Background Although it is the moral duty of physicians to protect vulnerable patients, there are no data on how vulnerability is perceived in clinical practice. This study explores how physicians classify someone as “vulnerable”. Method Thirty-three physicians were initially questioned about resource allocation problems in their work. The results of these interviews were examined with qualitative study software to identify characteristics associated with vulnerability in patients. Data were conceptualized, classified and cross-linked to highlight the major determinants of vulnerability. The findings (...) revealed the principal factors that make patients vulnerable in clinical practice, according to our definition of vulnerability: the likelihood of having one’s interests unjustly considered. Results Vulnerability can arise as a result of a mismatch between the characteristics of patients and physicians, the healthcare system, the treatment, or the communication between physicians and patients. Vulnerability appears as a gap between a patient’s needs and the means intended to meet them. Vulnerability can further be the result of doing too little or too much for patients. This result suggests that structures provided by healthcare systems are not as differentiated as they should be to cover all situations. Our initial definition of vulnerability was illustrated and supported by our results, showing that it encompasses all factors involved, not solely personal characteristics, indicating the need for a more pragmatic approach for use in clinical practice. Conclusion Vulnerability is not due to a single factor but appears under certain circumstances when there is a discrepancy between a patient’s interests and the care provided, despite existing compensation systems. The challenge that confronts corporate decision-makers in connection with global labor conditions is often in identifying the standardsby which they should govern themselves. In an effort to provide greater direction in the face of possible global cultural conflicts, ethicistsThomas Donaldson and Thomas Dunfee draw on social contract theory to develop a method for identifying basic human rights: Integrated Social Contract Theory (ISCT). In this paper, we apply ISCT to the challenge of global labor standards, attempting to identify labor rights that (...) could serve as guides for corporations producing or outsourcing outside of their home country. In addition to identifying areas of universal agreement, we also examine whether ISCT is, in fact, a sufficient basis for determining worker rights; we seek to define the parameters of the “sweatshop” problem; we include the application and results of our ISCT analysis as applied to labor standards: the global labor rights hypernorms; and conclude that ISCT is sufficient only for rights that are universal. We also discuss whether market-driven decisions can identify the boundaries of labor rights, or at least assure that market outcomes are compatible with maintaining labor rights, in order to respond to the shortcomings of ISCT. Lack of specificity around stakeholder identity remains a serious obstacle to the further development of stakeholder theory andits adoption in actual practice by business managers. Nowhere is this shortcoming more evident than in stakeholder theory’s treatment of the constituency known as “community.”In this paper we attempt to set forth what we call “the Problem of Community” as indicative of the definitional problems of stakeholdertheory. We then begin the process of gaining greater specificity around our notions of community and the role (...) of community in stakeholder theory and management. In doing so, we identify the emergence of two fairly new forms of community that we believe are particularly relevant to the stakeholder theorist and practicing manager. These two new variants of community—the virtual advocacy group and the community of practice—extend the notion of community in new directions, which have strikingly different implications for stakeholder theory and practice. The discovery of conjunctive causes--factors that act in concert to produce or prevent an effect--has been explained by purely covariational theories. Such theories assume that concomitant variations in observable events directly license causal inferences, without postulating the existence of unobservable causal relations. This article discusses problems with these theories, proposes a causal-power theory that overcomes the problems, and reports empirical evidence favoring the new theory. Unlike earlier models, the new theory derives (a) the conditions under which covariation implies conjunctive causation (...) and (b) functions relating observable events to unobservable conjunctive causal strength. This psychological theory, which concerns simple cases involving 2 binary candidate causes and a binary effect, raises questions about normative statistics for testing causal hypotheses regarding categorical data resulting from discrete variables. Which standards should we employ to evaluate the global order? Should they be standards of justice or standards of legitimacy? In this article, I argue that liberal political theorists need not face this dilemma, because liberal justice and legitimacy are not distinct values. Rather, they indicate what the same value, i.e. equal respect for persons, demands of institutions under different sets of circumstances. I suggest that under real-world circumstances – characterized by conflicts and disagreements – equal respect demands basic-rights protection (...) and democratic participation, which I here call ‘political justice’. I conclude the article by considering three possible configurations of the global order – the ‘democratic world-state’, ‘independent democratic states’, and ‘mixed’ models – and argue that a commitment to political justice speaks in favour of the latter. Taking Arthur Fine’s The Shaky Game as my inspiration, and the recent 25th anniversary of the publication of that work as the occasion to exercise that inspiration, I sketch an alternative to the “Naturalism” prevalent among philosophers of physics. Naturalism is a methodology eventuating in a metaphysics. The methodology is to seek the deep framework assumptions that make the best sense of science; the metaphysics is furnished by those assumptions and supported by their own support of science. The alternative presented (...) here, which I call “Locavoracity,” shares Naturalism’s commitment to making sense of science, but alters Naturalism’s methodology. The Locavore’s sense-making projects are piecemeal, rather than sweeping. The Locavore’s hypothesis is that the collection of local sense-making projects fails to issue a single overarching unifying framework deserving of the title “the metaphysics that makes the best sense of science.” I muster some examples supporting the Locavore hypothesis from the interpretation of quantum field theories. This article provides an overview of recent results on lexicographic, linear, and Bayesian models for paired comparison from a cognitive psychology perspective. Within each class, we distinguish subclasses according to the computational complexity required for parameter setting. We identify the optimal model in each class, where optimality is defined with respect to performance when fitting known data. Although not optimal when fitting data, simple models can be astonishingly accurate when generalizing to new data. A simple heuristic belonging to the class (...) of lexicographic models is Take The Best (Gigerenzer & Goldstein (1996) Psychol. Rev. 102: 684). It is more robust than other lexicographic strategies which use complex procedures to establish a cue hierarchy. In fact, it is robust due to its simplicity, not despite it. Similarly, Take The Best looks up only a fraction of the information that linear and Bayesian models require; yet it achieves performance comparable to that of models which integrate information. Due to its simplicity, frugality, and accuracy, Take The Best is a plausible candidate for a psychological model in the tradition of bounded rationality. We review empirical evidence showing the descriptive validity of fast and frugal heuristics. (shrink)

