Cette dernière était parfaitement unifiée par la maximisation. Mais Simon pose les fondements de l’économie comportementale en critiquant précisément le concept néoclassique de rationalité et en suggérant que l’agent suit des modes de raisonnement alternatifs. Bien que Kahneman et Tversky proposent une typologie de ces modes de raisonnements, ils les réunifient (...) ultimement dans la théorie des perspectives cumulative. Nous nous appuyons sur la littérature en philosophie morale pour montrer le rôle complémentaire que jouent la rationalité et les affects dans la construction des jugements moraux et lors de la prise de décision. Les travaux récents en philosophie expérimentale confirment la dualité du processus de choix. Or, la philosophe américaine Sarah Conly refuse d'emprunter la voie de la sacralisation de l'autonomie. The present essay addresses the conceptual structure of customary law, understood as a set of customary rules. More specifically, it deals with the core question of what opinio juris entails as a constituent element of customary law. The work will begin with an analysis of samples of common strategies in contemporary legal theory that deal with opinio juris when analyzing the structure of customary law. Subsequently, following Hart’s notion about what constitutes social rules, and introducing explanatory features from Game Theory (...) applied to social philosophy and some insights from Behavioral Economics, the goal of the present study is to propose a different conceptual path for analyzing and identifying customary law with what could be understood as “opinio juris”, given the conceptual necessity of finding the normative element that lies within the usus, or social practices. « Je t’aime moi non plus », le titre de la fameuse chanson de Gainsbourg reflète de manière exquise ce que la vie a de beau et d’amer à la fois. A défaut de traiter d’amour, cet ouvrage analyse les méandres de l’aide à sens unique. L’altruisme, ce comportement de don sans attente de retour de service, est abordé ici de manière scientifique et philosophique plutôt que poétique et littéraire. Un objectif est d’en traquer les mécanismes sous-jacents, ceux qui échappent (...) à tout romantisme et se traduisent souvent en calculs de coûts et bénéfices. Il s’agit également d’approfondir les diverses manières de comprendre et de pratiquer l’altruisme. Souvent considéré comme une des plus grandes vertus humaines, l’objet de nombreux écrits philosophiques et psychologiques, l’altruisme peut-il se trouver chez les abeilles et les marmottes ? Posez la question à un biologiste de l’évolution et il vous répondra « Mais oui, évidemment ! ». A première vue, une telle réponse est consternante mais nous verrons qu’à y regarder de plus près, les philosophes et les biologistes ne parlent pas exactement de la même chose en utilisant le même terme. L’hétérogénéité des disciplines intéressées à l’altruisme et des contextes théoriques dans lesquels il est utilisé en ont fait une notion extrêmement complexe et difficile à saisir. Au sein des différentes sciences sociales et du vivant, l’altruisme est un élément pivot dans trois débats dont cet ouvrage prend le temps de retracer les contours. Tantôt, l’altruisme se profile en danger (apparent) pour la théorie de l’évolution darwinienne (chap. 1), tantôt, il sert de cheval de bataille dans la croisade contre l’idéal de l’homo economicus si souvent prôné en économie (chap. 2 et 3), tantôt il est une énigme à découvrir dans les méandres de nos motivations intimes (chap. 3). Dans le cadre de ces différents débats, la notion d’altruisme prend des significations sensiblement différentes. Pour en rendre compte, l’ensemble de l’ouvrage s’articule autour d’une triple distinction fondamentale : l’altruisme peut être compris au sens biologique, comportemental ou psychologique. Chacune de ces notions est utilisée dans un contexte spécifique au sein de sciences qui ont leurs propres traditions et leurs propres débats internes. La structure de l’ouvrage est organisée en fonction de cette triple distinction. Le premier chapitre est consacré à l’altruisme biologique, définit en termes de valeur de survie et de reproduction (fitness) : un comportement est altruiste s’il a pour effet d’augmenter la fitness d’autrui aux dépens de sa propre fitness. L’observation de comportements altruistes au sein du monde animal a posé un des plus grands défis à la théorie de l’évolution depuis la publication de l’Origine des espèces. Des générations de biologistes se sont attelés à la tâche d’expliquer comment un comportement qui augmente la fitness biologique d’autres organismes aux dépends de la fitness de l’agent a pu être sélectionnée au fil de l’évolution. Nous verrons que c’est grâce aux travaux de William Hamilton et d’autres que cette difficulté a pu être résolue. Le deuxième chapitre retrace les attaques d’une frange d’économistes (supportés dans leur effort critique par des théoriciens des jeux et anthropologues évolutionnistes), contre le modèle classique de l’homo economicus. Leur objectif est de montrer que des personnes ordinaires ne se comportement souvent pas en maximisateurs rationnels de leurs gains propres, comme le prédirait la théorie économique néo-classique. Dans le cadre de ce débat, c’est du comportement social spécifiquement