This study represents a comparison between two radical gestures of literary self-reflexivity: romantic irony and postmodernist metafiction. It examines the impact of early German romantic theory and its central concept of irony on German and English romantic narrative fiction and relates the same to postmodernist self-reflexive novels, including its British and American variants. A primary objective of this comparison is to account for the radical skepticism that postmodernist metafiction voices with respect to the paramount philosophical question of truth and reality. (...) This collection provides the first in-depth introduction to the theory of the religious imagination put forward by renowned philosopher Douglas Hedley, from his earliest essays to his principal writings. Early German Romanticism sought to respond to a comprehensive sense of spiritual crisis that characterised the late eighteenth century. The study demonstrates how the Romantics sought to bring together the new post-Kantian idealist philosophy with the inheritance of the realist Platonic-Christian tradition. With idealism they continued to champion the individual, while from Platonism they took the notion that all reality, including the self, participated in absolute being. This insight was expressed, not in the language of theology or philosophy, but (...) through aesthetics, which recognised the potentiality of all creation, including artistic creation, to disclose the divine. In explicating the religious vision of Romanticism, this study offers a new historical appreciation of the movement, and furthermore demonstrates its importance for our understanding of religion today. In lieu of an abstract, here is a brief excerpt of the content:Romanticism and Coleridge’s Idea of HistoryMichael John Kooy*Romantic historiography is widely understood in methodological terms as a subjectively determined treatment of the human past, according to which historical knowledge is grounded in imaginative activity. That ambition was amply fulfilled in Scott’s historical novels, as Georg Lukacs once demonstrated. 1 Writing in broader terms, Hayden White characterized that whole creative enterprise as an “effort at palingenesis,” the striving to (...) recreate or relive the past in individual consciousness. 2In more recent years, as the approach to the period has become more historicist, criticism has begun to separate the historical and the aesthetic aspects of this romantic sensibility, usually emphasizing one at the expense of the other. The result has been a standoff in critical thinking about the way Romanticism represents the past. One side is occupied by some new historicists who claim to find a precedent for their own methodology among prominent figures of the period. Heyne, Wordsworth, and Keats, it turns out, not only were engaged actively in their own contemporary history, but they also demonstrated in their sophisticated evocation of the past the impossibility of overcoming historical difference by reference to natural law. 3 Arguments advanced on the other side of the controversy insist that the Romantics were not nearly such good historicists as supposed. In these accounts, often allied to post-structuralism, the aesthetic absolutism implicit in the high romantic argument is undiminished by the burgeoning historical consciousness in the period. Indeed, Romanticism’s aesthetic [End Page 717] retrieval of the past appears to be an instance of how subjectivity, rather than admit its own historicity, again asserts mastery over the object through its own self-will. 4Each of these accounts commands a considerable following, and a peace between them seems unlikely, indeed undesirable. On one matter they do agree, though, and that is in their distrust of Coleridge. His historiography—the notion that ideas make history and that the way to get at these ideas is aesthetically—is too idealist for today’s historicists and too monumentally subjective for the post-structuralists. I think both judgments are hasty. Coleridge, more than most contemporaries, reflected for many years upon the difficulties that arose in his own attempts to interpret historical knowledge (which appeared as a subjective, aesthetic construct) in systematic terms (as the reflection of natural order); and a good look at the record will show that his thought is not quite so anti-historical as some believe, and his subjective approach not nearly so absolutist.The goal of this essay is to rehabilitate Coleridge’s idea of history, considering what it tells us about Romanticism and how it foreshadows current debates about methodology. 