This paper discusses the discourse contrasts that arise in connection to direct evidentiality in Southern Aymara (henceforth, Aymara), an understudied Andean language. Aymara has two direct evidentials, the enclitic _=wa_ and the covert morpheme _-_∅, which are used whenever the speaker has the best possible grounds for some proposition. I make the novel observation that a sentence with _=wa_ can be felicitously uttered if the speaker attempts to update the common ground by addressing an issue on the table. In fact, (...) the sentence with _=wa_ that is uttered must be congruent with prior discourse; I tie this to the claim that _=wa_ is a (presentational) focus marker (Proulx in Language Sciences 9(1):91–102, 1987 ). This paper thus claims that _=wa_ is a marker that combines evidentiality and focus. In contrast, uttering a sentence with _-_∅ entails that the speaker’s contribution is already in the common ground, which likens this evidential to common ground management operators—there is no congruence requirement in this case. I identify which construction can be used in different discourse settings (conversation openers and telling anecdotes). I implement a formal analysis based on Farkas and Bruce (Journal of Semantics 27:81–118, 2010 ) and Faller (Semantics and Pragmatics 12(8):1–53, 2019 ) that links evidentiality and discourse. In the remainder of this article, we will disarm an important motivation for epistemic contextualism and interest-relative invariantism. We will accomplish this by presenting a stringent test of whether there is a stakes effect on ordinary knowledge ascription. Having shown that, even on a stringent way of testing, stakes fail to impact ordinary knowledge ascription, we will conclude that we should take another look at classical invariantism. Here is how we will proceed. Section 1 lays out some limitations of previous (...) research on stakes. Section 2 presents our study and concludes that there is little evidence for a substantial stakes effect. Section 3 responds to objections. The conclusion clears the way for classical invariantism. Is behavioral integration a necessary feature of belief in folk psychology? Our data from over 5,000 people across 26 samples, spanning 22 countries suggests that it is not. Given the surprising cross-cultural robustness of our findings, we argue that the types of evidence for the ascription of a belief are, at least in some circumstances, lexicographically ordered: assertions are first taken into account, and when an agent sincerely asserts that p, nonlinguistic behavioral evidence is disregarded. This article describes a new type of medical-legal partnership (MLP) that targets the health and justice concerns of people enmeshed in the U.S criminal justice system: a partnership between clinicians who care for people with criminal system involvement and public defenders. This partnership offers an opportunity to not only improve patient health outcomes but also to facilitate less punitive court dispositions, such as jointly advocating for community-based rehabilitation and treatment rather than incarceration.

Many contextual theology models have been shared, but no formula applies to all contexts, because each culture has specific and unique features. Indonesia shares a complex context and requires a proper approach for precise landing. This study aimed to formulate a contextual theology model on the Spirit suitable for Indonesians. It moves from the ‘naked Spirit’, a term provided by Vincent Donovan, originally ‘naked gospel’, highlighting the essence of the scripture or Spirit itself, to the Nusantara contextual formula. The Nusantara (...) model is a promising formula that could contribute inputs to the tension. The local contextual model is a bright sketch that could help Indonesians to engage with pneumatology in the church traditions. This study analysed and described articles, journals and other related sources with a sensitive approach. Additionally, it proposed argumentations and provided a prospective contextual theology model for the Spirit. The findings showed that the Nusantara formula is a significant model for the Spirit to engage in an Indonesian context.Contribution: Through the examination of contextual theology model globally, and especially speaking of the ‘naked Spirit’ insight, the study provided an alternative contribution to the contextual theology model. The result showed that the Nusantara contextual theology formula offers an alternative contribution to an Indonesian context. (shrink)

While feelings of disgust and repulsion are experienced and accepted as part of care practices of nurses who work in palliative care, they are often silenced. Working alongside two palliative care nurses in a hospice setting, we engaged in a narrative inquiry to inquire into their experiences of disgust. The study took place in a palliative care setting in a large urban city in Germany. We understand care practices as actions that follow a logic of care. According to a logic (...) of care, actions are situated within a social context, given by specific relationships including power, and individual needs. Various aspects of disgust are visible in the experiences of the participants and highlighted in the narrative threads of disgust and silence, disgust and protection, and disgust and boundaries. Embedded in the experience of disgust of nurses working in palliative care, we see that there are borderlands of care that challenge who we are and are becoming. Opening discussion about disgust in nursing makes visible the complexity of care. (shrink)

