In the wake of globalisation, we have witnessed the rise of the transnational corporation—powerful, new players in an international human rights system ill-equipped to handle the challenge. Despite the best efforts of the United Nations, international treaties and human rights lawyers the world over, there is simply no mandatory international code of corporate conduct targeting human rights practices. Enter the Alien Tort Claims Act (ATCA), a once-obscure U.S. statute that provides a private cause of action for violations of international human (...) rights law committed by governmental and non-governmental actors. This paper will examine recent ATCA jurisprudence, the landmark Unocal settlement, and the ATCA’s role in reining in Yahoo! Cybercrime in Nigeria is largely perpetrated by young people and students in tertiary institutions, and are socially tagged yahoo yahoo or yahoo boys. Yahoo boys rely on their computer dexterity to victimise unsuspecting persons in cyberspace. A new phenomenon in cybercrime is mixing spiritual elements with internet surfing to boost cybercrime success rates. This paper examines the factors underlying this spiritual dimension (cyber spiritualism) to cybercrime, and discusses some of the strategies employed in perpetuating cyber crime. Using Space Transition Theory (...) of cybercrime, data were generated on yahoo boys and those involved in yahoo plus. The clampdown on Internet fraudsters by the Economic and Financial Crimes Commission (EFCC), in-group conflict among yahoo boys over social recognition, reduced victimisation and delayed success, and mass media enlightenment were reported factors influencing the fusion of spiritual elements in cyber crime. The methods used include ase or mayehun (incontrovertible order), charmed or magical rings (oruka-ere) and incisions made around the wrist, which are used to surf the net, while ijapa (tortoise) is used to navigate profitable sites. Unsuspecting victims fall under the spell of the ase via phone conversation where spiritual orders are made to the victims without their objecting. (shrink)

This study sets out to examine the ways Nigerian cyber-fraudsters (Yahoo-Boys) are represented in hip-hop music. The empirical basis of this article is lyrics from 18 hip-hop artists, which were subjected to a directed approach to qualitative content analysis and coded based on the moral disengagement mechanisms proposed by Bandura (1999). While results revealed that the ethics of Yahoo-Boys, as expressed by musicians, embody a range of moral disengagement mechanisms, they also shed light on the motives for the Nigerian cybercriminals' (...) actions. Further analysis revealed additional findings: “glamorization/de-glamorization of cyber-fraud” and “sex-roles-and-cultures”. Having operated within the constraint of what is currently available (a small sample size), this article has drawn attention to the notion that Yahoo-Boys and some musicians may be “birds of a feather.” Secondly, it has exposed a “hunter-and-antelope-relationship” between Yahoo-Boys and their victims. Thirdly, it has also highlighted that some ethos of law-abiding citizens is central to Yahoo-Boys’ moral enterprise. Yahoo-Boys, therefore, represent reflections of society. Arguably, given that Yahoo-Boys and singers are connected, and the oratory messages of singers may attract more followers than questioners, this study illuminates the cultural dimensions of cyber-fraud that emanate from Nigeria. In particular, insights from this study suggest that cyber-fraud researchers might look beyond traditional data sources (e.g., cyber-fraud statistics) for the empirical traces of “culture in action” that render fraudulently practices acceptable career paths for some Nigerian youths. In the late 1990s, the Internet seemed a perfect medium for business: a facilitator of unlimited economical propositions to people without any regulatory limitations. Cases such as that of Yahoo! mark the beginning of the end of that illusion. They demonstrate that Internet service providers (ISPs) have to respect domestic state legislation in order to avoid legal risks. Yahoo! was wrong to ignore French national laws and the plea to remove Nazi memorabilia from its auction site. Its legal struggle proved (...) futile and may have harmed its business. This essay argues for the adoption of standards of corporate social responsibility (CSR). CSR considerations may trump some forms of antisocial, highly offensive expression. (shrink)

This article is about the manifestations of similarities between two seemingly distinct groups of Nigerians: cybercriminals and politicians. Which linguistic strategies do Twitter users use to express their opinions on cybercriminals and politicians? The study undertakes a qualitative analysis of ‘engaged’ tweets of an elite law enforcement agency in West Africa. We analyzed and coded over 100,000 ‘engaged’ tweets based on a component of mechanisms of moral disengagement (i.e., advantageous comparison), a linguistic device. The results reveal how respondents defend the (...) actions of online fraudsters (“the deviant group”) by strategically comparing them to the wrongful acts of corrupt politicians (“the respectable group”). Similarly, the results show how respondents positioned this linguistic strategy to compare “the powerless group” (online fraudsters) and “the powerful group” (politicians) in society. Indeed, tweet responses suggest that the Economic and Financial Crimes Commission (EFCC) generally looks downwards for culprits (i.e., online fraudsters) while ignoring fraudulent politicians. We conclude that the process by which some actions are interpreted as a crime compared to others is a moral enterprise. (shrink)

The article is based on lyrics from 2007 to 2017 involving 18 hip-hop artists. All the songs I studied were by male singers apart from one entitled, “Maga no need pay,” which involved seven multiple artists. In all the songs, the glamorization of cybercrime and cybercriminals was one of the most significant themes. The implications are discussed.

