A judgement analysis of people's social inferences of attitudes and ability was conducted. University students were asked to infer the liberalness ( N = 60; Study 1) or intelligence ( N = 40; Study 2) of targets seen in pictures. Multiple regression analyses revealed that attractiveness was the most important cue for predicting inferences of liberalness, while an ethnic cue (i.e., being Asian) was the most important cue for judgements about intelligence. Results also showed that a single-cue model was (...) less susceptible to overfitting, but significantly less accurate than a multiple-cue model in predicting participant's intelligence judgements. Although the multiple regression models suffered a degree of overfitting, cross validation showed that they continued to have significant predictive value when applied to new data. Furthermore, a “random partner” method (comparing each participant's own regression equation with that of another, randomly selected, participant) provided evidence of significant idiosyncratic variation in the way intelligence judgements were made. This paper proposes a framework for formalising intuitions about the behaviour of imperative commands. It seeks to capture notions of satisfaction and coherence. Rules are proposed to express key aspects of the general logical behaviour of imperative constructions. A key objective is for the framework to allow patterns of behaviour to be described while avoiding making any commitments about how commands, and their satisfaction criteria, are to be interpreted. The version of the paradox of false judgement examined at Tht. 188c10–189b9 relies on the assumption that to judge falsehoods is to judge the things which are not. The presentation of the argument displays several syntactic ambiguities: at several points it allows the reader to adopt different syntactic connections between the components of sentences. For instance, when Socrates says that in a false judgement the cognizer is “he who judges the things which are not about anything whatsoever” (188d3–4), how should (...) the clause “about anything whatsoever” be construed? In common with “he who judges” and “the things which are not” (in which case the cognizer would be “he who judges about anything whatsoever the things which are not about it”), or exclusively with “he who judges” (in which case the cognizer would be “he who judges about anything whatsoever the things which are not”)? The most plausible answer is that both construals are envisaged. Accordingly, the argument has two branches corresponding to these two alternative construals. In particular, it attempts to show that in both cases the cognizer will address what does not exist – an impossibility. The idea that a false judgement is concerned with what is not about its reference has a clear echo in the Sophist. The way in which the problem is handled in the Theaetetus provides a hint that can help to find a solution for the hotly debated issue of the interpretation of the Sophist’s account of false statement. This study analyzes cognitive responses to explore a dual processing perspective of ethical judgment formation. Specifically, the study investigates how two factors, judgment task difficulty and moral intensity, influence the extent of deontological and teleological processing and their effects on ethical judgments. A single experiment on 110 undergraduate research participants found that judgment task difficulty affected the extent of deontological and teleological processing. Although moral intensity affected ethical judgments, it did not produce effects on either deontological or (...) teleological cognitive responses. Results did not support the hypotheses that deontological and teleological cognitive responses would mediate the relationships between the experimental factors and ethical judgments. Overall, the results support continued research of factors that affect the nature of information processing in ethical decision situations and the use of cognitive response analysis as a tool for conducting this research. This comparative field study evaluated the moral reasoning used by U.S. and Belizean business students in resolving business-related moral dilemmas. The Belizeans, citizens of a less-developed country with Western heritage and a values-based education system, revolved the dilemmas using higher stages of moral judgment than did the U.S. business students.

My goal in this paper is to see the extent to which judgment aggregation methods subsume meta-analytic ones. To this end, I derive a generalized version of the classical Condorcet Jury Theorem, the aggregative implications of which have been widely exploited in the area of rational choice theory, but not yet in philosophy of science. I contend that the generalized CJT that I prove below is useful for modelling at least some meta-analytic procedures.

