En 1974 Jacques Rancière examinait la leçon de marxisme donné par le philosophe Louis Althusser à un collègue anglais et en faisait l'occasion d'un bilan sur l'althussérisme lui-même. Althusser avait imposé dans les années 1960 l'idée d'un retour à la vraie pensée de Marx, en phase avec les formes nouvelles de la pensée structuraliste (ethnologie de Lévi-Strauss, psychanalyse lacanienne, archéologie du savoir de Foucault) mais aussi avec les nouveaux espoirs révolutionnaires qui secouaient la planète à l'heure des luttes de (...) décolonisation et de la révolution culturelle chinoise. Or les événements de 1968 avaient montré le total décalage de ce marxisme renouvelé par rapport aux aspirations portées par les mouvements de la jeunesse et aux formes prises par la mobilisation populaire. La pensée du renouveau théorique et politique s'était transformée en pensée de l'ordre. Mais aussi, dans le contexte de l'après-68, cette pensée de l'ordre ne pouvait trouver son efficacité qu'en s'exprimant dans le langage de la subversion. La Leçon d'Althusser s'attachait à dégager les conditions de ce renversement en examinant le coeur politique de la philosophie althussérienne, l'opposition de la science et de l'idéologie, à la lumière de l'histoire récente mais aussi à celle de la tradition ouvrière et révolutionnaire. Ce texte devenu introuvable est aujourd'hui réédité avec une préface de l'auteur qui en souligne l'actualité : le destin de cette pensée de la subversion devenue une justification de l'ordre existant n'est que le premier épisode d'un mouvement politique et intellectuel bien plus vaste. Des années 1970 jusqu'à notre présent nous avons été témoins d'une vaste contre-révolution politique et intellectuelle dirigée contre tous les acquis des mouvements populaires d'un siècle et contre toute idée d'émancipation. Or cette contre-révolution a continuellement recyclé à son profit tous les thèmes de la pensée marxiste et critique d'hier. La Leçon d'Althusser mettait en lumière le mécanisme fondamental de ce processus et anticipait en ce sens le travail poursuivi par Jacques Rancière jusque dans des livres récents comme La Haine de la démocratie et Le Spectateur émancipé. Ce travail est donc propre à aider à la compréhension du présent et à la reformulation d'une pensée de l'émancipation. (shrink)

Derrida’s recently published Life Death seminars have again highlighted the importance of values within the ongoing philosophical conversation about overcoming metaphysics. The seminars further indirectly raise a matter of great importance for constitutional theory. Values have become central to constitutional discourse since the mid-twentieth century despite critique due to their supposedly subjective nature, the potential conflict between them, and the legal uncertainty that they bring about. This essay enquires into the origin, logic, structure, and operation of (constitutional) values. It does (...) so through a close reading of the texts of Heidegger and Derrida in which Nietzsche’s call for a revaluation of values takes on a central role, along with a reflection on the relation between life and Being, as well as between life and death. A close reading of these texts in turn makes possible an unorthodox reading of Schmitt’s newly translated text on constitutional values in The Tyranny of Values, which finally opens the possibility of a move beyond such values and thus beyond metaphysics. He delivered this address, which is reprinted with permission, at a Conference on Business and Moral Standards in Post Communist Europe held in London in November last year under the auspices of the Archdiocese of Westminster and sponsored by the Sedgwick Group and KPMG Peat Marwick.

Les hommes sont-ils sujets ou assujettis à la structure objective du monde naturel et social ? Est-ce l’idéologie ou la critique de l’idéologie qui les fait sujets ? Les deux, selon Marx, car les hommes ne sont pas libres mais le deviennent à travers l’histoire, dialectiquement, en se libérant de la nécessité qui les conditionne. Depuis, le marxisme s’est scindé, un matérialisme objectif y affrontant un idéalisme subjectif, et aujourd’hui Althusser retourne le socialisme scientifique contre l’utopie communiste, à l’inverse d’Habermas. (...) Une critique scientiste de l’humanisme idéologique s’oppose alors à une critique humaniste de l’idéologie scientiste. Is it ideology or criticism of ideology which makes them subjects ? Both, according to Marx, because men aren’t but become free throught history, dialectically, being liberated from necessity which determines them. Since, marxism has been splitting up into an objective materialism fronting a subjective idealism, and today Althusser, at the opposite of Habermas, returns scientific socialism against communist Utopia. Then, a scienticist criticism of ideological humanism is opposed to a humanist criticism of scienticist ideology. So, shouldn’t we criticize both humanism and scienticism as two contrary but complementary sides of a single metaphysical - and ideological - rationalism ? (shrink)

This text proposes an evaluation of what remains of cinema in the age of the digital, and of an ever increased circulation between movie theatres and museums. Much has changed in the social and aesthetic status of cinema, at least since the appearance of video art; but cinema, in general, has not disappeared, quite to the contrary, and remains a very important social practice. Two important factors, however, have undergone deep changes: 1°, film no longer has the exclusivity of the (...) moving image, which it has to share with television and contemporary art; 2°, the recent hegemony of the digital image has driven film toward a massive return to the “Méliès path” of film art, that of a direct intervention on the film image. The contention here is that, though the art of film is obviously not what it was, it has kept a number of qualities which still make it the positive reference for any thinking of the moving image in general. The article puts forward three kinds of reasons to support this argument: 1°, cinema has invented a specific way to see moving images, resting on what is termed here the production of a gaze; 2°, time is essential to the film form itself; 3°, film is the only art which has developed an aesthetic of the encounter (with the real) – and the co-presence of these three ranges of value remain absolutely specific. The historian and religious scholar Ernst Ludwig Ehrlich (1921-2007) was among the most influential minds in the post-Shoah German-speaking Jewish world. In 1943, with the help of Christian friends, he escaped from Berlin to Switzerland, where as a student, he became a spokesman in Jewish-Christian dialogue. Hartmut Bomhoff narrates how despite the experience of expulsion, life in the underground, and flight, Ehrlich became a bridge-builder.

The language of balancing and proportionality figures increasingly, often in judicial and academic constitutional legal reasoning in Western democracies. The spread of this particular form of discourse raises important methodological and substantive issues for scholars of comparative law. While the dominant narrative in the relevant lines of scholarship has long been one of similarity and convergence, this article argues that not enough attention has been paid to the possibility of difference—the idea that references to balancing might mean very different things (...) in different settings. In Parts I and II, the article suggests that a methodological shift—from a focus on balancing as doctrine to a focus on balancing as legal argument—will be necessary to bring out these different meanings. Based on a case study of early and mid-twentieth century practices in Germany and the United States, it is argued that one crucial difference in the local meanings of balancing in these settings relates to the extent to which choices of legal form are locally expected to have inherent substantive implications.