5 More specifically, I want to show how in different contexts Coleridge treats, with varying degrees of success, history as an ideational field that is both created and then interpreted by an inquiring subject. First, at the literary and cultural level, history is conceived as the object of imaginative reconstruction, where subjectivity provisionally orders the mass of material according to an idea found nowhere within history itself. Here the anti-positivist bias of Coleridge’s idealist historiography dominates a project that is, both in orientation and achievement, not so much cognitive as aesthetic. Secondly, at the level of religion, history is conceived in mythic terms, the past being revealed only symbolically to the discerning inquirer who must interpret the Christian mythos as recorded in the inspired biblical account of the nation of Israel. Here it is the application of certain interpretive or hermeneutic strategies that determines success or failure. Finally, as a single idea, history is conceived as the process of humanity seeking consciousness of itself, and this Coleridge expresses in a narrative of universal proportions, beginning in apostasy and ending in grace. ABSTRACTThis article discusses the turn to polytheism in postmodern theory. In postmodernism, there is a strong interest in polytheism as an alternative to the much-criticized dominance of onto-theology in the philosophical tradition. The article argues that the new polytheism cannot be unequivocally understood as an alternative for an onto-theological way of thinking, or as a ‘liberation’ from monotheism. Already in Romanticism, the engagement with polytheism and paganism was ambiguous. There was the familiar superiority of Christian monotheism over polytheism. But (...) there was also an appropriation of polytheism that served a new self-perception of the West. This article focuses on this second line of interpretation and argues that postmodern theory inherits the theo-political concerns central to eighteenth- and nineteenth- century Romanticism. The article sets out to sketch the role of polytheism in a post-secular paradigm. Subsequently, it sketches the engagement with polytheism in British and German Romanticism. It will be argued that in Romanticism, polytheism was always embedded in more substantial cultural and political narratives. The remainder of the article will scrutinize the function of polytheism in the writings of Richard Rorty and John Milbank and how their respective forms of polytheism give way to different political theologies. Paolo Mayer sets out to revise the accepted image of the influence of Jakob Böhme, the sixteenth-century mystic and theosophist, (...) on the romantic poets and philosophers who congregated at Jena in the years 1798-1803. She convincingly argues that, except for the philosophers and critics Friedrich Schlegel and F. W. J. Schelling, Böhme's direct influence was negligible, more a matter of the self-proclaimed new religion of romanticism making ideological use of a controversial, in some sense subversive, forerunner in German literary history. In the hands of Ludwig Tieck, for instance, or Novalis, Böhme becomes a symbol of the new religion of Poesie and the hostile reception afforded by the orthodox evangelical pastors of his time becomes an allegory for the hostility that the new, "let it all hang out" aesthetic of romanticism encountered in the more classical and form-loving members of the literary culture. In Mayer's terms, Böhme's reception among the poets was hagiographic; he was the romantics' poster child.Böhme lived from 1575 to 1624. The son of peasants, but by no means unlettered, the "mystic shoemaker of Görlitz" claimed the source of his teachings was direct divine revelation. He claimed to have visions in 1600 and 1610, whose content he translated into his unusually graphic writings, interspersed with Pietist attacks on reason and on outward religious observances. This unusual 'theology' blended themes that F. Schlegel and Schelling, at least, found attractive: (a) the idea of a self-generating or developmental God, (b) an approach to the problem of evil that logically seems to place responsibility on God, and (c) a large systematic role for desire and will, rather than reason, in the origin of the world and in human salvation. Notable also is the physicalism of Böhme's theology, and the assignment of a wrathful nature to God the Father. Böhme's reception in the seventeenth and eighteenth centuries, determined largely by a first biography written in 1652 by a disciple named von Furstenburg, was generally warm in pietist circles, cool in rationalist quarters, e.g., in that of Lessing and Leibniz.The established story is that all the major romantic writers, poets as well as philosophers, were influenced through a direct study of Böhme's texts. Mayer takes issue with that, especially in the case of the poets Tieck and Novalis and the scientists J. W. Ritter. Though each of them writes glowingly of Böhme as a poet—in fact a persecuted poet, a near-martyr for the religion of Poesie—Mayer finds no sound evidence for a direct transmission, either of ideas or of terminology, from Böhme to these figures. What other literary critics have advanced as evidence is, she argues, a body of ideas and vocabulary common to the Neoplatonic, mystic tradition and to Christian thinking in general. If a stricter standard of proving "reception" than mere similarity of language is adopted, it