ABSTRACT The paper challenges the general perception that the positive–negative freedom discourse privileges negative liberty. It demonstrates that Constant and Berlin’s dual freedom conceptual scheme contains the blueprint of a modern concept of positive freedom and it reveals the nature of negative freedom in an entirely new light. Constant’s ancient and modern liberties have many similarities with Berlin’s two concepts of freedom – positive and negative. The paper shows that these similarities warrant a parallel study and allow us to examine (...) the relation between the two sides of the freedom dichotomy by using the compound terms modern/negative and ancient/positive freedom. It is argued that understanding the relation between the two freedoms depends on accepting ancient/positive liberty as practiced by the participants of modern revolutions. Then we can see why this freedom can both violate and complement modern/negative freedom. The paper argues that the combined tension and mutual dependency of the two freedoms can be explained by tapping into a metaphysical study of human agency, where metaphysics is understood as conceptualisation of moral experience. This helps demonstrate why Constant’s modern liberty and Berlin’s negative liberty rely on satisfaction as a key category reflecting individuals’ capacity for subjective judgement. (shrink)

This book offers a new phenomenological interpretation of T.H. Green's (1836-1882) philosophy and political theory. By analyzing his theory of human practice, the moral idea, the common good, freedom and human rights, the book demonstrates that Green joins the same tradition as Kantian and Husserlian transcendentalism. The book offers a reconstruction of Green's idealism and demonstrates its potential to address contemporary debates on the nature of moral agency, positive and negative freedom and on justifying human rights.

We have two kinds of freedom, in both our private and social spheres, because there are two types of goods that we, as human beings, pursue: ordinary and moral. In his paper “The Much —Maligned and Misunderstood Eternal Consciousness” Coin Tyler argues that “the eternal consciousness is a potential of every individual mind”. Later in this paper I will myself argue that the eternal consciousness has a role to play. It comes to emphasise the importance of what exists beyond the routine daily experience, more specifically, the importance of true knowledge and moral perfection. However, does the fact (...) that we can make sense from the eternal consciousness give us enough grounds to defend it? Tyler vigorously criticises the critics of the eternal consciousness but his two lines of defending it end up with two rather modest claims. (shrink)

L.T.Hobhouse's concept of liberty--the concept at the heart of new liberalism--is based on T.H. Green's positive freedom. However, this paper demonstrates that the former has its own distinct nature and can be usefully defined as 'liberty as welfare'. In a context of renewed interest in the link between liberty and ability/personal development, scholars have looked back to Green's positive liberty. But the complex nature of latter has led to scholarly disagreement about its definitive features. The paper argues that Hobhouse's liberty (...) has achieved what neither of Green's two liberties, juristic and true (or positive), have: accommodate concerns with personal development and social justice in a 'primary' concept of freedom. It is demonstrated that only Green's positive freedom, as opposed to his juristic freedom, internalises commitment to development and social justice, but for a number of reasons reviewed in the paper, it is not a primary concept. The first section of the paper examines and criticises Green's dismissal of juristic freedom and outlines the ways in which this concept could have been more viable. The second section demonstrates how Hobhouse's liberty achieves what Green's juristic freedom could have but did not--accommodate personal development and social justice in a concept of liberty that remains an opportunity concept. This book argues that the distinction between positive and negative freedom remains highly pertinent today, despite having fallen out of fashion in the late twentieth century. It proposes a new reading of this distinction for the twenty-first century, building on the work of Constant, Green and Berlin who led the historical development of these ideas. The author defends the idea that freedom is a dynamic interaction between two inseparable, yet sometimes fundamentally, opposed positive and negative concepts - the yin and (...) yang of freedom. Positive freedom is achieved when one succeeds in doing what is right, while negative freedom is achieved when one is able to advance one's wellbeing. In an environment of culture wars, resurging populism and challenge to progressive liberal values, recognising the duality of freedom can help us better understand the political dilemmas we face and point the way forward. The book analyses the duality of freedom in more philosophical depth than previous studies and places it within the context of both historical and contemporary political thinking. This paper aims to show the advantages of the personal ethics perspective employed by the British idealists in the analysis of justice. In the context of Green’s and Bosanquet’s political theory, justice is a secondary moral ideal. Yet, it is argued here, their moral philosophy leads us, through a longer path, to the philosophical grounds we already occupy today: those of thinking about human rights as fundamental, not derivative, i.e. thinking about justice as a primary, not secondary moral ideal. There (...) are three related yet distinct philosophical claims here. First, the British idealists saw clearly the stand-off between justice and virtue. Second, the personal ethics of Green and Bosanquet, with some reconstruction offered here, outlines the way in which this stand-off can be resolved without undermining its significance. Third, the personal ethics perspective is beneficial for resolving some of the difficulties surrounding the institutional approach of implementing of social justice. (shrink)

