A critical issue facing the criminal justice system today is how best to promote ethical behavior by public prosecutors. The legal profession has left much of a prosecutor’s day-to-day activity unregulated, in favor of a general, catch-all admonition to “seek justice.” In this article the author argues that professional norms are truly functional only if those working with a given ethical framework recognize the system’s implicit dependence on character. A code of professional conduct in which this dependence is not recognized (...) is both contentless and corrupting. Building on the ethics of Aristotle and modern philosophers Alasdair MacIntyre and Bernard Williams, the author argues that virtue theory can help bridge the gaps in prosecutorial ethics where other forms of moral reasoning fail. The author analyzes three especially difficult ethical problems frequently confronted by prosecutors in the field. He demonstrates not only that the Model Rules of Professional Conduct and the ABA Criminal Justice Standards fail to answer any of these complex questions, but also that future attempts to more closely regulate how prosecutors should act in any of these nuanced situations are unlikely to succeed. The author argues that honesty, fairness, courage, and prudence are the primary virtues that citizens have a right to expect of their public prosecutors. He then demonstrates how these four key virtues might provide important guidance to conscientious prosecutors striving to do what is right. The author concludes by offering several insights into how the field of virtue ethics might inform both the structure and organization of government law offices, and the manner in which individual prosecutors working within these offices might perceive and fulfill their professional roles. At the heart of ethics reside the concepts of good and bad; they are at work when we assess whether a person is virtuous or vicious, an act right or wrong, a decision defensible or indefensible, a goal desirable or undesirable. But there are many varieties of goodness and badness. At their core lie intrinsic goodness and badness, the sort of value that something has for its own sake. It is in virtue of intrinsic value that other types of value (...) may be understood, and hence that we can begin to come to terms with questions of virtue and vice, right and wrong, and so on. This book investigates the nature of intrinsic value: just what it is for something to be valuable for its own sake, just what sort of thing can have such value, just how such a value is to be computed. In the final chapter, the fruits of this investigation are applied to a discussion of pleasure, pain, and displeasure and also of moral virtue and vice, in order to determine just what value lies within these phenomena. In this paper I propose to shed new light on the role of feeling in Kant’s psychology of moral motivation by focusing on the concept of an incentive (Triebfeder), a term he borrowed from one of his most important rationalist predecessors, Alexander Gottlieb Baumgarten. I argue that, similar to Baumgarten, Kant understands an incentive to refer to the ground of desire and that feelings function as a specific kind of ground within Kant’s psychology of moral action, namely as the ‘impelling (...) cause’ of desire. I claim that this interpretation has several advantages over the alternatives currently on offer in the literature. (shrink)

Russell alleged that the version of the cosmological argument he debated with Copleston involved type confusions, but the definitions of plural descriptive functions and the ancestral in Principia Mathematica can be used to reformulate the argument in a type-safe way via a notion of causally self-sufficient classes. Although the argument depends on the assumption that the class of contingent things is not causally self-sufficient, if that assumption is weakened to say only that it may not be so, then a new (...) modalized version emerges which has similarities with recent ontological arguments but weaker and more intuitive assumptions. Anthropogenic climate change threatens humanity as a whole, making its mitigation a matter of pressing concern. Mitigation efforts at the institutional level are necessary to successfully change the course of climate change, but thus far governments and industries have been ineffective at reducing greenhouse gas emissions. A point of philosophical contention is whether individuals have a moral responsibility to reduce their own emissions given the lack of institutional action. I argue that they do by redefining climate change as a collective (...) impact. Individual emitters share collective responsibility for that impact, which translates to an individual duty to reduce their contribution. (shrink)

Wolff's book defends the Kantian idea of a "general logic" whose principles underlie special systems of deductive logic. It thus undermines "logical pluralism," which tolerates the co-existence of divergent systems of modern logic without asking for consistent common principles. Part I of Wolff’s book identifies the formal language in which the most general principles of logic must be expressed. This language turns out to be a version of syllogistic language already used by Aristotle. The universal validity of logical principles, as (...) well as the translatability of other logical languages into this language, are shown to depend only on the meanings of its logical vocabulary. Part II of the book answers the metalogical question concerning the deductive relation between general logic and special logical systems, which also have their own (less general) principles. This part identifies the rules according to which logical rules can be derived from principles. The main result of the book is that the highest principles of logic and metalogics are provided by the syllogistic, when properly understood. (shrink)

