In this study, we examine investor and firm response to the California Transparency in Supply Chains Act of 2010. The CTSCA requires large retail and manufacturing firms to disclose efforts to eradicate slavery and human trafficking from their supply chains and is a rare example of mandated corporate social responsibility disclosure. Based on a sample of 105 retail companies subject to the CTSCA, we find a significant negative market reaction to the passing of the CTSCA. Furthermore, we find that the (...) reaction is significantly more negative for larger firms and companies facing greater supply chain risks, suggesting that investors place a negative value on exposure to legitimacy threats in the social domain. With respect to company disclosure response, we document relatively high compliance with the legislation, although we also find that the disclosure response appeared to be more symbolic than substantive in nature. Finally, our analysis indicates that both disclosure choice and disclosure extensiveness were significantly higher for the high-supply chain risk companies, suggesting that the response was influenced by concerns with strategic legitimation. Overall, the limited quality of disclosure suggests that, without additional rules and guidance, mandates alone may not lead to meaningful social disclosure. (shrink)

In this paper we examine the effects of different competitive conditions on the determination and evaluation of strategies of corporatesocial responsibility (CSR). Although the mainstream of current thinking in business ethics recognizes that a firm should invest in social responsibility, the normative theory on how specific competitive conditions affect a firm’s social responsibility remains underdeveloped. Intensity of competition, risks to reputation and the regulatory environment determine the competitive conditions of a firm. Our central thesis is that differential strength of competition (...) produces differential moral legitimacy of firm behavior. When competition is fierce or weak, different acts or strategies become morally acceptable, as well as economically rational. Hart's "Ascription of Responsibility and Rights" is where we find perhaps the first clear pronouncement of defeasibility and the technical introduction of the term. The paper has been criticised, disavowed, and never quite fully redeemed. Its lurid history is now being used as an excuse for dismissing the importance of defeasibility.

