Rendre hommage à un auteur, ce n'est pas seulement célébrer ce qu'il fut mais c'est aussi alerter sur ce que son oeuvre apporte au présent et à l'avenir de la connaissance. C'est bien le sens donné à cet hommage à André-Jean Arnaud. Repenser le droit, c'était pou r cet auteur érudit : repenser les lieux, les conditions et les façons de l'étudier en dépassant les frontières géographiques en même temps que les frontières disciplinaires. En montrant en quoi André-Jean (...) class='Hi'>Arnaud fut, hors des sentiers battus et des orthodoxies de la production et de la transmission des savoirs en la matière, un exceptionnel précurseur et l'infatigable artisan d'un nouveau régime de connaissance sur le droit, le présent ouvrage s'adresse à toutes celles et à tous ceux, enseignants, chercheurs, étudiants ou simples citoyens, pou r qui l'étude du droit permet de mieux comprendre ce que sont et ce que sont susceptibles de devenir nos sociétés. One of the themes that has been widely addressed in both the implicit learning and statistical learning literatures is that of rule learning. While it is widely agreed that the extraction of regularities from the environment is a fundamental facet of cognition, there is still debate about the nature of rule learning. Rey and colleagues show that the comparison between human and non‐human primates can contribute important insights to this debate.

De la scolastique médiévale au XIXe siècle, la tradition philosophique a cherché à saisir l'unité des directions en lesquelles elle se déploie à travers des métaphores, celle de l'arbre par exemple, ou en élaborant des systèmes dont le XXe siècle semble bien avoir fait le deuil. Comment donc penser l'hétérogénéité de ces directions, qui font l'ampleur d'une pensée, si ce n'est en les reconduisant à des modalités de l'existence qui en constituent le sol? Cet ouvrage s'est ainsi proposé de recueillir (...) le déploiement de la philosophie lorsqu'elle pense le mythique, l'esthétique et le logique, en partant de cette réflexion sur l'existence. Dans son célèbre article de 1950 «Computing Machinery and Intelligence», Alan Turing suggère qu'un critère d'intelligence pour une machine serait qu'elle puisse se faire passer pour un interlocuteur humain. Ce test, appelé «Test de Turing», a été critiqué par John Searle, qui a remis en cause sa pertinence en s'appuyant sur une expérience mentale connue sous le nom de l'argument de la chambre chinoise. L'expérience tend à montrer que l'intelligence artificielle au sens propre du terme est impossible, parce que les (...) symboles manipulés par les programmes de prétendue «intelligence artificielle» sont dépourvus de signification. L'intentionalité propre à certains êtres vivants peut seule faire naître le sens. L'imitation d'un comportement intentionnel ne le peut pas. Le test de Turing serait done insatisfaisant, parce qu'il ne permettrait pas de distinguer les systèmes intentionnels de systèmes qui ne le sont pas, et que par conséquent il ne permettrait pas de distinguer l'intelligence authentique de la simulation de l'intelligence. This article argues that Brentano’s classification of mental phenomena is best understood against the background of the theories of natural classification held by Auguste Comte and John Stuart Mill. Section 1 offers a reconstruction of Brentano’s two-premise argument for his tripartite classification. Section 2 gives a brief overview of the reception and historical background of the classification project. Section 3 addresses the question as to why a classification of mental phenomena is needed at all and traces the answer back to (...) Mill’s view that psychological laws are class-specific. Section 4 and 5 connect the second premise of Brentano’s argument to Comte’s principle of comparative likeness and Mill’s insistance that class membership is determined by the possession of common characteristics. The interventionist account of causation offers a criterion to distinguish causes from non-causes. It also aims at defining various desirable properties of causal relationships, such as specificity, proportionality and stability. Here we apply an information-theoretic approach to these properties. We show that the interventionist criterion of causation is formally equivalent to non-zero specificity, and that there are natural, information-theoretic ways to explicate the distinction between potential and actual causal influence. We explicate the idea that the description of causes should be (...) proportional to that of their effects. Then we draw a distinction between two ideas in the existing literature, the range of invariance of a causal relationship and its stability. The range of invariance is related to specificity and range of causal values. Stability concerns the effect of additional variables on the relationship between some focal pair of cause and effect variables. We show how to distinguish and measure the direct influence of background variables on the effect variable, and their influence on the relationship between the focal cause and the effect variable. Finally, we discuss the limitations of the information-theoretic approach, and offer prospects for complementary approaches. (shrink)