A prolonged confrontation between Yahoo! Inc. and French activists who demand the removal of Nazi items from auction sites as well as restricted access to neo-Nazis sites is described and analyzed. We present the case up to the decision of Yahoo! Inc. to remove the items from yahoo.com following a French court's verdict against the firm. Using a business ethics approach, we distinguish legal, technical, philosophical and managerial issues involved in the case and their management by Yahoo! We conclude on (...) the difficulty of governing relations with society from corporate and legal affairs departments at the headquarters level, and on the clash of two visions over the regulation of social freedom. This article is a theoretical treatment of the ways in which local worldviews on wealth acquisition give rise to contemporary manifestations of spirituality in cyberspace. It unpacks spiritual (occult) economies and wealth generation through a historical perspective. The article ‘devil advocates’ the ‘sainthood’ of claimed law-abiding citizens, by highlighting that the line dividing them and the Nigerian cybercriminals (Yahoo-Boys) is blurred with regards to the use of magical means for material ends. By doing so, the article also illustrates that the (...) intersectionality of the spirit world and the acquisition of wealth (crime or otherwise) is connected with local epistemologies and worldviews, and its contemporaneity has social security benefits. Therefore, the view that the contemporary manifestations of spirituality in cyberspace signify a ‘new-danger’ and an ever-increasing outrage in the Nigerian society is misplaced. I conclude that if people believe all aspects of life are reflective of the spiritual world and determined by it, the spiritual realm, by implication, is the base of society, upon which sits the superstructure comprised of all aspects of life, especially wealth. Inferentially, this conceptual position that the spirit world is the base of society is an inversion of Orthodox Marxist’s theory of economic determinism. (shrink)

This thesis, which is based on six peer-reviewed publications, is a theoretical and qualitative treatment of the ways in which social and contextual factors serve as a resource for understanding the particularities of ‘cybercrime’ that emanates from Nigeria. The thesis illuminates how closer attention to Nigerian society aids the understanding of Nigerian cybercriminals (known as Yahoo Boys), their actions and what constitutes ‘cybercrime’ in a Nigerian context. ‘Cybercrime’ is used in everyday parlance as a simple acronym for all forms of (...) crimes on the internet, whereas ‘cybercrime’ in a Nigerian context is rooted in socioeconomics and determined by it. In particular, the defrauding of victims for monetary benefit is the most significant theme that emerged from the analysis of Yahoo Boys. While all six publications are situated at the intersections of multiple fields of study, they all share a common endorsement of the constructionist/interpretivist position. The six published works comprise: [a] three conceptual publications; and [b] three empirical publications. The conceptual publications deconstruct the meanings of multiple taken-for-granted concepts in cybercrime scholarship and develop more robust conceptual lenses, namely: (1) ‘Digital Spiritualization’; (2) ‘The Tripartite Cybercrime Framework – TCF’; and (3) ‘The Synergy between Feminist Criminology and the TCF’. These new conceptual lenses represent the candidate’s contribution to developing theory in the field. Alongside this, the empirical section includes three sets of qualitative data, which include: (1) interviews with seventeen Nigerian parents; (2) lyrics from eighteen Nigerian musicians; and (3) interviews with forty Nigerian law enforcement officers. These diverse sources of qualitative data provide a more fully-developed understanding of ‘cybercrime’ in the Nigerian context (and elsewhere). All six-published works, while individually contributing to knowledge, collectively shed clearer light on the centrality of cultural context in the explanation of ‘cybercrime’. (shrink)

While this article sets out to advance our knowledge about the characteristics of Nigerian cybercriminals (Yahoo-Boys), it is also the first study to explore the narratives of the Economic and Financial Crimes Commission (EFCC) officers concerning them. It appraises symbolic interactionist insights to consider the ways in which contextual factors and worldview may help to illuminate officers’ narratives of cybercriminals and the interpretations and implications of such accounts. Semi-structured interviews of forty frontline EFCC officers formed the empirical basis of this (...) study and were subjected to a directed approach of qualitative content analysis. While prior studies, for example, indicated that only a group of cybercriminals deploy spiritual and magical powers to defraud victims (i.e. modus operandi), our data analysis extended this classification into more refined levels involving multiple features. In particular, analysis bifurcates cybercriminals and their operations based on