Research on bias in peer review examines scholarly communication and funding processes to assess the epistemic and social legitimacy of the mechanisms by which knowledge communities vet and self-regulate their work. Despite vocal concerns, a closer look at the empirical and methodological limitations of research on bias raises questions about the existence and extent of many hypothesized forms of bias. In addition, the notion of bias is predicated on an implicit ideal that, once articulated, raises questions about the normative implications (...) of research on bias in peer review. This review provides a brief description of the function, history, and scope of peer review; articulates and critiques the conception of bias unifying research on bias in peer review; characterizes and examines the empirical, methodological, and normative claims of bias in peer review research; and assesses possible alternatives to the status quo. We close by identifying ways to expand conceptions and studies of bias to countenance the complexity of social interactions among actors involved directly and indirectly in peer review. (shrink)

Neuropsychiatrist Michael T. H. Wong argues that the notions of soul, mind, brain, self and consciousness are no longer adequate on their own to explain humanity. He formulates a “third discourse” that brings philosophy neuroscience theology and psychiatry together as an innovative multilayered narrative for the person in the twenty-first century.

This chapter offers an account of Crusius’ conception of freedom. In the first part of the chapter I sketch Crusius’ understanding of ‘Thelematology’ or ‘science of the will’ and his conception of the will itself. In the second part of the paper I provide an account of Crusius’ conception of freedom of the will and I focus on two topics: his understanding of freedom as self-determination and his conception of free choice. Contrary to how some of the secondary literature portrays (...) his view, I argue that freedom of the will, for Crusius, is not best described as the freedom to choose otherwise or liberty of indifference. On the contrary, Crusius argues that free choice is rarely indifferent to its choices and is most often strongly inclined towards certain ends that free choice must overcome and choose against. Inspired by the work of Wilfrid Sellars, Michael Williams launches an all-out attack on what he calls "phenomenalism," the idea that our knowledge of the world rests on a perceptual or experiential foundation. The point of this wider-than-normal usage of the term "phenomenalism," according to which even some forms of direct realism deserve to be called phenomenalistic, is to call attention to important continuities of thought between theories often thought to be competitors. Williams's target is not phenomenalism in its (...) classical sense-datum and reductionist form but empiricism generally. Williams examines and rejects the idea that, unless our beliefs are answerable to a "given" element in experience, objective knowledge will be impossible. Groundless Belief was first published in 1977. This second edition contains a new afterword in which Williams places his arguments in the context of some current discussions of coherentism versus the Myth of the Given and explains their relation to subsequent developments in his own epistemological views. The fact that Gilbert Ryle and J.L. Austin seem to disagree about the ordinary use of words such as ‘voluntary’, ‘involuntary’, ‘voluntarily’, and ‘involuntarily’ has been taken to cast doubt on the methods of ordinary language philosophy. As Benson Mates puts the worry, ‘if agreement about usage cannot be reached within so restricted a sample as the class of Oxford Professors of Philosophy, what are the prospects when the sample is enlarged?’ (Mates, Inquiry 1:161–171, 1958, p. 165). In this chapter, (...) we evaluate Mates’s criticism alongside Ryle’s and Austin’s specific claims about the ordinary use of these words, assessing these claims against actual examples of ordinary use drawn from the British National Corpus (BNC). Our evaluation consists in applying a combination of methods: first aggregating judgments about a large set of samples drawn from the corpus, and then using a clustering algorithm to uncover connections between different types of use. In applying these methods, we show where and to what extent Ryle’s and Austin’s accounts of the use of the target terms are accurate as well as where they miss important aspects of ordinary use, and we demonstrate the usefulness of this new combination of methods. At the heart of our approach is a commitment to the idea that systematically looking at actual uses of expressions is an essential component of any approach to ordinary language philosophy. (shrink)

Arguments from perceptual variation challenge the view that colors are objective properties of objects, properties that objects have independent of how they are perceived. This paper attempts, first, to diagnose one central reason why arguments from perceptual variation seem especially challenging for objectivists about color. Second, we offer a response to this challenge, claiming that once we focus on determinate colors rather than the determinables they determine, a response to arguments from perceptual variation becomes apparent. Third, our nominal opponents are (...) relationalist (like Cohen in The red and the real: an essay on color ontology, Oxford University Press, Oxford, 2009) and we will argue that the main argument for rejecting objectivism commits the relationalist to a position that is more radical than the one he would wish to endorse. Fourth, we suggest that insight into which properties could be relational may be found by looking to our best scientific theories. (shrink)