Au-delà de l’utilité pratique du costume, qui peut faire débat, policiers et gendarmes affichent une prestance militaire qui renforce leur prestige. Mais ils montrent aussi qu’ils travaillent en toute transparence, en assumant leurs actes et en se plaçant au service du public. Ils prouvent enfin leur valeur en engageant des dépenses vestimentaires qui deviennent un gage (...) de respectabilité. S’il constitue un enjeu symbolique fort, l’uniforme évolue dans le sens d’une plus grande simplicité fonctionnelle au cours du xixe siècle, s’adaptant dans une certaine mesure à la mode masculine. The canonists’ determination of the sphere of sanction provides an insight into the foundations of ecclesiastical tolerance. There is indeed an ecclesiastical tolerance that leads the magisterium to limit the scope of penal normativity for theological and pastoral reasons. The distinction between sin and crime, well known to canonists, is justified less by recourse to decretals or decisions of councils than by a return to the discourses of the Church Fathers. The definition of the notion of crime in canon law (...) and beyond owes a debt to Augustine’s meditation on the Donatist quarrel: according to this approach, it is a question of tolerating the tares. Résumé Monothéisme. Le mot désigne un système de pensée reposant sur la reconnaissance de la divinité d’un seul dieu à l’exclusion de tout autre. Ce caractère exclusif distingue le monothéisme de l’hénothéisme ou de la monolâtrie. C’est pourquoi le monothéisme est affaire de croyance, au contraire des religions orientales traditionnelles dont celle de l’Ancien Testament. L’article démontre que le caractère monothéiste est en réalité absent de la bible hébraïque, en examinant notamment les récits de la Création et le lexique de (...) l’unicité du divin. C’est à l’époque romaine, en particulier chez Philon d’Alexandrie que se rencontrent des écrits plus proprement monothéistes, à la faveur d’exégèses fondées sur les mythes cosmogoniques, au premier rang desquels le récit biblique dit de la Création. Il aura fallu que le pouvoir impérial prenne des traits véritablement universels pour que la notion d’un dieu unique garant de ce pouvoir émerge de la multitude. (shrink)

Ce sont I'interpretation égalita-riste des idées de Platon quant aux différences sexuelles, la neutralité du concept d'homme et 1'interpretation philosophique de la complémenta-rite des sexes comme modèle des relations égalitaires. Penser selon une "pensee-mouvement", c'est se concentrer, non sur les etres et les choses existant dans leurs limites assignees, mais porter son regard sur l'intervalle, la passerelle entre ces etres et ces choses. On evite ainsi ce cancer de la pensee occidentale et desormais mondiale: la dichotomie sous sa forme manicheenne qui oppose les choses deux a deux, en chiens de faience (pensee de guerre). On considere que les choses et les etres, non seulement ne peuvent exister sans leurs innombrables (...) "relatifs" - l'arbre avec l'eau et la terre, l'animal avec son "milieu", l'homme, avec ses poumons et l'air qui les fait vivre, avec ses milliards de ses congeneres -, mais encore sont continuellement modifies dans et par cette relation. On oppose aisement la "relation" et le "rapport" dans la relation, les elements se transforment mutuellement; dans le rapport, les elements demeurent "tels qu'en eux-memes". On repere soudain une lutte feroce de la culture humaine pour eliminer toute importance de la nature et prendre definitivement les commandes de l'univers. On peut relire critiquement toute l'evolution de la pensee et modifier son regard sur ce qui nous entoure, a l'aide d'une intelligence du coeur, d'une fonciere bienveillance. (shrink)

