Levins and Lewontin have contributed significantly to our philosophical understanding of the structures, processes, and purposes of biological mathematical theorizing and modeling. Here I explore their separate and joint pleas to avoid making abstract and ideal scientific models ontologically independent by confusing or conflating our scientific models and the world. I differentiate two views of theorizing and modeling, orthodox and dialectical, in order to examine Levins and Lewontin’s, among others, advocacy of the latter view. I compare the positions of (...) these two views with respect to four points regarding ontological assumptions: (1) the origin of ontological assumptions, (2) the relation of such assumptions to the formal models of the same theory, (3) their use in integrating and negotiating different formal models of distinct theories, and (4) their employment in explanatory activity. Dialectical is here used in both its Hegelian–Marxist sense of opposition and tension between alternative positions and in its Platonic sense of dialogue between advocates of distinct theories. I investigate three case studies, from Levins and Lewontin as well as from a recent paper of mine, that show the relevance and power of the dialectical understanding of theorizing and modeling. Three negative affective dispositions—anger, anxiety, and depression—are hypothesized to increase physical disease risk and have been the subject of epidemiological studies. However, the overlap among the major negative affective dispositions, and the superordinate construct of trait negative affectivity are only beginning to be tested. Presented here is a narrative review of recent prospective studies that simultaneously tested anger, anxiety, depression, and trait NA as risk factors for cardiac outcomes. Anxiety and depression emerged as independent risk factors for premature heart (...) disease in population studies of persons nominally healthy at baseline, and for recurrence/mortality among patients with existing heart disease. There is an old but powerful argument for the claim that exhaustive divine foreknowledge is incompatible with the freedom to do otherwise. A crucial ingredient in this argument is the principle of the “Fixity of the Past”. A seemingly new response to this argument has emerged, the so-called “dependence response,” which involves, among other things, abandoning FP for an alternative principle, the principle of the “Fixity of the Independent”. There is currently no consensus regarding what measures are most valid to demonstrate perceptual processing without awareness. Likewise, whether conscious perception and unconscious processing rely on independent mechanisms or lie on a continuum remains a matter of debate. Here, we addressed these issues by comparing the time courses of subjective reports, objective discrimination performance and response priming during meta-contrast masking, under similar attentional demands. We found these to be strikingly similar, suggesting that conscious perception and unconscious processing cannot be (...) dissociated by their time course. Our results also demonstrate that unconscious processing, indexed by response priming, occurs, and that objective discrimination performance indexes the same conscious processes as subjective visibility reports. Finally, our results underscore the role of attention by showing that how much attention the stimulus receives relative to the mask, rather than whether processing is measured by conscious discrimination or by priming, determines the time course of meta-contrast masking. This paper presents the development and validation of a new scale to measure consequentialism and formalism that is well grounded in prior research. The Ethical Standards of Judgement Questionnaire is validated via six studies. The fourth study addresses discriminant validity and the two remaining studies provide insight into how consequentialism and formalism predict the degree to which behaviors are deemed acceptable by individuals in the context of consumer beliefs and religious beliefs. I argue that our general disposition to make moral judgments and our core moral intuitions are likely the product of social selection—a kind of gene–culture coevolution driven by the enforcement of collectively agreed-upon rules. Social selection could potentially track mind-independent moral truth by a process that I term realist social selection: our ancestors could have acquired moral knowledge via reason and enforced rules based on that knowledge, thereby creating selection pressures that drove the evolution of our moral psychology. Given (...) anthropological evidence that early humans designed rules with the conscious aim of preserving individual autonomy and advancing their collective interests, the theory of realist social selection appears to be attractive for moral realists. The goal of evolutionary debunking arguments should be to show not that our moral beliefs are the product of natural selection, but that realist social selection did not occur. (shrink)

Using an international sample of firms from 32 countries, we study the relation between media independence and corporate tax aggressiveness. We measure media independence by the extent of private ownership and competition in the media industry. Using an indicator variable for tax aggressiveness when the firm’s corporate tax avoidance measure is within the top quartile of each country-industry combination, we find strong evidence that media independence is associated with a lower likelihood of tax aggressiveness, after controlling for other institutional determinants, (...) including home-country tax system characteristics. We also find that the effect of media independence is more pronounced when the legal environment is weaker, and when the information environment is less transparent. We contribute to the business ethics literature by documenting the role of independent media as an external monitoring mechanism in constraining corporate tax aggressiveness. (shrink)

