:A norm of equal treatment is cited regularly in the American jurisprudence of property “takings” under the Fifth and Fourteenth Amendments to the Constitution, as a benchmark of fair treatment of owners. According to an increasingly prevalent version of this equality norm, courts should look to parity of treatment among property owners in investigating whether particular regulations “take” property. This essay argues, however, that such an equality norm is misplaced, and that courts should judge fairness by the criterion of expectation—including (...) reasonable expectations of regulation.A norm of equality becomes problematic in the face of the economic theory of the evolution of property. This theory posits that as resources become more congested, their uses carry increasing common pool costs or “externalities”—a scenario that should predictably result in more stringent resource management—up to and including the establishment of regulatory regimes as well as property rights themselves. This evolutionary pattern, however, places earlier and later resource users in different positions vis-à-vis both common pool externalities and regulatory responses, and their different temporal positions fragment the meaning of equal treatment and destabilize it as a jurisprudential norm. This essay argues that while equal treatment may be a benchmark for special or invidious cases, like those relating to civil rights, the great bulk of takings cases involve regulatory responses to congesting resources, where a norm of equal treatment breaks down. Thus, in seeking fair treatment, takings jurisprudence should downplay equality and instead look to the understanding of property as a basis of expectations—but those expectations should include the anticipation of reasonable regulatory responses to resource congestion. The term “listening niche” refers to the contexts in which people listen to music including what music they are listening to, with whom, when, where, and with what media. The first experiment investigates undergraduate students’ music listening niches in the initial COVID-19 lockdown period, 4 weeks immediately after the campus shut down abruptly. The second experiment explores how returning to a hybrid semester, the “new normal,” further affected these listening habits. In both experiments, the participants provided a list of their (...) most frequently listened-to songs during the respective period of time. From these, they identified one song that seemed most associated with this period, their “signature song,” and stated why this song seemed relevant. These reasons were coded on nine underlying themes. Three clusters were found to underlie the themes: emotional responses memory associations, and discovery of new music. We identified songs and reasons for selecting them that represented the three clusters and related these to the lyrical content. Compared to before the pandemic, participants in both experiments report listening more in general and on Spotify, but there were no differences in listening between lockdown and the new normal. Whom they were listening with shifted overtime from family members to significant others and finally to other friends and roommates. These results demonstrate how students listen to and find new music that is meaningful to them during this unprecedented pandemic. (shrink)

As more and more firms operate globally, an understanding of the effects of cultural differences on ethical decision making becomes increasingly important for avoiding potential business pitfalls and for designing effective international marketing management programs. Although several articles have addressed this area in general, differences along specific, cultural dimensions have not been directly examined. Hence, the purpose of this study was to examine differences in ethical decision making within Hofstede's cultural framework. The results confirm the utility of Hofstede's cultural dimensions (...) and place ethical decision making within an overall theoretical framework. Sales agents from a high power distance, uncertainty avoidant, Confucian, collectivist culture (i.e., Taiwan) placed more value on company and fellow employee interests (vis-à-vis self interests) than did managers from a masculine, individualistic culture (i.e., the United States). American and Taiwanese managers did not differ in their deontological norms or on the importance that they placed on customer interests. Effective human–robot teaming increasingly requires humans to work with intelligent, autonomous machines. However, novel features of intelligent autonomous systems such as social agency and incomprehensibility may influence the human’s trust in the machine. The human operator’s mental model for machine functioning is critical for trust. People may consider an intelligent machine partner as either an advanced tool or as a human-like teammate. This article reports a study that explored the role of individual differences in the mental model in a simulated (...) environment. Multiple dispositional factors that may influence the dominant mental model were assessed. These included