The attention for Moral case deliberation has increased over the past years. Previous research on MCD is often written from the perspective of MCD experts or MCD participants and we lack a more distant view to the role of MCD in Dutch health care institutions in general. The purpose of this paper is to provide an overview of the state of the art concerning MCD in the Netherlands. As part of a larger national study on clinical ethics support (...) in the Netherlands, we will focus on the prevalence and characteristics of MCD in Dutch health. A mixed methods design was used in which we combined two survey questionnaires, two focus groups and 17 individual interviews with top managers or ethics support staff. The findings demonstrate that the prevalence of MCD is relatively high in Dutch health care, especially in mental health care. Institutions with MCD differ from institutions without MCD concerning size, kind of problems and importance of ideological background. Characteristic of MCD is that it often exists for 3 years or more, has a high participation of health professionals and middle managers and is both organized scheduled as unscheduled. As well integration in existing policy as key persons emerge as important issues in relation to the positioning of MCD. We conclude that MCD is a part of an integrated ethics policy and serves as a catalyst for such an integrated ethics policy. (shrink)

We examine the role of the American Psychological Association (APA) in the weaponization of American psychology post-9/11. In 2004, psychologists’ involvement in the detention and interrogation of terrorist suspects generated controversy over psychological ethics in national security (PENS). Two signal events inflamed the controversy. The 2005 APA PENS Report legitimized clinical psychology consultation in support of military/intelligence operations with detained terrorist suspects. An independent review, the 2015 Hoffman Report, found APA collusion with the US Department of Defense in producing (...) the APA PENS Report and subsequent policies. Ongoing activities within APA to weaponize psychology sharpened the controversy. The authors—two psychologists and four former military/intelligence professionals—bring a military/intelligence operational perspective to detail two neglected areas of collateral damage. The first is the toll on psychology as a scientific enterprise. The second is covert influence on professional associations for incompatible security-sector objectives. We establish epistemic, historical, institutional, legal, and operational foundations for evaluation of these damages, as well as implications for APA and related professional associations in the ongoing Global War on Terror. In an attempt to solve some serious economic and environmental problems, the Netherlands has embarked on an unique experiment over the past few decades. Based on a tradition of cooperation, consensus building, and democratic self-rule, the Dutch have revitalized a corporatist approach to economic and environmental planning. They refer to the polder model to describe the particular characteristics of this approach. Although the polder model is rooted in the past (i.e., the Golden Age of the 17th-century Dutch Republic), (...) its more recent application in planning efforts finds its start with the Wassenaar Accord in economic planning in 1982. A similar approach was used in environmental planning with the introduction of the first National Environmental Policy Plan in 1989. The key feature of the environmental plan is a covenant between business and government. In this article, the author compares the application of the polder model in both areas and concludes that there are serious challenges ahead for its survival. The article attempts to assess whether the model would work in the United States and why the approach used by the Dutch is the favored approach of Environmental Protection Agency chief Christie Whitman. Why are things different on the other side of national borders and how can this be explained sociologically? Using as its point of departure Dutch cycling culture, a paradigmatic example of non-state-led national similarity, this article explores these questions. The first section introduces Norbert Elias’ concept of ‘national habitus’, using this notion to critique comparative sociology and argue for a more processual approach to national comparison. The second section discusses four processes that have contributed to (...) increasing similarity within nations: growing interdependence within nations; increasing density of networks and institutions; vertical diffusion of styles and standards; and the development of national we-feelings. Together, these processes have contributed to the development of national habitus: increasing similarities within nations and increasing differences between people living in different countries. These processes reached their apex in the second half of the 20th century. The third section explores how these processes have diminished since the 1960s, leading to increasing variations within countries and growing similarities between comparable groups in different countries. Both the rise and decline of national habitus are illustrated by changes in Dutch cycling culture. Particularly important is the breakdown of trickle down as a result of the rise of the egalitarian informal ethos. This analysis poses new challenges for sociologists: first, concerning comparative research; second, concerning the diffusion of styles and standards; and, third, concerning the consequences of the decline of national habitus for social inequality, as evidenced by the growing rift between ‘locals’ and (bike-loving) ‘cosmopolitans’. Jeff Paris proves a generalized Dutch Book theorem. If a belief state is not a generalized probability then one faces ‘sure loss’ books of bets. In Williams I showed that Joyce’s accuracy-domination theorem applies to the same set of generalized probabilities. What is the relationship between these two results? This note shows that both results are easy corollaries of the core result that Paris appeals to in proving his dutch book theorem. Background: Patient participation in clinical ethics support services has been marked as an important issue. There seems to be a wide variety of practices globally, but extensive theoretical or empirical studies on the matter are missing. Scarce publications indicate that, in Europe, patient participation in CESS varies from region to region, and per type of support. Practices vary from being non-existent, to patients being a full conversation partner. This contrasts with North America, where PP seems more or less standard. While (...) PP seems to be on the rise in Europe, there is no data to confirm this. This study sought a deep understanding of both habits and the attitudes towards PP in the Netherlands, including respondents’ practical and normative perspectives on the matter. Methods and Results: We developed a national survey on PP for Dutch CESS staff. Our survey comprised a total of 25 open and close-ended questions, focused on four topics related to PP goals of CESS, status quo of PP, ideas and ideals concerning PP, and obstacles for PP. Discussion: The four most important findings were that: Patient participation in Dutch CESS is far from standard. Views on patient participation are very much intertwined with the goals of ethics support. Hesitations, fears and perceived obstacles for PP were not on principle and Most respondents see PP as a positive opportunity, yet requiring additional training, practical guidance and experience. Conclusions: Various normative reasons require PP. However, PP seems far from standard and somewhat rare in Dutch CESS settings. Our respondents did not raise many principled objections to PP. Instead, reasons for the lack of PP are intertwined with viewpoints on the goals of CESS, which seemingly focus on supporting health care professionals. Training and practical guidance was thought to be helpful for gaining experience for both CESS staff and HCPs. (shrink)

