This is the first book-length study of one of the most influential traditions in eighteenth-century Anglophone moral and political thought, 'theological utilitarianism'. Niall O'Flaherty charts its development from its formulation by Anglican disciples of Locke in the 1730s to its culmination in William Paley's work. Few works of moral and political thought had such a profound impact on political discourse as Paley's Principles of Moral and Political Philosophy. His arguments were at the forefront of debates about the constitution, the (...) judicial system, slavery and poverty. By placing Paley's moral thought in the context of theological debate, this book establishes his genuine commitment to a worldly theology and to a programme of human advancement. It thus raises serious doubts about histories which treat the Enlightenment as an entirely secular enterprise, as well as those which see English thought as being markedly out of step with wider European intellectual developments. My aim in this chapter is to push back against the tendency to emphasize Mill’s break from Bentham rather than his debt to him. Mill made important advances on Bentham’s views, but I believe there remains a shared core to their thinking—over and above their commitment to the principle of utility itself—that has been underappreciated. Essentially, I believe that the structure of Mill’s utilitarian thought owes a great debt to Bentham even if he filled in that structure with a richer (...) conception of human nature and developed it in more liberal directions. This commonality is revealed, in particular, in Mill’s own institutional designs and practical reform proposals in Considerations on Representative Government and related writings. If this is right, then the tendency of interpreters to highlight their differences rather than their similarities has been to the detriment of both Mill and Bentham scholarship, and so to our understanding of the rise of liberal utilitarianism. What are the distributive implications of utilitarianism? Is it compatible with a concern for equality, as many utilitarians have argued? We analyse these questions in the context of a pure allocation problem. We consider an infinitely-lived economy and, drawing on the behavioural literature, assume that individuals have reference-dependent preferences: agents’ utility is a function of current consumption and a reference point which captures consumption habits, or the agents’ upbringing. Assuming a history of inequalities in consumption, we show that (...) the utilitarian allocation is equalising: starting from an unequal distribution, inequalities decrease over time at the utilitarian optimum. However, even though agents are in a relevant sense identical, equality does not obtain at any finite time. (shrink)

Amid a far-reaching convergence of Western and Chinese cultures, utilitarianism has become a 'hot' new philosophical and ethical topic in China. I call the various different ideas associated with this new academic theme Chinese neo-utilitarianism. Chinese Neo-utilitarianism is an attempt to combine Marxism, the Western ethical tradition and the Chinese tradition to create a new approach different from that of complete Westernization, or the pure Chinese tradition or Marxism so as to bring the greatest happiness for the (...) greatest number of present-day Chinese people. ;We can trace the ideas of Chinese Neo-utilitarianism back in history, finding a Chinese utilitarian tradition differing somewhat from the Western moral philosophy of utilitarianism. Three key aspects of the Chinese utilitarian tradition are debates over the concepts of Yi and Li, Jing and Quan, and Gongli and Sili. The debate over Yi and Li concerns which is the ultimate standard for moral decision. The concepts of Jing and Quan address the question: is there an eternal moral standard or principle applicable in any circumstances? The discussion on the concepts of Gongli and Sili focuses on how or whether we can follow Yi and obtain Li; and how we can get Li in a moral way. If Gongli, the public interest, is Yi or the ultimate good is Li as Gongli, whose interests are to count? How is Gongli to be distributed ethically? Will neo-utilitarianism or neo-Confucian 'sageliness within and kingliness without' with science and democracy best serve the needs of modernization today? (shrink)

This special issue of the _ Revue d’études benthamiennes _ aims to examine the transmission and reception of utilitarian thought among various socialist movements in the nineteenth century, to shed light on their emergence, uses and legacy. By focusing on the originality and variety of these socialist reinterpretations, it builds upon renewed approaches in intellectual and political history that have successfully challenged the classical distinction between “utopian” and “scientific” socialism. Consequently, this issue brings a corrective to the tendency, on (...) the part of established scholarship, to confine Bentham’s influence to classical liberalism. Though the contributions to this issue focus on three European countries (Britain, Ireland and France), it is hoped that they will provide a first step towards a more general, joint history of the relation between utilitarianism and socialism. RULE-UTILITARIANISM