The lung allocation score system in the United States and several European countries gives more weight to risk of death without transplantation than to survival following transplantation. As a result, centers transplant sicker patients, leading to increased length of initial hospitalization. The care of patients who have accumulated functional deficits or additional organ dysfunction during their prolonged stay can be ethically complex. Disagreement occurs between the transplant team, patients and families, and non-transplant health care professionals over the burdens of ongoing (...) intensive intervention. These cases highlight important ethical issues in organ transplantation, including the nature and requirements of transplant informed consent, the limits of physician prognostication, patient autonomy and decision-making capacity following transplant, obligations to organ donors and to other potential recipients, and the impact of program metrics on individualized recipient care. We outline general ethical principles for the care of lung transplant recipients with prolonged hospitalization and give regulatory, research, and patient-centered recommendations for these cases. Do-not-resuscitate (DNR) orders are typically signed by physicians in conjunction with patients or their surrogate decision makers in order to instruct healthcare providers not to perform cardiopulmonary resuscitation (CPR). Both the medical literature and CPR guidelines fail to address when it is appropriate for physicians to sign DNR orders without any knowledge of a patient’s wishes. We explore the ethical issues surrounding instituting a twophysician DNR for a dying patient with multiple comorbidities and no medical record on file, no advance (...) directives, and no surrogate decision maker. Through this case we also highlight the issues of poor prognostication and the reversal of a DNR in such circumstances. (shrink)

Schumacher’s work explores the various facets of theological anthropology in the first half of the thirteenth century by focusing primarily on scholars belonging to the Franciscan Order such as Philip the Chancellor, Alexander of Hales, and William of Auvergne, as well as early Dominican scholars such as Roland of Cremona and Hugh of St. Cher. Of central focus in the study is John of La Rochelle, whom the author notes “was the only member of his generation to deal robustly and comprehensively” with not only traditional questions on the soul but also matters of philosophy that had previously been considered beyond the purview of the theologian, topics that included the processes of the body and the psychological makeup of the human being. In addition, John was among the first to embrace the newly translated Arabic sources into his work, most notably the writings of Avicenna.The work is divided into eleven chapters, the first four of which provide a theological background on various authors and their views on the relation between the body and soul and the powers of the soul. The fifth and sixth chapters focus on two works of John of La Rochelle, the Tractatus and the Summa de anima, followed by a study of the reception of Averroes in the first half of the thirteenth century. The work concludes with chapters on the cognitive powers, the affections, free choice, and angels. Schumacher’s study is thorough, providing robust examinations of the individuals and topics, even those who are not central to the study, such as Roland of Cremona and Guerric of St. Quentin. [End Page 161]The book is well written and clearly elucidates the complex schemas of the topics at hand, particularly the nature of the intellect. This is particularly evident in the middle chapters, which examine the ideas of John of La Rochelle, in whose works one finds a multifaceted account of the human intellect. In addition, Schumacher notes an interesting facet of John’s view of cognition, according to which “the mind ‘predetermines’ or influences its understanding of the world.” Thus John’s theory of the act of human rationality, as Schumacher summarizes it, is “arguably achieved at the level of perception, and perception, in turn, is permeated and guided by reason’s quest to know the ‘thing in itself’ apart from matter.” John’s view is then briefly compared to that of William of Auvergne, who argued that perception is “virtually irrelevant” for human understanding. This comparison underscores the rifts that took place during the development of early thirteenth-century thought regarding the nature and function of the intellect as it underwent a profound change from traditionally Augustinian ideas to attempts to reconcile the former with the ideas found in the newly available works of Aristotle and his Arab commentators, namely, Avicenna.The only criticism one might have is that, at times, the chapters seem out of order. For example, after the two chapters that deal extensively with the works of John of La Rochelle, the following chapter is “The Reception of Averroes in Early Scholasticism,” which examines the possible sources “of the three-fold intellectual schema” that is found in John of La Rochelle’s works. Possible sources include not only Averroes but also Aristotle and Alexander of Aphrodisias, as well as two anonymous works that John knew and utilized. The chapter itself is presented effectively but makes the work feel somewhat disjointed. Within the long tradition of halakhic stares decisis, or Jewish responsa literature, one can find no more intricate a weave of law and philosophy than that crafted by the twelfth century Jewish jurist and philosopher, Moses Maimonides, in response to an existential query by Ovadyah, a Muslim convert to Judaism. Ovadyah's conversion raised particular concerns within the realm of institutionalized prayer and the rabbinically standardized texts that were its mainstay. The liturgy that had evolved was replete with ethnocentric expressions that (...) rendered it highly resistant to the entry of outsiders anxious to become full-fledged members of the club. How can the convert utter the phrase “God of our fathers” when his biological ancestry belies its pronouncement? What right does he have to lay claim to a divine election, “who chose us,” which was motivated by a preference for one “nation” over others? Can he appeal to a God who is particularized as a national liberator, “who took us out of Egypt,” when enslavement and exodus were confined to a specific locale and time within a national historical consciousness? And finally, God's intrusion into history on Israel's behalf “who performed miracles for our fathers,” is a shared collective memory about which the convert cannot reminisce. This was no mere halakhic question as to whether he could legitimately adopt these communal liturgical expressions. Ovadyah was also posing a deep existential suspicion that he would never be able to consider himself an authentic insider of the religious community he had joined, in all likelihood, at great personal risk. While Maimonides reread his sources to reconcile biblical and rabbinic texts with the demands of reason, Hermann Cohen, in his construction of a “religion of reason,” rereads Maimonides' rereadings of those very same texts. Maimonides' Judaism often bridges the sources toward Cohen's religion of reason by providing a philological anchor that nudges a term or verse now viewed through a more modern historical and evolutionary lens toward its ultimate reason-infused meaning. This paper will explore a hitherto neglected feature of their (...) oeuvres that unites Maimonides and Cohen as much as it distinguishes them: the “Jewishness” shared by both, as evident in the most Jewish of all exercises that suffuses both their works, biblical and midrashic exegesis. Their exegetical nets are systematically cast widely throughout the breadth of the Hebrew Bible, but more often than not they offer highly discrepant readings of the same passage or prooftext. Cohen's referencing of many of the same sources appeals to their Maimonidean rationalist refurbishment, but at the same time often places them in combative discourse in order to subvert and reorient Maimonides' exegesis. The notions of divine names, the “image” ( tselem ) of God, “nearness” to God, and divine “glory” ( kavod ) are closely examined to demonstrate this intertextual relationship between these two seminal Jewish thinkers. While Cohen may be misreading Maimonides' rereading of scripture, he remains a true hermeneutical disciple in his exegetical restructuring and realignment of scripture. Cohen's programmatic exegetical idealization of Maimonidean prooftexts to reconstruct a new Kantianized God forms a common ground of discourse with Maimonides that traverses seven centuries of a quintessential Jewish enterprise. Reform of the federal income tax system has become a perennial item on the domestic policy agenda of the United States, although there is considerable uncertainty over specifics. Indeed the recent report of the President's Advisory Panel on Federal Tax Reform recommended not one but two divergent policy directions. Every work on Jewish thought and law since the twelfth century bears the imprint of Maimonides. A.N. Whitehead's famous dictum that the entire European philosophical tradition 'consists of a series of footnotes to Plato' could equally characterize Maimonides' place in the Jewish tradition. The critical studies in this volume explore how Orthodox rabbis of different orientations--Shlomo Aviner, Naftali Zvi Yehudah Berlin (Netziv), Kalonymus Kalman Shapira, Joseph Kafih, Abraham Isaac Kook, Aaron Kotler, Joseph Soloveitchik, and Elhanan Wasserman--have read and provided footnotes (...) to Maimonides in the long twentieth century. How well did they really understand Maimonides? And where do their arguments fit in the mainstream debates about him and his works? Each of the seven core chapters examines a particular approach. Some rabbis have tried to liberate themselves from the influence of his ideas. Others have sought to build on those ideas or expand them in ways which Maimonides himself did not pursue, and which he may well not have agreed with. Still others advance patently non-Maimonidean positions, while attributing them to none other than Maimonides. little more than a year ago, I participated in a meeting, organized by the National Academy of Sciences , on the subject of enhancing public understanding of science by encouraging greater collaboration between scientists and the media. Most of the scientists present were members of the academy, which serves both as an elected honor society and as an official adviser on science policy to the U.S. government. Across the room I spotted a slim man who seemed somehow familiar. His deliberate (...) movements suggested an inner passion concealed beneath a subdued exterior. In his adoption of the Maimonidean guidelines for extreme humility, the king acts as the supreme existential model for imitatio dei. Imperial governance, when filtered through the prism of Maimonidean humility, results in a regime that most closely resembles a divine one. Using those who occupy the very bottom of the social and political hierarchy (slaves and orphans) as models, the king projects his own sense of "lowliness" to the people. The king thereby promotes their sense of autonomy, and inhibits (...) any anthropocentrism that would be fostered if he were to be viewed as an autocrat. His administration of the royal office is limited by the ethical and philosophical dictates of humility, thereby offering a window into the distinction between its common (anivut) and extreme (shefal ruah) manifestations. Maimonides does in fact define the parameters of this extraordinary humility, but he chooses to do so within the context of a distinct and concrete personality--that of the king. (shrink)
