In the past 50 years, an ethical-legal boundary has been drawn between treatment and research. It is based on the reasoning that the two activities pursue different purposes. Treatment is aimed at achieving optimal therapeutic benefits for the individual patient, whereas the goal of scientific research is to increase knowledge, in the public interest. From this viewpoint, the patient’s experience should be clearly distinguished from that of a participant in a clinical trial. On this premise, two parallel and mutually exclusive (...) regimes have been established. Yet in the case of deep brain stimulation (DBS), this presentation is a poor fit, for both the patient’s lived experience and medical practice and research. The frictions may be explained by the specificities of the treatment (including surgery and medical devices) and of the pathologies concerned (chronic and evolutive), and by the characteristics of the medical team implementing the treatment. These particularities challenge the dominant frame of reference in medical bioethics and cause difficulties for the current legal framework in fulfilling its dual role: to protect patients while supporting the development of innovative treatments. The dominant model is still the clinical trial for medication safety and legal requirements of drug market regulation. However, DBS forces us to reflect on a medical device that is permanently implanted in the brain by highly specialized multi-disciplinary neurosurgical teams, for the treatment of chronic evolutive diseases. These devices demand fine-tuning on a case-by-case basis and there is still a lot to discover about why DBS is effective (or not). As a result, the wall between treatment and research is osmotic: many discoveries are made incidentally, in the course of treatment. The following study begins with these observations, and suggests that we review legal provisions (especially in French and United States law) so that they are better adapted to the first-person needs and experience of the patient undergoing brain stimulation. Deep brain stimulation (DBS) is an approved treatment for neurological diseases and a promising one for psychiatric conditions, which may produce spectacular results very quickly. It is also a powerful tool for brain research and exploration. Beyond an overview of the ethical and legal literature on this topic, this paper aims at showing that DBS is a compelling example for ethical-legal reflection, as it combines a highly technical surgical procedure, a complex active medical device and neuromodulation of the human brain (...) to restore lost abilities caused by a chronic and evolving disease. Some of the ethical and legal issues raised by DBS are not specific, but shed new light on medical ethics and law. Others are more DBS-specific, as they are linked to the intricacies of research and treatment, to the need to tune the device, to the patients’ control over the device and its effects and to the involvement of family caregivers. The techno-scientific development has no frontier, but the legal systems still take roots in local and cultural references. French Law is built on a continental model and conveys values and preferences of the French population, including an essential role given to the State and to textual requirements. Until now, French law has been modified to cope with new and emerging technologies issues with the idea that they can be taken one after the other, on the fringes of the classic legal (...) problems. Do the announcement of a convergence between Nanotechnologies, Biotechnologies, the sciences of Information and Cognition (NBIC) change the situation? According to “converging technologies” partisans, a lot of other deep perturbations may occur. Therefore, it could be pertinent to assess the legal implications of NBIC convergence. But trying to do so, a French legal scholar may first feel (and express) perplexity. What is the “convergence NBIC”? To answer, do we have to wonder which reality hides behind the expression or is it necessary to admit that the speeches are here more important to analyze than a hypothetical realization? Does it imply new legal questions? Do we need new methods to enlighten what is at stake? Is it a new challenge, stimulating the imagination of lawyers and legal scholars, or, on the contrary, is it a new illustration of the Economy of the promises, revealing big risks of vain (or inappropriate) intellectual and normative production? This article is dedicated to enlighten the important difficulties which mark out the road towards the answers to the legal questions raised by the “NBIC convergence”. (shrink)

