Background The allocation of scarce deceased donor kidneys is a complex process. Transplant providers are increasingly relying on constructs such as frailty and cognitive function to guide kidney transplant (KT) candidate selection. Patient views of the ethical issues surrounding the use of such constructs are unclear. We sought to assess KT candidates’ attitudes and beliefs about the use of frailty and cognitive function to guide waitlist selection.Methods KT candidates were randomly recruited from an ongoing single-center cohort study of frailty and (...) cognitive function. Semi-structured interviews were conducted, and thematic analysis was performed. Inductively derived themes were mapped onto bioethics principles.Results Twenty interviews were conducted (65% contact rate, 100% participation rate) (60% male; 70% White). With respect to the use of frailty and cognitive function in waitlisting decisions, four themes emerged in which participants: (1) valued maximizing a scarce resource (utility); (2) prioritized equal access to all patients (equity); (3) appreciated a proportional approach to the use of equity and utility (precautionary utility); and (4) sought to weigh utility- and equity-based concerns regarding social support. While some participants believed frailty and cognitive function were useful constructs to maximize utility, others believed their use would jeopardize equity. Patients were uncomfortable with using single factors such as frailty or cognitive impairment to deny someone access to transplantation; participants instead encouraged using the constructs to identify opportunities for intervention to improve frailty and cognitive function prior to KT.Conclusions KT candidates’ values mirrored the current allocation strategy, seeking to balance equity and utility in a just manner, albeit with conflicting viewpoints on the appropriate use of frailty and cognitive impairment in waitlisting decisions. Illinois Governor James Thompson, former DCFS Director Gregory Coler, and DCFS Director Gordon Johnson have all endorsed these materials by continuing to recommend them for day-care training in Illinois. Teaching and learning of medical ethics and law are at the heart of medical education because they are integral to all clinical encounters and public health interventions, and a foundation in medical ethics and law is essential for students to become virtuous doctors. The first model curriculum for medical ethics and law within medical education in the UK, published in 1998, has recently been reviewed and updated. Now called a core content of learning, it emphasizes that teaching and learning of (...) medical ethics and law should be attuned to the students' needs appropriate both to their particular stage of training and to relevant specialty-specific ethical issues; is a shared obligation of all teachers throughout the course; and should be integrated vertically and horizontally throughout the whole medical curriculum. The General Medical Council and the British Medical Association have confirmed that the revised core content of learning is consistent with their guidance on undergraduate education. (shrink)

Arnold and Bowie (2003) attempt to derive ethical constraints on the actions of the managers of multinational enterprises (MNEs), orthe MNEs themselves, from a Kantian perspective. We contest Arnold and Bowie’s claims regarding MNE duties, in particular that MNEs have a duty to pay a subsistence wage above market levels. We conclude that even within Arnold and Bowie’s Kantian framework such a duty does not properly emerge. In addition, we argue that the account of coercion used by Arnold and Bowie (...) does not serve their purposes. Arnold and Bowie address consequentialist issues by arguing that their conclusions are not undercut by economic considerations regarding unemployment. We argue that Arnold and Bowie have misread the economic literature in this regard. (shrink)

Mr. Kaufman's valuable study does not offer a doctrine of God, but instead explores why God is a problem for many moderns, the dimensions of that problem, and the inner logic of the notion of God as it has developed in Western culture. His object is to determine the function or significance of talk about God: how (...) the concept of God is generated in human experience; the special problems in turn generated by this concept (for example, the intelligibility of the idea of transcendence, the problem of theodicy) and how they are met; and under what circumstances the idea of God is credible or important or even indispensable. He does not try to prove God's existence or nonexistence, but elucidates what the concept of God means and the important human needs it fulfills. Four of the eleven essays have been previously published, at least in part; seven are completely new. (shrink)

