This essay expands upon an earlier work in which we analyzed the implications of the Verizon v RIAA case for P2P Networks vis-à-vis concerns affecting personal privacy and intellectual property. In the present essay we revisit some of the concerns surrounding this case by analyzing the intellectual property and privacy issues that emerged in the MGM Studios v. Grokster case. These two cases illustrate some of the key tensions that exist between privacy and property interests in cyberspace. In our analysis, (...) we contrast Digital Rights Management and Interoperability and we examine some newer distribution models of sharing over P2P networks. P2P (Peer-to-Peer) file-sharing or file-swapping has led to many disputes about copyright laws and has become “a worldwide problem.” This paper first describes the development of P2P and then discusses some of the disputes concerning Chinese copyright laws. Given the difficulties in implementing copyright laws in China and many other countries, this paper next analyzes the reasons why and the conditions under which P2P developed, its impact on music production, and some other general economic, social, and ethical (...) implications of this technology. The paper recognizes, on the one hand, the significance of P2P as an advanced technology for popularizing music and sharing human and spiritual values with more people, on the other hand, it points to several critical issues caused by the current illegal use of this technology for sharing copyrighted music files: e.g., the serious damage to music production and the infringement on copyright holders’ interests. It is hypothesized argue that the technological conditions, social demands, and problems with the current type of music production have deepened the present crisis, and a new type of music production is sought. Legislation should enhance such a development, support P2P technology in the interest of the public, protect copyrights, and regulate P2P stakeholders’ interests in a balanced manner according to the ethics of law. PurposeThe paper suggests overcoming the polarization of today's debate on peer‐to‐peer systems by defining a fair balance between the principle of precaution and the principle of openness. Threats arising from these file sharing applications‐systems should not be a pretext to limit freedom of research, speech or the right “freely to participate in the cultural life of the community”, as granted by the Universal Declaration of Human Rights from 1948. The paper aims to take sides in today's debate.Design/methodology/approachThe paper (...) adopts an interdisciplinary approach, including network theory, law and ethics. The method draws on both theoretical and empirical material so as to stress the paradox of the principle of precaution applied to P2P systems and why the burden of proof should fall on the party proposing that one refrain from action.FindingsCensors and opponents of P2P systems who propose to apply the principle of precaution to this case deny the premise upon which that principle rests. “Levels of evidence” required by the precautionary principle show that – in many cases in which the outcomes of technology are ignored – another principle is needed for orienting action, namely, the principle of openness.Social implicationsAlarm about how P2P systems undermine crucial elements of the societies often led to the ban of this technology. The paper illustrates why it should not be the case: rather than shutting these networks down, they should be further developed.Originality/valueThe paper provides the comprehensive picture of a far too often fragmented debate. Students are using file sharing sites to breach academic integrity in light of the Covid-19 pandemic. This paper analyses the use of one such site, Chegg, which offers “homework help” and other academic services to students. Chegg is often presented as a file sharing site in the academic literature, but that is just one of many ways in which it can be used. As this paper demonstrates, Chegg can and is used for contract cheating This is (...) despite the apparent existence of an Honour Code on Chegg which asks students not to breach academic integrity. With pandemic led safety considerations leading to increased online teaching and assessment, the paper analyses data relating to how Chegg is used by students in five STEM subjects, namely Computer Science, Mechanical Engineering, Electrical Engineering, Physics and Chemistry. The results show that students are using Chegg to request exam style questions. They demonstrate that contract cheating requests can be put live and answered within the short duration of an examination. The number of student requests posted for these five subjects increased by 196.25% comparing the time period April 2019 to August 2019 with the period April 2020 to August 2020. This increase corresponds with the time when many courses moved to be delivered and assessed online. The growing number of requests indicates that students are using Chegg for assessment and exam help frequently and in a way that is not considered permissible by universities. The paper concludes by recommending that academic institutions put interventions in place to minimise the risk to educational standards posed by sites such as Chegg, particularly since increased online teaching and assessment may continue after the pandemic. Individuals are downloading copyrighted materials at escalating rates (Hill 2007; Siwek 2007). Since most materials shared within these networks are copyrighted works, providing, exchanging, or downloading files is considered to be piracy and a violation of intellectual property rights (Shang et al. 2008). Previous research indicates that personal moral philosophies rooted in moral absolutism together with social context may impact decision making in ethical dilemmas; however, it is yet unclear which motivations and norms contextually impact moral awareness in a peer-to-peer (...) (P2P) file sharing context (Shang et al. 2008). In sum, factors affecting the decision to share copyrighted material require further clarification and investigation (Shang et al. 2008). The purpose of this study was to use a consumer-based scenario and multiple ethics measures to explore how idealism, formalism, and perceived social consensus impact users’ propensity to recognize that the sharing of copyrighted media through P2P networks was an ethical issue and their subsequent ethical intentions. Results showed that high levels of idealism and formalism were associated with an increased recognition that file sharing was an ethical issue, but neither construct had a direct effect on ethical intention. Strong social consensus among respondents that other people consider file sharing to be unethical was also positively related to the recognition that file sharing was an ethical issue, and ethical recognition was a moderate predictor of intention not to engage in file sharing. Finally, a post hoc mediation analysis indicated that idealism, formalism, and social consensus operated through recognition of an ethical issue to impact ethical intention (indirect-only mediation). Purpose – The purpose of this paper is to develop a novel approach for the ethical analysis of data collected from an online file-sharing site known as The PirateBay. Since the creation of Napster back in the late 1990s for the sharing and distribution of MP3 files across the Internet, the entertainment industry has struggled to deal with the regulation of information sharing at large. Added to the ethical questions of censorship and distributive justice are questions (...) related to the use of data collected from such file-sharing sites for research purposes. Design/methodology/approach – The approach is based on previous work analysing the use of data from online social networking sites and involves value analysis of the collection of data throughout the data’s various life cycles. Findings – This paper highlights the difficulties faced when attempting to apply a deontological or utilitarian approach to cases like the one used here. With this in mind, the authors point to a virtue ethics approach as a way to address ethical issues related to data sharing in the face of ever-changing data gathering and sharing practices. Practical implications – This work is intended to provide a concrete approach for ethical data sharing practices in the domain of Internet security research. Originality/value – The approach presented in this paper is a novel approach combining the insights from: the embedded values concept, value-sensitive design and the approach of the embedded ethicist. In a supply chain system, the prices with which the suppliers supply its local commodity to the retailers should satisfy the requirements of the retailers and the consumers. The supply and demand scheme satisfying these requirements is reduced into fuzzy relation inequalities with min-product composition. Due to the difference between the min-product composition and the classical max-t-norm one, we first study the resolution of such min-product FRI system. For optimization management in the supply chain system, we further investigate a maximin (...) programming problem subject to the min-product FRIs. An algorithm is proposed to obtain the optimal solution based on the quasi-maximal matrix and corresponding index set. To illustrate the efficiency of our proposed algorithm, we provide a simple numerical example. The obtained optimal solution reflects an optimal pricing scheme, which maximizes the minimum prices of the commodity from the suppliers. (shrink)

