Résumé Avant de devenir l’un des pères fondateurs de l’école de Marbourg, Hermann Cohen avait rédigé un article dans lequel il cherchait à mettre en évidence les liens entre Heinrich Heine et le judaïsme. L’article révèle une double préoccupation : théologico-philosophique et politico-philosophique. Cohen affirmait que le panthéisme de Heine, inspiré de Spinoza, serait compatible avec le monothéisme juif, et que c’est ce panthéisme qui aurait mené Heine vers les « idées socialistes » que, comme Heine, (...) il acceptait. Cohen changea ensuite d’attitude envers Spinoza mais il demeura, sa vie durant, un grand admirateur de Heine, alors que Rosenzweig, qui pourtant se présenta comme l’héritier et le successeur de Cohen en pensée juive, développa une forte aversion contre le poète, ce qui ne peut être expliqué que si l’on prend en considération son propre engagement religieux. The aim of this chapter is to explore and examine what hermeneutic methods can and should be summoned in order to interpret critically an intriguing yet endlessly puzzling sentence in the “Genjōkōan” (現成公案) fascicle of Sōtō sect founder Dōgen’s (道元, 1200–1253) Shōbōgenzō (正法眼蔵). The source material deals with the way perspectives shift dramatically “when riding a boat out to sea, where mountains can no longer be seen (yamanaki kaichū 山なき海中)”? The analogy of sailing past the horizon, so that any trace (...) of land is not visible, and one feels temporarily encircled by the ocean with no other frame of reference available, raises key phenomenological issues regarding the innate partiality or insufficiency of human perception in connection to the Zen goal of awakening to a holistic standpoint that is devoid of divisibility but incorporates an array of standpoints. This passage has been interpreted in diverse ways since the time of early medieval commentaries by Senne and Kyōgō and by Edo-period Sōtō scholiasts, as well as in modern times by various Japanese philosophers and researchers of Dōgen’s texts. Machine intelligence already helps medical staff with a number of tasks. Ethical decision-making, however, has not been handed over to computers. In this proof-of-concept study, we show how an algorithm based on Beauchamp and Childress’ prima-facie principles could be employed to advise on a range of moral dilemma situations that occur in medical institutions. We explain why we chose fuzzy cognitive maps to set up the advisory system and how we utilized machine learning to train it. We report on the (...) difficult task of operationalizing the principles of beneficence, non-maleficence and patient autonomy, and describe how we selected suitable input parameters that we extracted from a training dataset of clinical cases. The first performance results are promising, but an algorithmic approach to ethics also comes with several weaknesses and limitations. Kant is well known for his restrictive conception of proper science. In the present paper I will try to explain why Kant adopted this conception. I will identify three core conditions which Kant thinks a proper science must satisfy: systematicity, objective grounding, and apodictic certainty. These conditions conform to conditions codified in the Classical Model of Science. Kant’s infamous claim that any proper natural science must be mathematical should be understood on the basis of these conditions. In order to substantiate (...) this reading, I will show that only in this way it can be explained why Kant thought (1) that mathematics has a particular foundational function with respect to the natural sciences and (2) as such secures their scientific status. The Curry-Howard isomorphism states an amazing correspondence between systems of formal logic as encountered in proof theory and computational calculi as found in type theory. For instance, minimal propositional logic corresponds to simply typed lambda-calculus, first-order logic corresponds to dependent types, second-order logic corresponds to polymorphic types, sequent calculus is related to explicit substitution, etc. The isomorphism has many aspects, even at the syntactic level: formulas correspond to types, proofs correspond to terms, provability corresponds to inhabitation, proof normalization corresponds to (...) term reduction, etc. But there is more to the isomorphism than this. For instance, it is an old idea---due to Brouwer, Kolmogorov, and Heyting---that a constructive proof of an implication is a procedure that transforms proofs of the antecedent into proofs of the succedent; the Curry-Howard isomorphism gives syntactic representations of such procedures. The Curry-Howard isomorphism also provides theoretical foundations for many modern proof-assistant systems (e.g. Coq). This book give an introduction to parts of proof theory and related aspects of type theory relevant for the Curry-Howard isomorphism. It can serve as an introduction to any or both of typed lambda-calculus and intuitionistic logic. This article analyses the relationship between the Belgian government and the national Nuclear Research Centre (SCK CEN) in the renegotiation of the mission and organization of Big Science in Belgium. While the founding decades of nuclear laboratories are often characterized by ever-increasing budgets and the establishment of large infrastructure, I show that downsizing or transforming Big Science demanded a new form of politics on the organization of science. Drawing on archival material, this article will demonstrate how the mission and management (...) of SCK CEN were critically followed by a variety of stakeholders. Furthermore, the Belgian government explicitly aimed to allow corporate principles to guide the reorganization of the research centre by hiring consultants from Arthur Andersen. This episode in the history of nuclear research invites historians of science to reflect upon both the politics of Big Science in an era in which its original principles were fundamentally questioned and the historical development of new norms and expectations attached to this phenomenon. Medieval philosophers had a predilection for using the correlative pair father and son as an illustrative example in their discussions of relations. The use of this example has sometimes led to charges of confusion on the grounds that fatherhood and sonship are not proper converses. The present article shows how a group of twelfth-century philosophers from the milieu around the logician Alberic of Paris handled the problems arising from the use of this illustrative example which they had inherited from their (...) ancient and late-ancient predecessors. Carey's book on conceptual change and the accompanying argument that children's biology initially is organized in terms of naïve psychology has sparked a great detail of research and debate. This body of research on children's biology has, however, been almost exclusively been based on urban, majority culture children in the US or in other industrialized nations. The development of folkbiological knowledge may depend on cultural and experiential background. If this is the case, then urban majority culture children may prove to (...) be the exception rather than the rule, because plants and animals do not play a significant role in their everyday life. Urban majority culture children, rural majority culture children, and rural Native American children were given a property projection task based on Carey's original paradigm. Each group produced a unique profile of development. Only urban children showed evidence for early anthropocentrism, suggesting that the co-mingling of psychology and biology may be a product of an impoverished experience with nature. In comparison to urban majority culture children even the youngest rural children generalized in terms of biological affinity. In addition, all ages of Native American children and the older rural majority culture children gave clear evidence of ecological reasoning. These results show that both culture and expertise play a role in the development of folkbiological thought. (shrink)