When people make judgments about the effects of a perturbation on populations of species in a food web, their judgments exhibit the dissipation effect: a tendency to judge that effects of the perturbation weaken or dissipate as they spread out through the food web from the locus of the perturbation. In the present research evidence for two more phenomena is reported. Terminal locations are points in the food web with just a single connection to the rest of the web. Judged (...) changes tended to be higher for species at terminal locations than for species the same distance from the perturbation but at nonterminal locations. Branches are points in the web where a route splits into two or more routes. Judged changes tended to be lower for species following branching points than for species the same distance from the perturbation but not following branching points. It is proposed that the findings can be explained as effects of a mental model employing concepts of influence and resistance. Under this model a perturbation is a change in energy level at a point in the system that acts as an influence affecting the rest of the system. The basic concepts in this model are domain‐general and on that basis it is predicted that the dissipation effect should be found in judgments of any physical system to which notions of influence and resistance can be applied. This study aims to examine the ethical decision-making model proposed by Schwartz, where we consider the factors of non-rationality and aspects that affect ethical judgments of auditors to make the decision to blow the whistle. In this paper, we argue that the intention of whistleblowing depends on ethical awareness and ethical judgment as well as there is a mediation–moderation due to emotion and perceived moral intensity of auditors. Data were collected using an online survey with 162 external auditors who (...) worked on audit firms in Indonesia as well as 173 internal auditors working in the manufacturing and financial services. The result of multigroup analysis shows that emotion can mediate the relationship between EAW and EJW. The nature of this relationship is more complex and then tested by adding moderating variables using consistent partial least squares approach. We found that EMT and PMI can improve the relationship between ethical judgments and whistleblowing intentions. These findings indicate that internal auditors are more likely to blow the whistle than external auditors; and reporting wrongdoing internally and anonymously are the preferred way of professional accountants to blow the whistle in Indonesia. According to Wlodek Rabinowicz's (2008) fitting-attitude analysis of value relations, two items are on a par if and only if it is both permissible to strictly prefer one to the other and permissible to have the opposite strict preference. Rabinowicz’s account is subject, however, to one important objection: if strict preferences involve betterness judgements, then his analysis contrasts with the intuitive understanding of parity. In this paper, I examine Rabinowicz’s three responses to this objection and argue that they (...) do not succeed. I then propose an alternative solution. I argue that the objection can be avoided if we ‘relativize’ Rabinowicz’s account and define parity in terms of opposite strict preferences between two items that are only relatively permissible, rather than permissible simpliciter. I argue that this account of parity can be defended if we take seriously the distinction between sufficient and decisive reason for a preference relation. I also show that, on the basis of this distinction, we can arrive at a more extensive taxonomy of value relations than the one proposed by Rabinowicz. (shrink)

This essay defends moral expertise against the skeptical considerations raised by Gilbert Ryle and others. The core of the essay articulates an account of moral expertise that draws on work on expertise in empirical moral psychology, and develops an analogy between moral expertise and linguistic expertise. The account holds that expertise is contrastive, so that a person is an expert relative to a particular contrast. Further, expertise is domain specific and characterized by “automatic” behavior and judgment. Some disagreements in (...) the literature regarding moral expertise are diagnosed as being due to failures to adequately distinguish different ways in which someone can be a moral expert. Background The aim of this study was to investigate whether physicians who felt strongly for or against a treatment, in this case a moderately life prolonging non-curative cancer treatment, differed in their estimation of medical indication for this treatment as compared to physicians who had no such sentiment. A further aim was to investigate how the notion of medical indication was conceptualised. Methods A random sample of GPs, oncologists and pulmonologists comprised the study group. Respondents were randomised to receive either (...) version of a case presentation; in one version, the patient had smoked and in the other version she had never smoked. The physicians were labelled value-neutral and value-influenced on the basis of their attitude towards the treatment. Results In the ‘value-influenced’ group, there was a significant difference in the estimation of medical indication for treatment depending upon whether the patient had smoked or never smoked ). There was no such difference in the ‘value-neutral’ group. Conclusion This study shows that compared to value-neutral physicians, value-influenced physicians are more likely to base decisions of medical indication on medically irrelevant factors. Moreover, medical indication is used in an ambiguous manner. Hence, we recommend that the usage of ‘medical indication’ be disciplined. (shrink)