three factors: [a] educational-attainment, [b] modus-operandi, and [c] networks-collaborators. Results also suggest that these cybercriminals and their operations are embedded in “masculinity-and-material-wealth”. These contributions thus have implications for a range of generally accepted viewpoints about these cybercriminals previously taken-for-granted. Since these criminals have victims all over the world, insights from our study may help various local and international agencies [a] to understand the actions/features of these two groups of cybercriminals better and develop more effective response strategies. Management practitioners and scholars have worked diligently to identify methods for ethical decision making in international contexts. Theoretical frameworks such as Integrative Social Contracts Theory (Donaldson and Dunfee, 1994, Academy of Management Review 19, 252–284) and more recently the Global Business Citizenship Approach [Wood et al., 2006, Global Business Citizenship: A Transformative Framework for Ethics and Sustainable Capitalism. (M. E. Sharpe, Armonk, NY)] have produced innovations in practice. Despite these advances, many managers have difficulty implementing these theoretical concepts in daily (...) practice. Using the example of recent decisions by internet service providers Google, Yahoo, and MSN regarding censorship requirements in China, we offer six heuristic questions to help managers to resolve cross-cultural ethical conflicts in which the firm’s way of doing business differs from the practice in the host country. Recognizing that companies can take different approaches to law and ethics (Paine, 1994, Harvard Business Review 72(2), 107–117), our aim is to provide a management decision process to deal with demands or opportunities for engaging in questionable business practices in a host country. SCHNALL According to David Hume, we believe in the existence of an external world because of the phenomena of constancy and coherence (T 1.4.2.18-43; SBN 194-210).1 Hume delineated these two aspects of our sensory experience, and claimed that they influence the imagination in such a way as to generate belief in the existence (...) of unperceived objects, independent of the mind. There is disagreement among philosophers as to the proper way to characterize constancy and coherence and the ways in which they respectively lead us to believe in external objects. The most straightforward account of coherence seems to make it the same as Hume's concept of causality. Yet Hume denies that they are the same ; and commentators disagree as to how to understand Hume's distinction between the two. As to constancy, many philosophers, following H.H. Price,2 have argued that it is really just a special case of coherence, and that its role in generating belief in external objects is the same as that of coherence. There is consequent puzzlement as to why Hume attributed a different, and more important, role to constancy. In an important recent book, Louis E. Loeb has proposed a very interesting two-part solution to this last puzzle: First, Hume is convinced that the commonsense view of the external world is patently false; so he cannot allow that it results from something as reasonable as causal inference. But the way coherence leads to belief in external objects is a form of causal inference. So, Hume wants constancy to lead to belief in external objects in a different, less reasonable way; and he wants constancy to be more important than coherence in leading to belief in the external world. Second, Hume did not realize that constancy is simply a special case of coherence (or causality), because of certain assumptions about causality that he Ira M. After introducing some basic terms, including 'constancy' and 'coherence' themselves (in section I), I will discuss the proper characterization of coherence and how it differs from causality (section II). Then I will discuss Hume's account of constancy and how it leads to belief in external obj ects; and I will contrast it with the alternative account, referred to above, that is widely held to be preferable (section III). This study interrogates narrow-mindedness and laziness leading many of the Nigerian undergraduates to be tempted to cheat and fraud on Internet instead of working hard for their studies. The author proposes a contextual survey around a tendency also called “yahooism”, “yahoo-yahooism”, as most of the first attempted cybercrimes were realized by sending yahoo emails. This harmful tendency is contrasted with Prof Obiora Ike’s teaching on the value of hard work as the road to wealth. The study used the quantitative survey (...) method of 372 undergraduates from two purposively selected higher in-stitutions in Nigeria, namely: Edo State University Uzairue and Federal Polytechnic Auchi, both in Etsako West Local Government Area of Edo State, Nigeria. Do people share their feelings of guilt with others and, if so, what are the reasons for doing this or not doing this? Even though the social sharing of negative emotional experiences, such as regret, has been extensively studied, not much is known about whether people share feelings of guilt and why. We report three studies exploring these questions. In Study 1, we re-analysed data about sharing guilt experiences posted on a social website called “Yahoo Answers”, and found that people (...) share intrapersonal as well as interpersonal guilt experiences with others online. Study 2 found that the main motivations of sharing guilt (compared with the sharing of regret) were “venting”, “clarification and meaning”, and “gaining advice”. Study 3 found that people were more likely to share experiences of interpersonal guilt and more likely to keep experiences of intrapersonal guilt to themselves. Together, these studies contribute to a further understanding of the social sharing of the emotion guilt. (shrink)

