This paper analyses whether current explainable AI (XAI) techniques can help to address taxpayer concerns about the use of AI in taxation. As tax authorities around the world increase their use of AI-based techniques, taxpayers are increasingly at a loss about whether and how the ensuing decisions follow the procedures required by law and respect their substantive rights. The use of XAI has been proposed as a response to this issue, but it is still an open question whether current XAI (...) techniques are enough to meet existing legal requirements. The paper approaches this question in the context of a case study: a prototype tax fraud detector trained on an anonymized dataset of real-world cases handled by the Buenos Aires (Argentina) tax authority. The decisions produced by this detector are explained through the use of various classification methods, and the outputs of these explanation models are evaluated on their explanatory power and on their compliance with the legal obligation that tax authorities provide the rationale behind their decision-making. We conclude the paper by suggesting technical and legal approaches for designing explanation mechanisms that meet the needs of legal explanation in the tax domain. (shrink)

Noise in behavior is often viewed as a nuisance: while the mind aims to take the best possible action, it is let down by unreliability in the sensory and response systems. How researchers study cognition reflects this viewpoint – averaging over trials and participants to discover the deterministic relationships between experimental manipulations and their behavioral consequences, with noise represented as additive, often Gaussian, and independent. Yet a careful look at behavioral noise reveals rich structure that defies easy explanation. First, both (...) perceptual and preferential judgments show that sensory and response noise may potentially only play minor roles, with most noise arising in the cognitive computations. Second, the functional form of the noise is both non-Gaussian and non-independent, with the distribution of noise being better characterized as heavy-tailed and as having substantial long-range autocorrelations. It is possible that this structure results from brains that are, for some reason, bedeviled by a fundamental design flaw, albeit one with intriguingly distinctive characteristics. Alternatively, noise might not be a bug but a feature: indeed, we suggest that noise is fundamental to how cognition works. Specifically, we propose that the brain approximates probabilistic inference with a local sampling algorithm, one that uses randomness to drive its exploration of alternative hypotheses. Reframing cognition in this way explains the rich structure of noise and leads to a surprising conclusion: that noise is not a symptom of cognitive malfunction but plays a central role in underpinning human intelligence. The aim of this paper is to further develop van Fraassen’s diagnosis, expanding a previous analysis of the fundamental law of classical genetics and the status of the so-called ‘Mendel’s laws’.6 According to this diagnosis the Hardy-Weinberg law: 1) cannot be considered as axiom (or fundamental law) for classical population genetics, since it is a law that describes an equilibrium that 2) holds only under certain special conditions, and 3) only determines a subclass of models, 4) whose generalized form (and (...) fundamental law) being shading off into logical vacuity, and 5) more complex variants of the fundamental law (and of the Hardy-Weinberg law) can be “deduced” for more realistic assumptions. In order to achieve this, I will use notions of the structuralist view of theories, a version that is related to but different from that of van Fraassen’s. These are the notions of fundamental law, specialization, and special law. Having as a background a structuralist reconstruction of classical population genetics, I will show why the Hardy-Weinberg law should not be in fact considered the fundamental law of such a theory, but a special law (and not even a “terminal” specialization, i.e. a “non-terminal” specialization). Der orthodoxen Interpretation zufolge wird die Genetik als eine Disziplin dargestellt, deren Geschichte (von ihrem vermuteten Ursprung mit dem Werk Mendels an über die Werke der sogenannten «Wiederentdecker» de Vries, Correns und Tschermak und des englischen Mendelianers Bateson bis hin zur Arbeit Morgans) kontinuierlich, kumulativ und linear verlaufen sei. Im ersten Teil des Buches wird hingegen die Diskontinuität dieses Prozesses betont. Innerhalb der strukturalistischen Auffassung wissenschaftlicher Theorien wird die klassische Genetik im zweiten Teil in einer Weise rekonstruiert und formal analysiert, (...) die den im ersten Teil erarbeiteten Ergebnissen gerecht wird. Three metascientific concepts that have been object of philosophical analysis are the concepts oflaw, model and theory. The aim ofthis article is to present the explication of these concepts, and of their relationships, made within the framework of Sneedean or Metatheoretical Structuralism (Balzer et al. 1987), and of their application to a case from the realm of biology: Population Dynamics. The analysis carried out will make it possible to support, contrary to what some philosophers of science in general and of (...) biology in particular hold, the following claims: a) there are "laws" in biological sciences, b) many of the heterogeneous and different "models" of biology can be accommodated under some "theory", and c) this is exactly what confers great unifying power to biological theories. In this paper, I discuss the problem of scientific laws in general and laws of biology in particular. After reviewing the debate around the existence of laws in biology, I examine the subject in the light of the structuralist notion of a fundamental law and argue for the law of matching as the fundamental law of genetics.

