This book provides an analysis of the debate surrounding cultural diversity, and attempts to reconcile the seemingly opposing views of "ethical imperialism," the belief that each individual is entitled to fundamental human rights, and cultural relativism, the belief that ethics must be relative to particular cultures and societies. The author examines the role of cultural tradition, often used as a defense against critical ethical judgments. Key issues in health and medicine are explored in the context of cultural diversity: (...) the physician-patient relationship, disclosing a diagnosis of a fatal illness, informed consent, brain death and organ transplantation, rituals surrounding birth and death, female genital mutilation, sex selection of offspring, fertility regulation, and biomedical research involving human subjects. Among the conclusions the author reaches are that ethical universals exist, but must not be confused with ethical absolutes. The existence of ethical universals is compatible with a variety of culturally relative interpretations, and some rights related to medicine and health care should be considered human rights. Illustrative examples are drawn from the author's experiences serving on international ethical review committees and her travels to countries in Africa, Asia, and Latin America, where she conducted educational workshops and carried out out her own research. Ruth Macklin's new book, AgainstRelativism, says in its subtitle that it intends to address cultural diversity and the search for ethical universals in medicine. This it does very well. Every chapter includes some discussion of cultural relativism, cultural anthropology, or postmodernism, and her analyses are acute and scathing. Macklin is unabashed in her defense of the principles of medical ethics, and she gives a strong argument that principles are essential elements of any ethical system that is to (...) successfully survive the skeptical doubts of relativism. The global turn in media ethics has presented a tough challenge for traditional models of moral theory: How do we assert common moral standards while also showing respect for the values of those from outside the Western tradition? The danger lies in advocating for either extreme: reason-dependent absolutism or cultural relativism. In this paper, I reject Cliff Christian’s attempts to solve the problem and propose instead a moral theory of universal standards that are discovered via a mix of rationally grounded (...) methods. Such universality refutes relativism but, because it is grounded in evolutionary naturalism and life-world philosophy—as opposed to a Kantian or theological transcendentalism—it also avoids absolutism. David Armstrong argues that necessitation relations among universals are the best explanation of some of our observations. If we consequently accept them into our ontologies, then we can justify induction, because these necessitation relations also have implications for the unobserved. By embracing Armstrongian universals, we can vindicate some of our strongest epistemological intuitions and answer the Problem of Induction. However, Armstrong’s reasoning has recently been challenged on a variety of grounds. Critics argue against both Armstrong’s usage of inference (...) to the best explanation and even whether, by Armstrong’s own standards, necessitation relations offer a potential explanation of this explanandum, let alone the best explanation. I defend Armstrong against these particular criticisms. Firstly, even though there are reasons to think that Armstrong’s justification fails as a self-contained defence of induction, it can usefully complement several other answers to Hume. Secondly, I argue that Armstrong’s reasoning is consistent with his own standards for explanation. (shrink)

This paper examines two contemporary answers to the question of whether moral values and norms are apt for rational criticism and justification: Richard Rorty’s radically contextualist approach—which is centered around the notion of contingency and is characterized by a dismissal of all claims to philosophical justification—and Karl-Otto Apel’s transcendental-pragmatic version of discourse ethics—which encompasses highly ambitious claims to justification and universal validity. The paper discusses some formal difficulties concerning the theory of universals of Trope-Only ontologies, from which the formal theory of predication advanced by Trope-Only theorists seems to be irremediably affected. It is impossible to lay out a successful defense of a Trope-Only theory without Russellian types, but such types are ontologically inconsistent with tropes’ nominalism. Historically, Tropists’ first way to avoid the problem is appealing to the supervenience claim, which however fails on its terms and, thus, fails as a (...) ground for a solution to the higher-order or ‘type’ problem. A later solution involves the invariance of primitive equivalence relations in order to make universals ontologically innocuous. However, I argue that this latter solution fails to meet the requirements imposed on an ontologically unbiased nominalist attitude. DARWIN’s (1859, 1871) discoveries have profound ethical implications that continue to be misrepresented and/or ignored. In contrast to socialdarwinistic misuses of his theory, Darwin was a great humanitarian who paved the way for an integrated scientific and ethical world view. As an ethical doctrine, socialdarwinism is long dead ever since its defeat by E. G. Moore although the socialdarwinistic thought is a hard-die in the biological community. The accusations of sociobiology for being socialdarwinistic are unfounded and stem (...) from the moralistic fallacy that is, a false assumption that morality is good by definition. Both social and developmental psychology demonstrate that the moral agency is a motivational device for executing reciprocity that remains at the core of any morality across all studied societies and throughout the ontogeny of moral judgment. The level of true universalizing ethical reflection (KOHLBERG’s postconvential stages or GIBBS’s existential phase) is achieved by a small minority of humans, thus showing that Homo sapiens is a moral but not an ethical animal. While the origin of reciprocity has been perfectly explained by sociobiology, the evolutionary assembly of affective and cognitive elements that make up the moral agency is being successfully studied by the social/personality/developmental psychology as extended to non-human primates. As DARWIN (1871) expected, the key innovation for the evolution of moral agency was the emergence of empathy that evolved independently at least three times: in elephants, dolphins and primates. Empathy has a motivational power of its own; it is also necessary for moral agency that requires two cognitive abilities: reflective self-consciousness and understanding of causality; the two make possible the attribution of responsibility. All these requirements are met by the chimpanzees whose moral agency operates in dyads. In contrast, the human moral agency allows for a third party intervention that opens up vast opportunities for ideologies, especially religions, to use and misuse the moral agency to enforce a reciprocation that may be harmful to both individuals and the entire group. Also, the moral agency is known to enforce enhanced intragroup cohesion and loyalty in response to conflict and war, which suggests that the two prima facie opposed human universals, morality and warfare, may have coevolved. The most important ethical consequence that follows from the increasing understanding of the primate moral agency is that every received morality is ethically flawed, none can be taken as a paragon of goodness, and each needs corrections by science-informed ethics. In fact, Darwin pioneered the integration of science and ethics, an approach that has come to be appreciated only recently under the heading of consilience. (shrink)

Current dogma holds that all cultures and moral values are conditional, nothing human is innate, and Einstein proved that the whole universe is "relative." Challenging this position, William Gairdner argues that relativism is not only logically and morally self-defeating but that progress in scientific and intellectual disciplines has actually strengthened the case for absolutes, universals, and constants of nature and human nature. Gairdner refutes the popular belief in cultural relativism by showing that there are hundreds of well-established cross-cultural "human (...) universals." He then discusses the many universals found in physics - as well as Einstein's personal regret at how his work was misinterpreted by the public's eagerness to promote relativism. Gairdner also gives a lively account of the many universals of human biology, including the controversial topic of universal gender differences or "brain sex." He then looks at universal concepts of both natural and international law, and ends by discussing language theory. He shows how philosophers from Nietzsche to Derrida have misused linguistic concepts to justify their relativism, even though a sustained and successful effort by serious scientists and philosophers of language has revealed myriad universals of human language, ranging from language acquisition, to word-order, to "Universal Grammar." To do minor activist research is to create and make use of critical neologistic vocabularies hopefully balancing the ascetic impoverishment of direction and syntax in majority vocabularies when conceptualized as universals. To do minor activist research is therefore to unsettle received discourses, narratives, and material social practices of power to develop means of resistance in new and different registers. To do minor activist research is to train the imagination for a collaboratively accomplished re/presentation of data through creating points of (...) encounters, thus engendering an affirmative perspectivist’s ethos. Re/presenting data as a space in which one’s own thinking is challenged, hence providing a perspective of the storying practices across participants and across different disciplinary, ideological, or personal boundaries within the researcher’s and the researched specific positioning. This requires getting everyone to participate