Joanna Crosby and Dianna Taylor: The theme of this special section of Foucault Studies, “Foucauldian Spaces,” emerged out of the 2016 meeting of the Foucault Circle, where the four of you were participants. Each of the three individual papers contained in the special section critically deploys and/or reconceptualizes an aspect of Foucault’s work that engages and offers particular insight into the construction, experience, and utilization of space. We’d like to ask the four of you to reflect on what makes a (...) space Foucauldian, and whether or not you’d consider the space created by the convergence of and intellectual exchanges among an international group of Foucault scholars at the University of New South Wales in the summer of 2016 to be Foucauldian. Earlier this year, the U.S. Department of Health and Human Services announced its intent to strengthen enforcement of legal protections for health care providers' conscience rights. It proposed regulations that would give the DHHS Office of Civil Rights greater authority to ensure that recipients of federal funding comply with federal conscience laws. This recent development creates an opportunity for scholars and policy‐makers to revisit the perennial debate about whether and how law should protect health care providers' rights of conscience. Arguments (...) about who should be protected, what actions should be protected, and whether there should be any limitations on the exercise of conscience rights have brought us no closer to a resolution. However, there is one remaining avenue for analysis that has, surprisingly, received very little attention—the question of how providers are protected, and from what consequences. Existing U.S. conscience laws immunize health care providers from a wide range of adverse consequences—including civil liability, criminal prosecution, administrative penalties, adverse action by employers, and discrimination by private actors, among others. However, academic and public policy debates rarely acknowledge the breadth of these protections. It is essential to disentangle this network of possible protections. (shrink)

The practice of health-care professional involvement in capital punishment has come under scrutiny since the implementation of lethal injection as a method of execution, raising questions of the goals of medicine and the ethics of medicalized procedures. The American Medical Association and other professional associations have issued statements prohibiting physician involvement in capital punishment because medicine is dedicated to preserving life. I address the three primary arguments against health-care professionals being involved in lethal injection and argue that they are not (...) strong enough to prohibit physician involvement in the lethal injection process. La réflexion sur l’éthique et la déontologie des médias en Afrique de l’Ouest suscite diverses questions. Il convient d’abord de clarifier les concepts pour alimenter le débat qui a ses moments forts, notamment pendant les périodes électorales.D’un côté, les professionnels de l’information, les acteurs des médias mettent l’accent sur la nécessaire liberté de la presse et peuvent être en porte-à-faux dans leur pratique avec la philosophie et les règles de la profession. D’un autre côté, différentes institutions, que ce soit les (...) institutions gouvernementales, la société civile ou de « simples » citoyens, s’appuient sur les médias, mais les interpellent au sujet d’une liberté qui ne saurait être sans responsabilité.Il s’agira donc de contextualiser l’environnement d’intervention des médias et d’examiner les réponses données aux problèmes posés y compris par les citoyens dans leurs rapports aux médias. La mise en place d’une législation et de structures institutionnelles – que ce soit les organes de régulation, dans leur diversité, ou de manière plus problématique, les organes d’autorégulation ou le tribunal des pairs – montre qu’il existe une dynamique à prendre en compte dans le dévelop­pement des médias en Afrique de l’Ouest.Enfin, nous nous attaquerons à quelques défis, qu’il s’agisse de la formation des professionnels, de la pratique des médias en période de conflit ou des technologies de l’information et de la communication, pour montrer que l’éthique et la déontologie sont au cœur du développement démocratique en Afrique de l’Ouest et en sont un élément constitutif. Medicine often views hospice care as “giving up,” which results in a reduced quality of end-of-life care for many patients. By integrating a theology of the Sabbath with modern medicine, hospice becomes a sacred and valuable way to honor the dying patient in a comprehensive and holistic way. A theology of Sabbath as “Sacredness in Time” can provide the foundation for a shift in understanding hospice as a legitimate care plan, which shifts the focus from controlling and manipulating space for (...) the body, to rest and enjoyment of time for the whole person. First, I explore vitalism and its negative effects on the institution of hospice. Second, I address the main misconceptions and biases surrounding hospice in order to establish hospice as an appropriate option for the terminally ill. Finally, I argue for a shift away from sacredness in space (as seen in vitalism) to sacredness in time. (shrink)

Using randomly generated sequences of binary events we asked participants to make predictions about the next event. It turned out that while predicting uncertain events, people do not behave unsystematically. Our research identifies four types of relatively consistent strategies for predicting uncertain binary events: a strategy immune to short-run sequential dependencies consisting of the persistent prediction of long-run majority events, hereafter called the long-run momentum strategy ; a strategy immune to short-run sequential dependencies consisting of the persistent prediction of long-run (...) minority events, called the long-run contrarian strategy ; a strategy sensitive to short-run sequential dependencies consisting of the prediction of short-run majority events, called the short-run momentum strategy ; and a strategy sensitive to short-run sequential dependencies consisting of the prediction of short-run minority events, called the short-run contrarian strategy . When the character of events remains unknown, the most common strategy is the short-run momentum strategy. With the increase of a perceived randomness of the situation, people tend more often to use the short-run contrarian strategy. People differ in their general beliefs about the continuation or reversal of a trend in various natural and social processes. Trend believers, when facing sequences of binary events commonly perceived as random, tend to use momentum strategies, whereas those who believe in the trend's reversal tend to use contrarian strategies. When individual patients' medical decisions contribute to population-level trends, physicians may struggle with how to promote justice while maintaining respect for patient autonomy. This article argues that this tension might be resolved by using the informed consent conversation as an opportunity to position patients as societal stewards.