Taking as starting point Kuhn’s analysis of science textbooks and its application to Sinnott and Dunn’s (1925), it will be discussed the problem of the existence of laws in biology. In particular, it will be showed, in accordance with the proposals of Darden (1991) and Schaffner (1980, 1986, 1993), the relevance of the exemplars, diagrammatically or graphically represented, in the way in which is carried out the teaching and learning process of classical genetics, inasmuch as the information contained in them, (...) indispensable for the right development of that process, exceeds the information contained in the “laws” linguistically articulated and presented in the textbooks. However, it will be maintained that the information is implicit in the law that according to the structuralist concept of fundamental law and the reconstruction of genetics presented by Balzer & Dawe (1990), and later developed by Balzer & Lorenzano (1997) and Lorenzano (1995, 2000, 2002a) could be considered the fundamental law of classical genetics,the law of matching, clearly identified in this paper. In this paper I discuss the problem of scientific laws in general and laws of biology in particular. After reviewing the debate about the existence of laws in biology, I examine the subject under the light of the structuralist notion of a fundamental law and argue for the law of matching as the fundamental law of genetics.

Different conceptions of scientific theories, such as the state spaces approach of Bas van Fraassen, the phase spaces approach of Frederick Suppe, the set-theoretical approach of Patrick Suppes, and the structuralist view of Joseph Sneed et al. are usually put together into one big family. In addition, the definite article is normally used, and thus we speak of the semantic conception of theories and of its different approaches . However, in The Semantic Conception of Theories and Scientific Realism , starting (...) from certain remarks already made in “Theory Structure” , Current Research in Philosophy of Science, East Lansing: Philosophy of Science Association, 1979, pp. 317–338), Frederick Suppe excludes the structuralist view as well as other “European” versions from the semantic conception of theories. In this paper I will critically examine the reasons put forward by Suppe for this decision and, later, I will provide a general characterization of the semantic family and of the structuralist view of theories in such a way as to justify the inclusion of the structuralist view as a member of this family. The aim of this paper is to show, in the line suggested by Nickles (1980, 1981) and developed by Sintonen (1985, 1996), not just that the problem-solving approach and the theory approach are not incompatible, but also that the latter, in the version of the semantic conception of theories known as “structuralist view”, can be used to give precision to the problem-solving approach, by a more precise characterization of the theoretical context in which problems arise and, in this way, to (...) their individuation and history, distinguishing two types of “problem change”: “change in a problem” and “change of a problem”. In order to do this, it will be presented a proposal that will be applied to the two first research programs in the field of genetics: the “mendelism” of Bateson and “classical genetics” of Morgan. The aim of the present paper is to contribute to the discussion on the constitutive a priori in science by linking it with the discussion on scientific laws and theories, in such a way to show how the different senses of the notion of constitutive a priori are not incompatible to each other and that they can be precised in a unified, though differentiated, manner.

Tres conceptos metacientíficos objeto de análisis filosófico son los de ley, modelo y teoría. El objetivo de este artículo es presentar la elucidación de estos conceptos, y de sus relaciones, hecha dentro del marco del Estructuralismo Metateórico o Sneediano (BALZER; MOULINES & SNEED, 1987), y de su aplicación a un caso del ámbito de la Biología: la Genética Clásica. El análisis realizado posibilitará fundamentar, en contra de lo que sostienen algunos filósofos de la ciencia en general y de la biología (...) en particular, las siguientes afirmaciones: a) que hay “leyes” en las ciencias biológicas, b) que muchos de los heterogéneos y distintos “modelos” de la Biología pueden ser acomodados bajo alguna “teoría”, y c) que justamente esto es lo que les confiere a las teorías biológicas su gran poder unificador. Sponsored by the Argentine Association for the Progress of Sciences, Ciencia e Investigación magazine released its first issue in 1945. In order to circulate the discoveries in the areas of medical and natural sciences, and to instruct on scientific thought, the magazine was introduced as a knowledge disseminating one and attempted to address a general audience. However, during its first publication decade the CEI editors faced two challenges related to scientific communication. On the one hand, they exhibited the conflicts implied (...) in research writing and the typical conditions of the language of science. On the other, they manifested their interest to bestow a discursive style on the magazine which, although simple and oriented to a wide audience, would not corrupt scientific veracity. This paper follows the French approach to discourse analysis, whose purpose is the simultaneous and reciprocal study of the verbal and the socio-institutional dimension of discourses, and analyses the sociolinguistic representations of the language of science and of its dissemination formulated in CEI between 1945-1955, a period - besides - complex for the scientific development in Argentina, characterized by state interventionism in different institutions. To this aim, editorials and articles that address the aforementioned problems have been selected and examined. The results exhibit the discursive complexities of scientific dissemination in an environment unaware of this practice and, consequently, the difficulty of determining a reader profile for the magazine. In general terms, they reveal the importance of the reflection on the language for the development and communication of science. (shrink)