After reviewing the literature on current knowledge about consciousness in humans, we present a state-of-the art discussion on consciousness and related key concepts in animals. Obviously much fewer publications are available on non-human species than on humans, most of them relating to laboratory or wild animal species, and only few to livestock species. Human consciousness is by definition subjective and private. Animal consciousness is usually assessed through behavioural performance. Behaviour involves a wide array of cognitive processes that have to be (...) assessed separately using specific experimental protocols. Accordingly, several processes indicative of the presence of consciousness are discussed: perception and cognition, awareness of the bodily-self, self-related knowledge of the environment (including social environment). When available, specific examples are given in livestock species. Next, we review the existing evidence regarding neuronal correlates of consciousness, and emphasize the difficulty of linking aspects of consciousness to specific neural structures across the phyla because high-level cognitive abilities may have evolved independently along evolution. Several mammalian brain structures (cortex and midbrain) are involved in the manifestations of consciousness, while the equivalent functional structures for birds and fishes would likely be the pallium/tectum and midbrain. Caution is required before excluding consciousness in species not having the same brain structures as the mammalian ones as different neural architectures may mediate comparable processes. Finally, specific neurophysiological mechanisms appear to be strongly linked to the emergence of consciousness, namely neural synchrony and neural feedback. Considering the limited amount of data available and the few animal species studied so far, we conclude that different manifestations of consciousness can be observed in animals but that further refinement is still needed to characterize their level and content in each species. Further research is required to clarify these issues, especially in livestock species. (shrink)

We begin this article by delineating the explanatory gaps left by prevailing gene‐focused approaches in our understanding of phenotype determination, inheritance, and the origin of novel traits. We aim not to diminish the value of these approaches but to highlight where their implementation, despite best efforts, has encountered persistent limitations. We then discuss how each of these explanatory gaps can be addressed by expanding research foci to take into accountbiological agency—the capacity of living systems at various levels to participate in (...) their own development, maintenance, and function by regulating their structures and activities in response to conditions they encounter. Here we aim to define formally what agency and agents are and—just as importantly—what they are not, emphasizing that agency is an empirical property connoting neither intention nor consciousness. Lastly, we discuss how incorporating agency helps to bridge explanatory gaps left by conventional approaches, highlight scientific fields in which implicit agency approaches are already proving valuable, and assess the opportunities and challenges of more systematically incorporating biological agency into research programs. The COVID-19 outbreak has ravaged all societal domains, including education. Home confinement, school closures, and distance learning impacted students, teachers, and parents’ lives worldwide. In this study, we aimed to examine the impact of COVID-19-related restrictions on Italian and Portuguese students’ academic motivation as well as investigate the possible buffering role of extracurricular activities. Following a retrospective pretest–posttest design, 567 parents reported on their children’s academic motivation and participation in extracurricular activities. We used a multi-group latent change score model to (...) compare Italian and Portuguese students’: pre-COVID mean motivation scores; rate of change in motivation; individual variation in the rate of change in motivation; and dependence of the rate of change on initial motivation scores. Estimates of latent change score models showed a decrease in students’ motivation both in Italy and in Portugal, although more pronounced in Italian students. Results also indicated that the decrease in students’ participation in extracurricular activities was associated with changes in academic motivation. Furthermore, students’ age was significantly associated with changes in motivation. No significant associations were found for students’ gender nor for parents’ education. This study provides an important contribution to the study of students’ academic motivation during home confinement, school closures, and distance learning as restrictive measures adopted to contain a worldwide health emergency. We contend that teachers need to adopt motivation-enhancing practices as means to prevent the decline in academic motivation during exceptional situations. (shrink)

Aesthetic properties figure prominently in our daily lives, our conversations and many actions we take. Yet theoretical disagreement prevails over their nature, their variety, their epistemic and metaphysical status. This overview highlights the heterogeneity of aesthetic properties and examines repercussions for explanation. Aesthetic properties belong to natural objects or scenes, to artworks in any medium, to artefacts and built environments across historical eras; and they draw a wide variety of responses such as our perceptions, emotions or imaginative thought. Historicism about (...) artworks carries over to at least some aesthetic properties that depend on facts of their broader historical context just as works do. One issue is whether aesthetic properties can be demarcated solely in terms of non-aesthetic properties. If not, explanations of aesthetic properties need to draw on other aesthetic notions such as aesthetic experience, attention, judgement or value. The paper examines several accounts of aesthetic value to show how they extend to aesthetic properties. The paper concludes with an overview of the current metaphysical debate between realists and non-realists about aesthetic properties. (shrink)