This paper explores the relevance of the debate about ethical expertise for the practice of clinical ethics. We present definitions, explain three theories of ethical expertise, and identify arguments that have been brought up to either support the concept of ethical expertise or call it into question. Finally, we discuss four theses: the debate is relevant for the practice of clinical ethics in that it (1) improves and specifies clinical ethicists' perception of their expertise; (2) contributes to improving the perception (...) of moral competence of non-ethicists; (3) gives insight into complementary styles of argumentation of ethicists and non-ethicists; and (4) contributes to the awareness of the problem of profession-building of (clinical) ethicists. Do responsibility voids exist? That is, are there situations in which the group is collectively morally responsible for some outcome although no member can be held individually morally responsible for it? To answer these questions, I draw a distinction between competitive and cooperative decision contexts based on the team-reasoning account of cooperation. Accordingly, I provide a reasoning-based analysis of cooperation, competition, moral responsibility, and, last, potential responsibility voids. I then argue that competitive decision contexts are free of responsibility voids. The (...) conditions for the existence of responsibility voids in cooperative decision contexts depend on the type of uncertainty the group faces, either external or coordination uncertainty. Should one trust experts? My answer to this question is a qualified ‘no’. In this paper I explore the conditions under which it is rational to trust and defer to experts, and those under which it may be rational to refrain from doing so. I draw on two important factors for an actor’s trust in a partner: trust depends on the partner’s competence and on the partner’s interests. I propose that the conditions under which it is rational to trust and (...) defer to experts depend on the competences of the layperson and the expert, and the degree of interest alignment. I present a model that demonstrates that it can be practically infeasible and even logically impossible to determine the expert’s level of competence and the degree of interest alignment. Although it may sound pessimistic that one can rationally refrain from trusting experts, I will also explore some more optimistic conclusions. (shrink)