Green's Moral and Political Philosophy: A Phenomenological Perspective. New York: Palgrave, 2001. Pp. xiii + 175. Cloth, $60.00 Like most today who study Green's idealism, Dimova-Cookson finds only his ethics to be still relevant. She rejects his metaphysical epistemology and consequently his teleology, but offers an alternative. Dimova-Cookson (...) proposes a Husserlian analysis of Green's positions on goodness and a critical defense that attempts to rectify his apparently inconsistent formulations of that concept. Provided we recall that Husserl's method is not unproblematic and resist the tendency to adjust the doctrine analyzed for the sake of methodological fidelity, there is reason to be open to the author's proposal. Several of Husserl's ideas seem relevant to Green's thought: intentionality; "noematic content of the determinable X" and "horizon" developed in Ideas; intersubjectivity; and Husserl's teleological descriptions of phenomenological consciousness. But Dimova-Cookson pursues none of these. She employs Husserl's problematic "epoche" and a "necessary feature of human practice" she calls "the phenomenological circle" (69, hereafter, PC).Dimova-Cookson uses PC to resolve certain confusions imputed to Green. Green himself anticipates the charge of vicious circularity concerning the moral ideal when he reasons that "the unconditional good for man" is the good will and that the good will is to will the unconditional good. He subsequently explains that the circularity is not logically vicious for the two terms describe different states of one teleological process of a will actualizing its potential for perfection, and are distinguished "as the complete from the incomplete." According to Dimova-Cookson, Green hasn't escaped the charge and needn't try. Rather, he has unwittingly stumbled upon PC, but confused matters by carelessly conflating perspectives on the senses of "good" which she believes are two different definitions of two different things, elements in PC. "Circularity in explaining morality can be legitimized," she says, provided one rigorously clarifies the shift in perspective between the two elements in PC (70ff.). This move, she holds, can resolve certain contemporary criticisms. But note that if Green hasn't escaped the charge, and it is a genuine logical circle, then, as Husserl recognized, it cannot be avoided simply by making a rigorously clear shift in perspective. That would be a psychologistic response to a logical problem. Moreover, even if clarity of perspectival shift is useful here, it fails to capture the continuity in the moral progress of the self-actualization of moral agent to moral citizen. Finally, had Green represented his distinction in such dichotomous fashion, this would have compromised the teleological component of his explanations and made it more difficult to keep his theory from being conflated with utilitarianism. Green is far-sighted here, given recent tendencies to confuse utilitarianism and teleology on the basis that both can be represented as versions of consequentialism, a confusion based on the fallacy of undistributed middle.Most of Dimova-Cookson's connections are highly suggestive and many of her distinctions useful. She teases out several possible meanings of Green's conception of good, and is to be commended for having tried to answer some of his critics and calling attention to the valuable content of Green's doctrine. Her attempt at a phenomenological approach is novel.It is troubling, though, that Dimova-Cookson thinks it is also transcendental, for her words reveal a grave confusion about what this means. When discussing what she thinks is either transcendental or phenomenological, she uses the language of contingent psychological experience; e.g., "storing experience" (44), and projecting and relating to one's self-image (65). The process of learning she describes is more reminiscent of Piaget's "assimilation-accommodation" model than anything Husserlian or transcendental. Yet the author considers this an "advanced transcendentalism" wherein "our experience is preconditioned—that is, made possible—by the conceptual baggage that has accumulated and is always present at the back of our minds" (27). This paper develops a novel theory of the meaning of moral equality. This theory has two original and significant implications: first, it shows—contra what is commonly held in the literature—that adults and children are not always each other’s equals; rather, the former are sometimes inferior and sometimes superior to the latter, depending on the interest at stake. Second, it reveals that human beings’ comparative moral status changes across time, and what matters is that they are each other’s equals at simultaneous (...) segments of their lives. (shrink)

Conceptions of evil have changed dramatically over time, and though humans continue to commit acts of cruelty against one another, today we possess a clearer, more moral way of analyzing them. In _Narrating Evil_, María Pía Lara explores what has changed in our understanding of evil, why the transformation matters, and how we can learn from this specific historical development. Drawing on Immanuel Kant's and Hannah Arendt's ideas about reflective judgment, Lara argues that narrative plays a key role in helping (...) societies acknowledge their pasts. Particular stories haunt our consciousness and lead to a kind of examination and dialogue that shape notions of morality. A powerful description of a crime can act as a filter, helping us to draw conclusions about what constitutes a moral wrong, and public debates over these narratives allow us to construct a more accurate picture of historical truth, leading to a better understanding of why such actions are possible. In building her argument, Lara considers Greek tragedies, Shakespeare's depictions of evil, Joseph Conrad's literary metaphors, and movies that portray human cruelty. Turning to such philosophers and writers as Jürgen Habermas, Walter Benjamin, Primo Levi, Giorgio Agamben, and Ariel Dorfman, Lara defines a reflexive relationship between an event, the narrative of the event, and the public reception of the narrative, and she proves that the stories of perpetrators and sufferers are always intertwined. The process of disclosure, debate, and the public fashioning of collective judgment are vital methods through which we make sense not only of new forms of cruelty but of past crimes as well. _Narrating Evil_ describes the steps of this process and why they are a crucial part of our attempt to build a different, more just world. El dualismo de propiedades y los qualia han sido problemas heredados de la teoría cartesiana. ‘Problemas viejos con nuevas vestiduras’ que se han traslapado en el discurso de las ciencias cognitivas, en especial en el de la filosofía de la mente. Para algunos pensadores contemporáneos dichos «problemas» están en el marco de las cuestiones metafísicas. Esta investigación tuvo como objetivo develar la génesis del problema ocasionada por el uso inadecuado del lenguaje, con el fin de mostrar que tales cuestiones a (...) la larga no son más que pseudoproblemas. Problemas de orden lingüístico y lógico disfrazados con ropaje metafísico. El método usado en este estudio fue el método analítico. Por lo cual, en la primera parte del escrito se analiza el discurso que da origen al problema ; posteriormente, se revisa el discurso cartesiano —por ser la doctrina oficial que hereda el problema a la filosofía de la mente—. Como conclusiones, se presentan las razones por las que se afirma que dichos problemas no son más que errores heredados por el uso del lenguaje. Por último, se presentan de manera breve cómo las posturas eliminativista y emergentista de Dennett y Searle no son realmente la superación del dualismo como ellos lo sustentan. (shrink)

