The paper presents different clustering approaches in legal judgments from the Special Civil Court located at the Federal University of Santa Catarina. The subject is Consumer Law, specifically cases in which consumers claim moral and material compensation from airlines for service failures. To identify patterns from the dataset, we apply four types of clustering algorithms: Hierarchical and Lingo, K-means and Affinity Propagation. We evaluate the results based on the following criteria: entropy and purity; algorithm's ability in providing labels; legal expert’s (...) evaluation; and experimental complexity. The results demonstrate that the most advantageous approach is Hierarchical Clustering, since it has the best entropy and purity numbers, as well as the least difficulty for the expert to analyze the clusters, and the least experimental complexity. The main contribution of the paper is to show the advantages and disadvantages of each approach, especially to identify labels in unstructured and non-indexed legal texts. (shrink)

A legislação florestal brasileira pretérita é frequentemente interpretada de forma anacrônica. O objetivo deste artigo é contribuir para a compreensão da historicidade de tal legislação. De forma específica, serão analisadas, comparativamente, as propostas de alteração do primeiro Código Florestal Brasileiro até sua substituição em 1965. Apesar de modificações importantes, há uma permanência entre os textos analisados: as posturas conservacionistas, presentes em todos eles, só podem ser compreendidas quando atreladas à lógica produtivista e às políticas desenvolvimentistas evidenciadas no Brasil da época.

Vivemos nos desdobramentos daquilo que Manuel Castells (2005) nomeou de Sociedade em Rede, em cujo cerne estão as Tecnologias de Informação (TIs). Ele indicou as características-chave do novo cenário que diagnosticou, a saber, são tecnologias que agem sobre a própria informação e que também introduziram a lógica das redes; que promovem a convergência tecnológica e, por conseguinte, um sistema altamente integrado de aparatos técnicos; e que acentuadamente penetram pelos diferentes processos e âmbitos sociais. De lá para cá testemunhamos grandes e (...) rápidos saltos tecnológicos bem como o adensamento das transformações na dinâmica econômico-política organizacional e institucional e na construção das vidas humanas e não-humanas no planeta. Essas mudanças alcançaram não apenas modos informais de aprendizagem, mas também a educação formal. O objetivo desse artigo é discutir aspectos atuais da plataformização educacional presentes na educação básica brasileira, tendo como referência o ensino de Filosofia no Ensino Médio. Para tanto será desenvolvida reflexão sobre a plataformização educacional, fenômeno que diz respeito ao modelo de negócios presente na atual fase do capitalismo e que utiliza as plataformas sustentadas pela IA e também a constante extração de dados de quem transita pelas infovias do ciberespaço; sobre o que nomeamos como Escola do Cansaço, em diálogo com o conceito de Sociedade do Cansaço desenvolvido por Byung Chul Han; e sobre algumas implicações decorrentes que já se fazem presentes na administração do trabalho docente, na realização do trabalho docente e nas relações de ensino-aprendizagem. We address the problem of combining intuitionistic and S4 modal logic in a non-collapsing way inspired by the recent works in combining intuitionistic and classical logic. The combined language includes the shared constructors of both logics namely conjunction, disjunction and falsum as well as the intuitionistic implication, the classical implication and the necessity modality.We present a Gentzen calculus for the combined logic defined over a Gentzen calculus for the host S4 modal logic. The semantics is provided by Kripke structures. The (...) calculus is proved to be sound and complete with respect to this semantics. We also show that the combined logic is a conservative extension of each component. Finally we establish that the Gentzen calculus for the combined logic enjoys cut elimination. (shrink)

