A recent judgment by a lower court in Germany brought the problem of ritual male circumcision to the consciousness of the wider public and legal academia. This essay weighs in on this emerging discussion and argues that ritual male circumcision is not covered by parental authority. It first considers and dismisses the best interest of the child test, which is the most widely used test of parental authority in legal practice. Instead, the essay proposes what it terms the autonomy conception (...) of parental authority, according to which parental authority must be exercised such as to ensure that the child will become an autonomous adult. While parents may raise their child in line with their ethical, including religious, convictions, respect for his autonomy requires that this be done in a way that allows the child to later distance himself from these values; this implies, among other things, that irreversible physical changes are impermissible. This book is intended as a comprehensive defense of psycho-physical dualism. It gives answers to the question of what dualism may consist in, and inquires into the broadly cultural motivation behind accepting dualism or its opponent physicalism. Arguments for dualism, among them strengthened versions of the famous classical arguments, are presented and defended against objections. Moreover, the various general objections to dualism are criticized in detail, for example, the allegation that dualism is of an anti-scientific nature. The book issues into (...) developing the outlines of a dualistic theory of consciousness and agency. The theory outlined is not only compatible with science but actually connects with it. In the jurisprudence of constitutional courts around the world, there is an emerging trend towards an autonomy-based understanding of constitutional rights: increasingly, rights are interpreted as being about enabling people to live autonomous lives, rather than disabling the state in certain ways. This article investigates the conception of autonomy employed by courts by presenting two candidates and examining which of them explains the current practice of constitutional rights law better. The first, labelled the excluded reasons conception of autonomy, claims that (...) a person’s autonomy is violated if he is treated on the basis of certain impermissible—in particular, moralistic or paternalistic—reasons. It is concluded that, while this is a coherent understanding of autonomy, it cannot explain many of the rights that are widely accepted today. The second, the protected interests conception, argues that a person has autonomy interests in controlling certain domains of her life, and offers a scale on which the importance of the various autonomy interests can be assessed. The article demonstrates that this conception is coherent and adequately explains the current practice. The final section briefly explores some implications of this result for a comprehensive reconstructive theory of constitutional rights. (shrink)

This volume constitutes the Proceedings of a workshop on formal seman tics of natural languages which was held in Tiibingen from the 1st to the 3rd of December 1977. Its main body consists of revised versions of most of the papers presented on that occasion. Three supplementary papers are included because they seem to be of particular interest in their respective fields. The area covered by the work of scholars engaged in philosophical logic and the formal analysis of natural languages (...) testifies to the live liness in those disciplines. It would have been impossible to aim at a complete documentation of relevant research within the limits imposed by a short conference whereas concentration on a single topic would have conveyed the false impression of uniformity foreign to a young and active field. It is hoped that the essays collected in this volume strike a reasonable balance between the two extremes. The topics discussed here certainly belong to the most important ones enjoying the attention of linguists and philosophers alike: the analysis of tense in formal and natural languages, the quickly expanding domain of generalized quantifiers, the problem of vagueness, the connected areas of pronominal reference and presupposition and, last but not least, modal logic as a sort of all-embracing theoretical framework. The workshop which led to this collection formed part of the activities celebrating the 500th anniversary of Tiibingen University. (shrink)

The essay responds to a challenge posed by Vanessa MacDonnell and examines the question of stability and change under the global model of constitutional rights. Constitutionalism offers the promise of both stability and justice, but it may seem that there will often be a tension between these values. While some have accused the global model, and in particular proportionality, of overemphasizing justice at the cost of stability, MacDonnell claims that it underemphasizes the necessity of social change. In this response, I (...) argue that in the long run the push for social change and towards justice can be realized only when there is also a certain stability, namely the stubborn democratic insistence that any state action must be reasonably justifiable to those affected by it in terms of their freedom and equality. This conviction lies at the core and will be reinforced by the endorsement of the global model of constitutional rights. (shrink)

This article considers the Pauline construction of a “spiritual body” in 1 Corinthians 15 and his flesh/spirit dualism more generally in light of Paul’s probable disability. I suggest that this rhetoric functioned as a strategy for Paul to claim social power in his social context by deemphasizing his physical presence, and thus reflects a negotiation with cultural patterns of disability abjection rather than a meaningful part of Christian teaching. Because of the active harm done by these dualistic constructions, however unintentional (...) such an interpretation may have been on Paul’s part, liberative Christian theologies must reject this framing and work to integrate not just “body” and spirit but also flesh and its more negative bodily associations such as weakness, pain, illness, and death. In this paper, we show that reproducibility is a severe problem that concerns simulation models. The reproducibility problem challenges the concept of numerical solution and hence the conception of what a simulation actually does. We provide an expanded picture of simulation that makes visible those steps of simulation modeling that are numerically relevant, but often escape notice in accounts of simulation. Examining these steps and analyzing a number of pertinent examples, we argue that numerical solutions are importantly different from usual (...) mathematical solutions. They are do not merely approximate the latter, but introduce new problems, including issues of artificiality, stability, and well-posedness. Consequently, simulation modelling can attain reproducibility only to a certain degree because it is working with numerical solutions. (shrink)