AND HUME'S THEORY OF JUSTICE One of the striking features of Hume's theory of justice is the narrowness of the range of judgments it is designed to illumine. For Hume the paradigms of judgments of justice are judgments about particular actions, not judgments about laws or institutions or states of affairs. Moreover, the characterization of actions as just or unjust is possible according to Hume only (...) in a certain kind of legal context - namely when questions arise about the conformity of conduct to a certain class of legal rules, those which comprise the law of property. In such contexts, actions are said to be just if they are in accordance with property rules and unjust if they are contrary to them. Of particular interest is the exclusion of judgments about the law - and in particular judgments about property rules - from the class of judgments of justice. Hume recognizes, of course, that we often have occasion to evaluate rules of law, including the rules which make up the law of property. When such judgments have to be made, however, it is never their justice or injustice which is in question for Hume. The fact that he often refers to the rules of property as "rules of justice" may seem to be inconsistent with this view, but it is not. When Hume refers to property rules in this way, it is not because he wishes to signify that the rules themselves satisfy some principle of justice, but rather because he conceives of them as embodying our criteria for the making of judgments about the justice of particular acts. Property rules cannot be viewed as "rules of justice" in this sense without satisfying some supralegal standard of acceptability. But the standard in quesrtion is social utility, not justice. Property rules qualify as "rules of justice", then, not because they are just but rather because they serve the public interest. Like some contemporary rule-utilitarians, Hume expressly disallows the question whether particular acts of 75. justice are socially useful. Or rather, to be more accurate, he claims that the disutility of particular acts sanctioned by property law counts neither against their being regarded as "acts of justice" nor against recognition of the obligation to perform them. Neither the characterisation of particular actions as "just" nor the stringency of the obligation to perform them is affected by the discovery that they might have to be said not to be in the public interest if attention were to be concentrated on the special circumstances of their performance. The reason is that it is a mistake, Hume thinks, for such acts to be viewed in isolation from other similar acts. Rather they must be seen as forming part of a scheme or system - a scheme or system which, taken in its entirety, serves the public interest. Hume's theory of justice thus embodies an unusually neat distinction between questions of justice and questions of social utility. When questions of justice are allowed to arise which is when the justice of particular acts is to be determined - questions of social utility do not arise. And when questions of social utility are allowed to arise - as they do when property rules have to be evaluated - questions of justice do not arise. Despite the sharp distinction he draws between justice and utility, Hume's theory of justice is clearly a utilitarian one. It is indeed a veritable prototype of the kind of theory now dubbed "rule-utilitarian". As such it has obvious attractions for would-be utilitarians, if it can be made to work. It would enable utilitarians to offer an account of judgments of justice in terms of rules enjoying the status of secondary principles of morality. Justice judgments could be represented as a special sub-class of moral judgments and the principles regulating them as subordinate to, and derivable from, the principle of utility. In lieu of an abstract, here is a brief excerpt of the content:Hume Studies Volume 31, Number 1, April 2005, pp. 63-92 Utilitarianism with a Humean Face ELIZABETH ASHFORD Introduction There is a long-standing debate over whether or not Hume's moral theory1 should be viewed as some version of utilitarianism.2 Among opponents of a utilitarian reading, many contrast the subtlety and psychological plausibility of Hume's account of morality with what they take to be utilitarianism's failure both to (...) capture the complexity of morality and to be suited to the nature of human beings.3 Geoffrey Sayre-McCord is, in my view, one of the most incisive and forceful advocates of this position.4 He interprets Hume as an exponent of what he calls the "Bauhaus theory" of ethics. The Bauhaus theory avoids a commitment to a single overarching moral principle by which to solve all moral questions. On this view, the virtues are each well-suited to solving a particular problem which we find collectively salient when we take up the general point of view, " and different problems may demand dramatically different, sometimes incompatible solutions" (282). Sayre-McCord contrasts this with what he considers the overly systematic nature of utilitarianism, which identifies traits as virtues solely on the grounds of their tendency to realise or promote well-being. In addition, he contrasts the Bauhaus theory, which "portrays morality's demands as grounded