The Corporate Social Performance (CSP) model (Wood, Acad Manag Rev 164:691–718, 1991) assesses a firm’s social responsibility at three levels of analysis—institutional, organizational and individual—and measures the resulting social outcomes. In this paper, we focus on the individual level of CSP, manifested in the managerial discretion of a firm’s principles, processes, and policies regarding social responsibilities. Specifically, we address the human resources management of employees as a way of promoting CSR values and producing socially minded outcomes. We show that applying (...) the humanist philosophy to the managerial discretion of a business organization leads to the creation of an “autonomy supportive work environment”—as defined by the self-determination theory—which in turn, facilitates the internalization of social values, citizenship behaviors, and cooperation. The objective of promoting self-determination at work (i.e., the core of a humanist management) fits well with the ontology of social responsibility since autonomy and consideration of individuals as moral actors are central tenets. Furthermore, we show that applying humanistic management philosophy to the discretion of managers can lead to socially responsible outcomes. First, intra-organizational stakeholders (e.g., employees) are treated with respect and focus is put on their well-being, satisfaction, and self-actualization at work. Second, as employees’ need of self-determination is addressed by managers, it is likely that pro-social behaviors toward other stakeholders of the organization will be adopted, leading to socially responsible outcomes for extra-organizational stakeholders (Gagné, Motiv Emot 77:58–75, 2003). Thus, this paper ultimately posits that humanistic management applied to the HRM can be a solution for developing and maintaining socially responsible outcomes as determined at the individual level of the CSP model, through managerial discretion. In this article I want to create a presumption in favor of a nonreductive analysis of emotional phenomenology. The presumption relies on the claim that none of the nonemotional elements which are usually regarded as constitutive of emotional phenomenology may reasonably be considered responsible for the evaluative character of the latter. In section 1 I suggest this is true of cognitive elements, arguing that so-called ‘evaluative’ judgments usually result from emotional, evaluative attitudes, and should not be conflated with them. In (...) section 2 I argue the same holds true for conative attitudes. And in section 3 I briefly mention some salient aspects of the version of nonreductive analysis I lean toward. (shrink)

According to the transparency thesis, some conscious states are transparent or “diaphanous”. This thesis is often believed to be incompatible with an inner‐awareness account of phenomenal consciousness. In this article, I reject this incompatibility. Instead, I defend a compatibilist approach to transparency. To date, most attempts to do so require a rejection of strong transparency in favor of weak transparency. In this view, transparent states can be attended to by attending (in the right way) to the presented world: that is, (...) they are merely translucent. Here, I first argue that this understanding of transparency is too weak to qualify as a compatibilist view. Drawing on insights from Franz Brentano, I then describe a middle road between strong and weak transparency. The crucial idea is that, although transparent states cannot be attended to, they can be noticed (under suitable conditions). This view, I submit, allows supporters of inner awareness to commit themselves to a more interesting understanding of transparency—moderate transparency—that preserves the initial intuition underlying the transparency metaphor. The ability to detect and respond to chemosensory threat cues in the environment plays a vital role in survival across species. However, little is known about which chemical compounds can act as olfactory threat signals in humans. We hypothesized that brief exposure to putrescine, a chemical compound produced by the breakdown of fatty acids in the decaying tissue of dead bodies, can function as a chemosensory warning signal, activating threat management responses (e.g., heightened alertness, fight-or-flight responses). This hypothesis was tested (...) by gaging people’s responses to conscious and non-conscious exposure to putrescine. In Experiment 1, putrescine increased vigilance, as measured by a reaction time task. In Experiments 2 and 3, brief exposure to putrescine (vs. ammonia and a scentless control condition) prompted participants to walk away faster from the exposure site. Experiment 3 also showed that putrescine elicited implicit cognitions related to escape and threat. Experiment 4 found that exposure to putrescine, presented here below the threshold of conscious awareness, increased hostility toward an out-group member. Together, the results are the first to indicate that humans can process putrescine as a warning signal that mobilizes protective responses to deal with relevant threats. The implications of these results are briefly discussed. (shrink)