in the “analysis” of data, and then getting everyone “inside” the text: situating data-inquiries in immanence. It therefore demands a liberation from old scripts, and challenges how everyone is transformed into text, with perspectivism being simultaneously means and objective for avoiding the reproduction of both old scripts and ethics. Our goal is to enhance (self)reflexivity regarding knowledge production and research methodologies, to influence actual research practices through fostering a more inclusive, open, and collaborative approach to research that transcends traditional boundaries and embraces the fluid and hybrid nature of knowledge production. Ultimately, turning the concept of ethics through minoring into a thinking hub and pedagogy for change. The first and theoretical section is on how to ethically represent data in a new-empiricist and post qualitative environment. We call it data-philosophy. Our ontological approach brings its own concepts, which reflect the perspectives from which we argue. In the three next sections, we follow up by looking more closely into these ideas in re/presenting empirical qualitative research to invite hybrid and fluid configurations. Here, activist research refers to bringing actors into our thinking about the data, to accentuate the collaborative, open to thinking differently through staying close to the data. We then bring it all together in a section on the rebirth of language, to open for what we refer to as a storying personifying, thereby storying data together as a process of becoming, of mutuality and affect as a source of agency. We argue that this creates a theory of science and ethics in data analysis, and in re/presenting data, which are closely entangled. (shrink)

This book is an exploration of the epistemological, metaphysical, and psychological foundations of the Nicomachean Ethics. In a striking reversal of current orthodoxy, Reeve argues that scientific knowledge (episteme) is possible in ethics, that dialectic and understanding (nous) play essentially the same role in ethics as in an Aristotelian science, and that the distinctive role of practical wisdom (phronesis) is to use the knowledge of universals provided by science, dialectic, and understanding so as to best promote happiness (eudaimonia) in (...) particular circumstances and to ensure a happy life. Turning to happiness itself, Reeves develops a new account of Aristotle's views on ends and functions, exposing their twofold nature. He argues that the activation of theoretical wisdom is primary happiness, and that the activation of practical wisdom--when it is for the sake of primary happiness--is happiness of a secondary kind. This article examines Richard Rorty's approach to the self in Contingency, Irony, and Solidarity . In spite of their differing philosophical bases, Rorty and Emmanuel Levinas converge methodologically in their treatments of the self by avoiding paradigmatic notions of human nature and a philosophical project of justification. Although Rorty refuses to prioritize a moralist account of the self over its romanticist rivals, his presentation relies on the reader's response to the ethical appeal of the other as depicted by Levinas: (...) Rorty ultimately de-divinizes the moralist self on an ethical basis. Finally, a Levinasian approach would supplement Rorty's view of the self by manifesting: concern for victims of de-moralization, greater appreciation for philosophical rationality and justification, and acceptance of self-critically executed paternalistic interventions. In addition, Rorty's mistrust of universals converges with Kant's apprehension that ethical universalization could treat human beings as less than ends in themselves. This paper focuses on the dynamics of ethical perspectives that embody the Golden Rule of Morality. Based on critical analysis of this rule in various cultural and religious contexts, but also from the perspective of humanism, the author presents its paradoxical character, the essence of which is interpreted here in terms of a pointer to metaphysical reality. It turns out that social conditionality, as well as the self-referential concept as a starting point of any ethical reasoning, are serious (...) epistemological challenges for the application of the Golden Rule in the position of universal normativity that this study addresses. On the other hand, Judeo-Christian cosmology and the related basis for ethical foundations is presented here as an inspirational space of ethical reasoning in which the paradoxical character of the Golden Rule becomes rather an indicator of a deeper metaethical interpretation of one's own particular ethical attitudes and outcomes than a practical guide to the discovery of ethical universals. As a result it iustified not only a historicist treatment but also a speculative discussion of its truth-content. These genuine philosophies may be nonetheless rooted in their own time as we all are, but in philosophy as in life (...) everybody is confronted with a decision whether he wants to be merely a part of history or whether he wants to have history, i.e. also to have the link with