In this article, we comment upon and provide an arts-informed example of an emotive-focused reflection of a health care practitioner. Specifically, we use poetry and photographic imagery as tools to un-earth practitioners’ emotions within agonizing and traumatic clinical encounters. In order to recognize one’s own humanness and authentically engage in the art of medicine, we immerse ourselves in the first author’s poetic and photographic self-reflection. The poem and image are intended to inspire interpretation and meaning based on the reader’s own (...) professional and/or personal context. The last line of the poem is “I take off the gloves. Advance care planning (ACP) is considered a pivotal aid in the decision‐making process, especially for many people living with dementia, who inevitably will lose the capacity to make decisions at the end of life. In Italy, ACP has been recently regulated by law 219/2017, leading to the investigation of how physicians deal with ACP in dementia. In order to comprehend the perception of physicians who provide care for patients with dementia regarding ACP and to describe their difficulties and needs, this (...) study presents the results of a qualitative research study performed within a local health authority in northern Italy. Data were collected by semi‐structured interviews with 11 physicians dealing with patients with dementia and were analysed using interpretative phenomenological analysis. Four superordinate themes were identified, describing both the difficulties and challenges perceived by physicians in performing shared ACP in their daily activities. This study demonstrates that physicians experience troubles synchronizing the time of shared ACP with the more rapid development of dementia. Results also suggest that further training about communication on ACP is urgently required to ease the implementation of shared ACP. A broader involvement of institutions and other professionals is also important in spreading ACP among healthcare institutions. (shrink)

The Academics offered an argument from twins or perceptually indiscernible objects and an argument from dreams or madness in support of the indiscernibility thesis: that every true perceptual impression is such that some false impression just like it is possible. O principal ponto de desacordo sobre a abordagem kantiana do problema da verdade é se ela pode ser compreendida nos moldes da filosofia contemporânea como coerentista ou como correspondentista. Primando por uma consideração sistemática da argumentação de Kant em confronto com a literatura existente sobre o problema, este trabalho defende a segunda alternativa. Sustentase a tese de que a definição da verdade como a “concordância do conhecimento com o seu objeto” é cogente em todo o percurso do pensamento kantiano e (...) que, nessa acepção, a verdade culmina por ser abordada não a partir de uma teoria estabelecida, mas como um problema cuja solução não pode ser dada nos limites da filosofia crítico-transcendental. Pondera-se, primeiramente, a literatura que situa Kant quer como coerentista quer como correspondentista e sistematiza-se a segunda alternativa em quatro grupos: a leitura ontológica, a leitura isomórfica, a leitura “consequencialista” e a leitura regulativa. Num segundo momento, em atenção ao período pré-crítico, argumenta-se que a alternativa coerentista deixa de se confirmar já nessa mesma época e que, na década de 1750, Kant descarta uma suposta teoria correspondentista isomórfica. Num último momento, considera-se a argumentação crítica e defende-se que a mesma concebe a verdade como um problema fundamental que não cabe ao tratamento de uma teoria correspondentista concebida de modo “consequencialista” ou regulativo. A discussion concerning whether to conceive Artificial Intelligence systems as responsible moral entities, also known as “artificial moral agents”, has been going on for some time. In this regard, we argue that the notion of “moral agency” is to be attributed only to humans based on their autonomy and sentience, which AI systems lack. We analyze human responsibility in the presence of AI systems in terms of meaningful control and due diligence and argue against fully automated systems in medicine. With (...) this perspective in mind, we focus on the use of AI-based diagnostic systems and shed light on the complex networks of persons, organizations and artifacts that come to be when AI systems are designed, developed, and used in medicine. We then discuss relational criteria of judgment in support of the attribution of responsibility to humans when adverse events are caused or induced by errors in AI systems. (shrink)

Anglo-American authors have paid little attention to a subtle distinction that has important jurisprudential implications. It is the distinction between sources of law and the legal norms which can be derived from sources by means of interpretation. The distinction might also be rendered as a threefold one, separating sources of law from legal norms and both of these from that which mediates their relation, namely, methods of legal interpretation. BackgroundUnder COVID-19 pandemic, many organizations developed guidelines to deal with the ethical aspects of resources allocation. This study describes the results of an argument-based review of ethical guidelines developed at the European level. It aims to increase knowledge and awareness about the moral relevance of the outbreak, especially as regards the balance of equity and dignity in clinical practice and patient’s care. MethodAccording to the argument-based review framework, we started our research from the following two questions: what are the ethical (...) principles adopted by the ethical guidelines produced at the beginning of the COVID-19 outbreak related to resource allocation? And what are the practical consequences in terms of 'priority' of access, access criteria, management of the decision-making process and patient care?ResultsTwenty-two ethical guidelines met our inclusion criteria and the results of our analysis are organized into 4 ethical concepts and related arguments: the equity principle and emerging ethical theories; triage criteria; respecting patient’s dignity, and decision making and quality of care.ConclusionFurther studies can investigate the practical consequences of the application of the guidelines described, in terms of quality of care and health care professionals’ moral distress. O artigo trata das relações entre mito e filosofia enquanto formas do discurso humano. A análise filosófica da narrativa mítica a partir do modelo metafórico e a compreensão da consciência mítica, como forma originária da presença do ser humano no mundo, revelam o mito como sabedoria, pela qual os grupos humanos garantiram sua sobrevivência e identidade e na qual formulam o sentido de sua existência.

