Italian Constitutional Justice in Global Context is the first book ever published in English to provide an international examination of the Italian Constitutional Court, offering a comprehensive analysis of its principal lines of jurisprudence, historical origins, organization, procedures, and its current engagement with transnational European law. The ItCC represents one of the strongest and most successful examples of constitutional judicial review, and is distinctive in its structure, institutional dimensions, and well-developed jurisprudence. Moreover, the ItCC has developed a distinctive voice among (...) global constitutional actors in its adjudication of a broad range of topics from fundamental rights and liberties to the allocations of governmental power and regionalism. Nevertheless, in global constitutional dialog, the voice of the ItCC has been almost entirely absent due to a relative lack of both English translations of its decisions and of focused scholarly commentary in English.This book describes the "Italian Style" in global constitutional adjudication, and aims to elevate Italian constitutional jurisprudence to an active participant role in global constitutional discourse. The authors have carefully structured the work to allow the ItCC's own voice to emerge. It presents broad syntheses of major areas of the Court's case law, provides excerpts from notable decisions in a narrative and analytical context, addresses the tension between the ItCC and the Court of Cassation, and positions the development, character, and importance of the ItCC's jurisprudence in the larger arc of global judicial dialog. Adult humans show exceptional relational ability relative to other species. In this research, we trace the development of this ability in young children. We used a task widely used in comparative research—the relational match-to-sample task, which requires participants to notice and match the identity relation: for example, AA should match BB instead of CD. Despite the simplicity of this relation, children under 4 years of age failed to pass this test (Experiment 1), and their performance did not improve even with (...) initial feedback (Experiment 2). In Experiments 3 and 4, we found that two kinds of symbolic-linguistic experience can facilitate relational reasoning in young children. Our findings suggest that children learn to become adept analogical thinkers, and that language fosters this learning in at least two distinct ways. (shrink)

In this paper I discuss Elias Ashmole’s collections and views about John Dee. I consider Dee as an object of collection against the broader background of Ashmole’s collecting practices. I also look at the uses to which Ashmole put some of his collections relating to Dee, as well as those which he envisaged for posterity. I argue that Ashmole’s interest in Dee stemmed from his ideas about the uses of antiquity in the reconstruction and transmission of knowledge. They partly reflected (...) Ashmole’s interpretation of Francis Bacon’s Advancement of learning as well as the influence of William Backhouse and William Oughtred’s ideas about publishing natural philosophy in English. IntroductionConcussion is a growing public health concern. No uniformly established therapy exists; neurofeedback studies report treatment value. We use infralow frequency neuromodulation to remediate disabling neurological symptoms caused by traumatic brain injury and noted improved outcomes with a novel concussion protocol. Postconcussion symptoms and persistent postconcussion symptoms are designated timelines for protracted neurological complaints following TBI. We performed a retrospective study to explore effectiveness of ILF in PCS/PPCS and investigated the value of using this concussion protocol.MethodPatients with PCS/PPCS seen for (...) their first neurology office visit or received their first neurofeedback session between 1 August 2018 and 31 January 2021 were entered. Outcomes were compared following treatment as usual vs. TAU with ILF neurotherapy. The study cohort was limited to PPCS patients; the TAU+ILF group was restricted further to PPCS patients receiving at least 10 neurotherapy sessions. Within the TAU+ILF group, comparisons were made between those who trained at least 10 sessions using concussion protocol and those who trained for at least 10 sessions of ILF regardless of protocol.ResultsAmong our resultant PPCS cohort leading persistent neurological complaints were headache, memory impairment, and brain fog. PPCS patients in TAU+ILF+CP demonstrated greater net and percent improvement of symptoms compared to PPCS subjects in TAU. PPCS patients in TAU+ILF-CP trended toward significant symptom improvements compared to TAU, and TAU+ILF+CP trended toward greater efficacy than TAU+ILF-CP.ConclusionPPCS patients who received TAU+ILF+CP demonstrated significantly greater improvement as a group when compared to TAU. When used as an integrative modality to treatment as usual in managing patients with PPCS, ILF neuromodulation with use of concussion protocol provided significant symptom improvements. (shrink)