Because of their basic level, textbooks show the assumptions and biases of art historians more clearly than does advanced, and therefore more restricted, scholarship. Textbooks are the rock, as it were, within which lie the strata of historical method. They bury, and so preserve for the good and ill of students , not so much individual historical data, which can be picked up or rejected rather easily, as those things which give the appearance of intellectual grasp to historical writing: its (...) generalizations, its interpretations, its sweeping perspectives. The successive editions of Helen Gardner's Art through the Ages can tell us much about the assumptions that have pervaded art historical education in America over the past century. The first edition, published fifty years ago last year, is worth looking at in some detail, because for all its seminal importance in the teaching of art history it is by now little more than a deposit in library stacks. A mere glance will show that it is not ours. Indeed, the distance we have gone since then is exactly measured by the gaucheries it displays. It is half the length of modern surveys, and it makes no pretense either to completeness or to objectivity. It is arranged by period and style until we reach the Renaissance , at which point, in keeping with the interest of an earlier age in national characteristics, each country receives its due chapter. The Italian Renaissance, as befits the central position of the primitives in American taste then, has four chapters to itself. Thereafter, except for a final, brief section on contemporary art, each national school is taken to the period of its decline. This, of course, will vary. France is taken through Cézanne; England through the Pre-Raphaelites and William Morris; Spain, thanks to Goya, into the early nineteenth century; and Dutch and Flemish art only through the seventeenth century, but without Bosch or Bruegel. As for Germany, though the chapter heading promises us "From the Gothic Age to the Nineteenth Century," in fact it is on Durer and Holbein. What fulfills the promise of the title appears in its entirety thus: "After the death of these two masters, largely on account of exhaustion from wars there was very little production, until the second great manifestation of the German people came in the music of the eighteenth and nineteenth centuries."1 No pretense here at dutiful compilation; high points, after all, are high points. · 1. This study analyzed the national data on life-sustaining treatment decisions from 2018 to 2020 to find out the characteristics of South Korea’s end-of-life procedure according to the decision-making approach and process. We collected the data of 84,422 patients registered with the National Agency for Management of Life-sustaining Treatment. We divided the patients into four groups (G1, G2, G3, and G4) according to the decision-making approach. A descriptive analysis of each group was conducted using indicators such as the patient’s (...) age, status, diagnosis, and content of forgoing life-sustaining treatment. Additionally, logistic regression analysis was performed by dividing the patients into self-determining (G1, G2) and non-self-determining patients (G3, G4). Cancer was the most common diagnosis for each group. The period from life-sustaining treatment decision to implementation was 10.76, 1.01, 0.86, and 1.19 days for G1, G2, G3, and G4, respectively. In the logistic regression analysis, the self-determination ratio was higher for 40–49 years old and lower for cardiovascular disease and gastrointestinal disease. Age was has a major impact on life-sustaining treatment decisions (LSTD), and with increase in age, the family, and not the patient, made the LSTD. The LSTD method also differed depending on the disease. The self-determination rates of patients with circulatory or digestive diseases were somewhat lower than that of those with neoplastic diseases. BackgroundLiterature shows that middle-aged and older adults sometimes experience a wish to die. Reasons for these wishes may be complex and involve multiple factors. One important question is to what extent people with a wish to die have medically classifiable conditions. Aim(1) Estimate the prevalence of a current wish to die among middle-aged and older adults in The Netherlands; (2) explore which factors within domains of vulnerability (physical, cognitive, social and psychological) are associated with a current wish to die; (3) (...) assess how many middle-aged and older adults with a current wish to die do not have a medically classifiable condition and/or an accumulation of age-related health problems.MethodsData of 2015/16 from the Longitudinal Aging Study Amsterdam were used for this cross-sectional study (1563 Dutch middle-aged and older adults aged between 57 and 99 years), obtained through structured medical interviews and self-reported questionnaires. Three experienced physicians assessed whether the participants with a current wish to die could be classified as having a medically classifiable condition and/or an accumulation of age-related health problems.ResultsN = 62 participants (4.0%) had a current wish to die. Having a current wish to die was associated with multiple characteristics across four domains of vulnerability, among which: self-perceived health, problems with memory, self-perceived quality of life and meaningfulness of life. Fifty-four participants with a current wish to die were assessed with having a medically classifiable condition, of which one was also assessed with having an accumulation of age-related health problems. Six people were assessed to have neither, and for two people it was unclear.ConclusionA small minority of middle-aged and older adults in the Netherlands have a current wish to die. Most of them can be classified with a medical condition and one person with an accumulation of age-related health problems. Furthermore, the findings show that having a current wish to die is multi-faceted. There is still a need for more knowledge, such as insight in to what extent suffering stemming from the medical classifiable disease contributes to the development of the wish to die. (shrink)