In China, Xiong Shili 熊十力 is typically regarded as one of the most important Chinese philosophers of the twentieth century. The focus of this paper is Xiong’s monistic ontology and draws its findings principally from the 1932 literary edition of his New Treatise on Nothing but Consciousness. Xiong’s New Treatise is the first substantive attempt to respond to the modernist challenge of providing Chinese philosophy with ‘system,’ and he did this in the form of an ontology. The New Treatise consists (...) of an interpretive summary and discussion of key Yogācāra teachings that feature in Cheng weishi lun; a sustained critique of views Xiong attributes to the sixth-century Yogācāra master Dharmapāla; and a synthesis of Yogācāra thought with ideas derived from Madhyamaka Buddhism, various Sinitic traditions of Buddhism, the Book of Change, Laozi and Zhuangzi, and from Chinese Neo-Confucian thinkers associated with the Lu-Wang wing of Neo-Confucian philosophy, as well as Zhu Xi. Xiong was very much a syncretist. I seek to explain why Xiong insisted that reality cannot be sought independent of phenomena despite his also claiming that phenomena are not real. The first and major part of the paper introduces Xiong’s critique of Yogācāra accounts of consciousness. The second part introduces his understanding of the doctrine of emptiness. I also trace the connection between Xiong’s understanding and how the concept of emptiness was understood in Tathāgatagarbha school of Sinitic Buddhism. I do not address the Confucian elements in his thought—the Buddhist elements are complex enough. (shrink)

John Trenchard's and Thomas Gordon's ‘Cato’ has generally been seen by historians as the embodiment of neo-Harringtonianism and the polar opposite of Bernard Mandeville's thought. This paper addresses that misreading and places Trenchard and Gordon within a tradition of liberal republican political thought, rather than a civic humanist or neo-roman tradition. It examines the relationship between the political, philosophical and religious beliefs of Trenchard and Gordon and those of Mandeville, arguing that they shared a common framework with respect to the (...) problems of politics. The paper argues that an ethical firm has cause to realize and to respect, in good faith, the decision of workers regarding labor unions, and proceeds along the following lines. First, the employer is due appropriate deference the bounds of which should be determined in conjunction with employees, as they are the most closely affected party. Second, employee preferences for defining the employment relation and appropriate deference are best reflected through autonomous voice. Third, autonomous voice is assured by the right (...) to free association and generally achieved through labor unions. Fourth, because employment is so important to a dignified existence, an economically just system of employment requires respect for workers’ choice regarding labor unions. And fifth, there are concerns and contradictions that arise from labor union operations, but they do not justify impeding a morally valid prerogative. (shrink)

The debate about a new geological epoch ‘The Anthropocene’ has helped spawn ‘Age of Man Environmentalism’ (AME). According to AME, humans’ planetary impact indicates that respect for independent nature can no longer serve as a guiding value for environmentalism. Traditional goals of nature preservation and restoration are grounded in the illusory ideal of pristine nature. Humans are now fully integrated into nature and must become responsible managers of an earth we have created, governing it by our ideals. This essay (...) repudiates AME, defending traditional environmental values of naturalness and respect for nature’s autonomy. AME’s exaggeration of human influence over Earth manifests an anthropocentric narcissism blind to nature’s ongoing agency. Rather than becoming gods or parents of a nature that allegedly needs us, human flourishing requires we strengthen our commitment to humility, restraint, and respect for nature’s gifted character. Naturalness becomes increasingly valuable the rarer it becomes, even in highly humanized areas. AME’s thoroughly managed future ignores the possibility of rewilding and turning nature loose. Its promotion of non-native species and ‘novel ecosystems’ attempts to polish the image of human-impacted nature and denigrates preserved wild areas. Taking seriously humans’ massive impact on earth does not require abandoning traditional environmental values. (shrink)