seems that Tieck, Novalis, and Ritter had a slim acquaintance with Böhme's writings, but nonetheless advanced a hagiographic view of the "folk poet." Others among the Jena circle—Schleiermacher, A. W. Schlegel, Dorothea and Caroline Schlegel—took a skeptical view of this propagandistic ploy. Only the more philosophical minds, F. We present here for the first time an italian translation of Rang’s Vom Weg messianischer Deutung : the introductory essay on the work on Shakespeare’s sonnets. This work remained unfinished and was only partially published posthumously by Rang’s son, Bernhard, in 1954, with the title Shakespeare der Christ. Eine Deutung der Sonette. The translation is accompanied by a comment essay on Rang’s text. This comment essay firstly aims to contextualize both the work on Shakespeare and the very complex and still (...) little researched figure of Florens Christian Rang; secondly, it addresses the most important conceptual issues that the essay presents. With a strongly programmatic nature and, at the same time, with an expressionistic style, which is as obscure as it is visionary, Vom Weg messianischer Deutung presents the method of messianic interpretation in contrast with the classical-romantic one of the pneumatic interpretation. What is at stake is a perspective that challenges the autonomy of art in order to place the Kunstwerk in the series of all the works of divine creation to transform it in faith work. It is the point of view of the Last Judgment that leads the way. The messianic critique of art reveals to be only a particular case of messianic world critique, literally a critique of the world, which redirects itself to the world. It is the movement of conversion which breaks with the false dualism of Romanticism, according to which the spirit is divided in two: on the one hand, there are the experience, the world, the science, on the other hand, there is the art as pure mirroring of forms. Through the messianic interpretation, the spirit returns to be body, flesh. It follows the permanent movement of creation, namely the continuous conversion from God to the world and from the world to God. In this sense, according to Rang, Shakespeare’s sonnets exemplify the faith work: their poetic word names the messianic unity of body and spirit. They are crystals within which all creatural life, the great stages of the divine creation, are concentrated. (shrink)

The essay undertakes a theological genealogy of the spirit of managerialism as it affects churches today by tracing it back to hermeneutical shifts in the history of (Protestant) theology: the loss of the externality of the word as a result of Schleiermacherian hermeneutics as it moved the centre of attention from a doctrine of the word to a doctrine of faith. The three sections of this book include illuminating sketches of Schleiermacher's relationship to contemporaries, his work as public theologian as well as the formation and impact of his two most famous books, On Religion: Speeches to its Cultured Despisers and The Christian Faith. The subject of the study is the fundamental philosophical and aesthetic problems in the aesthetics of Pierre Simon Ballanche, who stood at the origins of French romanticism. Two layers of his creativity - explicit and implicit - have been identified and analyzed. It is shown that his ideas about the art of romanticism are verbalized in a strict academic style. The implicit layer, is associated with Ballanche’s artistic prose. It includes philosophical and aesthetic poems, testifying the originality of (...) his aesthetic position. Unlike most French romantics, who distance themselves from ancient culture as pagan in favor of Christianity and medieval art, Ballanche, in his talented paraphrases of mythological stories, romanticizes Antiquity, finding in it the beginnings of future Christian ideas of sublime love, mercy, sacrifice, beauty and goodness. The main conclusion of the study is the conclusion that art, according to Ballanche, plays a leading civilizational role in the cosmogonic-historical process. The core of Ballanche's implicit philosophical aesthetics is revealed - the original concept of palingenesis, interpreted by the author as a radical degeneration of the world for the sake of its future revival; it is precisely this stage of cultural and historical development that, in his opinion, marks romanticism. The author's special contribution lies in introducing into domestic scientific circulation, translated into Russian for the first time and analyzed the philosophical and aesthetic poems “Antigone”, “The Man with No Name”, “The Experience of Social Palingenesis. German Romanticism is commonly associated with nationalism rather than cosmopolitanism. Against this standard picture, I argue that the early German romantic author, Novalis (Georg Philipp Friedrich von Hardenberg, 1772–1801) holds a decidedly cosmopolitan view. Novalis’s essay “Christianity or Europe” has been the subject of much dispute and puzzlement ever since he presented it to the Jena romantic circle in the fall of 1799. On the basis of an account of the philosophical background of Novalis’s romanticism, I show (...) that the image of the Middle Ages sketched in “Christianity or Europe” plays a symbolic role and should not be taken as a literal description of the historical past or as a blueprint for the future. Rather, the romantic picture of medieval Europe serves to evoke poetically the ideal of a cosmopolitan re-unification of humanity. (shrink)