While ethical norms for conducting academic research in the United Kingdom are relatively clear, there is little empirical understanding of how university research ethics committees (RECs) themselves operate and whether they are seen to operate well. In this article, we offer insights from a project focused on the Scottish university context. We deployed a three-sided qualitative approach: (i) document analysis; (ii) interviews with REC members, administrators, and managers; and (iii) direct observation of REC meetings. We found that RECs have diverse (...) operation and vary in terms of what members understand to be the remit of their REC and what should constitute the content of ethics review. Overall, though, most participants perceive university RECs as operating well. When asked what they consider to be areas for further improvement, most commented on: implementation of an online system; more experience with how to evaluate various kinds of research projects; best practice exchange and training opportunities; more accurate reflection of the REC role as part of the university’s workload allocation model; and greater recognition of the importance of research ethics governance in the university’s research environment, and, for the members themselves, their career advancement. Based on our findings and subsequent discussions during an end-of-project roundtable with stakeholders, we propose a model of collaboration that can address some of the identified areas that could benefit from further improvement. This model would facilitate a heightened awareness of the importance of supporting REC members in their own effort in assisting students and staff alike in undertaking as ethically robust research as possible. A partir da psicanálise existencial sartriana, descrita na obra Saint Genet: Ator e Mártir, analisaremos os caminhos tortuosos que a subjetividade percorre na tentativa de se plenificar como objeto. Nosso propósito é demonstrar que Genet buscou identificar-se com seu ego para se colocar como um objeto de desprezo para a sociedade, porém, sua busca fracassa, pois, segundo Sartre, o homem jamais será completamente objetividade alienada no mundo. Nesse intuito, descreveremos brevemente os principais momentos da vida de Genet. Em sua infância, (...) teve seu ego-visto (ser-para-outro) constituído pelo olhar de outrem; a partir de então, realizou diversos esforços para se identificar com essa imagem alienada, entretanto - enquanto liberdade -, permaneceu frente a todas as suas tentativas de fixar um ego maldito com o qual se identificasse; e, por fim, encontrou apenas a sua própria subjetividade, exercendo sua liberdade no ofício de escritor. Concluiremos, portanto, que a subjetividade permanece livre e responsável, mesmo frente à construção do seu ego. (shrink)

Valendo-se de O Livre Arbítrio e As Confissões como principais referências, este estudo visa analisar a problematização que Agostinho faz do Mal, vez que o Bispo de Hipona refletiu sobre a possibilidade de conciliar o pilar cristão de infinita bondade divina com a existência do mal no real. Neste artigo separamos duas fases dessa reflexão. A primeira busca resolver o problema do mal como existente no universo físico, desenvolvendo para tanto uma ontologia que culmina na impossibilidade da existência do mal (...) como substância: o Mal é privação do Bem. Já que o Mal não é substância, mas sim privação do Bem, não existe o mal natural: o mal genuíno é resultado da ação humana. Na segunda fase, o debate se dirige para o sujeito e o livre-arbítrio, ou seja, o âmbito moral. É preciso explicar por quais razões Deus nos deu o livre-arbítrio se com ele praticamos o mal. Como veremos, a possibilidade de escolher é um bem dado por Deus que permite a qualificação moral do ato, dessa forma, o homem deve possuir o livre-arbítrio para que possa ser justo ou injusto. Por fim, concluímos mostrando que as origens do mal estão na defecção da vontade que se afasta de Deus. (shrink)

L'évêque d'Hippone a réfléchit sur la possibilité de concilier le pilier chrétien de la bonté infinie de Dieu avec l'existence du mal dans le réel. Nous avons séparé dans cet article deux phases de cette réflexion. La première vise à résoudre le problème du mal comme existant dans l'univers physique. Elle développe une ontologie qui culmine dans l'impossibilité de l'existence du mal en tant que substance: le mal est une privation du bien. Puisque le mal n'est pas une substance, mais bien il s’agit d’une privation du bien, il n’y a pas du mal naturel: le mal véritable est le résultat de l'action humaine. Dans la deuxième phase, le débat se dirige vers le sujet et le libre arbitre, en d'autres termes, le domaine de la morale. Il faut expliquer pourquoi Dieu nous a donné le libre arbitre alors que nous faisons du mal. Comme nous le verrons, la capacité de choisir est un Bien donné par Dieu qui permet à l'action morale, ainsi, l'homme doit avoir le libre arbitre afin qu'il puisse être juste ou injuste. Nine authors discuss what is the criteria of a work of art.

In this paper, we make explicit the changing configurations of power relations that currently characterize the Brazilian Emergency Care System (SAMU) team in Belo Horizonte, Brazil. The SAMU is a recent innovation in Brazilian healthcare service delivery. A qualitative case study methodology was used to explore SAMU’s current organizational arrangements, specifically the power relations that have developed and that demonstrate internal team struggles over space and defense of particular occupational interests. The argument advanced in this paper is that these professionals (...) are developing their work in conditions of exposure, that is, they are always being observed by someone, and that such observational exposure provides the conditions whereby everyday emergency care practices are enacted such that practice is shaped by, as well as shapes, particular, yet recognizable power relationships. Data were collected through the observation of the SAMU’s work processes and through semi‐structured interviews. Research materials were analyzed using discourse analysis. In the emergency care process of work, visibility is actually embedded in the disciplinary context and can thus be analyzed as a technique applied to produce disciplined individuals through the simple mechanisms elaborated by Foucault such as hierarchical surveillance, normalizing judgment, and the examination. In recent decades, developing and middle-income countries around the globe have adopted path-breaking reforms to their social protection systems. Latin America has been a pioneer region, expanding the state’s commitment on behalf of low-income citizens in key policy areas in many countries. This paper undertakes two tasks. First, it documents the surprising extension of noncontributory social protection policies across many Latin American countries, highlighting how tax-financed programs have come to play a central role in a variety of settings. Second, it (...) examines citizen-level preferences that support this trend, arguing that employment vulnerability and threats to income continuity play a decisive role in shaping demand for public, rather than private, social protection. Survey data on labor-market risks and social policy preferences from eighteen countries corroborate these claims. Our findings suggest that other countries undergoing labor-market strains may experience similar demands for a “return of the state” as a guarantor of social protection in the coming years. (shrink)