The exchange of goods and services between individuals is often formalised by a contract in which the parties establish norms to define what is expected of each one. Norms use deontic statements of obligation, prohibition, and permission, which may be in conflict. The task of manually detecting norm conflicts can be time–consuming and error-prone since contracts can be vast and complex. To automate such tasks, we develop an approach to identify potential conflicts between norms. We show the effectiveness of our (...) approach and its individual components empirically using two publicly available corpora, and contribute with a new annotated test corpus for norm conflict identification. This article critically examines the plain exit principle of Kukathas that argues as the best system to conciliate the demands of belonging to an indigenous culture and the right to dissent from their women members. We first review the tension between feminism of equality and the situation of indigenous women with their internal cultures. Second, we explore the thesis of Kukathas for conclude that it alone is not enough. Background: Frailty is a common syndrome among older adults and patients with several comorbidities. Grip strength is a representative parameter of frailty because it is a valid indicator of current and long-term physical conditions in the general population and patients with severe mental illnesses. Physical and cognitive capacities of people with SMIs are usually impaired; however, their relationship with frailty or social functioning have not been studied to date. The current study aimed to determine if GS is a valid predictor (...) of changes in cognitive performance and social functioning in patients with type-2 diabetes mellitus and SMIs. Methods: Assessments of social functioning, cognitive performance, and GS were conducted in 30 outpatients with type 2 diabetes mellitus, 35 with major depressive disorder, 42 with bipolar disorder, 30 with schizophrenia, and 28 healthy controls, twice during 1-year, follow-up period. Descriptive analyses were conducted using a one-way analysis of variance for continuous variables and the chi-squared test for categorical variables. Differences between groups for the motor, cognitive, and social variables at T1 and T2 were assessed using a one-way analysis of covariance, with sex and age as co-variates. To test the predictive capacity of GS at baseline to explain the variance in cognitive performance and social functioning at T2, a linear regression analysis was performed. Results: Predictive relationships were found among GS when implicated with clinical, cognitive, and social variables. These relationships explained changes in cognitive performance after one year of follow-up; the variability percentage was 67.7%, in patients with type-2 diabetes mellitus and 89.1% in patients with schizophrenia. Baseline GS along with other variables, also predicted changes in social functioning in major depressive disorder, bipolar disorder, and schizophrenia, with variability percentages of 67.3, 36, and 59%, respectively. Conclusion: GS combined with other variables significantly predicted changes in cognitive performance and social functioning in people with SMIs or type-2 diabetes mellitus. Interventions aimed to improve the overall physical conditions of patients who have poor GS could be a therapeutic option that confers positive effects on cognitive performance and social functioning. The world is increasingly developing towards complex and chaotic behaviour. Enterprises are challenged to establish flexible but trustworthy structures of doing business within global instability. We need to educate our students today for coping with such chaotic patterns in their professional future. As an example, the student-run Europe-wide organisation ESTIEM is offering the 2-week Summer Academy (SAC) to develop the communication skills corresponding. It also means among other aims to strengthen mutual trust through interaction of the students. In 2011, one (...) of the SAC took place in Serbia. About 15 students attended it from all over Europe. In the paper, three of these students report on their experiences as a set of suggestions of how to develop further engineering and economics teaching towards international trust and stability. El objetivo fue analizar la adquisición de vocabulario en idioma inglés de estudiantes de bachillerato a partir de la implementación de actividades de resolución de problemas. Se empleó un diseño cuasiexperimental de pre y post test, con grupo experimental y control. Los resultados sugieren que las actividades de resolución de problemas son estrategias didácticas efectivas para la enseñanza del inglés.