The aim of the present communication is to contribute to the discussion about the existence of laws in biology. In order of it the argumentation of J.J.C. Smart against their existence and the discussion of it made by M. Ruse and R. Munson are first reconstructed. The examination of this controversy shows that, despite of the differences between the first of the authors mentioned and the other two in relation to the problem of laws in biology, the three share the (...) assumption according to which in the case that there are laws (in strict sense or fundamental) in genetics, they must be some of the so-called “Mendel’s laws”. In the present communication, and from a revision of the metascientific concept of fundamental law, the above assumption is questioned, proposing an alternative analysis, based on a structuralist reconstruction of genetics. The objective of this papper is to examine, under the light of some recent works in general philosophy of science as well as in special philosophy of biology, the different forms that assumes the thesis of the unity of science, in order to be able to determine in what sense it can be spoken about the unity of biological sciences.

In the second one, the established connection will be nuanced, from a revision of the work of a “classical” author such as Carnap. Scientific activity produces results of various types. In particular, science produces a special kind of knowledge or knowledges, assumed to be different from knowledge or common sense knowledge, from everyday experience and formulated in ordinary language; a more systematized knowledge, with greater range and accuracy, and intersubjectively controllable. To produce this kind of knowledge (or knowledge), we introduce new concepts, formulate hypotheses and laws and, ultimately, construct theories, being the result of a practice or specific activity, considering science as (perhaps), (...) the supreme intellectual achievement of mankind. Thus, philosophical theorizing of science, or “philosophy of science”, is characterized by the development of interpretative conceptual frameworks of philosophical character, in order to understand science. Philosophy of science is, not just part of metascience, but also a part of philosophy, precisely that which is responsible for analyzing science. (shrink)

The question posed by the title is usually answered by saying that the “synthesis” between the theory of evolution by natural selection and classical genetics, which took place in 1930s-40s, would have taken place much earlier if Darwin had been aware of Mendel and his work. What is more, it nearly happened: it would have been enough if Darwin had cut the pages of the offprint of Mendel’s work that was in his library and read them! Or, if Mendel had (...) come across Darwin in London or paid him a visit at his house in the outskirts! (on occasion of Mendel’s trip in 1862 to that city). The aim of the present paper is to provide elements for quite a different answer, based on further historical evidence, especially on Mendel’s works, some of which mention Darwins’s studies. The article reviews research between 1999 and 2013 with the aim of knowing the epistemological foundations of research on distributed leadership, with special interest in education studies. We conclude it is an area in developing, with potential, but its empirical foundations are weak and methodological strategies are not always explicit, making it difficult to evaluate their findings somewhat. With respect to the theoretical basis, much of the research finds their sustenance in Engeström’s activity theory and Hutchins’s distributed cognition. The importance (...) of distributed leadership studies is its growing influence in the administration of colleges and universities, making these studies, a major political issue. El artículo revisa investigaciones entre los años 1999 y 2013 con el objetivo de conocer las bases epistemológicas de la investigación en liderazgo distribuido, con especial interés en estudios de educación. Se concluye que es un campo en formación, con potencial, pero que sus bases empíricas son débiles y sus estrategias metodológicas no siempre están explícitas, lo que dificulta un poco evaluar sus descubrimientos. Con respecto a las bases teóricas, gran parte de las investigaciones encuentran su sustento en la teoría de la actividad de Engeström y la teoría de la cognición distribuida de Hutchins. La importancia de los estudios de liderazgo distribuido es su creciente influencia en la administración de colegios y universidades, lo que hace de estos estudios un tema de gran relevancia política. Tocar los porqués últimos de la técnica, filosofar sobre ella, requiere un concepto radical de la misma, así como un autoexamen de la filosofía hacia sus propias "técnicas". Desde tal radicalidad estudiamos sobre la técnica: su surgimiento a partir de los límites humanos y su historicidad ; sus raíces en el ser y las transformaciones de éste ; su construcción racional ; sus géneros, técnicas del ser y técnicas del tener ; y su último alcance, en cuanto a las posibles (...) raíces ateas en la técnica. This paper discusses partial results of an ongoing project focused on analysing the current usefulness and implications of developing research on agent-based social simulation models beyond academic, hobbyist or educational purposes. Design, development and testing phases of such modelling are discussed along with common issues evidence-driven modellers often face whilst collecting, analysing and modelling quantitative and qualitative data into social simulations. It also includes a discussion on the evidence gathered in published literature and structured interviews with researchers that have lead (...) mid- to long-term (3–5 years) projects on social simulation in Europe and the United States. Finally, good-practice recommendations are put forward by presenting a development methodology fully guided by evidence. (shrink)