Humanistic and ethical thought existed in China already in the ancient culture period, and was strongly enhanced during the Spring and Autumn era. Based on this background and foundation, Confucius is ‘a creator of the paradigm’ of Chinese philosophy, and Lao-Tzu is ‘an original metaphysician,’ both establishing the basic tendencies of Chinese philosophy. After that, the philosophies of pre- and post-Qin eras, all continued to develop along their thought. Chinese philosophy has several characteristics, including the unity of nature and man, (...) truth and goodness, cognition and behavior, ontology and cosmology, humanity and natural law, the theory of human nature and values and many others. Its theoretic framework and basic structure aims to enlighten what humans ought to be - a question at the core of Chinese culture, reflecting the national spirit. The Chinese spirit is paradigmatically expressed in two sayings, “as Heaven’s movement is ever vigorous, so must a gentleman ceaselessly strive,” and “as Earth is broad and profound, so must a gentleman be greatly virtuous and lenient.”. Although neither Marx nor Engels attempted a systematic analysis of the development of merchant capitalism in 17th-century Holland, both did mention this "model capitalist nation" in their writings. Their analysis stressed that Dutch capitalism was based on the exploitation of non-capitalist forms of production, and that the decline of the Dutch Republic in the 18th century was the history of the subordination of commercial capital to industrial capital. Since the turn of the century Dutch Marxists have contributed (...) substantially to this classical analysis, paying much attention to the Dutch Revolt against Spain, which they considered as an early bourgeois revolution led by aristocrats. Nowadays Marxist historians seem to be divided as to the nature of the Dutch Republic: was it a "feudal business economy" or the first appearance of a full-fledged capitalism? A necessary conclusion seems to be that the realities of Dutch history call for a non-unilinear Marxist interpretation. (shrink)