humain et plus particulièrement de l’altruisme humain dont il est question. Le terme d’altruisme est alors utilisé dans un sens plus lâche que ne le font les biologistes ; ce que l’on appellera l’altruisme comportemental comprend les actions coûteuses pour l’agent et avantageuses pour autrui. La particularité humaine fournira également l’occasion de traiter la délicate question des rapports entre l’évolution génétique et la culture. Nous verrons que l’étude du comportement animal fournit les premiers éléments d’explication de l’altruisme humain, mais ce dernier ne peut être pleinement compris qu’au terme d’une analyse qui tient compte des capacités qui nous sont propres. Cette analyse nous permettra de saisir pourquoi les êtes humains sont à la fois plus sociaux et plus opportunistes (la contradiction n’est qu’apparente) que les autres espèces animales. Malgré leurs différences, les versions biologique et comportementale de l’altruisme sont très proches au sens où elles traitent des conséquences de comportements. Ces notions ne reflètent qu’imparfaitement la conception ordinaire que nous nous faisons de l’altruisme. L’altruisme tel qu’il est utilisé dans le langage courant correspond davantage à l’image que s’en font les philosophes et les psychologues. Pour déceler les actions altruistes, ces derniers se demandent généralement si elles ont été causées par un motif dirigé vers le bien d’autrui. En ce sens, on parle d’altruisme psychologique qui réfère aux causes plutôt qu’aux effets des actions d’aide. Le troisième chapitre est consacré aux débats qui font rage autour de la question de savoir si les êtres humains sont capables d’agir de manière altruiste psychologique, c’est-à-dire en fonction de motifs exclusivement dirigés vers le bien-être d’autrui. Nous verrons à quel point cette tâche est ardue à moins d’accepter de reformuler la question en termes de motivation primaire à l’action. Au terme de l’analyse, il apparaitra que les trois notions d’altruisme se croisent sans se recouper dans un enchevêtrement de liens plus ou moins complexes. Nous verrons par exemple que l’altruisme biologique (voire comportemental) pourrait bien être une condition nécessaire à l’évolution de l’altruisme psychologique ; des liens tangibles peut ainsi être tissés entre ces différentes notions. Les diverses approches du phénomène de l’altruisme retracées dans cet ouvrage fournissent également des clefs de compréhension des méandres du comportement social animal et plus particulièrement humain. De manière générale, sans apporter de solutions toutes faites, cet écrit peut servir de guide sémantique et initie le lecteur à une littérature interdisciplinaire émergeante, foisonnante, passionnante quoique encore souvent parsemée de confusions et de contradictions. Circular economy thinking has become the subject of academic enquiry across several disciplines recently. Yet whilst its technical and business angles are more widely discussed, its philosophical underpinnings and socio-economic implications are insufficiently investigated. In this article, we aim to contribute to their understanding by uncovering the circular economy role in shaping a new vision, highlighting the social and economic dimensions of future imaginaries and the mechanisms that can enable them to bring about change in the social context. We believe (...) that defining the vision that the circular economy is contributing to shape is key to explain its conceptual framework and activities. Drawing on the concept of fictional expectations, we uncover one of the plausible social dimensions inherent to the circular economy thinking thereby opening up a new perspective on the current debate in the circular economy literature wherein authors, by contrast, are emphasising the lack of an explicit social dimension. Fictional expectations are introduced to refer to those imaginaries of the future that can catalyse social action in the present and counteract societal addictions, in which modern society seems to be trapped. We show how a circular economy inspired vision can be instrumental to the emergence of a fictional expectation that can provide therapies to the current societal addiction of wasteful production and consumption systems. This philosophical background allows us to provide, in conclusion, a new conceptualisation of the circular economy as a cognitive framework instrumental to the emergence of a future imaginary. Before the Doi Moi reforms in 1986, Viet Nam’s economy was devastated by 30 years of warfare with two major military powers, France and the US, ending in 1975. In the subsequent 10 years, Viet Nam suffered from failing economic experiments, including agricultural cooperatization, “industry-commerce rehabilitation,” price-wage-currency reform, among others, under the centrally planned mechanism (Wood 1989), as well as the international isolation and a US trade embargo when its troops entered Cambodia to overthrow the Khmer Rouge (Riedel and Turley (...) 