IntroductionIn November of 1785, Kant published a highly unsympathetic review of the second part of Johann Gottfried Herder'sIdeas for a Philosophy of the History of Mankind. Herder had once been Kant's pupil, and had greatly admired his teacher, but the content of this review shows how profound the philosophical differences between them had by then become. A central area of dispute emerging from the review concerns the nature of happiness, and its place within the ‘destiny’ or ‘vocation’ of the human (...) race. Kant is responding, in particular, to a section of theIdeasentitled: ‘The happiness of human beings is everywhere an individual good; consequently, it is everywhere climatic and organic, a child of practice, tradition, and custom.’ Although Kant is not mentioned by name in this section, it clearly contains critical rejoinders, often quite harsh in tone, to aspects of his practical philosophy and philosophy of history, as Herder understands them. Simone de Beauvoir and the Politics of Ambiguity is the first full-length study of Beauvoir's political thinking. Best known as the author of The Second Sex, Beauvoir also wrote an array of other political and philosophical texts that together, constitute an original contribution to political theory and philosophy. Sonia Kruks here locates Beauvoir in her own intellectual and political context and demonstrates her continuing significance. Beauvoir still speaks, in a unique voice, to many pressing questions concerning politics: the values (...) and dangers of liberal humanism; how oppressed groups become complicit in their own oppression; how social identities are perpetuated; the limits to rationalism; and the place of emotions, such as the desire for revenge, in politics. In discussing such matters Kruks puts Beauvoir's ideas into conversation with those of many contemporary thinkers, including feminist and race theorists, as well as with historical figures in the liberal, Hegelian, and Marxist traditions. Beauvoir's political thinking emerges from her fundamental insights into the ambiguity of human existence. Combining phenomenological descriptions with structural analyses, she focuses on the tensions of human action as both free and constrained. To be human is to be a paradoxical being, at once capable of free choice and yet, because embodied, vulnerable to injury from others. Politics is thus a domain of complexly interwoven, multiple, human interactions that is rife with ambiguity, and where freedom and violence too often closely intertwine. Beauvoir accordingly argues that failure is a necessary part of political action. However, she also insists that, while acknowledging this, we should assume responsibility for the outcomes of what we do. (shrink)

This article explores gender inequities and sexual double standards in teens’ digital image exchange, drawing on a UK qualitative research project on youth ‘sexting’. We develop a critique of ‘postfeminist’ media cultures, suggesting teen ‘sexting’ presents specific age and gender related contradictions: teen girls are called upon to produce particular forms of ‘sexy’ self display, yet face legal repercussions, moral condemnation and ‘slut shaming’ when they do so. We examine the production/circulation of gendered value and sexual morality via teens’ discussions (...) of activities on Facebook and Blackberry. For instance, some boys accumulated ‘ratings’ by possessing and exchanging images of girls’ breasts, which operated as a form of currency and value. Girls, in contrast, largely discussed the taking, sharing or posting of such images as risky, potentially inciting blame and shame around sexual reputation (e.g. being called ‘slut’, ‘slag’ or ‘sket’). The daily negotiations of these new digitally mediated, heterosexualised, classed and raced norms of performing teen feminine and masculine desirability are considered. (shrink)

The standards for translating texts in specialized fields have become particularly rigorous with the increasing complexity of material and growing demand for its translation. While translations simply aimed at communication and produced by machine translation are proliferating, the need for reliable and high-quality translations is also increasing. The demand for expert-dependable legal translation is higher than ever, requiring competence-based training in the field of legal translation. This paper describes a guided-task framework for developing subject area competence at the earliest stage (...) of an English–Arabic legal translation course. It presents the three most problematic phases of concept processing in legal translation in terms of: legal systems; branches of law; and genre-based phraseology. The approach presented below is part of a more general study that aims to describe the first course in a series of three graduate courses on legal translation, each of them motivated by a guided-task framework that has the aim of developing three specific competences in legal translation: legal concept processing => subject area competence; documentary research => instrumental competence; and legal rhetorics => communicative and textual competence. In this paper we intend to focus on the first course of legal concept processing as a key prerequisite for legal knowledge development. We illustrate the relevance of addressing specific variables when analysing legal concepts in the text that is to be translated, before proceeding to the information search and communication, according to established formulae and conventions. With the shift toward online environments due to COVID-19 pandemic, particularly for educational sector, employees’ performance has been affected by an array of different factors. Personal aspects as well as organizational focus on individuals’ wellbeing are the main focus of this study through inclusion of job autonomy and work-life conflict alongside other factors, such as informational support that can aid academic staff regarding their wellbeing during times of crisis. In response to the effects of COVID-19 on employees, this study aims (...) to provide tangible data to protect university teachers during crises and establish key points that can improve their wellbeing. For this purpose, we used interviews to provide in-depth understanding of the subject. A total of 16 teachers as interviewees have provided qualitative data that was analyzed with MAXQDA. This study highlights the importance of work-life conflict and vitality of job autonomy on academic staffs’ performance and overall wellbeing through a conceptual analysis. We emphasize the role of organizations in maintaining a work environment where university teachers’ wellbeing is prioritized and various elements such as training and support are used to help stabilizing work-life balance. The current findings can be beneficial for both scholars and decision-makers in schools and universities to enhance elements of remote work for their staff. (shrink)