In the early 1960s, American philosopher of science Thomas Kuhn contributed to a “crisis of rationality” with his hypothesis that science develops by means of paradigm shifts. He challenged the positivist concept of cumulative and continuous scientific progress. According to Kuhn, the relation between two succeeding scientific traditions ‘separated by a scientific revolution’ is characterized by conceptual incommensurability that constrains the interpretation of science as a cumulative, steadily progressing enterprise. Thomas Kuhn’s philosophy was heavily criticized by German-American biologist Ernst Mayr (...) as unapplicable to the history of biology. Mayr, one of the most outstanding evolutionary biologists of the 20th century and a “co-architect” of the so-called Modern Synthesis (contemporary Darwinism), published extensively on the history and philosophy of biology as he thought that theoretical biology cannot progress without proper philosophy of science. Being convinced of the progressive development of Darwinism, Mayr pointed out that Kuhn’s concept of scientific revolutions does not reflect conceptual changes in evolutionary biology. Here we summarize Mayr’s critiques of Kuhn and, based on our own research, take Mayr’s side in the controversy between two great thinkers. (shrink)

The paper provides new perspectives for a dualistic conception of mental causation by putting causation that originates in a nonphysical self into an evolutionary perspective. Nonphysical causation of this type - free agency -, together with nonphysical consciousness, is regarded as being not only compatible with physics, but also as having a natural place in nature. It is described how free agency can work, on the basis of the brain, and how it can be compatible with the result of the (...) Libet-experiment. The necessary condition for the existence of free agency is that the physical macro-world is indeterministic to a degree that is relevant for living beings, that is, for their survival and well-being. From an evolutionary point of view, and on the basis of the facts of consciousness, it is more likely than not that this condition is in fact fulfilled. (shrink)

In the first part, the paper describes in detail the classical conception of intentionality which was expounded in its most sophisticated form by Edmund Husserl. This conception is today largely eclipsed in the philosophy of mind by the functionalist and by the representationalist account of intentionality, the former adopted by Daniel Dennett and David Chalmers, the latter by John Searle and Fred Dretske. The very considerable differences between the classical and the modern conceptions are pointed out, and it is argued (...) that the classical conception is more satisfactory than the two modern ones, not only regarding phenomenal adequacy, but also on the grounds of epistemological considerations. In the second part, the paper argues that classical intentionality is not naturalizable, that is, physicalizable. Since classical intentionality exists (in the experiences that display it), the non-naturalizability of classical intentionality implies psychophysical dualism. (shrink)

This chapter offers a version of Cartesian dualism that draws on the resources of a Husserlian account of intentionality. For example, it argues that 'I can locate myself at the point in space from which I am looking at the world (my 'center of perspective')'. It relies on empirical phenomenology to show that this location that does not correspond to my body or any part of it. Phantom sensations provide confirming evidence. Next, the chapter uses the example of blurred (versus (...) sharp) vision to provide evidence of qualitative properties that cannot be instantiated within the physical world. Finally, it argues that the self's endurance through calls for explanation in terms of patterns of psychophysical causation or interaction. (shrink)

Is there is a moral obligation to militarily intervene in another state to stop a genocide from happening (if this can be done with proportionate force)? My answer is that under exceptional circumstances a state or even a non-state actor might have a duty to stop a genocide (for example if these actors have promised to do so), but under most circumstances there is no such obligation. To wit, “humanity,” states, collectives, and individuals do not have an obligation to make (...) such promises in the first place or to create institutions that would impose a legal obligation of intervention upon them. Nor do states or persons or humanity “collectively” have – originally, without specifically creating such duties by contracts or promises – any pro tanto or special duties to save strangers at considerable cost to themselves or their own citizens (including their soldiers). That is, these costs do not merely override a duty to intervene, but rather there is no such duty to begin with – as shown by the fact that in such cases of non-intervention agents would not owe those they let die any compensation: if I do not save someone’s life because saving him would have cost me my arm or would have come with a high risk of losing my own life or would have forced me to kill innocent bystanders, I do not owe this person compensation. Thus the point of this chapter is that there is no “natural” or “general” or “original” duty to militarily intervene (or to create a legal obligation) to stop a genocide. I will consider and refute a number of arguments to the contrary, for example by Lango, Tan, and Pattison. (shrink)