In this article, I argue that if we challenge some tacit assumptions of narrow rationality that endure in much of entrepreneurial studies, we can elevate entrepreneurial ethics beyond mere external constraints on rational action, and move toward fuller integration of ethics as an intrinsic part of the process of value creation itself. To this end, I propose the concept of practical wisdom as a framework for exploring entrepreneurial decision making and action that can broaden the scope of our research to (...) recognize entrepreneurship as an inherendy normative enterprise. Specifically, I suggest that a framework built upon a concept of practical wisdom enables us to adopt a richer and more complex view of entrepreneurial decision making that is well suited to the dynamic and uncertain context of entrepreneurship. Further, this framework enriches our view of entrepreneurial ethics to include consideration of the personal character, values, and purpose of the entrepreneur. By examining entrepreneurship through a lens of practical wisdom, we can open up new avenues of fruitful inquiry for scholars of entrepreneurship. (shrink)

How does violence shape citizens’ preferences for conflict termination? The existing literature has argued that violence either begets sympathy for more violence or drives support for making peace. Focusing on the 2016 Colombian Peace Agreement, this article finds that victimhood dissociation strongly shapes these preferences. With victimhood dissociation, a discrepancy exists between objective and subjective victimization, and the effect of violence on peace attitudes depends on citizens’ subjective interpretations of their personal experiences of violence. Citizens who do not experience violence (...) often see themselves as victims of the conflict and vice versa. Victimhood dissociation is linked to cultural stereotypes of victimhood as portrayed in elite narratives concerning the conflict. In Colombia, political leaders framed victimhood around rurality, business entrepreneurship, kidnapping, extortion, and disappearance. In 2016, this widespread narrative was instrumental for politicians opposing the peace agreement. Citizens who disassociated their personal experiences of violence from their self-understanding as victims were instrumental to the failure of the peace plebiscite. (shrink)