BackgroundThis study aims to quantitatively and qualitatively evaluate the activities of a Bioethics Unit (BU) 5 years since its implementation (2016–2020). The BU is a research unit providing empirical research on ethical issues related to clinical practice, clinical ethics consultation, and ethical education for health care professionals (HPS).MethodsWe performed an explanatory, sequential, mixed-method, observational study, using the subsequent qualitative data to explain the initial quantitative findings. Quantitative data were collected from an internal database and analyzed by descriptive analysis. Qualitative evaluation (...) was performed by semi-structured interviews with 18 HPs who were differently involved in the BU’s activities and analyzed by framework analysis.ResultsQuantitative results showed an extensive increment of the number of BU research projects over the years and the number of work collaborations with other units and wards. Qualitative findings revealed four main themes, concerning: 1. the reasons for contacting the BU and the type of collaboration; 2. the role of the bioethicist; 3. the impact of BU activities on HPs, in terms of developing deeper and more mature thinking; 4. the need to extend ethics support to other settings. Overall, our results showed that performing both empirical bioethics research and more traditional clinical ethics activities at the same unit would produce an impetus to increase collaboration and spread an 'ethical culture' among local HPs.ConclusionsOur findings contribute to a growing body of literature on the models of clinical ethics support services and the role of empirical research in bioethics internationally. They also prepare the ground for the implementation of a multidisciplinary Clinical Ethics Committee (CEC) that aims to support the BU’s ethics consultation service within the local context. Phenomenological Interpretations Relating to the Philebus” (1928), this article seeks to highlight the fundamental lines of Plato’s image, outlined in that author’s first philosophical publication (1931). The confrontation with the themes of ethics and dialectic, in the current state of Platonic studies, indicates that in Plato’s image drawn in the early confrontation with the Philebus, clearly influenced by the phenomenological notion of Dasein, one already finds the fundamental features of what will become Gadamer's (...) philosophical hermeneutics, fully emancipated from Heideggerian tutelage. A Sociedade da Transparência, o controle psicopolítico, a digitalização e a crise da democracia são temas que ressurgem associados ao fenômeno do aprisionamento digital nas redes. Fenômeno em que se debatem entre si a informação produzida pela dinâmica da transparência e o holismo do Big Data. (...) Argumentation theorists often disagree about which scheme best represents a given type of argument. Unfortunately, authors sometimes become involved in fruitless pseudo-agreement because they fail to perceive that their supposedly competing schemes are means for achieving different practical or theoretical goals. This paper explains some of the different purposes that an argument scheme may serve, and it indicates how the relevant type of pseudo-disagreement may be avoided.

We use hyperbolic towers to answer some model-theoretic questions around the generic type in the theory of free groups. We show that all the finitely generated models of this theory realize the generic type $p_{0}$ but that there is a finitely generated model which omits $p^{}_{0}$. We exhibit a finitely generated model in which there are two maximal independent sets of realizations of the generic type which have different cardinalities. Four hundred seventy-six nuclear power plants are in operation or under construction around the world. Are concepts for designing and operating plants safely sufficient? Conventional approaches are premised on expectations of predictability and control of radiation release and on assumptions that plant operations are closed systems. Field observations in the industry find, however, that the periodic necessity to refuel, test safety equipment, and continuously upgrade plant designs introduces challenges to control not originally calculated. The social and cultural contexts of markets, (...) regulation, and work systems create additional contingencies. In this dynamic environment, reactor operations produce invaluable data about the states of the entire technology and organizational system. Rereading these dynamics as "experiments" suggests an alternative epistemol ogy that synthesizes science's values of doubt, discovery, and documentation with engineering's values of efficiency, optimization, and problem solving. This redefines plant-based risk handlers as ethologists, geologists, and anthropologists of an ecology of visible and invisible hazards. (shrink)

