality compensates the injustice of restrictions on movement is to commit a ‘sedentarist mistake’. The third affirms that any citizenship levy, including the egalitarian and non-sedentarist formula I’m proposing, would be better understood as a penalty rather than a tax. (shrink)

How should we understand the political morality of migration? Are travel bans, walls, or carrier sanctions ever morally permissible in a just society? This book offers a new approach to these and related questions. It identifies a particular vision of how we might apply the notion of justice to migration policy - and an argument in favor of expanding the ethical tools we use, to include not only justice but moral notions such as mercy.

This article argues that vehicles, roads and routes merit a much more central place in theorizations of migration politics. This argument is developed in terms of three theses. First, the study of migration politics should examine how vehicles feature in the public mediation of migration and border controversies. Second, it is important to analyze vehicles as mobile sites of power and contestation in their own right. Third, an understanding of the materiality of transportation helps to explain how the vehicle can (...) sometimes become a site of strategic political action. These arguments are in turn used to develop a concept of viapolitics as a contribution to literatures on migration, mobilities and power. Viapolitics orients us to see migration from the middle, that is, from the angle of the vehicle and not just the state. Climate change intersecting with complex socio-economic and political processes has produced distinctive patterns of crisis migration. However there exists a significant gap in understanding and theorizing these forms of migration creating significant policy challenges. Using a case study of an interstate migrant settlement in Bengaluru, India this article unpacks migration as an adaptation strategy through the lens of emotions. The article offers significant insights into how emotions affect the choice of migration as an adaptation strategy and shapes the differential experiences (...) of risks and vulnerability for different groups of people. Emphasizing such relational aspects of migration, the article calls for more research that develops a nuanced understanding of the emotional landscapes of migrants across migration pathways. This article sets out the principal ethical considerations for a just immigration policy. Advocates of a more liberal immigration regime have called for open borders or at least a more relaxed immigration policy. They argue that it is incompatible with basic rights such as freedom of movement, association, and opportunity. Furthermore, the use of coercion to prevent needy people from seeking opportunities abroad sits uneasily in a world of massive inequalities divided along geographical and state lines, as well as the (...) large number of refugees. At the other end of the spectrum, many individuals and groups protest immigration levels and their real or imagined effect on jobs, wages, and culture. The article briefly discusses the causes of migration and the implications of moral theory for immigration policy. It gives special consideration to the case of refugees and addresses the difficult question of how states should treat guest workers and undocumented immigrants. (shrink)

In this chapter, I bring non-ideal theory to bear on the ethics of immigration. In particular, I explore what the obligations of liberal states would be if they were to attempt to implement migration arrangements that conform to liberal-cosmopolitan principles. I argue that some of the obligations states have are feasibility-insensitive, while some are feasibility-sensitive. I show that such obligations can have as their content both the inclusion and exclusion of prospective immigrants, and that they can be grounded in the (...) requirements of liberal justice, mere capacity to assist, as well as past or foreseeable contribution to harm. The chapter therefore explores the possibility of an international migration regime that takes human rights seriously whilst avoiding the twin pitfalls of strict immigration restrictions and the complete liberalization of immigration. Studying student migration trends is a significant task in studying human capital development as one of the leading factors in sustainable socio-economic development. The migration potential of students impacts the opportunities and prospects for sustainable development. The study of factors influencing the migration behavior of students acquires special significance in this article. The interpersonal competencies of the population impact its migration potential. Migration processes impact the differentiation of regions in terms of human capital. This article is based on theoretical and (...) practical research on human capital, its formation, development, and migration as a factor in human capital development. The practical part of the study presents an analysis of data obtained from a sociological study of the factors that determine internal and international migration. An anonymous sociological survey of students in Ekaterinburg, Kursk, and Tomsk (Russia) was conducted in several stages. The first stage was implemented in October and December 2020 (N = 958). The second stage was implemented in October and November 2021 (N = 960). This study allows for tracing how the COVID-19 pandemic affects the migration potential of students and their desire for a satisfactory career path. (shrink)