How should you decide what to do when you’re uncertain about basic normative principles? A natural suggestion is to follow some "second-order:" norm: e.g., obey the most probable norm or maximize expected choiceworthiness. But what if you’re uncertain about second-order norms too—must you then invoke some third-order norm? If so, any norm-guided response to normative uncertainty appears doomed to a vicious regress. This paper aims to rescue second-order norms from the threat of regress. I first elaborate and defend the claim (...) some philosophers have made that the regress problem forces us to accept normative externalism, the view that at least one norm is incumbent on all agents regardless of their normative beliefs. But, I then argue, we need not accept externalism about first-order norms, thus closing off any question of how agents should respond to normative uncertainty. Rather, we can head off the threat of regress by ascribing external force to a single second-order norm: the enkratic principle. (shrink)

What kind of animals are human beings? And how do our visions of the human shape our theories of social action and institutions? In Moral, Believing Animals>, Christian Smith advances a creative theory of human persons and culture that offers innovative, challenging answers to these and other fundamental questions in sociological, cultural, and religious theory. Smith suggests that human beings have a peculiar set of capacities and proclivities that distinguishes them significantly from other animals on this planet. Despite the vast (...) differences in humanity between cultures and across history, no matter how differently people narrate their lives and histories, there remains an underlying structure of human personhood that helps to order human culture, history, and narration. Drawing on important recent insights in moral philosophy, epistemology, and narrative studies, Smith argues that humans are animals who have an inescapable moral and spiritual dimension. I do not mean to suggest that Kroner's book is not in many places interesting and learned, nor that, in its original form of lectures, it had no value. But, apart from the exaggeration and distortion of the central thesis, the detailed treatment of historical points leaves one with little confidence and robs the work of what usefulness it might have had. Thus an unquestioning application of Nietzche's division of Greek thinkers into 'Dionysiac' and 'Apollonian' leads to remarks like the (...) following: "Aristotle has little in common with the Dionysian romanticism and universal dynamism of Heraclitus, and yet there is a kinship between them based upon becoming instead of being". What evidence we have for the Presocratic period is harshly treated. On p. 85 this is the 'more literal' of two versions of Anaximander's fragment and its introduction: "All things are going back through destruction, whence they had come through generation, according to what is due; for they suffer just punishment by repayment to each other the wrong in the succession of time"--but Anaximander did not, in fact, write nonsense like this. Even a simple sentence like Heraclitus fr. 113 is mistranslated as "Thinking is the same for all," where the Greek is ξυνόν and not τὸ αὐτό. Nor is Kroner incapable of rebuking others for mistakes of his own; thus on p. 110 he writes: "J. Burnet, e.g., waters down the words of Parmenides which literally rendered are: 'The same is to know and that on behalf of which thought is,' by letting Parmenides say: 'You cannot find thought without something that is as to which it is uttered.'" But Burnet was translating not the line translated by Kroner, but the following one, a line ignored by Kroner and one which seriously damages his interpretation of Parmenides. Then the Greek word ἰδέαι, used of Plato's Forms, is implied to connote ideas existing in the mind; Socrates is the most worth-while of Greek thinkers because in some respects he resembled Jesus Christ; he was not really an ethical thinker, though, and in any case Plato's Forms owed nothing to him--and so on. The best treatment is of Aristotle; and there are many short sections of acute discussion, as, for example, on the meaning of the second part of the Parmenides. But the mind may be spinning so wildly by the time it reaches them that it is incapable of recognizing them. Cambridge University. (shrink)