This study investigates whether Dutch newspaper articles use the term ‘euthanasia’ according to the legal definition and determines what arguments for and against euthanasia they contain. We did an electronic search of seven Dutch national newspapers between January 2009 and May 2010 and conducted a content analysis. Of the 284 articles containing the term ‘euthanasia’, 24% referred to practices outside the scope of (...) the law, mostly relating to the forgoing of life-prolonging treatments and assistance in suicide by others than physicians. Of the articles with euthanasia as the main topic, 36% described euthanasia in the context of a terminally ill patient, 24% for older persons, 16% for persons with dementia, and 9% for persons with a psychiatric disorder. The most frequent arguments for euthanasia included the importance of self-determination and the fact that euthanasia contributes to a good death. The most frequent arguments opposing euthanasia were that suffering should instead be alleviated by better care, that providing euthanasia can be disturbing, and that society should protect the vulnerable. Of the newspaper articles, 24% uses the term ‘euthanasia’ for practices that are outside the scope of the euthanasia law. Typically, the more unusual cases are discussed. This might lead to misunderstandings between citizens and physicians. Despite the Dutch legalisation of euthanasia, the debate about its acceptability and boundaries is ongoing and both sides of the debate are clearly represented. (shrink)

The prevalence of Clinical ethics support services is increasing. Yet, questions about what quality of CES entails and how to foster the quality of CES remain. This paper describes the development of a national network, which aimed to conceptualize and foster the quality of CES in the Netherlands simultaneously. Our methodology was inspired by a responsive evaluation approach which shares some of our key theoretical presuppositions of CES. A responsive evaluation methodology engages stakeholders in developing quality standards of a (...) certain practice, instead of evaluating a practice by predefined standards. In this paper, we describe the relationship between our theoretical viewpoint on CES and a responsive evaluation methodology. Then we describe the development of the network and focus on three activities that exemplify our approach. In the discussion, we reflect on the similarities and differences between our approach and other international initiatives focusing on the quality of CES. (shrink)

This article presents an analytical overview of the critical modernisation features of Socialism with Chinese characteristics doctrine in the new era, which was proposed at the 20th National Congress of the Communist Party of China. The authors reconstructed and systematically represented the central philosophical and political principles of the doctrine of Socialism with Chinese characteristics in the context of the fundamental principles of Chinese Marxism. The authors also analysed and presented in a systematic form the essence and basic theoretical (...) principles of the concept of Socialism with Chinese characteristics following Xi Jinping's works and reports. The study includes a comparative analysis that concludes with the critical features of the modern concept of socialism with Chinese characteristics. These features embrace the need for constant modernisation of the very doctrine of socialism with Chinese characteristics, the state management system, as well as social and cultural practices, which are possible through the implementation of innovations and the integration of modern philosophical thought with traditional Chinese philosophy and culture. The article concludes that the main feature of the modernisation of Socialism with Chinese characteristics at the current stage reveals in the development and implementation of a system of creative practices at the level of everyday culture, high-tech sectors of social production and the practice of intercultural communication within the framework of China's Belt and Road Initiative. In the discussion, the authors argue that implementing creative practices and creative industries could become an effective tool for developing China's Belt and Road Initiative in European countries and improving mutual understanding in the intercultural communication practices between China, European countries, and Ukraine. This article examines and compares Adam Ferguson's and Guillaume-Thomas Raynal's analyses of modern commercial states by reconstructing their accounts of the history and politics of the Dutch Republic. For both writers, the Dutch case stood as a clear instance of the political dangers implicit in a particular type of commercial polity, and both sought to apply its lessons to an understanding of the future of their own states. Although Ferguson's and Raynal's arguments about the decline of the (...) class='Hi'>Dutch trading state overlapped, their analyses reflected different evaluations of the relationship between modern states and modern economic institutions (trading companies and public debts). The broader purpose of the article is to shed light on the distinctive theories of commerce and models of European development that informed the major works of Enlightenment historiography and political thought produced by Ferguson and Raynal in the 1760s and 1770s. Introduction In 2007, a national review committee was instituted in The Netherlands to review cases of active ending of life for newborns. It was expected that 15–20 cases would be reported. To date, however, only one case has been reported to this committee. Reporting is essential to obtain societal control and transparency; the possible explanations for this lack of reporting were therefore explored. Methods Data on end-of-life decision-making were scrutinised from Dutch nation-wide studies (1995, 2001 and 2005), before (...) institution of the committee. Physicians received a questionnaire about their medical decision-making for stratified samples of deceased infants up to 1 year, drawn from the central death registry. Results In 2005, 58% of all deaths were preceded by an end-of-life decision, compared with 68% in 2001 and 62% in 1995. The use of drugs with a possible life-shortening effect tended to be lower. In 2005, all four cases in the study in which an infants' life was actively ended were preceded by a decision to forego life-prolonging treatment. In three cases, the infant's life expectancy was short; one case involved a longer life expectancy. Discussion The expected number of cases is probably an overestimation due to changes in medical practice such as the tendency to attribute less life-shortening effects to opioids. The lack of reports is probably also associated with requirements in the regulation; it may be difficult to fulfil them due either to time constraints or the nature of the suffering that is addressed. If societal control of active ending of life is considered useful, changes in the regulation may be needed. (shrink)