Die vorliegende Studie geht von der These aus, dass sich Kants Uberlegungen zum Weltburgerrecht in einer produktiven Disharmonie zu gegenwartig vertretenen philosophischen wie politischen "Lagern" in der Migrationsdebatte befinden. Zur Begrundung dieser These wird zunachst die neuere Debatte um Migration anhand dreier Theoriestrange vorgestellt, die diese massgeblich strukturieren: der Kommunitarismus, der egalitaristische Kosmopolitismus und der liberale Nationalismus. Anschliessend werden die fur die Migrationsdebatte entscheidenden Theoriegange (...) in Kants politischer Philosophie erschlossen. Auf dieser Grundlage wird schliesslich die Produktivitat und systematische Relevanz von Kants Theorie fur die Hauptfragen der gegenwartigen Debatte herausgearbeitet und eine rechtsmoralische Migrationstheorie entworfen. Es werden dabei insbesondere die Themengebiete Asyl, (il-)legitime Abweisungsgrunde, Staatenlosigkeit, der Erwerb der Staatsburgerschaft, das Recht auf Auswanderung und individuelle Hilfspflichten sowie die Frage nach der Notwendigkeit einer "weltburgerlichen Gesinnung" diskutiert. International migration of work force is presently a high amplitude phenomenon. Romanian people have emigrated for work around the world, being engaged both in the physically hardest jobs and in activities that require completion of specialized courses and certification in a particular field. This last category includes social workers who, following schooling and certification and even having a minimal experience in the home country, apply for jobs in the field of social assistance. These recruiters aim to distribute social workers at (...) the workplace of interest, according to certain well-defined criteria. In the present paper we describe international migration of work force, and we illustrate it by adding case studies of life experience of social workers who underwent the process of emigration to the United Kingdom. Throughout the emigration process, these workers experienced certain changes in their life principles, mentality, values, and were marked by professional dilemmas in extreme situations. (shrink)

In Strangers in Our Midst, David Miller develops a ‘realist’ political philosophy of immigration, which takes as its point of departure ‘the world as it is’ and considers what legitimate immigration policies would look like ‘under these circumstances’. Here I focus on Miller’s self-described realist methodology. First, I ask whether Miller actually does start from the ‘world as it is’. I note that he orients his argument around a particular vision of national communities and that, in so doing, he deviates (...) from a description of ‘the real world’. In shifting between the descriptive and prescriptive without clearly acknowledging it, Miller undermines his claim to be outlining legitimate policies ‘under these circumstances’. I also question whether Miller’s picture of ‘the real world’ takes sufficient account of past injustice and its ongoing relationship to migration regimes. I maintain that there is a fundamental tension between Miller’s commitments to his brand of nationalism on the one hand, and his version of realism on the other hand. (shrink)

The migration of nursing professionals from developing countries such as Zimbabwe to industrialised countries is taking place at an alarming rate, with little signs of slowing down. In Africa, nurses form the backbone of the healthcare delivery system and their migration has a huge negative impact on health service provision. Drawing on evidence from selected health institutions, the paper shows the magnitude of migration of nurses from Zimbabwe. The paper also shows that public to private health sector migration of nurses (...) is occurring at a significant rate. The effects of such movements are examined in detail. For instance, at the health institution level, nurse migration has led to staff shortages, and health institutions located in the disadvantaged areas have been the worst affected. The paper calls for the adoption of an integrated approach in managing and addressing the concerns of the nursing professionals. (shrink)

Calls to expand temporary work programmes come from two directions. First, as global justice advocates observe, every year thousands of poor migrants cross borders in search of better opportunities, often in the form of improved employment opportunities. As a result, international organizations now lobby in favour of expanding ‘guest-work’ opportunities, that is, opportunities for citizens of poorer countries to migrate temporarily to wealthier countries to fill labour shortages. Second, temporary work programmes permit domestic governments to respond to two internal, contradictory (...) political pressures: (1) to fill labour shortages and (2) to do so without increasing rates of permanent migration. Temporary work programmes permit governments to appear ‘tough’ on migration, while responding to employer pressure to locate workers willing to work in low-skilled, poorly remunerated positions. The coincidence of national self-interest and global justice generates a strong case in favour of expanding guest-work. We evaluate the moral benefits and burdens of expanding guest-work opportunities, and conclude that although there are benefits to be gleaned from the perspective of global wealth redistribution, at present, temporary work programmes are generally unjust. We will argue that just temporary work programmes, in time, permit temporary workers to attain citizenship. This spells the end of traditional temporary work programmes, which require that workers return to their home country in time; instead, what is temporary is the employment obligation that must be fulfilled as a requirement to access citizenship. As long as this requirement is met, we endorse guest-work programmes as a tool to respond to global inequality. (shrink)