true being. Pareyson's theory of interpretation is specially tailored to the reconciliation of the multiplicity of philosophies and of the unity of philosophical thought, aiming at ontological truth. All philosophies are personal interpretations of the world, yet they have an indestructible content of ontological truth that surpasses their own time. We shall not err if we compare Pareyson's interpretation with what Joseph Scbelling called "intelektuelle Anschauung," i.e. the intuitive penetration of what he called the Absolute. Pareyson protests also against the claims of the humanistic sciences, such as sociology, anthropology and cultural history, to replace philosophy. All these sciences canhot replace the function of philosophy as described above. Pareyson uses a very illuminating metaphor: interpreting truth is like interpreting a musical score. While any such interpretation may be legitimate, all may be different and all are personal. But the musical score is always the same. It may be a myth that Plato wrote over the entrance to the Academy “Let no-one ignorant of geometry enter here.” But it is a well-chosen motto for his view in the Republic that mathematical training is especially productive of understanding in abstract realms, notably ethics. That view is sound and we should return to it. Ethical theory has been bedevilled by the idea that ethics is fundamentally about actions (right and wrong, rights, duties, virtues, dilemmas and so on). (...) That is an error like the one Plato mentions of thinking mathematics is about actions (of adding, constructing, extracting roots and so on). Mathematics is about eternal relations between universals, such as the ratio of the diagonal of a square to the side. Ethics too is about eternal verities, such as the equal worth of persons and just distributions. Mathematical and ethical verities do both constrain actions, such as the possibility of walking over the seven bridges of Königsberg once and once only or of justly discriminating between races. But they are not themselves about action. In principle, neither mathematical nor ethical verities are subject to historical forces or disagreement among tribes (though they can be better understood as time goes on). Plato is right: immersion in mathematics induces an understanding of the necessities underpinning reality, an understanding that is essential for distinguishing objective ethics from tribal custom. Rejecting current orthodoxy, this book argues that scientific-knowledge (episteme) is possible in ethics, that dialectic and understanding (nous) play essentially the same role in ethics as in an Aristotelian science, and that the distinctive role of practical wisdom (phronēsis) is to use the knowledge of universals provided by science, dialectic, and understanding so as best to promote happiness (eudaimonia) in particular circumstances and to (...) ensure a happy life. Turning to happiness itself, the book develops a new account of Aristotle's views on ends and functions, exposing their twofold nature. It argues that the activation of theoretical wisdom is primary happiness, and that the activation of practical wisdom — when it is for the sake of primary happiness — is happiness of a second kind. He concludes with an account of the virtues of character, external goods, and friends, and their place in the happy life. (shrink)

We survey the meta-ethical tools and institutional processes that traditional Islamic ethicists apply when deliberating on bioethical issues. We present a typology of these methodological elements, giving particular attention to the meta-ethical techniques and devices that traditional Islamic ethicists employ in the absence of decisive or univocal authoritative texts or in the absence of established transmitted cases. In describing how traditional Islamic ethicists work, we demonstrate that these experts possess a variety of discursive tools. We find that the (...) ethical responsa—i.e., the products of the application of the tools that we describe—are generally characterized by internal consistency. We also conclude that Islamic ethical reasoning on bioethical issues, while clearly scripture-based, is also characterized by strong consequentialist elements and possesses clear principles-based characteristics. The paper contributes to the study of bioethics by familiarizing non-specialists in Islamic ethics with the role, scope, and applicability of key Islamic ethical concepts, such as “aims” (maqāṣid), “universals” (kulliyyāt), “interest” (maṣlaḥa), “maxims” (qawā`id), “controls” (ḍawābit), “differentiators” (furūq), “preponderization” (tarjīḥ), and “extension” (tafrī`). Reviews show that comprehensive studies of international media ethics are necessarily incomplete because not all countries have either media codes or comparable measurement instruments. This article reviews major studies of international and national approaches to media ethics and describes contexts for global studies and comparisons. The three likely universals of truth, responsibility, and the drive for free expression are hypothesized, and codes are explored to see which patterns endured.

