O presente trabalho visa uma reflexão interessada do pensamento de Luis Alberto Warat sobre a égide do ensino jurídico, trata-se de uma releitura da obra A Ciência Jurídica e seus dois maridos, onde aborda o imaginário carnavalizado. Essa proposta nasce motivada dos conceitos e desconstruções feitas pelo autor em epígrafe. Trata-se de analisar a dogmática jurídica a partir de uma desconstrução que se dá no entrelaçamento entre Direito e Arte, perpassando pelo amor tendo como método o surrealismo jurídico. O jurista britânico John Austin está inserido no limiar do desenvolvimento da tradição juspositivista. Sua obra, que data da primeira metade do século XIX, foi especialmente importante para a fixação dos elementos básicos dessa vertente do pensamento jurídico. Entre suas contribuições para a doutrina juspositivista está a sua formulação da tese da separação entre o direito e a moral. No âmbito ético, por seu turno, John Austin foi um fervoroso utilitarista e defendeu a utilização do princípio da utilidade como o (...) único critério racional para o desvelamento das normas morais superiores (as leis divinas). Considerando essas duas dimensões do seu pensamento, há muito se questiona se a sua ética utilitarista teria influenciado, de algum modo, a sua teoria jurídica, especialmente no que tange à tese da separação. Esta última, que está no centro da tradição juspositivista, tem sido interpretada de diferentes modos no debate jurídico contemporâneo. Uma vertente em especial, o chamado positivismo ético, abriu novas perspectivas para o estudo dessa tradição, ao defender a teoria juspositivista como um modelo teórico moralmente satisfatório para os sistemas jurídicos contemporâneos. Desse modo, utilizando a premissa central do positivismo ético (de que existem razões morais para a defesa da tese da separação) como instrumento metodológico- interpretativo, pretende-se retomar a questão da relação entre as convicções éticas e jurídicas de John Austin, a fim de compreender quais foram as razões morais que o levaram a defender a separação entre o que é o direito e aquilo que ele deveria ser. Corporate governance is an issue of growing importance in developing economies, as many firms pass through significant transformations due to the combined forces of sociopolitical changes, technological progress and economic trends toward globalization. These elements, along with the structural characteristics of developing economies such as less developed capital markets and governmental interventionism, draw a picture for corporate governance practices that may, in some aspects, be fundamentally different from the practices found in European or North American contexts. A partir da fenomenologia, os textos que compõem esta obra pretendem apresentar questões como a popularização da Biomedicina, as experiências do viver com HIV/AIDS e de recomposição do cotidiano após situações de violência sexual e reflexões sobre habilidades sensoriais na contemporaneidade. Apresenta dois capítulos que buscam tratar do Candomblé e os processos de autoidentificação e orientação das relações pessoas e orixás.

Este número da Revista Diálogos debate o tema da consolidação dos estudos acerca da Idade Média. Assim, neste artigo, apresentamos um levantamento bibliográfico da personagem Morgana na lenda arturiana, de suas origens medievais a seu resgate literário oitocentos anos depois de que fora literariamente citada pela primeira vez. Baseamos nossas considerações em teóricos como Câmara, Carver e Kopřivová. Concluímos que este é um estudo válido porque dialoga com a História e com a Literatura no que tange ao reflexo de Morgana (...) na história das mulheres no Ocidente, não se restringindo ao Medievo, mas que se amplia multidisciplinarmente. Este artigo objetiva realizar uma revisão narrativa sobre a temática da branquitude, de modo a verificar suas definições presentes na literatura, assim como as maneiras como ela se expressa no cotidiano. As produções foram organizadas em um quadro segundo autor e data, discutindo os diferentes aspectos da raça, na realidade brasileira, em diferentes regiões e também da realidade de outros países. Os dados obtidos indicam que a branquitude, em suas diversas representações, configura-se um agente central na manutenção do racismo. Confirmaram-se (...) os problemas da não racialização e os prejuízos centenários dessa relação de poder. É um panorama diverso e complexo, que compreende pessoas com ou sem consciência de si, com variados níveis de privilégios, expressos territorialmente de maneira diferente. (shrink)

