The past decade has seen a burgeoning of scholarly interest in conscientious objection in healthcare. While the literature to date has focused primarily on individual healthcare practitioners who object to participation in morally controversial procedures, in this article we consider a different albeit related issue, namely, whether publicly funded healthcare institutions should be required to provide morally controversial services such as abortions, emergency contraception, voluntary sterilizations, and voluntary euthanasia. Substantive debates about institutional responsibility have remained largely at the level of (...) first-order ethical debate over medical practices which institutions have refused to offer; in this article, we argue that more fundamental questions about the metaphysics of institutions provide a neglected avenue for understanding the basis of institutional conscientious objection. To do so, we articulate a metaphysical model of institutional conscience, and consider three well-known arguments for undermining institutional conscientious objection in light of this model. We show how our metaphysical analysis of institutions creates difficulties for justifying sanctions on institutions that conscientiously object. Thus, we argue, questions about the metaphysics of institutions are deserving of serious attention from both critics and defenders of institutional conscientious objection. (shrink)

One hundred years after Gestalt views first took hold our understanding of how perceptual processes organize the visual field into objects and their local backgrounds has progressed substantially. We now know that in addition to the image-based properties that the Gestalt psychologists identified as relevant, a myriad of other image-based factors influence figure–ground organization, as do subjective factors such as past experience, attention, and intentions. Moreover, properties of grounds as well as properties of figures play a role. The recent use (...) of indirect measures and brain imaging techniques has revealed that there is much more processing of the regions ultimately perceived as grounds than is supposed in traditional approaches, and that competition and feedback are involved in figure–ground organization. The vulnerable require special justification to participate in human subject research in order to eliminate potential human rights abuses. The Nuremberg Code of 1947 was written in response to the extreme human subject abuses that occurred under the Nazi regime, and, although the intent of the 1947 Code was to protect human rights, rigid voluntary consent requirements deprived some individuals of the right to participate in clinical trials. Recent human research guidelines, such as the CIOMS/WHO guidelines referenced above and the guidelines referenced in Section V of this Scope Note, attempt to balance both protection from abuse in research and access to new, experimental treatments for the vulnerable.Although various protective guidelines stipulate special protections for vulnerable populations, the concept of vulnerability and consequently the criteria designating vulnerable populations remain vague. Precisely who are the vulnerable? The word "vulnerability" stems from the Latin vulnerare, "to wound." (Oxford Encyclopedic English Dictionary 1995). In clinical research, the term [End Page 411] vulnerable generally is applied to individuals who are unable to give informed consent or who are susceptible to coercion. The Common Rule (45 CFR 46, Subpart A) includes as vulnerable research subjects: children, prisoners, pregnant women, and persons who are handicapped, mentally disabled, economically disadvantaged, or educationally disadvantaged. Although the Common Rule specifies certain vulnerable categories, the guidelines were not intended to be exclusive, leaving open the interpretation of vulnerability.In medical research and health policy, vulnerability is an abstract concept that has concrete effects both for those labeled vulnerable and for those not. Clinical researchers, healthcare workers, ethical reviewers, and policymakers must be able to identify vulnerable subjects to establish how healthcare resources will be allocated and who will qualify for special protections and socialized benefits. Attempts to quantify vulnerability in clear, measurable ways have met little if any consensus. As Alexander Morawa (II, 2003, p. 150) states, "There is no single approach to definition of vulnerability. In fact, there is no purposeful categorisation at all."Difficulties in defining vulnerability have prompted discourse surrounding its utility as a qualifying factor in the allocation of health resources and its appropriateness as a guiding principle in bioethics. Some of the authors cited in this Scope Note argue against the labeling and categorization of vulnerable individuals and populations. "Labeling individuals as 'vulnerable' risks viewing vulnerable individuals as 'others' worthy of pity, a view