the Robot Threat Assessment, which measures the person’s propensity to apply tool and teammate models in security contexts. Participants were paired with an intelligent robot tasked with making threat assessments in an urban setting. A transparency manipulation was used to influence the dominant mental model. For half of the participants, threat assessment was described as physics-based ; the remainder received transparency information that described psychological cues. We expected that the physics-based transparency messages would guide the participant toward treating the robot as an advanced machine, while psychological messaging would encourage perceptions of the robot as acting like a human partner. We also manipulated situational danger cues present in the simulated environment. Participants rated their trust in the robot’s decision as well as threat and anxiety, for each of 24 urban scenes. They also completed the RoTA and additional individual-difference measures. Findings showed that trust assessments reflected the degree of congruence between the robot’s decision and situational danger cues, consistent with participants acting as Bayesian decision makers. Several scales, including the RoTA, were more predictive of trust when the robot was making psychology-based decisions, implying that trust reflected individual differences in the mental model of the robot as a teammate. These findings suggest scope for designing training that uncovers and mitigates the individual’s biases toward intelligent machines. (shrink)

The Indian religious scene, however, is characterized by not only religions which originated in India but also by religions which entered India from outside India and made their home here. Thus religious life in India has been enlivened throughout its history by the presence of religions of foreign origin on its soil almost from the very time they came into existence. This volume covers (...) three such religions—Zoraoastrianism, Judaism, and Islam. In the case of Zoraostianism, even its very beginnings are intertwined with India, as Zoroastrianism reformed a preexisting religion which had strong links to the Vedic heritage of India. This relationship took on a new dimension when a Zoroastrian community, fearing persecution in Persia after its Arab conquest, sought shelter in western India and ultimately went on to produce India’s pioneering nationalist in the figure of Dadabhai Naoroji ( 1825-1917), also known as the Grand Old Man of India. Jews found refuge in south India after the destruction of the Temple by the Romans in 70 C.E. and have remained a part of the Indian religious scene since then, some even returning to Israel after it was founded in 1948. Islam arrived in Kerala as soon as it was founded and one of the earliest mosques in the history of Islam is found in India. Islam differs from the previously mentioned religions inasmuch as it went on to gain political hegemony over parts of the country for considerable periods of time, which meant that its impact on the religious life of the subcontinent has been greater compared to the other religions. It has also meant that Islam has existed in a religiously plural environment in India for a longer period than elsewhere in the world so that not only has Islam left a mark on India, India has also left its mark on it. Background Healthcare leader support and facilitation for ethics work are of great importance for healthcare professionals’ handling of ethical issues, moral distress, and quality care provision. A digital tool for ethical reflection in long-term care was developed in response to the demand for appropriate tools. Research aim This study aimed to explore healthcare leaders’ expectations of using a digital tool for ethical reflection among their home nursing care staff. Research design A qualitative research design with vignettes and focus group (...) interviews was used. The data were analyzed using reflexive thematic analysis. Participants and Research Context The sample comprised ten healthcare leaders from municipal long-term care in Norway. Ethical Considerations Participation was voluntary and based on informed consent. The Norwegian Agency for Shared Services in Education and Research approved this study. Findings The analysis resulted in the development of three themes representing leaders’ expectations of the tool: (i) giving staff a voice, (ii) revealing ethics in practice, and (iii) keeping the pot boiling. Discussion Leaders must be informed about the ethical issues experienced to engage in supportive measures for their staff. Digital channels can increase the democratization, safety, and efficiency of communication between employees and leaders and increase awareness of ethical aspects in daily care work. The leaders had positive expectations of employees’ activities and benefits from using the tool for ethical reflection. However, they admitted that realizing the tool’s potential to ensure continuity in ethics work requires considerable organizational and leader involvement. Conclusions This study shows that healthcare leaders are open to digital solutions for managing ethics work in home nursing care. Both opportunities and important prerequisites for successfully implementing the digital tool were identified. (shrink)