Este artigo tem como objetivo apresentar como se estabelecem os estudos do filósofo húngaro Georg Lukács sobre a origem do complexo da arte a partir das formas abstratas do reflexo estético da realidade, a saber: ritmo, simetria e proporção e ornamentística. Tais categorias configuram-se, conforme os estudos de Lukács, em princípios; em elementos estruturais da produção artística, os quais são diversos, orientados por funções as mais variadas e já bastante evoluídas e que, de forma excepcional, no caso da ornamentística, mantiveram (...) sua independência, ainda que não tenham garantido o mesmo grau de importância de tempos remotos. Trata-se de um estudo teórico-bibliográfico, apoiado em uma base onto-histórica. O filósofo húngaro considera a dificuldade de revelar a procedência do complexo da arte. Atentamos ao método, considerando que devemos partir do já esteticamente formado, procedendo a tempos remotos, numa relação dialética. Podemos então nos aproximar da origem quando entendemos o mais desenvolvido. Nossas considerações vão ao encontro da compreensão de que qualquer nível de atividade humana deve implicar o trabalho como categoria fundante, na relação de transformação da natureza e do próprio homem. A arte, portanto, tem sua gênese no trabalho e, enquanto complexo tardio no mundo dos homens, tem o seu desprendimento do solo cotidiano, alcançando um processo de autoconsciência humana. Nesse sentido, a relevância do estudo consiste em contribuir com o projeto coletivo para o entendimento do papel da atividade criadora-receptora no aprimoramento dos sentidos, abrindo possibilidades de elevadas expressões no processo de humanização, com vistas à superação da sociabilidade regida pelo capital. Gênese e processo histórico do complexo da arte no cotidiano do ser social na Estética de Lukács Resumo: Esse artigo tem como objetivo apresentar o entendimento onto-histórico sobre o trabalho e a origem tardia do complexo da arte no cotidiano dos seres sociais. Trata-se de uma pesquisa teórico-bibliográfica e fundamenta-se, especialmente, na obra “Estética: la peculiaridad de lo estético”, de Georg Lukács. É pela via do trabalho que a significação de utilidade se transpõe a uma dimensão estética. O complexo da (...) arte se estrutura a partir do tempo livre (ócio), do desenvolvimento da técnica e, ademais, pela experiência do agradável e pela consciência do estético. Considera-se, com efeito, que muito mais do que se acercar dos fatos históricos a respeito da arte, é imprescindível reconhecê-los ontologicamente, compreendendo as necessidades assentes ao cotidiano dos indivíduos enquanto partícipes do gênero humano. It is through labor that the significance of utility is transposed to an aesthetical dimension. The art complex develops itself from the free time (idleness), from the developing of technics and, also, from the experience of agreeable and from the consciousness of the aesthetic. It is considered, undeniably, that much more than approaching by the historical facts about art, it is essential to ontologically recognize them, understanding the needs which are part of the individual’s quotidian as partakers of the human gender. O presente trabalho faz uma breve discussão sobre a importância da atuação do designer instrucional em cursos educacionais à distância, levando em consideração o acelerado crescimento na preferência por cursos ofertados através dos recursos das Tecnologias Digitais de Informação e Comunicação (TDICs). A humanidade vem passando por profundas mudanças, a forma como as pessoas se relacionam e se comunicam mudou, tal fato trouxe impacto direto nos processos de ensinar e aprender. A educação, na era digital, passou a ser repensada e (...) tem sido amplamente discutida buscando um equilíbrio entre a tecnologia como ferramenta educacional. What I call the Doxastic Puzzle, is the impression that while each of these claims seems true, at least one of them must be false: (a) Claims of the form ‘S ought to have doxastic attitude D towards p at