Syracuse University, NY, USA This paper seeks to demonstrate that hermeneutics is a powerful conceptual tool for exploring the current trend towards theorizing justice as a conversation. Specifically we explore the work of John Rawls in order to describe the particular variety of hermeneu tics at work in both 'political liberalism' and 'justice as fairness' and to critique this hermeneutics from the perspective of the ontological hermeneutics of Hans-Georg Gadamer. Using the critique of Quinean pragmatism found in Joseph Rouse's (...) epistemology, we draw a par allel between the 'hermeneutics as translation' in Quine and Rawls's public reason. This parallel, we argue, helps us better understand the features and the limitations of political liberalism, especially when Rawls's hermeneutics is contrasted with the possibility of a theory of justice inspired by Gadamer. Consider such light musical pieces as Schumann's and Debussy's Arabesques, Schumann's Traumerie, Debussy's Petite Suite, Tschaikowsky's Andante Cantabile, and so on. They all strike their new listener very forcefully; indeed, if you can find music lovers who have not heard one of these you can easily move them to tears by a good performance. Yet they wear out, some with the first hearing, some with the tenth. To be really both immediately very impressive and very durable, like Debussy's Fetes and (...) Mozart's standard music, is every artist's dream, yet many serious composers prefer the durable over the immediately impressive, and take comfort in the fact that Bach's monumental works, The Art of Fugue. The Musical Offering, the Goldberg Variations, and the Mass in B Minor, take a lot of sustained effort from their audience, as do most of Beethoven's later compositions, except for his ninth symphony and similar bits. Since the idea of a canon seems so closely bound up with the idea of history, there should be something to be learned from the persistent efforts that have been going on for nearly two hundred years to extend the musical repertory back in time. What is involved here is nothing less than a continuous effort to endow music with a history. From the workings of this process in the nineteenth century, we learn that where the ideology is right the (...) past can indeed yield up a canon of works and even a canon of performance. Bach, to take the most weighty example, would appear to have entered the canon—Hoffman’s canon—before entering the repertory. The history of the nineteenth-century Bach revival begins as a triumph of ideology over practice. Only after J. N. Forkel, in his famous biography, canonized Bach as the archetypal German master was The Well-tempered Clavier published for the first time—and if any one work of music deserved to be called canonic, it would have to be The Well-tempered Clavier.14 Gradually other Bach works, works which fitted better into nineteenth-century concert life, did enter various nineteenth-century repertories; Mendelssohn’s revival of the St. Matthew Passion is a famous landmark, and various piano transcriptions and orchestral arrangements, not to speak of Gounod’s “Ave Maria,” followed in due course. Bach was made to sound like a premature Romantic. There was as yet no call for historical “authenticity.” But I do not think it was Bach that Hood was thinking of when he complained of musical traditions of the past whose “real identities are gone.” The skeleton may not have been bodied out with authentic flesh and blood, but it was made into a handsome waxwork which was quite real enough for the nineteenth century. 14. Theories of discourse bring to realism new ideas about how knowledge develops and how representations of reality are influenced. We gain an understanding of the conceptual aspect of social life and the processes by which meaning is produced. This collection reflects the growing interest realist critics have shown towards forms of discourse theory and deconstruction. The diverse range of contributions address such issues as the work of Derrida and deconstruction, discourse theory, Eurocentrism and poststructuralism. What unites all of the contributions (...) is a sense that it is essential to provide a realist alternative to the hitherto dominance of social constructionism, hermeneutics and postmodernism, over many of the issues discussed. By developing a realist perspective the different authors attempt to embed discourse within the structured nature of the reality of the world. Realism can situate language, discourse and ideology within context specific, or 'causally efficacious' circumstances. Realism can help to uncover issues of power, representation, and subjectivity and how discursive and other social practices produce real effects. This can help us understand the manner in which social structures are reproduced through various forms of ideology and discourse. And by knowing this, we can start to address questions concerning human emancipation and how the world is to be transformed. (shrink)

There are many mean and nasty things to say about mean and nasty talk, but I don't plan on saying any of them. There's a specific problem about slurring words that I want to address. This is a semantic problem. It's not very important compared to the real-world problems presented by bigotry, racism, discrimination, and worse. It's important only to linguistics and the philosophy of language.