This book is an essential starting place for those intrigued by what new theoretical accounts of materiality, posthumanism, and affect can offer educational research. After #MeToo, academics have become increasingly focused on the liberal concept of consent. Either problematized as a means of distinguishing between sex and rape, or vaunted as a tool for having better sex, consent remains central to discussions of sexual violence. Returning to Andrea Dworkin’s thought, this article argues that contemporary feminists must move beyond consent and recenter the problem of violence to theorize rape. Dworkin, alongside Catharine MacKinnon and Carole Pateman, critiques consent for disguising the violence of rape, sex, (...) and pornography. By defining violence as a process of objectification, Dworkin exposes rape, pornography, and most controversially, consensual heterosexual intercourse as “a new kind of death.” She, in turn, calls for the feminist exercise of violence as a tactic of disclosure that promises to make visible patriarchal violence hidden by consent and sexualization. Moving beyond consent to recenter the problem of violence, I conclude, opens up new avenues for feminist action and brings into view the seemingly unthinkable possibility of a world without rape. Relationships are central to enacting person‐centred care of the older person with cognitive impairment. A fuller understanding of relationships and the role they play facilitating wellness and preserving personhood is critical if we are to unleash the productive potential of nursing research and person‐centred care. In this article, we target the acute care setting because much of the work about relationships and older people with cognitive impairment has tended to focus on relationships in long‐term care. The acute care setting (...) is characterized by archetypal constraints which differentiate it from long‐term care, in terms of acuity and haste, task‐orientated work patterns and influence from “the rule of medicine,” all of which can privilege particular types of relating. In this article, we drew on existing conceptualizations of relationships from theory and practice by tapping in to the intellectual resources provided by nurse researchers, the philosophy of Martin Buber and ANT scholars. This involved recounting two examples of dyadic and networked relationships which were re‐interpreted using two complementary theoretical approaches to provide deeper and more comprehensive conceptualizations of these relationships. By re‐presenting key tenets from the work of key scholars on the topic relationships, we hope to hasten socialization of these ideas into nursing into the acute care setting. First, by enabling nurses to reflect on how they might work toward cultivating relationships that are more salutogenic and consistent with the preservation of personhood. Second, by stimulating two distinct but related lines of research enquiry which focus on dyadic and networked relationships with the older person with cognitive impairment in the acute care setting. We also hope to reconcile the schism that has emerged in the literature between preferred approaches to care of the older person with cognitive impairment, that is person‐centred care versus relationship‐centred care by arguing that these are complementary rather than mutually exclusive and can be brought together in one theoretical framework acknowledging personhood as relational in essence. In earlier work ( Cleland [2001] , [2002]), I sketched an account of the structure and justification of ‘prototypical’ historical natural science that distinguishes it from ‘classical’ experimental science. This article expands upon this work, focusing upon the close connection between explanation and justification in the historical natural sciences. I argue that confirmation and disconfirmation in these fields depends primarily upon the explanatory (versus predictive or retrodictive) success or failure of hypotheses vis-à-vis empirical evidence. The account of historical explanation that (...) I develop is a version of common cause explanation. Common cause explanation has long been vindicated by appealing to the principle of the common cause. Many philosophers of science (e.g., Sober and Tucker) find this principle problematic, however, because they believe that it is either purely methodological or strictly metaphysical. I defend a third possibility: the principle of the common cause derives its justification from a physically pervasive time asymmetry of causation (a.k.a. the asymmetry of overdetermination). I argue that explicating the principle of the common cause in terms of the asymmetry of overdetermination illuminates some otherwise puzzling features of the practices of historical natural scientists. A common early narrative that arose as people struggled to cope with their new lives under COVID-19 centered on a platitude about the pandemic being “the great leveler.” But the