This study focuses on retraction notices from two major Latin American/caribbean indexing databases: SciELO and LILACS. SciELO includes open scientific journals published mostly in Latin America/the Caribbean, from which 10 % are also indexed by Thomson Reuters Web of Knowledge Journal of Citation Reports. LILACS has a similar geographical coverage and includes dissertations and conference/symposia proceedings, but it is limited to publications in the health sciences. A search for retraction notices was performed in these two databases using the keywords “retracted”, (...) “retraction” “withdrawal”, “withdrawn”, “removed” and “redress”. Documents were manually checked to identify those that actually referred to retractions, which were then analyzed and categorized according to the reasons alleged in the notices. Dates of publication/retraction and time to retraction were also recorded. Searching procedures were performed between June and December 2014. Thirty-one retraction notices were identified, fifteen of which were in JCR-indexed journals. “Plagiarism” was alleged in six retractions of this group. Among the non-JCR journals, retraction reasons were alleged in fourteen cases, twelve of which were attributed to “plagiarism”. The proportion of retracted articles for the SciELO database was approximately 0.005 %. The reasons alleged in retraction notices may be used as signposts to inform discussions in Latin America on plagiarism and research integrity. At the international level, these results suggest that the correction of the literature is becoming global and is not limited to mainstream international publications. (shrink)

This series presents issues which are central to 20th-century European thought, but unfamiliar to students of Anglo-American philosophy. In this book the author traces the development of the concept of situation through the work of Gabriel Marcel, Sartre, Simone de Beauvoir and Merleau-Ponty.

In recent years, the changing landscape for the conduct and assessment of research and of researchers has increased scrutiny of the reward systems of science. In this context, correcting the research record, including retractions, has gained attention and space in the publication system. One question is the possible influence of retractions on the careers of scientists. It might be assessed, for example, through citation patterns or productivity rates for authors who have had one or more retractions. This is an emerging (...) issue today, with growing discussions in the research community about impact. We have explored the influence of retractions on grant review criteria. Here, we present results of a qualitative study exploring the views of a group of six representatives of funding agencies from different countries and of a follow-up survey of 224 reviewers in the US. These reviewers have served on panels for the National Science Foundation, the National Institutes of Health, and/or a few other agencies. We collected their perceptions about the influence of self-correction of the literature and of retractions on grant decisions. Our results suggest that correcting the research record, for honest error or misconduct, is perceived as an important mechanism to strengthen the reliability of science, among most respondents. However, retractions and self-correcting the literature at large are not factors influencing grant review, and dealing with retractions in reviewing grants is an open question for funders. (shrink)

In the light of a renewed interest today in forms of direct political participation, this paper explores the contributions of Sartre and Arendt to defending direct political action as an intrinsically valuable form of human freedom. Both thinkers note, however, that such forms of action and the ‘spaces of freedom’ in which they become possible are always fleeting and transitory. The paper argues that Sartre's account of the ways in which human action is always mediated and alienated by materiality is (...) important in accounting for this phenomenon. (shrink)