Proponents of children's liberation (CL) argue that there are no morally relevant differences between children and adults. Consequently, special protective laws that limit children's freedom are unjustified, and should be abolished. Protectionists reject the premise of this argument, and hence also the conclusion. Proponents of CL mostly fix upon the capacity for instrumental reasoning as the criterion that should separate autonomous from non-autonomous individuals. I argue that most children are substantially worse at instrumental reasoning than most adults, and although drawing (...) a line between the two categories has an arbitrary element, outstanding exceptions on both sides can be justly accommodated. Furthermore, the capacity for instrumental reasoning is a necessary but not sufficient basis for equal rights. A morally decent society is more demanding of individuals than the skeptical or libertarian one that most plausibly grounds CL. To construct and live in such a society requires both prudence and morality. But there is evidence that children need protection and limits to develop these traits. So there are morally relevant differences between children and adults after all, and the argument from justice fails. The utilitarian arm of the argument also fails: because of these morally relevant differences, CL would have worse consequences than those envisioned by its supporters. Parents would lose important authority, and there would be more homeless children. Consequently, the gap between advantaged and disadvantaged persons would become larger and more irreversible. A growing number of multi-stakeholder initiatives seek to improve labor and environmental standards through third-party certification. Fairtrade, one of the most popular third-party certifications in the agro-food sector, is currently expanding its operations from its traditional base in commodities like coffee produced by peasant cooperatives to products like flowers produced by hired labor enterprises. My analysis reveals how Fairtrade’s engagement in the hired labor sector is shaped by the tensions between traditional market and industrial conventions, rooted in price competition, bureaucratic (...) efficiency, product standardization and certification and alternative domestic and civic conventions, rooted in trust, personal ties, and concerns for societal wide benefits. At the global level, these tensions shape Fairtrade’s global standard setting as reflected in Fairtrade’s recently revised labor standards. At the local level, these tensions shape the varied impacts of certification on the ground as revealed through a case study of certified flower production in Ecuador. (shrink)

Starting from the standard quantum formalism for a single spin 1/2 system (e.g., an electron), this essay develops a model rich enough not only to afford an explication of symmetry breaking but also to frame questions about how to circumscribe physical possibility on behalf of theories that countenance symmetry breaking.

Much contemporary political philosophy claims to be Kant-inspired, but its aims and method differ from Kant's own. In his recent book, Force and Freedom, Arthur Ripstein advocates a more orthodox Kantian outlook, presenting it as superior to dominant (Kant-inspired) views. The most striking feature of this outlook is its attempt to ground the whole of political morality in one right: the right to freedom, understood as the right to be independent of others’ choices. Is Ripstein's Kantian project successful? In this (...) research note I argue that it is not. First, I suggest that Ripstein's notion of freedom is viciously circular. It is meant to ground all rights, but in fact it presupposes an account of those rights. Second, I show that—independently of its inability to ground a whole political morality—such a moralized understanding of freedom is normatively unappealing. (shrink)

Language and thought share a unitary cognitive activity, addressed by an interpretative function. This interpretative effort reveals the assonance between the attribution of meaning to an utterance and the discovery of a solution via restructuring in insight problem solving. We suggest a view of complex integrated analytical thinking, which assumes that thinking processes information in different ways, depending on the characteristics of the tasks the subject has to solve, so that reasoning results in a stepwise, rule-based process or in a (...) widespread activity of search where implicit parallel processes are also involved. We investigated the interrelationship between language and thought in insight problem solving, in both its positive (Experiments 1 and 3) and its negative effects (Experiment 2). Our results are discussed in the light of the debate on dual processing theories. (shrink)