The centennial of Dewey & Tuft’s Ethics (1908) provides a timely opportunity to reflect both on Dewey’s intellectual debt to utilitarian thought, and on his critique of it. In this paper I examine Dewey’s assessment of utilitarianism, but also his developing view of the good (ends; consequences), the right (rules; obligations) and the virtuous (approbations; standards) as “three independent factors in morals.” This doctrine (found most clearly in the 2nd edition of 1932) as I argue in the last sections, (...) has significant forward-going implications for debates in ethics, insofar as it functions to deflate debates among ethicists that turns on claims about the conceptual primacy of any one of these three ethical concepts over the other two. To find what “permanent value each group contributes to the clarification and direction of reflective morality” was the task Dewey set for himself. But to carry that project through demands showing also why the application of considerations of ends, rules, and virtues to problems of practice is not quite as many self-described utilitarians, deontologists, and virtue ethicists conceive it. Short-term or working memory provides temporary storage of information in the brain after an experience and is associated with conscious awareness. Neurons sensitive to the multiple stimulus attributes comprising an experience are distributed within many brain regions. Such distributed cell assemblies, activated by an event, are the most plausible system to represent the WM of that event. Studies with a variety of imaging technologies have implicated widespread brain regions in the mediation of WM for different categories of information. Each kind (...) of WM may thus be expected to involve many brain regions rather than a local, uniquely dedicated set of cells. Neurons in a distributed “cell assembly” may be self-selected by their temporally coherent activations. The process by which this fragmented representation of the recent past is reassembled to accomplish essentially automatic and reliable recognition of a recurrent event constitutes an important problem. One plausible mechanism to achieve the identification of past with previous events would require that the representational system mediating WM must coexist in spatial extent and somehow overlap in temporal activation with cell ensembles registering input from subsequent events. The detection of such a postulated mechanism required an experimental approach which would focus upon spatial patterns of coherent activation while information about different events was stored in WM and retrieved, rather than focusing upon the temporal sequences of activation in localized regions of interest. For this purpose, the familiar delayed matching from sample task was modified. A series of information-free flashes, or “noncontingent probes,” was presented before an initial series of visual information items, the Priming Sample, which were to be held in WM during a Delay Period. A second series of visual information items were then presented, the Matching Sample. The task required detection of any item in the second series which had beenabsentfrom the initial series. Thirty such trials with a particular category of visual information constituted a single task. Several DMS tasks with this standardized design, but with different categories of visual information, were presented within each test session. The information categories included letters of the alphabet, single digit numbers, or faces from a school yearbook. Event-related potentials , were computed from 21 standardized electrode placements, separately for information-free probes and for information items in each interval of the trials within a task. Because each electrode is particularly sensitive to coherent activation of neurons in the immediately underlying brain regions, topographic maps were constructed and interpolated across the surface of the scalp. The momentary fluctuations of the resulting voltage “landscapes” throughout the task were then subjected to quantitative analysis. Distinctive landscapes sometimes persisted for prolonged periods, implying sustained engagement of very large populations of neurons. “Difference landscapes” were constructed by subtraction of topographic maps evoked by noncontingent probes during the Delay Period from maps of probe ERPs before the presentation of the initial information in the Priming Sample. Such probe difference landscapes displayed recurrent high similarity to momentary landscapes elicited during subsequent presentation of the information items in the Matching Sample. It seemed as if the distributed cell assembly continuously engaged by mediation of WM of the diverse attributes of the initial stimuli was being dynamically compared to the ensembles engaged by registration of the subsequent stimuli. Spatial Principal Component Analysis was applied to the sequences of momentary voltage landscapes observed throughout trials of each task. This method sought a small number of spatial patterns with which these large sets of inhomogeneous spatial distributions of voltage could be reconstructed. This is the spatial analog of the reconstruction of local ERPs by temporal principal components, as often described previously. Five Spatial Principal Components were found which accounted for about 90% of the total variance of voltage across the surface of the scalp throughout every task. Theloadings,or distinguishing topographic features, of these SPCs, were highly similar during every cognitive task for every subject. However,factor scores,or relative average contribution to the overall voltage distributions, of the different SPCs varied substantially among subjects between the tasks and momentarily within successive intervals of each task. These five SPCs may reflect coherent activation of huge distributed ensembles of neurons which comprise independent but interacting functional brain subsystems. These subsystems may correspond to basic resources available to individuals for allocation to mediate conscious evaluation of information during cognitive activity, providing a filter to bind together fractionated representations of the past to evaluate the present. The problem of epistemic bootstrapping requires explaining, in a principled manner, why a subject who engages in bootstrapping fails to know the conclusion of her reasoning. Existing proposed solutions to the problem provide unsatisfactory explanations regarding the bootstrapper's ignorance. This paper puts forward a novel solution and argues that it satisfactorily explains the ignorance of the bootstrapper, while avoiding the difficulties that other proposals face. Section 1 explains what epistemic bootstrapping is, defines the problem it poses for a theory of (...) knowledge, and outlines the basic desiderata demanded of any acceptable solution to the problem. Section 2 explicates the proposal I defend throughout the rest of the paper. Here, I contend that the wrong−making feature of bootstrapping which ultimately explains the bootstrapper's ignorance is a failure to use an independent source in checking the accuracy of the reports of a given source. I call this explanation the “Independence proposal.” Section 2 also argues that the phenomenon of bootstrapping is broader than is usually assumed; there are cases of bootstrapping that do not fit the superficial structure of the prototypical cases discussed in the literature, and any good proposal should apply to these as well. Section 3 argues that the independence proposal does better than other current proposals in fulfilling the desiderata identified in Section 1. Intuitively, a speaker who uses slurs to refer to people is doing something morally objectionable even if no one is measurably affected by their speech. Perhaps they are only talking to themselves, or they are speaking with bigots who are already as vicious as they can be. This paper distinguishes between slurring as an expressive act and slurring as the act of causing a psychological effect. It then develops an expression-focused ethical account in order to explain the intuition that slurring (...) involves an effect-independent moral wrong. The core idea is that the act of expressing a morally defective attitude is itselfpro tantomorally objectionable. Unlike theories that focus only on problematic effects, this view is able to shift the moral burden of proof away from victims of slurring acts and onto speakers. It also offers moral guidance with respect to metalinguistic and pedagogical utterances of slurs. (shrink)