Digitized information and network have made an enormous impact on the music and movie industries. Internet piracy is popular and has greatly threatened the companies in these industries. This study tests Hunt-Vitell’s ethical decision model and attempts to understand why and how people share unauthorized music files with others in the peer-to-peer (P2P) network. The norm of anti-piracy, the ideology of free software, the norm of reciprocity, and the ideology of consumer rights are proposed as four deontological norms related to (...) using P2P systems. The model is tested using a scenario survey with four alternatives; the results indicate that the deontological norm of anti-piracy is not a main factor in affecting P2P users’ ethical considerations regarding sharing files with others. This finding suggests that to protect their property rights, record companies should try to realize the consumer benefits brought via new digital and network technology, instead of simply declaring their intellectual property and resisting the innovations resulting from new technologies. What is it for two people to think of an object, natural kind or other entity under the same mode of presentation (MOP)? This has seemed a particularly difficult question for advocates of the Mental Files approach, the Language of Thought, or other ‘atomistic’ theories. In this paper I propose a simple answer. I first argue that, by parallel with the synchronic intrapersonal case, the sharing of a MOP should involve a certain kind of epistemic transparency between the token (...) thoughts of the two thinkers. I then explain how shared words help bring about this transparency. Finally, I show how this account can be extended for thoughts expressed using demonstratives or indexicals. (shrink)

