Our commentary critically reviews the advantages and limits of this approach, in particular with respect to its expressive power, its capability to generalize across analogous structure and analyze systematicity in analogies.

A recent judgment by a lower court in Germany brought the problem of ritual male circumcision to the consciousness of the wider public and legal academia. This essay weighs in on this emerging discussion and argues that ritual male circumcision is not covered by parental authority. It first considers and dismisses the best interest of the child test, which is the most widely used test of parental authority in legal practice. Instead, the essay proposes what it terms the autonomy conception (...) of parental authority, according to which parental authority must be exercised such as to ensure that the child will become an autonomous adult. While parents may raise their child in line with their ethical, including religious, convictions, respect for his autonomy requires that this be done in a way that allows the child to later distance himself from these values; this implies, among other things, that irreversible physical changes are impermissible. There is probably no conceptualization of rights more famous than Ronald Dworkin’s claim that they are “trumps.” This seems to stand in stark contrast to the dominant, proportionality-based strand of rights discourse, according to which rights, instead of trumping competing interests, ultimately have to be balanced against them. The goal of this article is to reconcile Dworkin’s work and proportionality and thereby make a contribution to our understanding of both. It offers a critical reconstruction of Dworkin’s theory of rights which (...) does away with the misleading label of rights as “trumps” and shows that, far from being in conflict with proportionality, properly understood Dworkin’s work supports and supplements that doctrine and provides a much-needed account of its moral foundation as being about human dignity, freedom, and equality. Esto es, una forma de comprender esta noción que se adapte tanto a las posibilidades como a las necesidades del ser humano. A su vez, pondré al descubierto la inadecuación y los riesgos para el ser humano de perseguir libertad concebida como algo desligado de lo político, lo plural y lo público. Para ello expondré las consecuencias para la condición humana de, en primer (...) lugar, la transformación de las nociones de trabajo y fabricación tras la revolución industrial y, en segundo lugar, el desplazamiento de la noción de libertad después de la revolución francesa. A su vez, haré algunas observaciones sobre el estado actual de nuestra relación con el mundo, en tanto que artificio humano, en el desarrollo de cada una de las actividades de nuestra “vida activa”. Estas breves observaciones tendrán que ver con los cambios que sufre esta relación a causa de la aceleración del ritmo de trabajo y consumo que resulta de la revolución industrial y de la invasión de la política por parte de la economía a consecuencia de la revolución francesa. Wittgenstein did not write on the philosophy of religion. But certain strands of his later thought readily lend themselves to what I call Wittgensteinian Fideism. There is no text that I can turn to for an extended statement of this position, but certain remarks made by Winch, Hughes, Malcolm, Geach, Cavell, Cameron and Coburn can either serve as partial statements of this position, or can be easily used in service of such a statement. Some of their contentions will serve as (...) targets for my argumentation, for as much as I admire Wittgenstein, it seems to me that the fideistic conclusions drawn by these philosophers from his thought are often absurd. This leads me back to an inspection of their arguments and the premisses in these arguments. (shrink)

Objective:To characterize the prevalence of hyperpalatable foods (HPF) among baby foods in the U.S. and examine the prevalence of HPF exposure and consumption from both baby food and adult food sources among infants aged 9–15 months.Methods:A U.S. baby food database as well as baby foods from three 24-h dietary recalls of 147 infants were used to identify baby foods as HPF per previous publication. HPF exposure was defined as intake of any HPF during the 3-day measurement period. To determine the (...) extent of HFP consumption, % kilocalorie (kcal) intake from HPF was characterized.Results:Only 12% of baby foods were HPF; however, nearly all participants (>90%) consumed HPF, primarily through exposure to adult foods. Younger infants (<12 months) consumed 38% [standard deviation (SD) = 23.6%] of their daily food kcal from HPF and older infants (≥12 months) consumed 52% (SD = 16.4%) of daily food kilocalorie from HPF. Most younger infants (68%) and older infants (88%) had repeated exposure to the same HPF across the measurement period.Conclusions:The prevalence of HPF among baby foods in the U.S. is low. However, almost all infants were exposed to HPF, and HPF comprised a substantial percentage of daily food kilocalorie in infants' diets. Findings highlight the transition to solid food consumption during complimentary feeding period is a critical time for early HPF exposure. (shrink)