This chapter offers a phenomenological interpretation of Brentano’s view of mentality. The key idea is that mental phenomena are not only characterized by intentionality; they also exhibit a distinctive way of appearing or being experienced. In short, they also have a distinctive phenomenology. I argue this view may be traced back to Brentano’s theory of inner perception. Challenging the self-representational reading of IP, I maintain the latter is best understood as a way of appearing, that is, in phenomenological terms. Section (...) 1 addresses Brentano’s claim that IP is one mark of the mental alongside intentionality. Sections 2 and 3 present support for a phenomenological interpretation of IP. This collection of fourteen original essays addresses the seminal contribution of Franz Brentano and his heirs, to philosophy of language. Despite the great interest provoked by the Brentanian tradition and its multiple connections with early analytic philosophy, precious little is known about the Brentanian contribution to philosophy of language. The aim of this new collection is to fill this gap by providing the reader with a more thorough understanding of the legacy of Brentano and his school, in their pursuit of (...) a unique research programme according to which the analysis of meaning is inseparable from philosophical inquiries into what goes on in the mind and what there is in the world. In three parts, the volume first reconstructs Brentano’s pathbreaking thoughts on meaning and grammatical illusions, exploring their strong connections with the Austro-German tradition and analytic philosophy. It then addresses the multifaceted debates on the objectivity of meaning in the Brentano School and its aftermath. Finally, part three explores Brentano’s wider legacy, namely: Husserl’s theory of modification and typicality, Bühler’s theory of linguistic and non-linguistic expressions, and Wittgenstein’s thoughts on guidance and rule-following. The result is a unique collection of essays which shows the significance, originality and timely character of the Brentanian philosophy of language. (shrink)

Franz Brentano’s works are not just full of deep and innovative insights into mind, world and values. His views also turned out to be highly influential upon several generations of students, who made them the basis of their own philosophical investigations, giving rise to what is known as the Brentano School (Albertazzi et al. 1996; Fisette & Fréchette 2007). In this chapter, I give a bird’s eye view of the Brentano School from a rather historical perspective. My leading hypothesis is (...) that one crucial factor explaining the rise of the school is Brentano’s unique strategy, within the academic context of the time, to promote the revival of philosophy as a rigorous science. After a brief introduction, I reconstruct the three main phases in the school’s development, namely Brentano’s teaching in Würzburg (1866-73), his teaching in Vienna (1874-95), and Anton Marty’s teaching in Prague (1880-1913). In this article, the authors, as researchers, are part of a clinical approach to psychoanalytic orientation in education sciences, questioning their research approach during an investigation on the expulsion from classrooms in secondary school in France. Trying to compare themselves to different types of collaborative research, they analyse the modalities of relationship they tried to implement during this research ‘with’ subjects, including teenagers students they have interviewed.

This chapter argues that Gilbert Ryle’s account of misleading expressions, which is rightly considered a milestone in the history of analytic philosophy, is continuous with Brentano’s. Not only did they identify roughly the same classes of misleading expressions, but their analyses are driven by a form of ontological parsimony which sharply contrasts with rival views in the Brentano School, like those of Meinong and Husserl. Section 1 suggests that Ryle and Brentano share a similar notion of analysis. Section 2 spells (...) out the notion of misleading expression by means of the surface-grammar/truth-conditions distinction, which I argue is implicit in their accounts. Section 3 zooms in on a specific class of misleading expressions, namely expressions about ficta. Finally, Section 4 draws the consequences of what precedes for a correct understanding of the notion of meaning. (shrink)

Résumé À partir d’une réflexion initiée par une petite forme donnée au théâtre de la Cité internationale en juin 2009 (Au bois dormant), l’étude vise à établir que l’instauration d’une mise en commun et d’un temps commun lors de la représentation n’implique pas l’existence d’une véritable « communauté ». Prolongeant le souci de l’« adresse » et du public sur lesquels s’interrogent les milieux de théâtre, elle se demande ce qu’est un « public » et ce qu’il en est de (...) la communauté créée par le fait d’être réuni. Cette question invite à repenser l’articulation du public et du privé, de l’intime et du social. Or dans le monde moderne, le privé ou l’intime s’oppose au social et non au politique dont il partage l’éviction ou l’oubli. Le dispositif théâtral propose paradoxalement de mobiliser la sphère de l’intime, mais en présence d’autrui, sans toutefois vouloir mettre en place une « communauté théâtrale ». C’est en ce sens qu’indirectement sa leçon revêt une dimension philosophique, éthique et politique. (shrink)