Decision-making under normative uncertainty requires an agent to aggregate the assessments of options given by rival normative theories into a single assessment that tells her what to do in light of her uncertainty. But what if the assessments of rival theories differ not just in their content but in their structure -- e.g., some are merely ordinal while others are cardinal? This paper describes and evaluates three general approaches to this "problem of structural diversity": structural enrichment, structural depletion, and multi-stage (...) aggregation. All three approaches have notable drawbacks, but I tentatively defend multi-stage aggregation as least bad of the three. (shrink)

The perception of meaningful patterns in random arrangements and unrelated events takes place in our everyday lives, coined apophenia, synchronicity, or the experience of meaningful coincidences. However, we do not know yet what predicts this phenomenon. To investigate this, we re-analyzed a combined data set of two daily diary studies with a total of N = 169 participants (mean age 29.95 years; 54 men). We investigated if positive or negative affect (PA, NA) predicts the number of meaningful coincidences on the (...) following day (or vice versa). By means of a cross-lagged multilevel modelling approach (Bayesian estimation) we evaluated with which of two theoretical assumptions the data are more in line. First, if meaningful coincidences are facilitated by a broader and more flexible thinking style, PA should positively predict meaningful coincidences at the following day. However, if the experience of meaningful coincidences signifies a strategy to cope with negative feeling states, NA should predict the experience of meaningful coincidences during the following day. In favour of a more flexible thinking style, we found that PA predicted the number of perceived coincidences the following day. We did not find any effect for NA, and therefore, no evidence arguing for the coping mechanism hypothesis of meaningful coincidences. (shrink)

The principle that rational agents should maximize expected utility or choiceworthiness is intuitively plausible in many ordinary cases of decision-making under uncertainty. But it is less plausible in cases of extreme, low-probability risk (like Pascal's Mugging), and intolerably paradoxical in cases like the St. Petersburg and Pasadena games. In this paper I show that, under certain conditions, stochastic dominance reasoning can capture most of the plausible implications of expectational reasoning while avoiding most of its pitfalls. Specifically, given sufficient background uncertainty (...) about the choiceworthiness of one's options, many expectation-maximizing gambles that do not stochastically dominate their alternatives "in a vacuum" become stochastically dominant in virtue of that background uncertainty. But, even under these conditions, stochastic dominance will not require agents to accept options whose expectational superiority depends on sufficiently small probabilities of extreme payoffs. The sort of background uncertainty on which these results depend looks unavoidable for any agent who measures the choiceworthiness of her options in part by the total amount of value in the resulting world. At least for such agents, then, stochastic dominance offers a plausible general principle of choice under uncertainty that can explain more of the apparent rational constraints on such choices than has previously been recognized. Nudge is a popular public policy tool that harnesses well-known biases in human judgement to subtly guide people’s decisions, often to improve their choices or to achieve some socially desirable outcome. Thanks to recent developments in artificial intelligence (AI) methods new possibilities emerge of how and when our decisions can be nudged. On the one hand, algorithmically personalized nudges have the potential to vastly improve human daily lives. On the other hand, blindly outsourcing the development and implementation of nudges to (...) “black box” AI systems means that the ultimate reasons for why such nudges work, that is, the underlying human cognitive processes that they harness, will often be unknown. In this paper, we unpack this concern by considering a series of examples and case studies that demonstrate how AI systems can learn to harness biases in human judgment to reach a specified goal. Drawing on an analogy in a philosophical debate concerning the methodology of economics, we call for the need of an interdisciplinary oversight of AI systems that are tasked and deployed to nudge human behaviours. Der Angelpunkt ist dabei die Annahme entweder eines Satzes im Geiste oder einer Proposition, die aus Dingen besteht. Diese Entscheidung wirkt sich dann auf verschiedenste Gebiete der Philosophie aus. Am Beispiel der Kategorienlehre wird dies deutlich: Kategorien sind Aussagbares. In Satzen aussagbar sind aber fur Ockham nur mentale Begriffe, keine Dinge. Also ist fur ihn die Kategorienordnung (...) keine Ordnung von extramentalen Dingen, sondern nur von mentalen Zeichen. Anders Franciscus: Fur ihn sind Gegenstande, nicht Zeichen primar aussagbar. Also ist fur ihn die kategoriale Ordnung eine reale Hierarchie. Welches