The essay responds to a challenge posed by Vanessa MacDonnell and examines the question of stability and change under the global model of constitutional rights. Constitutionalism offers the promise of both stability and justice, but it may seem that there will often be a tension between these values. While some have accused the global model, and in particular proportionality, of overemphasizing justice at the cost of stability, MacDonnell claims that it underemphasizes the necessity of social change. In this response, I (...) argue that in the long run the push for social change and towards justice can be realized only when there is also a certain stability, namely the stubborn democratic insistence that any state action must be reasonably justifiable to those affected by it in terms of their freedom and equality. This conviction lies at the core and will be reinforced by the endorsement of the global model of constitutional rights. (shrink)

In the jurisprudence of constitutional courts around the world, there is an emerging trend towards an autonomy-based understanding of constitutional rights: increasingly, rights are interpreted as being about enabling people to live autonomous lives, rather than disabling the state in certain ways. This article investigates the conception of autonomy employed by courts by presenting two candidates and examining which of them explains the current practice of constitutional rights law better. The first, labelled the excluded reasons conception of autonomy, claims that (...) a person’s autonomy is violated if he is treated on the basis of certain impermissible—in particular, moralistic or paternalistic—reasons. It is concluded that, while this is a coherent understanding of autonomy, it cannot explain many of the rights that are widely accepted today. The second, the protected interests conception, argues that a person has autonomy interests in controlling certain domains of her life, and offers a scale on which the importance of the various autonomy interests can be assessed. The article demonstrates that this conception is coherent and adequately explains the current practice. The final section briefly explores some implications of this result for a comprehensive reconstructive theory of constitutional rights. (shrink)

ABSTRACT By integrating theories of social learning and moral judgment, we developed a theoretical model on whether and when peers imitate employees’ unethical pro-organizational behavior in the workplace. The study, which involved 256 employees in a large manufacturing company in China, revealed that employees’ UPB positively predicted peers’ vicarious learning of UPB, with the effect strengthened by employees’ organizational tenure but weakened by peers’ deontic injustice. Moreover, the positive effect of employees’ UPB on their peers’ vicarious learning was mitigated, and (...) even turned negative when employees’ organizational tenure was low, but peers’ deontic injustice was high. In the early 1960s, American philosopher of science Thomas Kuhn contributed to a “crisis of rationality” with his hypothesis that science develops by means of paradigm shifts. He challenged the positivist concept of cumulative and continuous scientific progress. According to Kuhn, the relation between two succeeding scientific traditions ‘separated by a scientific revolution’ is characterized by conceptual incommensurability that constrains the interpretation of science as a cumulative, steadily progressing enterprise. Thomas Kuhn’s philosophy was heavily criticized by German-American biologist Ernst Mayr (...) as unapplicable to the history of biology. Mayr, one of the most outstanding evolutionary biologists of the 20th century and a “co-architect” of the so-called Modern Synthesis (contemporary Darwinism), published extensively on the history and philosophy of biology as he thought that theoretical biology cannot progress without proper philosophy of science. Being convinced of the progressive development of Darwinism, Mayr pointed out that Kuhn’s concept of scientific revolutions does not reflect conceptual changes in evolutionary biology. Here we summarize Mayr’s critiques of Kuhn and, based on our own research, take Mayr’s side in the controversy between two great thinkers. (shrink)

Scientists have shown that many non‐human animals such as ants, dogs, or rats are very good at using smells to find their way through their environments. But are humans also capable of navigating through their environment based on olfactory cues? There is not much research on this topic, a gap that the present research seeks to bridge. We here provide one of the first empirical studies investigating the possibility of using olfactory cues as landmarks in human wayfinding. Forty subjects participated (...) in a piloting study to determine the olfactory material for the main experiment. Then, 24 subjects completed a wayfinding experiment with 12 odors as orientation cues. Our results are astonishing: Participants were rather good at what we call “odor‐based wayfinding.” This indicates that the ability of humans to use olfactory cues for navigation is often underestimated. We discuss two different cognitive explanations and rule out the idea that our results are just an instance of sequential learning. Rather, we argue that humans can enrich their cognitive map of the environment with olfactory landmarks and may use them for wayfinding. (shrink)