Kant's Religion within the Boundaries of Mere Reason was written late in his career. It presents a theory of 'radical evil' in human nature, touches on the issue of divine grace, develops a Christology, and takes a seemingly strong interest in the issue of scriptural interpretation. The essays in this Critical Guide explore the reasons why this is so, and offer careful and illuminating interpretations of the themes of the work. The relationship of Kant's Religion to his other writings is (...) discussed in ways that underscore the importance of this work for the entire critical philosophy, and provide a broad perspective on his moral thought; connections are also drawn between religion, history, and politics in Kant's later thinking. ABSTRACTHan Fei’s political theory is widely characterized as eschewing any connection with morality; so, can he have any conception of justice? In this paper, I accept the interpretation of Han Fei jettisoning any moral commitment, but I argue that he gives heed to an understanding of justice. This conception of justice arises naturally from the ordinary human sentiment of resentment for wrongs done and becomes a moral staple in the consciousness of ordinary people. Such a conception of justice has these (...) features: all and only the guilty receive punishment, and the punishments are in some sense proportionate to the crime. Since disregarding this popular conception of justice results in resentment and political instability, Han Fei, without any moral commitment to it, accepts the popular conception of justice on prudential and consequentialist grounds. In this paper I intend to discuss difficulties which face Hilary Putnam’s internal realism, difficulties which involve issues in semantics. I hope to show that Putnam has not presented a viable theory of truth. Putnam wishes to avoid relativism, which he claims is incoherent. My argument against Putnam’s theory of truth will be that Putnam has avoided relativism at only a very superficial level. On a deeper analysis we will see that Putnam has in fact not avoided relativism.Putnam has abandoned (...) the correspondence theory of truth since he can make no sense of the claim that our words, thoughts, images, sensations, etc. correspond to external objects. Considerations of human psychology (1983a, p.viii), as well as problems concerning reference (1981; 1983a, pp.vii-xviii; 1983b), have led Putnam to adopt the view that truth must be analyzed in terms of justification. In the Second Analogy, Kant argues that we must presuppose, a priori, that each event is determined to occur by some preceding event in accordance with a causal law. Although there have been numerous interpretations of this argument, we have not been able to show that it is valid. In this paper, I develop my own interpretation of this argument. I borrow an insight offered by Robert Paul Wolff. In Kant's argument, our need to presuppose that the causal determination of (...) each event rests not upon our need to impose a 'necessary' and 'irreversible' temporal order upon representations of the states of an object, as Kant is usually interpreted, but upon our need to generate a comprehensive representation that includes a certain a priori conception of events in the world around us. Although the argument I attribute to Kant is valid, it cannot compel the Humean skeptic to accept the necessity of presupposing the causal determination of each event: Kant has not successfully responded to Hume in the Second Analogy. Ignorance has been both vilified and celebrated throughout the ages. However, the social sciences have had little to say about this topic over the years. In this paper, we argue that in an age of competing and contrasting worldviews, scholarly attention to ignorance can shed light on interpersonal processes and relational dynamics that occur in encounters between subjects holding different points of view. We discuss data from two studies documenting an attribution of ignorance in social relations that serves to relegate (...) the other's point of view to one that stands in need of education or correction. We argue that this communicative strategy enacts a semantic barrier that serves to retain the interlocutor's original point of view unscathed and unchallenged. We argue that this limits dialogical relations by eliminating the requirement for perspective-taking in social dialogue. (shrink)

Two arcas of continuing interest to direct marketing professionals are the perceived myths and unethical practices in the field. Documentation of specific cases and more abstract discussion of these two points of interest frequently appear in the direct marketing literature (e.g. Gitlitz and Barton, 1983; Lewis, 1982; Pierce, 1985). Indeed, the Direct Marketing Association (DMA) has promulgated specific guidelines (DMA, 1985) for ethical business practices within the industry. Up to this point, however, there has been no attempt at a systematic (...) evaluation of the perceptions of professionals in the field.Such an evaluation of these two areas of practice would appear to beg the following questions: (1) What are the major common myths which abound in direct marketing as perceived by professionals who come into direct contact with the operations of direct marketing organizations? (2) Which of these so-called myths are most requently mentioned? (3) What are the most commonly perceived unethical practices? (4) Which of these unethical practices are most frequently mentioned by direct marketing professionals? Das heißt aber nicht, dass bewährte traditionelle metaphysische Begriffe völlig aufgegeben werden müssen. Gerade in den modernen Naturwissenschaften gibt es Fragen, die aus der einzelnen Wissenschaft heraus nicht beantwortet werden können, ohne begriffliche Anleihen bei traditionellen metaphysischen Konzepten zu nehmen. The classical Chinese philosopher Mengzi shares the idea with David Hume that virtue and vice are dispositions of character that arise from original qualities of the mind. Mengzi is guardedly optimistic that these original qualities can be extended to become fully formed virtues, while Hume is guardedly skeptical about this same enterprise. Yet these two thinkers have something to share with each other. In this essay I will use illustrations from Mengzi to sketch out an interpretation of extending original moral (...) qualities into the virtue of benevolence. I will chart two developmental stages on the pathway to fully developed benevolence, and I will attempt to superimpose Hume’s account of the passions and his double.. (shrink)

Professor Tullock shows what happens when, abandoning the traditional view of civil and criminal law as an extension of moral philosophy, concepts and procedures of modern welfare economics are applied to our legal system.

Electricity is hidden within wires and networks only revealing its quantity and flow when metered. The making of its properties into data is therefore particularly important to the relations that are formed around electricity as a produced and managed phenomenon. We propose approaching all metering as a situated activity, a form of quantification work in which data is made and becomes mobile in particular spatial and temporal terms, enabling its entry into data infrastructures and schemes of evaluation and value production. (...) We interrogate the transition from the pre-digital into the making of bigger, more spatiotemporally granular electricity data, through focusing on those actors selling and materialising new metering technologies, data infrastructures and services for larger businesses and public sector organisations in the UK. We examine the claims of truth and visibility that accompany these shifts and their enrolment into management techniques that serve to more precisely apportion responsibility for, and evaluate the status of, particular patterns and instances of electricity use. We argue that whilst through becoming Big Data electricity flow is now able to be known and given identity in significantly new terms, enabling new relations to be formed with the many heterogeneous entities implicated in making and managing energy demand, it is necessary to sustain some ambivalence as to the performative consequences that follow for energy governance. We consider the wider application of our conceptualisation of metering, reflecting on comparisons with the introduction of new metering systems in domestic settings and as part of other infrastructural networks.