Political judgment is notoriously hard to theorise, and in the recent debates surrounding Habermas's discourse ethics we encounter classic disagreements around the nature, operation and validity of such judgments. This paper evaluates Habermas's account of political judgment and explores the problems raised by his critics. It then focuses on the contentious role played by universals within his account. What emerges is a reformulated theory of judgment based on the thin universalism of fair deliberation, and a description of a sub-set (...) of judgments, termed ``democratic judgments'', which are oriented to the preservation of democracy. Berkeley: University of California Press, 2002. 448 pp.Gananath Obeyesekere, professor emeritus of anthropology at Princeton University, is probably one of the world's greatest living anthropologists. The proof of that assertion lies in this his latest work on comparative anthropology, a study of (...) the concept and practice of rebirth—"reincarnation" as he calls it—from ancient Greece and India to modern West Africa, Melanesia, and North America. In what follows let me briefly set forth what I understand his central thesis to be, the evidence for it, and the conclusions to be drawn from it. I will end with two very modest problems connected with this altogether intriguing and brilliant investigation into the doctrine of rebirth.As a modified structural anthropologist, Gananath Obeyesekere rejects the rationalist model structuralism of Claude Levi-Strauss. He follows instead the lead of two of his empiricist predecessors, Max Weber and Fernand Braudel, pointing out that structures, types, or models "are constructions of scholars, not universals waiting to be discovered" (p. 351). Consequently, as this book aptly proves, Obeyesekere's own "imagined" models are based on parole data following the actual language of the cultures being studied.Obeyesekere thus begins his book with an elementary rebirth structure based on such parole. He refers to this primitive, first structure as "rebirth eschatology," which entails the rebirth of a deceased's soul into the body of a newborn relative of the deceased but without any determining ethical component as found in the more sophisticated and complex "karmic eschatologies." Such ethically neutral kin group rebirths are found among certain small-scale societies in West Africa, the Trobriand Islands, the Northwest American coast tribes, and the Inuits (Eskimos). Obeyesekere [End Page 303] draws extensively on field studies of these groups to bolster his conclusions about them. This simple rebirth eschatology is non-Indic in origin, Obeyesekere claims, since no evidence of influences have been found between these practitioners of rebirth eschatology and work relating to the Indic religions (Hinduism and Buddhism). The entry of the soul into postdeath life, either in this world or the world of the ancestors, depends not at all, consequently, on one's this-worldly behavior such that "morality does not affect the fate of the soul after death" (p. 74).Obeyesekere turns next to the "transformation" of this rebirth eschatology. It occurs with the introduction of the concept of ethicization, "the processes whereby morally right or wrong action becomes a religiously right or wrong action that in turn affects a person's destiny after death" (p. 75). It is Obeyesekere's contention that when ethicization is systematically introduced into any rebirth eschatology the latter must logically transform itself into a so-called "karmic eschatology." In other words, this second topological model or conceptual structure, karmic eschatology, the new ethicized rebirth eschatology, says that the otherworld for the dead is not simply a way station for departed souls waiting to be reborn, but rather that otherworld is now a place of retribution and punishment. Kinship affiliation alone no longer determines who goes where after death but moral action does. My own guess is that rebirth eschatology was introduced to answer the question of why the grandchild resembles the deceased grandparent. Karmic eschatology, on the other hand, was probably introduced to solve a more complex and sophisticated puzzle: Why is it, if there really is justice in the universe, that the wicked never get appropriately punished and the good never get sufficiently rewarded? At this stage of transformation, the law of karma, or some other principle of universal justice, now says that everyone gets what's coming to them, either in this life or the next, and that rebirth is necessary to make that principle of justice workable.1 In arguing that "rebirth cannot be divorced from ethics; it looks as if it is generated from ethics" (p. 82), Obeyesekere would seem to concur that karmic eschatology was introduced to answer the question: Why do the wicked seem to prosper and the good appear to suffer?Following... Like many disciplines, moral philosophy is being subjected to critical scrutiny by feminist scholars. By applying a feminist critique of gender to the area of ethics, feminists pose the question, “Does gender make a difference?” or “Is ethics gendered?” Given that gender differences exist, it stands to reason that these differences might be institutionalized at the level of theory. Given also that different theories highlight different properties of a moral problem, theories can be evaluated according to how well, or how (...) poorly they account for gendered perspectives. Such gender differences need not be explained essentialistically, but may be explained as the result of different socialization strategies and the different social, political and economic standing of men and women. This discussion has seen the revival of the issue over whether ethical theory ought primarily to reflect care or justice, with the former reflecting a consequentialist approach with emphasis on concrete particulars and sentiment, and the latter reflecting a nonconsequentialist approach with emphasis on abstract universals and reason.