Topics covered in Discrete Mathematics have become essential tools in many areas of studies in recent years. This is primarily due to the revolution in technology, communications, and cyber security. The book treats major themes in a typical introductory modern Discrete Mathematics course: Propositional and predicate logic, proof techniques, set theory (including Boolean algebra, functions and relations), introduction to number theory, combinatorics and graph theory. An accessible, precise, and comprehensive approach is adopted in the treatment of each topic. The ability (...) of abstract thinking and the art of writing valid arguments are emphasized through detailed proof of (almost) every result. Developing the ability to think abstractly and roguishly is key in any areas of science, information technology and engineering. Every result presented in the book is followed by examples and applications to consolidate its comprehension. The hope is that the reader ends up developing both the abstract reasoning as well as acquiring practical skills. All efforts are made to write the book at a level accessible to first-year students and to present each topic in a way that facilitates self-directed learning. Each chapter starts with basic concepts of the subject at hand and progresses gradually to cover more ground on the subject. Chapters are divided into sections and subsections to facilitate readings. Each section ends with its own carefully chosen set of practice exercises to reenforce comprehension and to challenge and stimulate readers. As an introduction to Discrete Mathematics, the book is written with the smallest set of prerequisites possible. Familiarity with basic mathematical concepts (usually acquired in high school) is sufficient for most chapters. Once upon a time it was assumed that speaking literally and directly is the norm and that speaking nonliterally or indirectly is the exception. The assumption was that normally what a speaker means can be read off of the meaning of the sentence he utters, and that departures from this, if not uncommon, are at least easily distinguished from normal utterances and explainable along Gricean lines. The departures were thought to be limited to obvious cases like figurative speech and conversational (...) implicature. However, people have come to appreciate that the meaning of a typical sentence, at least one we are at all likely to use, is impoverished, at least relative to what we are likely to mean in uttering it. In other words, what a speaker normally means in uttering a sentence, even without speaking figuratively or obliquely, is an enriched version of what could be predicted from the meaning of the sentence alone. This can be because the sentence expresses a “minimal” (or “skeletal”) proposition or even because it fails to express a complete proposition at all.1 Indeed, it is now a platitude that linguistic meaning generally underdetermines speaker meaning. That is, generally what a speaker means in uttering a sentence, even if the sentence is devoid of ambiguity, vagueness, or indexicality, goes beyond what the sentence means. The question is what to make of this Contextualist Platitude, as I’ll call it. It may be a truism, but does it require a radical revision of the older conception of the relation between what sentences mean and what speakers mean in uttering them? Does it lead to a major modification, or perhaps even outright rejection, of the semantic-pragmatic distinction? I think.. (shrink)

There is a simple view of motivation on which desires are like pain-killers; they come in different strengths, and their strength determines their efficacy. That is, the stronger a desire the greater its motivational force and, when two desires conflict, the stronger one “wins out” over the weaker. This view makes it puzzling how anyone could ever exhibit “strength of will” and act on the weaker desire, even when it is a desire for something more highly valued than what is (...) more strongly desired. When the will, as the agent of reason, enters the fray, an explanation of what a person is motivated enough to do must reckon not only with competing desires and their motivational forces, but also with the will’s capacity to be affected by different ones in ways not proportional to their force. However, this complication sheds little light, for if the will must bestow its stamp of approval on a desire before the desire leads to action, then, it would seem, motivational force should be measured by strength of effect on the will. And if that’s the way to measure motivational force, then, since by that measure one always acts on the desire that affects one’s will most, there is no problem of strength of will after all. But the problem seems real, however inapt the label. (shrink)

Experimental philosophy involves subjecting philosophical methods and judgments to empirical scrutiny. I begin by exploring conceptual, confirmational, and empirical factors that limit the significance of experiment-based and survey-based approaches to the evaluation of philosophical epistemic activities. I then consider specific criticisms of experimental philosophy: its experimental conditions lack ecological validity; it wrongly assumes that philosophers rely on psychologized data; it overlooks the reflective and social elements of philosophical case analysis; it misconstrues the importance of both procedural and evaluative forms of (...) philosophical expertise; it incorrectly views psychological bias as incompatible with reliability; and it generalizes to a global, self-defeating skepticism about case judgment. I explain why these criticisms should be understood as converging and interdependent. I also set out a three-level model of philosophical case judgment that frames the criticisms. (shrink)

Die sich um 1800 neu konstituierende Disziplin der Biologie und die idealistische Naturphilosophie Schellings bemuhen sich in ihrer Frontstellung gegen einen unkritisch und ontologisch verstandenen Mechanismus um eine dem Leben angemessene Beschreibung und Erklarung der Lebensphanomene. Vor diesem Hintergrund wird im ersten Teil der vorliegenden Studie das Werk des Naturforschers Carl Friedrich Kielmeyer im Kontext der zeitgenossischen philosophischen und naturforschenden Diskussionen verortet, bevor im zweiten Teil die Bedeutung von Kielmeyers Phanomenologie des Organischen fur die systematische Ausarbeitung des Schelling'schen Systems der (...) Naturphilosophie aufgezeigt wird. In their animosity towards an uncritical and ontology-based mechanism, both the new discipline of biology, which was becoming established around 1800, and Schellings idealistic natural philosophy strove for a description and explanation of the phenomena of life which were pertinent to life. Against this backdrop, the work of the naturalist Carl Friedrich Kielmeyer is placed in the context of contemporary philosophical and naturalist discussions of the time in the first part of this study before the significance of Kielmeyers phenomenology of the organic for the systematic development of Schellings system of natural philosophy is shown in the second part. Think of linguistification by analogy with personification: attributing linguistic properties to nonlinguistic phenomena. For my purposes, it also includes attributing nonlinguistic properties to linguistic items, i.e., treating nonlinguistic properties as linguistic. Linguistification is widespread. It has reached epidemic proportions. It needs to be eradicated. That’s important because the process of communication is not simply a matter of one person putting a thought into words and another decoding them back into the same thought. Much of what a speaker means cannot be (...) traced to what his words mean or to their possibly context-sensitive semantic contents. Words carry information all right, but that information hardly determines what speakers mean in uttering them. They leave plenty of pragmatic gaps and sometimes even semantic slack. I’ll mention various reasons for that, but the important thing is to recognize how much people exploit extralinguistic information in communicating and to avoid confusing this process with semantic context sensitivity. To appreciate the limitations of semantics, we shouldn’t fall for the fallacy of misplaced information or for the more specific fallacies enumerated below. (shrink)