This study provides a comparative analysis of students' self-reported beliefs and behaviors related to six analogous pairs of conventional and digital forms of academic cheating. Results from an online survey of undergraduates at two universities (N = 1,305) suggest that students use conventional means more often than digital means to copy homework, collaborate when it is not permitted, and copy from others during an exam. However, engagement in digital plagiarism (cutting and pasting from the Internet) has surpassed conventional plagiarism. (...) Students also reported using digital "cheat sheets" (i.e., notes stored in a digital device) to cheat on tests more often than conventional "cheat sheets." Overall, 32% of students reported no cheating of any kind, 18.2% reported using only conventional methods, 4.2% reported using only digital methods, and 45.6% reported using both conventional and digital methods to cheat. "Digital only" cheaters were less likely than "conventional only" cheaters to report assignment cheating, but the former was more likely than the latter to report engagement in plagiarism. Students who cheated both conventionally and digitally were significantly different from the other three groups in terms of their self-reported engagement in all three types of cheating behavior. Students in this "both" group also had the lowest sense of moral responsibility to refrain from cheating and the greatest tendency to neutralize that responsibility. The scientific and educational implications of these findings are discussed in this study. (shrink)

It has been acknowledged on numerous occasions that personal religiousness is a potential source of ethical norms, and consequently, an influence in ethical evaluations. An extensive literature review provides little in the way of empirical investigation of this recognized affect. This investigation conceptualizes religiousness as a motivation for ethical action, and discovers significant differences in ethical judgements among respondents categorized by personal religious motivation. Using Natural Language Processing tools, the current study explores the evolution of objectivity practice in terms of attitude injection. Adopting the indicator of moral loading under the Moral Foundation Theory framework, it examined the moral judgments embedded in 20,679 culture war news articles published in five major U.S. newspapers from 1980 to 2021. Our findings revealed a distinct mixed journalistic liberal pattern and an apparent paradox in objectivity practice: the less moral judgments, the more liberal tendencies, which could be caused (...) by journalists’ watchdog role and the increase of liberal components in U.S. democracy. We then argue that the performance of traditional objectivity has remained robust, especially when accounting for the degree to which moral judgments can be attributed to source quotations. The study contributes to the literature by bridging moral psychology and the enactment of journalistic norms, applying MFT to evaluate degrees of objectivity in news. (shrink)

Consider orthodox motivational judgment internalism: necessarily, A’s sincere moral judgment that he or she ought to φ motivates A to φ. Such principles fail because they cannot accommodate the amoralist, or one who renders moral judgments without any corresponding motivation. The orthodox alternative, externalism, posits only contingent relations between moral judgment and motivation. In response I first revive conceptual internalism by offering some modifications on the amoralist case to show that certain community-wide motivational failures are not conceptually (...) possible. Second, I introduce a theory of moral motivation that supplements the intuitive responses to different amoralist cases. According to moral judgment purposivism (MJP), in rough approximation, a purpose of moral judgments is to motivate corresponding behaviors such that a mental state without this purpose is not a moral judgment. MJP is consistent with conceptual desiderata, provides an illuminating analysis of amoralist cases, and offers a step forward in the internalist-externalist debates. (shrink)