pretense that we are equally vulnerable—or that we’re “alone together” across lines of race, gender, and class—was a comforting lie. Chronicling the timeline of media talking points seen over the past few months, I argue that social privilege continues to structure the narratives many people use to process life under the (...) pandemic, even while material conditions are much worse for those not in charge of these narratives. At the same time, however, I argue that the pandemic might be setting the stage for genuinely new collective responses to social inequalities, including the long-overdue uprisings inspired by the Black Lives Matter movement. Did Freud present a scientific hypothesis about the unconscious, as he always maintained and as many of his disciples keep repeating? This question has long prompted debates concerning the legitimacy and usefulness of psychoanalysis, and it is of utmost importance to Lacanian analysts, whose main project has been to stress Freud's scientific grounding. Here Jacques Bouveresse, a noted authority on Ludwig Wittgenstein, contributes to the debate by turning to this Austrian-born philosopher and contemporary of Freud for a candid assessment (...) of the early issues surrounding psychoanalysis. Wittgenstein, who himself had delivered a devastating critique of traditional philosophy, sympathetically pondered Freud's claim to have produced a scientific theory in proposing a new model of the human psyche. What Wittgenstein recognized--and what Bouveresse so eloquently stresses for today's reader--is that psychoanalysis does not aim to produce a change limited to the intellect but rather seeks to provoke an authentic change of human attitudes. The beauty behind the theory of the unconscious for Wittgenstein is that it breaks away from scientific, causal explanations to offer new forms of thinking and speaking, or rather, a new mythology. Offering a critical view of all the texts in which Wittgenstein mentions Freud, Bouveresse immerses us in the intellectual climate of Vienna in the early part of the twentieth century. Although we come to see why Wittgenstein did not view psychoanalysis as a science proper, we are nonetheless made to feel the philosopher's sense of wonder and respect for the cultural task Freud took on as he found new ways meaningfully to discuss human concerns. Intertwined in this story of Wittgenstein's grappling with the theory of the unconscious is the story of how he came to question the authority of science and of philosophy itself. While aiming primarily at the clarification of Wittgenstein's opinion of Freud, Bouveresse's book can be read as a challenge to the French psychoanalytic school of Lacan and as a provocative commentary on cultural authority. Aristotle’s account of kingship in Politics 3 responds to the rich discourse on kingship that permeates Greek political thought (notably in the works of Herodotus, Xenophon and Isocrates), in which the king is the paradigm of virtue, and also the instantiator and guarantor of order, linking the political microcosm to the macrocosm of the universe. Both models, in separating the individual king from the collective citizenry, invite further, more abstract thought on the importance of the king in the foundation of (...) the polity, whether the king can be considered part of, or separate from, the polis, and the relationship between polis and universe. In addressing these aspects of kingship theories, Aristotle explores a ‘metaphysics of monarchy’, part of the long-running mereological problem of parts and wholes in the construction of the polis, and connecting his account of kingship to his thought on citizenship and distributive justice within the polis. The question ‘what is life?’ has long been a source of philosophical debate and in recent years has taken on increasing scientific importance. The most popular approach among both philosophers and scientists for answering this question is to provide a “definition” of life. In this article I explore a variety of different definitional approaches, both traditional and non-traditional, that have been used to “define” life. I argue that all of them are deeply flawed. It is my contention that a (...) scientifically compelling understanding of the nature of life presupposes an empirically adequate scientific theory (vs. definition) of life; as I argue, scientific theories are not the sort of thing that can be encapsulated in definitions. Unfortunately, as I also discuss, scientists are currently in no position to formulate even a tentative version of such a theory. Recent discoveries in biology and biochemistry have revealed that familiar Earth life represents a single example that may not be representative of life. If this is the case, life on Earth today provides an empirically inadequate foundation for theorizing about life considered generally. I sketch a strategy for procuring the needed additional examples of life without the guidance of a definition or theory of life, and close with an application to NASA’s fledgling search for extraterrestrial life. The Hawke and Keating Labor governments have tended