in the expansive interests and affections, generous and not, of real people looking for... solutions to problems they face," with what he takes to be utilitarianism's psychological implausibility. The question of whether Hume's moral theory should be viewed as a version of utilitarianism will, of course, largely depend on how utilitarianism is defined. My discussion of whether Hume's moral theory is utilitarian will focus on Sayre-McCord's argument that "no version of utilitarianism... sits comfortably as an interpretation of Hume." One of the strengths of Sayre-McCord's argument is that he bases it on the most uncontentious and ecumenical account of utilitarianism's core tenets. He argues that there are three ways in which a theory may fail to qualify as utilitarian, and that Hume's theory fails on all three counts: (i) a theory might rely on neither actual nor expected utility as the determinants of evaluation; or (ii) it might not take into account all the consequences for everyone affected; or (iii) it might not take utility to be a single measure of interpersonal value. I will argue that Hume's account of morality adheres to the first two tenets that Sayre-McCord rightly identifies as definitive of utilitarianism, welfarism and impartiality. This means that Hume's theory is a version of what Thomas Scanlon calls "philosophical utilitarianism, " according to which "all that counts morally is the well-being of individuals, no one of whom is singled out as counting for more than the others."5 By showing that Hume's account is a version of philosophical utilitarianism I hope to demonstrate that a moral theory's adherence to these two fundamental tenets of utilitarianism is compatible with its having considerable complexity and psychological plausibility. I will then argue that Hume also takes welfare to be "a single measure of interpersonal value," and so also adheres to what Sayre-McCord takes to be essential to the third tenet of utilitarianism. I will argue, contra Sayre-McCord, that Hume's account of the moral point of view is based on the interests of all, rather than the interests of each seriatim (as on contractualist accounts) or the individual selfinterest of the participants (as on Hobbesian contractarian accounts). Admittedly, though, Hume shows no commitment to maximizing the net sum total of welfare. Such a commitment has come to be viewed as definitive of classical utilitarianism. Utilitarianism has had an unfortunate history. Its most influential exponents, Bentham and John Stuart Mill, set it out in such a way as to expose it to facile criticism and even to ridicule, and it has never fully recovered from this ill-omened start. In spite of the criticism and the ridicule, however, it still bulks large in ethical studies, and many people still have a hankering sympathy with it.

Between 1787, and the end of his life in 1832, Bentham turned his attention to the development and application of economic ideas and principles within the general structure of his legislative project. For seventeen years this interest was manifested through a number of books and pamphlets, most of which remained in manuscript form, that develop a distinctive approach to economic questions. Although Bentham was influenced by Adam Smith's An Inquiry into the Nature and Causes of the Wealth of Nations, he (...) neither adopted a Smithian vocabulary for addressing questions of economic principle and policy, nor did he accept many of the distinctive features of Smith's economic theory. One consequence of this was that Bentham played almost no part in the development of the emerging science of political economy in the early nineteenth century. The standard histories of economics all emphasize how little he contributed to the mainstream of late eighteenth and early nineteenth-century debate by concentrating attention on his utilitarianism and the psychology of hedonism on which it is premised. Others have argued that the calculating nature of his theory of practical reason reduced the whole legislative project to a crude attempt to apply economics to all aspects of social and political life. Put at its simplest this argument amounts to the erroneous claim that Bentham's science of legislation is reducible to the science of political economy. A different but equally dangerous error would be to argue that because Bentham's conception of the science of legislation comprehends all the basic forms of social relationships, there can be no science of political economy as there is no autonomous sphere of activity governed by the principles of economics. This approach is no doubt attractive from an historical point of view given that the major premise of this argument is true, and that many of Bentham's ‘economic’ arguments are couched in terms of his theory of legislation. Yet it fails to account for the undoubted importance of political economy within Bentham's writings, not just on finance, economic policy, colonies and preventive police, but also in other aspects of his utilitarian public policy such as prison reform, pauper management, and even constitutional reform. All of these works reflect a conception of political economy in its broadest terms. However, this conception of political economy differs in many respects from that