Licht wirft diese Auseinandersetzung auf das Verstandnis der Philosophie Ockhams und der des Franciscus? Weitaus wichtiger als der universalientheoretische Unterschied zwischen Nominalismus und Realismus ist fur beide Denker ihre satztheoretische Ausrichtung. This article explores the cultural controversy about the relationship between painting and poetry sparked by Wilhelm von Schadow's 1828 rendering of Mignon, a famous literary heroine in Goethe's WilhelmMeister'sApprenticeship. Following closely a position introduced by Lessing and endorsed by Goethe, and using it to advance his general thesis about the end of art, Hegel argued that Schadow's image transgressed the proper borders of its medium by attempting to translate the poetic into the visual. Schadow, by contrast, insisted on the crucial (...) regenerative role of art in society and art's religious mission, thereby giving an emphatically Christian tenor to the Romantic injunction to strive after the infinite. Animated by these convictions, Schadow turned Goethe's heroine into an allegory of Romantic art, thus Goethe's neoclassical sensibility. The turn of the century saw a significant increase in the amount of attention being paid by philosophers to empirical issues about moral character. Dating back at least to Plato and Aristotle in the West, and Confucius in the East, philosophers have traditionally drawn on empirical data to some extent in their theorizing about character. One of the main differences in recent years has been the source of this empirical data, namely the work of social and personality psychologists on morally (...) relevant thought and action. -/- This entry briefly examines four recent empirical approaches to moral character. It will draw on the psychology literature where appropriate, but the main focus will be on the significance of that work for philosophers interested in better understanding moral character. Spacetime as we know and love it is lost in most approaches to quantum gravity. For many of these approaches, as inchoate and incomplete as they may be, one of the main challenges is to relate what they take to be the fundamental non-spatiotemporal structure of the world back to the classical spacetime of GR. The present essay investigates how spacetime is lost and how it may be regained in one major approach to quantum gravity, loop quantum gravity.

Longtermists claim that what we ought to do is mainly determined by how our actions might affect the very long-run future. A natural objection to longtermism is that these effects may be nearly impossible to predict — perhaps so close to impossible that, despite the astronomical importance of the far future, the expected value of our present actions is mainly determined by near-term considerations. This paper aims to precisify and evaluate one version of this epistemic objection to longtermism. To that (...) end, I develop two simple models for comparing ‘longtermist’ and ‘neartermist’ interventions, incorporating the idea that it is harder to make a predictable difference to the further future. These models yield mixed conclusions: if we simply aim to maximize expected value, and don’t mind premising our choices on minuscule probabilities of astronomical payoffs, the case for longtermism looks robust. But on some prima facie plausible empirical worldviews, the expectational superiority of longtermist interventions depends heavily on these ‘Pascalian’ probabilities. So the case for longtermism may depend either on plausible but non-obvious empirical claims or on a tolerance for Pascalian fanaticism. (shrink)

In Pali, the early Buddhist liturgical language, it is suñña. This poem’s story recalls the common Buddhist simile where a rope is mistaken for a snake in the dim light. There is nothing in the rope that should be feared as a snake, and likewise there is ultimately nothing in the five aggregates—basically, everything—that [End Page 111] can be regarded as atman (soul, self). So the aggregates are empty of self: anatta, in Pali. This is the doctrine of emptiness. Fallaciously imputing selfhood to the inherently selfless flux of the aggregates is a major source of suffering, so realizing emptiness brings liberation, just as investigating the rope and finding it empty of snakehood liberates one from fright.Recognizing that the rope is a rope and not a snake is a simile for realizing emptiness. Likewise, in the poem, recognizing that the snake is a snake and not a “Whip Lash / Unbraiding in the Sun” catapults the speaker into a sublime experience of “Zero at the Bone.” This last line may be a metaphor for being chilled to the bone, but the absence of a subject for zero to modify and the sonic and aesthetic overload in an otherwise mostly matter-of-fact nature poem suggest that the sudden recognition of the snake scares us out of ourselves, empties us out, providing a Romantic corollary for Buddhist emptiness.In the Buddhist simile and in the poem, the correction of faulty recognition precipitates the realization of emptiness. But in the simile, what