t’ are sometimes true at t, (b) If Φ-ing at t is not within S’s effective control at t, then it is false, at t, that ‘S ought to Φ at t’, (c) For all S, p, and t, having doxastic (...) attitude D towards p at t is not within S’s effective control at t. All three natural replies to the puzzle have been pursued. Some have claimed that doxastic attitudes like believing that p are, in fact, within our effective control, or sufficiently so. Others have claimed that doxastic ought-claims, strictly speaking, are always false. And some have denied that effective control is required for the adequacy of doxastic ought-claims in general. I here pursue and examine a different strategy. In the first part of this paper, I argue that these claims are not only each true but actually not in tension with each other in the first place. Instead of attempting to dispel the puzzle, this solution proposes to evade it instead: to solve it by properly understanding, and by thereby accepting without contradiction, all of its constitutive claims. In the second part of the paper, I argue that the evasive strategy forces us to re-think our understanding of the place of normative reasons in epistemology. More exactly, it seems to come at the cost of one central way of thinking about our reasons for having doxastic attitudes, one where such reasons are good-standing exemplars of normative reasons in general. The evasive strategy, that is, threatens to lead us very quickly to a deflationary picture of epistemic normativity: it rescues normative talk, but sacrifices normative substance. I conclude by explaining why I think this is more consequential than some have made it out to be, and by suggesting that these consequences are welcome nonetheless. (shrink)

My starting point is what I call the Normative Authority Conception of justification, where S is justified in their belief that p at t (to some degree n) if and only if their believing that p at t is not ruled out by epistemic norms that have normative authority over S at t. With this in mind, this paper develops an account of doxastic justification by first developing an account of the normative authority of epistemic norms. Drawing from work in (...) political philosophy, I argue that (a) the cognitive and evaluative commitments and concerns behind our actual practices of holding each other and ourselves accountable for our beliefs reveal which epistemic norms we have consented to be under, and that (b) it is because we have consented to be under the authority of these norms – by actually holding ourselves and others accountable to them – that they in turn have normative authority over us. By connecting the authority of epistemic norms to the authority we have over ourselves in this way, the resulting account of doxastic justification (i) explains why it can be appropriate to criticize, resent, or sanction someone for having unjustified beliefs, (ii) avoids the phenomena of normative alienation and normative parochialism, and (iii) respects the social and collective nature of epistemic justification. In this novel account of global citizenship, Luis Cabrera argues that all individuals have a global duty to contribute directly to human rights protections and to promote rights-enhancing political integration between states. The Practice of Global Citizenship blends careful moral argument with compelling narratives from field research among unauthorized immigrants, activists seeking to protect their rights, and the 'Minuteman' activists striving to keep them out. Immigrant-rights activists, especially those conducting humanitarian patrols for border-crossers stranded in the brutal Arizona desert, (...) are shown as embodying aspects of global citizenship. Unauthorized immigrants themselves are shown to be enacting a form of global 'civil' disobedience, claiming the economic rights central to the emerging global normative charter while challenging the restrictive membership regimes that are the norm in the current global system. Em quatro passos, o texto que segue abaixo expande e examina a validade de um argumento que é frequentemente rascunhado em favor do naturalismo. Como veremos, contudo, a versão do naturalismo que esse argumento nos permite é um pouco diferente dos naturalismos filosóficos mais populares.