to practise a politics of inclusion in which women, along with other social groups, are seen to have an important part to play in building the new, internationally competitive Australian economy of the twenty-first century, Australian politics have therefore had a very different nature from that of the more exclusionary politics practised by British Conservative governments. While the politics of inclusion have given feminists room for manoeuvre, and facilitated some positive developments in (...) areas such as affirmative action and childcare policies, feminists have had little success in challenging the overall direction of the governments’ right-wing economic policies. Furthermore, the ‘economic’ has functioned as a meta-category which dissolves difference and conflict. The Australian experience therefore has both practical and theoretical implications for British feminists who may be experiencing a Labour government themselves before too long. (shrink)

German human rights campaigner Karl Heinrich Ulrichs advocated for same-sex marriage in the nineteenth century. Over a century later, we still have a long way to go. Arguing before his time, he took the Church, both Catholic and Protestant, head on. Ulrichs’s insights seem to have been all but forgotten. No one, to my knowledge, has invoked Ulrichs in contemporary debates about same-sex marriage, and yet he expertly diagnosed the problem and proposed a solution: start with the Church. Estelle Carol The Chicago Women’s Graphics Collective: A Memoir In 1973, the Chicago Women’s Graphics Collective worked in an old run-down second-floor office on Belmont Avenue, which we shared with the main offices of the Chicago Women’s Liberation Union (CWLU).1 They call it New Town now, but in 1973, there wasn’t much new about it. We (...) weren’t the only artists in the building though; downstairs was a tattoo parlor. Still, it was better than having the studio located in my apartment on Newport Street, where there were silkscreen tables in the dining room and a bathroom that doubled as a darkroom. My bedroom door opened directly into the dining room and usually reeked of the foul chemicals we used to make the posters. Just one OSHA inspection would have shut us down forever, but it was not until later that we learned about the dangers of long-term exposure. On Newport Street, the apartment was right next to the Ravenswood Branch of the “L,” and it shook like the aftershock of a California earthquake each time a train passed. But we were in the midst of a women’s revolution, and our priorities were clear. 1. The Chicago Women’s Graphics Collective (WGC) was a “workgroup” of the CWLU from the very start. There were about 25 workgroups and other groups within the CWLU. CWLU outreach to recruit new members got a lot of new women into WGC. It was based on egotism and the cult of the individual—the great-men-of-art syndrome. So we decided to throw all that out, and art now had to be a collective experience. So every poster that we created had to be done by committee. Every one. We had a system in which any one of the collective could get an idea or a phrase or an image and decide to do a poster. They would ask two or three other members to be their assistants and to help develop the idea. And then in little teams they would physically create the poster in silk screen. It had to be a collective process. There’s no way that one single woman could really do it because we were using very primitive reproduction methods, and we needed at least three people to run the silk screen. The silk screens were all hand printed. No machines. If a poster was more than one color, it had to be hand printed, one color at a time, so it was very, very labor intensive. And... (shrink)

In lieu of an abstract, here is a brief excerpt of the content:Evidence, Authority, and Interpretation: A Response to Jason HelmsCarol PosterAs someone with a long-standing interest in Heraclitus, I am delighted that Philosophy and Rhetoric is providing a forum for an ongoing discussion of his work.1 Although Jason Helms and I do disagree on specific matters concerning Heraclitean interpretation, we are, I think, in full agreement concerning the importance of Heraclitus for both rhetorical and philosophical studies and intend (...) these essays as contributions to what, it is hoped, will be a fruitful ongoing discussion of Heraclitus within the interdisciplinary tradition of this journal. Rather than address many minor points of disagreement superficially, I will concentrate below on close analysis of a few specific issues that I consider paradigmatic of differences in method rather than merely in conclusions.Panta Rhei (All Things Flow)That Heraclitus was interested in establishing any sense of orthoepia plays down his insistence on the panta rhei (everything flows). To suggest any final rightness of words would suggest that everything flows but the Logos.