Digital communication between a patient and their clinician offers the potential for improved patient care, particularly for young people with long term conditions who are at risk of service disengagement. However, its use raises a number of ethical questions which have not been explored in empirical studies. The objective of this study was to examine, from the patient and clinician perspective, the ethical implications of the use of digital clinical communication in the context of young people living with long-term conditions. (...) A total of 129 semi-structured interviews, 59 with young people and 70 with healthcare professionals, from 20 United Kingdom -based specialist clinics were conducted as part of the LYNC study. Transcripts from five sites were read by a core team to identify explicit and implicit ethical issues and develop descriptive ethical codes. Our subsequent thematic analysis was developed iteratively with reference to professional and ethical norms. Clinician participants saw digital clinical communication as potentially increasing patient empowerment and autonomy; improving trust between patient and healthcare professional; and reducing harm because of rapid access to clinical advice. However, they also described ethical challenges, including: difficulty with defining and maintaining boundaries of confidentiality; uncertainty regarding the level of consent required; and blurring of the limits of a clinician’s duty of care when unlimited access is possible. Paradoxically, the use of digital clinical communication can create dependence rather than promote autonomy in some patients. Patient participants varied in their understanding of, and concern about, confidentiality in the context of digital communication. An overarching theme emerging from the data was a shifting of the boundaries of the patient-clinician relationship and the professional duty of care in the context of use of clinical digital communication. The ethical implications of clinical digital communication are complex and go beyond concerns about confidentiality and consent. Any development of this form of communication should consider its impact on the patient-clinician-relationship, and include appropriate safeguards to ensure that professional ethical obligations are adhered to. Environmental research has usually highlighted that the existence of slack resources in an organization helps allocate investment to innovative initiatives. However, the existing literature has paid very limited attention to how slack resources can influence the effects of focused and diversified innovations in different ways. Agency theory scholars claim that a manager’s first preference when confronted with discretionary resources will not generate positive investments for the firm, but their own opportunistic preferences. The differences between focused and diversified environmental innovations allow (...) us to gain a better understanding of the financial impact of being focused and how slack resources matter in this context. We analyze a longitudinal sample of 5845 environmental patents from the 75 largest companies in the electrical components and equipment industry worldwide. Our results show that high levels of slack resources reduce the existing positive relationship between focused environmental innovations and a firm’s financial performance. These results contribute to delineating the theoretical and empirical implications of focused versus diversified environmental innovations and extend the literature on ethical dilemmas concerning managers’ use of slack resources in the firm. The purpose of the article is to analyze the meaning of examples in C. Hempel’s works. Hempel uses many examples referring to readings of magnetic hand, burning of white phosphorus, predictions of properties of some elements of the table of Mendeleev, to astrophysical hypotheses, terms of total solar eclipse, throwing of dice, as well as on unmarried men, on white and black swans, green mermaids, black crows and white shoes, blue roses, predictions of Jones’ recovery, the eruption of Vesuvius, the (...) assassination of Julius Caesar, and other “special cases” and “concrete facts”. The question is raised as to whether the case studies are mere illustrative material, a form of argumentation; a way of verifying Hempel’s ideas, their “demonstrable confirmation”, and in this sense a definite empirical basis for the study. The necessity of analyzing concrete examples in the context of Hempel’s theoretical research is shown, for which the examples turn out to be an occasion for investigating the logic of confirmation and the logic of explanation, for analyzing the structures of explanans and explanandum, for understanding the differences in inductive and deductive logical constructions, and for analyzing “quasi-induction”. The paper discusses Hempel’s famous example, the crow paradox, which is named in his honor and is a kind of logical provocation. (shrink)

