Analysis of the local implementation of paternity establishment and child support policy in four Wisconsin counties suggests that these policies reproduce some aspects of patriarchal gender relations. The counties' information-collecting practices focused on nonmarital mothers' sexual activity and nonmarital fathers' employment and income. Women were questioned far more extensively than men about their sexual practices and partners; women's accounts of their sexual activity were used to evaluate their overall truthfulness, and administrative practices in effect encouraged alleged fathers to state whether (...) they were convinced of the mother's sexual fidelity. By demonstrating the gendered nature of the terms under which public assistance is granted, the findings highlight the significance of the process of policy implementation for understanding the gendered character of state systems of social provision. I argue that inferences from highly probabilifying racial generalizations are not solely objectionable because acting on such inferences would be problematic, or they violate a moral norm, but because they violate a distinctively epistemic norm. They involve accepting a proposition when, given the costs of a mistake, one is not adequately justified in doing so. First I sketch an account of the nature of adequate justification—practical adequacy with respect to eliminating the ~p possibilities from one’s epistemic statespace. Second, I argue (...) that inferences based on demographic generalizations tend to disproportionately expose group members to the risks associated with mistakenly assuming stereotypical propositions, and so magnify the wrong involved in relying on such inferences without adequate justification. À medida, porém, em que a troca de correspondência (...) se intensificava, o debate ia tornando-se cada vez mais teórico, passando pela discussão da Vida Beata, de Sêneca, até forçar Descartes a apresentar os primeiros esboços de sua própria concepção moral. I argue that the offense generation pattern of slurring terms parallels that of impoliteness behaviors, and is best explained by appeal to similar purely pragmatic mechanisms. In choosing to use a slurring term rather than its neutral counterpart, the speaker signals that she endorses the term. Such an endorsement warrants offense, and consequently slurs generate offense whenever a speaker's use demonstrates a contrastive preference for the slurring term. Since this explanation comes at low theoretical cost and imposes few constraints on (...) an account of the semantics of slurs, this suggests that we should not require semantic accounts to provide an independent explanation of the offense profile. Several authors have recently suggested that moral factors and norms `encroach' on the epistemic, and because of salient parallels to pragmatic encroachment views in epistemology, these suggestions have been dubbed `moral encroachment views'. This paper distinguishes between variants of the moral encroachment thesis, pointing out how they address different problems, are motivated by different considerations, and are not all subject to the same objections. It also explores how the family of moral encroachment views compare to classical pragmatic encroachment accounts.

Long a widespread and comfortable assumption in medieval studies, the notion of “courtly love” has come under considerable attack in recent years. Beginning in the 1960s, American scholars such as D. W. Robertson, Jr., E. Talbot Donaldson, and John F. Benton sharply criticized the whole concept, suggesting that it is a “myth” of rather recent origin, that it is an impediment to understanding medieval texts, and that it ought to be banned from scholarly discourse. Being rather crude and unrefined by (...) modern intellectual standards, the original theory of courtly love was very vulnerable to such criticism. By calling it into question the Robertsonians performed a useful and salutary service to scholarship, launching a much-needed reassessment which is still going on. And yet, because these revisionist scholars accepted at face value some of the most questionable assumptions underlying the theory, their critique of it often presents a view of medieval literature and society just as distorted as that which it seeks to replace. The total effect of their intervention has thus been to confuse the issue thoroughly rather than to clarify it. (shrink)

Theory of Literature was originally published in 1949. It is not a textbook introducing the young to the elements of literary appreciation nor a survey of the techniques employed in scholarly research. The authors have sought to unite "poetics" (or literary theory) and "criticism" (evaluation of literature) with "scholarship" ("research") and "literary history" (the "dynamics"of literature, in contrast to the "statics" of theory and criticism).

Some, but not all, of the mistakes a person makes when acting in apparently necessary self-defense are reasonable: we take them not to violate the rights of the apparent aggressor. I argue that this is explained by duties grounded in agents' entitlements to a fair distribution of the risk of suffering unjust harm. I suggest that the content of these duties is filled in by a social signaling norm, and offer some moral constraints on the form such a norm can (...) take. (shrink)