Could global government be the answer to global poverty and starvation? Cosmopolitan thinkers challenge the widely held belief that we owe more to our co-citizens than to those in other countries. This book offers a moral argument for world government, claiming that not only do we have strong obligations to people elsewhere, but that accountable integration among nation-states will help ensure that all persons can lead a decent life. Cabrera considers both the views of those political philosophers who say we (...) have much stronger obligations to help our co-citizens than foreigners and those cosmopolitans who say our duties are equally strong to each but resist restructuring. He then outlines his own position, using the European Union as a partial model for the integrated alternative and advocating instituting EU-style supranational government, development aid, and free movement of persons in the Americas and other regions. Over time, Cabrera argues that the transformation of the global system into a cohesive network of democratic institutions would help ensure that anyone born anywhere could lead a decent life. Contemporary studies in unconscious cognition are essentially founded on dissociation, i.e., on how it dissociates with respect to conscious mental processes and representations. This is claimed to be in so many and diverse ways that one is often lost in dissociation. In order to reduce this state of confusion we here carry out two major tasks: based on the central distinction between cognitive processes and representations, we identify and isolate the main dissociation paradigms; we then critically analyze their key tenets (...) and reported findings. Since Freud and his co-author Breuer spoke of dissociation in 1895, a scientific paradigm was painstakingly established in the field of unconscious cognition. This is the dissociation paradigm. However, recent critical analysis of the many and various reported dissociations reveals their blurred, or unveridical, character. Moreover, we remain ignorant with respect to the ways cognitive phenomena transition from consciousness to an unconscious mode. This hinders us from filling in the puzzle of the unified mind. We conclude that we have reached (...) a Kuhnian crisis in the field of unconscious cognition, and we predict that new models, incorporating partly the relevant findings of the dissociation paradigm—but also of dynamic psychology—, will soon be established. “Literature and the Right to Death” is probably the most quoted of French thinker Maurice Blanchot’s texts. For decades it has been discussed by such important figures as Emmanuel Levinas, Jacques Derrida, or even the writer Paul Auster. Its importance is twofold: on the one hand, it is often considered an important gateway to Blanchot’s literary thought. On the other hand, it constitutes a substantial example of the new reception of Hegel in France after the Second World War. Although there (...) is no doubt about its Kojèvo-Hegelian inspiration and its center in what we could call “literary experience”, this article intends to explore another of its layers: its relation to the discussion around humanism and the Terror, as forgotten as it was central in France at the end of the 1940’s. We will thus try to lay the foundations for a new reading of this fundamental piece in Blanchot’s production. (shrink)

Cosmopolitanism is said by many critics to be arrogant. In emphasizing universal principles and granting no fundamental moral significance to national or other group belonging, it wrongly treats those making non-universalist claims as not authorized to speak, while treating those in non-Western societies as not qualified. This book works to address such objections. It does so in part by engaging the work of B.R. Ambedkar, architect of India's 1950 Constitution and revered champion of the country's Dalits (formerly "untouchables"). Ambedkar cited (...) universal principles of equality and rights in confronting domestic exclusions and the "arrogance" of caste. He sought to advance forms of political humility, or the affirmation of equal standing within political institutions and openness to input and challenge within them. This book examines how an "institutional global citizenship" approach to cosmopolitanism could similarly advance political humility, in supporting the development of input and challenge mechanisms beyond the state. It employs a grounded normative theory method, taking insights for the model from field research among Dalit activists pressing for domestic reforms through the UN human rights regime, and from their critics in the Hindu nationalist Bharatiya Janata Party. Insights also are taken from Turkish protesters challenging a rising domestic authoritarianism, and from UK Independence Party members demanding "Brexit" from the European Union-in part because of possibilities that predominantly Muslim Turkey will join. Overall, it is shown, an appropriately configured institutional cosmopolitanism should orient fundamentally to political humility rather than arrogance, while holding significant potential for advancing global rights protections and more equitable rights specifications. We conducted a rapid review and quantitative summary of meta-analyses that have examined interventions which can be used by individuals during quarantine and social distancing to manage anxiety, depression, stress and subjective well-being. A literature search yielded 34 meta-analyses (total number of studies k = 1,390, n = 145,744) that were summarized. Overall, self-guided interventions showed small to medium effects in comparison to control groups. In particular, self-guided therapeutic approaches (including cognitive-behavioral, mindfulness, and acceptance-based interventions), selected positive psychology interventions, and (...) multi-component and activity-based interventions (music, physical exercise) showed promising evidence for effectiveness. Overall, self-guided interventions on average did not show the same degree of effectiveness as traditional guided individual or group therapies. There was no consistent evidence of dose effects, baseline differences and differential effectiveness of eHealth interventions. More research on the effectiveness of interventions in diverse cultural settings is needed. (shrink)