B a c k g r o u n d. Deng Xiaoping is considered the main architect of socialist reforms and the founder of China's modernization theory. He mastered and developed the socialist system, trying to adjust it to the national conditions of China. Deng Xiaoping believed that it was by following the course of "socialism with Chinese characteristics" that China would transform from a poor country into a highly developed one. The article provides a theoretical reconstruction of the (...) main content of Deng Xiaoping's concept of "socialism with Chinese characteristics." The main philosophical and socio-political aspects of the concept of building socialism with Chinese characteristics are presented in a systematic form in the context of the foundations of Chineseization of Marxism. M e t h o d s. In the article, a historical-logical approach was used to reveal the specified research topic, which allowed us to determine the socio-political prerequisites for the emergence of Chineseized Marxism. An interdisciplinary approach made it possible to carry out a theoretical analysis of social, economic, and political changes in modern China, which were caused by the proposed theory of Deng Xiaoping's "socialism with Chinese characteristics". Systemic, structural-functional, and constructivist methods, as well as methods of synthesis and generalization, were also applied. R e s u l t s. Because of the above, the purpose of this study was to carry out a theoretical reconstruction of Deng Xiaoping's theory of building "socialism with Chinese characteristics" and to find out how his ideas influenced the development of modern China after the completion of the "Great Leap Forward" and the "Cultural Revolution" of Mao Zedong. The key features of Deng Xiaoping's proposed theory of "socialism with Chinese characteristics" were established, including the idea of democratization of society and implementation of the legal basis of state functioning; the beginning of a new period of "reforms and openness"; determining the course for socialist modernization; following Marxism-Leninism and the ideas of Mao Zedong. C o n c l u s i o n s. In conclusion, it can be noted that the main feature of Deng Xiaoping's ideas was that they were inextricably linked with the national and cultural traditions of Chinese civilization, starting from Confucianism and the gradual synthesis with Marxist ideology. Evaluating the theory of Deng Xiaoping, it can be defined as a relatively complete scientific system that covers the fields of philosophy, political economy, and scientific socialism, it contains the doctrine of socialist ideology, and the doctrine of the essence and ways of socialist development, theories of the reform of socialist political and economic systems, the theory of building a socialist country. Kristeva points to Montesquieu's esprit général--his notion of the social body as a guaranteed hierarchy of private rights--in this humanistic plea for tolerance and commonality.

The fourth chapter analyses the establishment of Cartesianism at the University of Leiden in 1650s and 1660s. This was carried out by De Raey, who provided a defence and teaching of Descartes’s physics in his Clavis philosophiae naturalis (1654), although not based on Descartes’s metaphysics: physical principles, indeed, are presented by De Raey as self-evident truths, and consistent with Aristotle’s theory of scientia or universal and necessary knowledge. This was not the only peculiar characteristic of Leiden Cartesianism, as De Raey (...) also provided a differentiation between philosophical and practical knowledge (including medicine and revealed theology), as these are based on different sources of knowledge, namely, intellect and sensory experience. In the hands of Christopher Wittich, the separation thesis became the standard in conceiving the place of Cartesianism in the university, which was confined to natural philosophy in 1650s and strictly secluded from revealed theology. At the same time, the need to develop a moral philosophy consistent with the Reformed creed became the centre of the debate between Revius and Heidanus, a Reformed theologian who saw in Cartesianism a philosophy more consistent with Calvinism than Scholasticism. Accordingly, he was eager to support the appointment in Leiden of Arnold Geulincx, who was developing a philosophical ethics independent of revealed theology but consistent with the Reformed creed. For this purpose, besides the relation of body, soul and world, Geulincx considered those relations of man, world, and God from which moral duties follow. Accordingly, he provided his ethics with a foundation in rational theology. In turn, this foundation entails a reflection on the type of knowledge that constitutes physics and determines its very method. Given the inscrutability of God’s reasons in creating the world, Geulincx could claim that physics has to proceed by hypotheses based on experience rather than by a deduction of natural laws from metaphysical principles. In this way, the epistemic consequences of his foundational theory refuelled a reflection on the method of natural philosophy itself, making his foundation a sample of the transformation of Cartesian foundationalism – dominated by Descartes’s metaphysical physics – into a reflection on physics itself. In other words, Geulincx provided, together with De Raey, a de-metaphysicisation of physics. (shrink)