While prior literature has widely acknowledged that the entrepreneurial environment significantly fertilizes entrepreneurship, the impact of workplace receives limited attention, and the vital role of organizations in linking social entrepreneurial environment and employee entrepreneurship has been largely ignored. Therefore, this study aims to unfold how multiple entrepreneurial environments shape employee entrepreneurship and then further reveal how such relationships vary with employees’ risk propensity. Drawn on the theoretical lens of mindsponge process, which offers an explanation of why and how organizations and (...) individuals adopt new values through the cost-benefit analysis, we proposed a research model to explain the influence mechanisms of the social entrepreneurial environment on the cost-benefit analysis of both organizations and individual employees. Specifically, given that organizations deeply embedded in the society need to balance the costs and benefits under the pressure of the social entrepreneurial environment, the social entrepreneurial environment affects the organizational entrepreneurial environment. Similarly, employees’ cost-benefit analysis under the pressure of organizational hostility will influence their entrepreneurial intentions. Through analyzing the data collected from a two-wave survey with 220 employees, we showed that organizational hostility toward employee entrepreneurship plays a mediating role between social entrepreneurial environment and employees’ entrepreneurial intentions. In addition, such mediation relationship is moderated by coworkers’ unethical behaviors during their entrepreneurship and employees’ risk propensity, which are expected to influence organizations’ and employees’ cost-benefit analysis, respectively. There are, it is argued, conceptually and empirically adequate naturalistic explanations of religion that explain religion without explaining it away and without leaving out anything needed fully to comprehend religious phenomena. Moreover, naturalistic explanations arc sometimes also critiques of religion. This article concerns itself with a subspecies of such explanations through articulating and defending some naturalistic criticisms of the truth-claims of religion. The rationale is displayed for naturalistic thinkers going from truth-claim analyses to functional analyses and the central naturalistic explanations (...) of the roles and functions of religion are distinguished and related. It is shown how these analyses dovetail and, particularly when supplemented by an error-theory of religious belief, constitute a comprehensive and adequate explanation of religion. (shrink)

This thesis is concerned with two interrelated sets of problems: How can we have knowledge in a universe of processes? How can knowledge be improved, and how is scientific progress possible? ;To address the epistemological question in conjunction with the ontological is not a common approach in contemporary philosophy of science. I therefore begin the dissertation by arguing that these two areas of philosophy are intimately interrelated, and that the one-sided concentration on epistemological issues has led to an unsatisfactory account (...) of the nature of knowledge. In particular it has led to a conflation of epistemology with methodology. I argue that methodologies carry with themselves certain presuppositions concerning the nature of the world and of human beings. ;I suggest that we should attempt to construct a philosophical system within which epistemology and ontology mutually support one another. Insights derived from modern science provide us with a basis for the construction of such a system. ;I begin this task by arguing that scientific knowledge can be viewed as an extension of perception. Relying on insights derived from Gregory and Piaget I emphasize the constructive characteristics of our perceptual system and argue that they find their counterpart in the constructive nature of modern science. ;Having outlined a constructivist view of knowledge I turn to the discussion of the ontological issues. ;I propose as an alternative the adoption of a metaphysics of processes. I outline such an ontology, basing my model upon ideas derived from Prigogine's research on dissipative structures and Pattee's investigation of hierarchical organization. I explain how dissipative structures create stability in an instable world and link this insight to the constructive features of our perceptual and conceptual systems. ;The resulting model shows how knowledge is possible in the strange world of processes which we probably inhabit. It further shows how knowledge can be improved and what progress through evolution means. This issue is pursued in greater detail in the last part of the dissertation. There I expound Waddington's cybernetic model of evolutionary change and show how it finds its counterpart in cognitive evolution. (shrink)

In this paper, I develop a naturalistic conception of evolutionary progress. I argue that the Waddingtonian notion of adaptability can be embedded meaningfully into a framework which views living things as nonequilibrium structures. This thermodynamic interpretation places great emphasis on the dynamics of environmental change, whereas the classical conceptions are based on equilibrium conceptions of the evolutionary process. What improves in evolution is the ability of living things to stay alive in increasingly heterogeneous environments.

This paper expounds the central tenets of the Austro-German school of evolutionary epistemology and points out that it conflicts in important aspects with Popper's. The conflict arises because some of the members of the above-mentioned school consider induction to be an absolutely central feature of any evolutionary epistemology. Thus the question arises if Poppers 'method of trial-and-error' is still to be considered to be the evolutionary method. The present author suggests that what is being selected for during scientific evolution is (...) our capacity to apply induction appropriately. We learn when to use induction reliably and when to resort to the most elementary of all methods, the method of trial-and-error. (shrink)

Et cependant, le concept lui-même est souvent vu comme problématique et nombreux sont ceux qui pensent que le raisonnable ne saurait avoir la portée cruciale que Rawls lui attribue. Le concept est ici élucidé et certaines conceptualisations du raisonnable sont explicitées. L’auteur soutient que ces conceptualisations permettent au raisonnable de jouer le rôle-clé que Rawls en attend.