It looks at the major actors – such as Facebook, Google, Twitter, and Yahoo! – and their significant influence on the informational environment and users’ interactions within it, as well as the responsibilities and liabilities such influence entails. OSPs as information gatekeepers and how they have gone from offering connecting and information-sharing services to paying members to providing open, free infrastructure and applications that facilitate digital expression and the communication of information. The book seeks consensus on the principles that should shape OSPs’ responsibilities and practices, taking into account business ethics and policies. This research article examines the increasing spate of youths who engage in fraudulent Internet activities in Nigeria in the light of Proverbs 4:10–19. Nigerian youths are fast becoming impatient with their quest for wealth. This had led many of them to engage in high-level fraudulent Internet activities. It has come to a point where Internet fraudsters opened schools to teach prospecting youths how to make money fast. The circle keeps expanding on a daily basis. Their victims include the rich, the (...) poor and unsuspecting foreigners. The study findings revealed that the spate of Internet fraud has continued to increase because more youths are willing to engage in such activities and other cybercrimes to make fast wealth, so that they can feel pride among other youths and the society. Proverbs 4:10–19 provide a lucid response to this sad development. Contribution: In the light of Proverbs 4:10–19, Nigerian youths are advised not to join evildoers because their path of wickedness ends in darkness and unhappiness. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:Spiritually Bilingual:Buddhist Christians and the Process of Dual Religious BelongingJonathan HomrighausenSociologists studying convert Buddhism in America have found that a surprisingly large number of Buddhists also identify as Christian.1 However, little empirical literature examines these Buddhist-Christian “dual religious belongers.”2 This study aims to fill that gap. Based on extensive interviews with eight self-identified “Buddhist Christians” of varying levels of doctrinal and experiential understanding, this study examines the conversion process (...) of these dual belongers and how they combine these religious traditions. Building on Michael von Brück’s contention that one’s first religion is like a mother tongue, I compare taking on a second religious tradition to learning a second language.3 As practitioners become more “fluent” in the second religion, they differentiate the two religions more clearly while combining them more seamlessly in their daily lives.methodologyThis study employs grounded theory and a qualitative, inductive methodology. Grounded theory is designed to elucidate the dynamic changes involved in a social process, with rich descriptions of categories and explanations for variations between different people’s experiences.4 While the use of qualitative methods with a small sample size means that my results have little statistical significance, such methods have been used in recent research on conversion and dual belonging and yield deep theoretical insight.5Eight participants for this study were solicited via word of mouth, personal acquaintance, and posting in a Buddhist-Christian Yahoo Group. In particular, I focused on Buddhist-Catholic practitioners to limit my sample group. Interviews were conducted and recorded in person or on the phone over a three-month period in fall, 2011. Interviews were open-ended, each lasting from sixty to ninety minutes. Several participants later received a draft of the paper to ensure they felt adequately represented; five participants responded. To complement these interviews, I also incorporate written accounts of Buddhist-Christian conversion from both Catholic and Protestant authors.6participants’ backgroundsIt can be difficult to define Buddhist identity in the West, as many people who regularly practice meditation in a sangha do not self-identify as Buddhist.7 This study focuses on those who both practice Buddhist and Christian spirituality and belong to religious groups of both traditions. The eight participants have a range of religious expertise and commitment to both traditions. In terms of Catholic identity, six are laypeople (one in a secular religious order), one