Although ethics instruction has become an accepted part of the business school curriculum at both the undergraduate and graduate levels, some scholars have questioned its effectiveness, and research results have been mixed. However, studies yield interesting results regarding certain factors that influence the ethicality of business students and may impact the effectiveness of business ethics instruction. One of these factors is gender. Using personal and business ethics scenarios, we examine the main and interactive effects of gender and business ethics education (...) on moral judgment. We then analyze the relationships between gender and business ethics education on personal ethical perspectives. Our results indicate that women are generally more inclined to act ethically than men, but paradoxically women who have had business ethics instruction are less likely to respond ethically to business situations. In addition, men may be more responsive to business ethics education than women. Finally, women’s personal ethical orientations may become more relativistic after taking a business ethics class. In this paper we focus on the difficulty in judging what is called covert hate speech. We emphasize the need for a multidimensional framework when analysing covert hate speech in situ, and the need to consider the multifaceted dimension of such speech act to assess its performativity. To explain such need, we apply the test of the Rabat Plan of Action and adopt a pragmatic perspective to analyse a specific covert hate speech act, considering such speech act as both an (...) expressive and potentially performative act. We focus on the prosecution of hate speech against a woman holding a poster during an anti-safe pass demonstration. Her poster inferred a link between conspiracy theory, the government strategy addressing the Covid pandemic and many other collectives, primarily the Jewish community. Our analysis of the sign adopts a radically context-dependent methodology combining a pragmatic approach and the Rabat Plan of Action test. We then contrast our analysis with the legal and media perspective on the issue. We conclude by suggesting the benefit of integrating pragmatic analysis with application of normative set of rules such as the Rabat Plan of Action test, even though the fluidity of meaning always poses a challenge to any authority tasked with judging such communicative events. In addition, it has remained a landmark work in fields such as phenomenology, hermeneutics, the Frankfurt School, analytical aesthetics, and contemporary critical theory. The aim of the paper is to illuminate some core aspects of Leibniz’s conception of judgement and its place in his conception of the mind. In particular, the paper argues for three claims: First, the act of judgement is at the centre of Leibniz’s conception of the mind in that minds strive at actualising innate knowledge concerning derivative truths, where the actualising involves an act of judgement. Second, Leibniz does not hold a judgement account of predication, but a two-component account (...) that distinguishes between predication and alethic evaluation. Third, Leibniz understands the act of affirmative judgement in terms of establishing active dispositions, i.e. strivings, to make reasons available for future reasoning that aims at answering whether-questions. Correspondingly, he understands the act of negative judgement in terms of establishing dispositions to ban propositions from future reasoning that aims at answering whether-questions. In the final analysis, the acts of affirmative as well as of negative judgement turn out to be acts of changing memory dispositions. (shrink)

Recently, the ethical rather than just the economic resonance of entrepreneurship has attracted attention with researchers highlighting entrepreneurship and ethics as interwoven processes of value creation and management. Recognising that traditional normative perspectives on ethics are limited in application in entrepreneurial contexts, this stream of research has theorised entrepreneurship and ethics as the pragmatic production of useful effects through the alignment of public—private values. In this article, we critique this view and use Kant's concept of reflective judgement as discussed in (...) his Critique of the Power of Judgement to theorise ethical entrepreneurial practice as the capacity to routinely break free from current conventions through the imaginative creation and use of self-legislating maxims. Through an analysis of the narratives of 12 entrepreneurs, we suggest there are three dimensions to reflective judgement in entrepreneurial contexts: (1) Social Performance; (2) Public Challenge and; (3) Personal Autonomy. Whilst the entrepreneurs were alive to the importance of commercial return, their narratives demonstrated further concern for, and commitment to, standards that they rationally and imaginatively felt as being appropriate. In our discussion, we integrate the findings into existing theoretical categories from entrepreneurship studies to better appreciate ethics within the context of value creation. (shrink)