Chronic pain is associated with high levels of mental health issues and alterations in cognitive processing. Cognitive-behavioral models illustrate the role of memory alterations in the development and maintenance of chronic pain as well as in mental health disorders which frequently co-occur with chronic pain. This study aims to expand our understanding of specific cognitive mechanisms underlying chronic pain which may in turn shed light on cognitive processes underlying pain-related psychological distress. Individuals who reported a history of chronic pain and (...) individuals who reported no history of chronic pain were recruited from MTurk to complete an online survey including standardized measures of anxiety and depression and two sentence completion tasks that assessed autobiographical memory and future thinking specificity and content. Chi square analyses revealed that participants who endorsed experiencing chronic pain were significantly more likely to recall at least one painful and negative event and to imagine at least one anticipated painful event in their future. Two ANCOVAs were performed to examine the degree to which chronic pain endorsement influenced specificity in memory and future imagining. Individuals with a history of chronic pain and higher levels of depression symptom severity generated autobiographical memories with significantly less specificity; whereas, individuals with a history of chronic pain also generated future autobiographical events with significantly less specificity. In addition, individuals with a history of chronic pain were more likely to generate episodes related to pain when asked to recall the past or imagine the future. Further research is needed to improve our understanding of the etiology of autobiographical memory and future thinking specificity and content in the pathogenesis of mental health conditions in the context of chronic pain. This requirement makes a number of questionable assumptions predicated upon what we will argue is an erroneous epistemology. It is not always possible to articulate in a publishable form a detailed description of disciplinary practices such as assessment. As a result publication cannot (...) achieve its stated goals. The COVID-19 pandemic was a global health crisis that required US residents to understand the phenomenon, interpret the cues, and make sense within their environment. Therefore, how the communication of COVID-19 was framed to stakeholders during the early stages of the pandemic became important to guide them through specific actions in their state and subsequently with the sensemaking process. The present study examines which frames were emphasized in the states' press releases on policies and other COVID information to influence stakeholders (...) on what to focus on to help with sensemaking during the crisis. We conducted content analysis on 602 press releases from 50 US states using an unsupervised machine learning approach called Latent Dirichlet Allocation (LDA). The results show that health communication using press releases to help the public make sense of the crisis were framed to include health frames as well as economic frames. Health communication messages are typically framed with health and safety measures; however, this study shows that economic frames were emphasized more than public health frames in the government's health communication for COVID-19, which forced both large and small businesses to engage in specific socially responsible activities that were previously voluntary to support public health safety. The emerging area of philosophy of birth is invaluable, first, to diagnose fallacious assumptions about the relation between the womb and reason, and, ultimately, to challenge potentially damaging narratives with major impact on birth care. With its analysis of eighteenth-century epistemic and medical discussions about the role of the uterus in women's reasoning, this article supports two arguments: first, that women's “flawed thinking” was a premise drawn by many modern intellectual men, one that was presented as based upon empirical evidence; (...) and second, that the pervasive construction of the uterus as an element that renders women wild, uncontrollable, and irrational continues to influence contemporary obstetrics, even as today's medicine and science consider themselves to be free of any such prejudices.This article shows the role that Giacomo Casanova played in debunking these prejudices and presents his short manuscript on the issue as an important contribution to the literature of the Enlightenment, with its argument against women's supposed “natural” inferiority and for the idea that differences in education were to blame for women's subordinate position in society.Detailed analysis of the “thinking uterus” debate illuminates the different ways in which various arguments from/by the “anti-uterine” lobby were used to justify the subordination of women: sometimes emphasizing the connection between the uterus and thought and sometimes negating it, but always concluding that women's inferiority is to be found in some known or yet-to-be-discovered anatomical, and mainly sexual, deficiency or problem. Prior research has investigated the recruitment of inhibition in the use of science/mathematics concepts in tasks that require the rejection of a conflicting, nonscientific initial concept. The present research examines if inhibition is the only EF skill recruited in such tasks and investigates whether shifting is also involved. It