rarely appreciated" (III, Danis and Patrick 2002, p. 320). The categories of vulnerable groups listed under the Common Rule have been the source of controversy, "for example, many find the suggestion that pregnant women are vulnerable to be quite sexist" (IV, DeBruin 2001, p. 7). Instead of creating categories of vulnerable populations, would it not be better to derive an account of just treatment from a just social policy at large that encompasses human vulnerabilities (II, Brock 2002, p. 283).For some of the authors listed here, the concept of vulnerability is essential to bioethics. Robert Goodin (I, 1985, p. 107) writes that the vulnerability of other human beings is the source of our special responsibilities to them. ABSTRACT:Programs aimed at increasing women’s entrepreneurship are a rapidly proliferating class of CSR initiatives across the globe with participation by many of the world’s largest corporations. The gendered nature of this phenomenon suggests that feminist approaches to CSR may offer a particularly salient mode of their analysis. In this article, I argue that insights from feminist economics regarding the historically prevalent—but narrow and gendered—definition of work, which artificially separates production from reproduction, provide fruitful tools for theory building when conceptualizing gender (...) through the lens of CSR. I demonstrate that the gendered separation of production and reproduction is typicallytaken as givenin entrepreneurship, and that mainstream CSR research has not sufficiently challenged this perspective. I present a conceptual framework of what is to be gained by examining the CSR, entrepreneurship, and feminist economics literatures in combination, and demonstrate how researchers might use this framework for future research. This article explains how li 禮 or ‘ritual propriety’ is the ‘body language’ of ren 仁 or the authentic expression of our humanity. Li and ren are interdependent aspects of a larger creative human way (rendao 仁道) that can be conceptually distinguished as follows: li refers to the ritualized social form of appropriate conduct and ren to the more general, authentically human spirit this expresses. Li is the social instrument for self-cultivation and the vehicle of harmonious human interaction. More, li (...) must mean something that is effectively communicated to others for an authentic, human (ren) interaction to occur. Li is the body language of ren in being the ritual vehicle for its’ expression; however, li is underdetermined by ren and so must be distinguished from it in on further grounds: authentic human activity must not just be equivocated with social convention because conclusively establishing whether a particular action is li (or is a truly ren action) is impossible. As a result, li is often confused with social power and privilege that is easier to empirically identify than ren conduct is, but this is a mistake since li has to express ren or it is not li at all. The inescapable ambiguity of li – an ambiguity that attaches to any language – can be critiqued by the Western view that sees something ‘essential’ to the ‘self,’ and that makes one a ‘self’ in and of oneself and not in a way that depends on others. I show that such Western individualism – while resting on a fundamentally different way of thinking of being a person and living a good life – does not reduce Confucian ritual to being an instrument for social discrimination and subordination. My argument is indebted to twentieth-century philosophy of language in the West that offered the idea that some words are actions. (shrink)

People judge that an individual who attempts to harm someone but fails should be blamed and punished more when they imagine how things could have turned out worse, compared to when they imagine how things could have turned out the same, or when they think only about what happened. This moral counterfactual amplification effect occurs when people believe the protagonist had no reason for the attempt to harm, and not when the protagonist had a reason, as Experiment 1 shows. It (...) occurs for intentional failed attempts to harm and also for accidental near-misses, as Experiment 2 shows, but not for failed attempts in which the harm occurs anyway by another cause, for both general judgments about the event and specific judgments about the individual's actions, as Experiments 3 and 4 show. Although stockholders may benefit from information regarding the frequently substantial charitable and political contributions of the corporations they own, US corporations are typically not required to disclose any information about such payments in annual financial statements or information submitted periodically to regulatory agencies. This lack of transparency is confounded by disclosure requirements of private foundations, which a corporation may choose to establish for the purposes of administering charitable giving for the corporation. The resulting disclosure fog engendered by