1999). We argue that the economy of nature constitutes an invocation of structure in the biological sciences, one largely missed by philosophers of biology despite the turn in recent years toward structural explanations throughout the philosophy of science. We trace a portion of the history of this concept, beginning with the theologically and economically grounded work of Linnaeus, moving through Darwin’s adaptation of the economy of nature and its reconstitution in genetic terms during the first decades of the Modern Synthesis. What (...) this historical case study reveals, we argue, is a window into the shifting landscape of the explanatory and ontic uses of structural concepts. In Linnaeus, the economy of nature has both ontic and explanatory import; in Darwin the ontic and explanatory aspects start to come apart ; and finally, in the Modern Synthesis, the economy of nature is replaced by the conceptual toolkit of population genetics, the structural elements of which are nearly entirely explanatory. Having traced a historical trajectory of structural concepts that moves from an ontic formulation to an increasingly explanatory one, we conclude by outlining some insights for structural realism. In the following pages we discuss three historical cases of moral economies in science: Drosophila genetics, late twentieth century American astronomy, and collaborations between American drug companies and medical scientists in the interwar years. An examination of the most striking differences and similarities between these examples, and the conflicts internal to them, reveals constitutive features of moral economies, and the ways in which they are formed, negotiated, and altered. We critically evaluate these three examples through the filters of rational choice, (...) utility, and American pragmatism, using the latter to support the conclusion that there is no single vision of moral economies in science and no single theory—moral, political, social—that will explain them. These filters may not be the only means through which to evaluate the moral economies examined, but aspects of each appear prominent in all three cases. In addition, explanations for decisions are often given in the language of these theories, both at the macro (policy) level and at the local level of the moral economies we discuss. In light of such factors, the use of these frameworks seems justified. We begin with an attempt to define the nature of moral economies, then move to a consideration of scientific communities as moral communities operating within material and other constraints which we relate to wider questions of political economy and societal accountabilities. The transition economy of Vietnam enjoyed remarkable achievements in the first 20 years of economic renovation (Doi Moi) from 1986 to 2006. Notably, the economy grew at an average annual rate of 7.5% in 1991-2000 period. Vietnam’s Amended Constitution 1992 recognized the role of private sector in the economy. U.S.-Vietnam Trade Bilateral Agreement (US-BTA) was signed in 2001. The country's stock market made debut trading in 2000. Vietnam became a member of Association of Southeast Asian Nations (ASEAN) in 1995, then (...) proceeded to full membership of the World Trade Organization in 2007, following which registered foreign direct investment (FDI) reached an all-time high of US$71.7 billion in 2008. Together with the impressive economic achievements, Vietnam also saw its diplomatic and political status constantly improved in the international arena. The country has established diplomatic relations with more than 170 countries in the world, strategic partnerships with 12 important economies, both developed and emerging, namely China, Japan, Russia, India, England, France, North Korea, Italy, Germany, Indonesia, Malaysia and Thailand. ‘Moral economy’ has become a popular concept in empirical research in disciplines such as history, anthropology, sociology and political science. This research utilizes normative concepts and has obvious normative implications and relevance. However, there has been little to no dialogue between this research and philosophers working on normative ethics. The present article seeks to remedy this situation by highlighting fertile points of dialogue between descriptive and normative ethicists. The proposition is that empirical researchers can become more precise and stringent in (...) their descriptions of moral attitudes and traditions with a greater understanding of normative ethics; and, at the same time, philosophers have much to gain from a closer examination of the realities of moral thinking and social action. In this article, we address why our management of the economy, community and business has led to global warming and we discuss the importance of worldviews, ontology, epistemology and axiology in the search for alternative paths of development. We do this by focusing on the concept of Circular Economy. Circular Economy is often presented as a solution to the problems of a globalized economy in the form of over-exploitation of resources, climate change and pollution of the environment. Within the mainstream (...) economics paradigm, the aim is how to increase the effectiveness of resource extraction and utilization in order to maintain growth. We contrast this with the paradigm of Ecological Economics where the goal of the economy is to achieve and secure a higher quality of life. Circular Economy often side steps the deep ontological and epistemological questions we need to answer if we are to address the complex and interrelated environmental, economic and social problems we face today. This can be a limiting factor in the search for creative and long-term solutions. However, within the Circular Economy discourse, we find strands that critically engage with the foundations of mainstream Economics and so, innovative solutions for the society of the future are a possibility. We argue that to bring about a lasting solution to the interconnected social, economic and environmental problems, Circular Economy must engage with the ontological, epistemological and axiological foundations of mainstream economics. To further this argument, we apply Imre Lakatos’ ‘research program’ model to philosophy of science as our framework of analysis and draw lessons for business and communities. (shrink)