also investigates whether inhibition and/or shifting are recruited in tasks in which the use of science/mathematics concepts does not require the rejection of an initial concept, or which require only the use (...) of initial concepts. One hundred and thirty‐three third‐ and fifth‐grade children participated in two inhibition and shifting tasks and two science and mathematics conceptual understanding and conceptual change (CU&C) tasks. All the tasks were on‐line, and performance was measured in accuracy and RTs. The CU&C tasks involved the use of initial concepts and of science/mathematics concepts which required conceptual changes for their initial formation. Only in one of the tasks the use of the science/mathematics concepts required the concurrent rejection of an initial concept. The results confirmed that in this task inhibition was recruited and also showed that the speed of shifting was a significant predictor of performance. Shifting was a significant predictor of performance in all the tasks, regardless of whether they involved science/mathematics or initial concepts. It is argued that shifting is likely to be recruited in complex tasks that require multiple comparisons of stimuli and the entertainment of different perspectives. Inhibition seems to be a more selective cognitive skill likely to be recruited when the use of science/mathematics concepts requires the rejection of a conflicting initial concept. (shrink)

This article presents the results of an experiment which investigated elementary school children's explanations of the day/night cycle. First, third, and fifth grade children were asked to explain certain phenomena, such as the disappearance of the sun during the night, the disappearance of stars during the day, the apparent movement of the moon, and the alteration of day and night. The results showed that the majority of the children in our sample used in a consistent fashion a small number of (...) relatively well‐defined mental models of the earth, the sun, and the moon to explain the day/night cycle. These mental models of the day/night cycle were empirically accurate, logically consistent and revealed some sensitivity on the part of the children to issues of simplicity of explanation. The younger children formed Initial mental models which provided explanations of the day/night cycle based on everyday experience (e.g., the sun goes down behind mountains, clouds cover up the sun). The older children constructed synthetic mental models (e.g., the sun and the moon revolve around the stationary earth every 24 hours; the earth rotates in an up/down direction and the sun and moon are fixed on opposite sides) which represented attempts to synthesize the culturally accepted view with aspects of their Initial models. A few of the older children appeared to have constructed a mental model of the day/night cycle similar to the scientific one. A theoretical framework is outlined which explains the formation of initial, synthetic, and scientific models of the day/night cycle in terms of the reinterpretation of a hierarchy of constraints, some of which are present early in the child's life, and others which emerge later out of the structure of the acquired knowledge. The article proposes to sketch an analogy between, on the one hand, linguistic learning and sound dialogue in humanist music therapy and, on the other hand, certain reflections of Maurice Merleau-Ponty: in particular, the centrality of corporeality in the learning, treated in the Phenomenology of Perception and in the courses on the psychology and pedagogy of the child, and the status of inter-corporeality developed through reflections on passivity and the metaphor of flesh. We will trace an analysis of the music (...) therapy of Giulia Cremaschi Trovesi, with reference to the linguistic and musical gesture, through the Merleau-Pontian notion of praktognosia, and of the sound dialogue with reference to institution and intercorporeity. Through an interpretation of music in the terms adopted by Stéphanie Ménasé and in reference to Merleau-Pontian passivity in artistic creation, our objective is to define the musical institution of the vibrating body in music therapy in terms analogous to the institution of the subject according to Merleau-Ponty and, consequently, to find, in the sound dialogue, the intercorporeity which anticipates the individuation of the subject, by describing the communicative authenticity of the musical-therapeutic encounter. The acquisition of syntactic categories is a crucial step in the process of acquiring syntax. At this stage, before a full grammar is available, only surface cues are available to the learner. Previous computational models have demonstrated that local contexts are informative for syntactic categorization. However, local contexts are affected by sentence-level structure. In this paper, we add sentence type as an observed feature to a model of syntactic category acquisition, based on experimental evidence showing that pre-syntactic children are able (...) to distinguish sentence type using prosody and other cues. The model, a Bayesian Hidden Markov Model, allows for adding sentence type in a few different ways; we find that sentence type can aid syntactic category acquisition if it is used to characterize the differences in word order between sentence types. In these models, knowledge of sentence type permits similar gains to those found by extending the local context. (shrink)