(Helms, this issue)Actually, I do not use the phrase “final rightness of words” but, rather, describe Heraclitus as “focus[ing] on the problem of correctness of names” and as [End Page 288] “consider[ing] the possibility that one can learn something about the nature of things by examining the non-literal sense of their names” (2006, 15).2 Name is an English equivalent of the Greek onoma (Latin nomen, substantive as opposed to verb or particle), not rhêma (word, verb, phrase) or logos (word, account, speech, saying, story, ratio, reason, etc.). The phrase “correctness of names” alludes to an ongoing discussion among scholars in classics and philosophy about a specific problem in early Greek thought (normally discussed in relation to Heraclitus, Protagoras, Prodicus, Plato’s Cratylus, and Aristotle’s Categories and On Interpretation).More importantly, Helms seems to think it impossible a priori that Heraclitus might have considered some sort of doctrine of flux compatible with a belief in correctness of names. Ancient evidence, however, suggests that Heraclitus did, in fact, consider stability of logos, correctness of names, and sensible flux compatible in some manner.For logos as unchanging, dk22b1 begins, “Of the logos that exists always [eontos aiei] uncomprehending are men.”3 Although the syntax is ambiguous, eontos aiei suggests some stability of logos. Sextus Empiricus states that Heraclitus considered the “divine logos” stable and eternal and human reason grounded in its participation therein (Adv. Math. 7.126–33).4 The “commonality” of logos in dk22b2 also suggests some interpretive stability, in the sense of logos not varying with respect to the perception of the individual.The phrase panta rhei, although solidly entrenched in the reception history of Heraclitus, often as part of a “doctrine of flux,” is not actually a well-attested Heraclitean saying (included in the dk “b” fragments) but, rather, derived from early testimonia. Whether the phrase is a paraphrase, indirect quotation, or Platonic/Aristotelian recasting of Heraclitus is uncertain. One of the basic metatheoretical premises of pragma-dialectics is that “Argumentation has the general function of managing the resolution of disagreement.” From a Peircean perspective this is at best a partial truth. While it may be correct that in concrete, finite contexts, argumentation may function to manage the resolution of disagreement, in the long run argumentation will tend towards the Truth. Using Peirce as my compass, I will take argumentation to refer to the resolution function of thought contingently situated (...) and finitely understood. I will take argument to mean any structure or process which can serve as a real, compelling constraint upon thought in general. I will show that while the particular function of argumentation may be managing the resolution of disagreement, when situated within a Peircean-styled realism, argumentation will tend in the long run toward the Truth. I will end by showing that while argumentation may have a resolution function, its real measure and normative standard is growth rather than resolution per se. (shrink)

A widely touted approach to involving laypeople in science and technology policy-related decisions is the consensus conference. Virtually nothing written on the topic provides detailed discussion of the many steps from citizen recruitment to citizen report. Little attention is paid to how and why the mechanics of the consensus conference process might influence the diversity of the participants in theses fora, the quality of the deliberation in the citizen sessions, the experiences of the participants and organizers, and other outcomes that (...) affect democratic decision making within the conference and more broadly over the long term. As an aid to those interested in utilizing the consensus conference format, the authors outline in detail how they set about organizing their consensus conference on nanotechnology in the spring of 2005. They discuss what specific aspects of their consensus conference worked, and why, and also consider what they learned of relevance to future application. (shrink)

This study examines the discourse representation of migrant voices in two Spanish broadsheets and two freesheets through the analysis of quoted utterances. Data analyzed were gathered within the framework of a year-long EU research pilot project aimed at developing a cost-effective methodology to comparatively analyze print media content from six EU member states. Within the paradigm of CDA and drawing on Appraisal Theory, we analyzed the writer’s use of different types of reported speech, the corresponding reporting verbs, the endorsement (...) of the reported voices, and the attitudes and emotions that these denote. Results show some significant differences in the way immigrants’ voices are reported in Spanish broadsheets and freesheets. While the stories from the broadsheets depict voices of human suffering, freesheets articles show a different immigrant voice: one which is confident, successful, and well-adapted to the host environment. Here is the first book to present Karl Marx as one of the great systematic philosophers, a man who went beyond the traditional bounds of the discipline to work out a philosophical system in terms of a concrete social theory and