Este artículo analiza el pesimismo desde una perspectiva ontológica. Para esto se analizan dos concepciones filosóficas que describan un “estado de cosas”, es decir, lecturas de la realidad en donde se manifieste la naturaleza decadente de la realidad: Schopenhauer y Nietzsche, por ejemplo. Para ello, se analizará la estructura ontológica de la realidad y su pertinencia con el suicidio: ¿el suicidio es conclusión necesaria del pesimismo? Luego, se analiza la ontología pluralista de Philipp Mainländer que defiende una postura a favor (...) del suicidio en contraposición de la ontología monista de Schopenhauer y la ontología pluralista de Nietzsche. Para finalizar con un análisis ontológico a partir de las tecnologías involucradas en la afirmación o negación del suicidio. (shrink)

Esta conversación tuvo lugar durante una visita de varios días de Pablo Posada Varela a la casa de Marc Richir en Haut-Vaucluse en junio de 2012. He aquí tres extractos (de extensión variable) de una conversación del 8 de junio, y algunos otros fechados el 10 de junio.

Neste artigo, pretendemos defender a tese segundo a qual julgamentos sociais se iniciam com a percepção emocional e com o processamento de informações emocionais no reconhecimento de expressões faciais. Para tanto, revisaremos modelos que discutem (i) os mecanismos pelos quais as expressões faciais são codificadas para transmitir informações e ser percebidas pelos outros, (ii) os mecanismos perceptivos de decodificação e categorização de expressões faciais e, por fim, (iii) os mecanismos pelos quais o reconhecimento de expressões faciais geram respostas emocionais e (...) ajustes comportamentais e, por fim, (iv) a eficiência de nosso sistema perceptual na decodificação desses processos. Com essa discussão, nossa intenção é a de (i) explicitar em que sentido nossa percepção emocional de expressões faciais é u m dos principais mecanismos evolutivos de regulação da vida e que (ii) o processamento de informações emocionais é um poderoso instrumento para assegurar a sobrevivência e sustentar razoáveis interações sociais. O presente texto é de natureza hermenêutica, e sua finalidade é a de sistematizar o estudo que empreendemos em relação às linhas gerais do projeto de Varela, Thompson e Rosch. Nosso objetivo é o de analisar as bases e o caminho a partir dos quais nossos autores buscaram redirecionar os rumos e mesmo os princípios mais centrais das ciências empíricas e fenomenológicas da mente. Buscaremos demonstrar que o projeto de Varela, Thompson e Rosch foi exitoso em seu propósito de constituir (...) um novo programa de pesquisa no interior das ciências cognitivas e das ciências da mente em geral. Buscaremos, por fim, discutir a concepção de cognição sobre a qual se sustentaram e o papel da fenomenologia nesse empreendimento. (shrink)

We introduce the variety $\scr{L}_{n}^{m}$ , m ≥ 1 and n ≥ 2, of m-generalized Łukasiewicz algebras of order n and characterize its subdirectly irreducible algebras. The variety $\scr{L}_{n}^{m}$ is semisimple, locally finite and has equationally definable principal congruences. Furthermore, the variety $\scr{L}_{n}^{m}$ contains the variety of Łukasiewicz algebras of order n.