The use of artificial intelligence (AI) to aid legal decision making has become prominent. This paper investigates the use of AI in a critical issue in employment law, the determination of a worker’s status—employee vs. independent contractor—in two common law countries (the U.S. and Canada). This legal question has been a contentious labor issue insofar as independent contractors are not eligible for the same benefits as employees. It has become an important societal issue due to the ubiquity of (...) the gig economy and the recent disruptions in employment arrangements. To address this problem, we collected, annotated, and structured the data for all Canadian and Californian court cases related to this legal question between 2002 and 2021, resulting in 538 Canadian cases and 217 U.S. cases. In contrast to legal literature focusing on complex and correlated characteristics of the employment relationship, our statistical analyses of the data show very strong correlations between the worker’s status and a small subset of quantifiable characteristics of the employment relationship. In fact, despite the variety of situations in the case law, we show that simple, off-the-shelf AI models classify the cases with an out-of-sample accuracy of more than 90%. Interestingly, the analysis of misclassified cases reveals consistent misclassification patterns by most algorithms. Legal analyses of these cases led us to identify how equity is ensured by judges in ambiguous situations. Finally, our findings have practical implications for access to legal advice and justice. We deployed our AI model via the open-access platform, https://MyOpenCourt.org/, to help users answer employment legal questions. This platform has already assisted many Canadian users, and we hope it will help democratize access to legal advice to large crowds. (shrink)

David Enoch has recently proposed that the deliberative indispensability of irreducibly normative facts suffices to support their inclusion in our ontology, even if they are not necessary for the explanation of any observable phenomena. He challenges dissenters to point to a relevant asymmetry between explanation and deliberation that shows why explanatory indispensability, but not deliberative indispensability, is a legitimate guide to ontology. In this paper, I aim to do just that. Given that an entity figures in the actual explanation of (...) some phenomenon, it is not an open question whether that entity exists. Thus, if you can manage to find actual explanations, you can find answers to ontological questions. In contrast, even if some entity is indispensable to deliberation, it still might not exist. For example, even if some form of libertarian free will is deliberatively indispensable, we still might not have libertarian free will. So even if you manage to discover the indispensable commitments of deliberation, there is still more work to do to get to the bottom of things. That additional work is explanatory work, and so deliberative indispensability is not an independent guide to what there is. (shrink)

We prove an institutional version of A. Robinson ’s Consistency Theorem. This result is then appliedto the institution of many-sorted first-order predicate logic and to two of its variations, infinitary and partial, obtaining very general syntactic criteria sufficient for a signature square in order to satisfy the Robinson consistency and Craig interpolation properties.

