Organ transplantation has increased worldwide while the number of organ donors have not increased similarly. Consequently, the waiting period for transplant candidates is prolonged. Patient narratives have uncovered physical and psychosocial suffering in the transplantation process. However, relatively few studies have explored patients’ experiences in the actual waiting period. This qualitative study was conducted in Norway and aimed to describe patients’ experiences of being accepted as recipients of a new liver and their waiting following this decision. A sample of 21 (...) patients with end‐stage liver disease, placed on the ordinary waiting list for a liver transplant, were interviewed in the hospital before they went home to wait for a compatible liver. Uncertainty related to life and death was a major issue, both in the waiting period and as a response to being put on the waiting list. Another central issue was their overwhelming lack of energy. Patients inferred a linear relationship between lack of energy, physical limitations and mental distress. Despite major advances in medical treatment, little follow‐up was given during the waiting period and most of the patients seemed resigned to the inevitability of their suffering. This raises issues of health personnel responsibility and a need to heighten awareness about patient suffering during the waiting period. (shrink)

This article examines the domestic use of drones by law enforcement to gather information. Although the use of drones for surveillance will undoubtedly provide law enforcement agencies with new means of gathering intelligence, these unmanned aircrafts bring with them a host of legal and epistemic complications. Part I considers the Fourth Amendment and the different legal standards of proof that might apply to law enforcement drone use. Part II explores philosopher Wittgenstein’s notion of actional certainty as a means to interpret (...) citizens' expectations of privacy with regard to their patterns of movement over time. Part III discusses how the theory of actional certainty can apply to the epistemic challenge of determining what is a “reasonable” expectation of privacy under the law. This Part also investigates the Mosaic Theory as a possible reading of the Fourth Amendment. (shrink)

This essay aims to outline in what ways Kierkegaard’s thinking of existence not only brings into view a concept of existence, but, more fundamentally, enables one to locate an opening to questioning anew the relation of thinking and existence. This thinking of existence does not seek to dissolve existence into knowledge but aims at intensifying the question of a thinking grounded not in the conclusion made in “an external relation between a knower and a non-knower” of which non-knowledge is the (...) negative determination of knowledge, but rather of a thinking grounded in existence. In his article, “Wittgenstein and Basic Moral Certainty,” Nigel Pleasants argues that killing an innocent, non-threatening person is wrong. It is, he argues, “a basic moral certainty.” He believes our basic moral certainties play the “same kind of foundational role as [our] basic empirical certaint[ies] do.” I believe this is mistaken. There is not “simply one kind of foundational role” that certainty plays. While I think Pleasants is right to affiliate his proposition with a Wittgensteinian form of certainty, he exposes (...) himself to a tension that exists in On Certainty regarding how we acquire it: is certainty natural, is it social? In this paper, I present two ways in which we come to possess certainty: a bottom-up approach, where certainty is part of our instinctual predisposition, and a top-down approach, where certainty is acquired through positive reinforcement by family and culture. Bringing the views of Grayling, Moyal-Sharrock and Stroll together, I argue that in On Certainty, Wittgenstein explores the possibility of a new kind of foundationalism. Distinguishing propositional language-games from non-propositional, actional certainty, Wittgenstein investigates a foundationalism sui generis . Although he does not forthrightly state, defend, or endorse what I am characterizing as a "new kind of foundationalism," we must bear in mind that On Certainty was a collection of first draft notes written at the end of Wittgenstein's life. The (...) work was unprogrammatic, sometimes cryptic. Yet, his exploration into areas of knowledge, certitude and doubt suggest an identifiable direction to his thoughts. (shrink)

The aim of this essay is to reflect on the place and importance of the question of address and to show how it comes to the fore in Søren Kierkegaard’s writings. What shall be attempted, with regard to Kierkegaard’s already widely recognized renown as an existential thinker, is to catch a glimpse of issues that make up the larger background in which the question of address is embedded. In doing so, the essay explores several features of Kierkegaard’s inquiry into the (...) question of existence in the Concluding Unscientific Postscript and connect them with the notion of the reader. This latter notion provides a way of understanding the singularity of voice, while offering an account of the testimony to existence. After a brief recapitulation, the essay identifies in conclusion unresolved issues relating to speech, silence, confidentiality, and listening. (shrink)

In this paper, we argue for craftivism as a form of social activism with a political depth reached through making. From Mary Wollstonecraft to the suffragettes, Betsy Greer to DIY, craftivism has had a place in feminist activism. The human tradition for making objects combined with the online possibility of documentation, has made craftivism a political weapon. But it is a soft weapon, where the power lies in the pain and suffering it reminds us off. This protest is often performed (...) by women and history shows that this is why craft has been seen as something other than art, and as a form of political protest today. This article ties the history of feminist craft to the current movement of craftivism, arguing for this art herstory to be part of the canon and part of a political solution. (shrink)

Exploring Certainty: Wittgenstein and Wide Fields of Thought considers how, where, and to what extent the thoughts and ideas found in Wittgenstein’s On Certainty can be applied to other areas of thought, including: ethics, aesthetics, religious belief, mathematics, cognitive science, and political theory. Robert Greenleaf Brice opens new avenues of thought for scholars and students of the Wittgensteinian tradition, while introducing original philosophies about human knowledge and cognition.