politico-economic critique. Basing her work on the Grundrisse (probably Marx's most systematic work and only translated into English for the first time in 1973), Gould argues that Marx was engaged in a single enterprise throughout his works, specifically the construction (...) of a systematic and philosophical theory of society. Gould examines five basic themes of Marx's social ontology: society, labor, causality, freedom, and justice, in five separate chapters, preceded by an introductory chapter explicating thesis and methods. The book shows how Marx's ontology, or theory of social reality, may be reconstructed from concrete details of his account of the historical stages of social development and from his analyses and critiques of capitalist economy. It clarifies further the value theory underlying Marx's critique of modern society and explores the question of how philosophy can play a major role in understanding and resolving social issues. This book will be of interest to all students of society, since it raises issues of the relationship of technologies to society and of the forms and prospects for socialism as a possible future society. It has deliberately been written in a style that makes the difficult, technical issues accessible to undergraduates just beginning to read Marx, as well as, of course, graduate students of social theory and specialized scholars. The lay reader will also be drawn to the particular content of this book and will enjoy the lucid, straightforward presentation. Marx's Social Ontology proposes a solution to a long-standing problem in interpretations of Marx: the apparent dilemma of his insistence on the ideal of full self-realization of the individual and his equal insistence on the ideal of full self-realization of the community. This is a book of major significance dealing with topics of enduring and current interest. (shrink)

This article analyzes how women in residential real estate sales interweave their work and family activities. It is presented as a case study of the effects of flexible scheduling on the tasks of managing paid and domestic work. Women are attracted to real estate sales because they perceive that it will enable them to combine their paid and unpaid labor in a relatively comfortable way as a result of the flexibility of setting their own work schedules. They find that the (...) work requires long hours and significant adaptations in the division of household labor. The findings demonstrate that flexibility itself is not adequate for accomodating the demands of families and wage work. Additional changes in the organization of both types of work, as well as ideological changes in the ownership of family-related tasks are required to alleviate the difficulties women face in integrating family and work responsibilities. Two epidemics—Covid‐19 and opioid use disorder (OUD) —are creating short‐ and long‐term mental and physical health risks for vulnerable children and adolescents. Information about the risks to children from exposure to the coronavirus is still fragmentary, but even many healthy children are not getting appropriate health care, such as vaccinations or monitoring of developmental milestones during the Covid‐19 pandemic. Children living in poverty are at heightened risk. Youngsters who are already dealing with OUD in their families—2.2 million as of (...) 2017—face serious consequences stemming from trauma and stress. Although not officially designated by the Centers for Disease Control and Prevention as “adverse childhood experiences” (“ACEs”), these situations meet the CDC's criteria for inclusion, such as death or separation from a parent. It is important to recognize and meet the needs of all these children now and not just when the long‐term consequences become apparent. (shrink)

‘Becoming all things to all persons’ is a key primal insight into the potential healing of the wound and the rift in the human family caused by long years of devaluation of one sex by the other. In this light, this article examines the theological implications of male-dominant language and imagery for God and God’s people in daily usage and community worship and its cumulative psychological effects on women. The main assumption in this article is that unconscious beliefs and (...) symbols rule the human imagination far more than do words and conscious declarations. The over-riding question is: How can believers be motivated to embrace the Gospel call to the mission of reconciliation in the area of gender, human identity, and language so as to increase everyone’s access to the unique healing power of Christ’s resurrection? Biomedical and behavioral research may affect strongly held social values and thereby create significant controversy over whether such research should be permitted in the first place. Institutional review boards responsible for protecting the rights and welfare of participants in research are sometimes faced with review of protocols that have significant implications for social policy and the potential for negative social consequences. Although IRB members often raise concerns about potential