This article provides a conceptual framework for studying the influence of mood on managerial ethical decision making. We draw on mood-congruency theory and the affect infusion model to propose that mood influences managerial ethical decision making through deliberate and conscious assessments of the moral intensity of an ethical issue. By accounting for proscriptive and prescriptive morality—i.e., harmful and prosocial behavior, respectively—we demonstrate that positive and negative mood may have asymmetrical and paradoxical effects on ethical decision making. Specifically, our analysis suggests (...) that individuals in a positive mood will be more likely to engage in prosocial behavior but less likely to refrain from activities that have harmful consequences for others, whereas individuals in a negative mood will be more likely to avoid activities that put others at risk or harm but at the same time less prone to engaging in activities that have positive consequences for others. Importantly, we account for the context within which managers make their decisions by examining how situational strength may moderate the influence of mood on managerial ethical decision making. Finally, we discuss how organizations can leverage the double-edged sword effect of mood on ethical decision making and prevent, control and manage the risk of unethical decision making on the part of managers. Conventional truth describes things as delivered by ordinary experience; ultimate truth captures the way that things are independent of our interests, practices, and cognitive faculties. It is notoriously difficult to provide an adequate analysis of either conventional or ultimate truth, however. This chapter develops a previous scholarly suggestion to understand conventional truth in Madhyamaka as deflationary truth. It points out that this suggestion is a good one only if a supplementary theory of meaning, which the deflationary theory of truth presupposes, (...) can be given in a way that is consistent with both the limitations of the deflationary theory of truth and with Madhyamaka antirealist metaphysics. It then offers a presentation of Dharmakīrti’s theory of apoha in order to argue that the resources necessary to give the required account of meaning can be found in Dharmakīrti’s account of intentional mental content. New pharmacological therapies, often dubbed `lifestyle drugs', demonstrate the enactment of yet another interface between technologies and bodies that promises a re-fashioning of the body with transformative, life-enhancing results. This article analyzes the emergence of one lifestyle drug, Viagra, from a technoscience studies perspective, conceptualizing Viagra as a new medical technology of the body. Through an analysis of promotional materials for Viagra, we argue that this pharmaceutical device performs ideological work through its discursive scripts that serves to reinforce and augment (...) dominant cultural narratives in relation to material bodies, particularly those of hegemonic masculinity and male (and female) sexuality. We conclude that Viagra carries the potential to reify and reinforce these dominant and hegemonic narratives, while at the same time, through ensuring an open market for heterogeneous users, it provides spaces for alternatives to these normative ideals and assumptions. New and proposed medical technologies continually challenge our vision of what constitutes appropriate medical treatment. As scholars and consumers grapple with the meaning of innovation, one common critical theme to surface is that it constitutes undesirable medicalization. But we are embodied creatures who can often benefit from medical knowledge; in addition, rejection of medicalization may be in some cases based on an untenable appeal to nature. Drawing on the built environment concept of “inclusive design” and its emphasis on creating accessible environments for all persons regardless of ability, I suggest that a central task for feminist disability theory is to redesign foundational philosophical concepts to present opportunities rather than barriers to inclusion for people with disability. Accounts of autonomy within liberal philosophy stress self-determination and the dignity of all individual persons, but have excluded people with intellectual disability from moral and political theories by denying their capacity (...) for individual autonomy, seen as a chief marker of moral personhood. This paper modifies and extends feminist theories of relational autonomy by arguing for the need to view autonomy as a feature of persons that is manifested only through relations of support, advocacy, and enablement. An “inclusively designed,” relational account negotiates the tensions encountered in attempts to apply autonomy to people with high support needs, and politicizes the concept as an advocacy tool for people with intellectual disability and their allies. Recent revisions in child support and paternity establishment legislation enacted under the 1996 welfare reform act, the Personal Responsibility and Work Opportunity Reconciliation Act, significantly alter the American welfare state's relationship to men's fathering. Through a critical review of prior research and social service literature, the authors argue that PRWORA actively constructs fatherhood not only through state policies that maintain males as “breadwinners” but also through state-sponsored social service programs that seek to influence men's identities as fathers. It is common to believe that some of our concerns are deeper concerns of ours than are others and that some of our attitudes are central rather than peripheral to our psychological identity. What is the best approach to characterizing depth or centrality to the self? This paper addresses the matter of the depth and authenticity of attitudes and the relation of this matter to the autonomy of action. It defends a conception of the real self in terms of preferences (...) and convictions that cohere in a particular structural sense. It thereby gives content to the notion of wholeheartedness to which various action theorists make appeal. Health policymakers employ utility measures to inform resource allocation decisions. They often rely on a conceptual tool called the quality-adjusted life year that discounts the value of years lived in a state of disability relative to years lived in full health. A representative sample of the general public is asked to place values on hypothetical health states as part of a standard gamble or time trade-off task. Policymakers use the resulting values to calculate the number of QALYs gained through particular (...) interventions. Significant amounts of wealth have been exchanged as part of marriage settlements throughout history. Although various models have been proposed for interpreting these practices, their development over time has not been investigated systematically. In this paper we use a Bayesian MCMC phylogenetic comparative approach to reconstruct the evolution of two forms of wealth transfers at marriage, dowry and bridewealth, for 51 Indo-European cultural groups. Results indicate that dowry is more likely to have been the ancestral practice, and that a minimum (...) of four changes to bridewealth is necessary to explain the observed distribution of the two states across the cultural groups. An “intrinsically mixed” state is a mixed state of a system that is ‘orthogonal’ to every pure state of that system. Although the presence of such states in the quantum theories of infinite systems is well known to those who work with such theories, intrinsically mixed states are virtually unheralded in the philosophical literature. Rob Clifton was thoroughly familiar with intrinsically mixed states. I aim here to introduce them to a wider audience—and to encourage that audience to cultivate their acquaintance (...) by suggesting that intrinsically mixed states undermine assumptions framing standard discussions of the quantum measurement problem. For the last eighteen months, I have worked with a group of disability and health policy researchers. I began this interview-based project trying to learn how these researchers’ disability identities shaped their work. How did their disability standpoint contribute to the liberatory nature of their research? I found that the disability standpoint of these researchers was in fact hard-won and grew not just out of their own disability experiences but out of their connections with the larger disability community. These connections, (...) for the most part, helped researchers come to “claim crip,” and that later influenced their research. (shrink)