is primarily important is that the rope is recognized as not a snake. One Tibetan text says that substantial progress can be made by, as it were, mistaking the rope for a vine, just so the scary snake perception is cleared away.2 A slightly later Tibetan text says that, simile aside, recognizing that the rope is not a snake and not even a vine but precisely a rope is merely a matter of “conventional valid cognition,” which stops far short of liberating insight into the selflessness of phenomena as such.3 Believing the rope really is a rope is the same as, in the simile, mistaking the rope for a snake, because in both cases it is a matter of perceiving substantiality where there is impermanence. By contrast, Dickinson’s poem emphasizes neither clearing up a particularly pernicious and persistent misconception about existence nor replacing this misconception with complete insight; rather, the poem emphasizes “conventional valid cognition” itself as a vehicle for sublime transcendence. The ecstatic experience of “Zero at the Bone” requires that the snake be accurately recognized as a snake.This “conventional valid cognition” is technically compatible with complete insight into the selflessness of phenomena as such, and it is certainly possible that the speaker experiences zeroness due to an optical illusion or hallucination or dream rather than recognizing a real snake, but the poem does not highlight either of these possibilities. It emphasizes recognitional accuracy, and being thrown from the quotidian as a result. This is quite different from the lesson of the Buddhist simile, where, again, the emphasis is on what is not there, specifically selfhood, rather than on what is there in its precise distinctness from other things. Legal theorists have proposed several theories to justify statutes of limitations in the criminal law, but none of these normative theories is generally accepted. This chapter investigates the related descriptive question as to whether ordinary people have the intuition that legal punishment becomes less appropriate as time passes from the date of the offense and, if they do, what factors play a role in these intuitions. Five studies demonstrate that there is an intuitive statute of limitations on both legal punishment (...) and moral criticism, and that these intuitions arise, in part, from judgments about changes in psychological connectedness over time. The problem of free will as it is know in Western philosophical traditions is hardly known in China. Considering how central the problem is in the West, this is a remarkable fact. We try to explain this, and we offer insights into discussions within Chinese traditions that we think are related, not historically but regarding the issues discussed. Thus we introduce four central Chinese concepts, namely: (1) xīn 心 (heart, heart-mind), (2) xìng 性 (human nature, characteristic tendencies, inborn capacity), (3) (...) mìng 命 (lifespan, fate, command, allotment, endowment), and (4) zìrán 自然 (self-so, so of itself, nature, spontaneity), and we indicate how these concepts and their discussions can be related to discussions on free will. Zusammenfassung Die enge Widerspruchslösung in Österreich erlaubt eine postmortale Organspende bei fehlendem Widerspruch zu Lebzeiten, da von einer mutmaßlichen Zustimmung ausgegangen wird. Liegt kein Eintrag im Widerspruchsregister vor, wird die Familie zum mutmaßlichen Willen der verstorbenen Person befragt. Um die praktische Umsetzung der Widerspruchslösung in Österreich zu beschreiben, sollen relevante Aspekte der Angehörigengespräche und die Rolle der Familie im Entscheidungsprozess zur postmortalen Organspende identifiziert werden. Es wurden insgesamt zehn leitfadengestützte Expert:inneninterviews mit Ärzt:innen und Pflegepersonen an einer österreichischen Krankenanstalt durchgeführt, die (...) mithilfe der qualitativen Inhaltsanalyse nach Mayring unter Anwendung von MAXQDA ausgewertet wurden. Herausforderungen beim Ermitteln des mutmaßlichen Patient:innenwillens im Angehörigengespräch können aufgrund von unterschiedlichen Kulturen/Religionen, Uneinigkeit und Entscheidungsunfähigkeit in der Familie aufgrund von Trauer und der Schwierigkeit der Angehörigen, das Hirntodkonzept zu begreifen, entstehen. Daher ist eine gute Vorbereitung, ausreichend Zeit, interdisziplinäre Zusammenarbeit, das Schaffen von Vertrauen und professionelle Gesprächsführung sowie das Eingehen auf Fragen und Bedürfnisse von Angehörigen durch Ärzt:innen und Pflegepersonen in einem geeigneten Setting notwendig. Die Kommunikation mit Angehörigen bezüglich einer postmortalen Organspende ist sowohl für das Gesundheitspersonal als auch die Familie belastend. Anhand der Ergebnisse wird die Anwendung des Kommunikationsleitfadens der Gesundheit Österreich mit Erweiterung um die Information zur Gesetzeslage sowie regelmäßige Kommunikationsschulungen des Gesundheitspersonals empfohlen. Zudem wird eine flächendeckende Information der Bevölkerung zur Förderung der intrafamiliären Diskussion gefordert. (shrink)