extant regulations may (...) be confusing to those corporation owners who would like to know what corporation contributions are being made to charities and politicians. This article enumerates the magnitude of the charitable and political gifts of 40 of the most generous public corporations in the USA, the current disclosure requirements for public companies, the role of foundations, rationales for withholding relevant information from owners, and ethically questionable strategies that corporations may use to manage those disclosures for their benefit. THE following treatise on Sextus Empiricus and Greek Scepticism has been prepared to supply a need much felt in the English language by students of Greek philosophy. For while other schools of Greek philosophy have been exhaustively and critically discussed by English scholars, there are few sources of information available to the student who wishes to make himself familiar with the teachings of Pyrrhonism. The aim has been, accordingly, to give a concise presentation of Pyrrhonism in relation to its historical (...) development and the Scepticism of the Academy, with critical references to the French and German works existing on the subject. The time and manner of the connection of Sextus Empiricus with the Pyrrhonean School has also been discussed. As the First Book of the "Hypotyposes," or Pyrrhonic Sketches by Sextus Empiricus, contains the substance of the teachings of Pyrrhonism, it has been hoped that a translation of it into English might prove a useful contribution to the literature on Pyrrhonism, and this translation has been added to the critical part of the work. This article examines the claim that Duns Scotus’s position on the will’s freedom changed between his early Lectura teaching to his late Reportatio lectures on Distinction 25 of Book II of the Sentences. Stephen Dumont in “Did Duns Scotus Change His Mind on the Will?” suggests that Scotus moves closer to the position of Henry of Ghent on the will. The Franciscan had criticized that position in his earlier teaching. In order to demonstrate that Scotus’s voluntarism continues to be moderate, (...) the author first explicates the notion of a rational will in Scotist thought, by means of the two affections of the will and the position outlined in Scotus’s Questions on the Metaphysics of Aristotle Book IX, Q. 15. Following this, a textual comparison of Lectura II, D. 25 with Reportatio II, D. 25 shows that there is indeed a shift, but not toward a more exaggerated form of voluntarism. Rather, close reading of these texts reveals that, in his early teaching, Scotus did not think the will was the rational potency, and did not identify its freedom with rationality. In the later Parisian teaching he presents the will as the sole rational potency, thereby diminishing the role of the intellect, but not that of rationality. The textual evidence of Ordinatio II, D. 6, Questions on the Metaphysics, Lectura II, D. 25 and Reportatio II, D. 25 show that Scotus’s final teaching on the will integrates rationality into the functioning of freedom, and does not align him with Henry’s position, despite similarity of language. Bergin, Mary As an Australian it is a great honour to receive this award as Australian Humanist of the Year. It is often thought, mistakenly, that Humanism is somehow contrary to or opposed to religion, but of course it is not. It is simply a belief in rational and humane tolerance, and it holds that people should not be made miserable by cruel politicians or primitive moralists or superstitious beliefs. Humanists have succeeded to some considerable extent in the West (...) in removing ancient prejudices - for example against the LGBT community. We don't seem to have succeeded, to judge from the latest appointments in the NSW government, in refuting the strange idea that Christian politicians are less corrupt than atheists. (shrink)

Respect and dignity are central to moral life, and have a particular importance in health care settings such as the intensive care unit (ICU). We conducted 15 semistructured interviews with 21 participants during an ICU admission to explore the definition of, and specific behaviors that demonstrate, respect and dignity during treatment in the ICU. We transcribed interviews and conducted thematic qualitative analysis. Seven themes emerged that focused on what it means to be treated with respect and/or dignity: treated as a (...) person; Golden Rule; acknowledgement; treated as family/friend; treated as an individual; treated as important/valuable; and treated as equal. Participants described particular behaviors or actions that were considered related to demonstrating treatment with respect and dignity: listening; honesty/giving information; attention to body/modesty/appearance; caring/bedside manner; patient and family as an information source; attention to pain; and responsiveness. These behaviors provide a framework for improving experiences with care in the ICU. (shrink)