Influenced by the Wittgensteinian slogan “Don’t look for the meaning, look for the use,” ordinary language philosophers aimed to defuse various philosophical problems by analyzing key words in terms of what they are used to do or the conditions for appropriately using them. Although Moore, Grice and Searle exposed this error – mixing pragmatics with semantics – it still gets committed, now to a different end. Nowadays the aim is to reckon with the fact that the meanings of a great (...) many sentences underdetermine what we would normally mean in using them – even if the sentence is free of indexicality, ambiguity, and vagueness. This can be so because the sentence expresses a “minimal” proposition or even because it doesn’t fully express any proposition. Many theorists are led to defend “truth-conditional pragmatics” (or linguistic “contextualism”), to find a hidden indexical in every syntactic nook or semantic cranny, or otherwise to pay undue respect to seemingly semantic intuitions and intentions. This article makes a number of points about reference, both speaker reference and linguistic reference. The bottom line is simple: reference ain't easy — at least not nearly as easy as commonly supposed. Much of what speakers do that passes for reference is really something else, and much of what passes for linguistic reference is really nothing more than speaker reference. Referring is one of the basic things we do with words, and it would be a good idea to understand (...) what that involves and requires before worrying about the linguistic means by which this is done. Jennifer Hornsby has defended the Reasons-Knowledge Thesis : the claim that \-ing because p requires knowing that p, where the ‘because’ at issue is a rationalising ‘because’. She defends by appeal to the thought that it provides the best explanation of why the subject in a certain sort of Gettier case fails to be in a position to \ because p. Dustin Locke and, separately, Nick Hughes, present some modified barn-façade cases which seem to constitute counterexamples to and undermine Hornsby’s (...) way of motivating it by rendering their alternative Reasons-Explanation Thesis a better explanation of Hornsby’s datum. This paper defends and Hornsby’s argument for it against those objections. First, I point out that their supposedly intuitive verdict about the relevant barn-façade cases is not as intuitive as they think. Second, I point out that even if we share the intuition: we have strong reason to doubt the verdict anyway. And finally, I point out that since is independently implausible, the two problems can be tackled anyway. (shrink)

According to standard comparativist views, death is bad insofar as it deprives someone of goods she would otherwise have had. In The Ethics of Killing, Jeff McMahan argues against such views and in favor of a gradualist account according to which how bad it is to die is a function of both the future goods of which the decedent is deprived and her cognitive development when she dies. Comparativists and gradualists therefore disagree about how bad it is to die at (...) different ages. In this paper I examine two prominent criticisms of gradualism and show that both misconstrue McMahan. I develop a related criticism that seems to show that a gradualist cannot coherently relate morbidity and mortality. This criticism also fails, but has an instructive implication for how policy-makers setting priorities for health care investments should regard choices between life-saving interventions and interventions against non-fatal diseases in the very young. Over the last few decades, multiple studies have examined the understanding of participants in clinical research. They show variable and often poor understanding of key elements of disclosure, such as expected risks and the experimental nature of treatments. Did the participants in these studies give valid consent? According to the standard view of informed consent they did not. The standard view holds that the recipient of consent has a duty to disclose certain information to the profferer of consent because valid (...) consent requires that information to be understood. The contents of the understanding and disclosure requirements are therefore conceptually linked. In this paper, we argue that the standard view is mistaken. The disclosure and understanding requirements have distinct grounds tied to two different ways in which a token of consent can be rendered invalid. Analysis of these grounds allows us to derive the contents of the two requirements. It also implies that it is sometimes permissible to enroll willing participants who have not understood everything that they ought to be told about their clinical trials. (shrink)

To attribute confusion to someone is to take up a paternalistic stance in evaluating his reasoning.

Confusion in terms inspires confusion in concepts. When a relevant distinction is not clearly marked or not marked at all, it is apt to be blurred or even missed altogether in our thinking. This is true in any area of inquiry, pragmatics in particular. No one disputes that there are various ways in which what is communicated in an utterance can go beyond sentence meaning. The problem is to catalog the ways. It is generally recognized that linguistic meaning underdetermines speaker (...) meaning because of the need for disambiguation and reference assignment and because people can speak figuratively or indirectly. But philosophers and linguists are coming to recognize that these are not the only ways. The situation may be described in Gricean terms: the distinction between what is said and what is implicated is not exhaustive. Charting the middle ground between the two will require attending to specific examples, noting their distinctive features, and articulating the relevant concepts. That is what I aim to do here. The basic idea will be to distinguish not only the implied from the explicit but the implicit from the implied. (shrink)