The Groningen Protocol, introduced in the Netherlands in 2005 and accompanied by revised guidelines published in a report commissioned by the Royal Dutch Medical Association in 2014, specifies conditions under which the lives of severely ill newborns may be deliberately ended. Its publication came four years after the Netherlands became the first nation to legalize the voluntary active euthanasia of adults, and the Netherlands remains the only country to offer a pathway to protecting physicians who might engage in deliberately (...) ending the life of a newborn. In this paper, I offer two lines of argument. The first is a positive argument for the Protocol, grounded in the good of the newborn as unanimously determined by those in a position to determine it. The second addresses the widely shared belief that the killing of newborns is morally prohibited, where I offer two arguments—one grounded in the fact that the kinds of cases the Protocol is meant to govern are very rare and highly unusual, and the other focused more broadly on the role of pre-theoretical beliefs in moral reasoning—meant to undermine the strong role that the critic of the Protocol affords this belief. I argue that, given this second line of argument, the beliefs underlying my positive argument for the Protocol are in fact more secure than the widely shared belief underlying the critic’s position. This article presents various developments in Dutch health care policy toward a greater role for individual financial responsibility, such as cost-control measures, priority setting, rationing, and market reform. Instead of the collective responsibility that is characteristic of previous times, one can observe in government policies an increased emphasis on the need for individuals to take care of one’s own health and health care needs. Moreover, surveys point to decreasing levels of public support for “unlimited” solidarity and “irresponsible” health behavior. (...) This article attempts to answer the question of how these policies and public attitudes are limiting the ethical principles of solidarity and equal access to care that have long guided Dutch health care policy making. The authors argue that from a moral point of view, the increased emphasis on individual responsibility is acceptable as long as it does not affect solidarity with those weak and vulnerable groups who are not able to take individual responsibility, such as the demented and mentally handicapped. This far-ranging and ambitious attempt to rethink postcolonial theory's discussion of the nation and nationalism brings the problems of the postcolonial condition to bear on the philosophy of freedom. Closely identified with totalitarianism and fundamentalism, the nation-state has a tainted history of coercion, ethnic violence, and even, as in ultranationalist Nazi Germany, genocide. Most contemporary theorists are therefore skeptical, if not altogether dismissive, of the idea of the nation and the related metaphor of the political body as an organism. Going (...) against orthodoxy, Pheng Cheah retraces the universal-rationalist foundations and progressive origins of political organicism in the work of Kant and its development in philosophers in the German tradition such as Fichte, Hegel, and Marx. Cheah argues that the widespread association of freedom with the self-generating dynamism of life and culture's power of transcendence is the most important legacy of this tradition. Addressing this legacy's manifestations in Fanon and Cabral's theories of anticolonial struggle and contemporary anticolonial literature, including the Buru Quartet by Indonesian writer Pramoedya Ananta Toer, and the Kenyan writer Ngugi Wa Thiong'o's nationalist novels, Cheah suggests that the profound difficulties of achieving freedom in the postcolonial world indicate the need to reconceptualize freedom in terms of the figure of the specter rather than the living organism. In the Netherlands, Forensic Flexible Assertive Community Treatment is used as a specialized form of outpatient intensive treatment. This outreaching type of treatment is aimed at patients with severe and long lasting psychiatric problems that are at risk of engaging in criminal behavior. In addition, these patients often suffer from addiction and experience problems in different areas of their life. The aim of this exploratory study was to gain more insight into the characteristics of the ForFACT patient population. More knowledge (...) about these patients may enhance the effectiveness of ForFACT and therefore reduce the risk of recidivism. Data on 132 ForFACT patients were gathered by studying electronic patient records, criminal records, and by conducting semi-structured interviews with practitioners and patients. Additionally, as part of a cognitive screening, two screening instruments were conducted to gain insight into intelligence and possible mild cognitive impairments. This article gives a broad description of the ForFACT patient population, including demographic data and context variables, diagnostics, recidivism risk and offense history, and aspects related to care. Furthermore, several recommendations are given to further improve ForFACT. Based on the results it can be concluded that the ForFACT patient population shows a high degree of diversity in complex care needs and responsivity issues. Therefore, this article highlights the necessity for ForFACT to collaborate with other mental health institutions, as well as probation officers, and forensic or criminal justice institutions. Moreover, it is important to continually check the inclusion and exclusion criteria when admitting patients to ForFACT, and to examine whether ForFACT is still the most adequate care for patients or if they need to be referred. In addition, the results emphasize the importance of cognitive screening for forensic outpatients. Finally, this study zooms in on the interface between forensic psychiatric care and general mental health care. (shrink)