Belief fragments and mental files are based on the same idea: that information in people’s minds is compartmentalized rather than lumped all together. Philosophers mostly use the two notions differently, though the exact relationship between fragments and files has yet to be examined in detail. This chapter has three main goals. The first is to argue that fragments and files, properly understood, play distinct yet complementary explanatory roles; the second is to defend a model of belief that includes them both; (...) and the third is to raise and address a shared dilemma that confronts them: that they threaten to be either explanatorily lightweight or empirically refuted. This chapter contends that it is better to embrace the horn of this dilemma that opens up files and fragments to empirical refutation or confirmation, by adopting a psychofunctionalist approach. What is it to share the same concept? The question is an important one since sharing the same concept explains our ability to non-accidentally coordinate on the same topic over time and between individuals. Moreover, concept identity grounds key logical relations among thought contents such as samesaying, contradiction, validity, and entailment. Finally, an account of concept identity is crucial to explaining and justifying epistemic efforts to better understand the precise contents of our thoughts. The key question, then, is what (...) psychological and social facts could play these roles? Elsewhere, we have argued for a specific relational model of concept identity, the connectedness model (e.g. Schroeter 2012, Schroeter and Schroeter 2014, 2015). Our aim in this chapter is to further explain the motivations behind that account, to address worries about transitivity and vagueness, and to contrast our approach with closely related accounts of concept identity developed by François Recanati and Simon Prosser. -/- What’s distinctive of our approach is that we seek to vindicate the first-person epistemic perspective of concept users. Concepts, on our account, play a crucial normative role in setting regulative ideals for the representational practices in which individual subjects participate. This focus on the normative role of concepts – as opposed to a purely causal explanatory role – motivates our approach to concept identity and our toleration of vagueness and borderline cases. Key activities in biomedicine and related research rely on collections of biological samples and related files. Access to such resources in industry and in academic contexts has become strategic and represents a central issue in the general framework of rising patenting practices and in debates about the knowledge economy. It raises important issues concerning the organisation of scientific and medical work, the outline of data-sharing guidelines, and science policy's contribution to the elaboration of an adapted framework. This paper presents (...) an ethnographic study of three French human biobanks. Building on field work (participant observation and in-depth interviews), the study focuses on data access in the concrete practices in biobanks. The paper develops a perspective based on an analysis of different exchange regimes. We argue that access practices are submitted to the different regimes that can coexist and be articulated within the daily activities of each biobank. We also discuss how this perspective can further our understanding of biomedical research, and how it might inform data access policy. (shrink)

Owners of businesses represent an interesting case in the study of the intersection of personal and corporate philanthropic values. Because individuals who own businesses have the means and the ability to act on philanthropic motivations through the medium of their businesses, it is interesting to explore the extent to which their corporate contributions to nonprofits are philanthropic in nature or instrumentally motivated, as in the instance of cause related marketing. The trade-offs between cause related marketing and corporate support of nonprofits (...) are complex. Although larger firms are increasing their investments in cause related marketing, the extent of and motivations for adoption of cause related marketing among privately held businesses is less well understood. This study of 478 businesses which are supporters of arts organizations shows that privately held businesses of medium size (300 to 500 employees) are participating in cause related marketing to a significant degree. The adoption rate of cause related marketing is about 40%, and the primary benefits sought are company image enhancement and product marketing support. Adoption of cause related marketing among privately held and smaller enterprises will grow as CEOs exhibit satisfaction with the results of their program, intend to engage in positive word of mouth about it, and plan to allocate more resources to it. Change blindness experiments had demonstrated that detection of significant changes in natural images is extremely difficult when brief blank fields are placed between alternating displays of an original and a modified scene. On the other hand, research on the visual mismatch negativity component of the event-related potentials identified sensitivity to events different from the regularity of stimulus sequences, even if the deviant and standard events are non-attended. The present study sought to investigate the apparent controversy between the experience under the (...) change blindness paradigm and the ERP results. To this end, the stimulus of Rensink, O’Reagen, and Clark was adapted to a passive oddball ERP paradigm to investigate the underlying processing differences between the standard and deviant stimuli measured in 22 subjects. Posterior negativity within the 280–330 ms latency range emerged as the difference between ERPs elicited by standard and deviant stimuli, identified as visual mismatch negativity. These results raise the possibility that change blindness is not based on the lack of detailed visual representations or the deficiency of comparing two representations. However, effective discrimination of the two scene versions requires considerable frequency differences between them. (shrink)

This article explores the discursive behaviour of professional male team sports players in post-match interviews from a social identity construction perspective. Drawing on a data set of 160 televised post-match interviews from two different team sports and two different regions of the world, this article identifies stances players orient to when presenting themselves in these media interviews. A supplementary data set of ethnographic semi-structured interviews with professional team sports players is also used to develop insider perspectives on the discursive behaviour (...) of professional team sports players when speaking to the media. What is argued is that the acts and stances employed by team sports players can be interpreted as indexing a media self, or media identity, one that professional team sports players construct in order to strategically negotiate a public version of self that presents them positively to their audience and maintains their relationships with other members of their team. Adaptive training adjusts a training task with the goal of improving learning outcomes. Adaptive training has been shown to improve human performance in attention, working memory capacity, and motor control tasks. Additionally, correlations have been observed between neural EEG spectral features and the performance of some cognitive tasks. This relationship suggests some EEG features may be useful in adaptive training regimens. Here, we anticipated that adding a neural measure into a behavioral-based adaptive training system would improve human performance on a (...) subsequent transfer task. We designed, developed, and conducted a between-subjects study of 44 participants comparing three training regimens: Single Item Fixed Difficulty, Behaviorally Adaptive Training, and Combined Adaptive Training using both behavioral and EEG measures. Results showed a statistically significant transfer task performance advantage of the CAT-based system relative to SIFD and BAT systems of 6 and 9 percentage points, respectively. Our research shows a promising pathway for designing closed-loop BCI systems based on both users' behavioral performance and neural signals for augmenting human performance. (shrink)