In The Grammar of Society, first published in 2006, Cristina Bicchieri examines social norms, such as fairness, cooperation, and reciprocity, in an effort to understand their nature and dynamics, the expectations that they generate, and how they evolve and change. Drawing on several intellectual traditions and methods, including those of social psychology, experimental economics and evolutionary game theory, Bicchieri provides an integrated account of how social norms emerge, why and when we follow them, and the situations where we are (...) most likely to focus on relevant norms. Examining the existence and survival of inefficient norms, she demonstrates how norms evolve in ways that depend upon the psychological dispositions of the individual and how such dispositions may impair social efficiency. By contrast, she also shows how certain psychological propensities may naturally lead individuals to evolve fairness norms that closely resemble those we follow in most modern societies. (shrink)

In Norms in the Wild, distinguished philosopher Cristina Bicchieri argues that when it comes to human behavior, social scientists place too much stress on rational deliberation. In fact, she says, many choices occur without much deliberation at all. Two people passing in a corridor automatically negotiate their shared space; cars at an intersection obey traffic signals; we choose clothing based on our instincts for what is considered appropriate. Bicchieri's theory of social norms accounts for these automatic components of coordination, (...) where individuals react automatically to cues that focus their attention on what the norm is in that situation. Social norms thus act as rules for making choices in a social world where people expect others -- often unconsciously -- to follow the same rule. Some norms enable seamless social co-operation, while others are less beneficial to human flourishing.Bicchieri is famous for her interdisciplinary work on game theory and most recently her work on social norms, and Norms in the Wild represents her latest challenge to many of the fundamental assumptions of the social sciences. Bicchieri's work has broad implications not only for understanding human behavior, but for changing it for better outcomes. People have a strongly conditioned preference for following social norms, but that also means that manipulating their expectations can cause major behavioral changes. Bicchieri has been working recently with UNICEF and other NGO's to explore the applicability of her views to issues of human rights around the world. Is it possible to change social expectations around forced marriage, genital mutilations, and public health practices like vaccinations and sanitation? If so, how? What tools might we use? This short book explores how social norms work, and how changing them - changing preferences, beliefs, and especially social expectations - can potentially improve lives all around the world. Cristina Lafont draws upon Hilary Putnam's work in particular to criticize the linguistic idealism and relativism of the German tradition, which she traces back to the assumption that meaning determines reference.

This book articulates a participatory conception of deliberative democracy that takes the democratic ideal of self-government seriously. It aims to improve citizens' democratic control and vindicate the value of citizens' participation against conceptions that threaten to undermine it. The book critically analyzes deep pluralist, epistocratic, and lottocratic conceptions of democracy. Their defenders propose various institutional ''shortcuts'' to help solve problems of democratic governance such as overcoming disagreements, citizens' political ignorance, or poor-quality deliberation. However, all these shortcut proposals require citizens to (...) blindly defer to actors over whose decisions they cannot exercise control. Implementing such proposals would therefore undermine democracy. Moreover, it seems naive to assume that a community can reach better outcomes 'faster' if it bypasses the beliefs and attitudes of its citizens. Unfortunately, there are no 'shortcuts' to make a community better than its members. The only road to better outcomes is the long, participatory road that is taken when citizens forge a collective will by changing one another's hearts and minds. However difficult the process of justifying political decisions to one another may be, skipping it cannot get us any closer to the democratic ideal. Starting from this conviction, the book defends a conception of democracy ''without shortcuts''. This conception sheds new light on long-standing debates about the proper scope of public reason, the role of religion in politics, and the democratic legitimacy of judicial review. It also proposes new ways to unleash the democratic potential of institutional innovations such as deliberative minipublics. (shrink)

