Ontologies represent the standard way to model the knowledge about specific domains. This holds also for the legal domain where several ontologies have been put forward to model specific kinds of legal knowledge. Both for standard users and for law scholars, it is often difficult to have an overall view on the existing alternatives, their main features and their interlinking with the other ontologies. To answer this need, in this paper, we address an analysis of the state-of-the-art in legal ontologies (...) and we characterise them along with some distinctive features. This paper aims to guide generic users and law experts in selecting the legal ontology that better fits their needs and in understanding its specificity so that proper extensions to the selected model could be investigated. As biological and biomedical research increasingly reference the environmental context of the biological entities under study, the need for formalisation and standardisation of environment descriptors is growing. The Environment Ontology (ENVO) is a community-led, open project which seeks to provide an ontology for specifying a wide range of environments relevant to multiple life science disciplines and, through an open participation model, to accommodate the terminological requirements of all those needing to annotate data using ontology classes. The concepts of molecular structure and molecular shape are ubiquitous in the chemical literature, where they are often taken as synonyms, with unavoidable drawbacks in chemistry teaching. A third concept, molecular topology, is less frequent but it is a reference term in molecular research domains such as Quantitative Structure–Activity Relationships. The present paper proposes an epistemological analysis of these three notions, aimed at clarifying the nature of their relationship, as well as the contiguities and differences between them. At first, we (...) discuss the various acceptations of the terms molecular structure and molecular shape. Then, we examine some crucial milestones in the history of these concepts and we analyse the relationship between structure, shape and topology from an epistemological viewpoint. We point out the distinguishing features of each concept and we show that their semantic openness, that may be fruitful in a specialized context, turns into a source of incoherence and inaccuracy in the teaching context, fostered by the misleading use of these terms made by textbooks. Eventually, we propose a criterion fit to discriminate between the conceptual domains of molecular shape, molecular structure and molecular topology. (shrink)

Using a large sample of retail investors as well as experimental data we find that risk and ambiguity aversion are positively correlated. We provide evidence that a common link is decision mode: intuitive thinkers tolerate more risk and ambiguity than effortful reasoners. One interpretation is that intuitive thinking confers an advantage in risky or ambiguous situations. We present supporting lab and field evidence that intuitive thinkers outperform others in uncertain environments. Finally, we find that risk and ambiguity aversion vary with (...) individual characteristics and wealth. The wealthy are less risk averse but more ambiguity averse, which has implications for financial puzzles. (shrink)

The Diagnostic and Statistical Manual of Mental Disorders (DSM) is universally acknowledged as the prominent reference textbook for the diagnosis and assessment of psychiatric diseases. However, since the publication of its first version in 1952, controversies have been raised concerning its reliability and validity and the need for other novel clinical tools has emerged. Folk-economic beliefs may be regarded as “evidential fictions” that exploit the natural tendency of human cognition to organize itself in narrative form. Narrative counter-arguments are likely more effective than logical debunking. The challenge is to convey sound economic reasoning in narratively conspicuous forms – an opportunity for economics to rethink its role and agency in public discourse, in the spirit of its old classics.

Hands are commonly held up as an exemplar of well-known, familiar objects. However, conceptual knowledge of the hand has been found to show highly stereotyped distortions. Specifically, people judge their knuckles as farther forward in the hand than they actually are. The cause of this distal bias remains unclear. In Experiment 1, we tested whether both visual and tactile information contribute to the distortion. Participants judged the location of their knuckles by pointing to the location on their palm directly opposite (...) each knuckle with: 1) a metal baton (using vision and touch) 2) a metal baton while blindfolded (using touch), 3) a laser pointer (using vision). In Experiment 2, we investigated whether judgments are influenced by visual landmarks such as the creases at the base of each finger on the palm. Participants localized their knuckles on either a photograph or a silhouette of their hand. In both experiments, clear distortions were found across conditions, of generally similar magnitude. These results show that distal bias is resistant to changes in the stimulus information and does not rely on any specific stimulus cue or single sensory modality, suggesting that such mislocalisations reflect a conceptual misrepresentation of hand structure. PurposeThe purpose of this study is to illustrate how the adoption of new enterprise resource planning systems affects sensemaking in the process of Organizational Identity integration after a Merger and Acquisition.Design/methodology/approachWithin a wider case study about an acquisition in chemical/pharmaceutical industry, the paper describes the effects of SAP adoption and implementation on the organizational identity. This methodology, based on semi‐structured interviews to project leaders and to team members, has allowed a deep comprehension of the context, even if results cannot provide (...) statistical evidence of relationships.FindingsUsing the Swanson and Ramiller's approach to innovation, the paper argues that ERP adoption and implementation support sensemaking process if innovation takes place with mindfulness and because, in that case, people interact on symbolic meanings sharing retrospective knowledge and cognitive causal maps. After an M&A there are conditions for a mindful innovation with IT and therefore innovating with IT can be an effective way to enforce sensemaking process and, as a consequence, to influence the Organizational Identity evolution. In a constructionist approach, the evolution of organizational identity requires a social negotiation among members where sensemaking has a primary role. So, the integration process following acquisitions can be facilitated by adopting, implementing and assimilating common IT solutions with mindfulness.Research limitations/implicationsThe first limitation of this study is referred to timing. The author entered into the company within a year after the acquisition and went out at the beginning of SAP assimilation phase. Therefore, some perceptions could still evolve in different ways. The second limitation depends on the fact that the author analyzed a single case. By focusing on one case of acquisition – an acquisition that gives value to acquired company – the author might be limiting the transferability of the findings.Practical implicationsThese results can be useful for both scholars and practitioners. Managers who face organizational change can consider the adoption and implementation of ERP as an opportunity to influence the evolution of Organizational Identity according to strategic priorities.Originality/valueThe value of this study is in its approach that links a strategic level with a social level. This link is realized not using the ERP as an artefact but using the process of its adoption and implementation. (shrink)