Ist Geschichtsdarstellung ein transparentes Fenster zu einer faktischen Vergangenheit? Oder verlieren Fakten ihre Verbindlichkeit zugunsten der Repräsentation? Der vorliegende Band weist einen vermittelnden Weg zwischen diesen Extremen. Jenseits der positivistisch verstandenen historischen Fakten sowie der infolge des linguistic turn häufig behaupteten Unzugänglichkeit und Unentscheidbarkeit der faktischen Vergangenheit wird die Geschichtsdarstellung selbst als das eigentlich Greifbare zur Geltung gebracht. Geschichte ist demnach in ihrer Darstellung zu suchen – unabhängig davon, ob es sich um historiographische Quellen, literarische Texte, Gemälde oder um Museen (...) als mediale Darstellungsräume handelt. Die Beiträge gehen einem breiten Spektrum unterschiedlicher Dimensionen von Geschichtsdarstellung nach. Medien, Methoden und Strategien bilden dabei die zentralen Koordinaten, anhand derer Geschichtsdarstellung mit ihren narrativen und bildlichen Ausdrucksformen exemplarisch erörtert wird. Die Korrespondenz zwischen körperlichen Merkmalen und dem Charakter eines Menschen, die im 19. Jahrhundert die Matrix für die Naturwissenschaften fungierte, stellt heute die Basis von Lifestyle-Normen oder auch von psychologischer und medizinischer Diagnostik dar. Infolge strukturalistisch-semiotischer Methoden gilt die Physiognomik immer noch als Deutungsdispositiv bei Formen literarischer Personendarstellungen oder philosophischer Deutung menschlichen Antlitzes. In den durch umfangreiche mediale und technische Umwälzungen hervorgebrachten Modellierungen der Sinnlichkeit erweist sich die Physiognomik auch als Paradigma des Enhancements. Der Band untersucht historisch und systematisch die (...) biopolitische Performativität physiognomischer Praktiken der Selbst- und Fremddeutung, ihre Gestaltung sowie ihre Transformationen durch neue Technologien. Er diskutiert ihre materiell-mediale Dynamik, das in der Ästhetik von Texten und Medien implizierte Lebenswissen, Formen der Affektforschung sowie die anthropozentrischen Implikationen der Physiognomik. This essay aims to reappraise Agnes Arber's contribution to the history of science with reference to her work in the history of botany and biology. Both her first and her last books are classics: the former in the history of botany, the latter in that of biology. As such, they are still cited today, albeit with increasing criticism. Her very last book was rejected by Cambridge University Press because it did not meet the publisher's academic standards – we shall return (...) to it in due course. Despite Kathryn Packer's two essays about Arber's life in context, much remains to be done toward a just appreciation of her research. We need such a reappraisal in order to avoid anachronistic criticisms of her contributions to the historiography of botany, or, on the other hand, uncritical applause for her studies in plant morphology. Descartes’s doctrine of clarity and distinctness states that whatever is clearly and distinctly perceived is true. This paper looks at his early doctrine from Rules for the Direction of the Mind, and its application to the demarcation problem of curves in Descartes’s Geometry. This paper offers and defends a novel account of the demarcation criterion of curves: a curve is geometrical just in case it is clearly and distinctly perceivable. This account connects Descartes’s rationalist epistemological programme with his ontological views (...) about mathematics. (shrink)

In dieser Arbeit geht es zunächst um eine Auslegung der aristotelischen Affekttheorie, so wie sie hauptsächlich im 2. Buch der Rhetorik ausgeführt wird unter Berücksichtigung der einschlägigen Passagen aus der Nikomachischen Ethik und aus De Anima. Es zeigt sich, dass Affekte für Aristoteles nicht etwa unserem Verstand gegenüberstehen, sondern, dass sie selbst Anteil an der Vernunft haben, indem sie auf einem Erkenntnisakt beruhen. Ziel dieser Untersuchung ist aber auch zu zeigen, dass der Stoiker Poseidonios, trotz seiner Absicht sich der platonisch-aristotelischen (...) Seelen- und Affekttheorie anzuschließen, mit seiner Theorie das Konzept eines Gegensatzes von Vernunft und Affekt verteidigt hat und somit in Wirklichkeit nicht als Anhänger der platonisch-aristotelischen Philosophie betrachtet werden kann. Für Poseidonios besteht, anders als bei Aristoteles, eine radikale Trennung zwischen Sinnlichkeit und Vernunft, zwischen Emotionslos-Rationalem und Geistfrei-Irrationalem. (shrink)

Analogical reasoning is a foundational tool for human learning, allowing learners to recognize relational structures in new events and domains. Here I sketch some grounds for understanding and applying analogical reasoning in social learning. The social world is fundamentally characterized by relations between people, with common relational structures—such as kinships and social hierarchies—forming social units that dictate social behaviors. Just as young learners use analogical reasoning for learning relational structures in other domains—spatial relations, verbs, relational categories—analogical reasoning ought to be (...) a useful cognitive tool for acquiring social relations and structures.