Jerry Fodor’s arguments against the possibility of concept learning, and the responses that have been offered in defense of the coherence of concept learning, have both by and large assumed that concept learning is a descriptive process. I offer an alternative, ostensive approach to concept learning and explain how descriptive concept learning can be explained as a version of ostensive concept learning. I argue that an ostensive view of concept learning offers an empirically plausible and philosophically adequate account of concept (...) learning that is explanatorily superior to traditional descriptive views. ResumoEste ensaio examina a sobrevida textual de uma cabeça — a de Antônio Vicente Mendes Maciel, o Antônio Conselheiro (1830-1897), a partir de sua morte na Guerra de Canudos (1896-1897). Traçam-se as figurações do crânio de Conselheiro na imprensa brasileira do fim do século XIX e nos trabalhos do médico legista Raimundo Nina Rodrigues e do engenheiro e escritor Euclides da Cunha. Embora ambos esperassem que o crânio de Conselheiro apresentasse evidências físicas de degeneração racial, as observações craniométricas de Nina (...) Rodrigues revelaram um crânio normal. Argumenta-se que esse fracasso da aproximação materialista à psique humana deu proeminência a explicações sociológicas para o fenômeno de Canudos, além de levantar questões sobre visibilidade, raça e racismo científico na virada do século XX e no mundo contemporâneo.Palavras-chave: Raça. AbstractThis essay examines the textual afterlife of a head—that of Antônio Vicente Mendes Maciel (Antônio Conselheiro [1830-1897]), after his death in the Canudos War (1896-1897). It traces figurations of Conselheiro’s skull in the late nineteenth-century Brazilian press and in the works of Raimundo Nina Rodrigues and Euclides da Cunha. Although these two social scientists expected Conselheiro’s skull to display physical evidence of racial degeneration, Nina Rodrigues’s craniometric measurements and observations revealed a perfectly normal skull. It is argued that this failure of a materialist approach to the human psyche allowed a stronger reliance on sociological explanations for the Canudos phenomenon that opens up questions on scientific racism and the visibility of race in the turn of the twentieth century and in contemporary times.Keywords: Race. Spoken communication between social robotic devices, powered by generative AI tools such as ChatGPT, and the senior population offers great potential for researching social interaction and robot identity perceptions as well as exploring the potential opportunities and challenges when implementing this human-machine interactions in real life situations and health care. In this paper we explore people’s perceptions of the social robot Furhat when administering verbal tasks similar to those used in screening for Alzheimer’s disease. We describe the Slovak system mounted (...) on the robot that includes a speech recognizer, the scenarios powered by generative large language model ChatGPT, and a speech synthesizer. We tested the functionality of the proposed approach with two groups of participants: attendees of a large science fair and a scientific conference. The observations from 87 collected questionnaires suggest good potential and applicability of such an approach for the given task and more positive attitudes of older subjects compared to younger ones. Under the influence of the mysterious Ammonius Saccas, Plotinus conceived a desire to learn Persian and Indian philosophy firsthand. This led him to a romantic participation in the emperor Gordian's ill-fated Persian expedition. He managed to escape to Antioch and two years later began teaching in Rome.1 It is unlikely he was vouchsafed any contact with Hinduism or Buddhism,2 but the parallels between his thought and especially Buddhist philosophy are striking. Developments in professional practice can be related to ongoing changes in relations of power among professionals, which often lead to changes in the boundaries of practices. The differing contexts of practices also influence these changing relations among health professionals. Legislation governing professional practice also differs from country to country. In Brazil, over the past 12 years, in a climate of deep disagreement, a new law to regulate medical practice has been discussed. It was sanctioned, or made into law, but with (...) some notable changes, in July 2013. Of interest to us in this paper are the ways the proposed legislation, by setting out the boundaries and scope of medical practice, ‘interfered’ in the practices of other health professions, undermining many ‘independent’ practices that have developed over time. However, even taking into account the multiple routes through which practices are established and developed, the role of legislation that seems able to contradict and deny the historical realities of multiple, intersecting practices should be critically interrogated. In this paper, we use the theoretical resources of poststructuralist thinking to explore gaps, ambiguities, and power relations implicit in the discourses that constituted this law. We argue that although the new law can be understood as a social and political device that will interfere in the organization of other health professions’ practices, such legislation is only part of what constitutes change in a consolidated professional practice. And while it is important to understand the effects of such legislation, healthcare practices are also realized or ‘made real’ through ongoing relations of knowledge and power, including, as we will see in this case, activities of resistance. The problem, then, is to understand the practical arrangements, including legislation, traditions and routines, values and knowledge that come to shape the practices of nursing in a particular context. There is widespread disagreement about whether epistemic akrasia is possible. This paper argues that the possibility of epistemic akrasia follows from a traditional rationalist conception of epistemic critical reasoning, together with considerations about the fallibility of our capacities for reasoning. In addition to defending the view that epistemic akrasia is possible, we aim to shed light on why it is possible. By focusing on critical epistemic reasoning, we show how traditional rationalist assumptions about our core cognitive capacities help to explain (...) the possibility of epistemic akrasia. (shrink)