long-term social implications in protocol review, federal regulations strongly discourage IRBs (...) from considering them in their decisions. Yet IRBs often do consider the social implications of research protocols and sometimes create significant delays in initiating or even prevent such research. The social implications of research are important topics for public scrutiny and professional discussion. This article examines the reasons that the federal regulations preclude IRBs from assessing the social risks of research, and examines alternative approaches that have been used with varying success by national advisory groups to provide such guidance. The article concludes with recommendations for characteristics of a national advisory group that could successfully fulfill this need, including sustainability, independence, diverse and relevant expertise, and public transparency. “‘[C]onscience,’” Nietzsche suggests early in Essay Two of On the Genealogy of Morals, “has a long history and variety of forms behind it” (II.3). Glossing over the explicit equivocity and irony of such statements, most commentators presume that the primary ambition of GM is to reconstruct the emergence and in so doing denaturalize and denounce the reign of conscience, which is treated as equivalent to both bad conscience and slave morality. Such presumption has obscured the central claims, operations, and (...) stakes of the text, indeed of Nietzsche’s late work generally. Although they are intertwined, Nietzsche’s genealogy of conscience is textually, substantively, and strategically distinct from his genealogy of bad conscience, which in turn is involved in but distinct from his genealogy of slave morality. Textually, it is not until Essay Two, section four of On the Genealogy of Morals that Nietzsche begins to ask after the emergence and psychosocial (“physiological”) consequences of bad conscience, while the genealogy of conscience proceeds from the first essay. Substantively, the three genealogies are concerned with manifestly disparate objects. Strategically, the addressees of the three genealogies are diverse, thus are their modes of address: genealogy cannot be reduced to a uniform method. (shrink)

In this chapter, the author wants to situate Arthur Danto's work in relation to a particular elaboration of it that has emerged at Columbia University, where Arthur presided for so long as a senior philosophical figure. Danto's non‐Cartesian dualism poses a problem of other bodies, which he claims is a much more important philosophical problem than the problem of other minds that is alleged to follow up on the nature of consciousness. Danto would surely be right to insist that (...) the first‐person point of view from which mental agency is exercised, by undertaking irreducibly normative commitments, must also be a first‐person point of view from which embodied agency is exercised so as to effect changes in the world. The quickest route to seeing the normative point of the normative analysis of agent identity lies in the case of group agency. (shrink)

The market-based innovation known as assisted living (AL) has changed the landscape of long-term care in the US. Using Edgar Schein’s three-level conceptual framework of organizational culture and data from a two-year qualitative study of five AL facilities located in suburban Philadelphia, we argue that misalignments among publicly stated values, material artifacts, and underlying assumptions can create a climate that fosters ethical tension. Drawing on forty-five in-depth interviews with staff at all levels, we derive five operational assumptions that guide (...) behavior in the facilities included in our study, and we describe how facility artifacts and espoused values give rise to ethical tensions and, at times, ethical violations. The findings highlight the imperative for providers and managers in all industries to look beyond the façade of artifacts and espoused values to underlying assumptions, and to recognize that these three levels must be aligned in order to create and sustain a culture in which ethics is a visible and enduring element and where ethical conduct is encouraged on an everyday basis. Nursing Inquiry 2011; 18: 154–164The ‘mindless’ relationship between nursing homes and emergency departments: what do Bourdieu and Freire have to offer?This paper explicates the long-standing and largely unquestioned adversarial relationship between nurses working in the nursing home (NH) and the emergency department (ED). Drawing on the author’s own research on resident ED transfers, this paper reports on the conflict and tension that can arise when residents transfer between the two settings. The theoretical concepts of mindlessness, habitus, social (...) capital and oppression are deployed to understand the contextual nature of the social relations that exist between NH and ED practitioners and between practitioners and residents. This theoretical discussion offers the potential to uncover the social relations that give rise to problematic transfers which may lead to alternative and more productive NH to ED transfers. (shrink)