The ability of a group of adults with high functioning autism (HFA) or Asperger Syndrome (AS) to distinguish moral, conventional and disgust transgressions was investigated using a set of six transgression scenarios, each of which was followed by questions about permissibility, seriousness, authority contingency and justification. The results showed that although individuals with HFA or AS (HFA/AS) were able to distinguish affect-backed norms from conventional affect-neutral norms along the dimensions of permissibility, seriousness and authority-dependence, they failed to distinguish moral and (...) disgust transgressions along the seriousness dimension and were unable to provide appropriate welfare-based moral justifications. Moreover, they judged conventional and disgust transgressions to be more serious than did the comparison group, and the correlation analysis revealed that the seriousness rating was related to their ToM impairment. We concluded that difficulties providing appropriate moral justifications and evaluating the seriousness of transgressions in individuals with HFA/AS may be explained by an impaired cognitive appraisal system that, while responsive to rule violations, fails to use relevant information about the agent’s intentions and the affective impact of the action outcome in conscious moral reasoning. This study examines the implications of practical reason for entrepreneurial activities. Our study is based on Thomas Aquinas’ interpretation of such virtue, with a particular focus on the partition of practical reason in potential parts such as synesis, or common sense, and gnome, or perspicacity. Since entrepreneurial acts and actions deal with extremely uncertain situations, we argue that only this perspicacity, as the ability of correctly judging in exceptional cases, has the power to find wisdom under such blurred conditions. Perspicacity (...) frees entrepreneurs from their cognitive schemata rendering them able to be truly entrepreneurial. Based on this vision and thanks to a semantic analysis of the meaning of the Greek word gnome, we construct an interpretative model for entrepreneurial judgment composed of three dimensions, specifically, knowledge-cognitive, external-affective and personal-reflective. The model highlights how a ‘successful’ entrepreneurial judgment is also such from a holistic point of view. (shrink)

The account applies also to artworks, of which some serve extrinsic functions (such as the glorification of God and the communication of religious lore) and others have the function of being contemplated for their own sake alone. Along the way, I deny that aesthetic judgements fit the model of judgements either of free beauty or of dependent beauty, given how these (...) two came to be described in the early twentieth century. Past research showed that the ability to focus on one’s internal states positively correlates with the self-regulation of behavior in situations that are accompanied by somatic and/or physiological changes, such as emotions, physical workload, and decision-making. The analysis of moral oriented decision-making can be the first step for better understanding the legal reasoning carried on by the main players in the field, as lawyers are. For this reason, this study investigated the influence of the decision context and interoceptive manipulation (...) on the moral decision-making process in the legal field gathering the responses of two groups of lawyers. A total of 20 lawyers were randomly divided into an experimental group, which was explicitly required to focus the attention on its interoceptive correlates, and a control group, which only received the general instruction to perform the task. Both groups underwent a modified version of the Ultimatum Game, where are presented three different moral conditions and three different offers. Results highlighted a significant increase of Acceptance Rate in those offers that should be considered more equal than fair or unfair ones, associated with a general increase of Reaction Times in the equal offers. Furthermore, the interoceptive manipulation oriented the Lawyers toward a more self-centered decision. This study shows how individual, situational, contextual, and interoceptive factors may influence the moral decision-making of lawyers. Future research in the so-called Neurolaw field is needed to replicate and expand current findings. (shrink)

The growing body of whistleblowing literature includes many studies that have attempted to identify the individual level antecedents of whistleblowing behavior. However, cross-cultural differences in perceptions of the ethicality of whistleblowing affect the judgment of whistleblowing intention. This study ascertains how Chinese managers/professionals decide to blow the whistle in terms of their locus of control and subjective judgment regarding the intention of whistleblowing. Hypotheses that are derived from these speculations are tested with data on Chinese managers and professionals. (...) The core argument in this paper is that, to reconstruct the last unwritten section on Judging in Hannah Arendt's Life of the Mind , it is necessary to address what Arendt was doing with the book as a whole and how the different parts relate internally to one another. This is no easy matter, especially as the existing sections on Thinking and Willing are quite different in tone from one another. My proposition is that the work should be read as (...) a critique of the life of the `modern' mind, and especially of the differentiation of the modern mind into distinct and reified faculties. The work as a whole is an attempt to understand the distorted forms of modernization that result from the division of the life of the mind into opposing faculties. It is, so to speak, a critique of the combined and uneven development of the life of the modern mind. While Arendt famously argues that the activity of thinking itself conditions people against evildoing, the spectre that informs her analysis of both thinking and willing is the danger of nihilism inherent in these mental activities. The work raises vital questions concerning the conditions under which this danger is actualized and the means by which it might be averted. What this entails for our reconstruction of the missing section on judgment is that, rather than see it as the core of Arendt's contribution to political thought or as the promised solution to an impasse, we should explore the equivocations of judging. This aporetic reading of the text helps clarify Arendt's concerns over the separation of the life of the mind from the world and the role of both judging and understanding in renewing its connections to the world. In recent years, judgement aggregation has emerged as an important area of social choice theory. Judgement aggregation is concerned with aggregating sets of individual judgements over logically connected propositions into a set of collective judgements. It has been shown that even seemingly weak conditions on the aggregation function make it impossible to find functions that produce rational collective judgements from all possible rational individual judgements. This implies that the step from individual judgements to collective judgements requires trade-offs between different desiderata, (...) such as universal domain, rationality, epistemological quality, and unbiasedness. These dilemmas challenge us to decide which conditions we should relax. The typical application for judgement aggregation is the problem of group decision making. Juries and expert committees are the stock examples. However, the relevance of judgement aggregation goes beyond these cases. In this survey I review some core results in the field of judgement aggregation and social epistemology and discuss their implications for the analysis of distributed thinking. (shrink)