a priest, and one a nun. Three participants are theology professors. Seven have been Catholics from birth. One spent a decade living in a Buddhist monastery, two of them are roshis, and five give Buddhist teaching or meditation instruction formally. Seven of them practice various forms of Ch’an or Zen, while one practices Tibetan Buddhism.Cathy went not from Catholicism to Buddhism, but from Buddhism to Catholicism. A former Mormon and Unitarian, she began learning meditation at a Ch’an temple. This Ch’an temple normally only reached out to the Chinese community, but there was a Taiwanese nun there who wanted to reach out to non-Chinese community members. After practicing there for a few years, Cathy moved to another location, where she could not find any sangha that fit her needs. After attending Mass with a friend, she decided to become Catholic because she needed a community. It was not a hard transition for Cathy, who described feeling in meditation “some kind of entity, whether you call it God or Creator or atomic process.” She was confirmed as a Catholic in 2011.Rachel has been a nun for fifty years and a practicing Zen Buddhist for thirty, ten of those years living and working in a Zen monastery in the mountains of California. She described feeling an emptiness in her faith, a lack of practical knowledge of how to attain the spiritual goals that her Catholic tradition had for her. After hearing Zen teacher Cheri Huber speak at a conference, she took Huber on as her teacher. She has facilitated meditation workshops for many years. How do tweets reflect the long-standing disparities between the northern and southern regions of Nigeria? This study presents a qualitative analysis of Twitter users' responses (n = 101,518) to the tweets of the Economic and Financial Crimes Commission (EFCC) regarding the production and prosecution of cybercrime. The article uses postcolonial perspectives to shed light on the legacies of British colonial efforts in Nigeria, such as the amalgamation of the northern and southern protectorates in 1914. The results revealed significant discrepancies between (...) Nigeria's northern and southern regions regarding cybercriminal arrest, conviction, and sentencing. Specifically, the results showed that the EFCC's criminalization of Southerners differs substantially from that of Northerners. The contemporary manifestation of inequalities concerning the production and prosecution of cybercrime on Twitter reflects long-standing contestations (e.g., economic, political, cultural, geological) between the northern and southern parts of Nigerian society. Therefore, since the North-South divide in present-day Nigeria originated from British colonization, colonialism is the base that shaped the superstructure comprising political, religious, historical, geological (e.g., crude oil), and economic factors. In turn, the article spotlights that regional differences in educational attainment, originating from differing experiences of Christianization and colonization, interact with regional disparities in the production of cybercrime. More research is required to better understand how these contextual disparities in society interact with the production and prosecution of cybercrime, given that Nigerian cybercriminals defraud victims all over the world. How do hip-hop songs produced from 2017 to 2023 depict and rationalize online fraud? This study examines the depiction of online fraudsters in thirty-three Nigerian hip-hop songs on nine popular streaming platforms such as Spotify, Deezer, iTunes, SoundCloud, Apple Music, and YouTube. Using a directed approach to qualitative content analysis, we coded lyrics based on the moral disengagement mechanism and core themes derived from existing literature. Our findings shed light on how songs (a) justify the fraudulent actions of online fraudsters, (...) (b) blame and dehumanize victims of online romance fraud, (c) glamorize online fraud, and (d) provide insights into prevailing attitudes, indigenous linguistics, and worldviews regarding cybercrime victimization. Specifically, our analysis shows the presence of moral disengagement mechanisms, including "dehumanization," “minimizing own agency,” and "displacement of responsibility." Moreover, we identify core contextual themes pertinent to online fraud in the Nigerian context: (a) "cyber spiritualism" and (b) "the North-South divide." This research underscores the global influence of musicians whose songs are easily accessible on diverse music platforms in trivializing the plight of online fraud victims. We argue that these artists' persuasive messages not only downplay but also satirize the victims' predicaments, thus contributing to the cultural worldviews and dimensions of online fraud. We conclude by underscoring these songs' capacity to actualize, reshape, and actively engage with the narratives of glamorization, justification, spiritualism, colonial legacies, gender dynamics, and societal implications. We recommend that future research endeavors explore non-conventional data sources adept at capturing the intricate fabric of cultural attitudes and dynamics. (shrink)