The article presents a theoretical discussion and sociological analysis about the tensions in the building of social sex/gender relationships that are at the basis of the exclusion of women within the political field. It shows contents in dispute in the production of politics, considering the weight that categories play in the relations at a global level and in the school, the attributions inside the system sex/gender, the significations in politics, and the modes in which it is subjectified, resisted and confront (...) different logics to understand life and politics, considering the conceptual distinctions between Bíos and Zoé. This discussion allows the analysis of the imaginary institution within systematic difficulties and obstacles of political and legal kind during the post dictatorship in Chile, where based on arguments about the sex/gender system, the exclusion of women from the political field is established, limiting the development of politics that valorizes cultural diversity and human rights, accentuating discrimination and social exclusion. These shape the discussion over the modes in which the political field for women is configured, recovering the possibilities of conflict as an opening of that horizon. El artículo presenta una discusión teórica y análisis sociológico acerca de las tensiones en la construcción social de las relaciones sexo/género, que fundamentan la exclusión del campo político de las mujeres. Se distinguen los contenidos en disputa en la producción de la política, considerando el peso que tienen las categorías en juego en las relaciones a nivel global y en el espacio de la escuela, las atribuciones dentro del sistema sexo/género, las significaciones de la política, y los modos en que se subjetivan, se resisten y se confrontan diferentes lógicas para entender la vida y la política, teniendo como base las distinciones conceptuales entre Bios y Zoé. Esta discusión permite analizar la institución del imaginario en el marco de las dificultades sistemáticas y obstáculos de tipo político y legal durante la post dictadura en Chile, donde sobre la base de argumentos propios del sistema sexo/género, se establece la exclusión del campo político de las mujeres, limitando el desarrollo de políticas que pongan en valor la diversidad cultural y los derechos humanos, acentuando la discriminación y la exclusión social. Resuelta evidente la desigualdad que ha develado la crisis sanitaria a nivel global. Sin embargo, no se trata de una fotografía actual, sino que ha puesto de manifiesto las falencias estructurales del sistema económico político global y, con ello, los devastadores efectos sobre el ser humano en todas sus dimensiones. Las consecuencias de la pandemia no son homogéneas dentro de una misma sociedad. Existen sectores que se han vuelto más ricos y otros más pobres. Las distancias en salud, bienestar y (...) dignidad de los individuos han aumentado y estamos ante una crisis de que esta injusticia se siga calcificando. El ser humano no sólo tiene que sobrevivir sino lograr la fundamental biopsicosocial realización tanto individual como colectiva. Por lo tanto, es imperativo, recuperar al Otro, al necesitado, dentro del discurso y, sobre todo, en la acción política, mirando al Otro como un fin en sí mismo, y no como un medio. Este es el origen y debe volver a ser la finalidad primordial de la política interna y externa de cada gobierno. Para ello, la reflexión filosófica nos proporciona nuevas perspectivas para reestructurar la realidad, cambiando, y mejorando, las escalas de valores y nuestro modo de actuar. La postpandemia nos plantea un único objetivo, el restaurar y reactivar las verdaderas relaciones intersubjetivas, rehumanizando al hombre, es decir, volviendo a la raíz de la esencia de toda sociedad, que no es otra que el ser humano mismo, como un fin en sí mismo. No se podrá lograr de manera inmediata, por lo tanto es fundamental recanalizar todas las herramientas e instituciones políticas hacia y para el bienestar del hombre, sin devastar su entorno, donde la reflexión filosófica es primordial para construir un nuevo mundo. Even though sign-systems are a crucial part of society, critical realism, as developed by Roy Bhaskar, does not yet have an adequate theory of signs and semiosis. The few suggestions that Bhaskar offers can be advanced through the semiotics of C.S. Peirce. In doing so, however, it becomes necessary to reconsider Bhaskar's ontological domains of the real, the actual, and the subjective, and expand the last domain into one of semiosis. This new understanding of ontological domains, incorporating Peirceian semiotics, provides (...) the basis for rethinking the ontology of society: the customary dyad structures/agents becomes the triad structures/agents/discourses, each of which possesses material, sociological, and meaningful aspects. Medical Officers serving with their national contingents in peacekeeping operations are faced with difficult ethical decisions in regard to their obligations to the local civilian population. Such populations may be under-resourced in regard to medical care, and vulnerable to abuse and exploitation. Though the medical officer may support the local medical services, he/she should never undermine these resources. Adopting a human rights approach and observing the requirements of ethical medicine, aids the doctor in prioritising his/her duties. At times there may (...) be conflict with one’s own military superiors. It is wise to discuss potential difficulties prior to setting out on the mission. Human rights abuses cannot be ignored. The medical officer has a duty to do his/her best to report their observations so as to prevent abuse or to bring it to an end. (shrink)