En 1961, un article de Souriau relevant une difficulté signalée en 1953 par Dufrenne porte sur la juste part à accorder à la contemplation dans la relation à l’art. La zone d’ombre concernant la relation humaine et intellectuelle entre les deux hommes fera l’objet d’un premier examen. L’hypothèse souralienne d’une transmutation de conceptions théologiques dans le domaine de l’art sera ensuite examinée par rapport à Dufrenne sans évacuer la question de sa pertinence par rapport aux études phénoménologiques ultérieures. La question (...) de la relation à l’art, telle que Souriau l’envisage ressurgira dans sa pleine actualité jusque dans le face à face avec les œuvres. (shrink)

Arnaud Martin Le 29 août 2018, le président du gouvernement espagnol Pedro Sánchez annonça la création d’une commission de la vérité sur les crimes commis durant la guerre civile et la dictature franquiste. Ainsi devait prendre officiellement fin la politique d’impunité et d’amnésie politique imposée au peuple espagnol au lendemain de la mort du général Franco par la loi du 15 octobre 1977, confirmée trente ans plus tard par la loi du 26 décembre 2007, comme contrepartie des mesures d’amnistie (...) prises en faveur des condamnés politiques et comme prix à payer pour assurer la réussite du processus consensuel de transition démocratique. La mémoire historique qui avait été refusée aux Espagnols allait pouvoir devenir réalité. La commission s’inscrit de façon originale dans la logique de la justice transitionnelle. En effet, l’élaboration de la vérité historique annoncée par Pedro Sánchez a pour but, non pas d’assurer la transition démocratique et la pacification d’une société postconflictuelle, mais de prévenir la « déconsolidation » démocratique à laquelle pourraient conduire la non-reconnaissance des torts subis par les victimes du franquisme et l’impossibilité de l’Espagne – notamment de la droite – à tourner la page du franquisme. On the basis of neuroiinaging studies, Posner & Raichle summarily report that the prefrontal cortex is involved in executive functioning and attention. In contrast to that superficial view, we briefly describe a testable model of the kinds of representations that are stored in prefrontal cortex, which, when activated, are expressed via plans, actions, thematic knowledge, and schemas.

This paper suggests that autistic people relate to themselves via a third-person perspective, an objective and explicit mode of access, while neurotypical people tend to access the different dimensions of their self through a first-person perspective. This approach sheds light on autistic traits involving interactions with others, usage of narratives, sensitivity and interoception, and emotional consciousness. Autistic people seem to access these dimensions through comparatively indirect and effortful processes, while neurotypical development enables a more intuitive sense of self.

In 1952, Heinrich Scholz published a question in The Journal of Symbolic Logic asking for a characterization of spectra, i.e., sets of natural numbers that are the cardinalities of finite models of first order sentences. Günter Asser in turn asked whether the complement of a spectrum is always a spectrum. These innocent questions turned out to be seminal for the development of finite model theory and descriptive complexity. In this paper we survey developments over the last 50-odd years pertaining to (...) the spectrum problem. Our presentation follows conceptual developments rather than the chronological order. Originally a number theoretic problem, it has been approached by means of recursion theory, resource bounded complexity theory, classification by complexity of the defining sentences, and finally by means of structural graph theory. Although Scholz' question was answered in various ways, Asser's question remains open. (shrink)

Les études anthroponymiques visent généralement à faire du nom un outil pour comprendre les usages sociaux et culturels dans un espace donné. Le statut spécifique des femmes dans la société du haut Moyen Âge invite donc à s’appuyer sur leurs noms pour comprendre quelle était leur condition. La rareté de la documentation ne facilite pas cette tâche. Néanmoins, en s’appuyant sur les noms, il est possible d’analyser le rôle des femmes dans la parenté : il s’avère qu’elles ont plus de (...) peine à transmettre leurs noms et qu’elles transmettent également les noms de leurs ancêtres plus difficilement que ne le font les hommes, sauf dans de rares cas d’hypogamie. Il serait toutefois imprudent de postuler l’existence de différences radicales entre noms des hommes et des femmes, et tout aussi dangereux d’attacher aux noms une sémiotique genrée. (shrink)