The philosophies of Ludwig Wittgenstein and Maurice Merleau-Ponty may seem at first glance to be mutually exclusive. On further examination, however, they can be seen to share some fundamental points of view. For instance, they both share a common rejection of a modern mechanistic explanation of nature, and both endorse what we might call a pre-linguistic level of meaning. In this paper, we show that these thinkers not only share some fundamental philosophical views, but also had, for many years, contemplated (...) what cognitive scientists today call “embodied cognition.”. In this essay I will examine the various ways in which the concept of decision emerges in the writings of Kierkegaard focusing mainly on the Philosophical Fragments and the Postscript. This prepares the way for revisiting Kierkegaard’s concept of decision. Doing so indicates the radical way in which Kierkegaard connects the concept of decision to an aporia. The crucial existential concept of decision not only concerns the difficulty, or even the impasse, pertaining to knowledge, but also relates to the question (...) of how the singular finds his or her own way through existence. In the penultimate chapter of his book, Art as Language, G. L. Hagberg presents an argument against Arthur Danto, George Dickie, and other advocates of the Institutional Theory (IT), arguing that a tension exists within the theory. Through conferral, a spokesperson declares what artifacts are accepted into the artworld. Hagberg finds this problematic because, while the criterion one uses is something that the later Wittgenstein would endorse, it points back to an essentialism that he clearly rejected. But Hagberg believes he (...) can avoid this problem by applying Wittgenstein’s notion of certainty to specific artifacts in aesthetics. By relying on Wittgenstein’s notion of certitude, however, he exposes himself to a tension that exists in On Certainty: is certainty natural, or is it social? Although the propositions Hagberg uses have the potential to become certain, he treats them as if they begin that way. In this paper I present two ways in which Wittgenstein classifies or understands certainty: a bottom-up approach, where certainty is part of our natural and instinctual predisposition, and a top-down approach, where certainty is acquired through positive reinforcement. I believe Hagberg fails to appreciate this distinction as well as the consequences for his claim. (shrink)

Mental time travel is the ability to mentally project oneself backward in time to relive past experiences and forward in time to pre-live possible future experiences. Previous work has focused on MTT in its voluntary form. Here, we introduce the notion of involuntary MTT. We examined involuntary versus voluntary and past versus future MTT in a diary study. We found that involuntary future event representations—defined as representations of possible personal future events that come to mind with no preceding search attempts—were (...) as common as involuntary autobiographical memories and similar to them regarding cuing and subjective qualities. Future MTT involved more positive and idyllic representations than past MTT. MTT into the distant future/past involved more representations of cultural life script events than MTT into the immediate past/future. The findings are discussed in relation to cultural learning and MTT considered as a higher mental process. (shrink)

One of the more recent pedagogical debates confronting university instructors is whether liberal education should be replaced with multiculturalism. John Searle has labeled these positions as “traditionalists” and “challengers,” respectively. While not finding “much that is objectionable in the [traditionalists’] assumptions,” Searle argues that the challengers’ assumptions are “weak” and “fallacious.” This negative outcome for the challengers however, is due in large part to Searle’s misrepresentation of their position. Searle presents a flawed, straw-man argument; he unfairly and inaccurately presents the (...) challengers’ assumptions as inadequate. In this paper I shall address some of the assumptions Searle raises on the challengers’ side and offer further elucidation of their position where he fails to do so. (shrink)

In On Certainty, the important, but to many readers obscure, twentieth century Austrian philosopher, Ludwig Wittgenstein, provides not only a brilliant solution to a previously intractable philosophical problem, but also the elements of an entirely new way of approaching this and similar longstanding, apparently un-resolvable, problems. In these notes he re-conceives the problem of radical skepticism–the claim that we can never really be certain of anything except the contents of our own minds–as a kind of philosophical “disease” of thought. His (...) approach to the problem, which I will emphasize is similar to the treatment of disease, has two main goals: -/- (1) bring about an awareness in the philosopher that this kind of extreme skepticism is not a methodological approach to be taken seriously, and, with this awareness, -/- (2) an attempt to replace this radical skepticism with a practical, Common Sense framework. -/- Implicit in Wittgenstein’s approach are a number of strategies found in a contemporary approach to psychotherapy known as Cognitive Behavioral Therapy (CBT). These strategies, along with philosophical methods and scientific practices rooted in the Scottish School of Common Sense, seek to diagnose and treat irrational thoughts and beliefs that often emerge (and re-emerge) in the discipline of philosophy. The aim is to provide the philosopher with tools necessary to adjust and reshape these irrational, self-defeating thoughts and beliefs into something new, something healthy. (shrink)

This paper presents an introduction to Arne Grøn’s existential hermeneutics as a philosophical method, while also attempting to indicate how Grøn’s work contributes to and engages in a number of crucial topics in modern continental philosophy. The first section of the paper shows how Grøn draws on Paul Ricoeur and Michael Theunissen to rethink the concept of existence through a reading of Kierkegaard that uncouples this concept from the self-evident status it attained in twenty-century existentialism. The second section of the (...) paper argues that Grøn proposes an existential ethics that takes the Kierkegaardian notion that humans are inherently normative beings and uses this as a basis for a critique of ethics, as well as for establishing an ethics of vision inspired by Kierkegaard. The third section of the paper presents a reading of Grøn’s notion of religion as an inextricable part of human existence. (shrink)

There is more to legal knowledge representation than knowledge-bases. It is valuable to look at legal knowledge representation and its implementation across the entire domain of computerisation of law, rather than focussing on sub-domains such as legal expert systems. The DataLex WorkStation software and applications developed using it are used to provide examples. Effective integration of inferencing, hypertext and text retrieval can overcome some of the limitations of these current paradigms of legal computerisation which are apparent when they are used (...) on a stand-alone basis. Effective integration of inferencing systems is facilitated by use of a (quasi) natural language knowledge representation, and the benefits of isomorphism are enhanced. These advantages of integration apply to all forms of inferencing, including document generation and casebased inferencing. Some principles for development of integrated legal decision support systems are proposed. (shrink)