Most work on reflexivity has focused on individuals exercising their reflexivity through discourse. However, agents have three major aspects (intentionality, causal efficacy and embodiment) and they are fundamentally social. This article examines the possibility of collective reflexivity conducted not just by saying, but also by doing—that is, through their embodiment. By expanding the concept of ‘performatives’ to encompass not just speech acts but also acts that speak (i.e. embodied activities as socially meaningful) and applying the work of Charles S. Peirce (...) in order to develop an ontology of embodied reflexivity, it becomes possible to determine several criteria defining embodied collective reflexivity. Assessing possibilities such as legislative debate, political demonstrations, religious ritual and dramatic performance reveals that a certain set of practices does in fact meet those criteria and discloses additional aspects of what constitutes embodied collective reflexivity. After thirty-five years of teaching and administrating at Princeton University, dozens of books, and innumerable articles, the eminent Germanist Theodore Ziolkowski has turned his attention to a (...) theme appropriate for someone so immersed in the intellectual life: the sorrow and grief that accompany human knowledge. Although Ziolkowski has made great contributions in standard studies of genre (notably the elegy and the twentieth-century novel) and authors (Mann, Hesse, and Broch), he became especially well known for his theorization and implementation of thematic studies, ranging from the sublime--fictionalizations of the life of Jesus--to the humorous--talking animals in literature. The figures whom Ziolkowski has selected for analysis of the sin of knowledge are Adam, Prometheus, and Faust, each of whom he views through both an ancient and a modern lens.All three of these mythic heroes violate "divine prohibitions against the new knowledge" (p. 69). Less heroically, all of these myths treat women misogynistically. Generally, Ziolkowski sees each of these stories as having emerged in a time of crisis, when new opportunities presented humanity with knowledge both alluring and disruptive. Because these are highly elastic myths, able to provide meaning in a variety of contexts, they have all mutated in modern times. Adam's Fall comes to represent the human transition from innocence to consciousness, Prometheus becomes a symbol for socialism's promise, and Faust turns into a representative of the American way of life.Looking at the ancient legend of Adam, Ziolkowski notes that sexuality and wisdom are linked in many of the oldest texts in humanity's recorded history. The emphasis on knowledge, however, is especially strong in the Hebrew myth. While many Near Eastern traditions have stories with similarities to the Biblical account of Adam and Eve, only Hebrew mythology has the Tree of Knowledge. For Ziolkowski, the fact that this story was probably set down during the reign of King Solomon explains this emphasis on knowledge. Because the Age of Solomon was a time of unparalleled wealth and power for the Hebrews, [End Page 347] Ziolkowski argues that the tale of Adam and Eve is the kind of myth "produced by cultures that have reached a certain level of sophistication... and look back with a degree of nostalgia at an imagined simpler, happier existence" (p. 23). According to Ziolkowski, knowledge becomes a sin for the Hebrews as they come to terms with the limitations of everything that their knowledge has brought them even at the height of their power and glory.In the modern era, Ziolkowski continues, the story of Adam has become secularized, representing the transition of humanity from a state of innocence to one of consciousness. He finds references to the Fall in Voltaire's Candide, Kleist's The Broken Pitcher, E. T. A. Hoffmann's The Golden Pot, Melville's Billy Budd, and Hesse's Demian. The overall trend of these representations of the rise of consciousness has been increasingly negative, culminating in sentiments like those expressed by the East German author Günter Kunter, who argues that "our whole present misery and all the problems of industrial civilization" can be linked to "the moment when man used the first firestone as a tool, the Fall" (p. 107). As Ziolkowski concludes: "Two centuries of secularization have brought the modern Adam to a depressing end" (p. 108).Citing Nietzsche, who compared Prometheus to Adam (and Pandora to Eve), Ziolkowski looks first at Hesiod's depiction of Prometheus as a trickster and then to Aeschylus' hero. Unlike the authors of the story of Adam and Eve, though, Aeschylus depicts Prometheus' claim to divine knowledge in a positive light: "Rather than a humankind declining from a glorious golden age to the present deplorable iron age, Aeschylus sees humanity progressing by means of knowledge--the crafts, arts, and sciences--from blindness and ignorance... We show that in the Maxwell–Lorentz theory of classical electrodynamics most initial values for fields and particles lead to an ill-defined dynamics, as they exhibit singularities or discontinuities along light-cones. This phenomenon suggests that the Maxwell equations and the Lorentz force law ought rather to be read as a system of delay differential equations, that is, differential equations that relate a function and its derivatives at different times. This mathematical reformulation, however, leads to physical and philosophical consequences for the ontological (...) status of the electromagnetic field. In particular, fields cannot be taken as independent degrees of freedom, which suggests that one should not add them to the ontology. (shrink)