We introduce a reciprocity criterion for coalition formation among goal-directed agents, which we call the indecomposable do-ut-des property. It refines an older reciprocity property, called the do-ut-des or give-to-get property by considering the fact that agents prefer to form coalitions whose components cannot be formed independently. A formal description of this property is provided as well as an analysis of algorithms and their complexity. We provide an algorithm to decide whether a coalition has the desired property, and we show that (...) the problem to verify whether a single coalition satisfies the property is tractable. Moreover, we provide an algorithm to search all the sub-coalitions of a given coalition satisfying the new property. Even if this problem is not computationally tractable, we show that in several cases, also the complexity of this problem may decrease considerably. (shrink)

Le défi des antinomies joue un rôle décisif dans l'élaboration même de la pensée kantienne ; cela devient particulièrement significatif par rapport à l'Être absolument nécessaire, qui devrait dépasser le niveau des phénomènes même lorsque, comme l'on dit dans la thèse de la quatrième antinomie, l'on l'entend comme quelque chose du monde. Dans la structure même des antinomies nous sommes forcés à aller au-delà de l'expérience, à un Être qui dépasse radicalement le monde ; en ce sens, même à l'intérieur (...) de la pensée kantienne, l'analogie classique reste la structure spécifique de la métaphysique, surtout par la possibilité de dire la transcendance sans la réduire jamais au niveau des phénomènes. The challenge of the antinomies plays a decisive role in the development of Kantian thought. This becomes particularly significant with reference to the absolutely necessary Being, which should exceed the phenomenal domain even when, as Kant says in the fourth antinomy, it is considered as a part of the world. In the structure of the antinomies we are pushed beyond experience towards a Being which radically transcends the world; in this sense, even within Kantian thought, the classical analogy remains the specific structure of metaphysics, especially by virtue of the possibility of expressing transcendence without reducing it to the phenomenal level. Literature on ethical reasoning research indicates a positive relationship between higher levels of moral reasoning and ethical behaviour. This paper presents the findings of a (...) study of the moral reasoning/moral development of managers working in large manufacturing enterprises situated in the state of Punjab in India. Kohlberg's theory of Cognitive Moral Development forms the basis of the study. Moral Judgement Interview developed by Weber, on the basis of Kohlberg's theory was used for the study. Moral Reasoning Scores were calculated using Abbreviated Scoring Guide. More than half of the managers scored at post-conventional level of reasoning while assessing the moral dilemmas. Luigi Giussani, a high school religion teacher throughout the 1950s and 1960s, grounded his teachings in the vast body of experience to be found in Christianity's two-thousand-year history. He told his students, “I'm not here to make you adopt the ideas I will give you as your own, but to teach you a method for judging the things I will say.” Throughout his life, education was one of Giussani's primary intellectual interests. He believed that effective education required an adequate (...) background in the Christian tradition, presented within a lived experience that underscored the capacity of the faith to answer universal questions. What he proposed was a process that allowed one to sift through tradition, critically examining it and comparing it against the ultimate criteria for judgment: the desires of the heart. In Giussani's view, the primary concern was to “educate the human heart as God made it.” In The Risk of Education he states that fear leads students to associate this process of criticism with negativity or doubt. Yet, without an education in criticism, students cannot develop conviction. At a time when young people are abandoning the church and questioning the value of faith, Giussani's method of judging and verifying Christianity as an experience seems a necessary intervention. Simple assumptions represent a decisive reason to prefer one theory to another in everyday scientific praxis. But this praxis has little philosophical justification, since there exist many notions of simplicity, and those that can be defined precisely strongly depend on the language in which the theory is formulated. The language dependence is a natural feature—to some extent—but it is also believed to be a fatal problem, because, according to a common general argument, the simplicity of a theory is always trivial (...) in a suitably chosen language. But, this trivialization argument is typically either applied to toy-models of scientific theories or applied with little regard for the empirical content of the theory. This paper shows that the trivialization argument fails, when one considers realistic theories and requires their empirical content to be preserved . In fact, the concepts that enable a very simple formulation, are not necessarily measurable, in general. Moreover, the inspection of a theory describing a chaotic billiard shows that precisely those concepts that naturally make the theory extremely simple are provably not measurable. This suggests that—whenever a theory possesses sufficiently complex consequences—the constraint of measurability prevents too simple formulations in any language. This explains why the scientists often regard their assessments of simplicity as largely unambiguous. In order to reveal a cultural bias in the scientists’ assessment, one should explicitly identify different characterizations of simplicity of the assumptions that lead to different theory selections. General arguments are not sufficient. (shrink)