Law-enforcement agencies are increasingly able to leverage crime statistics to make risk predictions for particular individuals, employing a form of inference that some condemn as violating the right to be “treated as an individual.” I suggest that the right encodes agents’ entitlement to a fair distribution of the burdens and benefits of the rule of law. Rather than precluding statistical prediction, it requires that citizens be able to anticipate which variables will be used as predictors and act intentionally to avoid (...) them. Le jeune homme de vingt ans présente au philosophe de courts extraits de ses principales oeuvres publiées (Méditations métaphysiques, Principes de la philosophie, Discours de la méthode) que l'auteur en personne se charge d'expliquer, répondant aussi aux objections de son interlocuteur. Ce texte possède donc un statut décisif dans le corpus cartésien car il s'agit d'un (...) commentaire des points les plus délicats de la philosophie de Descartes par lui-même. Ce faisant, il ne se contente pas de répéter ce qu'il a déjà écrit sur le doute, la connaissance sensible, l'existence de Dieu, le mouvement de la matière ou encore la santé du corps, il ne cesse au contraire d'approfondir, de nuancer, voire de transformer les thèses sur lesquelles il est interrogé. Ce texte interdit ainsi de faire de la pensée de Descartes une "doctrine" stable et immuable. Il donne plutôt à voir de manière éclatante une pensée en marche, celle d'un philosophe majeur et reconnu qui accepte pourtant de remettre sur la table de travail les points essentiels d'une oeuvre déjà constituée en fonction des questions précises qui lui sont posées. Bien plus qu'un simple résumé de sa philosophie, cet Entretien montre l'inlassable exigence de l'effort de la pensée cartésienne à la conquête de sa propre clarté. (shrink)

An historical review of authorship definitions and publication practices that are embedded in directions to authors and in the codes of ethics in the fields of psychology, sociology, and education illuminates reasonable agreement and consistency across the fields with regard to (a) originality of the work submitted, (b) data sharing, (c) human participants’ protection, and (d) conflict of interest disclosure. However, the role of the professional association in addressing violations of research or publication practices varies among these fields. Psychology and (...) sociology provide active oversight with sanction authority. In education, the association assumes a more limited role: to develop and communicate standards to evoke voluntary compliance. With respect to authorship credit, each association’s standards focus on criteria for inclusion as an author, other than on the author’s ability to defend and willingness to take responsibility for the entire work. Discussions across a broad range of research disciplines beyond the social sciences would likely be beneficial. Whether improved standards will reduce either misattribution or perceptions of inappropriate attribution of credit within social science disciplines will likely depend on how well authorship issues are addressed in responsible conduct of research education (RCR), in research practice, and in each association’s ongoing efforts to influence normative practice by specifying and clarifying best practices. Between the years 1643 and 1649, Princess Elisabeth of Bohemia and René Descartes exchanged fifty-eight letters—thirty-two from Descartes and twenty-six from Elisabeth. Their correspondence contains the only known extant philosophical writings by Elisabeth, revealing her mastery of metaphysics, analytic geometry, and moral philosophy, as well as her keen interest in natural philosophy. The letters are essential reading for anyone interested in Descartes’s philosophy, in particular his account of the human being as a union of mind and body, as well as (...) his ethics. They also provide a unique insight into the character of their authors and the way ideas develop through intellectual collaboration. Philosophers have long been familiar with Descartes’s side of the correspondence. Now Elisabeth’s letters—never before available in translation in their entirety—emerge this volume, adding much-needed context and depth both to Descartes’s ideas and the legacy of the princess. Lisa Shapiro’s annotated edition—which also includes Elisabeth’s correspondence with the Quakers William Penn and Robert Barclay—will be heralded by students of philosophy, feminist theorists, and historians of the early modern period. Tobacco sales have been successfully monitored and regulated, to some extent, in convenience stores, grocery stores, and smoke shops, and in most cases sales taxes are collected. The Internet, however, is extremely difficult to regulate. States could use their regulatory powers to ban the sale of products such as tobacco and (...) alcohol over the Internet, but enforcement would be nearly impossible.The issue of enforcement of Internet sales is extremely difficult. Keeping the products out of the wrong hands, under aged children for example, is difficult. Also, it is difficult in terms of tax policy. (shrink)

En Zambie et en Tanzanie, une génération de travailleurs est en train d’atteindre l’âge de la retraite : il s’agit de ceux qui, aux côtés de leurs collègues chinois, ont construit dans les années 1970 le chemin de fer TAZARA, reliant le bassin minier (Copperbelt) zambien à l’océan Indien. Façonnés dans leur jeunesse, ces « nouveaux ouvriers » ont souscrit à la promesse et à l’édification de nations socialistes en Afrique de l’Est, avec l’espoir d’une retraite qui assurerait leurs vieux (...) jours et soutiendrait leurs familles. Mais, prenant leur retraite en pleine époque de néolibéralisme économique, ils expriment leur frustration et leur déception, estimant que l’Etat ne reconnaît pas leur contribution passée à un grand projet. Confrontés à des licenciements ou à des retards dans le versement de leurs pensions, les travailleurs du TAZARA se mobilisent, et mobilisent leurs souvenirs individuels et collectifs, pour obtenir à la fois une reconnaissance et une meilleure sécurité matérielle. Through established modern theories of design thinking, the internalization of environmental design through studio education is fundamentally a construct of ego-centrism. This fact subsequently inhibits an intersubjective and discursive professional ethic. Alternatively, a pedagogy set within a construct of practical discourse could ground an ethical construction of practice which more accurately reflects the realities of intersubjectivity found in human learning, in the best possibilities of studio education, and in the discursive processes fundamental to environmental design in society.