This paper begins with the assumption that the differences among women pose a threat to building a unified feminist theory and practice. Utilizing the work and methods of Michel Foucault, I explore theoretical and practical implications of taking difference seriously. I claim that a politics of difference puts into question the concept of a revolutionary subject and the idea of a social totality. In the final section a brief Foucauldian analysis of the feminist sexuality debates is given.

This article argues that the Supreme Court’s decision in Dobbs is likely to impact medical decision-making by pregnant patients in a variety of contexts. Of particular concern are situations where a patient declines treatment recommended for its potential benefit to the fetus and situations where treatment is withheld due to potential risk to the fetus. The Court’s elevation of fetal interests, combined with a history of courts using abortion jurisprudence to guide their reasoning in compelled treatment cases, means that Dobbs (...) has the potential to limit patient autonomy in a wide array of clinical settings. The article calls on professional medical associations to issue ethical guidance affirming the duty to respect the medical self-determination of pregnant patients. (shrink)

People make different choices depending on which decision is the default option. In intertemporal choices, the default option is typically imposed externally. For example, people expect more for delaying the gain than are willing to pay for accelerating the future gain over the same period. We claim that apart from the external default, people’s choices are also influenced by the internal default such as the time perspective resulting in the reference point in the present. By manipulating the congruency between the (...) internal and external defaults, we show that incongruence between defaults decreases the strength of discounting of gains, but not of losses. Niniejszy tekst podejmuje kwestię bogów i bohaterów mitów greckich, odnosząc ją do obecnej w psychologii głębi koncepcji archetypów i nieświadomości zbiorowej. Główny cel badań sprowadza się tym samym do bacznego przyjrzenia się potencjalnej korelacji pomiędzy zewnętrznymi w rozumieniu starożytnego Greka postaciami bogów i bogiń, a wewnętrznymi przejawami nieświadomości zbiorowej, które mogą stanowić – według Carla Gustava Junga – istotę antycznych bóstw. Ponadto został poddany namysłowi problem wpływu „wewnętrznych bogów” na sposób myślenia, odczuwania i działania jednostki, wpływu zarówno pozytywnego, jak i (...) negatywnego. Occupying an eccentric position with respect to critical theories, Foucault prefigures a queer critical thought and practice. In this paper I make a case for the continuing importance of Foucault for rethinking feminism within the context of neoliberal governmentality despite continuing skepticism about the value of his ethical writings. I draw not only upon the work of Foucault, but also that of queer feminist Eve Kosofsky Sedgwick.

A generalized Wittgensteinian semantics for propositional languages is presented, based on a lattice of elementary situations. Of these, maximal ones are possible worlds, constituting a logical space; minimal ones are logical atoms, partitioned into its dimensions. A verifier of a proposition is an elementary situation such that if real it makes true. The reference (or objective) of a proposition is a situation, which is the set of all its minimal verifiers. (Maximal ones constitute its locus.) Situations are shown to form (...) a Boolean algebra, and the Boolean set algebra of loci is its representation. This text aims at a multi-dimensional reflection on Erich Fromm’s conception of the human being. Starting from Marxist-Freudian sources of the philosopher’s thought, the authors show the fundamental ideas underlying his version of psychoanalysis. Next, Fromm’s view of the human being as a social being is discussed, referring to the concepts of unproductive and productive orientations. Another important dimension of Fromm’s thought that is discussed is the reflection on the nature and functions of the symbolic language of the unconscious, which (...) reveals to the human being both the best and the worst aspects of his or her personality. One of the most famous concepts of the American philosopher is also discussed — the distinction between the being mode and the having mode. The authors drawattention to the value Fromm placed on a life oriented towards the being mode. Finally, they remind us, following Fromm, that a human being turns towards himself in his or her dreams, going beyond all the schemes and concepts that bind his mind when he or she is awake. The understanding of oneself that comes from a deep reflection on the content and character of a dream can awaken in a person the recognition of previously unknown dimensions of his or her mind; from now on, he is not merely someone immersed in the reality of everyday life. Crossing the horizon of oneiric imagination, he or she becomes free, in the dream, and she experiences the freedom of being on waking. (shrink)

The most difficult problem that Leniewski came across in constructing his system of the foundations of mathematics was the problem of defining definitions, as he used to put it. He solved it to his satisfaction only when he had completed the formalization of his protothetic and ontology. By formalization of a deductive system one ought to understand in this context the statement, as precise and unambiguous as possible, of the conditions an expression has to satisfy if it is added to (...) the system as a new thesis. Now, some protothetical theses, and some ontological ones, included in the respective systems, happen to be definitions. In the present essay I employ Leniewski's method of terminological explanations for the purpose of formalizing ukasiewicz's system of implicational calculus of propositions, which system, without having recourse to quantification, I first extended some time ago into a functionally complete system. This I achieved by allowing for a rule of implicational definitions, which enabled me to define any propositionforming functor for any finite number of propositional arguments. (shrink)