Der Kausalbegriff gehört zu den, gerade in der Gegenwart, am häufigsten in Anspruch genommenen philosophischen Begriffen. In Erkenntnistheorie, Wissenschaftstheorie, der Philosophie des Geistes, in der Handlungstheorie und der Sprachphilosophie taucht er immer wieder in zentraler Funktion auf. Für die Philosophie ist die Deutung des Kausalbegriffs daher von größter Bedeutung. Das vorliegende Buch ist ein Leitfaden zum Kausalbegriff. In seinem ersten Teil wird eine detaillierte Explikation dieses Begriffs geboten, die auf eine neuartige Fassung der nomologischen Regularitätstheorie und die Formulierung einer Logik (...) der Kausalität hinausläuft. Im zweiten Teil wird diese Explikation in einer umfassenden kritischen Auseinandersetzung mit der Literatur zu den verschiedenen Themen, die sich mit dem Kausalbegriff verbinden, weiter begründet und verteidigt. I argue (1) that it is not philosophically significant whether causation is linguistically represented by a predicate or by a sentence connective; (2) that there is no philosophically significant distinction between event- and states-of-affairs-causation; (3) that there is indeed a philosophically significant distinction between agent- and event-causation, and that event-causation must be regarded as an analog of agent-causation. Developing this point, I argue that event-causation's being in the image of agent-causation requires, mainly, (a) that the cause is temporally prior to (...) the effect, (b) that the cause necessitates (is sufficient with necessity) for the effect. Causal necessity is explained as a derivative of nomological necessity, and finally, via a definition of the causal sentence connective, the logic of event-causation is shown to be a part of temporal modal logic. This book presents a comprehensive, non-model-theoretic theory of ontic necessity and possibility within a formal (and formalised) ontology consisting of states of affairs, properties, and individuals.

What one is ultimately interested in with regard to ‘just cause’ is whether a specific war, actual or potential, is justified. I call this ‘the applied question’. Answering this question requires knowing the empirical facts on the ground. However, an answer to the applied question regarding a specific war requires a prior answer to some more general questions, both descriptive and normative. These questions are: What kind of thing is a ‘just cause’ for war (an aim, an injury or wrong (...) suffered, or something different altogether)? I call this ‘the formal question’. Then there is what I call the ‘the general substantive question’. Depending on the previous answer to the formal question, the general substantive question can be formulated as: ‘Which causes are just?’ or as ‘Under what conditions is there a just cause?’ A final question, which has recently elicited increased interest, is what I call ‘the question of timing’: does the ‘just cause’ criterion only apply to the initiation of a war or also to the continuation of a war, that is, can a war that had a just cause at the beginning lose it at some point in its course (and vice versa)? I argue that a just cause is a state of affairs. Moreover, the criterion of just cause is not independent of proportionality and other valid jus ad bellum criteria. One cannot know whether there is a just cause without knowing whether the other (valid) criteria (apart from ‘right intention’) are satisfied; and this account has certain theoretical and practical advantages. As regards the general substantive question, I argue that all kinds of aims can, in principle, be legitimately pursued by means of war, even aims that might sound dubious at first, like vengeance or the search for glory. Thus, the pursuit of such aims does not make the war disproportionate or deprive it of just cause. As regards the question of timing, I argue that the criteria of jus ad bellum apply throughout the war, not only at the point of its initiation. While starting a war at t1 might be justified, continuing it at time t2 might be unjustified (and vice versa), and this insight does not require an addition to jus ad bellum but is already contained in it. With the emergence of modern physics a conflict became apparent between the Principle of Sufficient Cause and the Principle of Physical Causal Closure. Though these principles are not logically incompatible, they could no longer be considered to be both true; one of them had to be false. The present paper makes use of this seldom noticed conflict to argue on the basis of considerations of comparative rationality for the truth of causal statements that have at least some degree of philosophico-theological (...) relevance and can be taken to indicate ( not prove) the existence of God. The paper’s comparatively modest aim is to establish belief in the existence of God as a rational metaphysical option, not as a rational obligation. In its final section, enriched causal considerations lead to an indication ( not proof) of God as that which guarantees the unified continuance of the physical world. (shrink)

What happens in a conversation between a committed Atheist and a committed Christian? While agreeing to disagree on almost every detail, Kai Nielsen, Chair of the Department of Philosophy, University of Calgary, and Hendrik Hart, Senior Member in Philosophy at the graduate Institute for Christian Studies, Toronto, agree that it is not fruitless.

In Plato's Parmenides we find on the one hand that the One is denied every property , and on the other hand that the One is attributed every property . In the course of the history of Platonism , these assertions - probably meant by Plato as ontological statements of an entirely formal nature - were repeatedly made the starting points of metaphysical speculations. In the Mystical Theology of the Pseudo-Dionysius they became principles of Christian mysticism and negative theology. I (...) shall show that the two assertions can each be interpreted within the ontological framework of ancient and medieval logic in such a manner that it becomes true, and I shall make plausible that they were understood, with regard to their logical core, by pagan and Christian Platonic metaphysicians just as is indicated by that interpretation. The mentioned ontological framework is basically the Boolean algebra of first-order properties. The main points of the interpretation are on the one hand the identification of the One with the maximal element of the algebra of properties, and on the other hand two alternative intuitively prominent mereological definitions of ontic predication.