Some exchanges of reasons are agonistic. Others work mutually, as in planning and adjusting divergent understanding. Mutual argumentation subconsciously yields judgment that integrates and clarifies a common vision coordinating interrelated lives. It harmonizes agents sharing a space of action and understanding. Pierre Bourdieu held that such thought generates and expresses culture, patterning a logic that reflexively constrains itself. This discussion examines Bourdieu’s views as an analysis of mutual argumentation.

Questions regarding the nature of moral judgment loom large in moral philosophy. Perhaps the most basic of these questions asks how, exactly, moral judgments and moral rules are to be defined; what features distinguish them from other sorts of rules and judgments? A related question concerns the extent to which emotion and reason guide moral judgment. Are moral judgments made mainly on the basis of reason, or are they primarily the products of emotion? As an example of the (...) former view, Kant held all moral requirements to be derived from a principle of rationality (the categorical imperative). As an example of the latter, Hume famously claimed that reason is “the slave of the passions” and that moral judgments stem from the moral emotions. When addressing these issues, philosophers have largely relied on the traditional tools of philosophical analysis, along with introspection, anecdotal evidence and armchair speculation. In recent years, however, a rich body experimental psychology has emerged which, in the view of a growing number of philosophers, casts important new light on these venerable questions. Our aim, in this chapter, is to illustrate how empirical methods can help move traditional philosophical debates forward in interesting and important ways. Since space does not permit an exhaustive survey of the relevant experimental work, we will focus on a few of the most compelling examples. (shrink)