Mill and Charles Dickens' engagement with mid-Victorian dualities; Keynesianism and Mrs Dalloway's exploration of post-war consumer impulses; the a/moralistic discourses of Friedrich von Hayek, and Ayn Rand's Atlas Shrugged; and finally the virtual crises of the twenty-first century financial market and Don DeLillo's Cosmopolis. Through its sustained comparative analysis of literary and economic discourses, this book transforms our understanding of the genre of the novel and offers critical new understandings of literary value, cultural capital and the moral foundations of political economy. Since independence in 1922, the Irish economy has gone from being one of the poorest in Europe in the 1980s to double-figure growth rates in the 1990s, prompting comparisons with the “tiger” economies of the Pacific Rim. Opinions vary about the extent to which this growth is sustainable and whether it has alleviated poverty, increased inequality, or indeed done both. This paper argues that Milonakis and Fine, in their bookFrom Political Economy to Economics, offer an account of history that systematically omits discussion of how economics has been shaped by the political and social context in which it developed. This contrasts with work by intellectual historians who have argued that such factors were crucial to understanding the history of economic ideas. It is ironic given that Milonakis and Fine are criticising economists for excluding the political and the social from economics.

Mark Sagoff draws on the last twenty years of debate over the foundations of environmentalism in this comprehensive revision of The Economy of the Earth. Posing questions pertinent to consumption, cost-benefit analysis, the normative implications of neo-Darwinism, the role of the natural in national history, and the centrality of the concept of place in environmental ethics, he analyses social policy in relation to the environment, pollution, the workplace, and public safely and health. This book proposes, from a civil perspective —such as that developed by Stefano Zamagni— and a cordial perspective —such as that developed by Adela Cortina—, orientations to design an economy in tune with what the historical moment demands. Among other things, this comes from encouraging institutions, organisations and companies to include in their designs aspects as important for carrying out their activities as cordial reciprocity, mutual recognition of the communicative and affective capacities of the linked or linkable parties, public commitment (...) and the active participation of civil society. The book first shows the conceptualisation of the process of self-interest as operating for one’s own benefit and its inclusion in the orthodox economic model. In Chapter 2 it then displays some of the logical/formal and experimental limits of the axiomatic economics model to discover the possibility of building bridges between theoretical modelling and factual validation. Chapter 3 demonstrates the fragility of a rationality model based on the paradigmatic figure of homo oeconomicus. Chapter 4 reflects on the critical process that has identified reciprocity as a determining factor for human cooperation, turning this behaviour into a paradox in which the lack of a reasonable explanation from the selfish perspective becomes inconsistent in the predominant economic theory. Chapter 5 is from a moral point of view it describes and criticises the different approaches to reciprocity observed by sociologists, biologists, psychologists and economists. Chapter 6 analyses three mutual recognition proposals as possible foundations for human cooperation, highlighting one of them –cordial recognition, developed by Cortina– because it is more closely related to studies of reciprocity, particularly the most recent contributions from the neurosciences. Chapter 7 proposes cordial reciprocity as a horizon of meaning for the various approaches to reciprocity observed. Chapter 8 explores the possible emergence and development of cordial goods, a type of relational and communicative good that enables joint actions to take place in different contexts of human activity. Chapter 9 analyses the application and implementation of cordial reciprocity at the macro, meso and micro levels of the economy. And finally, it proposes guidelines for designing a monitoring and compliance system which, based on the communication, storage and processing of big data and the committed participation of stakeholders, offers businesses the possibility of inspecting their underlying dimensions of morality, emotions and responsibility.