This paper examines two strands of literature regarding economic models of cooperation. First, payoff transformation theories assume that people may not be exclusively motivated by self-interest, but also care about equality and fairness. Second, team reasoning theorists assume that people might reason from the perspective of the team, rather than an individualistic perspective. Can these two theories be unified? In contrast to the consensus among team reasoning theorists, I argue that team reasoning can be viewed as a particular type of (...) payoff transformation. However, I also demonstrate that many payoff transformations yield actions that team reasoning rules out. (shrink)

The objective of this article is to analyse and compare four methods of ethical case deliberation. These include Clinical Pragmatism, The Nijmegen Method of ethical case deliberation, Hermeneutic dialogue, and Socratic dialogue. The origin of each method will be briefly sketched. Furthermore, the methods as well as the related protocols will be presented. Each method will then be evaluated against the background of those situations in which it is being used. The article aims to show that there is not one (...) ideal method of ethical case deliberation, which fits to all possible kinds of moral problems. Rather, as each of the methods highlights a limited number of morally relevant aspects, each method has its strengths and weaknesses as well. These strengths and weaknesses should be evaluated in relation to different types of situations, for instance moral problems in treatment decisions, moral uneasiness and residue, and the like. The suggestion arrived at on the basis of the findings of this paper is a reasonable methodological plurality. This means that a method can be chosen depending on the type of moral problem to be deliberated upon. At the same time it means, that by means of a method, deliberation should be facilitated. It is Elias' contention that changes in personality structure--embodied in phenomena ranging from table manners and hygiene habits to rites of punishment and courtly love--inevitably reflect and mould patterns of control generated by new political and social instututions. Elias' rejection of a dichotomy between individual and society, and his use of psychoanalysis, political theory, and social history, help restore a fullness of resource to sociology. (shrink)