Modeling work by Brian Skyrms and others in recent years has transformed the theoretical role of David Lewis's 1969 model of signaling. The latter can now be understood as a minimal model of communication in all its forms. In this article, we explain how the Lewis model has been generalized, and consider how it and its variants contribute to ongoing debates in several areas. Specifically, we consider connections between the models and four topics: The role of common interest in communication, (...) signaling within the organism, meaning, and the evolution of human communication and language. ABSTRACT:The notion of stakeholder salience based on attributes (e.g., power, legitimacy, urgency) is applied in the family business setting. We argue that where principal institutions intersect (i.e., family and business); managerial perceptions of stakeholder salience will be different and more complex than where institutions are based on a single dominant logic. We propose that (1) whereas utilitarian power is more likely in the general business case, normative power is more typical in family business stakeholder salience; (2) whereas in a general (...) business context legitimacy is socially constructed; for family stakeholders, legitimacy is based on heredity; and (3) whereas temporality and criticality are somewhat independent in general-business urgency, they are linked in the family business case because of family ties and family-centered non-economic goals. Despite both positive and negative perceptions of the current state of higher education, the contemporary debate over what it is to be a university is limited. Most of all, it is limited imaginatively. The range of imagined options is narrow. The imagination has not been given anything even approaching a wide scope. As a result, our sense as to what a university could be and could become in the modern age is itself impoverished. If we are seriously to develop a (...) wide range of ideas of the university that is adequate to the challenges of the modern world, the imagination itself needs to be freed. Imagining the University seeks to address each of these sets of issues and will do so by first, identifying a very wide range of ideas of the university as it is now unfolding and could become; secondly, by evaluating those conceptions of the university with a classification of ideas of the university; and thirdly, by reflecting on the imagination itself, its current impoverishment and its possibilities. According to one currently influential line of thinking, the evolution of ostensive communication was a prerequisite for the evolution of human language. In this article, I distinguish between a strong and a weak version of this view and offer a sustained argument against the former. More specifically, the strong version of this view would have it that ostensive communication was a prerequisite not just for the evolution of fully modern language but for any language-like system of communication. I argue that (...) this version is too strong: I show how some distinctive and important features of language may well have been assembled prior to the evolution of ostensive communication. Put another way, I argue that a protolanguage before ostensive communication scenario is a real possibility. I conclude by briefly arguing that such an evolutionary scenario coheres better with archaeological evidence from the early Pleistocene as well as evidence from developmental psychology pertaining to the nature of our mind reading abilities. This article addresses the question of whether early Pleistocene hominins are plausibly viewed as having possessed a protolanguage, that is, a communication system exemplifying some but not all of the distinctive features of fully modern human language. I argue that the answer is “yes,” mounting evidence from the early Pleistocene “lithics niche.” More specifically, I first describe a cognitive platform that I think would have been sufficient, given appropriate socio-ecological conditions, for the creation and retention of a protolanguage. Then, using (...) archaeological evidence pertaining to hominin lithic behavior from the early Pleistocene, I attempt to make plausible the idea that each of these cognitive abilities were in fact in place by this point in hominin evolutionary history and also that the requisite socio-ecological conditions were satisfied. Forty years ago, Vaughn Ball demonstrated that the then received notion of conditional relevance served no useful purpose, as it would only come into effect if the probability of an element were 0.0. But, if the probability of an element were 0.0, a directed verdict would be in order and so once again conditional relevancy was doing no work. I extended that analysis to include the relationship between proffers of evidence and facts of consequence to demonstrate that the work that (...) conditional relevancy was supposedly doing was isomorphic to that done by relevancy in all significant ways, and yet the Federal Rules of Evidence provide different standards for the two situations to determine admissibility. I thus proposed an amendment to FRE 104(b) to provide for the same standard to be applied to ‘relevancy’ and ‘conditional relevancy’. In a recent article, Matthew Kotzen appears to subject this work to intense scrutiny and criticism, yet at the same time reaches, so far as I can tell, identical conclusions. This game3 was designed to investigate protocols and strategies for resourcebounded disputation. The rules presented here correspond very closely to the problem of controlling search in an actual program. The computer program on which the game is based is LMNOP. It is a LISP system designed to produce arguments and counterarguments from a set of statutory rules and a corpus of precedents, and applied to legal and quasi-legal reasoning. LMNOP was co-designed by a researcher in AI knowledge representation and by (...) a trained computer scientist who was an editor of Washington University Law Review at the time. LMNOP is based on the idea of a non-demonstrative or defeasible rule: i.e., a rule that admits exceptions. It adopts a representational convention that supposes there is an implicit preference of more specific rules over less specific rules. In fact, it automatically adjudicates between competing arguments when one argument meets the broader criterion of being more specific than another. The convention is based on an idea origianlly presented by David Poole [85], and is embedded in a system of determining which arguments are ultimately warranted, which originally appeared in the literatures of epistemology and ethics, by Pollock [87]. This system evolves from work by the first author since 1987; the full statement of the theory is in [92]. Prakken [92] is one example of the idea’s application to the legal domain. LMNOP also draws heavily on the model of legal reasoning and analogical reasoning put forward by Edwina Rissland and Kevin Ashley [89, 90]. _Natural Beauty_ was selected for the _Choice_ _Outstanding Academic Title_ list for 2008! _Natural Beauty_ presents a bold new philosophical account of the principles involved in making aesthetic judgments about natural objects. It surveys historical and modern accounts of natural beauty and weaves elements derived from those accounts into a “syncretic theory” that centers on key features of aesthetic experience—specifically, features that sustain and reward attention. In this way, Moore’s theory sets itself apart from both the purely cognitive and the (...) purely emotive approaches that have dominated natural aesthetics until now. _Natural Beauty_ shows why aesthetic appreciation of works of art and aesthetic appreciation of nature can be mutually reinforcing; that is, how they are cooperative rather than rival enterprises. Kinship plays a foundational role in organizing human social behavior on both local and more global scales. Hence, any adequate account of the evolution of human sociality must include an account of the evolution of human kinship. This article aims to make progress on the latter task by providing a few key pieces of an evolutionary model of kinship systems. The article is especially focused on the connection between primate social cognition and the origins of kinship systems. I argue that (...) early conceptions of kinship in our line were very likely scaffolded by preexisting forms of primate social cognition. It was only later, as linguistic resources increased in our line, and as human social life grew more complex, that these conceptions came to resemble kin categories as we now know them. I conclude by situating “kin cognition” within a broader cognitive science framework for studying capacities that reflect both innate knowledge and human cultural learning. (shrink)