Foundational ontologies, central constructs in ontological investigations and engineering alike, are based on ontological categories. Firstly proposed by Aristotle as the very ur- elements from which the whole of reality can be derived, they are not easy to identify, let alone partition and/or hierarchize; in particular, the question of their number poses serious challenges. The late medieval philosopher Dietrich of Freiberg wrote around 1286 a tutorial that can help us today with this exceedingly difficult task. In this paper, I discuss (...) ontological categories and their importance for foundational ontologies from both the contemporary perspective and the original Aristotelian viewpoint, I provide the translation from the Latin into English of Dietrich's De origine II with an introductory elaboration, and I extract a foundational ontology–that is in fact a single-category one–from this text rooted in Dietrich's specification of types of subjecthood and his conception of intentionality as causal operation. Ontologies are some of the most central constructs in today's large plethora of knowledge technologies, namely in the context of the semantic web. As their coinage indicates, they are direct heirs to the ontological investigations in the long Western philosophical tradition, but it is not easy to make bridges between them. Contemporary ontological commitments often take causality as a central aspect for the ur-segregation of entities, especially in scientific upper ontologies; theories of causality and philosophical ontological investigations often go hand-in-hand, (...) and were essentially inseparable in medieval thought. This constitutes the foundation for a bridge, and this article analyzes the causality-based ontology of the late medieval philosopher Dietrich of Freiberg from the viewpoint of today's upper-ontology engineering. In this bridging attempt, it offers a translation into English of the first part of Dietrich's De origine (abbreviated title) that is a compromise between traditional scholarly translations of medieval Latin philosophical texts and contemporary ontology. The representational nature of human cognition and thought in general has been a source of controversies. This is particularly so in the context of studies of unconscious cognition, in which representations tend to be ontologically and structurally segregated with regard to their conscious status. However, it appears evolutionarily and developmentally unwarranted to posit such segregations, as,otherwise, artifact structures and ontologies must be concocted to explain them from the viewpoint of the human cognitive architecture. Here, from a by-and-large Classical cognitivist viewpoint, (...) I show why this segregation is wrong, and elaborate on the need to postulate an ontological and structural continuity between unconscious and conscious representations. Specifically, I hypothesize that this continuity is to be found in the symbolic-based interplay between the syntax and the semantics of thought, and I propose a model of human information processing characterized by the integration of syntactic and semantic representations. The van Wijngaarden grammars are two-level grammars that present many interesting properties. In the present article I elaborate on six of these properties, to wit, (i) their being constituted by two grammars, (ii) their ability to generate (possibly infinitely many) strict languages and their own metalanguage, (iii) their context-sensitivity, (iv) their high descriptive power, (v) their productivity, or the ability to generate an infinite number of production rules, and (vi) their equivalence with the unrestricted, or Type-0, Chomsky grammars.

The traditional model of human cognition (TMHC) postulates an ontological and/or structural gap between conscious and unconscious mental representations. By and large, it sees higher-level mental processes as commonly conceptual or symbolic in nature and therefore conscious, whereas unconscious, lower-level representations are conceived as non-conceptual or sub-symbolic. However, experimental evidence belies this model, suggesting that higher-level mental processes can be, and often are, carried out in a wholly unconscious way and/or without conceptual representations, and that these can be processed unconsciously. (...) This entails that the TMHC, as well as the theories on mental representation it motivates and that in turn support it, is wrong. (shrink)