Les évangéliques sont devenus une source inépuisable d’énigmes, de paniques et de poncifs, et un grand défi pour les forces progressistes. Leur croissance montre que la sécularisation ne fonctionne pas comme un mur capable d’annuler les échanges entre le monde de la religion et celui de la politique. Mais elle montre aussi des efficaces connexions entre le théologique et les croyances et les sensibilités populaires, matérialisées par la « théologie de la prospérité » et la guerre spirituelle.

Grounded in a will to adapt to dangers, and espouse both responsibility and resilience, voluntary measures have largely replaced one of the oldest public health strategies, quarantine. The Covid-19 pandemic, however, elicited a broad sweep of tactics from the archive of public health armoury. On a general level, this review essay addresses the common measures rolled out by various authorities against the pandemic - the lock-downs, reopening process, financial support and vaccination. By relating these measures to 1) the “plague-stricken town”, (...) deployed during the seventeenth and eighteenth centuries in Europe by the Polizeistaat; 2) the “self-regulation strategy” that emerged with liberal ideas at the end of the eighteenth century; and 3) the “minimum security” programmed by neoliberal governmentality in the second half of the twentieth century, it is suggested that tensions between freedom and security during, and after, the pandemic can be better understood. To end, the essay noticed that the pandemic has enforced tensions in the administration and calibration of individual wishes and collective wellbeing, creating a fragile “freedom-security relationship” and new problem space for self-regulation. El objetivo de este trabajo es mostrar la importancia que tiene recuperar el concepto de «ideología» y con él la labor de crítica ideológica en la teoría del derecho. En las teorías positivistas de Kelsen y Ross era uno de los conceptos centrales, pero cayó paulatinamente en desuso en la segunda mitad del siglo xx, tanto a nivel político como en el campo específico de la teoría jurídica. En este trabajo se examinan algunas de las razones por las que se (...) dejó de utilizar y se propone un concepto de «ideología» capaz de evitar esos cuestionamientos. Por último, se ponen de manifiesto las consecuencias perjudiciales (tanto teóricas como prácticas) que trae aparejado el abandono de la crítica ideológica en la teoría jurídica. Se utiliza como caso de estudio la concepción postpositivista sobre la naturaleza del derecho defendida por Manuel Atienza y algunas de las decisiones argumentativas que el propio Atienza ha adoptado guiado por ella en una polémica sobre el estatus normativo de la gestación por sustitución en la práctica jurídica española. This text proposes an interpretation of the work of Franklin Leopoldo e Silva based on the reading of some of his numerous published articles and books, without neglecting the classes and guidance received from the stage of Scientific Initiation to Postdoctoral studies. Precisely, by highlighting the importance of three thinkers widely studied by Professor Franklin – Berkeley, Bergson and William James –, we suggest that at the heart of this philosophical experience there would be a constant: empiricism. Whether in the (...) classical or radical version, the line we draw in this multiplicity reveals an openness to concrete empiricism. (shrink)

Although the simultaneous presence of multiple ambitions is inherent in hybrid venturing, pursuing social and/or environmental missions while securing commercial viability can generate ambivalence among stakeholders. In this study, we draw on the notion of “holism” to show how venture founders both embrace tensioned ambitions and sustain hybridity during critical venture development phases. Based on 6 years of data on The People’s Supermarket in the United Kingdom, we identify three distinct practices— fantasizing, bartering, and conjuring—used by founders to harness tensions (...) productively, without compromising their venture’s multiple ambitions. These practices demonstrate the founders’ ability to maintain a venture’s hybrid nature throughout the ideation, organizational, and scale-up phases, thereby shedding light on the application of “holism” within the realm of hybrid venturing. Junto con Rebeldes académicos de Iván Jaksić (SUNY 1989; UDP 2013) y Una disciplina de la distancia de Cecilia Sánchez (CESOC 1992), este libro ya forma parte del canon bibliográfico selecto y escaso que propone investigaciones de largo aliento sobre la historia de la filosofía en el Chile republicano. No se trata de una reseña de nombres y obras, ni de una historia interna del desarrollo de problemas puros o escuelas. Más bien, su foco, en afinidad con las obras mencionadas, (...) son “las distintas relaciones históricas entre las fuerzas del poder y las razones de la filosofía […] las distintas inscripciones en los también múltiples quiasmos entre saberes y poderes” (14-15), asumiendo, de modo más sustantivo, que “el bloque histórico dominante en Chile rara vez ha logrado establecer un relato coherente de la dominación, justamente porque es poco lo que le importan las razones en nombre de las cuales ejerce la fuerza” (41).