This article challenges E.P. Thompson's definition of ‘moral economy’ as a traditional consensus of crowd rights that were swept away by market forces. Instead, it suggests that the concept has the potential of improving the understanding of modern civil society. Moral economy was a term invented in the eighteenth century to describe many things. Thompson's approach reflects only a minor part of this conceptual history. His understanding of moral economy is conditioned by a dichotomous view of history and by the (...) acceptance of a model according to which modern economy is not subject to moral concerns. It is on principle problematic to confine a term conjoining two concepts as general as ‘moral’ and ‘economy’ to a specific historical and social setting. Recent approaches that frame moral economy as an emotively defined order of morals are also misleading since they do not address economic issues in the way they are commonly understood. Martin Heidegger regnes som den mest innflytelsesrike filosofen i det 20. århundre. Det er også kjent at han hadde nazistiske sympatier og var medlem av NSDAP i perioden 1933-1945. Utgivelsen av Svarte hefter (Schwarze Hefte) - hans filosofiske dagbøker skrevet i perioden fra 1931-1975 - gir et mer detaljert bilde av Heideggers nazisme. Vi får en tydelig dokumentasjon ikke bare av hans dyrking av Hitler og nasjonalsosialismen, men også av et verdenssyn preget av antisemittisme. I heftene kan vi lese flere (...) konspiratoriske passasjer om en ±metafysisk jødedom?, der jødene er representanter for en verdensomspennende instrumentell rasjonalitet som har banet vei for materialisme og kapitalisme.I lys av dette må vi revurdere vårt forhold til Heidegger som filosof og stille oss følgende spørsmål: Skal vi lese alt Heidegger skrev, i lys av hans tid som nazist? Eller er tenkningen av et slikt format at den uansett går fri fra Heideggers politiske engasjement?Denne antologien er et forsøk på å gå inn på disse spørsmålene. Foruten oversettelser av blant annet deler av Svarte hefter fra tysk til norsk, får vi perspektiver fra en rekke internasjonalt anerkjente Heidegger-forskere som analyserer Heideggers politiske engasjement, antisemittisme, sivilisasjonskritikk og religionskritikk. Historically, blatantly untrue and defamatory conspiracy theories had disastrous consequences for those who were portrayed in them as evil-doers. At the same time, conspiratorial agreements at the expense of the common good between powerful groups in society do exist and have occasionally been uncovered. Against this background, the article describes different ways in which critical theory has looked at conspiracies. First, an attempt is made to show that Max Horkheimer's notes on `rackets' are an ambitious but flawed attempt to theorize (...) conspiracy. It is argued that Horkheimer's theory is imbued by the very conspiracy thinking that he proposed to criticize. Second, the author suggests recovering Franz Neumann's concept of `political alienation' as a more appropriate starting point to think critically about the ethical and epistemological questions raised by conspiracy theories. In this article, the question is discussed if and how Healthcare Ethics Committees (HECs) should be regulated. The paper consists of two parts. First, authors from eight EC member countries describe the status quo in their respective countries, and give reasons as to the form of regulation they consider most adequate. In the second part, the country reports are analysed. It is suggested that regulation of HECs should be central and weak. Central regulation is argued to be apt to improve (...) HECs’ accountability, relevance and comparability. To facilitate biomedical citizenship and ethical reflection, regulation should at the same time be weak rather than strict. Independence of HECs to deliberate about ethical questions, and to give solicited and unsolicited advice, should be supported and only interfered with by way of exception. One exception is when circumstances become temporary adversarial to ethical deliberation in healthcare institutions. In view of European unification, steps should be taken to develop consistent policies for both Eastern and Western European countries. (shrink)

The aim of the article is to give an outline of a value theory suitable for climate ethics, based on a perfectionist account on the convergence between prudential values and moral responsibility. I claim that such a convergence may generate a system of values that specify norms and obligations and attribute responsibility towards future generations, and thereby provides us with a measure of acceptable political action.

This contribution analyzes the views of Kant and Fichte on a topic that seems to be far removed from their main philosophical preoccupations: prostitution. Nevertheless, systematic links can be constructed between their major ethical and political presuppositions and their views on prostitution. To understand these views correctly, we must first reconstruct their views on sexuality and marriage. Only then will it become clear why they morally condemn prostitution. Yet moral condemnation does not yet tell us how the legal system should (...) fare with prostitutes and their clients. Whereas Kant is rather silent on this topic - merely saying that the pactum fornicationis should have no legal standing - Fichte draws a distinction between professional prostitutes and hobby prostitutes. Whereas the former are to be excluded from the community, the latter may be tolerated. (shrink)

Eine globale Theorie der Freiheit muß den vier großen Dimensionen der Freiheit Rechnung tragen: der ontologischen, der axiologischen, der bürgerlichen und der politischen Dimension. In diesem Beitrag sollen diese vier Dimensionen zunächst kurz vorgestellt werden, bevor wir uns dann eingehend mit der axiologischen Dimension befassen. Innerhalb dieser Dimension sollen drei Figuren des Liberalismus unterschieden werden: der Liberalismus der Unabhängigkeit, der Liberalismus der Heteronomie und der Liberalismus der Autonomie. Es soll gezeigt werden, daß der Liberalismus der Heteronomie die axiologische Freiheit leugnet, (...) während der Liberalismus der Unabhängigkeit sie nur als negative Freiheit denkt. Nur der Liberalismus der Autonomie konzipiert sie als positive Freiheit. In der Diskussion soll gezeigt werden, daß die Beantwortung der Frage nach der axiologischen Freiheit für die Antworten auf die Fragen nach der bürgerlichen und politischen Freiheit relevant ist.