This paper reports the findings of a study comparing the public examination results at GCE advanced and advanced supplementary levels of pupils with assisted places in the independent sector and pupils in the state sector of similar ability. The examination entries and results of pupils with APs were compared with those of pupils who had gained an AP at the same school but had not attended that school; they had, instead, taken their A levels in the state sector. After (...) controlling for ability it was found that the AP pupils achieved a significantly higher total point score in their A/AS levels than the pupils in the state sector and that the average point score per examination entry was higher for AP than state pupils. The results suggest that there is an advantage in taking up an AP but the possibility cannot be ruled out that the advantage for AP pupils arises from factors other than their education in the independent sector. The 'fitting-attitudes analysis' aims to analyze evaluative concepts in terms of attitudes, but suffers from the 'wrong kind of reasons' problem. This article critiques some suggested solutions to the WKR problem and offers one of its own, which appeals to the aims of attitudes. However, goodness is not a concept that can be successfully analyzed according to the method suggested here. Reasons are given why goodness should be thought of, instead, as a mind-independent property.

As evaluation of practitioners’ competence is largely based on self-report, accuracy in practitioners’ self-assessment is essential for ensuring high quality treatment-delivery. The aim of this study was to assess the relationship between independent observers’ ratings and practitioners’ self-reported treatment integrity ratings of Motivational interviewing. Practitioners were randomized to two types of supervision [i.e., regular institutional group supervision, or individual telephone supervision based on the MI Treatment Integrity code]. The mean age was 43.2 years, and 62.7 percent were females. All (...) sessions were recorded and evaluated with the MITI, and the MI skills were self-assessed with a questionnaire over a period of 12 months. The associations between self-reported and objectively assessed MI skills were overall weak, but increased slightly from baseline to the 12-months assessment. However, the self-ratings from the group that received monthly objective feedback were not more accurate than those participating in regular group supervision. These results expand findings from previous studies and have important implications for assessment of practitioners’ treatment fidelity: Practitioners may learn to improve the accuracy of self-assessment of competence, but to ensure that patients receive intended care, adherence and competence should be assessed objectively. This cross-sectional study, which included men aged 20–40 years, aimed to determine the relationships among type D personality, depressive symptoms and lower urinary tract symptoms in young men. An internet-based questionnaire was administered, and General demographics, International Prostate Symptom Scores, Type D Scale-14 scores, and Depression and Somatic Symptom Scale scores were analyzed. A total of 3,127 men were included; of these, 762 reported moderate/severe lower urinary tract symptoms, and 1,565 met the criteria for type D personality. Men with type (...) D personality had significantly higher body mass index and total and sub-scores for the International Prostate Symptom Score and Depression and Somatic Symptom Scale. Furthermore, the type D personality group had a higher prevalence of lower urinary tract symptoms, particularly voiding symptoms. Univariate analysis revealed that all parameters, except for body mass index, were significant predictors of moderate/severe lower urinary tract symptoms. Multivariate analysis showed that age >30 years, type D personality, and depressive and somatic Depression and Somatic Symptom Scale sub-scores were independent predictors of moderate/severe lower urinary tract symptoms. Regarding Type D Scale-14 subscales, social inhibition, rather than negative affectivity, impacted moderate/severe lower urinary tract symptoms. Mediation analysis revealed that depressive symptoms mediated the relationship between type D personality and lower urinary tract symptoms. This study established correlations between type D personality, depressive symptoms, and lower urinary tract symptoms. As previous studies suggested that patients with type D personality are less likely to consult and adhere to treatment, and are at higher risk for depression, urologists should therefore actively recognize patients with TDP.