Scientific realism is a doctrine that was both in and out of fashion several times during the twentieth century. I begin by noting three presuppositions of a succinct characterization of scientific realism offered initially by the foremost critic in the latter part of the century, Bas van Fraassen. The first presupposition is that there is a fundamental distinction to be made between what is “empirical” and what is “theoretical”. The second presupposition is that a genuine scientific realism is committed to (...) their being “a literally true story of what the world is like”. The third presupposition is that there are methods for justifying a belief in the empirical adequacy of a theory which do not also suffice to justify beliefs in its literal truth. Each of these presuppositions raises a number of problems, some of which are quite old and others rather newer. In each case, I briefly review some of the old problems and then elaborate the newer problems. (shrink)

My concern is with the possible implications of research in developmental psychology for understanding the workings of modern science. I agree both with Gopnik's general naturalistic orientation and with her more specific claims about scientists as cognitive agents. Neither the formal structure of propositions nor the social structure of scientific communities provides sufficient resources for the understanding we seek. So I agree that the empirical study of human cognition is not only relevant, but necessary, for understanding how science works.

ABSTRACTFast food chains such as McDonald's, KFC, and Burger King are major players in the production, marketing, and consumption of animal‐derived food throughout the world. Animal rights activists are quick to point out the link between the highly efficient factory farms that supply these chains and extreme animal cruelty and environmental degradation. Strategically, fast food is well positioned to leverage change in the methods by which animals are raised and processed for human consumption. Although progress has been made as the (...) fast food industry has responded to pressure exerted by animal rights organizations, there is little indication of true collaborative efforts that would harness the power of the market to bring about substantive changes in the way the consuming public views the issue of animal welfare and food production. Leibniz es parte de la tradición mecanicista que concibe los seres vivos a partir del modelo del reloj o de los autómatas, pero establece una distinción esencial entre máquinas naturales y artificiales, que muestra los límites de este modelo. Las primeras son máquinas infinitamente complejas, máquinas dentro de máquinas ad infinitum, las segundas no, alcanzan un límite de complejidad. (...) Esta distinción obliga a ir más allá del reloj como modelo de los seres vivos, pues este modelo resulta insuficiente para comprender la dinámica propia de los seres vivos, en al menos dos aspectos: a) deja sin explicar el origen de la estructura o forma del ser vivo; b) no establece un principio interno de actividad que fundamente la unidad dinámica y estructural del ser vivo. ABSTRACT During the seventeenth century, the clock seems the most appropriate model for thinking about living beings. The German philosopher G. W. Leibniz, is part of the mechanical tradition that conceives living beings from the clock or the automata’s model, but he establishes an essential distinction between natural and artificial machines. This distinction shows the limits of the mechanical model. The machines of nature are infinitely complex machines, machines within machines ad infinitum; the artificial machines, instead, reach a limit of complexity. This distinction forces us to go beyond the clock as a model of living beings, because this model is insufficient to understand the dynamics of living beings, in at least two aspects: a) it is not able to explain the origin of the living being’s structure or form; b) it does not establish an internal principle of activity grounding the living being’s dynamic and structural unit. With his notion of organism or natural machine, Leibniz tries to solve these insufficiencies of the purely mechanical model: a) in his proposal, the living being is not constituted mechanically or serially, but at once, by an act of creation; b) the conservation of the living being in time is only understandable from a principle of intrinsic activity that provides unity, activity and structure to living beings. Although rejecting the core values of the modern worldview, postmodernism may prove to be more blessing than bane for worshiping communities. From deconstruction to apologetics, the postmodern context calls for new ways of preaching the gospel.

Hunger and deprivation, lack of education, sanitation, and health care are only a few pressing issues related to poverty in developing countries. Addressing such complex social issues requires pooling complementary resources of the civil, public, and private sector. Over the last decade, stakeholders tried to cocreate innovative solutions in cross‐sector social partnerships (CSSPs) at the base of the economic pyramid (BoP), but collaboration proved to be very challenging. Practitioners become increasingly frustrated with operational differences, intransparency, and mismatched goals in partnerships. (...) This study unravels the black box of collaboration and delivers empirical insights on trust and power inCSSPsbased on social exchange theory. Structural equation modeling (SEM) enables us explore relationships beyond case‐based insights. Our rigorous empirical analysis covers 207 interorganizational relationships and outlines a crucial gatekeeping function of trust inCSSPs. Findings provide strong empirical support for conceptual works calling for an “integrative orientation” inCSSPs. Furthermore, we pinpoint the role of intermediates and draw implications for future research. (shrink)