Drawing on managerial discretion and conflicting institutional logics literature, this study investigates the relation between the personal sustainability behaviors of owner–managers and the corporate sustainability practices of SMEs. The research proposes a contingency model that assesses the moderating effects of perceived economic advantages and environmental hostility on this relationship. Based on linear hierarchical multiple regression analyses of a cross-sectoral sample of French SMEs, the results suggest a positive influence of the manager's PSB on the SME's CS practices that appears to (...) be differently moderated depending on the type of practice considered. The influence on environmental practices is fostered through the perception of economic advantages. The influence on workplace practices is only effective when the business environment is deemed benign and the influence on community practices is dampened by the perception of environmental hostility. Highlighting the trade-off between the manager's personal values and the SME's economic constraints, these findings contribute to a better understanding of the critical antecedents of sustainability in small businesses. Herder is often criticized for having embraced cultural relativism, but there has been little philosophical discussion of what he actually wrote about the nature of the human species and its differentiation through culture. This book focuses on Herder's idea of culture, seeking to situate his social and political theses within the context of his anthropology, metaphysics, epistemology, ethics, theory of language and philosophy of history. It argues for a view of Herder as a qualified relativist, who combined the conception of (...) a common human nature with a belief in the importance of culture in developing and shaping that nature. Especially highlighted are Herder's understanding of the relativity of virtue and happiness, and his belief in the impossibility of constructing a single best society. The book will appeal to a wide range of readers interested both in Herder and in Enlightenment culture more generally. (shrink)

Meaningful social interactions and regular physical activity are inversely associated with loneliness. Using a mixed-methods research design employing quantitative and qualitative research approaches, this research aimed to explore loneliness, physical activity, friendship, and experiences relating to the COVID-19 pandemic both prior to and during the pandemic. Quantitative data of n = 363 first-year university students assessed in 2018/2019 and of n = 175 individuals aged 18–29 years assessed in 2020 were gathered using independent self-administered online surveys. In addition, n = (...) 4 students were recruited for semi-structured, qualitative interviews in 2020 during the onset phase of the COVID-19 pandemic. Correlation and regression analyses as well as analyses of variance were conducted. Thematic analysis as a qualitative method was used to explore the role physical activity, friendship, and social interactions played in loneliness, particularly in times of social isolation and social distancing. Results revealed associations of varying strength between physical activity and loneliness in 2018/2019 and 2020. Analyses of qualitative data revealed three main themes: the lack of deep friendships at university, the positive perceived impact of team sports on feelings of loneliness, and the need for real connection in times of crisis. Thus, with regard to feelings of loneliness during the pandemic, being physically active seems to be a small but potentially relevant factor among young individuals. The qualitative study suggests that first-year university students might buffer the lack of deep friendships and meaningful interactions by building social bonds in team sports. In times of physical distancing, young individuals vulnerable to loneliness may therefore require special support such as doing sports with physical distance and perceiving connected with their team for instance by digital devices and emotional coping. The widespread use of social network sites by children has significantly reconfigured how they communicate, with whom and with what consequences. This article analyzes cross-national interviews and focus groups to explore the risky opportunities children experience online. It introduces the notion of social media literacy and examines how children learn to interpret and engage with the technological and textual affordances and social dimensions of SNSs in determining what is risky and why. Informed by media literacy research, a social developmental pathway (...) is proposed according to which children are first recipients, then participants, and finally actors in their social media worlds. The findings suggest that SNSs face children with the fundamental question of what is real or fake. By around 11–13, they are more absorbed by the question of what is fun, even if it is transgressive or fake. By age 14–16, the increasing complexity of their social and emotional lives, as well as their greater maturity, contributes to a refocusing on what is valuable for them. Their changing orientation to social networking online appears to be shaped by their changing peer and parental relations, and has implications for their perceptions of risk of harm. (shrink)

En novembre 1984, Christa Wolf ouvrait la première conférence de l'association des gynécologues psy-chosomaticiens de RDA réunis à Mag-Debourg. Dans son discours intitulé "Maladie et privation d'amour", elle s'interrogeait sur l'évolution de la médecine moderne dont les progrès en matière d'appareils médicaux éloignaient toujours davantage les praticiens de leurs patients. Par-delà son regard sur la relation entre l'âme et le corps, Christa Wolf informait aussi des attentes des femmes qui avaient pris au mot les promesses d'égalité des sexes en régime (...) "socialiste réel". Quelques années plus tôt Georges Canguilhem, résistant au scientisme triomphant, se proposait de continuer à penser la médecine comme un art qui devait s'adapter à chaque individu malade.