In order for a state to rightfully exercise self-determination by means of setting policies concerning migrants and migration, they must be legitimate, Gillian Brock argues in _Justice for People on the Move_. Legitimacy, in Brock’s view, requires that states satisfy three (jointly sufficient) conditions: they must respect their own citizens’ human rights; they must be a part of a legitimate state system; and they must adequately contribute to the maintenance of this state system. In her new book, Brock also argues (...) persuasively for a variety of migration-related policies that states ought to adopt (concerning, for example, addressing the needs of refugees, regularization of undocumented migrants, and protections for temporary labor migrants). In previous work (Brock, _Global Justice: A Cosmopolitan Account_, Oxford University Press, New York, 2009; Brock and Blake, _Debating Brain Drain: May Governments Restrict Emigration?_, Oxford University Press, New York, 2015), Brock has compellingly defended the justice of policies designed to allay the harmful effects of brain drain. In this commentary, I wish to argue that the legitimacy standard Brock defends in _Justice for People on the Move_ is an obstacle to the justified adoption of the migration-related policies Brock demonstrates here and in previous work to be substantively morally justified, if not required by justice. If a state is not legitimate, then it lacks the moral standing to adopt migration policies that are otherwise morally justified. I do not intend to question the importance of the concept of state legitimacy for political philosophy generally. However, I wish to argue that that in the context of migration justice, considerations of state legitimacy may be contrary to the goal of defending a view on what policies a state ought to adopt. It may be more useful simply to consider whether or not there is moral justification for a particular state to adopt a particular policy. (shrink)

In this chapter, we take stock of existing critiques of contemporary migration research and bring these debates into contact with ongoing debates among decolonial scholars and in feminist social epistemology. We illustrate how the ethical and epistemic concerns voiced by migration scholars in regard to the socio-epistemic functioning of their field can be understood using the conceptual apparatus that has been developed around the notions of epistemic injustice and oppression. In so doing, we illustrate the relevance and usefulness of both (...) feminist social epistemology and of decolonial theory for theorising the socio-epistemic challenges that migration scholars face. The conceptual framework of epistemic injustice and oppression not only offers clarity in what is at stake within migration studies both ethically and epistemically, but also elucidates moral and epistemic reasons for why these issues should be addressed. This framework both calls attention to issues of undue epistemic marginalisation, and centres these issues as a core concern as migration scholars critically reflect upon the knowledge production and dissemination practices of their field. Understanding the processes through which this happens, rather than just the epistemic outcomes, can help us to identify ways to address the structural inequalities with which the production of migration knowledge is often associated. Writing Migration through the Body builds a study of the body as a mutable site for negotiating and articulating the transnational experience of mobility. At its core stands a selection of recent migration stories in Italian, which are brought into dialogue with related material from cultural studies and the visual arts. The migration of constitutional ideas across jurisdictions is one of the central features of contemporary constitutional practice. The increasing use of comparative jurisprudence in interpreting constitutions is one example of this. In this 2007 book, leading figures in the study of comparative constitutionalism and comparative constitutional politics from North America, Europe and Australia discuss the dynamic processes whereby constitutional systems influence each other. They explore basic methodological questions which have thus far received little attention, and examine the complex relationship between (...) national and supranational constitutionalism - an issue of considerable contemporary interest in Europe. Assisted migration, an ecosystem engineering technology, is receiving increasing attention and significant support as a means to save biodiversity in a changing climate. Few substantive, or not obviously deficient, reasons have been offered for why pursuing this conservation goal via these means might be good. Some proponents of AM, including those who identify themselves as “pragmatists,” even suggest there is little need for such argument. We survey the principal reasons offered for AM, as well as reasons offered for not offering (...) reasons. As exemplified by the case for translocating whitebark pine, which may at first seem especially strong, we note the incongruence of framing the goal of AM in terms of “saving biodiversity,” neglect of some crucial moral questions, marginalization of normative and scientific context when AM is cast as the lesser of two evils in a “crisis,” doubtful validity and, in any case, marginal importance of arguments that AM projects ought to be undertaken, inconsistent use of scientific facts, and omission of science that counters sanguine assessments. All told—even in cases such as whitebark pine for which AM may seem most defensible—there is little reason to think that AM projects are good as means to “save biodiversity,” or good as means to other goals that have accreted into arguments for these projects. Editor's introduction to special issue of Essays in Philosophy: Migration and Mobility.