of Bentham's contemporaries, and for this reason Bentham's distinctive approach to problems of economics and political economy has largely been misunderstood. In the long history of moral theory, non-human animals—hereafter, just animals—have often been neglected entirely or have been relegated to some secondary status. Since its emergence in the early 19th century, utilitarianism has made a difference in that respect by focusing upon happiness or well-being (and their contraries) rather than upon the beings who suffer or enjoy. Inevitably, that has meant that human relations to and use of other animals have appeared in a different light. Some cases have (...) seemed easy: once admit that the interests of animals matter and there can be little hesitation in condemning their cruel treatment. Among the more difficult cases has been the bearing of utilitarianism upon the use of animals in various kinds of research where, though the animals might suffer, there were believed to be prospects of great human benefit and where no cruel or malicious motives need be involved. What I shall provide in the current paper is an extended discussion of the bearing of utilitarianism upon practices of animal research. Since such practices have attracted both utilitarian criticism and defense, this will require the examination of arguments on both sides, including consideration of the human benefits, the animal costs, and the ways in which the one can be weighed against the other. The object of this article is to examine, with the work of Jeremy Bentham as the principal example, one strand in the complex pattern of European social theory during the second half of the eighteenth century. This was of course the period not only of the American and French revolutions, but of the culmination of the movements of thought constituting what we know as the Enlightenment. Like all great historical episodes, the Enlightenment was both the fulfilment of long-established processes and (...) the inauguration of new processes of which the fulfilment lay in the future. Thus the seminal ideas of seventeenth-century rationalism realized and perhaps exhausted their potentialities in the eighteenth-century Enlightenment. The ideas with which this article is concerned, however—conveniently grouped and labelled as the ideas of utilitarianism—only began to achieve systematic development in these later decades of the eighteenth century. Within that period—during the first half and more of Bentham's long life—attempts to apply those ideas to the solution of social problems met largely with failure and frustration. Yet unrealized potentialities remained, the realization of which was reserved for a time when the world of the philosophes no longer existed. The movements for social and political reform which have played so large a part in modern history since the French Revolution may be judged in widely differing ways; but whatever the verdict, these movements surely cannot be understood without due consideration of that part of their origins which lies in eighteenth-century utilitarianism. His vast knowledge of the history of utilitarianism, which he has spent his entire career investigating, makes him the perfect author for this very helpful book on the influences of utilitarianism in early American thought. It is a rich sourcebook that can help direct anyone looking to do more research in this area. Here, Crimmins provides a thorough historical account of the influence of utilitarianism on the development of early American thought and the rise of pragmatism, giving reason to believe that utilitarianism was more impactful on American pragmatism than is often realized.The first chapter highlights why utilitarian influence on American law and politics is overlooked and why it should not be. Some have challenged this Lockean consensus and pointed out that republican virtues drawn from the ancient Greeks and others show up in ideas such as the "right to happiness" (which is a right that is found nowhere in Locke) (20). Crimmins shows that there was a very strong emphasis on "public utility," "general welfare," and happiness, and this frequently outweighed concerns for natural rights for thinkers like Thomas Paine, John Adams, Nathaniel Chipman, Joseph Haven, and many other early American thinkers. Furthermore, utilitarian considerations can be found in the Constitution and federalist papers, and even Tocqueville explained American thinking through the lens of utilitarian concerns.Bentham was ambitious in attempting to promote codification of law in many countries worldwide. While Bentham had made offers (some accepted, some rejected) to help in the codification of law to various countries, ranging from Catherine the Great's Russia to France, Portugal, Spain, and numerous South American countries, he spent much of the last quarter of his life focused on trying to provide his services to the new United States. This chapter argues that the modern understanding of the appeal of utilitarianism does not fit all of the utilitarians. Focusing on the views of Bentham and Rashdall, it begins by discussing the character of Bentham's utilitarianism and his arguments for utilitarianism, and then considers Rashdall's criticisms of deontologists and hedonistic utilitarians.