Type II DNA topoisomerases (Topo II) are essential enzymes implicated in key nuclear processes. The recent discovery of a novel kind of Topo II (DNA topoisomerase VI) in Archaea led to a division of these enzymes into two non‐homologous families, (Topo IIA and Topo IIB) and to the identification of the eukaryotic protein that initiates meiotic recombination, Spo11. In the present report, we have updated the distribution of all Topo II in the three domains of life by a phylogenomic approach. (...) Both families exhibit an atypical distribution by comparison with other informational proteins, with predominance of Topo IIA in Bacteria, Eukarya and viruses, and Topo IIB in Archaea. However, plants and some Archaea contain Topo II from both families. Empathy is the combined ability to interpret the emotional states of others and experience resultant, related emotions. The relation between prefrontal electroencephalographic asymmetry and emotion in children is well known. The association between positive emotion (assessed via parent report), empathy (measured via observation), and second-by-second brain electrical activity (recorded during a pleasurable task) was investigated using a sample of one hundred twenty-eight 6- to 10-year-old children. Contentment related to increasing left frontopolar activation (p < .05). Empathic concern and positive empathy (...) related to increasing right frontopolar activation (ps < .05). A second form of positive empathy related to increasing left dorsolateral activation (p < .05). This suggests that positive affect and (negative and positive) empathy both relate to changes in prefrontal activity during a pleasurable task. (shrink)

We investigate the entrepreneurial opportunities and ethical dilemmas presented by technological turbulence. More specifically we investigate the line between Baumol’s [J. Polit. Econ. 98 (1990) 893] productive (e.g. innovation), unproductive (e.g. rent seeking) and destructive (e.g. criminal) entrepreneurship through three examples of Internet innovation – spam (destructive), music file sharing (unproductive), and Internet pharmacies (potentially productive). The emergence of accessible Internet technologies, under present norms, has created the potential for all three entrepreneurial activities. Because of the propensity for (...) self-serving biases and for bending the rules, the need for creativity in overcoming obstacles and overall liabilities of newness, entrepreneurs are likely to challenge established industrial morals and laws. Unlike new entrants, incumbents must abide by the currently accepted norms, and thus suffer from “liabilities of oldness”. The challenge for new entrants is to change sociopolitical legitimacy, whereas incumbents need to defend the established norms. We discuss competitive and other issues that result from technological turbulence and innovation. (shrink)

Translation and commentary on the only surviving sustained work on Plato's Phaedrus from antiquity.

I argue that the study of variability rather than invariance should head the reading research agenda, and that strong claims of orthographic are unwarranted. I also expand briefly on Frost's assertion that an efficient orthography must represent sound and meaning, by considering writing systems as dual-purpose devices that must provide decipherability for novice readers and automatizability for the expert.

It is the only Neoplatonic commentary on Plato's Phaedrus to have survived in its entirety. Further interest comes from the recorded interventions by Syrianus' pupils - including those by Proclus, his eventual successor as head of the Athenian school, who went on to teach Hermias' father, Ammonius. Intellectual property is one of the highly divisive issues in contemporary philosophical and political debates. The main objective of this paper is to explore some sources of tension between the formal rules of intellectual property (particularly copyright and patents) and the emerging informal norms of file sharing and open access in online environments. We look into the file sharing phenomena not only to illustrate the deepening gap between the two sets of norms, but to cast some (...) doubt on the current regime of intellectual property as an adequate frame for the new type of interactions in online environments. Revisiting the classic Arrow–Demsetz debate about intellectual property and the epistemological issues involved in assessing institutions, we suggest that seeking out new institutional arrangements aligned with the norms-in-use seems to be a more promising strategy in the new technological setting than attempting to reinforce the current legal framework. Moreover, such a strategy is less prone to committing the so-called ‘Nirvana fallacies’. As a secondary task, we try to cast some doubt on the two most common moral justifications of intellectual property as being able to ground the full extent of the current intellectual property regime. In line with recent developments in leadership research which conceptualise leadership as a discursive and collaborative process rather than a set of static attributes and characteristics displayed by individuals, this paper explores some of the discursive processes through which leadership emerges in a sports team. Drawing on over ten hours of naturally occurring interactions among the players of a women’s netball team in the UK, and applying the concepts of deontic and epistemic status and stance, we identify and describe some (...) of the specific processes through which leadership is claimed and assigned, as well as rejected, passed on, and eventually accepted by different team members at different points throughout an interaction. While the processes outlined in our analysis contribute to theoretical discussions regarding the notion of emergent leadership, this paper also demonstrates the benefits of taking a discourse analytical approach to leadership, and outlines how such an approach enables researchers to empirically capture emergent leadership in situ.