Defenders and opponents of judicial review under charters of rights often share political ideals, and yet disagree deeply on the best means to pro- mote them or on the proper way to balance them in the event of conflict. In his most recent book, Wil Waluchow attempts to provide a theory of judicial review which deals adequately with the popular ideals of stability and adaptability. The cornerstone of his argument is the notion of community morality - that which enables constitutional (...) adjudicators to develop charter law (adaptability) while remaining loyal to democratic and rule of law principles (stability). The aim of this paper is to offer a critique of the notion of community morality; in particular, the aim is to challenge the assumption that the morality of the members of modern plural societies is as uniform as Waluchow’s theory requires it to be.Resumen:Los defensores y oponentes de la figura del judicial review que se lleva a cabo a través de la defensa de las garantías individuales en ocasiones comparten puntos de vista en relación con los ideales políticos, sin embargo, existen profundos desacuerdos en cuanto a la mejor forma de promocionarlos o en cuanto a la manera apropiada de decidir casos concretos en casos de conflicto. En su más reciente libro, Wil Waluchow intenta proporcionar una teoría del judicial review que atienda adecuadamente los ideales comunes de estabilidad y adaptabilidad. El punto medular de su argumento es la noción de la moralidad de la comunidad—aquella que permite a los jueces constitucionales desarrollar las garantías y derechos (adaptabilidad) mientras que se continúa leal a los principios de democracia y Estado de derecho (estabilidad)—. El objetivo de este trabajo es ofrecer una crítica a esta noción de moralidad de la comunidad, concretamente el objetivo es plantear un reto a la cuestión de asumir que la moralidad de los miembros de las sociedades modernas plurales es tan uniforme como lo exige la teoría de Waluchow. In the current debate in political philosophy, the so-called communitarian thinkers intend to offer an alternative to the dominant liberal thought. The ideal of ethicalcommunity as way of life in society in which intersubjective relationships are ruled by laws conceived as public laws, reintroduces the question of virtue in the scope of social and political life, with the requirement of an ethical style of doing politics.

The paper provides a qualified defence of Bruce Waller’s deductivist schema for a priori analogical arguments in ethics and law. One crucial qualification is that the schema represents analogical arguments as complexes composed of one deductive inference but also of one non-deductive subargument. Another important qualification is that the schema is informed by normative assumptions regarding the conditions that an analogical argument must satisfy in order for it to count as an optimal instance of its kind. Esta comunicación toma como punto de partida un conflicto paradigmático entre las concepciones de Isócrates y de Platón sobre la educación y el ideal de hombre que las guiaba, para delinear los trazos de otro conflicto entre el humanismo inspirado por la tradición griega, asumido y transformado en el interior de la tradición cristiana, y un “humanismo” que, en el marco del pensamiento liberal, intenta recrear el ideal de hombre en términos de individuo aislado, con desdoblamientos consecuentes en la concepción (...) de la sociedad y de las tareas del Estado. Las tres figuras del conflicto aquí expuestas indican que los desafíos actuales del humanismo de inspiración cristiana son ciertamente más graves de los que se le presentaron al humanismo griego del siglo IV a.c. El individualismo asumido como ideología, el liberalismo transformado en tradición y el neoliberalismo como doctrina econó- mica hegemónica conforman una comprensión de hombre y de los bienes de la vida humana, en sus dimensiones individuales y sociales, en contraste radical con la que se reporta a la tradición cristiana. The deduction of the categories lies undoubtedly at the very heart of Kant's theoretical philosophy and, for this reason, it is one of items in the philosophical canon that is greatly discussed and least agreed upon. In the modern and contemporary Western philosophical tradition as well as in Kant’s literature, the loci classici for its consideration are the 1781 and 1787 editions of the Critique of pure reason. In this paper, I aim at presenting and discussing an argument that Kant (...) advances in the Prolegomena and which is virtually ignored in the approach of the deduction of the categories. At first, an inquiry into the distinction between analytic and synthetic methods is carried out. After that, the difference between judgments of perception and judgments of experience is taken into account. Finally, the Prolegomena’s argument for the categories is brought into discussion. This paper takes up two questions. Is there a sense in which the Sceptic as described by Sextus Empiricus is detached from himself? Does this self-detachment by itself make the Sceptic’s way of life undesirable? I sketch two conceptions of self-detachment, and then conclude that the Sceptic faces a dilemma: either he is more detached from himself than the non-Sceptic or he is vulnerable to a non-standard version of the apraxia objection.

No Timeu, ao tomar a via mais longa para expor a natureza da alma, Platão apresenta a Ideia da alma cósmica como uma mistura de três Ideias intermediárias procedentes de um princípio bipolar. Assim como na alma do mundo, também a alma humana possui uma estrutura tripartite (...) hierarquizada segundo o mesmo princípio bipolar que governa a realidade.