This rich and provocative study assesses Herbert Spencer's pivotal contribution to the emergence of liberal utilitarianism and shows that Spencer, as much as J. S. Mill, provided liberal utilitarianism with its formative contours. Like Mill, Spencer tried to reconcile a principle of liberty and strong moral rights with a utilitarian, maximizing theory of good. In this powerful and sympathetic account, David Weinstein argues that Spencer's moral and political thought exhibits greater systematic integrity than received views of his thought (...) acknowledge. This thesis aims to provide the appropriate historical context for interpreting John Stuart Mill's Utilitarianism. The central question considered here concerns two views of Mill's intentions for Utilitarianism, and whether the work should be read as Mill arguing for his own version of utilitarianism, or as an ecumenical document expressing and defending the views of many utilitarians. The first view, labeled the orthodox view, as defended by Roger Crisp, is probably the most commonly held view as to (...) how to interpret the document. The second view, labeled the revisionist view, is defended by Daniel Jacobson in a recent article. By examining Mill's place in the history of utilitarianism, his journals, correspondence, and other writings leading up to and after the publication of Utilitarianism, this thesis argues in support of the revisionist position. Furthermore, it is argued that certain portions of the book deserve special consideration apart from other chapters, and this is taken to have implications for the future of research in Mill?s thought. This thesis has four chapters including the first introductory chapter, which outlines the motivations guiding the orthodox and revisionist views. The second chapter provides a general exposition of Utilitarianism, as well as an outline of the primary evidence supporting the orthodox and revisionist positions. The third chapter is a defense of the revisionist position, and it highlights the specific biographical context in which Utilitarianism was composed, as well as evidence from Mill's writings, correspondence, and journals suggesting that he saw the need to write a general defense of the principle of utility and elaborate his theory of justice. This chapter also includes a historiographical analysis of Mill's biographers, which suggests that Utilitarianism is not viewed by Mill's biographers as being especially central to his considered views on utilitarianism. Finally, the chapter includes a section on the early reception and criticisms offered against Utilitarianism, which partly explains why the book has come to be interpreted as it has. The final chapter reviews the evidence for the revisionist position and explains the implications for Mill scholarship in light of the findings of this study. (shrink)

Utilitarianism has a curious history. Its most celebrated founders—Jeremy Bentham and John Stuart Mill—were radical progressives, straddling the worlds of academic philosophy, political science, economic theory and practical affairs. They made innumerable recommendations for legal, social, political and economic reform, often (especially in Bentham’s case) described in fine detail. Some of these recommendations were followed, sooner or later, and many of their radical ideas have become close to articles of faith of western liberalism. Furthermore many of these recommendations (...) were made expressly to improve the condition of the deprived, or of oppressed groups. Yet the moral theory which inspired this reforming zeal is, at least officially, utilitarianism, and when we teach this theory to our students we feel it our duty to point out the horrors that could be justified by any theory which assesses the moral quality of actions in terms of the maximization of good consequences over bad. No consequence is so bad that it cannot, in principle, be outweighed by a large aggregation of smaller goods. Hence there are circumstances in which utilitarianism can require slavery, the punishment of the innocent, and redistribution of resources from the poor to the rich, or from the disabled and the sick to the able bodied and healthy. Indeed, in the right circumstances, it can justify pretty much anything you can think of. For all their intelligence and imagination neither Bentham nor Mill seemed to recognise or discuss these catastrophic possibilities. (shrink)

RULE or restricted utilitarianism is frequently propounded and just as frequently criticized in the literature. Its various refinements initially involve conceptual adjustments such as clarifying the logical relations between some stateable rule of utility and other moral rules or the specification of a criterion for ranking rules in case of conflict and so forth. It soon becomes clear, comparatively speaking, that a cluster of problems involving justice, personal rights and the denotation of ‘intrinsic good’ cannot be resolved without extending (...) rule utilitarianism as a theory of right conduct and justification; thus the origin of the appellation ‘extended’ rule utilitarianism. In this paper I shall: render an interpreted model of rule utilitarianism that possesses all the logical features of alternative interpretations. Describe a style of argument for extending rule utilitarianism to incorporate a rule of distribution. Such an extension preserves the consistency of rule utilitarianism. Mill's essay on utilitarianism is reinterpreted in the light of his psychological theories. his early anonymous essay on bentham helps to define the form of psychological hedonism to which he subscribed, and this in turn explains his views on the relations of virtue and utility.