National history has once again become a battlefield. In internal political conflicts, which are fought on the terrain of popular culture, museums, schoolbooks, and memorial politics, it has taken on a newly important and contested role. Irrespective of national specifics, the narratives of new nationalism are quite similar everywhere. National history is said to stretch back many centuries, expressesing the historical continuity of a homogeneous people and its timeless character. This people struggles for independence, guided by towering (...) leaders and inspired by the sacrifice of martyrs. Unlike earlier forms of nationalism, the main enemies are no longer neighbouring states, but international and supranational institutions. To use national history as an integrative tool, new nationalists claim that the media and school history curricula should not contest or question the nation and its great historical deeds, as doubts threaten to weaken and dishonour the nation. This book offers a broad international overview of the rhetoric, contents, and contexts of the rise of these renewed national historical narratives, and of how professional historians have reacted to these phenomena. The contributions focus on a wide range of representative nations from around all over the globe. (shrink)

ABSTRACTThe Dutch history of the golden century, a formula which had effectively imposed this interpretative paradigm well beyond the seventeenth century, has been analysed in a more conscientious manner by more recent historiography. This has tempered the hagiographic reading and confirmed the fact that, in the second half of the century, the question of tolerance had become primarily a political conquest and a value shared by other nations. A supernational, European value, but which had also begun to cross the (...) Atlantic several decades earlier. It is interesting to explore how writers facing each other across the two shores of the Channel, on one side observed and interpreted and on the other side presented themselves, offering to foreign eyes the concept of tolerance that had been consolidated in the Netherlands. With the ever-growing accessibility of case law online, it has become challenging to manually identify case law relevant to one’s legal issue. In the Netherlands, the planned increase in the online publication of case law is expected to exacerbate this challenge. In this paper, we tried to predict whether court decisions are cited by other courts or not after being published, thus in a way distinguishing between more and less authoritative cases. This type of system may be used to process (...) the large amounts of available data by filtering out large quantities of non-authoritative decisions, thus helping legal practitioners and scholars to find relevant decisions more easily, and drastically reducing the time spent on preparation and analysis. For the Dutch Supreme Court, the match between our prediction and the actual data was relatively strong (with a Matthews Correlation Coefficient of 0.60). Our results were less successful for the Council of State and the district courts (MCC scores of 0.26 and 0.17, relatively). We also attempted to identify the most informative characteristics of a decision. We found that a completely explainable model, consisting only of handcrafted metadata features, performs almost as well as a less well-explainable system based on all text of the decision. (shrink)

In this third article on the role of international comparative practices in the formation of national health care systems I discuss a familiar group of systems-builders--medical professional organisations--and so focus on some early comparisons undertaken by organised groups of doctors. So far in this series I have argued that any attempt to make international comparisons--whether in the 19th-century or today--is bound to be based on a 'characteristically national' understanding. Not infrequently such an understanding finds its clearest expression in (...) the very act of undertaking practical tasks like 'comparing'. Dependent on whether comparisons are carried out by individuals privately, collectively by larger groups within the medical profession, or by government agencies the descriptions of 'national characteristics' (of medical organisation, institutional formation, clinical practice, research, public health and education) will differ in emphasis. -/- The examination of collective professional attempts at international comparison can enhance our understanding of the cultural distinctions that were incorporated by emerging national medical professions. This process can show which aspects of foreign medical systems were deemed pertinent, and also reveals methodology. What did such collective endeavours add to the more biographically coloured comparisons undertaken by the individual mid-century authors I discussed in part II of this series? (shrink)

There is a sizeable group of self-described Christian companies which have declared their belief in the successful merging of biblical principles with business activities. As these companies have become more visible, an increasing number of anecdotal newspaper and magazine articles about these companies have appeared. Surprisingly, no rigorous research has been conducted prior to our recent study. This article provides national estimates of the size and predominant characteristics of self-identified Christian companies. This volume asks which national histories underpinned which national identity constructions in almost every nation state in Europe during the nineteenth and twentieth centuries. It explores the construction of national identities through history writing and analyses their interrelationship with histories of ethnicity/race, class and religion.