According to Darwinian thinking, organisms are (for the most part) designed by natural selection, and so are (for the most part) integrated collections of adaptations, where an adaptation is a phenotypic trait that is a specialized response to a particular selection pressure. For animals that make their living in the Arctic, one adaptive problem is how to maintain body temperature above a certain minimum level necessary for survival. Polar bears' thick coats are a response to that selection pressure (surviving in (...) extreme cold). A thick coat makes a positive difference to a polar bear's fitness, since polar bears with very thin coats left fewer offspring than those with thicker coats. The foundational idea ofevolutionary psychologyis that brains are no different from any other organ with an evolutionary function, insofar as brains too are systems shaped by natural selection to solve adaptive problems. Thus brains have a particular functional organization because their behavioural effects tend, or once tended, to help maintain or increase the fitness of organisms with those brains. Prominent evolutionary psychologists (for example: Cosmides and Tooby, 1987; Cosmides and Tooby, 1994 and Symons, 1992) have endorsed the view that the last time any significant modifications were made by natural selection to the human brain's functional architecture, we were hunter-gatherers, inhabiting a world quite different from that which we now inhabit. That world was the Pleistocene epoch, between about 2 million years ago and 10 thousand years ago. On this view, then, the Pleistocene constitutes what evolutionary psychologists often call ourenvironment of evolutionary adaptedness(or EEA), and the information- processing structure and organization of our present-day cognitive architecture is no different from that of our recent huntergatherer ancestors. The threat of terrorism once again raises some of the classic questions about constitutionalism: is it possible for constitutions to do what they aim to do—channel and control political power in such a way as to make it safe and beneficent for those under its rule but also competent to govern? Does not terrorism reraise the Schmittian problem of “the exception”, i.e., the situation of emergency that necessarily escapes all constitutional limitations? Although they did not face the problem of terrorism (...) as we know it, the American founders developed three different models of constitutionalism, embodying three different ways of responding to emergent circumstances and yet remaining bound to the constitutionalist aspiration. We develop the main outlines of the three models both conceptually and historically and show how they continue to be relevant to current discussions of constitutionalism in the age of terror. Finally, we make a tentative effort to judge which of the three models is most able to do what constitutions should do in difficult times. (shrink)

In diesem Band sind unterschiedliche Disziplinen und Perspektiven versammelt, die sich aus ihrer Fachgenese und wissenschaftlichen Position heraus mit Körper, Leib und Gesundheit beschäftigen, um v.a. In a rich and thought-provoking paper, Lambros Malafouris argues that taking material culture seriously means to be ‘systematically concerned with figuring out the causal efficacy of materiality in the enactment and constitution of a cognitive system or operation’ (Malafouris 2004, 55). As I understand this view, there are really two intertwined claims to be established. The first is that the things beyond the skin that make up material culture (in other words, the physical objects and artefacts in which cultural networks (...) and systems of human social relations are realized) may be essential to the enactment of, and be partly constitutive of, certain cognitive systems or operations. The consequence of establishing this claim is supposed to be that we have a mandate to recast the boundaries of the mind so as to include, as proper parts of the mind, things located beyond the skin. Thus, in talking about the contribution of the world to cognition, Malafouris (2004, 58) concludes that ‘what we have traditionally construed as an active or passive but always clearly separated external stimulus for setting a cognitive mechanism into motion, may be after all a continuous part of the machinery itself; at least ex hypothesi’. This is the position that, in philosophical circles, is known increasingly as the extended mind hypothesis (Clark & Chalmers 1998; Menary forthcoming). Henceforth I shall refer to this hypothesis as EM. A stock example will help bring the idea into view. Rumelhart et al. (1986) note that most of us solve difficult multiplication problems by using ‘pen and paper’ as an external resource. This environmental prop enables us to transform a difficult cognitive problem into a set of simpler ones, and to temporarily store the results of certain intermediate calculations. For the fan of EM, the distributed combination of this external resource and certain inner psychological processes constitutes a cognitive system in its own right. (shrink)

Formalised public participation in project approval procedures is rarely addressed in technology assessment. Empirical data about public participation processes are taken into account even more rarely. This article explores the practice of public participation in infrastructure projects in the Federal Republic of Germany on the basis of empirical data from the period of 1990 to 2010. The author compares the empirical data about participation processes with the targets of the public participation and asks for the reasons for the lack of (...) participation in formalised approval procedures. Furthermore, the author contrasts participation formats used in technology assessment with formalised public participation. In his conclusions, he advocates for a stronger combination of formalised and informal public participation in technology assessment. (shrink)

In this article, I examine Thomas Aquinas's teaching on the light of glory (lumen gloriae), and attempt to resolve several problems that arise within this teaching.

The author identifies four possible attitudes of tolerance toward groups with different ways of life: resignation, indifference, curiosity and enthusiasm. He explores the potential for these attitudes and concludes by discussing the role of boundaries within communities in modernism and postmodernism. The author is not going to focus on toleration of eccentric or dissident individuals in civil society; he is interested in individual rights primarily when they are exercised in common—in the course of voluntary association or religious worship or cultural (...) elaboration—or when they are claimed by groups on behalf of their members.