Contra un presunto naturalismo de la filosofía de Nietzsche, este artículo reconstruye la noción nietzscheana de vida al hilo del tema de la interpretación. Se pretende mostrar que para este autor el problema de la vida excede todo marco estrictamente biologicista y se orienta en cambio hacia una dimensión ontológica, en tanto la interpretación representa la actividad configuradora de sentido, mediante la cual todo ser vivo genera y sostiene su realidad. El análisis de este proceso lleva a identificar varios niveles (...) de desarrollo de esta vida interpretante: la forma de vida meramente natural, la vida simbólica propia de los seres humanos y, en último término, la vida del conocimiento como forma de vida genuinamente filosófica. For millennia, knowledge has eluded a precise definition. The industrialization of knowledge (IoK) and the associated proliferation of the so-called knowledge communities in the last few decades caused this state of affairs to deteriorate, namely by creating a trio composed of data, knowledge, and information (DIK) that is not unlike the aporia of the trinity in philosophy. This calls for a general theory of knowledge (ToK) that can work as a foundation for a science of knowledge (SoK) and additionally distinguishes (...) knowledge from both data and information. In this paper, I attempt to sketch this generality via the establishing of both knowledge structures and knowledge systems that can then be adopted/adapted by the diverse communities for the respective knowledge technologies and practices. This is achieved by means of a formal–indeed, mathematical–approach to epistemological matters a.k.a. formal epistemology. Specifically, we use a robust and comprehensive model of individual work values to predict unethical decision-making in a sample of working professionals and accounting students enrolled in ethics courses, and IT employees working in sales and customer service. Study 1 demonstrates that young professionals who rate power as a relatively important value are more likely to violate professional conduct guidelines (...) despite receiving training regarding ethical professional principles. Study 2, which examines a group of employees from an IT firm, demonstrates that those rating power as an important value are more likely to engage in non-work-related computing even when they are aware of a monitoring software that tracks their computer usage and an explicit policy prohibiting the use of these computers for personal reasons. RESUMEN En este trabajo analizaremos las consideraciones sobre la neutralidad y la sexualidad del Dasein en sus articulaciones con la dispersión fáctica y la libertad en las elaboraciones de Heidegger entre 1927 y 1929.En este marco nos proponemos argumentar que tales consideraciones tienen como función poner de manifiesto el carácter primario de la estructura ontológica del Ser-con y el horizonte originario de la temporeidad, desde la cual circunscribe el empuje de las dinámicas respectivas. Para ello, en primer lugar analizaremos la (...) consideración de la neutralidad y la dispersión en Sein und Zeit en el marco de sus especificaciones respecto del Dasein cotidiano. Luego, distinguiremos las especificaciones y reelaboraciones en su curso de Marburg, respecto del estatuto ontológico que le confiere a la neutralidad en sus relaciones con la concreción fáctica y la libertad. Finalmente dedicaremos el último apartado al análisis e interpretación del sentido de la neutralidad y la dispersión que articula de modo diferencial en su curso de Freiburg. Junto a ello, buscamos aportar con la clarificación del lugar que ocupa las consideraciones de la corporalidad física en este período, en diálogo con interpretaciones relevantes de su obra. ABSTRACT In this work we will analyze the considerations about Dasein´s neutrality and sexuality in their articulations with the factual dispersion and freedom in Heidegger’s elaborations between 1927 and 1929. In this framework we propose to argue that such considerations have the function of highlighting the primary character of the ontological structure of Being-with and the original horizon of temporality, from which it circumscribes the thrust of the respective dynamics. To do this, we will first analyze the consideration of neutrality and dispersion in Sein und Zeit within the framework of its specifications regarding everyday Dasein. Then, we will distinguish the specifications and reworkings in his course from Marburg, regarding the ontological status that he confers on neutrality in its relations with factual concretion and freedom. Finally, we will dedicate the last section to the analysis and interpretation of the meaning of neutrality and dispersion that he articulates in a differential way in his Freiburg course. Next to it, we seek to contribute with the clarification of the place occupied by the considerations of physical corporeality in this period, in dialogue with relevant interpretations of his work. Given the evidence available today, we know that the later Middle Ages knew strong forms of idealism. However, Plato alone will not do to explain some of its features. Aristotle was the most important philosophical authority in the thirteenth and fourteenth centuries, but until now no one dared explore in his thought the roots of this idealism because of the dogma of realism surrounding him. I challenge this dogma, showing that the Stagirite contained in his thought the roots of idealist (...) aspects that will be developed, namely by Dietrich of Freiberg and Eckhart of Hochheim, into a fully idealist epistemology. This paper introduces an axiomatisation for equational hybrid logic based on previous axiomatizations and natural deduction systems for propositional and first-order hybrid logic. Its soundness and completeness is discussed. This work is part of a broader research project on the development a general proof calculus for hybrid logics.