The issue of interpersonal comparisons of utility is about the possibility (or not) of comparing the utility or welfare or the mental states in general, of different individuals. Embedded in the conceptual framework of utilitarianism, interpersonal comparisons were admissible in economics as part of the theoretical justification of welfare policies until the first decades of the twentieth century. Under the strong influence of the scientific philosophy of positivism as reflected in the works of early neoclassical economists and as epitomized by (...) Lionel Robbins, utility comparisons were subsequently rejected as a value judgement. Robbins’ methodological stance is still prevalent among mainstream economists. Despite the explicit rejection of comparability by the majority of economists, interpersonal comparisons are necessary for many key policy issues, such as progressive taxation, social welfare policies, GDP-based welfare comparisons, cost–benefit analysis, and public goods provision. In this paper, the case of interpersonal utility comparisons is discussed as an illustrative example of the usefulness of the study of the role of value judgements, and generally of the interrelationship between ethics and economics. It is argued that the current tension between theory and policy practice might be resolved through the efforts of prominent economists and philosophers to challenge positivism, and especially its problematic treatment of value judgements and of ethical assumptions in general. The discussion also provides more strength to the view that policy makers and their economic advisers cannot avoid ethical questions in their analysis of the workings of the economic system. In this study, we investigated the relationships between judgments of intentionality and moral evaluation in individuals with High Functioning Autism (HFA) or Asperger Syndrome (AS). HFA or AS are neurodevelopmental disorders characterised by severe deficits in communication and social functioning. Impairments in Theory of Mind (ToM), i.e., the ability to attribute mental states to oneself and to others, are thought to be the core features of autism. Of all mental states, the concept of ‘intentional action’ is particularly important. People normally (...) distinguish between actions that are performed intentionally and those that are performed unintentionally and this distinction plays a crucial role in social understanding and moral judgment. Recently, Knobe (Analysis 63: 190–193, 2003a ), (Philosophical Psychology 16: 309–324, 2003b ) showed that people’s moral evaluations might serve as input to the process by which people intuitively arrive at the intentionality judgments. Here, by using two pairs of vignettes, the Knobe’s Harm/Help cases and Murder/Bull’s-eye cases, we showed that, as already observed in typical population, in individuals with HFA/AS judgment of intentional action is informed by the moral appreciation of the action outcome. However, the two groups differed on praise judgments and moral justifications, suggesting that these processes were poorly influenced by the agent’s psychological states. We concluded that, although under certain circumstances, individuals with HFA/AS and people with typical development have similar intuitive judgments of intentionality, over-assignment of praise judgments and the reduced use of folk-psychological concepts in moral judgment likely reflect difficulties using intentionality information for moral reasoning. Early analytic philosophers such as Frege, Russell and Wittgenstein as well as phenomenologists such as Brentano, Husserl and Reinach changed how philosophers think about this question. The papers in this book explore and assess their contributions and help us to retrace their steps. In doing so we will get a clearer picture of judgement and the related notion of truth.

As Hong Kong is the only common law jurisdiction operating in Chinese, alongside English, writing a common law judgment in Chinese is like exploring an uncharted domain in legal discourse. Apart from those judgments originally written in Chinese, Chinese judgments have also been prepared by way of translation from English. Besides, there are also English translations of Chinese judgments of jurisprudential value. Judgments in Hong Kong therefore present an interesting case for study both from a legal point of view (...) and from the perspective of discourse analysis. As Chinese judgments in Hong Kong to a large extent mirror images of their English counterparts, they provide us with insights into how judicial thinking embodied in one language is carried over to another. As the translation of court judgments can serve as a clue to the understanding of how judicial thinking is transferred and reflected in another language, this study looks into some of the fundamental problems of legal translation in general and translation of court judgments in particular, showing how the sociosemiotic approach can shed light on those problems. The question of rationality and of its role in human agency has been at the core of pragmatist concerns since the beginning of this movement. While Peirce framed the horizon of a new understanding of human reason through the idea of inquiry as aiming at belief-fixation and James stressed the individualistic drives that move individuals to action, it is in Dewey’s writing that we find the deepest understanding of the naturalistic and normative traits of rationality considered as the qualifying attribute (...) of human agency. Recent developments in moral and political philosophy as well as in general pragmatist scholarship have shown a renewal of interest in the role of human reason in agency, both with respect to control of conduct (decisions about how to act) and with respect to normative attitudes (considerations of what is good and right). In this article I will examine some features of Dewey’s epistemology which are particularly promising for the elaboration of a theory of practical rationality based on pragmatist sources. In particular, I will focus on Dewey’s notion of “judgment of practice” in order to frame a distinctively Deweyan approach to practical rationality. In order to point out the specificity of Dewey’s epistemological framework, I will refer to it as an “epistemology of practice”i. The aim of this article is to clarify the epistemological meaning of the concepts of articulation and transformation, that Dewey places at the heart of his theory of inquiry. Part of my argument consists in showing that through these notions Dewey aimed at broadening the conception of rationality, bringing it beyond the reach of the standard notions of analysis and synthesis and of induction, deduction, and abduction. Once the specificity of Dewey’s conception of rationality will have been demonstrated, I will proceed to show some of its implications in the explanation of the rationality of human agency with reference to practical reasoning and value assessment. I will then conclude the article by drawing some implications of Dewey’s theory of judgment for a broader epistemology based upon the acknowledgment of the primacy of practice. (shrink)