In pluralistic modern societies, moral dissent will, to an increasing extent, be an inescapable fact in our lives. Moral dissent, however, involves various serious dangers: escalation of conflicts, the use of violence, flourishing of radical extremism and even civil war. There are basically two ways in which these threats can be addressed: coercive enforcement of consensus or tolerance. First, we could try to eliminate moral dissent by using more dictatorial forms of consensus formation, like propaganda, indoctrination and terror. This, however, (...) would endanger or even destroy the open society. Therefore, from a moral point of view, tolerance appears to be the more desirable antidote to the unwanted effects of moral dissent. This paper aims to contribute to the discussions about the regulation of moral dissent and the formation of moral consensus by analyzing one of the most important and idiosyncratic elements of the Dutch way of handling these issues: pragmatic tolerance. First, some general thoughts are developed about moral consensus, moral dissent and tolerance as a means of regulating dissent. In addition, the characteristic Dutch policy of pragmatic tolerance is described. Finally, some of the pros and cons of pragmatic tolerance are analyzed from an ethical perspective. (shrink)

This article analyzes Orthodox influence on developing national identity in modern Ukraine. The authors state that the factor of national specificity of Christianity is evident if we consider nations, especially in Central and Eastern Europe. In addition, Christianity influences the development of national cultures and has acquired the national characteristics of a particular community. Also, the war in Ukraine, which was started by the Russian Federation on 24 February 2022, has significantly impacted socio-cultural processes in Ukraine, (...) the functioning of national identity, and the religious situation, especially regarding the Orthodox churches. Authors pay attention to the reference to the topic of national identity in the documents and sermons of the Orthodox Church of Ukraine to show how the Orthodox hierarchies treat these issues. In addition, they study the ideologies that the Russian Orthodox Church creates and tries to impose through the faithful of the Ukrainian Orthodox Church churches of the Moscow Patriarchate as a dominant cultural, religious, and political discourse. The article analyzes the phenomenon of national self-determination in terms of evolution and functioning. The authors aim to determine the general characteristics and evolution of this phenomenon in both conceptual and applied versions. In the evolution’s context of national self-determination as a theoretical concept and a political and legal principle, several stages were identified and considered. According to the authors, each stage of the phenomenon’s evolution was inevitably accompanied by its qualitative transformations, both in political and legal terms. (...) The first stage (from the end of the XVIII c. till the First World War), according to the authors, is characterized by the emergence of the idea and the formation of the socio-political concept of national self-determination, and the applied aspect of the phenomenon of national self-determination is filled with concrete content based on the ever-expanding political practice of its application. The second stage (from the First World War and the post-war reconstruction) is characterized by the transformation of self-determination from a concept into a political principle. The authors associate the third stage of the evolution of the phenomenon of national self-determination (the period after the Second World War) with the development of international relations and the formation of a global bipolar system. National self-determination turned into a principle of positive international law and laid the foundations for the future political instability of the newly independent states. Finally, the last period (the early 90s to this day) is characterized by the search and crystallization of new approaches to the principle of national self-determination and the emergence of new theories, the authors of which are trying from a political and legal point of view to substantiate the legitimacy of an expansive interpretation of this principle. The analysis allowed us to conclude that the qualitative transformations of the principle of national self-determination presented in the article did not lead to the formation of the phenomenon of national self-determination as an integral, complete, and universally recognized international political and legal norm. This essay by the Dutch modernist writer Menno ter Braak, ‘National Socialism as a Doctrine of Rancour’, was written in 1937 just before the German annexation of the Netherlands. It is a rare examination of how the concept ressentiment can be used to analyse 1930s National Socialism, outlining the ways in which the fascist variant of ressentiment is both distinctive and also, nonetheless, connected to its democratic and socialist versions. The essay develops Nietzsche’s and Scheler’s understandings of (...) ressentiment by applying them to fascism, insisting on the centrality of the moral sentiment of ressentiment not just to populism but to all forms of democracy, and to any philosophical or political orientation committed to an ideal of equality, indeed to all of modern society, culture and politics.