The primacy of practice in the development of knowledge is one of materialism’s fundamental tenets. Most arguments supporting it have been strictly philosophical. However, over the past thirty years cognitive science has provided mounting evidence supporting the primacy of practice. Particularly striking is its finding that thought is fundamentally metaphoric—that images emerging from everyday embodied activities not only make ordinary experiences intelligible, but also underpin our more abstract engagements with the world, elaborated in disciplines such as ethics and science. The primacy of practice in the development of knowledge is one of materialism's fundamental tenets. Most arguments supporting it have been strictly philosophical. However, over the past thirty years cognitive science has provided mounting evidence supporting the primacy of practice. Particularly striking is its finding that thought is fundamentally metaphoric—that images emerging from everyday embodied activities not only make ordinary experiences intelligible, but also underpin our more abstract engagements with the world, elaborated in disciplines such as ethics and science. The practical politician must not claim, in the event of a dispute with a theorist, to detect some danger to the nation in those views that the political theorist expresses openly and without ulterior motive.... By this clausula salvatoria, the author ofthis essay will regard himselfto be expressly protected in the best way possible from all malicious interpretation. (Immanuel Kant, Preface to Perpetual Peace) My goal is to work my way back to Kant's defensive preface to Perpetual Peace, the prophetic essay situated by many at the origin ofmodern conceptions ofpeace and international diplomacy. Suffice it to say for the moment that the following reflections are intended to reveal the epitaph in Kant's epigraph—the eternal repose residing in perpetual peace. Imagining relation One of the master ideas to come down to us from the eighteenth century holds that the imagination is central to all relations between self and other, however one might designate this otherness. The imagination is central to Adam Smith's idea of sympathy, and Kant uses it as a bridge to 86Tobin Siebers unify his critical philosophy. Whether referring to objects or other people, we require a faculty by which to extend understanding to them, and this faculty continues even today to be described as imaginative. Postmodern theorists, for example, conceive of human relations in terms of identity politics, but at the core of identification is the power to imagine, be it the power to sympathize or to conceive of a party different from oneself. In effect, then, relation is itself a function of the imagination. Moreover, no relation, I want to claim, exists for long that cannot be well imagined, for which some symbolic object or idea cannot be found. The four dominant modes of relation are religion, aesthetics, ethics, and politics.1 They deserve to be called modes insofar as they name different others to which the self (or another principal) may relate imaginatively. Religion is about the relation of goodness between subject and god called the sublime. Often nature, fate, or providence as personified forces or overarching systems are also called sublime. Aesthetics is about the relation of goodness between subject and object called beauty. Ethics is about the relation of goodness between subjects called character or virtue. Finally, politics is about the relation ofgoodness between communities called peace. Peace may seem at first glance to be an odd choice to name the relation of goodness in politics. A more obvious candidate might be the idea of utopia. But utopia comes into being as a concept only with Thomas More's treatise in 1516, and this late invention seems to exclude its being considered as the privileged good of politics. Moreover, the traditional opposition between ethics and politics exposes the unfitness ofutopia as a candidate for the political good. Ethics and politics are often at war because ethics does not want to sacrifice even one person to improve the relations among other people. Ethics strives for a wholly inclusive community, but it defines this community as a collection of autonomous individuals having value in themselves only as ends and never as means to an end. If ethics aims at a wholly inclusive community of individuals, then "utopia" may be described by rights as an ethical concept, regardless ofthe fact that Utopian desire seems to stress the wrong perspective on this community, coming as it does from the collective rather than the individual point of view.