For many young Americans, access to credit has become critical to completing a college education and embarking on a successful career path. Young people increasingly face the trade-off of taking on debt to complete college or foregoing college and taking their chances in the labor market without a college degree. These trade-offs are gendered by differences in college preparation and support and by the different labor market opportunities women and men face that affect the value of a college degree and (...) future difficulties they may face in repaying college debt. We examine these new realities by studying gender differences in the role of debt in the pivotal event of graduating from college using the 1997 cohort of the National Longitudinal Survey of Youth. In this article, we find that women and men both experience slowing and even diminishing probabilities of graduating when carrying high levels of debt, but that men drop out at lower levels of debt than do women. We conclude by theorizing that high levels of debt are one of the mechanisms that sort women and men into different positions in the social stratification system. (shrink)

Van Fraassen's 1991 modal interpretation of Quantum Mechanics offers accounts of measurement and state preparation. I argue that both accounts overlook a class of interactions I call General Unitary Measurements, or GUMs. Ironically, GUMs are significant for van Fraassen's account of measurement because they challenge it, and significant for his account of preparation because they simplify it. Van Fraassen's oversight prompts a question about modal interpretations: developed to account for ideal measurement outcomes, can they consistently account as well for the (...) whole horizon of laboratory practices by which we investigate QM? This is the first of a two-part introduction to some interpretive questions that arise in connection with quantum field theories (QFTs). Some of these questions are continuous with those familiar from the discussion of ordinary non-relativistic quantum mechanics (QM). For example, questions about locality can be rigorously posed and fruitfully pursued within the framework of QFT. A stark disanalogy between QFTs and ordinary QM – the former, but not the latter, typically admit infinitely many putatively physically inequivalent realizations – prompts (...) relatively novel questions, questions about how to understand and adjudicate different strategies for equipping quantum theories with content. Part I sketches the fate of locality and related notions in QFT, then documents the non-uniqueness unprecedented in ordinary QM but rampant in QFT. Todo Estado de Derecho moderno tiene su fundamento en ciertos principios que rigen la manera en cómo se ejerce el Poder Público, y es el modo en que efectivamente se aplican, lo que ciertamente determinará la naturaleza y característica de dicho Estado. En el caso venezolano, tales principios se encuentran expresamente plasmados en nuestra Carta Magna y son: El principio de competencia administrativa, el principio de legalidad, el principio de separación y colaboración entre los poderes y el principio de responsabilidad (...) del Estado y sus funcionarios. La intención es definir y desarrollar brevemente estos principios, a fin de poder establecer las características del Estado Venezolano, desde el punto de vista Constitucional (positivo) y desde el punto de vista real. Mathematics and aesthetics are closely intertwined. Not only mathematical concepts, relationships and theorems can be aesthetically pleasing, but we also often find harmony between their results and the patterns of the world around us, and we like that. Yet, apart from rare exceptions, the beauty of mathematics, particularly in education, is mostly unrecognized: this science rarely meets the favour of students. Vedic mathematics is an approach which encapsulates the enjoyment and power of this knowledge, not only in the sphere of (...) thought process, but also in its practical utility. It highlights and develops the aesthetic dimension of learning in a very immediate sense. The aim of this article is to introduce the method – what it is and how it works – to give comparative examples of techniques and their efficacy, and to emphasize the aesthetic value it conveys.