The denial of the intrinsic value of acts apart from both motives and consequences lies at the heart of Ross’s deontology and his opposition to ideal utilitarianism. Moreover, the claim that acts can have intrinsic value is a staple element of early and contemporary attempts to “consequentialise” all of morality. I first show why Ross’s denial is relevant both for his philosophy and for current debates. Then I consider and reject as inconclusive some of Ross’s explicit and implicit motivations (...) for his claim, stemming from his philosophy of action, his axiology, and his concept of intrinsic value, or a combination of these. I also criticize Ross’s later view that all right acts somehow produce some good, but that the value of some of these goods is explained by the prior rightness of the act. In the course of the discussion, the idea that acts can have intrinsic value apart from motives and consequences gains credibility both from the weaknesses in Ross’s arguments and from some putative examples. So, finally, I distinguish two attitudes in the history of ideal utilitarianism towards the necessity or not to give a detailed account of the intrinsic value of acts, and suggest that a Why Bother attitude is more promising than a Constructive one. This paper provides the first systematic interpretation of the moral theory developed in Newcome’s Enquiry Into the Evidence of the Christian Religion (1728, revised 1732). More importantly, it shows that Newcome’s views constitute a valuable but overlooked contribution to the development of utilitarianism. Indeed, she is arguably the first utilitarian. Her ethical views are considered in two stages. The paper first explores her hedonist approach to the good and then turns to her consequentialist account of right action. The paper (...) then situates Newcome’s work within the context of the pre-Bentham utilitarian movement. Strikingly, Newcome lived and worked in close proximity to other prominent early utilitarians and was well-positioned to have exerted an influence on the development of their views. Newcome has never been discussed in connection with the history of ethics. This paper constitutes an argument for her inclusion in our narratives about the development of a major moral theory. This article is an attempt to take an overview of the current position of utilitarian theory. It begins by providing a definition of utilitarianism as it is found in the works of Bentham, Mill and Sidgwick. These authors are all interpreted as intuitionists. It is claimed that the main rivals to utilitarianism are egoism on the one hand, and reflective non-egoistic pluralism, as found in the work of Ross, on the other. Call for Paper The 2014 publication of three of Jeremy Bentham’s extensive manuscript papers on sexual nonconformity as _ Of Sexual Irregularity and Other Writings on Sexual Morality _ has inspired a wide range of new scholarship on the relationship between utilitarianism and queer theory and history. Bentham’s sexual nonconformity papers demonstrate that the experiences of pleasure and pain are individual to each person, and thus, "the greatest happiness of the greatest number" necessitates the maximal toleration of as (...) many experiences of happiness as there are persons, rather than a normative or hierarchical delineation of acceptable forms of happiness. Bentham asserts that differences in sexuality and gender must be accounted for in epistemology, law, moral philosophy, aesthetics, and theology, and addresses these differences in the context of oppression on the basis of race, gender, class, religious dissent, disability, and animal species.