The aim of this study is to examine the relationship between migrating soccer players and the annual ranking of the national teams according to the World Football Elo Rating. The sample includes annual data for 243 countries over the period 1994-2018. Migration is captured with the number of migrating players by country in the ‘big-five’ leagues. The causal relationship between the two variables is examined by using Granger causality test. Four control variables are included: the political regime, per capita income, (...) population and regional soccer confederations. The results shed light on two crucial issues. First, causality mainly goes from national soccer performance to migrating soccer players rather than the other way around. Second, the timing of the two effects is quite different. While those players giving an outstanding performance when their national team is doing well are immediately bought by clubs from more highly ranked leagues (the shop-window effect), it takes at least four years for the additional skills acquired by migrated players to have a positive effect on the national soccer performance (the blending effect). Climate change challenges the means of subsistence for many, particularly in the Global South. To respond to the challenges of climate change, countries increasingly resort to resettling those most affected by land erosion, heat, drought, floods, and the like. In this article, I investigate to what extent resettlement can compensate for the harm that climate-induced migration brings. The first harm I identify is that to individual autonomy. I argue that climate change changes the options of those affected by it to (...) the point that the decision to migrate can no longer count as a voluntary one. In some cases, I argue, the conditions of climate change coerce individuals. Second, I suggest that climate-induced migration severs the ties to territory, explaining the constitutive nature of such ties for accounts of individual autonomy. Third, I argue that severing ties with a traditional and historical territory challenges the capacity to imagine a future for individuals. I conclude that resettlement, even if actively planned and chosen, possibly providing gains in individual well-being and human flourishing, nevertheless harms individual autonomy interests. (shrink)

The current European ‘migration crisis’ encompasses increasing rates of migration and the accompanying failure of migrants, including both economic migrants and refugees, to integrate. In this paper, I focus on a normative analysis of the entry fee immigration system, providing both an internal and external critique. In the internal critique, I take for granted that states are best understood as clubs. However, states seem to share greater similarities with clubs that are too exclusive to allow membership to be purchased. In (...) the external critique, I argue that imposing a substantial entry fee on club membership is impermissible if exclusion from membership deprives non-members of basic rights and interests, even if measures are taken to equalise their ability to pay. The upshot of the internal and external critique, I believe, is that membership ought not to be contingent on the payment of a fee, or more generally, the acceptance of current members. (shrink)

This paper makes the case for amnesty of irregular migrants by reflecting on the conditions under which a wrong that is done in the past can be considered superseded. It explores the relation between historical injustice and irregular migration and suggests that we should hold states to the same stringent standards of compliance with just norms that they apply to the assessment of the moral conduct of individual migrants. It concludes that those standards ought to orient migrants and citizens’ moral (...) assessment of how their states handle questions of irregular migration and to inform political initiatives compatible with these moral assessments. There is an ongoing debate on the migration of doctors, especially psychiatrists, from developing countries. It is argued that these countries, which are already running short of psychiatrists, will further be jeopardised and their health systems will collapse if this migration and subsequent recruitment continue. In this paper the author presents a personal view of the ethics and human rights of this matter. He emphasises the importance of migration of doctors in view of the current situation in developing countries and (...) advises that the Commonwealth Code be followed to address the problem of the shortage of psychiatrists in developing countries and psychiatrists’ basic right to avail themselves of the opportunities in the developed world. Most critical discussions of European immigration policies are centered around the concept of Fortress Europe and understand the concept of the border as a way of sealing off unwanted immigration movements. However, ethnographic studies such as our own multi-sited field research in South-east Europe clearly show that borders are daily being crossed by migrants. These findings point to the shortcomings of the Fortress metaphor. By bringing to the fore the agency of migrants in the conceptualization of borders, we propose to (...) understand how borders are being shaped by taking as a starting point the struggles of mobility. Against the background of our two-year transdisciplinary research project TRANSIT MIGRATION European migration and border policies cannot be longer conceptualized as being simply oriented towards the prevention of migration. Since migrants cross the borders daily, what happens if the borders’ permeability is part of the way they work? If so, we have to investigate the mechanisms of border policies and practices anew. One is the concept of the border or migration regime. The other is the concept of the autonomy of migration. Our concept of ethnographic regime analyses is based on a transdisciplinary approach, comprising political studies, anthropology and sociology. (shrink)