This article considers aspects of a development aid that provides medical support to strengthen pediatric orthopedics in Rwanda. We present part of the Afriquia foundation work, a nonprofit foundation from Poland involved in supporting the medical sector in Rwanda as a sign of global solidarity and the human right to health. The main foundation's activity is the treatment of orthopedic problems among Rwandan citizens. We present a case study of two children under the care of the Afiquia foundation. 11‐year‐old Seraphine (...) treated due to the consequences of right tibia osteomyelitis and 11‐year‐old Lavi suffering from osteogenesis imperfecta. Both children were treated surgically in Poland due to Rwanda's lack of treatment possibilities. After the applied treatment, Seraphine walks correctly without crutches and can attend school and thrive among her peers. Lavi has not sustained any fragility fracture since the surgery in Poland. He is healthy and constantly ongoing his rehabilitation including gait training. The described cases initiated development aid in Rwanda, supplying hospitals with orthopedic implants and training medical staff. The growing number of humanitarian crises across the globe and the people affected requires increasing organizations involved in providing relief. The emphasis should be on global education, aiming to make the recipients reflect and prepare them to face humanitarian crises. (shrink)

La estabilidad es una de las características centrales de una constitución, aunque su consecución trascienda los planteamientos puramente constitucionales. Los métodos institucionales que se han utilizado para, en cierta medida, intentar alcanzarla son diversos —y a veces contradictorios— según se adapten más o menos fácilmente a la demanda de cambio constitucional. Entre estos fenómenos, este trabajo formula un nuevo concepto denominado liquidez constitucional cuya utilidad radica en propiciar dimensiones de flexibilidad en constituciones rígidas. La liquidez constitucional se canaliza a través (...) de las denominadas cláusulas de liquidez constitucional que se formulan inductivamente a la luz de la Constitución española de 1978 y que son analizadas estructural y funcionalmente. Finalmente, se comparan con otros conceptos tradicionales relativos al tratamiento de la estabilidad y el cambio constitucional. (shrink)

El objetivo fundamental de este artículo está dirigido a valorar las funciones de la intertextualidad en la construcción del espacio insular caribeño en WideSargasso Sea, de la escritora dominiquesa Jean Rhys. Por tal motivo se analizaron las relaciones intertextuales entre Jean Eyre, de Charlotte Brontë, y Wide Sargasso Sea, de Jea Rhys, con énfasis en la isla en tanto espacio literario presentado de manera explícita. Como resultado se pudo constatar que la principal función de la intertextualidad en dicho texto responde (...) a la intención calibanesca y desmitificadora de desmonte de los arquetipos en los que la imagen del otro ha sido construida en el discurso del poder. De igual manera, el presente análisis permite develar la riqueza de las connotaciones otorgadas en el texto al espacio isla y a sus significados añadidos. La red de significaciones encontradas refuerza su identidad cultural caribeña. (shrink)

Postmodern political critiques speak of the death of ideology, the end of history, and the postsecular return of religious attitudes, yet radical conservative theorists such as Mark Lilla argue religion and politics are inextricably intertwined. Returning much-needed uncertainty to debates over the political while revitalizing the very terms in which they are defined, María Pía Lara explores the ambiguity of secularization and the theoretical potential of a structural break between politics and religion. For Lara, secularization means three things: the translation (...) of religious semantics into politics; a transformation of religious notions into political ideas; and the reoccupation of a space left void by changing political actors that gives rise to new conceptions of political interaction. Conceptual innovation redefines politics as a horizontal relationship between governments and the governed and better enables societies (and individual political actors) to articulate meaning through action--that is, through the emergence of new concepts. These actions, Lara proves, radically transform our understanding of politics and the role of political agents and are further enhanced by challenging the structural dependence of politics on religious phenomena.
